CANCELLATION OF ELECTION TO THE OFFICE OF CHAIRPERSON, JAGITIAL IN JAGITIAL DIERTCT - REVISED NOTIFICATION ISSUED BY THE STATE ELCTION COMMISSION.
No.117/TSEC-ULBs/2023,- Whereas, the Municipal Commissioner, Jagitial Municipality in Jagitial District has reported a casual vacancy in the Office of Chairperson of Jagitial Municipality occurred on 30-01-2023 vide his letter No.381/C/2023, dated:30.01.2023.
And whereas, upon reporting the vacancy, the State Election Commission examined the matter and decided to defer the issuance of Notification for holding election to the Office of Chairperson, Jagitial Municipality, till the completion of the Parliament Sessions held during the period beetween 31st January, 2023 to 06-04-2023, so as to enable the Members of Parliament concerned (Ex.Officio Members) to participate in the Special Meeting of the Municipality.
And whereas, after issue of completion of Union Budget Session, 23, the State Election Commission considered the matter and issued Notification in reference No. 177/TSEC-ULBs/2023, dated: 06-05-2023 for conduct of Election.
And whereas, after issue of Notification, the Municipal Commissioner, Jagitial Municipality in Jagital District in his letter No.381/C/2023, dated:14.03.2023 reported a vacancy in the office of 37th Ward Member in Jagitial Municipality, occurred due to resignation of the incumbent, sent through Mail today i.e. on 08.05.2023.
Ahd whereas, Rule 11 in Part III of Telangana Municipalities and Municipal Corporatins (Conduct of Election of Chairperson and Vice-Chairperson of Municipal council and Mayor and Deputy Mayor of Municipal Corporation) Rules, 2020 stipulate that,
"Provided that, before a casual election of Chairperson / Vice-Chairperson and Mayor/Deputy Mayor as the case may be is held, every casual vacancy in the office of an elected member of Municipality shall be filled.
Now, therefore, having due regard for the afore said rule position and in exercise of the powers conferred by Article 243ZA of the Constitution of India and all other powers there unto, the Telangana State Election Commission, hereby voids the election Notification No.117/TSEC-ULBs/2023, dated: 06-05-2023 in respect of election to the post of Chairperson of Jagitial Municipality, Jagitial District.
