अधिसूचना
चूँकि राज्य सरकार का समाधान हो गया है कि लोक हित में ऐसा करना समीचीन है ;
अतएव , अब, राज्यपाल , उत्तराखण्ड माल और सेवा कर अधिनियम, 2017 (2017 का 06) की धारा 9- की उपधारा (3 ) और उपधारा (4) , धारा 11 की उपधारा ( 1 ) , धारा 15 की उपधारा (5 ) और धारा 148 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए परिषद की सिफारिशों के आधार पर, उत्तराखण्ड शासन वित्त अनुभाग-8 की अधिसूचना संख्या 530/2017/9 ( 120 ) / XXVII ( 8 ) / 2017, दिनांक 29 जून, 2017 में निम्नलिखित अग्रेत्तर संशोधन करने की सहर्ष स्वीकृति प्रदान करते हैं, अर्थात्: -
उक्तअधिसूचना में, -
(क) सारणी में, -
(i ) क्रम संख्या 18 के समक्ष, स्तंभ ( 3 ) में, खंड (ख) के पश्चात्, निम्नलिखित स्पष्टीकरण अंतःस्थापित किया जाएगा, अर्थात्:-
"स्पष्टीकरण. - इस प्रविष्टि में निहित कोई भी बात निम्नलिखित पर लागू नहीं होगी:
( i ) किसी इलेक्ट्रॉनिक कॉमर्स ऑपरेटर द्वारा प्रदान की जाने वाली स्थानीय वितरण सेवाएँ; या
(ii) किसी इलेक्ट्रॉनिक कॉमर्स ऑपरेटर के माध्यम से प्रदान की जाने वाली स्थानीय वितरण सेवाएँ । ";
(ii ) क्रम संख्या 36 ख और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्याएँ और उससे संबंधित प्रविष्टियाँ अंतःस्थापित की जाएंगी , अर्थात्: - 2

बीमाकर्ता द्वारा बीमित व्यक्ति को प्रदान की जाने वाली जीवन शून्य बीमा व्यवसाय सेवाएँ, जहाँ बीमित व्यक्ति एक समूह नहीं है ।

स्पष्टीकरणः शंकाओं के निवारण हेतु, यह स्पष्ट किया जाता है
क. यह छूट उस बीमा अनुबंध पर लागू होगी जहाँ बीमित एक व्यक्तिहै, या एक व्यक्ति और उसका परिवार है ।
ख. उपर्युक्त (क) के प्रयोजनों के लिए, परिवार में बीमा अनुबंध में परिवार के रूप में बीमित सभी व्यक्ति शामिल होंगे।

स्पष्टीकरणः शंकाओं के निवारण हेतु, यह स्पष्ट किया जाता है
क. यह छूट उस बीमा अनुबंध पर लागू होगी जहां बीमित एक व्यक्तिया एक व्यक्ति और उसका परिवार है ।
ख. उपर्युक्त (क) के प्रयोजनों के लिए , परिवार में बीमा अनुबंध में परिवार के रूप में बीमित सभी व्यक्ति शामिल होंगे ।

