राज्यपाल भारत का " संविधान " के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उत्तराखण्ड राज्य में स्थित राजकीय संस्कृत विद्यालयों में संस्कृत शिक्षा संवर्ग के अन्तर्गत प्रधानाचार्य, उत्तरमध्यमा विद्यालय (इण्टरमीडिएट) , प्रधानाध्यापक, पूर्वमध्यमा विद्यालय (हाईस्कूल ), प्रवक्ता, विशेष अधीनस्थ श्रेणी तथा सहायक अध्यापक उत्तराखण्ड अधीनस्थ शिक्षा के पदों पर नियुक्त व्यक्तियों की भर्ती तथा सेवा शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं, अर्थात्-

उत्तराखण्ड संस्कृत शिक्षा (शैक्षिक संवर्ग ) सेवा नियमावली, 2026

भाग 1

सामान्य

संक्षिप्त नाम और 1 .

(1 ) इस नियमावली का संक्षिप्त नाम ' उत्तराखण्ड संस्कृत शिक्षा प्रारम्भ

(शैक्षिक संवर्ग) सेवा नियमावली , 2026 ' है ।

(2) यह तुरन्त प्रवृत्त होगी ।

उत्तराखण्ड असाधारण गजट, 14 मई , 2026 ई ० (बैशाख 24 , 1948 शक सम्वत्)

सेवा की प्रास्थिति

उत्तराखण्ड संस्कृत शिक्षा (शैक्षिक संवर्ग ) सेवा एक राज्य सेवा है, जिसमें प्रधानाचार्य , उत्तरमध्यमा विद्यालय (इण्टर मीडिएट) समूह "क", प्रधानाध्यापक, पूर्वमध्यमा विद्यालय (हाईस्कूल ), समूह "ख ", प्रवक्ता , विशेष अधीनस्थ श्रेणी एवं सहायक अध्यापक, उत्तराखण्ड अधीनस्थ शिक्षा (प्रशिक्षित स्नातक श्रेणी) समूह " ग " के पद सम्मिलित हैं ।

परिभाषाऐं

जब तक कि विषय या संदर्भ में कोई बात प्रतिकूल न हो, इस नियमावली में:-

(क) 'नियुक्ति प्राधिकारी' से उत्तराखण्ड संस्कृत शिक्षा (शैक्षिक संवर्ग) में प्रधानाचार्य / प्रधानाध्यापक पद के लिए राज्यपाल , प्रवक्ता (विशेष अधीनस्थ श्रेणी, समूह- ग) तथा सहायक अध्यापक, उत्तराखण्ड अधीनस्थ सेवा (प्रशिक्षित स्नातक श्रेणी , समूह " ग" ) के लिए निदेशक , संस्कृत शिक्षा, उत्तराखण्ड अभिप्रेत है;

(ख) ' भारत का नागरिक' से ऐसा व्यक्ति अभिप्रेत हैं, जो 'भारत का संविधान' के भाग दो के अधीन भारत का नागरिक हो या भारत का नागरिक समझा जाता है;

(ग) 'आयोग' से संस्कृत शिक्षा (शैक्षिक संवर्ग) के प्रवक्ता पदों हेतु उत्तराखण्ड लोक सेवा आयोग तथा सहायक अध्यापक, उत्तराखण्ड अधीनस्थ संस्कृत शिक्षा (प्रशिक्षित स्नातक श्रेणी) के पदों हेतु उत्तराखण्ड अधीनस्थ सेवा चयन आयोग अभिप्रेत है;

(घ) ' संविधान' से 'भारत का संविधान' अभिप्रेत है;

(ङ) 'सरकार' से उत्तराखण्ड राज्य की संरकार अभिप्रेत है;

(च) 'राज्यपाल' से उत्तराखण्ड के राज्यपाल अभिप्रेत हैं;

(छ) 'सेवा का सदस्य' से इस नियमावली या इससे पूर्व प्रवृत्त नियमावली या आदेशों के अधीन स्थायी रूप से/ मौलिक पद पर नियुक्त व्यक्ति अभिप्रेत है;

(ज) 'सेवा' से उत्तराखण्ड संस्कृत शिक्षा (शैक्षिक संवर्ग) में प्रधानाचार्य , उत्तरमध्यमा विद्यालय (इण्टरमीडिएट) , प्रधानाध्यापक, पूर्वमध्यमा विद्यालय (हाईस्कूल) , प्रवक्ता (विशेष अधीनस्थ श्रेणी) एवं सहायक अध्यापक, उत्तराखण्ड अधीनस्थ शिक्षा (प्रशिक्षित स्नातक श्रेणी) की सेवा अभिप्रेत है;

(झ) 'मौलिक नियुक्ति' से सेवा के संवर्ग में किसी पद पर ऐसी नियुक्ति अभिप्रेत है , जो तदर्थ नियुक्ति न हो और नियमानुसार चयन के पश्चात् की गयी हो और यदि कोई नियम न हो, तो सरकार द्वारा जारी किये गये कार्यपालक अनुदेशों द्वारा तत्समय विहित प्रक्रिया के अनुसार चयन के पश्चात् की गयी हो; तथा

