राज्यपाल, भारत का संविधान के अनुच्छेद 233 सपठित अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उत्तराखण्ड उच्चतर न्यायिक सेवा नियमावली, 2004 एवं संशोधित उत्तराखण्ड उच्चतर न्यायिक सेवा नियमावली 2024 में अग्रेत्तर संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं: -
उत्तराखण्ड उच्चतर न्यायिक सेवा (संशोधन) नियमावली, 2025
संक्षिप्त
नाम
1. (1 ) इस नियमावली का संक्षिप्त नाम उत्तराखण्ड उच्चतर न्यायिक सेवा (संशोधन) नियमावली , 2025 है ।

(2) यह तुरन्त प्रवृत्त होगी ।
नियम
2. उत्तराखण्ड उच्चतर न्यायिक सेवा नियमावली, 2004 (जिसे आगे इसके पश्चात् 15 का
संशोधन
मूल नियमावली कहा गया है) एवं संशोधित उत्तराखण्ड उच्चतर न्यायिक सेवा (संशोधन) नियमावली, 2024 में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम 15 के उपनियम (2) के स्थान पर स्तम्भ 2 में दिया गया उपनियम रख दिया जायेगा, अर्थात्ः- 2

स्तम्भ-1 विद्यमान नियम
स्तम्भ-2 एतद्वारा प्रतिस्थापित नियम
(2) मुख्य न्यायाधीश अथवा मुख्य न्यायाधीश द्वारा गठित समिति द्वारा प्रतियोगितात्मक परीक्षा का पैटर्न और पाठ्यक्रम निर्धारित किया जायेगा ।
(2) मुख्य न्यायाधीश अथवा मुख्य न्यायाधीश द्वारा गठित समिति द्वारा प्रतियोगितात्मक परीक्षा का पैटर्न और पाठ्यक्रम निर्धारित किया जायेगा , जिसे राज्य सरकार के अनुमोदनोपरान्त अन्तिम रूप प्रदान किया जायेगा ।
नियम 19का संशोधन
3. मूल नियमावली 2004 एवं संशोधित नियमावली 2024 में नीचे स्तम्भ -1 में दिये गये विद्यमान नियम 19 के उपनियम (2 ) के स्थान पर स्तम्भ -2 में दिया गया उपनियम रख दिया जायेगा, अर्थात्ः-

स्तम्भ-2 एतद्वारा प्रतिस्थापित नियम
(2) सभी अभ्यर्थी जिनके नाम मुख्य न्यायाधीश ( अथवा मुख्य न्यायाधीश द्वारा गठित समिति के द्वारा 1 : 3 के अनुपात में सूची में अन्तिम किये गये हो , लिखित परीक्षा में उपस्थित होंगे और प्रतियोगितात्मक परीक्षा का पैटर्न और पाठ्यक्रम मुख्य न्यायाधीश अथवा मुख्य न्यायाधीश द्वारा गठित समिति द्वारा निर्धारित किया जायेगा, जिसे राज्य सरकार के अनुमोदनोपरान्त अन्तिम रूप प्रदान किया जायेगा ।
2) सभी अभ्यर्थी जिनके नाम मुख्य न्यायाधीश अथवा मुख्य न्यायाधीश द्वारा गठित समिति के द्वारा 1 : 3 के अनुपात में सूची में अन्तिम किये गये हो, लिखित परीक्षा में उपस्थित होंगे और प्रतियोगितात्मक परीक्षा का पैटर्न और पाठ्यक्रम मुख्य न्यायाधीश अथवा मुख्य न्यायाधीश द्वारा गठित समिति द्वारा निर्धारित किया जायेगा ।

In exercise of the powers conferred by article 233 read with proviso to article 309 of the Constitution of India, the Governor is pleased to make the following rules in view to further amend the Uttarakhand Higher Judicial Service Rules, 2004, and Rules 2024 namely
The Uttarakhand Higher Judicial Service (Amendment) Rules 2025
Short title and 1. Commencement
( 1 ) These Rules may be called the Uttarakhand Higher Judicial Service (Amendment) Rules , 2025 .
(2) They shall come into force at once .
Ammendment ofRule 15
2. In the Uttarakhand Higher Judicial Service Rules , 2004 (hereinafter referred to as principal rules ) and Uttarakhand Higher Judicial Service (Amendment) Rules , 2024 for existing sub - rule ( ii) of Rule 15 , as set out in column 1 below, the sub- rule as set out in column - 2 shall be substituted, namely-

(ii)The Chief Justice or ( ii) Committee constituted by the Chief Justice shall prescribe the pattern and syllabus of competitive examination. which shall be finalized after approval Government. of the State

Ammendment 3 . ofRule 19
In the Principal rules 2004 and Uttarakhand Higher Judicial Service (Amendment ) Rules, 2024 for existing sub - rule (ii) of Rule 19, as set out in column 1 below, the sub - rule as set out in column- 2 shall be substituted, namely- 4

(ii ) All the candidates , whose names (ii) are in the list finalized by the Chief Justice or Committee constituted by Chief Justice in the ratio of 1 : 3 , shall appear in the written examination and the pattern and syllabus of competitive examination shall be as prescribed by the Chief Justice or Committee constituted by the Chief Justice , which shall be finalized after approval of the State Government .
All the candidates , whose names are in the list finalized by the Chief Justice or Committee constituted by Chief Justice in the ratio of 1 : 3 , shall appear in the written examination and the pattern and syllabus competitive of examination shall be as prescribed by the Justice Committee Chief or constituted by the Chief Justice .
