Proc.No. Cl/12/2017,- In the reference 1st cited the Managing Trustee of Sri Purender Memorial Charitable Trust, Mahabhoolpal Manzil, Jambagh, Hyderabad filed a representation before the Hon'ble Minister for Endowments with a request to accord permission to sell 900 Sq.Yds of land with old building covered by compound wall pertaining to the subject trust in public auction to keep the amount so derived in Fixed Deposit and to utilize 2/3rd interest amount for maintenance of the Trust as per the aims and objects of the Trust.

In this regard the Assistant Commissioner, Hyderabad submitted report vide reference 3rd cited stating that Sri Purender Memorial Charitable Trust situated at Mahabhoolpal Manzil, Jambagh, Hyderabad is published U/s 6 (c) (i) and registered u/s 38 of the A.P. Charitable and Hindu Religious Institutions and Endowments Act 17/1966. The Trust is having landed property to an extent of 4-36 Acs at Gaganmahal, Hyderabad and a old building at Jambagh, Hyderabad on an extent of 900 Sq.Yds.

The Assistant Commissioner further submitted that the trustees have passed resolution to sell 900 Sq.Yards of land with old building situated at Mahabhoopal Manzil, Jambagh, Hyderabad through public auction under the supervision of the Departmental Officer, since it has been kept vacant as it is in dilapidated condition and no income is being derived from the aforesaid property.

By narrating the aforesaid facts the Assistant Commissioner, Hyderabad recommended to accord permission to sell 900 Sq.Yds of land with old building pertaining to the subject trust situated at Jambagh, Hyderabad through Tender - Cum-Public auction under the supervision of the Departmental Officer.

In the reference 5th cited the Special Grade Deputy Collector, Land Protection Cell conducted joint inspection along with the Assistant Commissioner, Hyderabad and submitted the enquiry report as under along with the photographs of the property proposed to sell with a recommendation to accord permission to sell the property.

(I) The aforesaid trust is having 900 Sq.Yds of land situated at Jambagh with municipal No. 4-7-677 to 684 and an extent 4-36 Acs situated at Gaganmahal, Domalguda, Hyderabad. Out of 4-36 Acs land situated at Gaganmahal, Domalguda, Hyderabad an extent of 2-20 Acs of land has been leased out to Chaitanya Memorial Educational Societies on monthly rent of Rs. 30,000/- for a period of 03) years vide Commissioner, Endowments Proceeding in D.Dis. No. C3/13584/2014, Dt: 26-05-2014 and the balance land is covered with Compound Wall and Samadhies of the ancestors of the Managing Trustee of Subject Trust.

(II) The Market value of the proposed site for sale at Jambagh is Rs. 30,000/- per Sq.Yds as per the Sub - Registrar of Nampally. Accordingly the sale may be fetch minimum of Rs. 2,70,00,000/- and there is likely possibility of fetching around 3.50 Crores to 4.00 Crores in the Public Auction.

The Government in the reference 7th cited accorded permission to auction 900 Sq.Yds old building belonging to the Trust under the supervision of Departmental officer as per the rules and to keep the sale proceedings in the fixed deposits.

Accordingly vide reference 8th cited under the provisions of Sec. 80 (I) (b) of the Telangana State Charitable and Hindu Religious Institutions Act 30/1987 a notice has been issued inviting objections and suggestions if any within (30) days from the date of publication. The said notice has been affixed on the front door of Trust, Municipal Office and at other conspicuous places and published in the Telangana Gazette No. 176 Dt: 20.12.2017, and also published in Daily News paper Namasthe Telangana Dt: 23-12-2017.

The Managing Trustee and Assistant Commissioner, Hyderabad submitted that no objections and suggestions have been received in this matter, within stipulated period.

In view of the circumstances cited above sanction is hereby accorded U/s 80 (1) (b) of Act 30/87 for sale of 900 Sq.Yds of land with old building situated at Mahabhoolpal Manzil, Jambagh through public auction duly fixing the upset price as Rs. 60,000/- (Rupees Sixty Thousand only) per Sq.Yd. under the supervision of the Deputy Commissioner, Endowments Department, Hyderabad .

The following conditions should be complied in the matter.

(l) That the sale conditions duly approved should be adopted as required under Rule - 8 of the rules framed U/s 80 (I) of the Act 30/1987.

(2) That the sale is subject to the confirmation of the Commissioner.

(3) That the sale proceeds should be invested in scheduled or Nationalized Bank in interest yielding deposits in the Joint Account of the Executive Authority and the Commissioner, Endowments Department, Hyderabad.

(4) That the sale deed should be executed at the expenses of the purchaser or purchasers.

(5) That the sale proceeds should not be utilized for day to day administration and no loan should be raised on the sale proceeds.

(6) Auction notice shall be published in the leading telugu Daily news paper.

(7) The provision of Sec. 80 (5) of the Act 30/1987 should be followed.

Any person having interest may, within ninety days from the date of publication of this order, prefer an appeal to the Government, to modify the order or set it aside.
