" भारत का संविधान " के अनुच्छेद 200 के अधीन मा० राज्यपाल ने उत्तराखण्ड विधान सभा द्वारा पारित 'उत्तराखण्ड भाषा संस्थान (संशोधन) विधेयक, 2026' पर दिनांक 15 अप्रैल, 2026 को अनुमति प्रदान की और वह उत्तराखण्ड का अधिनियम संख्याः 05 वर्ष, 2026 के रूप में सर्व- साधारण के सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है ।

उत्तराखण्ड भाषा संस्थान अधिनियम , 2018 में अग्रेत्तर संशोधन के लिए ,

अधिनियम

भारत गणराज्य के सतत्तरहवें वर्ष में उत्तराखण्ड राज्य विधान-मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

( 1 ) इस अधिनियम का संक्षिप्त नाम उत्तराखण्ड भाषा संस्थान (संशोधन ) अधिनियम, 2026है ।

संक्षिप्त नाम 1. और प्रारम्भ

(2) यह तुरन्त प्रवृत्त होगा ।

धारा 2 का 2. संशोधन

उत्तराखण्ड भाषा संस्थान अधिनियम, 2018 (उत्तराखण्ड अधिनियम संख्या-16, वर्ष 2018) (जिसे इसमें इसके पश्चात् मूल अधिनियम कहा गया है) में धारा 2 का खण्ड (छ) एवं (ठ) निम्नवत् प्रतिस्थापित कर दिया जायेगा, अर्थात्:-

"(छ) " अकादमी" से डॉ० पीताम्बर दत्त बड़थ्वाल हिन्दी अकादमी उत्तराखण्ड, उत्तराखण्ड उर्दू अकादमी , उत्तराखण्ड पंजाबी अकादमी, उत्तराखण्ड लोकभाषा व बोली अकादमी एवं उत्तराखण्ड नेपाली अकादमी अभिप्रेत हैं;"

"(ठ) " उप निदेशक " से डॉ० पीताम्बर दत्त बड़थ्वाल हिन्दी अकादमी उत्तराखण्ड, उत्तराखण्ड उर्दू अकादमी, उत्तराखण्ड पंजाबी अकादमी, उत्तराखण्ड लोकभाषा व बोली अकादमी एवं उत्तराखण्ड नेपाली अकादमी के उप निदेशक अभिप्रेत हैं; " ।

धारा 4 का 3. संशोधन

मूल अधिनियम में धारा 4 के पार्श्व शीर्षक को निम्नवत् प्रतिस्थापित कर दिया जायेगा, अर्थात्:-

"साधारण सभा की संरचना" ।

मूल अधिनियम में धारा 5 को निम्नवत् प्रतिस्थापित कर दिया जायेगा, अर्थात्:-

" 5: " प्रबंध कार्यकारिणी समिति की संरचना निम्नवत् होगी:-

धारा 5 का 4. संशोधन

1. अध्यक्ष (पदेन) मुख्यमंत्री/भाषा मंत्री, उत्तराखण्ड ;

2. कार्यकारी अध्यक्ष प्रमुख सचिव/ सचिव, भाषा विभाग, उत्तराखण्ड़ शासन ; (पदेन)

3. सदस्य (पदेन) प्रमुख सचिव/ सचिव, वित्त विभाग , उत्तराखण्ड शासन ;

4. सदस्य (पदेन) प्रमुख सचिव/ सचिव, उच्च शिक्षा विभाग , उत्तराखण्ड शासन;

5. सदस्य (पदेन) प्रमुख सचिव / सचिव, नियोजन विभाग , उत्तराखण्ड शासन ;

6. सदस्य (पदेन) सचिव, उत्तराखण्ड संस्कृत अकादमी ;

7. सदस्य राज्य सरकार द्वारा संस्थान की साधारण सभा में नामित साहित्यकारों में से 03 सदस्यों को प्रबन्ध कार्यकारिणी समिति में नामित किया जायेगा ;

8. सदस्य (पदेन) वरिष्ठ वित्त अधिकारी, उत्तराखण्ड भाषा संस्थान ;