(ञ) ' भर्ती का वर्ष' से कैलेण्डर वर्ष के जुलाई के प्रथम दिवस से आरम्भ होने वाली बारह मास की अवधि अभिप्रेत है ।

भाग 2 संवर्ग

सेवा का संवर्ग

(1) सेवा में कार्मिकों की प्रत्येक श्रेणी के पदों की संख्या उतनी होगी, जो समय - समय पर सरकार द्वारा अवधारित की जाय ।

(2) सेवा में कार्मिकों की प्रत्येक श्रेणी के पदों की संख्या जब तक उपनियम (1 ) के अधीन पारित आदेशों द्वारा परिवर्तित न किया जाय, उतनी होगी जो परिशिष्ट-' क' में दी गयी हैं; परन्तु यह कि-

(क) नियुक्ति प्राधिकारी किसी रिक्त पद को खाली छोड़ सकेंगे अथवा राज्यपाल किसी पद को इस प्रकार प्रास्थगित कर सकेंगे कि कोई व्यक्ति प्रतिपूर्ति का हकदार नहीं होगा ।

(ख) राज्यपाल ऐसे स्थाई अथवा अस्थाई पद सृजित कर सकते हैं, जैसा कि वे उचित समझें ।

भाग 3 भर्ती

भर्ती का स्रोत 5 .

सेवा में विभिन्न श्रेणियों के पदों की भर्ती निम्नलिखित स्रोतों से की जायेगी:-

(1 ) प्रधानाचार्य , उत्तर मध्यमा (कक्षा 06 से कक्षा 12) इण्टरमीडिएट

शत प्रतिशत ऐसे प्रधानाध्यापकों में से जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में 05 वर्ष की संतोषजनक सेवा पूरी कर ली हो, चयन समिति के माध्यम से, अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर पदोन्नति द्वारा ।

(क) 45 प्रतिशत मौलिक रूप से नियुक्त ऐसे प्रवक्ताओं में से जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में कम से कम 07 वर्ष की निरन्तर सेवा पूर्ण कर ली हो, चयन (2) प्रधानाध्यापक, पूर्वमध्यमा (कक्षा 06 से कक्षा 10) हाईस्कूल

समिति के माध्यम से , अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर पदोन्नति द्वारा;

( ख) 55 प्रतिशत मौलिक रूप से नियुक्त ऐसे सहायक अध्यापकों में से, जिन्होंने भर्ती के वर्ष के प्रथम दिवस को इस रूप में कम से कम 12 वर्ष की निरन्तर सेवा पूर्ण कर ली हो , चयन समिति के माध्यम से , अनुपयुक्त को अस्वीकार करते हुये ज्येष्ठता के आधार पर पदोन्नति द्वारा ।

(3) प्रवक्ता, विशेष अधीनस्थ श्रेणी

(क) 50 प्रतिशत प्रवक्ता के पद उत्तराखण्ड लोक सेवा आयोग के माध्यम से सीधी भर्ती द्वारा भरे जायेंगे ।

(ख) 50 प्रतिशत पद सहायक अध्यापक (प्रशिक्षित स्नातक श्रेणी) में मौलिक रूप से नियुक्त ऐसे सहायक अध्यापक में से, जिन्होंने अपने संवर्ग में भर्ती वर्ष के प्रथम दिवस को इस रूप में 5 वर्ष की संतोषजनक सेवा पूरी कर ली हो तथा नियम 8 (1 ) के अधीन सम्बन्धित पद पर नियुक्ति के लिए विहित अपेक्षित अर्हता रखते हों, अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर पदोन्नति के माध्यम से भरेजायेंगे ।

(4) सहायक अध्यापक (प्रशिक्षित स्नातक श्रेणी)

सहायक अध्यापक के शत प्रतिशत पद उत्तराखण्ड अधीनस्थ सेवा चयन आयोग के माध्यम से सीधी भर्ती द्वारा भरे जायेंगे ।

आरक्षण

उत्तराखण्ड राज्य की अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे वर्ग, आर्थिक रूप से कमजोर वर्गों तथा अन्य श्रेणी के अभ्यर्थियों के लिए आरक्षण भर्ती के समय प्रवृत्त सरकार के आदेशों के अनुसार किया जायेगा ।

भाग 4

अर्हता

सेवा में किसी पद पर सीधी भर्ती के लिए अभ्यर्थी- 7.

