संख्या 1049 / VII-3-20/473-उद्योग / 2002- राज्यपाल , "भारत का संविधान " के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके "उत्तराखण्ड अधीनस्थ सेवा (उद्योग विभाग) नियमावली, 2008" में अग्रेत्तर संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं : -
" उत्तराखण्ड अधीनस्थ सेवा (उद्योग विभाग ) (संशोधन) नियमावली, 2020 "
संक्षिप्त नाम और प्रारम्भ 1. (1 ) इस नियमावली का संक्षिप्त नाम " उत्तराखण्ड अधीनस्थ सेवा (उद्योग विभाग) (संशोधन) नियमावली, 2020 " है ।
(2) यह तुरन्त प्रवृत्त होगी ।

नियम 3 का संशोधन
" उत्तराखण्ड अधीनस्थ सेवा (उद्योग विभाग) नियमावली, 2008 (जिसे यहां आगे मूल नियमावली कहा गया है) के परिभाषा खण्ड में उपखण्ड (ख ) के पश्चात एक नया उपखण्ड (ख ख) अन्तः स्थापित कर दिया जायेगा, अर्थातः-
(ख ख) "आयोग " से " उत्तराखण्ड अधीनस्थ सेवा चयन आयोग " अभिप्रेत है । "
नियम 6 का संशोधन 3. मूल नियमावली के नियम 6 में अनुसूचित जनजातियों शब्दों के पश्चात "अन्य पिछडा वर्ग , आर्थिक रूप से कमजोर वर्ग " शब्दों को अन्तः स्थापित कर दिया जायेगा ।
4.
नियम 9 का संशोधन
मूल नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम 9 के स्थान पर स्तम्भ-2 में दिया गया नियम प्रतिस्थापित कर दिया जायेगा, अर्थातः-

(एक) नियम 8 में दिये गये विवरण के (एक) नियम 8 में दिये गये विवरण के अनुसार व्यवहारिक 523 भाग 1 ]

अनुसार व्यवहारिक अनुभव, प्राप्त अनुभव, प्राप्त किया हो, या
(दो) प्रादेशिक सेना में दो वर्ष की न्यूनतम अवधि तक सेवा की हो, या (तीन ) राष्ट्रीय कैडेट कोर का "बी " अथवा "सी" प्रमाण - पत्र प्राप्त किया हो ।
किया हो, या (दो) प्रादेशिक सेना में दो वर्ष की न्यूनतम अवधि तक सेवा की हो, या - (तीन) राष्ट्रीय कैडेट कोर का " बी" प्रमाण - पत्र प्राप्त किया हो ।
(ब) अनिवार्य /वांछनीय अर्हतायें
उत्तराखण्ड लोक सेवा आयोग की परिधि के अंतर्गत तथा लोक सेवा आयोग की परिधि के बाहर समूह ' ग ' की सीधी भर्ती के लिए अनिवार्य/ वांछनीय अर्हता नियमावली , 2010 (समय- समय पर यथासंशोधित) में निहित प्राविधानों / शर्तों/ उपबन्धों के अनुसार अपेक्षित अर्हताऐ धारण करता हो ।
नियम 10 का संशोधन 5. मूल नियमावली में नीचे स्तम्भ -1 में दिये गये विद्यमान नियम 10 के स्थान पर स्तम्भ-2 में दिया गया नियम प्रतिस्थापित कर दिया जायेगा, अर्थातः-

स्तम्भ 1 विद्यमान नियम
एतद्वारा प्रतिस्थापित नियम
एक ) सीधी भर्ती के पदों, जिनकी न्यूनतम शैक्षिक अर्हता इंण्टरमीडिएट अथवा समकक्ष है के लिये अभ्यर्थी की आयु उस चयन वर्ष जिसमें आयोग द्वारा रिक्ति विज्ञापित की जाये, 01 जुलाई को न्यूनतम 18 वर्ष व अधिकतम 42 वर्ष होनी चाहिए ।
(दो) सीधी भर्ती के पदों, जिनकी न्यूनतम शैक्षिक अर्हता स्नातक अथवा समकक्ष है के लिये अभ्यर्थी की आयु उस चयन वर्ष की 01 जुलाई को न्यूनतम 21 वर्ष व अधिकतम 42 वर्ष होनी चाहिएः सीधी भर्ती के पदों, जिनकी न्यूनतम ( शैक्षिक अर्हता इंण्टरमीडिएट अथवा समकक्ष है , की भर्ती हेतु न्यूनतम आयु सीमा 18 वर्ष तथा ऐसे पदों जिनकी न्यूनतम शैक्षिक अर्हता स्नातक अथवा समकक्ष है , की भर्ती हेतु न्यूनतम आयु सीमा 21 वर्ष होगी तथा अधिकतम आयु सीमा 35 वर्ष होगी या
परन्तु यह कि उत्तराखण्ड राज्य की अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्ग तथा अन्य ऐसी श्रेणियों के मामले में, जिन्हें राज्य सरकार द्वारा समय - समय पर अधिसूचित किया जाय , अधिकतम आयु उतनी बढ़ायी जायेगी, जैसा कि विहित किया जाय ।
परन्तु अनुसूचित जातियों, अनुसूचित जनजातियों और ऐसे अन्य श्रेणियों के जो सरकार द्वारा समय - समय पर अधिसूचित की जायें, अभ्यर्थी की दशा में उच्चतम आयु सीमा उतने वर्ष अधिक होगी , जितनी विनिर्दिष्ट की जाय ।

