Act issued by the High Court of Telangana at Hyderabad praying that this Hon'ble Court may be pleased to

(i) Declare that the election of the 1st respondent as the relumed candidate from 060- Khairathabad Assembly Constituency , Hyderabad district. Telangana State in the Assembly General elections held on 07.12.2018 as void and set aside the same

(ii) Declare that the petitioner as duly elected from 060- Khairathabad Assembly Constituency, Hyderabad district. Telangana State in the Assembly General elections held on 07.12-.2018 (iii) Direct respondents 32 to count the paper trail of votes as recorded by the Voter Verifiable Paper Audit Trail (WPATs) of 060- Khairathabad Assembly Constituency , Hyderabad district, Telangana State in the Assembly General elections held on 07.12.2018

(iv) to award cost of this Election Petition from the Ist respondent.

IA NO: 1 OP 2019

Petition under Section 5 Rule 20 (1-A) r/w. Sec. 151 of CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to service notices on the respondents no 6,12,15,17,18,23 and 24 in EP No. 09/2019 by way of substituted service through paper publication in any of the widely published newspapers as decided by this Hon'ble Court in Hyderabad District Edition.

Heard the learned Counsel appearing on behalf of petitioner and the

learned Counsels appearing on behalf of Respondents.

2. The learned Counsel for the petitioner filed I.A.No.l of 2023 in E.P.No.9

of 2019 on 25.04.2023 seeking permission to withdraw the E.P.No.9 of

2019.

3. The learned Counsel appearing on behalf of Respondents stated no objection

in withdrawing the E.P.No.9 of 2019.

4. Permission is accorded.

5. Taking into consideration the averments made in support of the affidavit

filed vide I.A.No.l of 2023, E.P.No.9 of 2019 is withdrawn as prayed for

and accordingly I.A./No.l of 2023 is allowed. There shall be no order as

to costs.

Miscellaneous petitions, if any, pending shall stand closed.
