" भारत का सविधान " के अनुच्छेद 200 के अधीन महामहिम राज्यपाल ने उत्तराखण्ड विधान सभा द्वारा पारित " उत्तराखण्ड दुकान और स्थापन (रोजगार विनियम और सेवा -शर्त) (संशोधन) विधेयक , 2026 " पर दिनांक 15 अप्रैल , 2026 को अनुमति प्रदान की और वह उत्तराखण्ड का अधिनियम संख्या 06 , वर्ष 2026 के रूप में सर्व - साधारण के सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है ।

(उत्तराखण्ड अधिनियम संख्या - 06 , वर्ष 2026)

उत्तराखण्ड दुकान और स्थापन (रोजगार विनियमन और सेवा- शर्त) अधिनियम , 2017 (अधिनियम संख्या-03 , वर्ष 2018) का अग्रेत्तर संशोधन करने के लिए,

अधिनियम

भारत गणराज्य के सतहत्तरवें वर्ष में उत्तराखण्ड राज्य विधान - मंडल द्वारा निम्नलिखित रूप में अधिनियमित होः-

संक्षिप्त नाम , विस्तार एवं 1 प्रारम्भ

इस अधिनियम का संक्षिप्त नाम उत्तराखण्ड दुकान और स्थापन (रोजगार विनियमन और सेवा-शर्त) (संशोधन) अधिनियम , 2026 है । (1)

(2) इसका विस्तार संपूर्ण उत्तराखण्ड राज्य पर होगा ।

यह तुरंत प्रवृत्त होगा । (3)

धारा 1 का संशोधन

2. उत्तराखण्ड दुकान और स्थापन (रोजगार विनियमन और सेवा - शर्त) अधिनियम , 2017 (उत्तराखण्ड अधिनियम संख्या-03 , वर्ष 2018 ) (जिसे इसमें इसके पश्चात् मूल अधिनियम कहा गया है) की धारा 1 की उपधारा (2) में " दस" शब्द के स्थान पर " बीस" शब्द प्रतिस्थापित कर दिये जायेंगे ।

धारा 8 का संशोधन

3. मूल अधिनियम की धारा 8 में-

(i) उपधारा (1 ) में शब्द "नौ घण्टे" एवं " पांच घण्टे" शब्दों के स्थान पर क्रमशः " दस घण्टे" और " छः घण्टे" शब्द प्रतिस्थापित कर दिए जायेंगे ।

(ii) उपधारा (2) के स्थान पर निम्नलिखित उपधारा प्रतिस्थापित कर दी जाएगी, अर्थात्ः-

" (2) किसी भी दुकान या. स्थापन में किसी पाली में कार्य के घण्टों की कुल संख्या, जिसके अन्तर्गत विश्राम अंतराल भी है, बारह घण्टों से अधिक नहीं होगी । "

(iii) उपधारा (3 ) में "नौ घण्टों" एवं "एक सौ पच्चीस " शब्दों के स्थान पर क्रमशः "दस घण्टे" और " एक सौ चवालीस घण्टे" शब्द प्रतिस्थापितः कर दिये जायेंगे ।

धारा 9 का संशोधन

मूल अधिनियम की धारा 9 में " नौ घण्टे" शब्द के स्थान पर " दस घण्टे" शब्द प्रतिस्थापित कर दिये जायेंगे ।

धारा 19 का संशोधन 5. मूल अधिनियम की धारा 19 के स्थान पर निम्नलिखित धारा प्रतिस्थापित कर दी जायेगी, अर्थात्ः-

" 19. किसी दुकान या प्रतिष्ठान के प्रत्येक नियोक्ता ऐसे प्रारूप और

रीति (इलेक्ट्रानिक फॉर्म सहित) में वार्षिक विवरण रखेगा, जैसा विहित किया जाए । " उत्तराखण्ड असाधारण गजट, 17 अप्रैल, 2026 ई 0 (चैत्र 27 , 1948 शक सम्वत्) 3

निरसन और व्यावृत्ति

उत्तराखण्ड दुकान और स्थापन (रोजगार विनियमन और सेवा - शर्त) (संशोधन) अध्यादेश, 2025 एतद्वारा निरसित किया जाता है ।

(2) ऐसे निरसन के होते हुए भी उक्त अध्यादेश के अधीन कृत कोई कार्य या की गयी कोई कार्रवाई , इस अधिनियम के तत्स्थानी उपबंधों के अधीन कृत या की गयी समझी जायेगी ।

