" भारत का संविधान " के अनुच्छेद 213 के खण्ड (1 ) के अधीन मा० राज्यपाल ने " उत्तराखण्ड जन विश्वास (उपबंधों का संशोधन) अध्यादेश , 2025 " प्रख्यापित किया है और वह उत्तराखण्ड राज्य का अध्यादेश संख्याः 05 वर्ष-2025 के रूप में सर्व साधारण के सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है ।

जीवन और व्यापार को आसान बनाने के लिए विश्वास आधारित शासन को और अधिक बढ़ाने के लिए अपराधों को गैर- आपराधिक बनाने और तर्कसंगत बनाने के लिए कतिपय अधिनियमों में संशोधन करने हेतु,

अध्यादेश

चूंकि, राज्य विधान मण्डल सत्र में नहीं है और राज्यपाल का यह समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान है, जिनके कारण उन्हें तुरन्त कार्रवाई करना आवश्यक हो गया है;

अतएव, अब राज्यपाल भारत के संविधान के अनुच्छेद 213 के खण्ड (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित अध्यादेश प्रख्यापित करते हैः--

1 .

संक्षिप्त नाम और प्रारंभ

(1 ) इस अध्यादेश का संक्षिप्त नाम उत्तराखण्ड जन विश्वास (उपबंधों का संशोधन) अध्यादेश , 2025 है ।

(2) यह तुरंत प्रवृत्त होगा ।

कतिपय अधिनियमितियों का संशोधन

2. अनुसूची के स्तम्भ (4 ) में उल्लिखित अधिनियमों को, स्तंभ (5) में वर्णित सीमा तक और वर्णित रीति में, एतद्वारा संशोधित किया जाता है ।

जुर्मानों और शास्तियों का पुनरीक्षण

3. अनुसूची में उल्लिखित अधिनियमितियों में विभिन्न प्रावधानों के अधीन प्रदान किए गए जुर्माने और शास्तियों को, इस अध्यादेश के प्रारंभ होने की तारीख से प्रत्येक तीन वर्ष की समाप्ति के पश्चात्, उन्हें निर्धारित जुर्माने या शास्ति, जैसा भी मामला हो, की न्यूनतम राशि के दस प्रतिशत तक बढ़ाया जाएगा ।

व्यावृत्ति

4. इस अध्यादेश द्वारा किसी अधिनियमिति के संशोधन या निरसन से , किसी अन्य अधिनियमिति पर, जिसमें संशोधित या निरसित अधिनियमिति लागू की गई है , सम्मिलित अथवा निर्दिष्ट की गई है, प्रभाव नहीं पड़ेगा;

और यह अध्यादेश , पूर्व में की गई या भुगती गई किसी बात की विधिमान्यता, अविधिमान्यता, प्रभाव या परिणाम या पूर्व में ही अर्जित, प्रोद्भूत या उपगत किसी अधिकार, हक, बाध्यता या दायित्व या उसके संबंध में किसी उपचार या कार्यवाही या किसी ऋण , शास्ति, 3 उत्तराखण्ड असाधारण गजट , 15 दिसम्बर , 2025 ई ० (अग्रहायण 24, 1947 शक सम्वत्)

बाध्यता, दायित्व , दावे या मांग या उससे किसी निर्मुक्ति या उन्मोचन या पूर्व में ही अनुदत्त किसी क्षतिपूर्ति या भूतकाल में किए गए किसी कार्य या बात के सबूत पर , प्रभाव नहीं डालेगा;

और यह अध्यादेश विधि के किसी सिद्धांत या नियम या स्थापित अधिकारिता, अभिवचन के रूप या अनुक्रम पर, पद्धति या प्रक्रिया या विद्यमान प्रथा, रूढ़ि, विशेषाधिकार, निर्बन्धन, छूट, पद या नियुक्ति पर इस बात के होते हुए भी प्रभाव नहीं डालेगा कि वह क्रमशः किसी ऐसी अधिनियमिति द्वारा , जो कि एतद्वारा संशोधित या निरसित की गई है, उसमें या उससे किसी रीति में अभिपुष्ट किया गया है या मान्यताप्राप्त है या व्युत्पन्न है;