राष्ट्रीयता

(क) भारत का नागरिक हो , या

(ख) तिब्बती शरणार्थी, जो भारत में स्थायी रूप से बसने के आशय से 01 जनवरी , 1962 से पहले भारत आया हो , होना चाहिए, या,

(ग) भारतीय मूल का ऐसा व्यक्ति हो, जिसने भारत में स्थायी रूप से बसने के आशय से पाकिस्तान, बर्मा, श्री लंका तथा केन्या, युगाण्डा और संयुक्त तंजानिया गणराज्य (पूर्ववर्ती तांगानिका और जंजीबार) के पूर्वी अफ्रीकी देशों से प्रव्रजन किया होः

परन्तु, उक्त श्रेणी (ख) और (ग) से सम्बन्धित अभ्यर्थी वह व्यक्ति होगा जिसके पक्ष में राज्य सरकार द्वारा पात्रता प्रमाण- पत्र जारी किया गया होः

परन्तु यह और कि श्रेणी (ख ) से सम्बन्धित अभ्यर्थी के लिए भी पुलिस उपमहानिरीक्षक, अभिसूचना शाखा, उत्तराखण्ड द्वारा प्रदत्त पात्रता प्रमाण- पत्र प्राप्त करना आवश्यक होगाः

परन्तु यह भी कि यदि अभ्यर्थी उक्त श्रेणी (ग ) से सम्बन्धित है, तो पात्रता प्रमाण- पत्र एक वर्ष से अधिक के लिए जारी नहीं किया जायेगा और ऐसे अभ्यर्थी को एक वर्ष से अधिक अवधि के बाद भारत की नागरिकता प्राप्त करने पर सेवा में रखा जा सकेगा ।

टिप्पणी-ऐसे अभ्यर्थी को जिसके मामले में पात्रता प्रमाण- पत्र आवश्यक हो , किन्तु उसे न तो जारी किया गया हो और न ही नामंजूर किया गया हो इस परीक्षा या साक्षात्कार में सम्मिलित किया जा सकता है और उसे इस शर्त पर अनन्तिम रूप से नियुक्त भी किया जा सकता है, किन्तु शर्त यह है कि उसके द्वारा इस प्रकार का आवश्यक प्रमाण -पत्र प्राप्त कर लिया जाय, या उसके पक्ष में जारी कर दिया जाय ।

शैक्षिक एवं प्रशिक्षण अर्हता 8.

उत्तराखण्ड संस्कृत शिक्षा सेवा में विभिन्न पदों पर नियुक्ति/ पदोन्नति के लिए अभ्यर्थी के पास निम्नलिखित अर्हता होनी चाहिए: -

(1) प्रवक्ता

सेवा में प्रवक्ता के पदों पर नियुक्ति के लिए अभ्यर्थी के पास परिशिष्ट "ग " में प्रत्येक पद के सम्मुख विर्निदिष्ट उल्लिखित अर्हताएं अनिवार्य हैं ।

(2) सहायक अध्यापक

(क) सेवा में सहायक अध्यापक के पदों पर नियुक्ति के लिए अभ्यर्थी के पास परिशिष्ट " घ " में प्रत्येक पद के सम्मुख उल्लिखित विनिर्दिष्ट अर्हताए अनिवार्य है ।

(ख) सहायक अध्यापकों हेतु निर्धारित पात्रता मानदण्ड तब तक यथावत् लागू रहेंगे , जब तक राष्ट्रीय अध्यापक शिक्षा परिषद् ( एन०सी० टी० ई० ) न्यूनतम् योग्यतायें निर्धारित नहीं कर देती । एन ० सी० टी०ई ० द्वारा समय- समय पर न्यूनतम अर्हता हेतु जारी अधिसूचनाऐं मान्य होंगी ।

(ग) प्रशिक्षण पाठ्यक्रम राष्ट्रीय अध्यापक शिक्षा परिषद् से मान्यता प्राप्त होना अनिवार्य है ।

अधिमानी अर्हता 9.

अन्य बातों के समान होने पर सीधी भर्ती के मामले में उस अभ्यर्थी को अधिमान दिया जायेगा जिसने, 5 उत्तराखण्ड असाधारण गजट, 14 मई , 2026 ई ० (बैशाख 24 , 1948 शक सम्वत्)

(एक) प्रादेशिक सेना में कम से कम दो वर्ष की सेवा की हो, या

(दो) नेशनल कैडेट कोर अथवा एन ० एसएस ० से " बी " अथवा " सी" प्रमाणपत्र प्राप्त किया हो ।

अनिवार्य/ वांछनीय 10.

अर्हता

सीधी भर्ती के पदों हेतु अनिवार्य / वांछनीय अर्हता, उत्तराखण्ड लोक सेवा आयोग की परिधि के अन्तर्गत तथा लोक सेवा आयोग की परिधि के बाहर समूह " ग " के पदों की भर्ती के लिए अनिवार्य / वांछनीय अर्हता नियमावली, 2010 (समय - समय पर यथा संशोधित ) के प्रावधानों के अनुसार होगी ।

11.

आयु

सेवा में सीधी भर्ती के लिये अभ्यर्थी की आयु, जिस कलेण्डर वर्ष में रिक्तियां भर्ती करने वाले प्राधिकारी द्वारा सीधी भर्ती के लिए विज्ञापित की जाय , उस वर्ष की प्रथम जुलाई को न्यूनतम 21 वर्ष और अधिकतम 42 वर्ष होनी चाहिए:

परन्तु, अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग तथा अन्य ऐसी श्रेणियों के अभ्यर्थियों के मामले में जिन्हें सरकार द्वारा समय - समय पर अधिसूचित किया जाय, अधिकतम आयु उतनी बढ़ाई जायेगी , जैसा कि विहित किया जाए ।

12.

