REVISION OF MINIMUM RATES OF WAGES IN THE EMPLOYMENT IN "SPINNING MILLS" IN PART-I OF THE SCHEDULE TO THE MINIMUM WAGES ACT, 1948.

PRELIMINARY NOTIFICATION

In exercise of the powers conferred by sub-section (l) of Section 3 and sub-section (2) of Section 5 of the Minimum Wages Act, 1948 (Act 11 of 1948), the following revision of minimum rates of wages as specified in column (3) of the Schedule appended to this notification as payable to the each category employees specified in the corresponding entry column (2) thereof and employed in the employment in "Spinning Mills" included in Part-I of the Schedule to the Minimum Wages Act, 1948 (Act 11 of 1948) which is proposed to make is hereby published for information of all the persons likely to be affected thereby as required under clause (b) of sub-section (1) of Section 5 of the said Act.

Notice is hereby given that any objections or suggestions, in respect of the wages as proposed in the Schedule, which may be received within the period of two months from the date of publication of this notification in the Telangana Gazette, will be considered by the Government of Telangana.

Objections or suggestions should be addressed to the Principal Secretary to Government, Labour, Employment, Training and Factories Department, Government of Telangana through the Commissioner of Labour, Telangana, Hyderabad.

COST OF LIVING ALLOWANCE

The minimum basic rates of wages fixed are linked to the Consumer Price Index Numbers for the Industrial workers at 1317 points (Base Year 1982=100 series). The Commissioner of Labour shall notify the Cost of Living Allowance for every six months i.e. 1st April and 1st October. For this purpose, the average rise in the State Industrial Workers Consumer Price Index numbers for half year ending December and June respectively shall be taken into account. The details of calculation of Cost of Living Allowance for any rise in cost of Price Index over and above 1317 points are specified at Col.No.4 against each category in schedule.

NOTE:-

1. If any categories employees in this employment are left out they should not be paid less than the minimum rates of wages fixed in the category of the workers, being the same and similar category of work in this employment.

2. Where piece rate workers are employed, the remuneration paid to each of them for a normal working day shall not be less than the minimum wage fixed for a general worker being similar work, calculated on the basis of 8 hours a day.

3. To arrive at a daily rate, the monthly rate shall be divided by 26, which includes the rest day wages.

4. Where the nature of work is the same, no discrimination on payment of minimum rates of wages should be made in respect of male and female workers.

5. Where any category of employee is actually in receipt of higher rate of wages than those specified above shall continue to be paid such higher wages.

6. If any category of employee is paid other allowances (i.e., other than the notified basic wage) they shall continue to get the said allowances in addition to notified basic wage.

1948, కనీస వేతనాల చట్టం (1948 లోని ¹¹ వ చట్టం) లోని 3వ విభాగపు (1)వ ఉప విభాగం, 5వ విభాగపు (2) వ ఉప విభాగం ద్వారా లభ్యమయిన అధికారాలను పురష్కరించుకొని ప్రతిపాదించిన 1948, కనీస వేతనాల చట్టం (1948 లోని 11 వ కేంద్ర చట్టం) లో గల అనుసూచికి 1వ భాగంలో ªªస్పిన్నింగ్ మిల్స్µµ లోని ఉద్యోగాలలో నియమితులైన వారికి సంబంధించి (2)వ గడిలో తదనుసార నమోదులో నిర్ధిష్ట పరిచిన ప్రతి కేటగిరి ఉద్యోగులకు చెల్లించదగు ఈ ప్రకటనకు అనుబంధంగా ఉన్న అనుసూచిలోని (3)వ గడిలో పేర్కొన్నట్లుగా ఈ క్రింద పేర్కొన్న కనీస వేతనాల రేట్ల సవరణను, సదరు చట్టంలోని 5వ విభాగపు (1) వ ఉప విభాగం (బి) ఖండం క్రింద కోరిన విధంగా వర్తింపు అయ్యే వ్యక్తులందరి సమాచారం కోసం ఇందుమూలంగా ప్రచురించడమయింది.

