"भारत का संविधान" के अनुच्छेद 213 के खण्ड (1 ) के अधीन मा ० राज्यपाल ने ' समान नागरिक संहिता, उत्तराखण्ड (संशोधन) अध्यादेश, 2026 ' प्रख्यापित किया है और वह उत्तराखण्ड राज्य का अध्यादेश संख्याः 02 वर्ष-2026 के रूप में सर्व साधारण के सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है ।

समान नागरिक संहिता, उत्तराखण्ड, 2024 (उत्तराखण्ड अधिनियम संख्या-03 वर्ष, 2024) में अग्रेत्तर संशोधन करने के लिए ,
अध्यादेश
चूँकि, राज्य की विधान सभा सत्र में नहीं है और राज्यपाल का यह समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान है, जिनके कारण उन्हें तुरन्त कार्रवाई करना आवश्यक हो गया है;
अतएव , अब, राज्यपाल भारत का संविधान के अनुच्छेद 213 के खण्ड (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित अध्यादेश प्रख्यापित करते हैं-
1.
संक्षिप्त नाम और प्रारम्भ
(1) इस अध्यादेश का संक्षिप्त नाम समान नागरिक संहिता, उत्तराखण्ड (संशोधन) अध्यादेश, 2026 है ।
(2) यह तुरन्त प्रवृत्त होगा ।

संहिता में संशोधन
समान नागरिक संहिता , उत्तराखण्ड, 2024 (जिसे यहाँ आगे मूल संहिता कहा गया है ) में " दण्ड प्रक्रिया संहिता 1973 (अधिनियम संख्या 02, वर्ष 1974 )" शब्द, अंक एवं चिन्ह के स्थान पर , जहाँ - जहाँ वह आते है " भारतीय नागरिक सुरक्षा संहिता, 2023 (अधिनियम संख्या 46, वर्ष 2023) " शब्द, अंक एवं चिन्ह रख दिये जायेंगे ।

धारा 7 का संशोधन
मूल संहिता की धारा 7 में , उपधारा (1 ) के द्वितीय परन्तुक में, "छह माह " शब्दों के स्थान पर "एक वर्ष " शब्द रख दिये जायेंगे ।
4. मूल संहिता में , धारा 10 में,-
धारा 10 का संशोधन
( i ) उपधारा (2) में , " छह माह " शब्दों के स्थान पर " एक वर्ष "
शब्द रख दिये जायेंगे ;
(ii ) उपधारा ( 3 ) में, " छह माह " शब्दों के स्थान पर "एक वर्ष " शब्द रख दिये जायेंगे ।

5. मूल संहिता में , धारा 11 में,-
धारा 11 का संशोधन
(i ) उपधारा (3 ) में, " छह माह " शब्दों के स्थान पर " एक वर्ष " शब्द रख दिये जायेंगे ;
( ii ) उपधारा (4) में, " छह माह " शब्दों के स्थान पर "एक वर्ष " शब्द रख दिये जायेंगे ।
6.
धारा 12 का संशोधन
मूल संहिता की धारा 12 की उपधारा (1 ) में शब्द 'सचिव' के स्थान पर शब्द " अपर सचिव " रख दिये जाएंगे ।
7.
धारा 13 का संशोधन
मूल संहिता में धारा 13 की उपधारा (3 ) को निम्नवत् प्रतिस्थापित कर दिया जायेगा , अर्थात्ः- "यदि उप- निबंधक उपधारा (2) में निर्धारित समयान्तर्गत कार्यवाही करने में विफल रहता है , तो उस विवाह, विवाह-विच्छेद या विवाह की अकृतता जैसा भी मामला हो , को स्वचालित रूप से निबंधक के समक्ष अग्रेषित हो जाएगा तथा यदि निबंधक निर्धारित समयान्तर्गत कार्यवाही करने में विफल रहता है तो महानिबंधक के समक्ष अग्रेषित हो जायेगा । "

