संख्या-815 / XII ( 1 )/ 86 ( 11 ) 2008 / 2025- राज्यपाल , उत्तराखण्ड पंचायतीराज अधिनियम, 2016 (समय- समय पर यथासंशोधित) की धारा 10 - क , धारा 11 , धारा 55- क, धारा 56 , धारा 92- क एवं धारा 93 सपठित धारा 126 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा इस विषय पर विद्यमान समस्त नियमों और आदेशों का अधिक्रमण करते हुए, निम्नलिखित नियमावली बनाते है, अर्थात्:-

उत्तराखण्ड ग्राम पंचायत, क्षेत्र पंचायत तथा जिला पंचायत (स्थानों और पदों का आरक्षण और आवंटन) नियमावली, 2025

संक्षिप्त नाम और 1 .

प्रारम्भ

(1 ) इस नियमावली का संक्षिप्त नाम उत्तराखण्ड ग्राम पंचायत, क्षेत्र पंचायत तथा जिला पंचायत (स्थानों और पदों का आरक्षण और आवंटन) नियमावली, 2025 है ।

(2) यह तुरन्त प्रवृत्त होगी ।

परिभाषाएं

2. (1 ) जब तक कि प्रसंग या सन्दर्भ से अन्यथा अपेक्षित न हो, इस नियमावली में:-

(क) ' अधिनियम" से उत्तराखण्ड पंचायतीराज अधिनियम, 2016 अभिप्रेत है;

(ख) किसी खण्ड के संबंध में " संघटक ग्राम पंचायत " का अर्थ उस ग्राम पंचायत से है जो उस खण्ड के भीतर क्षेत्राधिकार का प्रयोग करती हो;

(ग) "खण्ड" का वही अर्थ है जो उत्तराखण्ड पंचायतीराज अधिनियम, 2016 में उनके लिये समनुदेशित है ;

(घ) "प्रादेशिक निर्वाचन क्षेत्र " से-

(एक) किसी ग्राम पंचायत के सन्दर्भ में , अधिनियम की धारा 130 की उपधारा (1 ) में निर्दिष्ट प्रादेशिक निर्वाचन क्षेत्र अभिप्रेत है ,

(दो) किसी क्षेत्र पंचायत के सन्दर्भ में , अधिनियम की धारा 50 की उपधारा (3) के खण्ड ( क) तथा ( 2)

धारा 130 की उपधारा (1 ) में निर्दिष्ट प्रादेशिक निर्वाचन क्षेत्र अभिप्रेत है , और

(तीन) किसी जिला पंचायत के सन्दर्भ में , अधिनियम की धारा 86 की उपधारा (2) के खण्ड (ख) तथा धारा 130 की उपधारा (1 ) में निर्दिष्ट प्रादेशिक निर्वाचन क्षेत्र अभिप्रेत है;

(2) उन शब्दों और पदों के, जो इस नियमावली में प्रयुक्त हैं, और परिभाषित नहीं हैं , किन्तु उत्तराखण्ड पंचायतीराज अधिनियम , 2016 में परिभाषित है के क्रमशः वही अर्थ होंगे जो अधिनियम में उनके लिए निर्दिष्ट हैं ।

आरक्षित किये जाने वाले स्थानों और पदों की संख्या

अधिनियम की धारा 10 - क या धारा 11 या धारा 55- (क) या धारा 56 या धारा 92- (क) या धारा 93 के उपबन्धों के अनुसार अनुसूचित जनजातियों , अनुसूचित जातियों , या पिछड़े वर्गों के लिए आरक्षित किए जाने वाले स्थानों या पदों की संख्या की संगणना करने में यदि शेष भाजक के आधे से कम न हो तो भागफल में एक बढ़ा दिया जाएगा और यदि शेष भाजक के आधे से कम हो तो इसे छोड़ दिया जाएगा और इस प्रकार प्राप्त संख्या, यथास्थिति, अनुसूचित जनजातियों या अनुसूचित जातियों या पिछड़े वर्गों के लिए आरक्षित किए जाने वाले स्थानों या पदों की संख्या होगीः

परन्तु यह कि अनुसूचित जातियों , अनुसूचित जनजातियों एवं अन्य पिछड़े वर्गों का कुल आरक्षण कुल स्थानों एवं पदों की संख्या के 50 प्रतिशत से अधिक नहीं होगा ।

चक्रानुक्रम द्वारा स्थानों का आवंटन

(1) अन्य उपनियमों के उपबन्धों के अधीन रहते हुए किसी ग्राम पंचायत या किसी क्षेत्र पंचायत या किसी जिला पंचायत में आरक्षित स्थान , यथास्थिति उस ग्राम पंचायत या क्षेत्र पंचायत या जिला पंचायत में भिन्न-भिन्न प्रादेशिक निर्वाचन क्षेत्रों को निम्नलिखित क्रम में आवंटित किए जायेंगे-

(क) अनुसूचित जनजातियों की महिलायें,

(ख) अनुसूचित जनजातियाँ ,

(ग) अनुसूचित जातियों की महिलायें,

(घ) अनुसूचित जातियाँ ,

(ङ) पिछड़े वर्गों की महिलायें,

(च) पिछड़े वर्ग , और

(छ) महिलायें ।

( 3 )

(2) यदि किसी पंचायत क्षेत्र में अनुसूचित जनजातियों की या अनुसूचित जातियों की या पिछड़े वर्गों की जनसंख्या के आधार पर केवल एक स्थान यथास्थिति, अनुसूचित जनजातियों के लिए या अनुसूचित जातियों के लिए या पिछड़े वर्गों के लिए आरक्षित किया जा सकता है, तो ऐसा स्थान, यथास्थिति, अनुसूचित जनजातियों की या अनुसूचित जातियों की या पिछड़े वर्गों की महिला के लिए होगा ।