चरित्र

सेवा के किसी भी पद पर सीधी भर्ती के लिए अभ्यर्थी का चरित्र ऐसा होना चाहिए जिससे वह सरकारी सेवा की नौकरी के लिए सभी प्रकार से उपयुक्त हो । नियुक्ति प्राधिकारी इस विषय में स्वयं समाधान करेगा ।

टिप्पणीः- संघ सरकार या राज्य सरकार अथवा संघ सरकार या राज्य सरकार के स्वामित्व में अथवा नियंत्रणाधीन किसी स्थानीय प्राधिकरण या निगम या निकाय द्वारा पदच्युत व्यक्ति सेवा में किसी पद पर नियुक्ति के पात्र नहीं होंगे । नैतिक अधमता के अपराध से सम्बद्ध सिद्धदोष व्यक्ति भी नियुक्ति के पात्र नहीं होंगे ।

वैवाहिक प्रास्थिति 13.

सेवा में किसी भी पद पर नियुक्ति के लिए ऐसा पुरूष अभ्यर्थी, जिसकी एक से अधिक पत्नियां जीवित हों अथवा ऐसी महिला अभ्यर्थी, जिसने ऐसे पुरूष से विवाह किया हो जिसकी पहले से ही एकएक जीवित पत्नी हो, अथवा जिस महिला के एक से अधिक जीवित पति हों, सेवा में किसी भी पद पर नियुक्ति की पात्र नहीं होंगेः

परन्तु, यह कि यदि सरकार का समाधान हो जाय कि ऐसा करने के लिए विशेष कारण विद्यमान है , तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से मुक्त कर सकेगी ।

शारीरिक स्वस्थता 14.

(1 ) किसी भी ऐसे अभ्यर्थी को सेवा में किसी पद पर नियुक्त नहीं किया जायेगा, जब तक वह शारीरिक और मानसिक रूप से स्वस्थ नही है और किसी ऐसे शारीरिक दोष से मुक्त नही है, जिसके कारण उसे अपने कर्तव्यों के दक्षतापूर्वक निर्वहन करने में हस्तक्षेप की सम्भावना हो । किसी अभ्यर्थी को नियुक्ति के लिए अंतिम रूप से अनुमोदित किये जाने से पूर्व उससे यह अपेक्षा की जायेगी कि वह चिकित्सा परीक्षा में सफल हो गया है ।

(2) अभ्यर्थी को वित्तीय हस्तपुस्तिका खण्ड- ॥ के भाग- ॥ के अध्याय ।। में दिये गये मूल नियम 10 के अधीन बनाये गये नियमों के अनुसार स्वस्थता प्रमाण - पत्र प्रस्तुत करना अनिवार्य होगा:

परन्तु यह कि दिव्यांगजन अधिकार अधिनियम 2016 (अधिनियम संख्या 49 वर्ष 2016) की धारा 33 के क्रम में इस हेतु चिह्नित पदों तथा धारा 34 के अन्तर्गत चिह्नित श्रेणियों में दिव्यांगों को नियमानुसार नियुक्ति देने से मना नहीं किया जाएगाः

परन्तु यह और कि, पदोन्नति द्वारा नियुक्त किये गये अभ्यर्थी से स्वस्थता प्रमाण पत्र की अपेक्षा नहीं की जायेगी ।

भाग 5

भर्ती प्रक्रिया

रिक्तियों की 15. अवधारणा

नियुक्ति प्राधिकारी वर्ष के दौरान भरी जाने वाली रिक्तियों की संख्या और नियम 6 के अधीन उत्तराखण्ड राज्य की अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे वर्ग , आर्थिक रूप से कमजोर वर्गों तथा अन्य श्रेणियों के लिए आरक्षित की जाने वाली रिक्तियों की संख्या अवधारित करेंगे और इस सम्बन्ध में सूचना चयन समिति / उत्तराखण्ड लोक सेवा आयोग / उत्तराखण्ड अधीनस्थ सेवा चयन आयोग जिससे भी सम्बन्धित हो को सूचित करेंगे ।

सीधी भर्ती द्वारा 16. चयन प्रक्रिया

(1) प्रवक्ता (क) नियुक्ति प्राधिकारी प्रवक्ता पदों पर सीधी भर्ती द्वारा चयन के लिए निर्धारित पदों की संख्या चिह्नित करेंगे और रिक्तियों के सम्बन्ध में उत्तराखण्ड लोक सेवा आयोग को सूचित करेंगे ।

(ख) नियुक्ति प्राधिकारी द्वारा भेजे गये अधियाचन के आधार पर आयोग सीधी भर्ती के प्रवक्ता पदों के लिए अपने स्तर से निर्धारित प्रारूप पर अभ्यर्थियों से आवेदन आमंत्रित करेगा ।

