संख्या-444 / XX - 5-2024-03 ( 58 ) 2022 टी० सी० -चूंकि, केन्द्रीय सरकार ने विधि - विरूद्ध क्रियाकलाप (निवारण ) अधिनियम , 1967 ( 1967 का 37) की धारा 3 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , स्टूडेंट्स इस्लामिक मूवमेंट ऑफ इण्डिया ( सिमी) को अधिसूचना संख्या का० आ० 354 (अ ) तारीख 29 जनवरी , 2024 द्वारा ' विधिविरूद्ध संगम' घोषित किया है;
और, चूंकि उक्त अधिनियम की धारा 42 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार ने तारीख 5 फरवरी , 2024 की अधिसूचना का.आ. 475 (अ) द्वारा निदेश दिया है कि सभी राज्य सरकारें और संघ राज्य क्षेत्र प्रशासन भी उक्त अधिनियम की धारा 7 और धारा 8 के अधीन केन्द्रीय सरकार द्वारा प्रयोग की जाने वाली शक्तियों का प्रयोग करेंगें;
और, चूंकि आदेश संख्या 14017 / 8 / 2024- एनआई- एमएफओ तारीख 05 फरवरी , 2024 के द्वारा सूचित किया गया है कि राज्य सरकार एवं संघ राज्य क्षेत्र प्रशासन द्वारा प्रयोग करने के लिए निदेशित शक्तियों का प्रयोग सभी राज्य सरकारों और संघ राज्य क्षेत्र प्रशासनों के किसी अधीनस्थ व्यक्ति द्वारा किया जा सकता है;
और, चूंकि उक्त अधिनियम की धारा 42 के अधीन केन्द्रीय सरकार द्वारा इस आशय के अनुमोदन की सूचना दी गयी है कि सभी राज्य सरकारें और संघ राज्य क्षेत्र प्रशासन, लिखित में आदेश द्वारा निदेश दे सकेंगे कि कोई शक्ति जो उसके द्वारा प्रयोग करने के लिए निदेशित है , ऐसी परिस्थितियों और शर्तों के अंतर्गत, जैसा कि निदेश में विनिर्दिष्ट हो , यथास्थिति, राज्य सरकार या संघ राज्य क्षेत्र प्रशासन के किसी अधीनस्थ व्यक्ति द्वारा भी प्रयोग की जाएगी ।

अतः अब, उपरोक्त प्रत्योजित शक्तियों का प्रयोग करते हुए , राज्य सरकार निदेश देती है कि सभी जिला मजिस्ट्रेट एवं वरिष्ठ पुलिस अधीक्षक/ पुलिस अधीक्षक तद्नुसार शक्तियों को प्रयोग करेंगे ।

Inpursuance of the provision of Clause ( 3 ) of Article 348 of the Constitution of India , the Governor is pleased to order the publication of following English translation of Notification No. 444/XX - 5-2025-03 ( 58 ) /2022 T.C. , dated April 02 , 2025 for general Information .
NOTIFICATION

No. 444 /XX - 5-2025-03 ( 58 ) / 2022 T.C. --Whereas , the Central Government , in exercise of powers conferred by sub - section ( 1 ) of section 3 of the Unlawful Activities ( Prevention ) Act , 1967 ( 37 of 1967 ) , has declared Students Islamic Movement of India ( SIMI ) as ' unlawful association ' vide notification number S.O. 354 ( E ) dated the 29th January, 2024 ;
And , whereas, in exercise of the powers conferred by section 42 of the said Act, the Central Government have directed vide Notification S.O. 475 (E ) dated 05th February, 2024, that all the State and Union territory administrations shall also exercise the powers exercisable by the Central Government under section 7 and section 8 of the said Act ;
And, whereas , vide order No. 14017 /8 /2024 - NI - MFO, dated 05th February , 2024 it has been conveyed that the powers directed to be exercised by all the State Governments and Union territory administrations as above , may be exercised by any person subordinate to the State Government and Union territory administrations ;

And, Whereas , the approval of the Central Government under section 42 of the said Act is hereby conveyed that State Governments and Union territory administrations may , by order in writing , direct that any power which has been directed to be exercised by it, shall, in such circumstances and under such conditions , as may be specified in the direction, be exercised by any person subordinate to the State Government or the Union territory administrations , as the casemay be.
Now , Therefore , in exercise of the aforesaid delegated powers , the State Government hereby directs that all the District Magistrates , the Senior Superintendents of Police/Superintendents of Police shall exercise the powers accordingly.