9. सदस्य सचिव (पदेन) निदेशक, उत्तराखण्ड भाषा संस्थान । " ।

मूल अधिनियम में धारा का खण्ड (क) निम्नवत् प्रतिस्थापित कर दिया जायेगा, धारा 6 का 5. संशोधन

अर्थात्:-

"(क) प्रबंध कार्यकारिणी समिति, संस्थान की साधारण सभा को इस अधिनियम के अधीन उत्पन्न समस्त प्रकरणों पर परामर्श देगी और ऐसी अन्य शक्तियों का प्रयोग एवं कर्तव्यों का पालन करेगी, जो विहित किये जाये; " ।

मूल अधिनियम में धारा 9 के खण्ड (क) एवं (ख) निम्नवत् प्रतिस्थापित कर दिये धारा 9 का 6. संशोधन जायेगें, अर्थात्:-

"(क) साधारण सभा की वर्ष में कम से कम एक बैठक होगी, एवं प्रबन्ध कार्यकारिणी समिति की बैठक त्रैमासिक होगी, किन्तु यदि आवश्यकता समझी जाये तो कभी भी बैठक आहूत की जा सकती है;

(ख) बैठक की गणपूर्ति कुल सदस्य संख्या का 2/3 होगी , जिसमें संस्थान का वार्षिक बजट, कार्यक्रम एवं योजनायें प्रस्तुत और पारित की जायेंगी;" ।

मूल अधिनियम में धारा 10 निम्नवत् प्रतिस्थापित कर दी जायेगी, अर्थात्:-

10 7. धारा का संशोधन " 10. राज्य सरकार के पूर्वानुमोदन से राज्य में बोली जाने वाली विभिन्न समुदाय की भाषा एवं बोलियों के विकास एवं संवर्धन हेतु संस्थान के अन्तर्गत निम्नलिखित अकादमियां होंगी, जो संस्थान की शाखाओं के रूप में कार्य करेंगी :-

(क) डॉ० पीताम्बर दत्त बड़थ्वाल हिन्दी अकादमी उत्तराखण्ड;

(ख) उत्तराखण्ड उर्दू अकादमी;

(ग) उत्तराखण्ड पंजाबी अकादमी;

(घ) उत्तराखण्ड लोक भाषा व बोली अकादमी;

(ङ) उत्तराखण्ड नेपाली अकादमी;

उपर्युक्त अकादमियों का संचालन धारा 11 के प्रावधानों के अधीन होगा। " ।

धारा 15 8. का संशोधन

मूल अधिनियम में, धारा 15 का खण्ड (क) निम्नवत् प्रतिस्थापित कर दिया जायेगा, अर्थात्:-

" (क) राज्य सरकार द्वारा वित्त एवं लेखा सेवा के एक ऐसे वरिष्ठ वित्त अधिकारी की नियुक्ति की जायेगी , जो संस्थान के समुचित लेखा तथा अन्य सम्बद्ध अभिलेखों के सम्बन्ध में उत्तरदायी होगा । वह लेखे का वार्षिक विवरण एवं बैलेन्स शीट तैयार करायेगा तथा अन्य वित्त सम्बन्धी कार्य करेगा;" ।

उद्देश्य और कारणों का कथन

उत्तराखण्ड राज्य में बोली जाने वाली समस्त बोली एवं भाषाओं के विकास एवं संवर्धन हेतु उत्तराखण्ड भाषा संस्थान अधिनियम, 2018 में संशोधन किया जाना अपरिहार्य है ।

2. प्रस्तावित विधयेक उपरोक्त उद्देश्यों की पूर्ति करता है ।

In pursuance of the provisions of Clause ( 3) of Article 348 of the Constitution of India , the Governor is pleased to order the publication of the following English translation of 'The Uttarakhand Language Institution (Amendment) Act, 2026' ( Act No. 05 of 2026) .

Aspassed by the Uttarakhand Legislative Assembly and assented to by the Governor on 15 April , 2026 .

Act

further to amend the Uttarakhand Language Institutions Act, 2018 : -

Be it is enacted by the Uttarakhand Legislature in the Seventy - seventh year of the Republic of India, as follows : -

( 1 ) This Act may be called the Uttarakhand Language Institution

Short title and 1 commencement (Amendment) Act, 2026.

