In exercise of the powers conferred by 2nd proviso of sub-section-7 of section-19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013,(Central Act-30 of 2013), as an appropriate Government conferred by the G.O.Ms.No.526 Revenue and Disaster Management Department, Land Administration wing- LA-1(1) Section, Dated.26.09.2020 hereby extend the time limit to the Notification issued in Tamil Nadu Government Gazette Extraordinary Notification No.45 Part VI—Section 1, Dated.29.01.2025 per sub section-1 of section-19.
TIME EXTENSION
As per G.O.Ms.No.526 Revenue and Disaster Management Department, Land Administration wing- LA-1(1) Section, Dated.26.09.2020, Tamil Nadu Government Gazette Extraordinary Notification No. 45 Part VI—Section 1, Dated.29.01.2025 has been issued in accordance with the provisions of sub-section-1 of section-19 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act-2013 (Central Act-30 of 2013), with regards to the acquisition of 5.10.07 Hectares Patta Land for Mettur Lift Irrigation Scheme (Filling up of 100 Dry Lakes in Sarabanga Basin by Surplus Flood Water from Mettur Dam by Lift Irrigation).
AND WHEREAS, The Land Acquisition Officer and Revenue Divisional Officer, Mettur and Sankari. reported that as the funds allocated for the Lift Irrigation Scheme (Filling up of 100 Dry Lakes in Sarabanga Basin by Surplus Flood Water from Mettur Dam by Lift Irrigation) have not been released it has not been possible to disburse due compensation to land owner who have consented to land acquisition through private negotiations, further, there has been a delay in passing final award in respect of landowners who have not consented to land acquisition and they above officers requested to 2 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY Now THEREFORE, Sanction is accorded to extend the time limit published in Tamil Nadu Government Gazette Extraordinary Notification No.45 Part VI—Section 1, Dated.29.01.2025 under section 19(1) declaration for the further period of 12 months from.29.01.2025 to 28.01.2026 with regards to the Acquisition of 1.79.18 hectares of patta land in Mettur Division and 3.30.89 hectares of patta land in Sankari Division of Salem District.

நிலம் கையகப்படுத்துதல், மறுவாழ்வு மற்றும் மீள்குடியேற்றத்தில் நியாயமான இழப்பீடு மற்றும் வெளிப்படைத்தன்மைக்கான உரிமை சட்டம்-2013, (மத்திய சட்டம்-30/2013) பிரிவு-19 இன் துணைப் பிரிவு-7 இன் 2-வது ஷரத்தின் மூலம் வழங்கப்பட்ட அதிகாரங்களை பயன்படுத்தி, அரசாணை நிலை எண்.526, வருவாய் மற்றும் பேரிடர் மேலாண்மைத் துறை, நிர்வாகப் பிரிவு [LA-1(1)] பிரிவு, நாள்.26.09.2020 -ன் படி, தமிழ்நாடு அரசிதழ்தமிழ்நாடு அரசிதழ் சிறப்பு அறிவிப்பு எண். 45 பகுதி-VI, பிரிவு-1-ல் 29.01.2025 அன்று வெளியிடப்பட்ட பிரிவு-19 இன் துணைப் பிரிவு-1 அறிவிப்பிற்கான கால வரம்பு இதன் மூலம் நீட்டிக்கப்படுகிறது.
கால நீட்டிப்பு
மேட்டூர் நீர் ஏற்றும் பாசனத் திட்டத்திற்காக (மேட்டூர் அணையின் மழைக்கால வெள்ள உபரிநீரை சரபங்கா வடிநிலத்தில் உள்ள வறண்ட ஏரிகளுக்கு நீர் ஏற்றும் திட்டம் மூலம் வறண்ட ஏரிகளுக்கு நீர் வழங்கும் திட்டம்) 5.10.07 ஹெக்டேர் பட்டா நிலத்தை கையகப்படுத்துவது தொடர்பாக அரசாணை நிலை எண்.526, வருவாய் மற்றும் பேரிடர் மேலாண்மைத் துறை, நிர்வாகப் பிரிவு [LA-1(1)] பிரிவு, நாள்.26.09.2020 இன் படி, தமிழ்நாடு அரசிதழ்தமிழ்நாடு அரசிதழ் சிறப்பு அறிவிப்பு எண். 45 பகுதி-VI, பிரிவு-1, 29.01.2025 அன்று நிலம் கையகப்படுத்துதல், மறுவாழ்வு மற்றும் மீள்குடியேற்றத்தில் நியாயமான இழப்பீடு மற்றும் வெளிப்படைத்தன்மைக்கான உரிமைச் சட்டம்-2013 (மத்திய சட்டம்-30/2013) பிரிவு-19 இன் துணைப் பிரிவு-1 வெளியிடப்பட்டது.
மேலும், மேட்டூர் மற்றும் சங்ககிரி, நில எடுப்பு அலுவலர் மற்றும் வருவாய் கோட்டாட்சியர்கள், மேட்டூர் அணையிலிருந்து உபரி வெள்ள நீரைப் பயன்படுத்தி சரபங்கா படுகையில் உள்ள 100 வறண்ட ஏரிகளை நிரப்புதல் என்ற நீர் ஏற்றும் பாசனத் திட்டத்திற்காக ஒதுக்கப்பட்ட நிதி வழங்கப்படாததால், தனியார் பேச்சுவார்த்தைகள் மூலம் நிலம் கையகப்படுத்துவதற்கு சம்மதித்த நில உரிமையாளர்களுக்கு உரிய இழப்பீடு வழங்க முடியவில்லை என்றும், மேலும், நிலம் கையகப்படுத்துவதற்கு சம்மதிக்காத நில உரிமையாளர்களுக்கு இறுதித் தீர்வம் பிறப்பிப்பதில் தாமதம் ஏற்பட்டுள்ளதால், பிரிவு-19 இன் துணைப் பிரிவு-1 இன் படி, தேதி 29.01.2025 அன்று தமிழ்நாடு சிறப்பு அரசிதழ்தமிழ்நாடு சிறப்பு அரசிதழ் அறிவிப்பு எண்.45 பகுதி-VI, பிரிவு-1 இல் வெளியிடப்பட்ட அறிவிப்பின் கால வரம்பை நீட்டிக்க வேண்டும் என கோரியுள்ளனர்.
எனவே, சேலம் மாவட்டம், மேட்டூர் கோட்டத்தில் 1.79.18 ஹெக்டேர் பட்டா நிலங்களையும், சங்ககிரி கோட்டத்தில் 3.30.89 ஹெக்டேர் பட்டா நிலங்களையும் கையகப்படுத்துவதற்கு, பிரிவு 19(1) அறிவிப்பின் கீழ் வெளியிடப்பட்ட கால வரம்பை 29.01.2025 முதல் 28.01.2026 வரை மேலும் 12 மாதங்களுக்கு நீட்டிக்க அனுமதி வழங்கப்படுகிறது.