नियम 13 का संशोधन 6. मूल नियमावली के नियम 13 में प्रथम परन्तुक के पश्चात निम्नलिखित परन्तुक अन्तः स्थापित कर दिया जायेगा, अर्थातः-
परन्तु यह और कि निःशक्त्तजनों हेतु दिव्यांजन अधिकार अधिनियम, 2016 (अधिनियम संख्या -49 वर्ष 2016) की धारा 33 के कम में इस हेतु चिन्हित पदों तथा धारा -34 के अंतर्गत चिन्हित श्रेणी में दिव्यांगों को नियमानुसार नियुक्ति दिये जाने से मना नहीं किया जायेगा ।
नियम 14 का संशोधन 7. मूल नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम 14 के स्थान पर स्तम्भ-2 में दिया गया नियम प्रतिस्थापित कर दिया जायेगा, अर्थातः-

नियुक्ति प्राधिकारी वर्ष के दौरान नियुक्ति प्राधिकारी वर्ष के दौरान विभिन्न श्रेणियों के पदों पर भरी विभिन्न श्रेणियों के पदों पर भरी जाने वाली रिक्तियों की संख्या और इस नियमावली के नियम 6 जाने वाली रिक्तियों की संख्या, के अधीन अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े अनुसूचित जातियों, अनुसूचित जन वर्ग , आर्थिक रूप से कमजोर वर्ग और अन्य श्रेणियों के अभ्यर्थियों जातियों और अन्य श्रेणियों के के लिए आरक्षित की जाने वाली रिक्तियों की संख्या, संगत सेवा अभ्यर्थियों के लिए आरक्षित की जाने नियमावली के अनुसार, अवधारित करेगा तथा रिक्तियों की सूचना वाली रिक्तियों की संख्या, संगत " आयोग " को देगा । सेवा नियमावली के अनुसार , अवधारित करेगा । यदि चयन समिति का अध्यक्ष नियुक्ति प्राधिकारी से भिन्न कोई अधिकारी है तो नियुक्ति प्राधिकारी चयन समिति के अध्यक्ष को रिक्तियों की सूचना देगा ।
नियम 15 का संशोधन 8. मूल नियमावली में नीचे स्तम्भ -1 में दिये गये विद्यमान नियम 15 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थातः-

नियम 15 (1 )
सीधी भर्ती निम्नलिखित रीति से , सीधी भर्ती
नियुक्ति प्राधिकारी , की प्रक्रिया के लिए आवेदन- पत्र और " (1 ) प्रतियोगिता परीक्षा में बैठने की अनुमति के लिए आयोग " विहित प्रपत्र में आवेदन-पत्र मंगायेगा । आवेदन पत्र निर्धारित शुल्क का भुगतान 525 भाग 1 ]

रिक्तियां अधिसूचित करेगाः- कर आयोग के सचिव से प्राप्त किये जा सकेंगे ।
(2 ) आयोग द्वारा जारी प्रवेश - पत्र के बिना किसी भी अन्यर्थी को परीक्षा में प्रवेश नहीं दिया जायेगा ।
(एक) ऐसे दैनिक समाचार- पत्रों में जिसका व्यापक परिचालन हो , विज्ञापन जारी करके, (दो) कार्यालय के सूचना पट्ट पर सूचना चस्पा करके या रेडियो / दूरदर्शन और अन्य रोजगार- पत्र के माध्यम से विज्ञापन करके, और .. (तीन) रोजगार कार्यालय को
(3) आयोग लिखित परीक्षा के परिणाम प्राप्त होने और उनके सारणीकरण के पश्चात् नियम-6 के अधीन अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़े वर्ग , आर्थिक रूप से कमजोर वर्ग तथा अन्य श्रेणियों के अभ्यर्थियों का प्रतिनिधित्व सुनिश्चित करने की आवश्यकता को ध्यान में रखते हुए , लिखित परीक्षा के परिणाम के आधार पर ऐसे अभ्यर्थियों को लिखित परीक्षा में प्राप्त कुल अंकों द्वारा प्रकट प्रवीणता के कम में सूची बनायेगा और नियुक्ति के लिए उतने अभ्यर्थियों की संस्तुति करेगा जिन्हें वह नियुक्ति के योग्य समझता है । यदि दो या अधिक अभ्यर्थियों द्वारा प्राप्त कुल अंक बराबर हों तो अधिक आयु वाले अभ्यर्थी का नाम सूची में ऊपर रखा जायेगा ।
टिप्पणीः-प्रतियोगिता परीक्षा एवं विभागीय परीक्षा के लिये पाठ्य विवरण और नियम ऐसे होगे जो सरकार
द्वारा आयोग के परामर्श से विहित किये जाये ।
रिक्तियां अधिसूचित करके । (2) (एक) चयन के लिए 100 अंकों की एक लिखित परीक्षा होगी । छंटनीशुदा कर्मचारियों को सेवा में प्रत्येक एक पूर्ण वर्ष के लिए 5 अंक व अधिकतम 15 अंक दिये जायेंगे । प्रवीणता सूची लिखित परीक्षा के प्राप्तांकों व अन्य मूल्यांकनों के योग के आधार पर तैयार की जायेगी । (दो) ( क) लिखित परीक्षा 100 अंकों की वस्तुनिष्ठ प्रकार की होगी , जिसमें सामान्य हिन्दी, सामान्य ज्ञान और सामान्य अध्ययन यथास्थिति तकनीकी विषय का एक प्रश्न पत्र होगा । प्रश्न पत्र मूल्यांकन में प्रत्येक सही उत्तर का एक अंक व प्रत्येक गलत उत्तर हेतु 1/4 ऋणात्मक अंक दिया जायेगा । (ख) लिखित परीक्षा की प्रश्न बुकलेट, परीक्षा के पश्चात अभ्यर्थियों को अपने साथ ले जाने की अनुमति दी जायेगी ।
(ग) लिखित परीक्षा की उत्तर शीट (Answer Sheet) कार्बन प्रति के साथ डुप्लीकेट में होगी तथा डुप्लीकेट प्रति अभ्यर्थी को अपने साथ ले जाने की अनुमति दी जायेगी ।

