Mariappan, Customs Broker, M/s. BSM Logistics, Shri. Deepak Siroya of M/s. Siroya Jewellers, Shri Santosh Kothari of M/s. Kalyan Jewellery, Shri Sunil Parmar of M/s. Sunil Jewellery, Shri Sunil Sharma of M/s. Balaji Jewellers and other unknown officials of Customs Department for the offences under section 120-B read with section 420 of the Indian Penal Code, 1860 (Central Act XLV of 1860) and section 7 of the Prevention of Corruption Act, 1988 (Central Act 49 of 1988) (as amended in 2018).

WHEREAS, complaints have been received from a number of depositors that Messrs Farmmer Eemu Private Limited, Tirunelveli District, a financial establishment, has defaulted the return of deposits made by the depositors after maturity;

AND WHEREAS, the Government are satisfied that the said financial establishment is not likely to return the deposits to the depositors and hence, the Government have to protect the interests of such depositors;

(D) No. 816, Home (Police - XIX), 30th June 2025, ஆனி 16, விசுவாவசு, திருவள்ளுவர் ஆண்டு-2056.] No.II(2)/HO/658/2025.—In exercise of the powers conferred by section 3 of the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997 (Tamil Nadu Act 44 of 1997), the Governor of Tamil Nadu hereby raises the attachment in respect of ¾ share (½ share belongs to the legal heirs of Late R.Ganesan and ¼ share belongs to Thiru.P.Kumaresan) in the immovable property, made in G.O.(Ms.) No.891, AND WHEREAS, since, no other movable and immovable properties that are procured from and out of the deposits collected from the depositors through the financial establishment are available for attachment and to repay the deposits to the depositors, the Government consider that the immovable property of Thiru.A.Rajesh, one of the borrowers of the said financial establishment, as specified in the Schedule to this Order is fit to be attached under section 3 of the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997 (Tamil Nadu Act 44 of 1997).

NOW, THEREFORE, in exercise of the powers conferred by section 3 of the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997 (Tamil Nadu Act 44 of 1997), the Governor of Tamil Nadu hereby makes an ad-interim order attaching the immovable property of Thiru.A.Rajesh, one of the borrowers of the defaulted financial establishment, namely, Messrs Farmmer Eemu Private Limited, functioned at Keelamuneerpallam, Ambai Road, Palayamkottai, Tirunelveli District, as specified in the Schedule to this Order and transfers the control over the said immovable500 TAMIL NADU GOVERNMENT GAZETTE [Part II—Sec. 2 property to the Competent Authority, namely, the Competent Authority and District Revenue Officer, Tirunelveli District appointed under the said Act.

3. The Special Public Prosecutor, Special Court for the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997, Madurai is requested to render necessary assistance to the Competent Authority and District Revenue Officer, Tirunelveli District in filing the application before the Special Court constituted under the said Act.

The Competent Authority and District Revenue Officer, Tirunelveli District is requested to pursue further action in accordance with the procedure laid down in sub-sections (3) and (4) of section 4 of the said Act and also the formalities prescribed in the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Rules, 1997.

யூனியன் (CITU) என்ற தொழிற்சங்கத்திற்குமிடையே தொழிற்தகராறு எழுந்துள்ளது என்று அரசு கருதுவதாலும்; மேற்சொன்ன தகராறை எழுவினாவுடன் உதகை தொழிலாளர் நீதிமன்றத்தின் தீர்விற்காக அனுப்புவது அவசியமென்று தமிழ்நாடு ஆளுநர் அவர்கள் கருதுவதாலும்; 1947-ஆம் ஆண்டு தொழிற்தகராறுகள் சட்டத்தின் (மத்திய சட்டம் XIV/1947) 10(1)(c) பிரிவிலும், 10(1(d) பிரிவின் வரம்பு நிபந்தனையிலும் வழங்கியுள்ள அதிகாரங்களைக் கொண்டு, இத்தகராறை கீழ்க்காணும் எழுவினாவுடன் உதகை தொழிலாளர் நீதிமன்றத்தின் தீர்விற்காக அனுப்பப்பட வேண்டும் என்று தமிழ்நாடு ஆளுநர் அவர்கள் இதனால் ஆணையிடுகிறார்.

தொழிலாளி திரு. அன்பு என்பவருக்கு நிர்வாகம் வழங்கிய Service Bookல் ஒரு தேதியும். சம்பள சீட்டில் வேறு ஒருதேதியும் குறிப்பிட்டு முரண்பாட்டை சரி செய்யாமல் 29.06.2019 அன்று முதல் பணிஓய்வு செய்தது சட்டவிரோதமானது என்றும், தொழிலாளியின் பிறப்பு சான்றிதழின் அடிப்படையில் பணிப்பதிவேட்டில் பிறந்த தேதியில் மாற்றம் செய்து பணிஓய்வினை இரத்து செய்து மீண்டும் வேலை மற்றும் வேலை மறுக்கப்பட்ட காலத்திற்கு முழு சம்பளம் மற்றும் அனைத்து வருகை பலன்களை வழங்க வேண்டுமென்ற தொழிற்சங்கத்தின் கோரிக்கை நியாயமானது தானா? ஆம் எனில் உரிய உத்தரவு பிறப்பிக்க.
