उत्तरांचल पर्यटन विकास अधिनियम 2001 की धारा 14 के द्वारा प्रदत्त शक्ति का प्रयोग करते * हुये उत्तरांचल राज्य के पर्यटन क्षेत्र के सर्वागीर्ण व बहुमुखी विकारा कायों को गति प्रदान करने के उद्देश्य से राज्यपाल उत्तरांचल नियमावली बनाते है:-
अध्याय-1
प्रारम्भिक
1- संक्षिप्त नाम विस्तार और आरम्भ - यह नियमावली उत्तरांचल पर्यटन कोष नियमावली-2005 कहलायेगी ।
2- यह सम्पूर्ण उत्तरांचल में लागू होगी ।
3- यह राज्य सरकार द्वारा सरकारी गजट में अधिसूचना प्रकाशित किए जाने की तिथि से प्रवृत्त हुई समझी जायेगी ।

परिभाषाएँ -जब तक कि संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में :-
(क) " परिषद" का तात्पर्य उत्तरांचल पर्यटन विकास परिषद से है ।
(ख) "अधिनियम " का तात्पर्य उत्तरांचल पर्यटन विकास परिषद अधिनियम , 2001 से है ।
(ग) " समिति" का तात्पर्य नियम-6 के अधीन गठित कार्यकारणी समिति से है ।
(घ) " कोष" का तात्पर्य उत्तरांचल पर्यटन कोष से है ।
(च) "राज्य" का तात्पर्य उत्तरांचल राज्य से है ।
(छ) "संरकार " का तात्पर्य उत्तरांचल राज्य सरकार से है ।
(ज) मुख्य कार्यकारी अधिकारी का तात्पर्य उत्तरांचल पर्यटन विकास के मुख्य कार्यकारी अधिकारी से
है ।
(झ) अपर मुख्य कार्यकारी अधिकारी का तात्पर्य उत्तरांचल पर्यटन विकास के अपर मुख्य कार्यकारी
अधिकारी से है ।
अध्याय-2
उद्देश्य
3-
उत्तरांचल में पर्यटने सम्बन्धी आधारभूत सुविधाओं का विकास एवं सुदृढीकरण ।
(क) (ख) उत्तरांचल में आने वाले पर्यटकों के लिये सुविधाओं में सुधार ।
(ग) भारत और विदेशों में पर्यटन सम्बन्धी प्रचार एवं विपणन को प्रोत्साहन ।
(घ) राज्य में पर्यटन के विभिन्न क्षेत्रों से सम्बन्धित अध्ययन एवं अनुसंधान ।
(ङ) पर्यटन से सम्बन्धित विभिन्न क्षेत्रों में प्रशिक्षण और मानव संसाधन विकास ।
राज्य पर्यटन के प्रोत्साहन एवं विकास हेतु पर्यटन सम्बन्धी अन्य गतिविधियों का कार्यान्वयन ।
परिषद के व्यय की पूर्ति जो उसके द्वारा प्राधिकृत किया जाय।
(ज) राष्ट्रीय आपात स्थिति/ संकट के समय अंशदान/ कोष राज्य सरकार नियन्त्रणाधीन होगा और उसमें निम्नलिखित धनराशियाँ जमा की जाएगी :-
4- निधि का स्रोत
(क) राज्य सरकार, भारत सरकार अथवा अन्य राज्य सरकारों द्वारा बजट अथवा सहायता
के रूप में अंशदान ।
ख) किसी अन्य स्रोत से अंशदान ।
परिषदः की गतिविधियों से प्राप्त आय ।
ब्याज या निधि द्वारा उत्पन्न अन्य प्रकार की आय ।
किसी विशेष प्रायोजना अथवा प्रयोजन के लिए प्राप्त अंशदान ।
किसी व्यक्ति अथवा संगठन को परिषद द्वारा प्रदत्त अनुज्ञप्ति ( लाइसेंस) पंजीकरण , पट्ट आदि से प्रोदभूत शुल्क ।
(छ) परिषद द्वारा किसी पर्यटन उत्पाद पर उद्गृहीत शुल्क, परिषद द्वारा अनुमोदित कोई अन्य स्रोत ।
विनियोजन 5-
(1) उत्तरांचल पर्यटन कोष का उपयोग केवल पर्यटन विकास के प्रयोजन के
लिए किया जायेगा।
(2) निधि की धनराशि का निवेश राज्य सरकार के बॉण्ड में राज्य व केन्द्र सरकार के
अधीन वित्तीय संस्थाओं में किया जा सकेगा ।
3) यदि आधुनिक मानको के अनुरूप अपेक्षित हो तो बैंकिंग क्षेत्र में उपलब्ध परामर्शी
( (कन्सल्टेनसी) सेवाओं का उपयोग किया जा सकेगा परन्तु यह सुनिश्चित किया जाय कि निधि की धनराशि का निवेश किसी एक ही क्षेत्र तक सीमित न रह जाये ।