धारा 17 का संशोधन
मूल संहिता की धारा 17 की उपधारा (2) में, "तीन माह तक के कारावास या पच्चीस हजार रूपये तक की शास्ति या दोनों के दण्ड का अधिकारी होगा " शब्दों के स्थान पर " भारतीय न्याय संहिता, 2023 (अधिनियम सं. 45, वर्ष 2023 ) में निहित प्रावधानों के अनुसार दण्डनीय होगा " शब्द, अंक और चिन्ह रख दिये जायेंगे ।
मूल संहिता की धारा 19 में, शीर्षक में " दण्ड" शब्द के स्थान पर " शास्ति" शब्द रख दिया जायेगा ।
धारा 19 का 9 . संशोधन
10. मूल संहिता की धारा 19 के पश्चात् निम्नलिखित धारा नवीन धारा 19क का अन्तःस्थापन
अंतस्थापित कर दी जायेंगी , अर्थात्- "19 क. उप- निबंधक पर शास्ति अधिरोपण के विरूद्ध अपील- (1 ) जहां धारा 19 के अंतर्गत उप- निबंधक पर शास्ति अधिरोपित की गयी हो, वहाँ वह तीस दिवस के भीतर राज्य सरकार द्वारा अधिसूचित सक्षम अपीलीय प्राधिकारी के समक्ष अपील प्रस्तुत कर सकेगा ।