(घ) लिखित परीक्षा के पश्चात लिखित परीक्षा की उत्तरमाला (Answer Key) को उत्तराखण्ड की बैबसाईट www.ua.nic.in
या दैनिक समाचार पत्र में जिसका व्यापक परिचालन है, पर प्रकाशित किया जायेगा ।
(ड) किसी ऐसे पद पर , जिसके लिये तकनीकी ज्ञान अनिवार्य अर्हता के रूप में विहित हो, चयन किये जाने वाले अभ्यर्थियों की दशा में यथा स्थिति तकनीकी परीक्षा ली जायेगी । यह परीक्षा 50 अंकों की होगी , तकनीकी परीक्षा के लिये बुलाये जाने वाले अभ्यर्थियों की संख्या रिक्तियों की संख्या की चार गुना होगी ।
(3) लिखित परीक्षा के प्राप्तांकों और अन्य मूल्यांकनों जिसमें छटनीशुदा कर्मचारियों हेतु अधिमान अंकों का जोड होगा, के अंकों के कुल योग से जैसा प्रकट हो, प्रवीणता सूची (अंतिम चयन सूची) तैयार की जायेगी । यदि दो या अधिक अभ्यर्थी कुल योग के बराबर अंक प्राप्त करें तो लिखित परीक्षा में उच्चतर अंक प्राप्त करने वाले अभ्यर्थी को चयन सूची में ऊपर रखां जायेगा। यदि लिखित परीक्षा में भी दो या अधिक अभ्यर्थी ने बराबर- बराबर अंक प्राप्त किये हों तो आयु में ज्येष्ठ अभ्यर्थी को चयन सूची में ऊपर रखा जायेगा । सूची में नामों की संख्या रिक्तियों की संख्या से अधिक (किन्तु 25 प्रतिशत से अनधिक) होगी।

No. 1049/VII - 3-20/473-Udhyog/2002 - In exercise of the powers conferred by proviso to article 309 of " Constitution of India " Governor is please to make the following rules with objective to further amend the Uttarakhand Subordinate Service ( Industries Department ) Rules , 2008 : --
The Uttarakhand Subordinate (Industries Department) (Amendment) Rules , 2020
Short title and 1 . commencement
(1) These rules may be called Uttarakhand Subordinate (Industries Department ) (Amendment ) Rules, 2020 .
(2) It shall come into force at once .
Amendment of rule 3 2 . After sub - clause (b ) of definition clause of the Uttarakhand Subordinate (Industry Department) Rules , 2008 , (herein after referred to as Principle rule) , a new sub- clause (bb ) shall be
inserted as follows , namely-
"(bb) " Commission " means Uttarakhand Subordinate Service Selection Commission; "
Amendment of rule 6 3 . In rule 6 of Principal rule after the words Scheduled Tribes the words " other backward castes , Economically weaker section " shall be inserted .
Amendment of rule 9 4 . In Principal rule for the existing rule 9 as set out in column 1 below, the rule as set out in column 2 shall be substituted, namely: -

In Principal rules after first proviso , a new proviso shall be inserted as follows--
"Provided further that in order of section 33 the posts identified for this purpose and the categories identified under section 34 of the Rights of Persons with Disability Act , 2016 ( Act no 49 of 2016) , the disabled shall not be deemed for appointment as per rules . "

(1) The appointing authority shall invite the applications for direct recruitment in the form published under sub - rule ( 1 ) and notify the vacancies in the following