अध्याय-4
कोष का प्रशासन एवं प्रबन्धन
6- (क) निधि द्वारा राष्ट्रीयकृत बैंक में उत्तरांचल कोष के नाम से बचत खाता खोला जायेगा जिसमें निधि की संमस्त प्राप्ति जमा की जायेगी ।
(ख) यह खाता समिति के सचिव और कोषाधिकारी द्वारा संयुक्त रूप से अथवा परिषद निदेशानुसार संचालित किया जायेगा ।
(ग) कोष की एक कार्यकारिणी समिति होगी जिसमें निम्नलिखित सदस्य होंगे ।

(1) परिषद के अध्यक्ष/ माननीय पर्यटन मंत्री
सदस्य
(2) प्रमुख सचिव, वित्त उत्तरांचल शासन
सदस्य
3) परिषद के मुख्य कार्यकारी अधिकारी
सदस्यसचिव
( (4) परिषद के अपर मुख्य कार्यकारी अधिकारी
(5) परिषद द्वारा नामित पर्यटन प्रबन्धन और धन
सदस्य
जुटाने के अनुभव को देखते हुये विभिन्न क्षेत्रों का प्रतिनिधत्व करने वाले दो गैर सरकारी
कोषाध्यक्ष
(9) निदेशक (वित्त) वित्त नियन्त्रक
सदस्य
(7) निदेशक ( संस्कृति) उत्तरांचल शासन
(क) समिति को कोष - प्रशासन और प्रबन्धन के लिये समस्त शक्त्तियां प्राधिकारी एवं उत्तरदायित्व होगे जो नियमानुसार इन्डी तक सीमित नहीं रहेगें ।
(1 ) इस निधि से वित्त पोषित पर्यटन, से सम्बन्धित क्रियाकलापों तथा प्रायोजनाओं की स्वीकृति तथा उनके लिये व्यय प्राधिकृत करना ।
(2) निधि में अंशदान प्राप्त करना ।
(3) नियमित रूप से निधि का लेखाकार्य एवं लेखा परीक्षा सुनिश्चित करना ।
(4) परिषद को तिमाही प्रगति रिपोर्ट प्रस्तुत करना ।
(5) परिषद के निर्देशों एवं अनुदेशों का अनुपालन । (6
) परिषद तथा सरकार को निधि की वार्षिक कार्य निष्पादन रिपोर्ट प्रस्तुत करना ।
(ड़) समिति की आवश्यकतानुसार किन्तु दो माह में एक बार से कम नहीं बैठक बुलाई जा सकेगी ।
(च) गैर सरकारी सदस्य एक वर्ष की अवधि के लिये मनोनित किया जायेगा तथा पुनः मनोनियत का पात्र होगा किन्तु किसी गैर सरकारी सदस्य को तीन बार से अधिक मनोनीत नहीं किया जा सकेगा ।
(छ) बैंक खाते से धनराशि परिषद की स्पष्ट स्वीकृति से तथा उस प्रयोजन हेतु निकाली जायेगी जो परिषद द्वारा प्राधिकृत किया जाय ।
(ज) गैर सरकारी सदस्यों समिति की बैठकों में भाग लेने के लिये वास्तविक खर्च के आधार पर यात्रा भत्ते के हकदार होंगे ।
7- (1) निधि की समस्त धनराशि सम्पत्ति तथा आय - व्यय लेखे निधि की ओर से कोषाध्यक्ष द्वारा रखा जायेगा । और उनकी भारत के नियन्त्रक तथा महालेखा परीक्षक द्वारा लेखा परीक्षा की जायेगी जो यह प्रमाणित करेगे कि निधि से व्यय इन नियमों के अनुसार किया गया है।
(2) भारत के नियन्त्रक एवं महालेखा परीक्षन्त्र द्वारा लेखा- परिक्षित तथा प्रमाणित वार्षिक लेखों के विवरण का परिषद द्वारा अनुमोदन किया जायेगा और सदस्य सचिव द्वारा प्रतिवर्ष सरकार को किये जायेगे । यह विवरण राज्य की विधान सभा की पटल पर रखे जायेगे ।
8- निधि की कार्यप्रणाली पर सदस्य सचिव द्वारा प्रतिवर्ष मई माह में रिपोर्ट प्रस्तुत की जायेगी और परिषद द्वारा अनुमोदित किये जाने के पश्चात (समिति के माध्यम से) सरकार को प्रस्तुत की जायेगी तथा राज्य की विधान सभा की पटल पर रखी जायेगी ।

अध्याय-4
विविध
9- यह नियम परिषद द्वारा परिवर्तित, संशोधित एवं निरसित किये जा सकेगे और सरकार के अनुमोदन के पश्चात लागू होगें ।