उददेश्योंऔर कारणों का कथन

उत्तराखण्ड दुकान और स्थापन (रोजगार विनियमन और सेवा- शर्त) अधिनियम, 2017 के अन्तर्गत प्रदेश में दुकानों की बिक्री बढ़ाने , नई दुकानों के खुलने को आसान बनाने , निवेश प्रोत्साहन देने , दुकानों में काम करने के समय को लचीला बनाने एवं प्रशासनिक बोझ कम करने, दुकानों की कार्यक्षता बढ़ाने, भारत सरकार के ईज ऑफ डूइंग बिजनेस, वैश्विक प्रतिस्पर्धा एवं आर्थिक वृद्धि हेतु और कामगारों को ज्यादा काम करने का मौका प्रदान किये जाने हेतु उक्त अधिनियम की कतिपय धाराओं में संशोधन किये जाने के लिए अध्यादेश प्रख्यापित किया गया था ।

2- करता है । प्रस्तावित विधेयक उक्त अध्यादेश का प्रतिस्थानी विधेयक है, जो उक्त उद्देश्यों की पूर्ति

In pursuance of the provisions of Clause ( 3 ) of Article 348 of the Constitution of India , the Governor is pleased to order the publication of the following English translation of ' The Uttarakhand Shops and Establishments (Regulation of Employment and Conditions of Service) (Amendment) Act , 2026' ( Adhiniyam Sankhya 06 , of 2026 )

As passed by the Uttarakhand Legislative Assemble and assented to by the Governor on 15 April , 2026 .

THE UTTARAKHAND SHOPS AND ESTABLISHMENTS (REGULATION OF EMPLOYMENT AND CONDITIONS OF SERVICE)

(AMENDMENT) ACT, 2026

[Uttarakhand Act No. 06 Of 2026 ]

ACT

further to amend the Uttarakhand Shops and Establishments ( Regulation of Employment and Conditions of Service) Act, 2017 (Act No 03 of 2018 ) ,

Be it enacted by Uttarakhand State Legislature in the Seventy - seventh Year of the Republic of India as follows : -

Short title , extent and commencement 1 (1) This Act may be called the Uttarakhand Shops and Establishments (Regulation of Employment and Conditions of Service) (Amendment) Act, 2026.

(2) It shall extend to the whole State of Uttarakhand .

(3) It shall come into force at once .

Amendment of 2 . Section 1

In sub - section (2 ) of the section ( 1 ) of the Uttarakhand Shops and Establishments (Regulation of Employment and Conditions of Service) Act , 2017 ( Uttarakhand Act No 03 of 2018 ) (hereinafter referred to as the principal Act) , for the word " ten ", the word "twenty" shall be substituted;

In section 8 of the principal Act-

Amendment of 3 . Section 8

(i ) In sub -section ( 1 ) for the word " nine hours " and " five hours " , the words " ten hours " and " six hours " shall respectively be substituted .

(ii) For sub - section (2) of the principal Act , the following sub- section shall be substituted , namely: -

"(2) In any shop or establishment, the total number of hours of work in a shift including the rest interval shall not exceed twelve hours . "

(iii) In sub -section (3 ) for the words "nine hours " and " one hundred and twenty five " the words " ten hours " and " one hundred and forty four hours " shall respectively be substituted .

Amendment of 4. Section 9

Insection 9 of the principal Act, for the words " nine hours", the words " ten hours " shall be substituted .

Amendment of 5 . Section 19

For section 19 of the principal Act, the following section shall be substituted , namely: -

" 19. Every employer of shop and establishment shall furnish an annual return , in such a form and manner (including electronic form ) , as may be prescribed . "

Repeal saving and 6 . (1) The Uttarakhand Shops and Establishments (Regulation of Employment and Conditions of Service) (Amendment) Ordinance , 2025 is hereby repealed .

(2) Notwithstanding such repeal , anything done or any action taken under said Ordinance , shall be deemed to have been done or taken under the corresponding provisions of this Act.

Statement of Objectives and reasons

Under the Uttarakhand Shops and Establishments (Employment Regulation and Conditions of Service) Act, 2017, to increase the sales of shops in the State, to facilitate opening of new shops, to encourage investment, to make the working hours of shops flexible and to reduce the administrative burden, to increase the efficiency of shops for the ease of doing business of the Government of India, global competition and economic growth and to provide more working opportunities to the workers , an Ordinance was promulgated to amend certain sections of the saidAct.

2- The Proposed bill is replacing bill of the said Ordinance and fulfills the aforesaid objectives .