(ग) आयोग नियम 6 के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग , आर्थिक रूप से कमजोर वर्गों और अन्य श्रेणियों के अभ्यर्थियों का सम्यक प्रतिनिधित्व सुनिश्चित करने की आवश्यकता को ध्यान में रखते हुए उतने अभ्यर्थियों की, जितनी वे पर्याप्त समझे और जो परिशिष्ट- 'ग ' के अनुसार अपेक्षित अर्हताऐं पूरी करते हों , लिखित परीक्षा आयोजित करेगा ।

(घ) आयोग, अभ्यर्थियों की विषयवार लिखित परीक्षा आयोजित कर उनकी प्रवीणता क्रम में, जैसा कि लिखित परीक्षा में प्रत्येक अभ्यर्थी द्वारा प्राप्त अंकों से प्रकट हो, विषयवार एक चयन सूची तैयार करेगा । सूची में नामों की संख्या, रिक्तियों की संख्या से अधिक (किन्तु 25 प्रतिशत से अनधिक) होगी । आयोग , सूची नियुक्ति प्राधिकारी को अग्रसारित करेगा ।

(2) सहायक

अध्यापक

(क) नियुक्ति प्राधिकारी सहायक अध्यापक पदों पर सीधी भर्ती द्वारा चयन के लिए निर्धारित पदों की संख्या चिह्नित कर रिक्तियों के सम्बन्ध में उत्तराखण्ड अधीनस्थ सेवा चयन आयोग को सूचित करेगा ।

(ख ) नियुक्ति प्राधिकारी द्वारा भेजे गये अधियाचन के आधार पर सहायक अध्यापक के पदों के लिए आयोग अपने स्तर से निर्धारित प्रारूप पर अभ्यर्थियों से आवेदन आमंत्रित करेगा ।

(ग) आयोग, नियम 6 के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग , आर्थिक रूप से कमजोर वर्गों और अन्य श्रेणियों के अभ्यर्थियों का सम्यक् प्रतिनिधित्व सुनिश्चित करने की आवश्यकता को ध्यान में रखते हुए उतने 7 उत्तराखण्ड असाधारण गजट, 14 मई , 2026 ई० (बैशाख 24 , 1948 शक सम्वत्)

अभ्यर्थियों , जितनी वह पर्याप्त समझे और जो परिशिष्ट- घ के अनुसार अपेक्षित अर्हताएं पूरी करते हों, की लिखित परीक्षा आयोजित करेगा एवं लिखित परीक्षा में प्राप्त अंकों के आधार पर गुणांक सूची तैयार करेगा ।

(घ) आयोग, अभ्यर्थियों की उनकी प्रवीणता क्रम में जैसा कि लिखित परीक्षा में प्रत्येक अभ्यर्थी द्वारा प्राप्त अंको से प्रकट हो, एक चयन सूची तैयार करेगा । सूची में नामों की संख्या, रिक्तियों की संख्या से अधिक (किन्तु 25 प्रतिशत से अनधिक) होगी । आयोग , सूची नियुक्ति प्राधिकारी को अग्रसारित करेगा ।

पदोन्नति द्वारा भर्ती की प्रक्रिया 17.

(1) प्रधानाचार्य

प्रधानाचार्य , उत्तरमध्यमा स्तर के शत - प्रतिशत पदों पर पदोन्नति द्वारा भर्ती पूर्वमध्यमा विद्यालय के पदों पर नियुक्त प्रधानाध्यापकों में से अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर , उत्तराखण्ड विभागीय पदोन्नति समिति का गठन (लोक सेवा आयोग की परिधि के बाहर के पदों के लिए ) नियमावली, 2002 (समय- समय पर यथा. संशोधित) के उपबन्धों के अनुसार गठित विभागीय चयन समिति के माध्यम से की जायेगी । " विभागीय चयन समिति निर्दिष्ट अभिलेखों के आधार पर अभ्यर्थियों के पदोन्नति मामले पर उत्तराखण्ड (लोक सेवा आयोग की परिधि के बाहर) राज्याधीन सेवाओं में पदोन्नति के लिए चयन प्रक्रिया नियमावली, 2013 (समय - समय पर यथा संशोधित) के

अनुसार विचार करेगी । " चयन समिति में निम्नलिखित शामिल होंगे-

-अध्यक्ष

(क) संस्कृत शिक्षा विभाग, उत्तराखण्ड शासन के यथा स्थिति प्रमुख सचिव या सचिव ।

(ख) उत्तराखण्ड शासन कार्मिक विभाग के सचिव या उनके द्वारा नाम निर्दिष्ट अधिकारी , जो सरकार के अपर सचिव के स्तर

-सदस्य

से न्यून न हो ।

-सदस्य सचिव

(ग) निदेशक, संस्कृत शिक्षा , उत्तराखण्ड ।

(2) प्रधानाध्यापक (1) प्रधानाध्यापक, पूर्वमध्यमा स्तर के शत प्रतिशत पदों पर पदोन्नति द्वारा भर्ती राजकीय संस्कृत विद्यालयों में नियुक्त प्रवक्ता तथा सहायक अध्यापक प्रशिक्षित स्नातक श्रेणी के पदों पर नियुक्त अध्यापकों में से अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर चयन समिति के माध्यम से की जायेगी । प्रधानाध्यापक पद पर पदोन्नति हेतु सहायक अध्यापक / प्रवक्ता का पदोन्नति अनुपात नियम 5 के उपनियम (2 ) के अनुसार होगा ।