(3) यदि किसी पंचायत क्षेत्र में जनसंख्या के आधार पर कोई स्थान अनुसूचित जनजातियों के लिए या अनुसूचित जातियों के लिए या पिछड़े वर्गों के लिए आरक्षित नहीं किया जा सकता है तो उपनियम (1 ) में उल्लिखित क्रम का इस प्रकार अनुसरण किया जाएगा मानो इसमें, यथास्थिति, अनुसूचित जनजातियों का या अनुसूचित जातियों का या पिछड़े वर्गों का कोई निर्देश न था ।

(4) नियम 3 में यथा उपबन्धित स्थानों की संख्या भिन्न- भिन्न प्रादेशिक निर्वाचन क्षेत्रों की जनसंख्या के अवरोही क्रम के आधार पर आवंटित की जाएगी, अर्थात् किसी ग्राम पंचायत के या किसी क्षेत्र पंचायत के या किसी जिला पंचायत के प्रादेशिक निर्वाचन क्षेत्रों में अनुसूचित जनजातियों की सर्वाधिक जनसंख्या वाला प्रादेशिक निर्वाचन क्षेत्र उनको आवंटित किया जाएगा , और अनुसूचित जातियों की सर्वाधिक जनसंख्या वाला प्रादेशिक निर्वाचन क्षेत्र उनको आवंटित किया जाएगा और पिछड़े वर्गों की सर्वाधिक जनसंख्या वाला प्रादेशिक निर्वाचन क्षेत्र उनको आवंटित किया जाएगा और पश्चात्वर्ती निर्वाचन में आवंटन उपर्युक्त रीति से किया जाएगा किन्तु इस प्रकार कि जहां तक हो सके , वह प्रादेशिक निर्वाचन क्षेत्र जो पूर्ववर्ती निर्वाचनों में अनुसूचित जनजातियों को आवंटित था , वह अनुसूचित जनजातियों को आवंटित नहीं किया जाएगा और जो प्रादेशिक निर्वाचन क्षेत्र अनुसूचित जातियों को आवंटित था वह अनुसूचित जातियों को आवंटित नहीं किया जाएगा और जो प्रादेशिक निर्वाचन क्षेत्र पिछड़े वर्गों को आवंटित था, वह पिछड़े वर्गों को आवंटित नहीं किया जायेगाः

परन्तु यह कि यदि किसी निर्वाचन में अनुसूचित जनजातियों की या अनुसूचित जातियों की या पिछड़े वर्गों की जनसंख्या, प्रादेशिक निर्वाचन क्षेत्रवार अभिनिश्चित नहीं की जा सकती है , तो प्रादेशिक निर्वाचन क्षेत्रों में, यथास्थिति अनुसूचित जनजातियों के या अनुसूचित (4).

जातियों के या पिछड़े वर्गों के परिवारों को संख्या के आधार पर अवरोही क्रम अवधारित किया जा सकता है ।

(

5) उपनियम (4) के अधीन अनुसूचित जनजातियों, अनुसूचित जातियों या पिछड़े वर्गों को आवंटित प्रादेशिक निर्वाचन क्षेत्रों के आधे से अन्यून प्रादेशिक निर्वाचन क्षेत्र यथास्थिति, अनुसूचित जनजातियों , अनुसूचित जातियों या पिछड़े वर्गों की महिलाओं को आवंटित किए जायेंगे ।

(6) उपनियम (5) के अधीन आरक्षित प्रादेशिक निर्वाचन क्षेत्रों

को सम्मिलित करते हुए कुल संख्या के आधे से अन्यून प्रादेशिक निर्वाचन क्षेत्र महिलाओं को आवंटित किए जायेंगे, किन्तु इस प्रकार कि जिन प्रादेशिक निर्वाचन क्षेत्रों में सबसे अधिक जनसंख्या है, जिसमें अनुसूचित जनजातियों , अनुसूचित जातियों और पिछड़े वर्गों की जनसंख्या सम्मिलित नहीं है , वे उनको आवंटित किए जाएंगे और पश्चात्वर्ती निर्वाचन में आवंटन उपर्युक्त रीति से किया जाएगा, किन्तु यथाशक्य , पूर्ववर्ती निर्वाचनों में महिलाओं को आवंटित प्रादेशिक निर्वाचन क्षेत्र महिलाओं को आवंटित नहीं किए जायेंगे ।

चक्रानुक्रम द्वारा पदों का आवंटन

(1 ) अनुसूचित जनजातियों, अनुसूचित जातियों और पिछड़े वर्गों के लिए नियम 3 में यथा संगणित प्रधानों के पदों की संख्या, संघटक ग्राम पंचायतों को आवंटित किये जाने के लिए खण्डवार निम्नलिखित रीति से वितरित की जायेगी-

(क) खण्ड में अनुसूचित जनजातियों के लिये प्रधानों के पदों की संख्या, राज्य की कुल जनसंख्या में राज्य में उनकी जनसंख्या के अधिकतम अनुपात के अधीन रहते हुए , खण्ड में प्रधानों के पदों की कुल संख्या के यथाशक्य उसी अनुपात में होगी जो खण्ड में कुल जनसंख्या के अनुपात में खण्ड में उनकी जनसंख्या होः