और इस अध्यादेश द्वारा किसी अधिनियमिति के संशोधन या निरसन से किसी अधिकारिता , पद, रूढ़ि , दायित्व, अधिकार, हक, विशेषाधिकार , निर्बन्धन , छूट, प्रथा, पद्धति, प्रक्रिया या अन्य विषय या बात का, जो अब विद्यमान या प्रवृत्त नहीं है, पुनः प्रवर्तन या प्रत्यावर्तन नहीं होगा ।

कठिनाईयों के निवारण की शक्ति

5. यदि इस अध्यादेश के उपबंधों को प्रभावी करने में कोई कठिनाई उत्पन्न होती है तो राज्य सरकार ऐसे आदेश द्वारा , जो इस अध्यादेश के उपबंधों से अंसगत न हो, उस कठिनाई को दूर कर सकेगीः

परन्तु ऐसा कोई आदेश इस अध्यादेश के प्रारंभ के दो वर्ष की अवधि के पश्चात् नहीं किया जाएगा ।

धारा 23 में,- ( i ) उपधारा (2 ) निम्नवत् प्रतिस्थापित कर दी जायेगी , अर्थात्-

" (2) कोई व्यक्ति जो धारा 16 के अधीन प्राधिकृत व्यक्ति को किसी भूमि या भवन में प्रवेश करने में बाधा डालता है या ऐसे व्यक्ति को प्रवेश के उपरान्त उत्पीड़ित करता है, वह पांच हजार रूपये के जुर्माने से दण्डित किया जायेगा । " उत्तराखण्ड असाधारण गजट , 15 दिसम्बर, 2025 ई ० (अग्रहायण 24, 1947 शक सम्वत्)

(ii) उपधारा (3 ) का खण्ड (घ) निम्नवत् प्रतिस्थापित कर दिया जायेगा, अर्थात्-

"(घ) अधिनियम की धारा 21 के अधीन अनुमति या अनापत्ति प्रमाण पत्र प्राप्त करने हेतु किसी विषय में झूठी सूचना देता है या किसी प्रकार नदी घाटी को प्रदूषित करता है या अधिनियम के प्रावधानों का किसी प्रकार उल्लंघन करता है , वह प्रथम अपराध के लिये न्यूनतम दो हजार और अधिकतम दस हजार रूपये के जुर्माने और पश्चातवर्ती अपराधों के लिये न्यूनतम दस हजार रूपये और अधिकतम बीस हजार रूपये के जुर्माने से दण्डित किया जायेगाः "

(iii) उपधारा (3) के खण्ड ( घ) के

पश्चात् निम्नलिखित परन्तुक अन्तःस्थापित कर दिया जायेगा, अर्थात्---

" परन्तु धारा 23 की उपधारा (3) के खण्ड (क) एवं (ख ) के उल्लघन के मामले में अपराधी को पचास हजार रुपये के जुर्माने या दो माह तक के कारावास या दोनों से दण्डित किया जाएगा । "

2013

धारा 13 में,-

उत्तराखण्ड बाढ़ मैदान परिक्षेत्रण अधिनियम, 2012

(i ) खण्ड (क) एवं ( ख) निम्नवत् प्रतिस्थापित कर दिये जायेगें अर्थात्-

"(क) जुर्माने से, जो पाँच हजार रूपये तक का हो सकेगा, और "

" (ख) खण्ड (क ) के अधीन दोष सिद्ध के पश्चात् उस प्रत्येक दिन के लिये , जिसके दौरान अपराध जारी रहता है , जुर्माना एक हजार रूपये तक हो सकेगा, और"