తెలంగాణ గెజిట్లో ఈ ప్రకటన ప్రచురితమయిన తేదీనుండి రెండు నెలల లోపు ఈ అనుసూచిలో ప్రతిపాదించినట్లుగా ఉన్న వేతనాలకు సంబంధించి ఏవేని ఆక్షేపణలు లేదా సూచనలు అందినట్లయితే వాటిని తెలంగాణ ప్రభుత్వం పరిoలిస్తుందని ఇందుమూలంగా నోటీసు ఇవ్వడమయింది.

పారిశ్రామిక కార్మికులకు కనీస వేతనాల మూల రేట్లను, వినియోగదారు ధర సూచిక నెంబర్లకు 1317 పాయింట్ల వద్ద (ఆధారిత సంవత్సరం 1986R100 స"రీస్) అనుసంధానం చేయడమయింది. ప్రతి ఆరు నెలలకు అంటే ఏప్రిల్ 1వ తేదీన, అక్టోబరు 1వ తేదీన కార్మిక శాఖ కమీషనరు గారు Jవన వ్యయ భత్యాన్ని ప్రకటించాలి. ఇందు నిమిత్తం, అర్థ సంవత్సరం పూర్తి అయ్యే నాటికి వరుసగా డిసెంబరు, జూన్ నెలల్లో రాష్ట్రంలోని పారిశ్రామిక కార్మికుల వినియోగదారు ధర సూచిక నెంబర్లలో సగటు పెరుగుదలను పరిగణనలోనికి తీసుకోవడమవుతుంది. ధర సూచి వ్యయంలో 1317 పాయింట్ల కంటే ఏదేని పెరుగుదల కోసం Jవన వ్యయ భత్యం లెక్కకట్టే వివరాలను అనుసూచిలోని ప్రతి కేటగిరీలోని 4వ గడిలో పేర్కొనడమయింది.

1. ఈ ఉపాధిలో నియమితులైన ఏవైనా కేటగిరీలను మినహాయించినట్లయితే, ఈ ఉపాధిలో ఇదే విధమైన తత్సమాన పని కేటగిరీని నిర్వహిస్తున్న కార్మికుల కేటగిరీలో నిర్ణయించిన కనీస వేతనాల రేట్ల కంటే తక్కువ చెల్లించరాదు.

2. శాల్తీ రేటు కార్మికులను నియమించుకున్నప్పుడు, సాధారణ దినానికి వారిలో ప్రతి ఒక్కరికి చెల్లించే పారితోషికం, అదే విధమైన తత్సమాన పని చేస్తున్న సాధారణ కార్మికునికి రోజుకు 8 గంటల ప్రాతిపదికన లెక్కకట్టి నిర్ణయించిన కనీస వేతనం కంటే తక్కువగా ఉండరాదు.

3. దినసరి రేటును లెక్కించేటప్పుడు, నెలసరి రేటును 26తో విభాగించాలి. ఇందులో విశ్రాంతి రోజు వేతనాలు కూడా చేరి ఉంటాయి.

4. పని స్వభావం తత్సమానమైనప్పుడు, పురుషßలు, మహిళా కార్మికులకు సంబంధించి చేసిన కనీస వేతనాల రేట్ల చెల్లింపులో ఎటువంటి వివక్ష చూపరాదు.

5. ఏదేని కేటగిరీ ఉద్యోగి వాస్తవంగా పైన నిర్ధిష్టపరిచిన రేట్ల కంటే అధిక వేతనాల రేట్లను పొందుతున్నప్పుడు, అట్టి అధిక వేతనాల చెల్లింపులను కొనసాగించాలి.

6. ఏదేని కేటగిరీ ఉద్యోగికి ఇతర భత్యాలను (అంటే ప్రకటించిన మూలవేతనం కాకుండా) చెల్లిస్తున్నట్లయితే, ప్రకటించిన మూలవేతనంతో పాటు వారు సదరు భత్యాన్ని పొందడం కొనసాగించాలి.