The Uttaranchal Tourism Development Fund Rules 1-Short Title , Commencement and Extent.
(a ) - These rules may be called the Uttaranchal Tourism Development Fund .
(b)- These Rules shall be effective from the date of their publication in the official gazette of the State Govt .
(c)- These Rules shall extend the whole State of Uttaranchal .
2-Definitions:
In these rules , unless the context otherwise requires: -
(a )- " Board " means the Uttaranchal Tourism Development Board;
(b)- "Act" means the Uttaranchal Tourism Development Board Act , 2001 ;
(c)- "Committee " means the executive committee constituted under rule- 5(c);
(d)- "Fund" means the Uttaranchal Tourism Development Board fund ;
(e)- "Rules" means the rules to manage and administer the Fund ;
( f)- "State" means the State of Uttaranchal ;
(g) - "Govt." means the Govt . of Uttaranchal;
(h)- " Chief Executive Officer" means the Chief Executive Officer of Uttaranchal Tourism Development Board;
(i ) - "Additional Chief Executive Officer" means the Additional Chief Executive Officer of Uttaranchal Tourism Development Board;

3-Objects of the Fund:
The objectives of the Fund will be: -
(a ) - to develop and strengthen tourism related infrastructure in the State ;
(b)- to improve facilities for the tourists to Uttaranchal ;
(c)- to promote publicity and marketing of tourism within India and abroad ;
(d )- to conduct studies and research related to various sectors of tourism in State;
(e)- training and human resource development in various sectors of tourism related activities;
(f)- to carry out any other tourism related activities which may be considered necessary for the promotion and development of tourism in the State ;
(g )- to meet such expenses of the Board as may be authorized by it ;
(h) - to contribute in case of national emergency/ calamity;
4-Sources of the Fund:
Any and all of the following will constitute the sources for the fund:
(a ) - all contributions from the Govt . of Uttaranchal , Govt . of India or any other State Govts . in the form of budgetary support or otherwise ; Specifically meaint for this fund.
(b)- any contribution from any other source ;
(c)- income generated by the Board through any of its activities ;
( d ) - interest or any other form of income generated from the fund ;
(e) - contribution towards any special project or purpose;
(f ) - fees accrued from licenses , registration , lease etc. granted by the Board to any individual or organization ;
( g) - fees levied by the Government or Board on any tourism product ;
( h ) - any other source approved by the Board .
5-Management and Administration of the Fund :
(a) - There shall be maintained a savings bank account in a Nationalised Bank in which all receipts will be deposited , in the name of "Uttaranchal Tourism Development Fund" .
(b) - This account shall be operated by the Secretary and Treasurer of the Committee jointly or as directed by the Board .

(c)- There shall be an Executive Committee comprising the following . members .
President
(i )- Chairman , U.T.D.Board
Member
( ii )- Principal Secretary(to the Deptt. Of Finance of State Govt .)
Member
(iii) - Chief Executive Officer of the Board
Member Secretary (iv) - Additional Chief Executive Officer of the Board
Member
(v)- Two Non- Official members nominated by the Board representing various fields and keeping in view their experience in the field of Tourism Management & fund raising .
(vi )- Finance Controller , Uttaranchal Tourism Development Board
Treasurer
(vii)- Director (Culture ) , Govt. of Uttaranchal
Member
(d)- The Committee shall have all the powers , authority and responsibilities for management and administration of the Fund and which shall include but not be restricted to the following:
(i )- to sanction Tourism related activities and projects to be funded from this Fund and authorize expenditure for the same,
( ii )- to accept contribution to the fund ,
(iii) - to ensure proper accounting and audit of the Fund on a regular basis, (iv) - to submit quarterly progress report to the Board;
(v) - to carry out the directions /instructions given by the Board ;
(vi )- to submit annual performance report of the Fund to the Board and the Govt.
(e)- The Committee can meet as frequently as required but not less then once in two months .
(1)- A non- official member shall be nominated for a period of One year and shall be eligible for re - nomination but not more than 3 times .
(g)- The money shall be withdrawn from the bank account only on the explicit sanction of and for the purpose authorized by the Committee .
(h )- The non - official members will be entitled to traveling allowance on an actual expenditure basis for attending the meeting of the Committee .

6-Accounts and Audit :
(i ) - Accounts of all moneys and properties and of income and expenditure of the Fund shall be maintained by the Treasurer on behalf of the Committee and audited by the Comptroller and Auditor General of India who shall certify that the expenditure from the fund has been incurred in accordance with the provisions of these rules .
(ii )- A statement of the annual accounts of the Fund shall be approved by the Board after the same has been audited and certified by the Comptroller & Auditor General of India and shall be submitted by the Member Secretary to the Govt . every year. These statements shall be laid on the table of the State Assembly.
7-Annual Report :
A report on the working of the Fund of every year shall be prepared in the month of May by The Member Secretary and after approval of the Board( through the Committee ) presented to the Govt . This report shall be lald on the table of the State Assembly.
8 -Miscellaneous :
These rules may be changed, modified or repealed by the Board and will come into force after approval by the Govt .