परन्तु यह कि नियम 3 में यथा संगणित प्रधानों के पदों की अवितरित संख्या की दशा में, खण्ड की कुल जनसंख्या में उनकी जनसंख्या के अनुपात के अवरोही क्रम में, केवल उन्हीं खण्डों में उन्हें पुनः वितरित किया जायेगा जहां खण्ड में उनकी जनसंख्या का अनुपात राज्य की कुल जनसंख्या में उनकी जनसंख्या के अनुपात से अधिक हो ।

(ख) खण्ड में अनुसूचित जातियों के लिये प्रधानों के पदों ( 5)

की संख्या, राज्य की कुल जनसंख्या में राज्य में उनकी जनसंख्या के अधिकतम अनुपात के अधीन रहते हुए, खण्ड में प्रधानों के पदों की कुल संख्या के यथाशक्य उसी अनुपात में होगी जो खण्ड में कुल जनसंख्या के अनुपात में खण्ड में उनकी जनसंख्या होः

परन्तु यह कि नियम 3 में यथा संगणित प्रधानों के पदों की अवितरित संख्या की दशा में खण्ड की कुल जनसंख्या में उनकी जनसंख्या के अनुपात के अवरोही क्रम में, केवल उन्हीं खण्डों में उन्हें पुनः वितरित किया जायेगा जहां खण्ड की कुल जनसंख्या में उनकी जनसंख्या का अनुपात राज्य में उनकी जनसंख्या के अनुपात से अधिक हो ।

(ग) खण्ड में पिछडे वर्गों के लिये प्रधानों के पदों की संख्या, खण्ड में प्रधानों के पदों की कुल संख्या के यथाशक्य उसी अनुपात में होगी जो खण्ड में कुल जनसंख्या के अनुपात में खण्ड में उनकी जनसंख्या होः

परन्तु यह कि किसी खण्ड में अनुसूचित जातियों, अनुसूचित जनजातियों एवं पिछड़े वर्गों का कुल आरक्षण प्रधानों के पदों की कुल संख्या के 50 प्रतिशत से अधिक नहीं होगा :

परन्तु यह और कि नियम 3 में यथा संगणित प्रधानों के पदों की अवितरित संख्या की दशा में, खण्ड की कुल जनसंख्या में उनकी जनसंख्या के अनुपात के अवरोही क्रम में, केवल उन्हीं खण्डों में पुनः वितरित किया जायेगा जहां खण्ड की कुल जनसंख्या में उनकी जनसंख्या का अनुपात राज्य की कुल जनसंख्या में उनकी जनसंख्या के अनुपात से अधिक हो ।

(2) उपनियम (1) के अधीन यथा अवधारित अनुसूचित जनजातियों , अनुसूचित जातियों और पिछड़े वर्गों के लिए प्रधानों के पदों की संख्या उस खण्ड में भिन्न-भिन्न ग्राम पंचायतों को पंचायत क्षेत्र की कुल जनसंख्या में उनकी जनसंख्या के अनुपात के आधार पर अवरोही क्रम में आवंटित की जायेगी अर्थात् उस खण्ड की ग्राम पंचायतों में से वह ग्राम पंचायत जिसके प्रादेशिक क्षेत्र में अनुसूचित ( 6 )

जनजातियों की जनसंख्या का अनुपात सबसे अधिक हो, उनको आवंटित की जाएगी और वह ग्राम पंचायत जिसके प्रादेशिक क्षेत्र में अनुसूचित जातियों की जनसंख्या का अनुपात सबसे अधिक हो, उनको आवंटित की जाएगी और वह ग्राम पंचायत जिसके प्रादेशिक क्षेत्र में पिछड़े वर्गों की जनसंख्या की अनुपात सबसे अधिक हो , उनको आवंटित की जाएगी और पश्चात्वर्ती निर्वाचन में आवंटन उपर्युक्त रीति से किया जायेगा किन्तु इस प्रकार कि जहां तक हो सके पूर्ववर्ती निर्वाचनों में अनुसूचित जनजातियों को आवंटित ग्राम पंचायत अनुसूचित जनजातियों को आवंटित नहीं की जायेंगी और अनुसूचित जातियों को आवंटित ग्राम पंचायत अनुसूचित जातियों को आवंटित नहीं की जायेगी और पिछड़े वर्गों को आवंटित ग्राम पंचायत पिछड़े वर्गों को आवंटित नहीं की जायेगीः

परन्तु यह कि अनुसूचित जनजातियों या अनुसूचित जातियों या पिछड़े वर्गों की किसी पंचायत क्षेत्र में जनसंख्या दस से कम हो तो ऐसे पंचायत क्षेत्र की ग्राम पंचायत के प्रधान का पद यथास्थिति अनुसूचित जनजातियों, अनुसूचित जातियों या पिछडे वर्गों को आवंटित नहीं किया जाएगा ।

(3) उपनियम (2) के अधीन अनुसूचित जनजातियों, अनुसूचित जातियों या पिछड़े वर्गों को आवंटित ग्राम पंचायतों की आधे से अन्यून ग्राम पंचायतें, यथास्थिति, अनुसूचित जनजातियों, अनुसूचित जातियों या पिछड़े वर्गों की महिलाओं को आवंटित की जायेगी ।

(4) उपनियम (3) के अधीन महिलाओं के लिये आरक्षित प्रधानों के पदों की संख्या को सम्मिलित करते हुए खण्ड में प्रधानों के पदों की कुल संख्या के आधे से अन्यून प्रधानों के पदों को महिलाओं को आवंटित किया जायेगा किन्तु इस प्रकार कि उन्हें आवंटित जिन ग्राम पंचायतों के प्रादेशिक क्षेत्रों में सबसे अधिक जनसंख्या है , जिसमें अनुसूचित जनजातियों, अनुसूचित जातियों और पिछड़े वर्गों की जनसंख्या सम्मिलित नहीं है . वे उनको आवंटित किये जायेंगे और पश्चात्वर्ती निर्वाचन में आवंटन उपर्युक्त रीति से किया जायेगा, किन्तु इस प्रकार कि पूर्ववर्ती निर्वाचनों में महिलाओं को आवंटित ग्राम पंचायतें महिलाओं को आवंटित नहीं की जायेगी ।