शून्य क्रम संख्या 36 ग या 36घ में निर्दिष्ट बीमा सेवाओं का पुनर्बीमा। शून्य

(ख) पैरा 2में,
(i ) खंड (यङ) के स्थान पर निम्नलिखित को अंतः स्थापित किया जाएगा, अर्थात्ः-
"(यङ) 'माल परिवहन एजेंसी' से तात्पर्य ऐसे किसी व्यक्ति से है जो सड़क मार्ग से माल के परिवहन के संबंध में सेवा प्रदान करता है और किसी भी नाम से माल भेजने का नोट जारी करता है , किन्तु इसमें शामिल नहीं है: -
( i ) कोई इलेक्ट्रॉनिक कॉमर्स ऑपरेटर जिसके द्वारा स्थानीय वितरण की सेवाएं प्रदान की जाती हैं,
(ii ) कोई इलेक्ट्रॉनिक कॉमर्स ऑपरेटर जिसके माध्यम से स्थानीय वितरण की सेवाएं प्रदान की जाती हैं";
(ii ) खंड (यचक) के पश्चात् निम्नलिखित खंड अंतः स्थापित किया जाएगा, अर्थात्ः-
"(यचख) ऊपर तालिका में क्रम संख्या 36ग और 36 घ की प्रविष्टियों के प्रयोजनों के लिए, 'समूह ' का अर्थ ऐसे व्यक्तियों का समूह है जो बीमा प्राप्त करने के अलावा एक समान उद्देश्य से या एक समान आर्थिक गतिविधि में संलग्न होने के लिए एक साथ आते हैं, और इसमें शामिल हैं:
क. नियोक्ता-कर्मचारी समूह , जहाँ मास्टर/समूह पॉलिसीधारक और समूह के सदस्यों के बीच , लागू कानूनों के अनुसार, नियोक्ता-कर्मचारी संबंध विद्यमान हो;
ख. गैर-नियोक्ता-कर्मचारी समूह , जहाँ बीमा के अलावा अन्य सेवाओं/गतिविधियों के लिए मास्टर/समूह पॉलिसीधारक और समूह के सदस्यों के बीच स्पष्ट संबंध विद्यमान हो । " ;
(iii) खंड (यछ) के पश्चात्, निम्नलिखित खंड अंतः स्थापित किया जाएगा, अर्थात्ः -
" (यछक) 'स्वास्थ्य बीमा व्यवसाय' से ऐसे अनुबंधों का कार्यान्वयन अभिप्रेत है जो रूग्णता लाभ या चिकित्सा, शल्य चिकित्सा या अस्पताल व्यय लाभ, चाहे वे आंतरिक रोगी हों या बाह्य रोगी, यात्रा कवर और व्यक्तिगत दुर्घटना कवर प्रदान करते हैं; " ।
2. यह अधिसूचना दिनांक 22 सितंबर, 2025 से लागू होगी ।

Inpursuance of the provision of clause (3 ) of Article 348 of the Constitution of India , the Governor is pleased to order the publication of the following English translation of the Notification No. 614/2025/01 (120) /XXVII ( 8 ) / 2025 - TC, CTR - 16, dated September 18 , 2025 for general information :

NOTIFICATION
interest; WHEREAS , the State Government is satisfied that it is expedient so to do in public
NOW, THEREFORE, In exercise of the powers conferred by sub- sections (3 ) and (4) of section 9 , sub - section ( 1 ) of section 11 , sub-section (5 ) of section 15 and section 148 of the Uttarakhand Goods and Services Tax Act, 2017 (06 of 2017) , the Governor , on the recommendations of the Council , is pleased to allow to make the following further amendments in the notification of Government of Uttarkhand, Finance Section- 8 , No. 530/2017/9 (120 ) /XXVII ( 8 ) / 2017 dated the 29th June , 2017 , namely:- In the said notification, -
(a) In the table , -
(i) against serial number 18, in column ( 3 ) , after clause (b) , the following explanation shall be inserted , namely : -
"Explanation . - Nothing contained in this entry shall apply to following :
( i) local delivery services provided by an Electronic Commerce Operator ; or
( ii) local delivery services provided through an Electronic Commerce Operator ." ;
(ii) after serial number 36B and the entries relating thereto, the following serial numbers and entries relating thereto shall be inserted , namely: -

Services of life insurance business provided by an insurer to the insured, where the insured is not a group.

Explanation: For the removal of doubts , it is hereby clarified that:
a. This exemption shall apply to a contract of insurance where the insured is an individual , or an individual and family of the said individual .
b. For the purposes of (a) above , family shall include all individuals insured as family in the contract of insurance.

Explanation: For the removal of doubts , it is hereby clarified that:

(b) in paragraph 2,
(i ) for clause (ze ) , the following shall be substituted , namely: -
"( ze) ' goods transport agency ' means any person who provides service in relation to transport of goods by road and issues a consignment note by whatever name called , but does not include
i) an electronic commerce operator by whom the services of local delivery are provided , ( (ii) an electronic commerce operator through whom the services of local delivery are provided" ;
(ii ) after clause (zfa) , the following clause shall be inserted , namely: -
"(zfb) For the purposes of entries at serial numbers 36C and 36D in the table above, 'group ' means group of persons who join together with a commonality of purpose or for engaging in a common economic activity , other than availing insurance, and includes:
a. Employer- employee groups , where an employer- employee relationship exists between the master/group policyholder and the members of the group in accordance with the applicable laws;
b. Non employer- employee groups , where a clearly evident relationship exists between the master/group policyholder and the members of the group, for services/ activities other than insurance. " ; after clause ( zg) , the following clause shall be inserted, namely: -
"(zga) ' health insurance business ' means the effecting of contracts which provide for sickness benefits or medical , surgical or hospital expense benefits , whether in - patient or out-patient , travel cover and personal accident cover ; " .
2. This notification shall come into force with effect from the 22nd day of September , 2025 .