(iii) by notifying vacancies to the Employment Exchange .
candidates belonging to the Scheduled Castes , Scheduled Tribes , Others Backward classes and other categories under rule 6 , shall prepare a list of candidate in order of their proficiency as disclosed by the aggregate of marks obtained by each of candidates , on the basis of result of the written examination and recommend such number of candidates as it consider fit for appointments . If two or more candidates obtain equal marks in total, the name of the candidate obtaining higher marks in the written examination shall be placed higher in the list .
(2) ( i ) There shall be a written examination carrying 100 marks for the selection . The retrenched employees shall be awarded 5 marks for each year of completed service , subject to the maximum of 15 marks . The merit list shall be prepared on the basis of the marks obtained in the written examination and others evaluations ;
Note-- The syllabus and rules for competitive examination and departmental examination shall be such as prescribed by the Commission, State Government from time to time with the consultation of the Commission.
( ii) (a) There shall be an objective type written examination carrying 100 marks consisting of single question paper which will include General Hindi , General Knowledge and General Studies . While evaluating the question paper one mark shall be awarded for each correct answer and ½ negative marks for each wrong answer;
(b) After the examination is over the candidates shall be allowed to carry back the question booklet of the written examination with them;
: (c) The answer sheet of written examination shall be in duplicate with carbon copy and the candidates shall be permitted to carry back the duplicate copy with them after the completion of the examination ;
(d) After the written examination the answer key of the written examination shall be displayed on the Uttarakhand website www.ua.nic.in ;
(e) after the result declaration , the marks of the written examination shall be भाग 1 ]

displayed on the Uttarakhand website www.uk.gov.in or published in the daily newspaper having wide circulation;
(3) The merit list (final selection list) shall be prepared in order of proficiency as described by aggregate of marks obtained in the written examination and other evaluations including preferential marks for the retrenched/ contract workers , marks obtained in typewriting for the post , as the case may be . If two of more candidates obtain equal marks in aggregate , the candidate obtaining more marks in written examination shall be placed higher in the select list . 360 संशोधन करने; शासन की अधिसूचना संख्या 431/2020 दिनांक 25 जून, 2020 में संशोधन करने ; शासन की अधिसूचना संख्या 97/2019 दिनांक 24 जनवरी , 2019 के तीसरे परन्तुक के पश्चात् परन्तुक अन्तःस्थापित किये जाने तथा उत्तराखण्ड माल और सेवा कर (आठवां संशोधन), नियम, 2020; समदिनांकित 22 जुलाई , 2020 जारी किया जाना अधिसूचित किया गया है ।
उपरोक्त अधिसूचनाओं की प्रतियां इस आशय से प्रेषित है कि उक्त अधिसूचनाओं की अतिरिक्त प्रतियाँ कराकर अपने अधीनस्थ समस्त कर निर्धारण अधिकारियों को आवश्यक कार्यवाही करने हेतु तथा बार एसोसिएशन के पदाधिकारियों/ व्यापारी संगठनों के अध्यक्ष / सचिव को सूचनार्थ उपलब्ध कराने का कष्ट करें ।

संक्षिप्त नाम एवं 1. (1 ) इन नियमों का संक्षिप्त नाम उत्तराखण्ड माल और सेवा कर (छठा संशोधन ) नियम , 2020 है ।

(2) ये 27 मई, 2020 से प्रवृत्त होंगे ।
संशोधन
नियम 26 का 2. उत्तराखण्ड माल और सेवा कर नियम, 2017 (जिसे इसके पश्चात् उक्त नियम कहा गया है) के नियम 26 के उपनियम (1 ) में, दूसरे परन्तुक के स्थान पर निम्नलिखित परन्तुकों को प्रतिस्थापित्त किया जाएगा; अर्थात्-
"परंतु यह और कि किसी भी रजिस्ट्रीकृत व्यक्ति, जो कि कम्पनी अधिनियम, 2013 (2013का 18) के उपबंधों के अधीन रजिस्ट्रीकृत हो, को 21 अप्रैल, 2020 से 30 सितंबर, 2020 तक की अवधि के दौरान, धारा 39 के तहत प्ररूप जीएसटीआर -3 ख में प्रस्तुत की जाने वाली विवरणी को इलेक्ट्रानिक सत्यापन कोड (ईवीसी) के माध्यम से सत्यापित करने की भी अनुमति हैः
परंतु यह भी कि किसी भी रजिस्ट्रीकृत व्यक्ति, जो कि कम्पनी अधिनियम, 2013 (2013 का 18 ) के उपबंधों के अधीन रजिस्ट्रीकृत हो, को 27 मई, 2020 से 30 सितंबर, 2020 तक की अवधि के दौरान, धारा 37 के तहत प्ररूप जीएसटीआर -1 में प्रस्तुत किए जाने वाले जावक पूर्तियों के ब्यौरे को इलेक्ट्रानिक सत्यापन कोड (ईवीसी) के माध्यम से सत्यापित करने की भी अनुमति है। " 361 भाग 1 -क]

Commencement
Short Title and 1. (1) These rules may be called the Uttarakhand Goods and Services Tax (Sixth Amendment) Rules , 2020 .
(2) They shall come into force on 27th day of May, 2020.
Amendment of 2. In the Uttarakhand Goods and Services Tax Rules , 2017 ( hereinafter rule 26
referred to as the said rules ), in rule 26 in sub - rule ( 1 ), for the second proviso, the following provisos shall be substituted , namely: - "Provided further that a registered person registered under the provisions of the Companies Act , 2013 ( 18 of 2013 ) shall , during the period from the 21st day of April , 2020 to the 30thday of September, 2020, alsobe allowed to furnish the return under section 39 in FORM GSTR- 3B verified through electronic verification code (EVC) . Provided also that a registered person registered under the provisions of the Companies Act , 2013 ( 18 of 2013 ) shall , during the period from the 27th day of May , 2020 to the 30th day of September , 2020, also be allowed to furnish the details of outward supplies under section 37 in FORM GSTR - 1 verified through electronic verification code (EVC). "