(5) नियम 4 के उपनियम (1 ) , (2) और (3 ) के उपबन्ध इस ( 7)

नियम के अधीन प्रधानों के पदों के आवंटन पर यथावश्यक परिवर्तनों सहित लागू होंगे ।

प्रमुखों के पदों का आवंटन

(1 ) अनुसूचित जनजातियों , अनुसूचित जातियों और पिछड़े वर्गों के लिए नियम 3 में यथा संगणित प्रमुखों के पदों की संख्या संघटक क्षेत्र पंचायतों को आवंटित किए जाने के लिए जिलेवार निम्नलिखित रीति से वितरित की जाएगी-

(क) जिले में अनुसूचित जनजातियों के लिए प्रमुखों के पदों की संख्या, राज्य की कुल जनसंख्या में राज्य में उनकी जनसंख्या के अनुपात के अधीन रहते हुए , जिले में प्रमुखों के पदों की कुल संख्या के यथाशक्य उसी अनुपात में होगी , जो जिला पंचायत में उनकी जनसंख्या का जिला पंचायत की कुल जनसंख्या में अनुपातहोः

परन्तु यह कि नियम 3 में यथा संगणित प्रमुखों के पदों की अवितरित संख्या की दशा में, जिला पंचायत की कुल जनसंख्या में उनकी जनसंख्या के अनुपात के अवरोही क्रम में, केवल उन्हीं जिला पंचायतों में पुनः वितरित किया जाएगा, जहाँ जिला पंचायत की कुल जनसंख्या में उनकी जनसंख्या का अनुपात राज्य की कुल जनसंख्या में उनकी जनसंख्या के अनुपात से अधिक हो ।

(ख) जिले में अनुसूचित जातियों के लिए प्रमुखों के पदों की संख्या, राज्य की कुल जनसंख्या में राज्य में उनकी जनसंख्या के अनुपात के अधीन रहते हुए , जिले में प्रमुखों के पदों की कुल संख्या के यथाशक्य उसी अनुपात में होगी, जो जिला पंचायत में उनकी जनसंख्या का जिला पंचायत की कुल जनसंख्या में अनुपात होः

परन्तु यह कि नियम 3 में यथा संगणित प्रमुखों के पदों की अवितरित संख्या की दशा में , जिला पंचायत की कुल जनसंख्या में उनकी जनसंख्या के अनुपात के अवरोही क्रम में , केवल उन्हीं जिला पंचायतों में पुनः वितरित किया जाएगा, जहाँ जिला पंचायत की कुल जनसंख्या में उनकी जनसंख्या का अनुपात राज्य की कुल जनसंख्या में उनकी जनसंख्या के अनुपात से अधिक हो ।

(ग) जिले में पिछड़े वर्गों के लिए प्रमुखों के पदों की संख्या, जिले में प्रमुखों के पदों की कुल संख्या के। यथाशक्य उसी अनुपात में होगी, जो जिला पंचायत में उनकी जनसंख्या का जिला पंचायत की कुल जनसंख्या में अनुपात होः

परन्तु यह कि जिले में अनुसूचित जातियों , * अनुसूचित जनजातियों एवं पिछड़े वर्गों का कुल आरक्षण प्रमुखों के पदों की कुल संख्या के 50 प्रतिशत से अधिक नहीं होगाः

परन्तु यह और कि नियम 3 में यथा संगणित प्रमुखों के पदों को अवितरित संख्या की दशा में , जिला पंचायत की कुल जनसंख्या में उनकी जनसंख्या के अनुपात के अवरोही क्रम में , केवल उन्हीं जिला पंचायतों में पुनः वितरित किया जाएगा , जहाँ जिला पंचायत की कुल जनसंख्या में उनकी जनसंख्या का अनुपात राज्य की कुल जनसंख्या में उनकी जनसंख्या के अनुपात से अधिक हो ।

( 2) उपनियम (1) के अधीन यथा अवधारित अनुसूचित

जनजातियों , अनुसूचित जातियों और पिछड़े वर्गों के लिए प्रमुखों के पदों की संख्या उस जिले में भिन्न-भिन्न क्षेत्र पंचायतों को पंचायत क्षेत्र में उनकी जनसंख्या का पंचायत क्षेत्र की कुल जनसंख्या में अनुपात के आधार पर अवरोही क्रम में आवंटित की जाएगी, अर्थात् उस जिले की क्षेत्र पंचायतों में से वह क्षेत्र पंचायत जिसके प्रादेशिक क्षेत्र में अनुसूचित जनजातियों की जनसंख्या का अनुपात सबसे अधिक हो, उनको आवंटित की जाएगी और वह क्षेत्र पंचायत जिसके प्रादेशिक क्षेत्र में अनुसूचित जातियों की जनसंख्या का अनुपात सबसे अधिक हो, उनको आवंटित की जाएगी, और वह क्षेत्र पंचायत जिसके प्रादेशिक क्षेत्र में पिछड़े वर्गों की जनसंख्या का अनुपात सबसे अधिक हो उनको आवंटित की जाएगी, और पश्चात्वर्ती निर्वाचन में आवंटन उपर्युक्त रीति से किया जायेगा, किन्तु इस प्रकार कि जहाँ तक हो सके, पूर्ववर्ती निर्वाचनों में अनुसूचित जनजातियों को आवंटित क्षेत्र पंचायत अनुसूचित जनजातियों को आवंटित नहीं की जायेगी और अनुसूचित जातियों को आवंटित क्षेत्र पंचायत अनुसूचित जातियों को आवंटित नहीं की जायेगी और पिछड़े वर्गों को आवंटित क्षेत्र पंचायत पिछड़े वर्गों को आवंटित नहीं की जायेगी ।