(2) उपधारा (1 ) के अंतर्गत की गई अपील , शास्ति आदेश की प्रमाणित प्रति के साथ , विहित प्ररूप एवं रीति में प्रस्तुत की जाएगी , जैसा कि राज्य सरकार द्वारा निर्धारित किया जाए ।
(3) अपीलीय प्राधिकारी , ऐसे आदेश को पुष्ट, उपांतरित या अपास्त कर सकेगा, जैसा वह उचित समझे । " ।
11. मूल संहिता की धारा 24 की उपधारा (1 ) में, -
धारा 24 का संशोधन
(i) खण्ड (घ) में " । " चिन्ह के स्थान पर " ; या " शब्द और चिन्ह रख दिये जायेंगे ;
(ii) खण्ड (घ) के पश्चात् निम्नलिखित खण्ड अंतःस्थापित कर दिया जायेगा, अर्थात-
" (ङ) कि विवाह के समय विवाह के किसी एक पक्षकार ने अपनी पहचान के विषय में मिथ्या प्रस्तुतिकरण किया हो । "
12.
धारा 25 का संशोधन
मूल संहिता में धारा 25 की उपधारा (3 ) के खण्ड (i ) को निम्नवत् प्रतिस्थापित कर दिया जाएगा, अर्थात्-
"(i ) पति विवाह के अनुष्ठापन / अनुबंधन के पश्चात् बलात्कार, गुदामैथुन, पशुगमन अथवा शव मैथुन में लिप्त हो; या "
13.
धारा 26 का संशोधन
मूल संहिता की धारा 26 में शब्द, अंक और चिन्ह " उपधारा (2 ) के खंड (i ) और (ii )" के स्थान पर शब्द, अंक और चिन्ह " तथा उपधारा (2) एवं उपधारा (3) " प्रतिस्थापित कर दिये जायेंगे ।
14.
धारा 32 का संशोधन
मूल संहिता में धारा 32 की उपधारा (1 ) निम्नवत् प्रतिस्थापित कर दी जायेगी , अर्थात्-
" (1 ) कोई भी व्यक्ति जो-
(i) जिसका पति या पत्नी जीवित है , संहिता के प्रारम्भ होने के पश्चात् धारा 4 के खंड (i ) का उल्लंघन करते हुए किसी अन्य से विवाह करता है, तो वह भारतीय न्याय संहिता, 2023 (अधिनियम संख्या 45 , वर्ष 2023 ) के अंतर्गत दण्ड का भागी होगा;
(ii) धारा 4 के खंड ( iii ) का उल्लंघन कर विवाह करता है, तो 5 उत्तराखण्ड असाधारण गजट, 27 जनवरी , 2026 ई० (माघ 07 , 1947 शक सम्वत्)
उसका यह कृत्य बाल विवाह प्रतिषेध अधिनियम, 2006 (अधिनियम संख्या 6 , वर्ष 2007) के अंतर्गत दण्डनीय होगा;
(iii) धारा 4 के खण्ड (iv) के उल्लंघन में विवाह की उपाप्त करता है, वह छः माह तक के साधारण कारावास और पचास हजार रूपये तक का जुर्माना और जुर्माना न देने पर अतिरिक्त कारावास, जो एक माह तक विस्तारित किया जा सकता है , के दण्ड का भागी होगा;
(iv) धारा 29 के उल्लंघन में विवाह विघटित करता है , वह तीन वर्ष तक के कारावास के दण्ड का तथा जुर्माना का भागी होगा;
(v) किसी व्यक्ति को पुनर्विवाह से पहले धारा 30 की उपधारा
(2) में निर्दिष्ट किसी भी बाधा के अनुरूप आचरण करने के लिए विवश , दुष्प्रेरित या अभिप्रेरित करता है, वह तीन वर्ष तक की अवधि के कारावास तथा एक लाख रूपये तक का जुर्माना और जुर्माना न देने पर छः माह तक के अतिरिक्त कारावास के दण्ड का भागी होगा;
(vi ) बल , दबाव या धोखाधड़ी के माध्यम से किसी व्यक्ति से विवाह के लिए सहमति प्राप्त करता है , वह सात वर्ष तक के कारावास से दण्डित किया जायेगा और जुर्माने का भी भागी होगा;
(vii) विवाह के लिए अपनी पहचान, वैवाहिक स्थिति को छिपाता है या गलत जानकारी देता है, तो उसका यह कृत्य भारतीय न्याय संहिता, 2023 (अधिनियम संख्या 45 , वर्ष 2023 ) के अंतर्गत दण्डनीय होगा । " ।
15.
धारा 43 का संशोधन
मूल संहिता की धारा 43 में उपधारा (1 ) के अंत में , "न्यायालय तद्नुसार ऐसे अनुतोष की आज्ञप्ति पारित करेगा " शब्दों के स्थान पर "न्यायालय खण्ड (क ) , (ख ) तथा (ग) के अनुसार अनुतोष प्रदान करेगा " शब्द और चिन्ह रख दिये जायेंगे ।
16.
धारा 384 का संशोधन
मूल संहिता में धारा 384 के अंत में निम्नलिखित शब्द एवं चिन्ह जोड़ दिये जायेंगे , अर्थात्-
"ऐसे मामलों में , निबंधक दोनों सहवासियों को, राज्य सरकार 6