( ii) नया खण्ड (ग ) निम्नवत् अन्तःस्थापित कर दिया जायेगा, अर्थात्-

"(ग) उन मामलों में जहां उसी प्रकृ ति का पश्चातवर्ती अपराध किया गया है , जुर्माने से जो बीस हजार 5 उत्तराखण्ड असाधारण गजट, 15 दिसम्बर, 2025 ई ० (अग्रहायण 24, 1947 शक सम्वत्)

रुपये तक हो सकेगा या साधारण कारावास से जो दो मास तक का हो सकेगा या दोनों से, दण्डित किया जायेगा । "

3 2013

धारा 10 में, - शब्द "तीन माह " के स्थान पर, शब्द "एक माह' रख दिये जायेगें ।

उत्तराखण्ड प्लास्टिक और अन्य जीव (उपयोग और निस्तारण का अनाशित कूड़ा- कचरा विनियमन) अधिनियम, 2013

2016

धारा 5 में,- शब्द और अंक " 06 माह " के स्थान पर, शब्द और अंक " 03 माह " रख दिये जायेगें ।

उत्तराखण्ड राज्य की नागर निकायों अवस्थित मलिन बस्तियों के सुधार, विनियमितिकरण , पुनर्वासन, पुनर्व्यस्थापन एवं अतिक्रमण निषेध अधिनियम, 2016

2019

उत्तराखण्ड लोक सेवा (आर्थिक रूप से कमजोर वर्गों के लिए आरक्षण) अधिनियम, 2019

धारा 5 में,- ( i ) उपधारा (1 ) में, शब्द और चिन्ह "ऐसी अवधि के कारावास से जो तीन मास तक हो सकेगी, या जुर्माने से जो बीस हजार रूपये तक हो सकेगा, या दोनों से दण्डनीय होगा। " के स्थान पर शब्द और चिन्ह " जुर्माने से जो चालीस हजार रूपये तक हो सकेगा , दण्डनीय होगा । " रख दिये जायेगें;

(ii) उपधारा (2) का लोप कर दिया जायेगा;

(iii) उपधारा (3) का लोप कर दिया जायेगा ।

6 2020

धारा 12 निम्नवत् प्रतिस्थापित कर दी जायेगी, अर्थात्-

उत्तराखण्ड जैविक कृषि अधिनियम , 2019

" 12. जो कोई इस अधिनियम की धारा 3 , 4, 5 , 8 अथवा 9 के उपबंधों का उल्लंघन करेगा , वह पचास हजार रुपये के न्यूनतम जुर्माने से , जो पांच लाख रुपये तक हो सकता है , दण्डित किया जायेगा और इसके अतिरिक्त, उसे तीस दिनों के भीतर धारा 1 की उपधारा 6

उत्तराखण्ड असाधारण गजट , 15 दिसम्बर, 2025 ई ० ( अग्रहायण 24, 1947 शक सम्वत्)

(2) के अधीन अधिसूचित क्षेत्र में उसके द्वारा बेचे गए धारा 3 की उपधारा (1 ) के अधीन विनिर्दिष्ट प्रतिषिद्ध माल को वापस मंगाना होगा और नियामक प्राधिकारी के समक्ष इसके अनुपालन की पुष्टि करते हुए एक शपथ पत्र प्रस्तुत करना होगाः

परन्तु यह कि कोई भी व्यक्ति जो ऐसे जुर्माने के भुगतान में चूक करता है , वह प्रत्येक दिन के लिए , जिसके दौरान ऐसी चूक जारी रहती है , एक हजार रुपये की अतिरिक्त राशि का भुगतान करने के लिए दायी होगा । "