(3) उपनियम (2) के अधीन अनुसूचित जनजातियों, अनुसूचित ( 9 )

जातियों या पिछड़े वर्गों को आवंटित पंचायतों की आधे से अन्यून क्षेत्र पंचायतें यथास्थिति अनुसूचित जनजातियों, अनुसूचित जातियों या पिछड़े वर्गों की महिलाओं को आवंटित की जायेगी ।

(4) उपनियम (3 ) के अधीन महिलाओं के लिए आरक्षित प्रमुखों

के पदों की संख्या को सम्मिलित करते हुए जिले में प्रमुखों के पदों की कुल संख्या के आधे से अन्यून प्रमुखों के पदों को महिलाओं को आवंटित किया जायेगा किन्तु इस प्रकार कि उन्हें आवंटित जिन क्षेत्र पंचायतों के प्रादेशिक निर्वाचन क्षेत्रों में सबसे अधिक जनसंख्या है, जिसमें अनुसूचित जनजातियों, अनुसूचित जातियों और पिछड़े वर्गों की जनसंख्या सम्मिलित नहीं है , ये उन्हें आवंटित किए जाएंगे और पश्चात्वर्ती निर्वाचन में आवंटित उपर्युक्त रीति से किया जाएगा किन्तु, यथाशक्य, पूर्ववर्ती निर्वाचनों में महिलाओं को आवंटित क्षेत्र पंचायत महिलाओं को आवंटित नहीं किए जायेंगे ।

(5) नियम 3 में यथा उपबन्धित अनुसूचित जनजातियों, अनुसूचित जातियों और पिछड़े वर्गों के लिए अध्यक्षों की संख्या राज्य में भिन्न- भिन्न जिला पंचायतों को पंचायत क्षेत्र में उनकी जनसंख्या का पंचायत क्षेत्र की कुल जनसंख्या में अनुपात के आधार पर अवरोही क्रम में आवंटित की जाएगी अर्थात् राज्य में जिला पंचायतों में से वह जिला पंचायत जिसके प्रादेशिक क्षेत्र में अनुसूचित जनजातियों की जनसंख्या का अनुपात सबसे अधिक हो, उनको आवंटित की जाएगी और वह जिला पंचायत जिसके प्रादेशिक क्षेत्र में अनुसूचित जातियों की जनसंख्या का अनुपात सबसे अधिक हो , उनको आवंटित की जाएगी, और वह जिला पंचायत जिसके प्रादेशिक क्षेत्र में पिछड़े वर्गों की जनसंख्या का अनुपात सबसे अधिक हो , उनको आवंटित की जायेगी , और पश्चात्वर्ती निर्वाचन में आवंटित उपर्युक्त रीति से किया जायेगा , किन्तु इस प्रकार कि जहाँ तक हो सके, पूर्ववर्ती निर्वाचनों में अनुसूचित जातियों को आवंटित जिला पंचायत अनुसूचित जनजातियों को आवंटित नहीं की जायेगी और अनुसूचित जातियों को आवंटित जिला पंचायत अनुसूचित जातियों को आवंटित नहीं की जायेगी और पिछड़े वर्गों को आवंटित जिला पंचायत पिछड़े वर्गों को आवंटित नहीं की जायेगी ।

(6) उपनियम (5) के अधीन अनुसूचित जनजातियों या अनुसूचित जातियों या पिछड़े वर्गों को आवंटित जिला (10 )

पंचायतों की आधे से अन्यून जिला पंचायतें यथास्थिति, अनुसूचित जनजातियों या अनुसूचित जातियों या पिछड़े वर्गों की महिलाओं को आवंटित की जाएगी ।

( 7) उपनियम (6) के अधीन महिलाओं के लिए आरक्षित जिला

पंचायतों की संख्या को सम्मिलित करते हुए जिला पंचायतों की कुल संख्या के आधे से अन्यून जिला पंचायतों को महिलाओं को आवंटित किया जायेगा, किन्तु इस प्रकार कि उन्हें आवंटित जिन जिला पंचायतों के प्रादेशिक निर्वाचन क्षेत्रों में सबसे अधिक जनसंख्या है , जिसमें अनुसूचित जनजातियों, अनुसूचित जातियों और पिछड़े वर्गों की जनसंख्या सम्मिलित नहीं है , वे उनको आवंटित किये जायेंगे और पश्चात्वर्ती निर्वाचन में आवंटन उपर्युक्त रीति से किया जाएगा, किन्तु जहां तक हो सके, पूर्ववर्ती निर्वाचनों में महिलाओं को आवंटित जिला पंचायतें महिलाओं को आवंटित नहीं किए जायेंगे ।

(8) अध्यक्षों के पद निम्नलिखित क्रम में आवंटित किए जायेंगेः

(क) अनुसूचित जनजातियों की महिलायें;

(ख) अनुसूचित जनजातियाँ,

(ग) अनुसूचित जातियों की महिलायें;

(घ) अनुसूचित जातियाँ;

(ङ) पिछड़े वर्गों की महिलायें;

(च) पिछड़े वर्ग;

(छ) महिलायें ।

(9) उपनियम (8) के उपबन्ध इस नियम के अधीन प्रमुखों के पदों के आवंटन पर यथावश्यक परिवर्तनों सहित लागू होंगे ।