द्वारा निर्धारित प्रपत्र में, सहवासी संबंध समाप्त होने का प्रमाण - पत्र जारी करेगा । " ।
मूल संहिता की धारा 385 में,-
धारा 385 का 17 . संशोधन
(i) उपधारा (1 ) में, " ऐसे सहवासी" शब्दों के स्थान पर "उन सहवासियों " शब्द रख दिये जाएंगे ;
(ii) उपधारा (2) का लोप कर दिया जायेगा;
(iii) उपधारा (3 ) में, "ऐसे सहवासी " शब्दों के स्थान पर "उन सहवासियों " शब्द रख दिये जाएंगे ।
धारा 387 का 18 . संशोधन
मूल संहिता की धारा 387 में, उपधारा (3) के पश्चात् निम्नलिखित उपधाराएं अंतःस्थापित कर दी जाऐंगी , अर्थात्-
"(4) यदि कोई व्यक्ति बल , दबाव या धोखाधड़ी द्वारा किसी व्यक्ति की सहमति प्राप्त कर सहवासी संबंध स्थापित करता है, तो वह कारावास से, जिसकी अवधि सात वर्ष तक हो सकती है, दंडित किया जायेगा और जुर्माने का भी दायी होगा ।
(5) जो कोई भी धारा 380 की उपधारा (2) के उल्लंघन में सहवासी सम्बंध में रहता है, को सात वर्ष तक के कारावास से दंडित किया जायेगा तथा वह जुर्माने का भी दायी होगाः
परन्तु इस उपधारा की कोई बात ऐसे किसी व्यक्ति पर लागू नहीं होगी जिसने सहवासी संबंध को समाप्त कर दिया हो अथवा जिसके साथी के विषय में सात वर्ष या उससे अधिक अवधि से कोई जानकारी न हो ।
(6) जो कोई वयस्क व्यक्ति धारा 380 की उपधारा (3 ) के उल्लंघन में किसी अवयस्क के साथ सहवासी संबंध में रहता है, तो वह छः मास तक के साधारण कारावास और जुर्माने से जो पचास हजार रूपये तक का हो सकेगा और ऐसा जुर्माना न देने पर अतिरिक्त कारावास , जो एक मास तक विस्तारित किया जा सकता है , से दण्डित किया जा सकेगा । " ।
7 उत्तराखण्ड असाधारण गजट, 27 जनवरी , 2026 ई ० (माघ 07 , 1947 शक सम्वत्)
19. मूल संहिता में धारा 390 के पश्चात् निम्नलिखित धाराएं अंतःस्थापित कर दी जायेंगी , अर्थात्ः-
" 390क. पंजीकरण निरस्त करने की शक्ति-
नवीन धारा 390क एवं 390ख का अन्तःस्थापन
विवाह , विवाह- विच्छेद, सहवासी सम्बंध अथवा उत्तराधिकार से संबंधित किसी पंजीकरण को निरस्त करने की शक्ति धारा 12 के अंतर्गत नियुक्त महानिबन्धक को होगी । ऐसे पंजीकरण को निरस्त किये जाने से पूर्व महानिबन्धक द्वारा आवेदक को सुनवाई का पूर्ण अवसर दिया जायेगा ।
390ख . शास्ति की वसूली-
इस संहिता के उपबंधों के अंतर्गत लगायी गयी कोई भी शास्ति, भू- राजस्व के बकाये की भांति अथवा इस संहिता के अंतर्गत बनाए गए नियमों द्वारा विनिर्दिष्ट प्रक्रिया के अनुसार बसूल की जाएगी । " ।
20 .
अनुसूची-2 का संशोधन
मूल संहिता में अनुसूची-2 की श्रेणी-1 की कम संख्या -3 में शब्द "विधवा " के स्थान पर " पति / पत्नी " शब्द रख दिये जायेंगे ।
21.
व्यावृत्ति
समान नागरिक संहिता, उत्तराखण्ड ( संशोधन ) अध्यादेश, 2025 (अध्यादेश संख्या-03 वर्ष, 2025) के अधीन की गई कोई बात या कार्रवाई इस अध्यादेश के तत्स्थानी उपबंधों के अधीन की गई समझी जायेगी ।

Miscellaneous
In pursuance of the provisions of Clause ( 3 ) of Article 348 of the Constitution of India , the Governor is pleased to order the publication of the following English translation of 'The Uniform Civil Code , Uttarakhand (Amendment) Ordinance , 2026' ( Uttarakhand Ordinance No. 02 of 2026) .

AN
ORDINANCE
further to amend the Uniform Civil Code , Uttarakhand , 2024 ( Uttarakhand Act No. 03 of the year , 2024) ,
Whereas , the Legislative Assembly of the State is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action;
Now, therefore, in exercise of the powers conferred by clause ( 1) of article 213 of the Constitution of India , the Governor is pleased to promulgate the following Ordinance: -
1.
Short title and commencement
(1) This Ordinance may be called the Uniform Civil Code , Uttarakhand (Amendment ) Ordinance , 2026 .
(2) It shall come into force at once.
2.
Amendment in Code
In the Uniform Civil Code , Uttarakhand , 2024 ( hereinafter referred to as the principal Code ) for the words , figures and signs " Criminal Procedure Code, 1973 (Act No 2 year 1974) " , wherever they occur, the words , figures and signs "Bharatiya Nagarik Suraksha Sanhita , 2023 (Act No. 46 of 2023 ) " shall be substituted .