परंतु यह भी कि यदि उक्त विवरणी में संदेय राज्य कर की राशि शून्य है तो उक्त अधिनियम की धारा 47 के प्रावधानों के तहत देय विलम्ब फीस को उन रजिस्ट्रीकृत व्यक्तियों के लिए अधित्यजन किया जाता है जिन्होने नियत तारीख तक माह जुलाई, 2017 से जनवरी, 2020 तक के लिए प्ररूप जीएसटीआर -3 ख में विवरणी प्रस्तुत नहीं की है लेकिन वह उक्त विवरणी को 1 जुलाई, 2020 से 30 सितम्बर, 2020 की अवधि के दौरान प्रस्तुत करते है। " 368

No. 502/2020/6 ( 120 ) / XXVII ( 8 ) / 2020 / CT-53 - WHEREAS, the State Government is satis- fied that it is expedient so to do in public interest;
NOW, THEREFORE, in exercise of the powers conferred by section 128 of the Uttarakhand . Goodsand Services Tax Act, 2017 (Act No. 06 of 2017 ) (hereafter in this notification referred to as the said Act) , the Governor , on the recommendations of the Council , is pleased to allow to make the following further amendment in the notification of the Government of Uttarakhand, Finance Section - 8 , No. 116/2018/5 ( 120)/XXVII ( 8 )/2017/CT-4 dated 31st January , 2018 (as amended from time to time), namely:-
In the said notification, for the fourth proviso , the following proviso shall be substituted , namely:-

उत्तराखण्ड माल और सेवा कर (कठिनाइयों का निवारण ) आदेश , 2020

संख्या 503/2020/6 (120) / XXVII (8 ) / 2020 / ROD-01- उत्तराखण्ड माल और सेवा कर अधिनियम, 2017 (जिसे इसमें इसके पश्चात् ' उक्त अधिनियम' कहा गया है) की धारा 29 की उप- धारा (2 ), खंड (क) से खंड (ङ) में वर्णित परिस्थितियों में उचित अधिकारी द्वारा रजिस्ट्रीकरण रद्द करने का उपबंध करती है जो इस प्रकार से है, जहां:-
(क) रजिस्ट्रीकृत व्यक्ति ने अधिनियम या इसके अधीन बनाए गए नियमों के अधीन ऐसे उपबंधों का उल्लंघन किया है जो विहित किए जाएं; या !
( ख ) धारा 10 के अधीन कर का संदाय करने वाले व्यक्ति ने , तीन क्रमवर्ती कर अवधियों के लिए विवरणी प्रस्तुत नहीं की है; या 371 भाग 1 -क]

(ग) खंड ( ख ) में विनिर्दिष्ट व्यक्ति से भिन्न किसी रजिस्ट्रीकृत व्यक्ति ने लगातार छह मास की अवधि के लिए विवरणी प्रस्तुत नहीं की है; या
( घ) किसी ऐसे व्यक्ति ने जिसने धारा 25 की उप - धारा ( 3. ) के अधीन स्वैच्छया रजिस्ट्रीकरण कराया है , रजिस्ट्रीकरण की तारीख से छह मास के भीतर कारबार प्रारम्भ नहीं किया है; या (ङ) रजिस्ट्रीकरण कपट के साधनों से , जानबूझकर किए गए मिथ्या कथन या तथ्यों के छिपाने के द्वारा प्राप्त किया गया है:
परंतु उचित अधिकारी किसी व्यक्ति को सुनवाई का अवसर दिये बिना रजिस्ट्रीकरण को रद्द नहीं करेगा। और , उक्त अधिनियम की धारा 169 की उपधारा ( 1 ) नोटिस की तामील ( सुनवाई का अवसर ) के लिए उपबंध करती है; उक्त उपधारा के खंड ( ग ) और ( घ ) निम्न प्रकार से हैं: -
घ) सामान्य पोर्टल पर उपलब्ध करवाने के द्वारा; या
( ग ) रजिस्ट्रीकरण के संमय उपलब्ध कराए गये या समय - समय पर संशोधित उसके ई- मेल पते पर संसूचना भेजने के द्वारा ; या (
और , धारा 30 की उप - धारा ( 1 ) रद्दकरण आदेश की तामील की तारीख से तीस दिन के भीतर रजिस्ट्रीकरण के रद्दकरण के प्रतिसंहरण के लिए उपबंध करती है ।
और , उक्त अधिनियम की धारा 107 की उपधारा ( 1 ) किसी न्यायनिर्णायक प्राधिकारी द्वारा पारित किसी विनिश्चय या आदेश से व्यथित किसी व्यक्ति के द्वारा , उस तारीख से जिसको ऐसे व्यक्ति को उक्त विनिश्चय या आदेश संसूचित किया जाता है , तीन मास के भीतर अपील फ़ाइल करने का उपबंध करती है और उक्त अधिनियम की धारा 107 की उप - धारा ( 4 ) अपील प्राधिकारी को सशक्त करती है कि , यदि उसका यह समाधान हो जाता है कि , अपीलकर्ता तीन मास की पूर्वोक्त अवधि के भीतर अपील प्रस्तुत करने से पर्याप्त कारणों से निवारित किया गया था तो , वह उसे एक मास की और अवधि के भीतर प्रस्तुत करने की अनुज्ञो दे सकेगा।
और , उक्त अधिनियम की धारा 169 की उपधारा ( 1 ) के खंड ( ग ) और खंड ( घ ) के अनुसार उचित अधिकारी द्वारा नोटिस तामील के द्वारा उक्त अधिनियम की धारा 29 की उपधारा ( 2 ) के अधीन बड़ी संख्या में रजिस्ट्रीकरण रद्द हुए हैं और उक्त अधिनियम की धारा 30 की उपधारा ( 1 ) में रद्दकरण आदेश के प्रतिसंहरण के लिए उपबंधित तीस दिन की अवधि , उक्त अधिनियम की धारा 107 की उपधारा ( 1 ) के अधीन अपील फ़ाइल करने की अवधि और उक्त अधिनियम की धारा 107 की उपधारा ( 4 ) में विलंब के लिए क्षमा की अवधि भी व्यपगत हो गई है। रजिस्ट्रीकृत व्यक्ति जिनके रजिस्ट्रीकरण उक्त अधिनियम की धारा 29 की उपधारा ( 2 ) के खंड ( ख ) और खंड ( ग ) के अधीन रद्द हो चुके हैं, रजिस्ट्रीकरण के रद्दकरण के प्रतिसंहरण के लिए सभी अपेक्षाओं को पूरा करने के बावजूद अपने रजिस्ट्रीकरण के रद्दकरण का प्रतिसंहरण कराने में असमर्थ हैं । जी एस टी के एक नया अधिनियम होने के कारण , ये करदाता रजिस्ट्रीकरण के रद्दकरण के प्रतिसंहरण के लिए आवेदन विनिर्दिष्ट समयावधि , जो रद्दकरण आदेश की तामील की तारीख से तीस दिन के भीतर है , में दाखिल नहीं कर पाये है , जिसके परिणामस्वरूप उक्त अधिनियम की धारा 30 की उप - धारा ( 1 ) के उपबंधों को प्रभावी बनाने में कतिपय कठिनाइयाँ उत्पन्न हुई हैं;
अतः अब , राज्यपाल उत्तराखण्ड माल और सेवा कर अधिनियम , 2017 की धारा 172 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , परिषद की सिफ़ारिशों पर , कठिनाइयों को दूर करने के लिए निम्नलिखित आदेश करने की सहर्ष स्वीकृति करते है , अर्थात्ः- 1. संक्षिप्त नाम इस आदेश का संक्षिप्त नाम उत्तराखण्ड माल और सेवा कर ( कठिनाइयों का निवारण )
आदेश , 2020 है।