(10) नियम 4 के उपनियम (2 ) के उपबन्ध नियम 6 के अधीन पदों के आवंटन पर यथावश्यक परिवर्तनों सहित लागू होंगे ।

No.815 /XII ( 1 ) / 2025 / 86 ( 11 ) 2008 --In exercise of the powers conferred by Section 10 - A , Section 11 , Section 55 - A , Section 56 , Section 92 - A and Section 93 read with Section 126 of the Uttarakhand Panchayati Raj Act , 2016 (as amended from time to time ) , and in supersession of all existing rules and orders on this subject , the Governor is pleased to make the following rules , namely:-

The Uttarakhand Gram Panchayat , Kshettra Panchayat and Zila Panchayat (Reservation and Allotment of Seats and Offices) Rules , 2025

Commencement Short title and 1. ( 1 ) These rules may be called the Uttarakhand Gram Panchayat , Kshettra Panchayat and Zila Panchayat (Reservation and Allotment of Seats and Offices ) Rules, 2025

(2) It shall come into force at once.

Definitions

2. (1) In these rules , unless there is anything repugnant in the subject or context-

(a) "Act" means the Uttarakhand Panchayati Raj Act , 2016;

(b) " Constituent Gram Panchayat " with reference to a Khand means a Gram Panchayat exercising jurisdiction within the Khand ;

(d) "territorial constituency " in relation to-

(i) a Gram Panchayat means the territorial constituency referred to sub- section ( 1 ) of section 130 of the Act ,

(ii ) a Kshettra Panchayat means the territorial constituency referred to in clause ( a) of sub- section (3 ) of section 50 and sub - section ( 1 ) of section 130 of the Act, and

(iii) a Zila Panchayat means the territorial constituency referred to in clause (b ) of sub- section (2) of section 86 and sub - section ( 1 ) of Section 130 of the Act .

(2) The words and expression used in these rules and not defined, but defined in the Uttarakhand Panchayati Raj Act , 2016 shall have the same meaning as assigned to them in the said Act .

Number of seats and offices to be reserved

3. In computing the number of seats or offices to be reserved for the Scheduled Tribes , the Scheduled Castes or the Backward Classes in accordance with the provisions of Section 10 -A , or Section 11 , or Section 55- A, or Section 56 , or Section 92 - A, or Section 93 of the Act, if the remainder is not less than half of the divisor , the quotient shall be increased by one , and if the remainder is less than half of the divisor, it shall be ignored , and the number so arrived at shall be the number of seats or offices to be reserved for the Scheduled Tribes or the Scheduled Castes or the Backward Classes , as the case may be :

Provided that the total reservation for the Scheduled Castes , the Scheduled Tribes and the Backward Classes shall not exceed 50 percent of the total number of seats and offices .

Allotment seats rotation-

( 1 ) Subject to the provisions of the other sub - rules , the seats reserved in the Gram Panchayat or a Kshettra Panchayat or a Zila Panchayat shall be allotted to different territorial constituencies in that Gram Panchayat or Kshettra Panchayat or Zila Panchayat as the case may be , in the following order :

(a) women belonging to the Scheduled Tribes ;

(b) the Scheduled Tribes ;

(d) the Scheduled Castes ;

(e) women belonging to the Backward Classes ;

(f) the Backward Classes ; and

(g) women .

(2) If on the basis of population of the Scheduled Tribes or of the Scheduled Castes or of the Backward Classes in a Panchayat area, only one seat can be reserved for the Scheduled Tribes or for the Scheduled Castes or for the Backward Classes , as the case may be, such seat shall go to a woman belonging to the Scheduled Tribes or to the Scheduled Castes or to the Backward Classes , as the case may be .

(3) If on the basis of population in a Panchayat area , a seat cannot be reserved for the Scheduled Tribes or for the Scheduled Castes or for the Backward Classes , the order mentioned in sub - rule ( 1 ) shall be so adhered to as if there was no reference in it to the Scheduled Tribes or to the Scheduled Castes or to the Backward Classes , as the case may be .

(4) The number of seats as provided in rule 3 shall be allotted to different territorial constituencies on the basis of population in the descending order , namely, from amongst the territorial constituencies in a Gram (14)

Panchayat or in a Kshettra Panchayat or in a Zila Panchayat , the territorial constituency having the largest population of the Scheduled Tribes shall be allotted to them , the territorial constituency having the largest population of the Scheduled Castes shall be allotted to them and the territorial constituency having the largest population of the Backward Classes shall be allotted to them , and in the subsequent election the allotment shall be made in the aforesaid manner so however that , as far as may be , the territorial constituency allotted in the previous elections to the Scheduled Tribes shall not be allotted to the Scheduled Tribes , and the territorial constituency allotted to the Scheduled Castes shall not be allotted to the Scheduled Castes and territorial constituency allotted to the Backward Classes shall not be allotted to the Backward Classes :

Provided that if in any election , the population of the Scheduled Tribes or of the Scheduled Castes or of the Backward Classes , cannot be ascertained territorial constituency - wise , the descending order may be determined on the basis of number of families , in the territorial constituencies of the Scheduled Tribes or of the Scheduled Castes or of the Backward Classes , as the case may be .

(5) Not less than half of the territorial constituencies allotted to the Scheduled Tribes , the Scheduled Castes or the Backward Classes under sub - rule (4 ) shall be allotted to the women belonging to the Scheduled Tribes , the Scheduled Castes or the Backward Classes as the case may be .