2020

उत्तराखण्ड फल पौधशाला (विनियमन) अधिनियम, 2019

धारा 18 के उपधारा ( 1 ) में शब्द, अंक और चिन्ह "वह प्रथम दोषसिद्धि पर 50,000 /(रूपये पचास हजार) तक का जुर्माना तथा जुर्माना देने में व्यतिक्रम होने कि दशा में छह माह तक का करावास से दण्डित किया जायेगा और द्वितीय अथवा पश्चातवर्ती दोषसिद्धि की दशा में 6 माह तक का कारावास तथा रू० 50,000 (रूपये पचास हजार) तक के जुर्माने से भी दण्डित किया जायेगा । " के स्थान पर शब्द, अंक और चिन्ह " वह प्रथम दोषसिद्धि पर न्यूनतम 1,00000 / (रूपये एक लाख) के जुर्माने से जो 5,00000 / (रूपये पांच लाख) तक हो सकता है तथा जुर्माना देने में व्यतिक्रम होने कि दशा में अंतिम भुगतान की तिथि तक रूपया 1,000 / (रूपये एक हजार) प्रतिदिन के अग्रत्तर जुर्माने से से दण्डित किया जायेगा और द्वितीय अथवा 7 उत्तराखण्ड असाधारण गजट , 15 दिसम्बर , 2025 ई० (अग्रहायण 24, 1947 शक सम्वत्)

पश्चातवर्ती दोषसिद्धि की दशा में रू 0 10,00000 / (रूपये दस लाख) तक के जुर्माने से दण्डित किया जायेगा । " रख दिये जायेगें ।

In pursuance of the provisions of Clause ( 3 ) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of 'The Uttarakhand Jan Vishwas ( Amendment Of Provisions) Ordinance , 2025 ' ( Uttarakhand Ordinance No. 05 of 2025) .

[Promulgated by the Governor in the seventy - sixth year of the Republic of India ]

Ordinance

to amend certain enactments for decriminalising and rationalising offences to further enhance trust - based governance for ease of living and doing business , WHEREAS , the State Legislature is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action ;

NOW, THEREFORE , in exercise of the powers conferred by clause ( 1 ) of Article 213 of the Constitution of India , the Governor is pleased to promulgatc the following Ordinance : -

Short title and 1. commencement

( 1 ) This Ordinance may be called the Uttarakhand Jan Vishwas (Amendment of Provisions) Ordinance , 2025 .

(2) Itshall come into force at once .

Amendment of certain enactments

2 . The enactments mentioned in column (4) of the Schedule are hereby amended to the extent and in the manner mentioned in column (5 ) thereof.

fines and penalties Revisions of 3. The fines and penalties provided under various provisions in the enactments mentioned in the Schedule shall be increased by ten per cent of the minimum amount of fine or penalty, as the case may be , prescribed therefor , after the expiry of every three years from the date of commencement of this Ordinance .

Savings

The amendment or repeal by this Ordinance of any enactment shall not affect any other enactment in which the amended or repealed enactment has been applied , incorporated or referred 4. to;

and this Ordinance shall not affect the validity, invalidity, effect or consequences of anything already done or suffered , or any right , title , obligation or liability already acquired , accrued or incurred or any remedy or proceeding in respect thereof, or any release or discharge of, or from any debt , penalty, obligation , liability, claim or demand, or any indemnity already granted, or the proof of any past act or thing ;

nor shall this Ordinance affect any principle or rule of law, or established jurisdiction , form or course of pleading , practice or procedure , or existing usage , custom , privilege , restriction , exemption , office or appointment , notwithstanding that the same respectively may have been in any manner affirmed , or recognised or derived by, in or from any enactment hereby amended or repealed ;

nor shall the amendment or repeal by this Ordinance of any enactment revive or restore any jurisdiction , office , custom , liability, right , title , privilege , restriction , exemption , usage , practice , procedure or other matter or thing not now existing or in force .

Power to remove difficulties

If any difficulty arises in giving effect to the provisions of this Ordinance , the State Government may , by order, not inconsistent with the provisions of this Ordinance , remove that difficulty:

Provided that no such order shall be made after the expiry of a period of two years from the commencement of this Ordinance .

In section 23 , -

( i ) sub - section ( 2) shall be substituted as follows , namely-

The Uttarakhand River Valley (Development and Management) Act, 2005

" ( 2) Any person who obstructs the entry of a person Authorised under section 16 to entry into or upon any land or building or molests such person after such entry shall be punishable with fine of five thousand rupees" .