Amendment of 3. section 7
In section 7 of the principal Code , in the second proviso of the sub - section ( 1 ) , for the words " six months " , the words " one year " shall be substituted .
4. In the principal Code , in section 10 , -
Amendment of section 10
(i ) in sub - section (2) , for the words " six months " , the words " one year " shall be substituted ;
(ii) in sub - section (3 ) , for the words " six months " , the words " one year " shall be substituted .
5. In the principal Code, in section 11 , -
Amendment of section 11
(i) , in sub - section (3 ) , for the words " six months " , the words " one year " shall be substituted ;
(ii) in sub - section (4), for the words " six months " , the words " one year " shall be substituted.

Amendment of section 12
In sub - section ( 1 ) of section 12 of the principal Code , for the word " Secretary " , the words " Additional Secretary " shall be substituted .
7.
Amendment of section 13
In the principal Code , sub - section ( 3 ) of Section 13 shall be substituted as follows , namely :-
" If the Sub- Registrar fails to take action within the time period prescribed under sub - section (2) , the marriage , divorce or declaration of nullity of marriage , as the case may be , shall automatically get forwarded to the Registrar , and if the Registrar fails to take action within the prescribed time period , it shall get forwarded to the Registrar general ." .

Amendment of section 17
In sub - section (2 ) of section 17 of the principal Code , for the words " shall be punishable with imprisonment for a term which may extend to three months , or with fine not exceeding twenty - five thousand rupees , or with both" , the words , figures and signs " shall be punishable according to the provisions contained in the Bharatiya Nyaya Sanhita ,. 2023 (Act No. 45 of 2023 ) " shall be substituted.
9.
Amendment of section 19
In section 19 of the principal Code , in the heading , for the word " punishment " , the word " penalty " shall be substituted .
10.
Insertion of new section 19 A
After section 19 of the principal Code , following section shall be inserted , namely-
" 19A. Appeal against penalty imposed on Sub- Registrar- 10