(6) Not less than half of the total number of territorial constituencies including the number of territorial constituencies reserved for women under sub - rule (5) shall be allotted to women, so however , that , the territorial constituencies having the largest population excluding the population of the Scheduled (15)

Tribes , the Scheduled Castes and the Backward Classes , shall be allotted to them and in the subsequent election the allotment shall be made in the aforesaid manner so however that , as far as may be, the territorial constituencies allotted to women in the previous elections shall not be allotted to women .

Allotment of offices rotation-

( 1 ) The number of offices of Pradhans as computed in rule 3 for the Scheduled Tribes , the Scheduled Castes and the Backward Classes shall be distributed Khand- wise for being allotted to the constituent Gram Panchayats in the following manner :

(a) The number of offices of Pradhans for the Scheduled Tribes in the Khand shall bear , as nearly as may be , the same proportion to the number of offices of Pradhans in the Khand as their population in the Khand bears to their total population of the Khand, subject to the ratio of their population in the State to the total population ofthe State:

Provided that in the case of undistributed numbers of offices of Pradhans as computed in rule 3 shall be redistributed amongst only those Khands , where the proportion of their population in the total population of the Khand exceeds the proportion of their population in the total population of the State , in the descending order of the ratio of their population in the total population of the Khand .

(b) The number of offices of Pradhans for the Scheduled Castes in the Khand shall bear , as nearly as may be , the same proportion to the total number of offices of Pradhans in the Khand as their population in the Khand bears to the total population of the Khand , subject to the ratio of their population in the State to the total population of the State:

Provided that in the case of undistributed (16 )

numbers of offices of Pradhans as computed in rule 3 shall be redistributed amongst only those Khands , where the proportion of their population in the total population of the Khand exceeds the proportion of their population in the total population of the State, in the descending order of the ratio of their population in the total population of the Khand .

(c) The number of offices of Pradhans for the Backward Classes in the Khand shall bear , as nearly as may be , the same proportion to the total number of offices of Pradhans in the Khand as their population in the Khand bears to the total population of the Khand:

Provided that the total reservation for the Scheduled Castes , the Scheduled Tribes and the Backward Classes shall not exceed 50 percent of the total number of offices of Pradhans in the Khand .

Provided further that in the case of undistributed numbers of offices of Pradhans as computed in rule 3 shall be redistributed amongst only those Khands , where the proportion of their population in the total population of the Khand exceeds the proportion of their population in the total population of the State , in the descending order of the ratio of their population in the total population of the Khand .

(2) The number of offices of Pradhans for the Scheduled Tribes , the Scheduled Castes and the Backward Classes , as determined in sub - rule (1 ) shall be allotted to different Gram Panchayats in the Khand on the basis of the ratio of their population in the Panchayat area to the total population of the Panchayat area in the descending order, namely , from amongst the Gram Panchayats in the Khand, the Gram Panchayat in whose territorial area the ratio of population of the Scheduled Tribes is highest shall be allotted to them , and the Gram Panchayat in whose territorial area the (17)

ratio of population of the Scheduled Castes is highest shall be allotted to them and the Gram Panchayat in whose territorial area the ratio of population of the Backward Classes is highest shall be allotted to them and in the subsequent election the allotment shall be made in the aforesaid manner , so , however , that , as far as may be , the Gram Panchayat allotted in the previous elections to the Scheduled Tribes shall not be allotted to the Scheduled Tribes and the Gram Panchayat allotted in the previous elections to the Scheduled Castes shall not be allotted to the Scheduled Castes and the Gram Panchayat allotted in the previous elections to the Backward Classes shall not be allotted to the Backward Classes :

Provided that if the population of the Scheduled Tribes or the Scheduled Castes or the Backward Classes in the Panchayat area is less than ten , the office of Pradhan of the Gram Panchayat for such Panchayat area shall not be allotted to the Scheduled Tribes , the Scheduled Castes or the Backward Classes , as the case may be .

(3) Not less than half of the Gram Panchayats allotted to the Scheduled Tribes , the Scheduled Castes or the Backward Classes under sub - rule (2) shall be allotted to the women belonging to the Scheduled Tribes , the Scheduled Castes or the Backward Classes , as the casemay be .

(4) Not less than half of the total number of the offices of Pradhans in the Khand including the number of offices of Pradhans reserved for women under sub- rule (3 ) shall be allotted to women so , however, that the territorial areas of the Gram Panchayats allotted to them have the largest population, excluding the population of the Scheduled Tribes , Scheduled Castes and the Backward Classes shall be allotted to them and in the subsequent election, the allotment shall be made in the aforesaid manner so however that , as far as may be , the Gram Panchayats allotted to women in the previous elections shall not be allotted to women .

(5) The provisions of sub - rules ( 1 ) , (2) and (3 ) of rule 4 shall mutatis matandis apply to allotment of offices of Pradhans under this rule .

Allotment of Pramukhs of Offices

6. ( 1 ) The number of offices of Pramukhs as computed in rule 3 for the Scheduled Tribes , the Scheduled Castes and the Backward Classes shall be distributed district- wise for being allotted to the constituent Kshettra Panchayats in the following manner :

(a) The number of offices of Pramukhs for the Scheduled Tribes in the district shall bear , as nearly as may be , the same proportion to the total number of offices of Pramukhs in the district as their population in the Zila Panchayat bears to the total population of the Zila Panchayat , subject to the ratio of their population in the State to the total population of the State :

Provided that in the case of undistributed numbers of offices of Pramukhs as computed in rule 3 shall be redistributed amongst only those Zila Panchayats , where the proportion of their population in the total population of the Zila Panchayats exceeds the proportion of their population in the total population of the State in the descending order of the ratio of their population in the total population of the Zila Panchayat .