2 . इसके द्वारा कठिनाइयों को दूर करने हेतु यह स्पष्ट किया गया है कि , अधिनियम की धारा 30 की उपधारा ( 1 ) के अधीन रजिस्ट्रीकरण के रद्दकरण के प्रतिसंहरण के लिए आवेदन दाखिल करने के लिए तीस दिन की अवधि की गणना हेतु , वे रजिस्ट्रीकृत व्यक्ति जिन्हें धारा 169 की उपधारा ( 1 ) के खंड (ग ) या खंड ( घ ) में यथा उपबंधित रीति से धारा 29 की उपधारा ( 2 ) के खंड ( ख ) और खंड ( ग ) के अधीन नोटिस तामील हुई थी और 12.06 : 2020 तक रद्दकरण आदेश पारित हुआ है , के लिए निम्नलिखित तिथियों मे से उत्तरवर्ती तिथि को माना जाएगा: -
क) उक्त आदेश के प्राप्ति की तारीख या
ख ) अगस्त, 2020 का 31 वाँ दिन

The Uttarakhand Goods and Services Tax ( Removal of Difficulties ) Order , 2020

No. 503/2020/6 ( 120 ) /XXVII ( 8 ) / 2020 / ROD - 01 - WHEREAS , sub - section (2) of section 29 of the Uttarakhand Goods and Services Tax Act , 2017 (hereinafter referred to as the said Act) provides for cancellation of registration by proper officer in situations described in clauses (a) 。 to ( e) as under : --
(a) a registered person has contravened such provisions of the Act or the rules made thereunder as may be prescribed; or .
(b) a person paying tax under section 10 has not furnished returns for three consecutive tax periods; or
(c) any registered person, other than a person specified in clause (b) , has not furnished returns for a continuous period of six months ; or
(d) any person who has taken voluntary registration under sub- section (3 ) of section 25 has not commenced business within six months from the date of registration; or
(e) registration has been obtained by means of fraud , wilful misstatement or suppression of facts:
Provided that the proper officer shall not cancel the registration without giving the person an opportunity of being heard .
AND WHEREAS, sub- section (1 ) of section 169 ofthe said Act provides for service ofnotice (opportunity ofbeing heard); clauses (c) and (d) of said sub -section are as under: -
(c) by sending a communication to his e-mail address provided at the time of registration or as amended from time to time ; or
(d) by making it available on the common portal ; or
.. ;
AND WHEREAS, sub- section ( 1 ) of section 30 of the said Act provides for application for revocation of cancellation of the registration within thirty days from the date of service of the cancellation order ;

