संख्या-53 / ई -14626 /VII - A- 2 /2025-चूंकि, भारत सरकार द्वारा देश में औद्योगिक / आर्थिक गलियारों के चतुर्भुज निर्माण के लिए राष्ट्रीय कार्यक्रम के तहत उत्तराखण्ड राज्य में भी संयुक्त उपक्रम गठित कर समेकित निर्माण समूह विकसित किया जाना है तथा इस हेतु किये गये समझौते के अनुपालन में राज्य द्वारा NICDC Uttarakhand Industrial Township Ltd. नाम से गठित SPV को Planning Authority के रूप में अधिकृत किया जाना है ;
और चूंकि, अधिसूचना संख्या-30 / VII- A-2/ 2022 / 33- सिडकुल/ 2015, दिनांक 07.01.2022 के द्वारा जनपद ऊधमसिंहनगर के अन्तर्गत ग्राम खुरपिया, बण्डिया, देवरिया, गौरीकला एवं भूड़ागौरी की AKIC परियोजना हेतु अधिसूचित 1019.631 एकड़ भूमि को Industrial Township के रूप में अधिसूचित किया जाना है (जिसे आगे उक्त अधिसूचित क्षेत्र का आंशिक भाग कहा गया है) । उक्त अधिसूचित क्षेत्र के आंशिक भाग के अन्तर्गत आने वाली भूमि के खसरा की विस्तृत सूची संलग्न है;
और चूंकि, उक्त कम्पनी के पास कम्पनी अधिनियम, 2013 के अधीन निगमन प्रमाण-पत्र है;
और चूंकि, अमृतसर- कोलकाता औद्योगिक कॉरिडोर परियोजना हेतु SHA एवं SSA समझौता दिनांक 30.04.2022 को हस्ताक्षरित हुआ एवं 21.10.2022 को NICDC Uttarakhand Industrial Township Ltd. नाम से SPV का गठन किया गया;
और चूंकि SSA के खण्ड 3.2 ( iv )( a ) , ( b ) , ( c ) , (d) , (e) , (f) एवं 3.4.2 (ii ) ( a ) , ( b ) , (c ) , (d), (e ) , (f) , (g ) में Planning Authority का उल्लेख है;
और चूंकि SSA के खण्ड 3.1 (i ) एवं 3.5 SHA के खण्ड 3.3.3 में औद्योगिक नगरी (Industrial Township ) का उल्लेख है;
और चूंकि उत्तर प्रदेश औद्योगिक क्षेत्र विकास अधिनियम , 1976 (उत्तराखण्ड में यथाप्रवृत्त) की धारा 51 , सपठित उत्तर प्रदेश औद्योगिक क्षेत्र विकास (संदेह निवारण और वैधीकरण) अधिनियम, 1991 की धारा 2 के अनुसार राज्य सरकार साधारण अथवा विशेष आदेश के द्वारा इस अधिनियम के अन्तर्गत प्रयोग की जाने वाली शक्तियों का प्रयोग करने हेतु किसी प्राधिकरण अथवा अधिकारी को प्राधिकृत कर सकते हैं;
और चूंकि, उपरोक्त वर्णित कार्यक्रम के क्रियान्वयन के लिए राज्य द्वारा NICDC Uttarakhand Industrial Township Ltd. नाम से गठित SPV को Planning Authority के रूप में प्राधिकृत किया जाना है । ऐसे में उत्तर प्रदेश औद्योगिक क्षेत्र विकास अधिनियम, 1976 (उत्तराखण्ड में यथाप्रवृत्त) की धारा 51 , सपठित उत्तर प्रदेश औद्योगिक क्षेत्र विकास (संदेह निवारण और वैधीकरण ) अधिनियम , 1991 की धारा 2 के अन्तर्गत राज्य सरकार NICDC Uttarakhand Industrial Township Ltd. नाम से गठित SPV को Planning Authority के रूप में प्राधिकृत कर सकती है;
और चूंकि भारत के संविधान के अनुच्छेद 243 थ के परन्तुक में यह उपबन्ध है कि राज्य किसी क्षेत्र को औद्योगिक नगरी के रूप में अधिसूचित कर सकता है ;
ऐसे में भारत के संविधान के अनुच्छेद 243 थ के परन्तुक के अन्तर्गत राज्य सरकार अधिसूचना संख्या-30 दिनांक 07.01.2022 के द्वारा जनपद ऊधमसिंह नगर के अन्तर्गत (2)
ग्राम खुरपिया, बण्डिया, देवरिया, गौरीकला एवं भूड़ागौरी की AKIC परियोजना हेतु अधिसूचित 1019.631 एकड़ भूमि को औद्योगिक नगरी (Industrial Township ) के रूप में अधिसूचित किया जाना विधिपूर्ण है;
अतएव अब राज्यपाल-
(क) उत्तर प्रदेश औद्योगिक क्षेत्र विकास अधिनियम , 1976 (उत्तराखण्ड में यथाप्रवृत्त) की धारा , 51 , सपठित उत्तर प्रदेश औद्योगिक क्षेत्र विकास (संदेह निवारण और वैधीकरण) अधिनियम, 1991 की धारा 2 के अन्तर्गत NICDC Uttarakhand Industrial Township Ltd. नाम से गठित SPV को SSA ड्रॉफ्ट के खण्ड-3.2 के अधीन Planning Authority के रूप में प्राधिकृत करते हैं ।
(ख) उत्तर प्रदेश औद्योगिक क्षेत्र विकास अधिनियम, 1976 (उत्तराखण्ड में यथा प्रवृत्त) की धारा 2 (घ) सपठित उत्तर प्रदेश औद्योगिक क्षेत्र विकास (संदेह निवारण और वैधीकरण) अधिनियम, 1991 की धारा 2 के द्वारा AKIC समेकित निर्माण समूह (Integrated Manufacturing Cluster ) हेतु अधिसूचना संख्या -30 दिनांक 07.01.2022 के द्वारा जनपद उधमसिंहनगर के अन्तर्गत ग्राम खुरपिया, बण्डिया, देवरिया, गौरीकला एवं भूड़ागौरी की AKIC परियोजना हेतु अधिसूचित 1019.631 एकड़ भूमि को संविधान के अनुच्छेद-243 थ के अन्तर्गत औद्योगिक टाउनशिप के रूप में अधिसूचित करते हैं ।

In pursuance of the provision of Clause ( 3 ) of article 348 of " the Constitution of India" , the Governor is pleased to order the publication of following English translation of Notification No. 53/E - 14626/VII - A- 2/2025/ 04 ( 13 ) 2023 Dated- February 06, 2025 for general information.