(2) प्रधानाध्यापक राजकीय संस्कृत विद्यालय (कक्षा 6 से कक्षा 10 तक) के पद पर पदोन्नति द्वारा भर्ती अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर उत्तराखण्ड विभागीय पदोन्नति समिति का गठन (लोक सेवा आयोग की परिधि के बाहर के पदों के लिए) नियमावली, 2002 (समय- समय पर यथा संशोधित) के उपबन्धों के अनुसार गठित विभागीय चयन समिति के माध्यम से की जायेगी । " विभागीय चयन समिति निर्दिष्ट अभिलेखों के आधार पर अभ्यर्थियों के पदोन्नति मामले पर उत्तराखण्ड (लोक सेवा आयोग की परिधि के बाहर) राज्याधीन सेवाओं में पदोन्नति के लिए चयन प्रक्रिया नियमावली , 2013 (समय - समय पर यथा संशोधित) के अनुसार विचार करेगी । " 8

चयन समिति में निम्नलिखित शामिल होंगे-

(क) संस्कृत शिक्षा विभाग , उत्तराखण्ड शासन के यथा स्थिति प्रमुख सचिव या सचिव । -अध्यक्ष

-सदस्य

(ख) उत्तराखण्ड शासन कार्मिक विभाग के सचिव या उनके द्वारा निर्दिष्ट अधिकारी जो सरकार के अपर सचिव के स्तर से निम्न न हो ।

-सदस्य सचिव

(ग) निदेशक, संस्कृत शिक्षा , उत्तराखण्ड ।

(3) प्रवक्ता

प्रवक्ता संवर्ग में कुल स्वीकृत पदों के 50 प्रतिशत पदों पर पदोन्नति द्वारा भर्ती अनुपयुक्त को अस्वीकार करते हुए , ज्येष्ठता के आधार पर उत्तराखण्ड लोक सेवा आयोग सपरामर्श चयनोन्नति (प्रक्रिया) नियमावली, 2003 (समय- समय पर यथा संशोधित) के अनुसार की जायेगी ।

चयन 18 .

संयुक्त सूची

यदि किसी भर्ती वर्ष में नियुक्तियां सीधी भर्ती और पदोन्नति दोनों प्रकार से की जाती हैं, तो संगत सूचियों से नाम लेकर एक संयुक्त सूची इस प्रकार तैयार की जायेगी , जिससे विहित प्रतिशत बना रहे । सूची में प्रथम नाम पदोन्नति द्वारा नियुक्त व्यक्ति का होगा ।

भाग 6

नियुक्ति, परिवीक्षा, स्थायीकरण एवं ज्येष्ठता

19.

नियुक्ति

(1) उपनियम (2) के अध्यधीन रहते हुये, नियुक्ति प्राधिकारी अभ्यर्थियों के नाम उस क्रम में, जिसमें वे नियम 16 , 17 अथवा 18 यथास्थिति, के अधीन बनायी गयी सूचियों में हों , नियुक्ति करेगा ।

(2) यदि भर्ती के किसी वर्ष में नियुक्तियां सीधी भर्ती और पदोन्नति दोनों प्रकार से की जानी हों तो नियमित नियुक्तियां तब तक नहीं की जायेंगी जब तक कि दोनों स्रोतों से चयन न किया गया हो और नियम 18 के अनुसार संयुक्त सूचियां तैयार न की गयी हों ।

(3) यदि एक चयन के सम्बन्ध में एक से अधिक नियुक्ति के आदेश जारी किये जाते हैं , तो एक संयुक्त आदेश भी जारी किया जायेगा , जिसमें चयनित व्यक्तियों के नाम का उल्लेख चयन में अवधारित ज्येष्ठता के आधार या उस क्रम में, यथा स्थिति, जिस क्रम में उनका नाम उस संवर्ग में है , जिससे उन्हें पदोन्नत किया गया है, किया जायेगा । यदि नियुक्तियाँ सीधी भर्ती और पदोन्नति दोनों प्रकार से की जाती हैं तो सूची में नाम नियम 18 में निर्दिष्ट चक्रीय क्रम में क्रमांकित किये जायेंगे ।

परिवीक्षा

20 .