(ii) clause ( d ) of sub - section ( 3 ) shall be substituted as follows , namely-

"(d ) For the purpose of obtaining any permission or NOC under section 21 of the Act makes a statement which is false in any material particular or in any way pollutes the River Valley or otherwise contravens the provisions of this Act shall be punishable with fine of minimum two thousand and maximum of ten thousand rupees for first offence and minimum of ten thousand rupees and a maximum of twenty thousand rupees for subsequent offences : "

(iii) after clause ( d ) of sub - section (3 ) following proviso shall be inserted , namely-

" Provided that in cases where there is a violation of clause ( a) and ( b ) of sub- section ( 3 ) of section 23 , the offender shall be punished with a fine of fifty thousand rupees or imprisonment of up to two months or both . "

2. 2013 07

In section 13 , -

Plain ( i) clause ( a) and ( b) shall be substituted as The Uttarakhand Flood Zoning Act , 2012 follows , namely.-

(b) with further fine which may extend to one thousand for each day during which the offence continues after conviction under clause (a) ; and

(ii) following new clause ( c) shall be inserted , as follows , namely : -

a "( c) In cases where a subsequent offence of the same nature has been committed fine which may extend to twenty thousand rupees or simple imprisonment for a term which may extend to two months or both ,. "

In section 10 , -

for the words " three months " , the words " one month " shall be substituted .

4. 2016 18

In section 5 for the words " six months " , the words " three months " shall be substituted .

The Uttarakhand , Reforms , Regularization , Rehabilitation Resettlement and Prevention of Encroachment of the Slums located in the Urban Local Bodies of the State Act , 2016

5. 2019 07

In section 5 , -

The Uttarakhand Public Services (Reservation for Economically Weaker Sections)Act, 2019

( i) in sub - section ( 1 ) , for the words , figures and sign " be punishable with imprisonment which may extend to 3 months or with fine which may extend to 20000 or both ; " the words , figures and sign "be punishable with fine which may extend to Rs . 40,000/" shall be substituted;

( ii) sub - section (2 ) shall be omitted ;

(iii) sub - section (3 ) shall be omitted .

The Uttarakhand Section 12 Shall be substituted as follows , Organic Agriculture Department Act , 2019

namely: - " 12. Whoever violates provisions of section 3 , 4 , 5 , 8 or 9 of this Act , shallbe punishable with a minimum fine of rupees fifty thousand which may extend to rupees five lakh and shall , in addition, be required to call back the prohibited goods as specified under sub - section ( 1 ) of section 3 and sold by him in the area notified under sub- section ( 2 ) of section I within thirty days and to submit an affidavit to the Regulatory Authority confirming compliance therewith:

Provided that any person who defaults in the payment of such fine shall be liable to pay an additional amount of rupees one thousand for every day during which such default continues . "

In sub - section ( 1 ) of section 18 ,

The Uttarakhand Fruit Nurseries (Regulation) Act, 2019

for the words , figures and sign " on first conviction shall be punished with the fine which may extend to Rs.50,000/- (Fifty thousand) and in default of payment of fine with imprisonment which may extend to six months andbe punished on second or subsequent conviction with imprisonment which may extend to six months and fine which may extend to Rs . 50,000/ - ( Fifty thousand ) . " the words , figures and sign "on first conviction shall be punished with a minimum fine of Rs . 1,00,000/- (One lakh) which may extend to Rs . 5,00,000/- ( Five lakh ) and in default of payment of fine with a further fine of Rs . 1,000/- (One thousand) per day until the date of final payment and in cases of second or subsequent a 12 उत्तराखण्ड असाधारण गजट , 15 दिसम्बर , 2025 ई ० (अग्रहायण 24, 1947 शक सम्वत्)

conviction, shall be punished with a fine which may extend upto Rs . 10,00,000/- (Ten lakh). " shall be substituted;.