(2) It shall come into force at once.

section 2 Amendment of 2. In the Uttarakhand Language Institutions Act, 2018 (Uttarakhand Act No. 16 of 2018) (hereinafter referred to as principal Act) clause (g) and (1) of section 2 shall be subsituted as follows , namely : -

"(g) "Academy " means Dr. Pitamber Dutt Barthwal Hindi Academy Uttarakhand , Uttarakhand Urdu Academy, Uttarakhand Punjabi Academy , Uttarakhand Regional Language and Boli (Dialect) Academy and Uttarakhand Nepali Academy ;

(1) " Deputy Director " means Deputy Director of Dr. Pitamber Dutt Barthwal Hindi Academy Uttarakhand, Uttarakhand Urdu Academy, Uttarakhand Punjabi Academy, Uttarakhand Regional Language and Boli (Dialect) Academy and Uttarakhand Nepali Academy ; " .

Amendment of 3 section 4

In the principal Act marginal heading of section 4 shall be subsituted as follows , namely : -

"Composition of General Body. " 6

Amendment of section5

4 In the principal Act section 5 shall be subsituted as follows , namely : -

"5. The composition of Managing Executive Committee shall be as follows : -

Chief Minister/Language Minister , Uttarakhand ;

(1) Chairman (ex-officio)

Principal Secretary/ Secretary, Language Department, Government of Uttarakhand;

(2) Executive Chariman (ex-officio)

(3) Member (ex-officio)

Principal Secretary/ Secretary , Finance Department, Government of Uttarakhand;

Principal Secretary/ Secretary , Higher Education Department , Government of Uttarakhand;

(4) Member (ex-officio)

(5) Member (ex-officio)

Principal Secretary/ Secretary, Planning Department, Government of Uttarakhand;

Secretary, Uttarakhand Sanskrit Academy:

(6) Member (ex-officio)

(7) Member

From amongst the litterateurs nominated in the General Body of the institution , by the State Government three members shall be nominated in the Managing Executive Committee ;

Senior Finance Officer , Uttarakhand Language Institution;

(8) Member (ex-officio)

Director, Uttarakhand Language Institution" .

(9 ) Member Secretary (ex-officio)

Amendment of 5 section 6

In the principal Act clause ( a) of section 6 shall be subsituted as follows , namely : -

" ( a) The Managing Executive Committee shall advice the General Body of the institution on all the matters arising under this Act and exercise such other powers and comply other duties as may be prescribed; "

Amendment of 6 section 9

In the principal Act clause (a) and (b) of section 9 shall be subsituted as follows , namely : -

" (a) At least one meeting of General Body shall be conducted once in a year and the meeting of Managing Executive Committee shall be conducted quarterly, but if deemed necessary, meeting may be convened any time;

(b) The quorum of meeting shall be two -third of total members , in which annual budget, program and plans of the institution shall be presented and passed . "

Amendment of 7 section 10

In the princiapal Act section 10 shall be subsituted as follows , namely:-

" 10. For development and promotion of language and dialects of various communities in the state , the following Academies shall come under the Institution with the prior approval of the State Government, which shall be function as branches of the Institution -

(a) Dr. Pitamber Dutt Barthwal Hindi Academy Uttarakhand ;

(b) Uttarakhand Urdu Academy ;

(d)Uttarakhand Regional Language and Boli (Dialect) Academy;

(e)Uttarakhand Nepali Academy;

The above said academies shall operate under the provisions ofsection 11 ;" .

Amendment of 8 section 15

In the principal Act clause (a) of section 15 shall be subsituted as follows , namely : -

"(a) One such Senior Finance Officer shall be appointed from the finance and accounts services by the State Government, who shall be responsible for appropriate accounts and other related records of the Institution. He shall cause to prepare annual statement and balance. sheet of accounts and conduct other financial works .; "

Statement of Objects and Reasons

For the development and promotion of all the dialects and languages spoken in the state of Uttarakhand the amendment in the Uttarakhand Language Institutions Act, 2018 is inevitable .

2. Proposed Bill fulfils the above objectives .