(1) सेवा या किसी स्थायी पद पर या उसके सापेक्ष रिक्ति पर मौलिक रूप से नियुक्त व्यक्ति दो वर्ष की अवधि के लिये परिवीक्षाधीन रहेगा ।

(2) नियुक्ति प्राधिकारी ऐसे कारणों से जो अभिलिखित किये जायेंगे , पृथक् पृथक् मामलों में दिनांक विनिर्दिष्ट करते हुए , जब तक कि अवधि बढाई गयी हो परिवीक्षा की अवधि बढ़ा सकता है:

परन्तु, यह कि आपवादिक परिस्थितियों के सिवाय 9 उत्तराखण्ड असाधारण गजट, 14 मई , 2026 ई ० (बैशाख 24 , 1948 शक सम्वत्)

परिवीक्षा अवधि एक वर्ष से अधिक और किसी भी परिस्थिति में दो वर्ष से अधिक नहीं बढ़ायी जायेगी ।

(3) यदि परिवीक्षा अवधि के दौरान किसी समय या परिवीक्षा अवधि की समाप्ति अथवा परिवीक्षा की बढ़ाई गयी अवधि में नियुक्ति प्राधिकारी को प्रतीत होता है कि किसी परिवीक्षाधीन व्यक्ति द्वारा अपने अवसरों का पर्याप्त उपयोग नहीं किया गया है या अन्यथा समाधान प्रदान करने में असफल रहा है तो उसे उसके मूल पद पर यदि कोई है, प्रत्यावर्तित किया जा सकेगा या यदि उसका किसी पद पर धारणाधिकार नहीं हैं तो उसकी सेवायें समाप्त की जा सकेंगी ।

(4) ऐसा परिवीक्षाधीन व्यक्ति, जिसे उपनियम (3 ) के अधीन प्रत्यावर्तित कर दिया गया हो या जिसकी सेवायें समाप्त कर दी गयी हैं, किसी प्रतिकर का हकदार नहीं होगा ।

(5) नियुक्ति प्राधिकारी परिवीक्षा अवधि की संगणना के प्रयोजन हेतु उस निरन्तर सेवा को गिने जाने की अनुमति दे सकेगा,

जो उस विशिष्ट संवर्ग में शामिल किये गये पद पर या किसी समान अथवा उच्चतर पद पर स्थानापन्न या अस्थाई रूप में प्रदान की गयी हों ।

स्थायीकरण 21.

(1) उपनियम (2) के उपबंधों के अधीन रहते हुए किसी परिवीक्षाधीन व्यक्ति को उसकी नियुक्ति में उसकी परिवीक्षा अवधि या बढ़ाई गयी परिवीक्षा अवधि की समाप्ति पर स्थायी किया जा सकेगा; यदि उसने-

(क) विहित विभागीय परीक्षा, यदि कोई हो उत्तीर्ण कर ली हो; (ख) विहित प्रशिक्षण , यदि कोई है, सफलतापूर्वक पूर्ण कर लिया

हो;

(ग) उसका कार्य और आचरण संतोषजनक बताया गया हो;

( घ) उसकी सत्यनिष्ठा अधिप्रमाणित हो;

(ङ) नियुक्ति प्राधिकारी का समाधान हो गया हो कि वह स्थायीकरण हेतु अन्यथा योग्य है ।

(2) जहाँ उत्तराखण्ड राज्य के सरकारी सेवकों की स्थायीकरण नियमावली, 2002 के उपबंधो के अनुसार स्थायीकरण आवश्यक नहीं है , वहाँ उस नियमावली के नियम 5 के उपनियम (3 ) के अधीन यह घोषणा करते हुए पारित आदेश, कि सम्बन्धित व्यक्ति ने परिवीक्षा अवधि सफलता पूर्वक पूरी कर ली है, स्थायीकरण का आदेश समझा जायेगा ।

22.

ज्येष्ठता

सेवा में किसी श्रेणी के पद पर किसी कार्मिक के ज्येष्ठता का निर्धारण उत्तराखण्ड सरकारी सेवक ज्येष्ठता नियमावली 2002 (समय-समय पर यथा संशोधित ) के अनुसार किया जायेगा ।

भाग 7

वेतन आदि

23.

वेतनमान

(1) सेवा में विभिन्न श्रेणियों के पदों पर नियुक्त व्यक्तियों का अनुज्ञेय वेतनमान वह होगा जो सरकार द्वारा समय - समय पर अवधारित किया जाय ।

(2) इस नियमावली के प्रारम्भ के समय विभिन्न श्रेणी के सृजित पदों हेतु लागू वेतनमान का विवरण परिशिष्ट ' क' में दिया गया है ।

परिवीक्षा अवधि 24.

में वेतन

(1) मूल नियमों में किसी प्रतिकूल उपबंध के होते हुए भी परिवीक्षाधीन व्यक्ति को, यदि वह स्थायी सरकारी सेवा में न हो तो 01 वर्ष की संतोषजनक सेवा पूरी करने , विभागीय परीक्षा में उत्तीर्ण होने और प्रशिक्षण प्राप्त करने पर, जहां विहित हो प्रथम वेतन वृद्धि की अनुमति प्रदान की जाएगी तथा दूसरी वेतन वृद्धि 02 वर्ष की सेवा के पश्चात् परिवीक्षा अवधि पूर्ण किये जाने तथा स्थायी किये जाने पर दी जाएगीः

परन्तु यह कि यदि संतोषजनक सेवा प्रदान करने में असफल रहने के कारण परिवीक्षा अवधि बढ़ायी जाये तो इस प्रकार बढ़ायी गयी अवधि की गणना वेतन वृद्धि के लिए नहीं की जाएगी ।