NOTIFICATION
February 06 , 2025
No. 53 /E -14626 /VII -A- 2/2025/04(13) 2023 --Whereas , under the national program for the quadrilateral construction of Industrial/Economic corridors in the country by the Government of India , an integrated construction group is to be developed by forming a joint venture in the state of Uttarakhand and in compliance with the agreement made for this , the SPV formed in the name of the state NICDC Uttarakhand Industrial Township Ltd , is to be authorized as the Planning Authority;
: And WHEREAS, 1019.631 acres land notified for AKIC project of village Khurpia , Barıdiya , Deoria, Gaurikala and Bhudagauri within district Udham Singh Nagar vide notification No - 30/VII- A-2/2022 /33 - Siidcul/ 201.5 dated 07.01.2022 . The land is to be nitified as Industrial Township . (hereinafter referred to as the partial part of the said notified area ) . The detailed list of Khasra of theland coming under the partial part of the said notified area is attached;
AND WHEREAS, the said company has Certificate of incorporation under the Companies Act, 2013;
AND WHEREAS , the SHA and SSA agreement for Amritsar- Kolkata Industrial Corridor Project was signed on 30.04.2022 and SPV was formed by the name NICDC, Uttarakhand Industrial Township Ltd. On 21.10.2022;
AND WHEREAS, Clause 3.2 (iv) ( a ) , ( b ) , ( c) , ( d ) , ( e ) , (f ) and 3.4.2 ( ii ) ( a ) , ( b ) , ( c ) , ( d ) , ( e ) , ( f ) , (g) of the SSA the planning Authority is mentioned;
AND WHEREAS, in Clause 3.1 and 3.5 of the SSA and Clause 3.3.3 of the SHA, Industrial Township has been mentioned;
AND WHEREAS in accordance with section 51 of the Uttar Pradesh Industrial Area development Act 1976 ( as applicable to Uttarakhand ) , read with section 2 of the Uttar Pradesh Industrial Area Development ( Removal of Doubts and Validation ) Act , 1991 , the State Government may, by general or special order authorize any authority or officer to exercise the powers to be exercised under this Act ;
AND WHEREAS the SPV formed in the name of NICDC Uttarakhand Industrial Township Ltd. has is to be authorized as the Planning Authority by the State for the implementation of the above mentioned programme . As such , under Section 51 of the Uttar Pradesh Industrial development Act , 1976 ( as applicable in Uttarakhand ) , read with section 2 of the Uttar Pradesh Industrial Area Development ( Removal of Doubts and Validation ) Act , 1991 , the State : Government may authorize the SPV formed in the name of NICDC Uttarakhand Industrial Township Ltd. as Planning Authority ;

AND WHEREAS it is provided in the proviso of article 243Q of the Constitution of India that the State may notify any area as an industrial township;
As such , under the proviso to Article 243Q of the Constitution of India it is lawful for the State Government to notify 1019.631 acres of land notified for the AKIC project of Khurpia , Bandia , Deoria , Gaurikala and Budagouri under District Udham Singh Nagar by the Notification No. 30 dated 07.01.2022, as Industrial Township for;
Now therefore the Governor-
( a) Under Section 51 of the Uttar Pradesh Industrial Area Development Act , 1976 ( as applicable in Uttarakhand ) , read with section 2 of the Uttar Pradesh Industrial Area Development( Rernoval of Doubts and Validation ) Act, 1991, authorize the SPV formed in the name of NICDC Uttarakhand Industrial Township Ltd. as Planning Authority under Clause-3.2 of the SSA draft .
(b) By Clause (d) of section 2 of the Uttar Pradesh Industrial Area Development Act - 1976 ( as applicable in Uttarakhand ) , read with section 2 of the Uttar Pradesh Industrial Area Development ( Removal of Doubts and Validation ) Act , 1991 for AKIC Integrated Manufacturing Cluster by Notification No. 30 dated 07.01.2022 , Villages Khurpia , Bandia , Deoria , Gaurikala and Budagouri under District Udham singh Nagar . 1019.631 acres of land notified for AKIC project notify as industrial township under Article- 243Q of the Constitution of India .