AND WHEREAS , sub - section (1 ) of section 107 of the said Act provides for filing appeal by any person aggrieved by any decision or order passed by an adjudicating authority within three months from the date on which the said decision or order is communicated to such person and sub- section (4) of section 107 of the said Act empowers the Appellate Authority that it may, if he is satisfied that the appellant was prevented by sufficient cause from presenting the appeal within the aforesaid period of three months, allow it to be presented within a further period of one month ;
AND WHEREAS, a large number of registrations have been cancelled under sub - section (2 ) of section 29 of the said Act by the proper officer by serving notices as per clause (c) and clause (d) of sub-section ( 1 ) of section 169 of the said Act and the period of thirty days provided for application for revocation of cancellation order in sub-section ( 1 ) of section 30 of the said Act, the period for filing appeal under section ( 1 ) of section 107 of the said Act and also the period of condoning the delayprovided in sub -section (4) of Section 107 of the said Act has elapsed; the registered persons whose registration have been cancelled under clause (b) or clause (c ) of sub - section (2 ) of section 29 of the saidAct are unable to get their cancellation of registration revoked despite having fulfilled all the requirements for revocation of cancellation of registration; the said Act being a new Act, these taxpayers could not apply for revocation of caricellation within the specified time period of thirty days from the date of service of the cancellation order , as a result whereof certain difficulties have arisen in giving effects to the provisions of sub - section ( 1 ) of section 30 of the said Act;
NOW, THEREFORE, in exercise of the powers conferred by section 172 of the Uttarakhand Goodsand Services Tax Act, 2017 , the Governor , on the recommendations of the Council , is pleased to allow to make the following Order , to remove the difficulties , namely:-
1. Short title. -This Order may be called the Uttarakhand Goods and Services Tax (Removal of Difficulties) Order, 2020 .
2. For the removal of difficulties , it is hereby clarified that for the purpose of calculating the period ofthirty daysfor filing application for revocation of cancellation of registration under sub - section (1) of section 30 of the Act for those registered persons who were served notice under clause (b ) or clause (c) of sub- section (2) of section 29 in the manner as provided in clause (c) or clause (d) of sub-section (1 ) of section 169 and where cancellation order was passed up to 12th June , 2020 , the later of the following dates shall be considered: -
a) Date of service of the said cancellation order ; or
b) 31st day ofAugust, 2020.

उक्त अधिसूचना के तीसरे परंतुक के बाद निम्नलिखित परंतुकों को अंतःस्थापित किया जाएगा , अर्थात्- "परंतु यह भी कि उन रजिस्ट्रीकृत व्यक्तियों के वर्ग के लिए , जो कि उक्त परंतुक में निर्दिष्ट तालिका के स्तंभ ( 2 ) में निर्दिष्ट किए गए है , जो उक्त तालिका के स्तंभ ( 3 ) में निर्दिष्ट कर अवधि के लिए उक्त तालिका के स्तंभ ( 4 ) में उल्लिखित शर्त के अधीन विवरणी प्रस्तुत नहीं करते है , लेकिन उक्त विवरणी को सितंबर , 2020 के 30वें दिन तक प्रस्तुत करते हैं, उक्त अधिनियम की धारा 47 के प्रावधानों के अधीन देय विलम्ब फीस को दो सौ पचास रुपये से अधिक अधित्यक्त किया जाता है , और उन करदाताओं के लिए देय विलम्ब फीस को पूरी तरह से अधित्यक्त किया जाता है जहाँ कुल देय राज्य कर कि राशि शून्य हैः
परंतु यह भी कि उन करदाताओं के लिए जिनका पूर्ववर्ती वित्तीय वर्ष में कुल आवर्त 5 करोड़ रुपये से अधिक है , जो कि नियत तारीख तक मई , 2020 से जुलाई , 2020 माह के लिए प्ररूप जीएसटीआर -3 ख में विवरणी प्रस्तुत नहीं करते हैं , लेकिन उक्त विवरणी को सितंबर , 2020 के 30 वें दिन तक प्रस्तुत करते हैं , उक्त अधिनियम की धारा 47 के प्रावधानों के अधीन देय विलम्ब फीस को दो सौ पचास रुपये से अधिक अधित्यक्त किया जाता है , और उन करदाताओं के लिए देय विलम्ब फीस को पूरी तरह से अधित्यक्त किया जाता है जहाँ कुल देय राज्य कर कि राशि शून्य है। " ।
2. यह अधिसूचना 25 जून 2020 से प्रभावी की गयी समझी जाएगी ।

In pursuance of the provisions of clause ( 3) of article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Notification No. 506/2020/ 6( 120 ) /XXVII ( 8 ) /2020/CT- 57 , dated July 22, 2020 for general information.