(b) The number of offices of Pramukhs for the Scheduled Castes in the district shall bear , as nearly as may be , the same proportion to the total number of offices of Pramukhs in the district as their population in the Zila Panchayat bears to the total population of the Zila Panchayat , subject to the maximum of the ratio of their population in the State to the total population of the State:

Provided that in the case of undistributed numbers of offices of Pramukhs as computed in ( 19)

rule 3 shall be redistributed amongst only those Zila Panchayats , where the proportion of their population in the total population of the Zila Panchayats exceeds the proportion of their population in the total population of the State , in the descending order of the ratio of their population in the total population of the Zila Panchayat .

(c) The number of offices of Pramukhs for the Backward Classes in the district shall bear, as nearly as may be , the same proportion to the total number of offices of Pramukhs in the district as their population in the Zila Panchayat bears to the total population of the Zila Panchayat : Provided that the total reservation for the Scheduled Castes , the Scheduled Tribes and the Backward Classes shall not exceed 50 percent of the total number of offices of Pramukhs in the district:

Provided further that in the case of undistributed numbers of offices of Pramukhs as computed in rule 3 shall be redistributed amongst only those Zila Panchayats , where the proportion of their population in the total population of the Zila Panchayat exceeds the proportion of their population in the total population of the State, in the descending order of the ratio of their population in the total population of the Zila Panchayat.

(2) The number of offices of Pramukhs for the Scheduled Tribes , the Scheduled Castes and the Backward Classes , as determined in sub-rule ( 1 ) shall be allotted to different Kshettra Panchayats in the district on the basis of the ratio of their population in the Panchayat area to the total population of the Panchayat area in the descending order, namely , from amongst the Kshettra Panchayats in the district , the Kshettra Panchayat in whose territorial area the ratio of population of the Scheduled Tribes is highest shall be ( 20)

Mica to payamiehen istab allotted to them , and the Kshettra Panchayat in whose territorial area the ratio of population of the Scheduled Castes is highest shall be allotted to them and the Kshettra Panchayat in whose territorial area the ratio ofpopulation of the Backward Classes is highest shall be allotted to them and in the subsequent election the allotment shall be made in the aforesaid manner , so , however , that , as far as may be , the Kshettra Panchayat allotted in the previous elections to the Scheduled Tribes shall not be allotted to the Scheduled Tribes and the Kshettra Panchayat allotted to the Scheduled Castes shall not be allotted to the Scheduled Castes and the Kshettra Panchayat allotted to the Backward Classes shall not be allotted to the Backward Classes .

(3) Not less than half of the Kshettra Panchayats allotted to the Scheduled Tribes , the Scheduled Castes or the Backward Classes under sub -rule (2) shall be allotted to the women belonging to the Scheduled Tribes , the Scheduled Castes or the Backward Classes , as the case may be.

(4) Not less than half of the total number of the offices of Pramukhs reserved for women in the district under sub -rule (3 ) shall be allotted to women so , however, that the territorial areas of the Kshettra Panchayats allotted to them have the largest population , excluding the population of the Scheduled Tribes , Scheduled Castes and the Backward Classes shall be allotted to them and in the subsequent election, the allotment shall be made in the aforesaid manner so however that , as far as may be , the Kshettra Panchayats allotted to women in the previous elections shall not be allotted to women.

(5) The number of Chairmen for the Scheduled Tribes , the Scheduled Castes and the Backward Classes as provided in rule 3 shall be allotted to different Zila Panchayats in the State on the basis of the ratio of their population in the Panchayat area to the total population of the Panchayat area in the descending order , namely , from amongst the Zila Panchayats in the State , the Zila Panchayat in whose territorial area (21)

the ratio of population of the Scheduled Tribes is highest shall be allotted to them , the Zila Panchayat in whose territorial area the ratio of population of Scheduled Castes is highest shall be allotted to them , and the Zila Panchayat in whose territorial area the ratio of population of the Backward Classes is highest shall be allotted to them, and in the subsequent election the allotment shall be made in the aforesaid manner so , however , that , as far as may be , the Zila Panchayat allotted in the previous elections to the Scheduled Tribes shall not be allotted to the Scheduled Tribes , the Zila Panchayat allotted in the previous elections to the Scheduled Castes shall not be allotted to the Scheduled Castes and the Zila Panchayat allotted to the Backward Classes shall not be allotted to Backward Classes .

(6).Not less than half of the Zila Panchayats allotted to the Scheduled Tribes or the Scheduled Castes or the Backward Classes under sub - rule (5) shall be allotted to women belonging to the Scheduled Tribes , or the Scheduled Castes or Backward Classes , as the case maybe.

(7) Not less than half of the total number of the Zila Panchayats including the number of Zila Panchayats reserved for women under sub -rule ( 6) shall be allotted to women, so however, that the territorial area of the Zila Panchayat allotted to them have the largest population , excluding the population of the Scheduled Tribes , Scheduled Castes and the Backward Classes and in the subsequent election the allotment shall be made in the aforesaid manner so however , that , as far as may be , that the Zila Panchayats allotted to women in the previous elections shall not be allotted to women .

(8) The offices of Chairmen shall be allotted in the following order:

(a) women belonging to the Scheduled Tribes ;

(b) the Scheduled Tribes ;

(d) the Scheduled Castes;

(e) women belonging to the Backward Classes ;

(f) the Backward Classes ;

(g) women.

(9) The provisions of sub - rule (8) shall mutatis mutandis apply to allotment of offices of Pramukhs under this rule .

( 10) The provisions of sub - rule (2) of rule 4 shall mutatis mutandis apply to allotment of offices under rule 6 .
