GRANT OF NON - MINERAL BEARING AREA CONTIGUOUS / NON- CONTIGUOUS TO THE FRESH, EXISTING ( OR ) RENEWAL OF QUARRY LEASES FOR DUMPING OF MINE WASTE AND OTHER ANCILLARY ACTIVITIES WITHOUT ANY MINERAL RIGHTS AMENDMENT.

In exercise of the powers conferredby Sub - section 1 of Section 15 of the Mines and Minerals (Development and Regulation ) Act , 1957 ( Central Act 67 of 1957 ) , the Governor of Telangana hereby issues the following amendments to the Telangana Minor Mineral Concession Rules , 1966 .

AMENDMENTS
In the said Rules , the following shall be replaced / inserted:
1. The Rule 4 ( h ) (ii ) shall be replaced as:
"Quarry Lease " means a precise area granted under lease for the purpose of undertaking quarrying operations for winning minerals which includes non- mineral bearing area contiguous/ non- contiguous to the fresh , existing and renewal of quarry leases granted for dumping of mine waste and other ancillary activities without any mineral rights" .
2. After Rule 12 ( 5 ) ( h ) ( xvi) the following shall be inserted:
Rule 12( 5) ( i ) : Grant of leases for Dumping
a . Existing leaseholder shall file an application for grant of lease for dumping of the mine waste and other ancillary activities without any mineral rights in the prescribed Form B - 1 for grant of the non - mineral bearing area contiguous / non- contiguous to the fresh , existing and renewal of quarry leases for dumping , in the interest of mineral development before the Assistant Director of Mines and Geology concerned.
b . Such application shall be accompaniedby a plan / sketch drawn to the scale by qualified Surveyor along with DGPS readings ( with Geo co- ordinates) duly signed by the lease holder .
c. The lease holder shall submit an affidavit , undertaking that the applied area is non - mineral bearing and categorically affirm that the applied area shall not be used for extraction of any mineral and no production of any mineral will be undertaken .
d . The lease holder shall pay Non- refundable Application Fee and Survey Charges as applicable under the Rule 12( 1 ) and 12 ( 5 ) ( a ) ( i ) of TMMC Rules , 1966 .
e . The Assistant Director of Mines and Geology , shall obtain Category , Classification and Availability of the Land both in Government and Patta lands along with No Objection Certificate from the Tahsildar/ Joint Collector/ Collector as the case may be duly confirming that the existing lease area is not sufficient for dumping of overburden , waste / tailing or other necessary ancillary activities and the lease area identified for dumping is non- mineralized .
f. In case of applied non - mineral bearing area is a pattaland , the leaseholder shall submit the consent of the Pattadar .
g . The Assistant Director of Mines and Geology shall conduct DGPS survey of the applied area and shall earmark the quarry lease with the mineral bearing area and non - mineral bearing area separately in the DGPS map . The non- mineral bearing area shall be shown with hatch marks duly indicating in the DGPS map that such area is meant exclusively for dumping of mine waste arid allied ancillary activities .

h . The Assistant Director of Mines and Geology shall submit proposal to the Director /Deputy Director of Mines and Geology , as the case may be , recommending the grant of non- mineral bearing extent contiguous / non- contiguous to the fresh , existing or renewal of quarry leases for dumping of mine waste and other ancillary activities without any mineral rights .
i . The Director / Deputy Director of Mines and Geology , as the case may be shall grant the lease for inclusion of additional contiguous / non- contiguous area of non -mineralized for the purpose of dumping of mine waste and other ancillary activities without any mineral rights in the interest of mineral development upon receipt of payment of 4 - times of Annual Dead Rent as grant amount .
j . Leaseholder shall execute the supplementary quarry lease deed with the Assistant Director of Mines and Geology concerned within thirty days from the date of grant order .
k. Provided that the period of supplementary lease shall be co - terminus with the existing Quarry Lease .
Provided further that, if the time stipulated above for execution of lease deed is expired , Director may condone the delay with recorded reasons and grant an extension for another 30 days .
1. Leaseholder shall pay Annual Dead Rent every year in advance as per the Rule 10 of these Rules and such amount shall not be applicable for adjustment towards Seigniorage Fee .
m. The Lease holder shall obtain necessary permissions or clearances from the competent authorities as applicable .
n . In case of breach of any condition (s ) , the leaseholder is liable for necessary action under these Rules .
5. The Director of Mines & Geology, Hyderabad shall take further necessary action in the matter accordingly.