No. 506/2020/6 ( 120 ) /XXVII ( 8 ) / 2020 / CT-57 - WHEREAS , the State Government is satisfied that it is expedient so to do in public interest ;
NOW, THEREFORE , in exercise of the powers conferred by section 128 of the Uttarakhand Goods and Services Tax Act, 2017 (Act No. 06 of 2017 ) (hereafter in this notification referred to as the said Act) , read with section 148 of the said Act , the Governor , on the recommendations of the Council , is pleased to allow to make the following further amendments in the notification of the Government of Uttarakhand No. 97/2019/14 ( 120) /XXVII ( 8 )/ 2018/CT- 76 dated 24th Januay, 2019 (as amended from time to tinie ) , namely:-
In the said notification , after the third proviso , the following provisos shall be inserted, namely: -
"Provided also that for the class of registered persons mentioned in column (2) of the Table ofthe above proviso , who fail to furnish the returns for the tax period as specified in column (3 ) of the said Table , according to the condition mentioned in the corresponding entry in column ( 4 ) ofthe said Table, but furnishes the said return till the 30thday ofSeptember, 2020, the total amount of late fee payable under secțion 47of the said Act, shall stand waived which is in excess of two hundred and fifty rupees and shall stand fully waived for those taxpayers where the total amount ofstate tax payable in the said return is nil:
Provided also that for the taxpayers having an aggregate turnover of more than rupees 5 crores in the preceding financial year, who fail to furnish the return in FORM GSTR-3B for the months of May, 2020 to July, 2020 , by the due date but furnish the said return till the 30th day of September, 2020, the total amount of late fee under section 47 of the said Act, shall stand waived which is in excess of two hundred and fifty rupees and shall stand fully waived for those taxpayers where the total amount of state tax payable in the said return is nil. " .
2. This notification shall be deemed to have come into effect from the 25th day of June, 2020.

संख्या507/2020/6 (120)/XXVII (8 ) /2020 /CT -58- राज्यपाल, उत्तराखण्ड माल और सेवा कर अधिनियम, 2017 (अधिनियम संख्या 06 , वर्ष 2017 ) की धारा 164 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , परिषद् की सिफारिशों पर, उत्तराखण्ड माल और सेवा कर नियम, 2017 को अग्रेत्तर संशोधित करने के लिए निम्नलिखित नियम बनाते है; अर्थात्-

(1 ) इन नियमों का संक्षिप्त नाम उत्तराखण्ड माल और सेवा कर (आठवां संशोधन) 1.

(2) ये 01 जुलाई, 2020 से प्रवृत्त होंगे ।

2. उत्तराखण्ड माल और सेवा कर नियम, 2017 (जिसे इसके पाश्चात् उक्त नियम कहा गया है) के नियम 67क के स्थान पर निम्नलिखित नियम अन्तःस्थापित किया जाएगा; अर्थात्-
67क. लघु संदेश सेवा सुविधा के द्वारा विवरणी या जावक आपूर्तियों का ब्यौरा प्रस्तुत करने का प्रबंध-
इस अध्याय में किसी बात के होते हुए भी, ऐसे रजिस्ट्रीकृत व्यक्ति के मामले में जिसे धारा 39 के अंतर्गत प्ररूप . जीएसटीआर -3 ख में किसी कर अवधि की 'शून्य' विवरणी भरना अपेक्षित हो या जिसका धारा 37 अंतर्गत के प्ररूप जीएसटीआर -1 में किसी कर अवधि का जावक आपूर्तियों का ब्यौरा शून्य हो, इलेक्ट्रॉनिक तरीके से भरे जाने के किसी भी संदर्भ में उक्तः विवरणियां जावक आपूर्तियों का ब्यौरा को रजिस्ट्रीकृत मोबाइल का प्रयोग करके लघु संदेश. सेवा के माध्यम से भरे जाने की बात भी शामिल होगी और उक्त विवरणी या जावक आपूर्तियों के ब्यौरे का सत्यापन उसके रजिस्ट्रीकृत मोबाइल नंबर आधारित 'वन टाइम पासवर्ड' की सुविधा के आधार पर किया जाएगा ।
स्पष्टीकरणः- इस नियम के प्रयोजन के लिए, 'शून्यविवरणी या शून्य जावक आपूर्तियों के ब्यौरे का मतलब, किसी कर अवधि के लिए, धारा 39 के अधीन कोई ऐसी विवरणी है या धारा 37 के अधीन कोई ऐसी जावक आपूर्तियों का ब्यौरा है, जिसमें प्ररूप जीएसटीआर- उख या प्ररूप जीएसटीआर-1 की सभी सारणी में शून्य दर्शाया गया हो या उसमें कोई प्रविष्टि न हो, जैसी भी स्थिति हो । "

The Uttarakhand Goods and Services Tax ( Eighth Amendment) Rules , 2020
(1) These rules may be called the Uttarakhand Goods and Services Tax (Eighth Amendment) Rules, 2020 .
Short Title and 1. Commencement
(2) They shall come into force from 1st July, 2020.
Amendment in rule 67A
2. In the Uttarakhand Goods and Services Tax Rules , 2017 ( hereinafter referred to as the said rules) , for the rule 67A, the following rule shail be substituted, namely: -
"67A . Manner of furnishing of return or details of outward supplies by short messaging service facility.-
Notwithstanding anything contained in this Chapter, for a registered person who is required to furnish a Nil return under section 39 in FORM GSTR-3B or a Nil details of outward supplies under section 37 in FORM GSTR- 1 for a tax period, any reference to electronic furnishing shall include furnishing of the said return or the details of outward supplies through a short messaging service using the registered mobile number and the said return or the details of outward supplies shall be verified by a registered mobile number based One Time Password facility.
Explanation. For the purpose of this rule, a Nil return or Nil details of outward supplies shall mean a return under section 39 or details of outward supplies under section 37 , for a tax period that has nil or no entry in all the Tables in FORM GSTR- 3B or FORM GSTR - 1 , as the case may be. "
