" भारत का संविधान " के अनुच्छेद 200 के अधीन मा० राज्यपाल ने उत्तराखण्ड विधान सभा द्वारा पारित 'उत्तराखण्ड अल्पसंख्यक आयोग (संशोधन) विधेयक , 2026 ' पर दिनांक 27 अप्रैल, 2026 को अनुमति प्रदान की और वह उत्तराखण्ड का अधिनियम संख्याः 09 वर्ष , 2026 के रूप में सर्व - साधारण के सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है ।

उत्तराखण्ड अल्पसंख्यक आयोग अधिनियम , 2002 में अग्रेत्तर संशोधन के लिए-

भारत गणराज्य के सतहत्तहरवें वर्ष में उत्तराखण्ड राज्य विधान- मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हो-
संक्षिप्त नाम और प्रारम्भ
1. (1 ) इस अधिनियम का संक्षिप्त नाम उत्तराखण्ड अल्पसंख्यक आयोग (संशोधन) अधिनियम, 2026 है ।
(2) यह तुरन्त प्रवृत्त होगा ।

धारा 4 का संशोधन
उत्तराखण्ड अल्पसंख्यक आयोग अधिनियम, 2002 की धारा 4 की उपधारा (1 ) में " पांच वर्ष" शब्दों के स्थान पर " तीन वर्ष " शब्द रख दिये जायेंगे ।

उद्देश्य एवं कारणों का कथन
!
उत्तराखण्ड अल्पसंख्यक आयोग अधिनियम, 2002 की धारा 4 में उत्तराखण्ड अल्पसंख्यक अयोग में अध्यक्ष, उपाध्यक्ष और सदस्योंकी पदावधि पांच वर्ष है ।
2. राष्ट्रीय अल्पसंख्यक आयोग , उत्तर प्रदेश अल्पसंख्यक आयोग , उत्तराखण्ड अनुसूचित जाति एवं अनुसूचित जनजाति आयोग एवं उत्तराखण्ड अन्य पिछड़ा वर्ग आयोग के अध्यक्ष, उपाध्यक्ष एवं सदस्यों का कार्यकाल तीन वर्ष निर्धारित है । इसके अतिरिक्त उत्तराखण्ड अल्पसंख्यक आयोग के अध्यक्ष, उपाध्यक्ष एवं सदस्यों का कार्यकाल पांच वर्ष होने के कारण अल्पसंख्यक समुदाय को समुचित प्रतिनिधित्व दिए जाने में कठिनाई हो रही है । इसको दृष्टिगत् रखते हुए अन्य आयोगों के साथ समता (Parity) एवं अल्पसंख्यक समुदाय को समुचित प्रतिनिधित्व दिए जाने हेतु कार्यकाल की अवधि तीन वर्ष किया जाना है ।
3. प्रस्तावित विधेयक उक्त उद्देश्यों की पूर्ति करता है ।

In pursuance of the provisions of Clause ( 3 ) of Article 348 of the Constitution of India , the Governor is pleased to order the publication of the following English translation of 'The Uttarakhand Commission for Minorities (Amendment) Act , 2026' (Act No. 09 of 2026) .
As passed by the Uttarakhand Legislative Assembly and assented to by the Governor on 27 April , 2026.
THE UTTARAKHAND COMMISSION FOR MINORITIES
(AMENDMENT) ACT, 2026
[Uttarakhand Act No. 09 Of 2026]
AN ACT
further to amend the Uttarakhand Commission for Minorities Act , 2002 ;
Be itenacted by the Uttarakhand State Legislature in the Seventy- seventh year of the Republic of India as follows: -
Short title and 1. commencement
(1) This Act may be called the Uttarakhand Commission for Minorities (Amendment) Act, 2026 .
(2) It shall come into force at once .

Amendment Section 4
In sub - section ( 1 ) of section 4 of the Uttarakhand Commission for Minorities Act, 2002, for the words "five years " , the words " three years " shall be substituted .

Statement of Objectives and Reasons
In section 4 of the Uttarakhand Minorities Commission Act, 2002 , the tenure of Chairman, Vice- Chairman and Members is five years .
2- The tenure of the Chairman, Vice-Chairman and Members of the National Commission for Minorities , the Uttar Pradesh Commission for Minorities , the Uttarakhand Scheduled Castes and Scheduled Tribes Commission and the Uttarakhand Other Backward Classes Commission is three years . Additionally, due to the five year tenure of the Chairman, Vice- Chairman and Members of the Uttarakhand Commission for Minorities, it is becoming difficult to provide adequate representation to the minority community . Considering this , the tenure needs to be made three years to bring parity with other commissions and ensure adequate representation for the minority community.
3- The proposed Bill fulfills the above objectives .