(1 ) Where a penalty has been imposed on a Sub - Registrar under section 19 , he may prefer an appeal within thirty days before the competent appellate authority as notified by the State Government .
(2) An appeal under sub - section ( 1 ) shall be presented along with certified copy of the order of penalty in the prescribed form and manner , as determinedby the State Government .
(3 ) The appellate authority may , confirm , modify or annul such order as it deems necessary . " .
In sub - section (1 ) of section 24 of the principal Code, - 11.
Amendment of section 24
(i) in clause (d) for the sign " . " , the "; or " sign and word shall be substituted;
(ii) after clause (d) , the following clause shall be inserted as follows , namely: -
"( e) that at the time of the marriage one of the parties to the marriage had misrepresented his /her identity. " .
Amendment of section 25
12. In the principal Code , clause ( i) of sub- section (3 ) of section 25 shall be substituted as follows , namely- "( i) the husband has, since the solemnization/ contracting of the marriage , indulged in rape , anal sex, bestiality or necrophiliac sexual intercourse ; or . " .
13.
Amendment of section 26
In section 26 of the principal Code after words , figures and signs " clauses (i ) and ( ii ) of sub - section (2) " , the words , figures and signs " sub - section (2) and sub- section (3) " shall be substituted.
14.
Amendment of section 32
In the principal Code , sub - section ( 1 ) of section 32 shall be substituted as follows , namely-
" ( 1 ) Any person who-
(i) having a husband or wife is living , marriage another person after the commencement of the Code in contravention of clause (i ) of section 4 , shall be punishable under the Bharatiya Nyaya Sanhita , 2023 (Act No. 45 of 2023 ) ;
(ii ) contracts a marriage in contravention of clause (iii ) of section 4, such act shall be punishable under the Prohibition of Child Marriage Act, 2006 (Act No. 6 of2007);
(iii ) procures a marriage in contravention of clause (iv ) of section 4 shall be punishable with simple imprisonment for a term which may extend to six 11 उत्तराखण्ड असाधारण गजट , 27 जनवरी , 2026 ई० (माघ 07, 1947 शक सम्वत्)
months and with fine not exceeding rupees fifty thousand , and in default of fine, to undergo further imprisonment for a term which may extend to one month;
(iv) dissolves a marriage in contravention of section 29 shall be punishable with imprisonment for a term which may extend to three years and shall also be liable to fine ;
(v) compels , abets or induces a person to observe any condition as is referred to in sub - section (2) of section 30 before remarriage shall be publishable with imprisonment for a term which may extend to three years and shall also be liable to fine of rupees one lakh, and in default of fine , to undergo further imprisonment for a term which may extend to six months;
(vi) obtains the consent of a person for marriage by force , coercion or fraud shall be punishable with imprisonment for a term which may extend to seven years and shall also be liable to fine ;
(vii) procured the consent for marriage through misrepresentation or concealment of facts then such act shall be punishable under ' the Bharatiya Nyaya Sanhita, 2023 ( Act No. 45 of 2023 ) . " .
15.
Amendment of section 43
In section 43 of the principal Code , at the end of in sub- section ( 1 ) , for the words " the Court shall decree such relief accordingly . " , the words and sign " the Court shall grant relief in accordance with clauses (a) , (b ) and (c ) . " shall be substituted .
16.
Amendment of section 384
In the principal Code at the end of section 384, the following words and sign shall be added , namely- "In such cases , the registrar shall issue a certificate regarding termination of the live- in relationship to both the partners , in a format prescribed by the State Government . " .
In section 385 of the principal Code.-
17.
Amendment of section 385
(i) in sub - section ( 1 ) , for the words and sign " such partner (s ) " , the words " those partners " shall be substituted;
(ii ) sub - section (2 ) has been omitted;
( iii ) in sub - section (3 ) , for the words and sign " such partner (s ) " , the words " those partners " shall be substituted .

Amendment of section 387
In section 387 of the principal Code , after sub - section (3 ) , the following sub - sections shall be inserted , namely- "(4) Whoever obtains the consent of any person by force , coercion or fraud to establish a live - in relationship shall be punishable with imprisonment for a term which may extend to seven years and shall also be liable to fine .
(5) Whoever stays in live - in relationship in contravention of sub - section (2) of section 380 shall be punishable with imprisonment for a term which may extend to seven years and shall also be liable to fine : a Provided that , nothing in this sub - section shall apply to a person who has terminated the live- in relationship or whose partner has not been heard of for a period of seven years or more .
(6) Any major person who lives in a live - in relationship with minor in contravention of sub- section ( 3 ) of section 380 shall be punishable with simple imprisonment for a term which may extend to six months and with fine which may extend to fifty thousand rupees ; and in default of payment of such fine , with further imprisonment which may extend to one month . " .
19. In the principal code after section 390 the following sections shall be inserted , namely:-
Insertion of new sections 390A and 390B
" 390A . Power to cancel registration- The power to cancel any registration relating to marriage , divorce , live - in relationship or succession shall lie with the Registrar General appointed under Section 12. Before the cancelling such registration, the applicant shalt be given opportunity of being heard by the Registrar General .
390B. Recovery of penalty-
Any penalty imposed under the provisions of this Code shall be recovered like arrears of land revenue or in such manner as may be specified by rules made under this Code ." .
20.
Amendment of Schedule-2
In the principal Code , in serial number 3 of Class - 1 of Schedule - 2 , for the word " Widow " , the word " Spouse " shall be substituted .

Savings
Anything done or any action taken under the Uniform Civil Code , Uttarakhand (Amendment ) Ordinance , 2025 (Ordinance No. 03 of 2025 ) shall be deemed to have been done or taken under the corresponding provisions ofthis Ordinance .