(2) परिवीक्षा के दौरान ऐसे व्यक्ति का वेतन जो सरकार के अधीन पहले से ही पद धारण कर रहा है , राज्य के कार्यों के संबंध में सेवारत सरकारी सेवकों का सामान्यतया लागू संगत मूल नियमों द्वारा विनियमित होगाः

परन्तु यह कि यदि संतोषजनक सेवा प्रदान करने में असफल रहने के कारण परिवीक्षा अवधि बढ़ायी जाये तो जब तक कि नियुक्ति प्राधिकारी अन्यथा निर्देश न दे , इस प्रकार बढ़ायी गयी अवधि वेतन वृद्धि के लिए नहीं गिनी जाएगी ।

(3) परिवीक्षा अवधि में ऐसे व्यक्ति का वेतन, जो पहले से ही स्थायी सरकारी सेवा में हो, राज्य के कार्यों के संबंध में सेवारत सरकारी सेवक पर सामान्यतया लागू संगत नियमों द्वारा विनियमित किया जाएगा ।

भाग 8 अन्य प्रावधान

पक्ष समर्थन 25 .

किसी पद या सेवा पर लागू नियमावली के अधीन अपेक्षित संस्तुति से भिन्न संस्तुति पर विचार नहीं किया जाएगा । अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए प्रत्यक्ष या परोक्ष रूप से समर्थन प्राप्त करने का कोई प्रयास उसे नियुक्ति के अयोग्य कर देगा ।

अन्य विषयों का विनियमन 26 .

ऐसे विषयों के सम्बन्ध में, जो विनिर्दिष्ट रूप से इन नियमों या विशेष आदेशों के अन्र्तगत न आते हों सेवा में नियुक्त ऐसे व्यक्ति राज्य के कार्यों से सम्बन्धित सेवारत सरकारी सेवकों पर साधारणतः लागू होने वाले नियमों, विनियमों और आदेशों द्वारा विनियमित होंगे ।

सेवा शर्तों में शिथिलीकरण 27 .

यदि राज्य सरकार का समाधान हो जाये कि सेवा में नियुक्त व्यक्तियों की सेवा शर्तें विनियमित करने वाले किसी नियम के प्रवर्तन से किसी विशिष्ट मामले में अनुचित कठिनाई होती है , तो वह उस मामले में लागू होने वाले नियमों में किसी बात के होते हुए भी आदेश द्वारा उस नियम की अपेक्षाओं को उस सीमा तक और ऐसी शर्तों के अधीन अभिमुक्त या शिथिल कर सकेगी , जो वह मामले में न्याय संगत और साम्यपूर्ण रीति से कार्यवाही करने के लिए उचित समझेः 11 उत्तराखण्ड असाधारण गजट , 14 मई , 2026 ई ० (बैशाख 24, 1948 शक सम्वत्)

परन्तु यह कि जहाँ कोई नियम आयोग के परामर्श से बनाया गया है, वहाँ नियम की अपेक्षाओं से अभिमुक्त करने या शिथिल करने से पूर्व आयोग से परामर्श करना होगा ।

व्यावृत्ति 28 .

इस नियमावली की किसी बात का कोई प्रभाव ऐसे आरक्षण और अन्य रियायतों पर नहीं पड़ेगा, जिनका इस सम्बन्ध में . सरकार द्वारा समय - समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग , आर्थिक रूप से कमजोर वर्गों तथा अन्य विशेष श्रेणियों के अभ्यर्थियों के लिए उपबन्धित किया जाना अपेक्षित हो ।

सहायक अध्यापक (सामाजिक विज्ञान)

(1 ) भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से भूगोल , अर्थशास्त्र, राजनीति विज्ञान / राजनीति शास्त्र एवं इतिहास , विषयों में से किन्हीं दो विषयों के साथ स्नातक उपाधि । परन्तु उक्त दो विषयों में से एक विषय तृतीय वर्ष तक तथा शेष एक विषय द्वितीय वर्ष तक अनिवार्यतः रहा हों ।

(2) किसी राजकीय या सरकार से मान्यता प्राप्त प्रशिक्षण संस्थान / महाविद्यालय से एल ०टी० डिप्लोमा या विधि द्वारा स्थापित विश्वविद्यालय से बी०एड्० / शिक्षा शास्त्री की उपाधि/ एन ० सी०टी० ई० मानक के अनुसार प्रशिक्षण उपाधि ।

(3) यू०टी० ई० टी०-2 अथवा सी० टी ० ई० टी०-2 योग्यता धारित हो ।

अथवा

(1 ) एन० सी० ई० आर ० टी० के क्षेत्रीय शिक्षा संस्थान से चार वर्षीय इन्टीग्रेटेड कोर्स (B.A.Ed ) (भूगोल , अर्थशास्त्र , राजनीति शास्त्र इतिहास विषयों में से किन्हीं दो विषयों के साथ)

सहायक अध्यापक (गणित)

(1) भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से गणित एवं भौतिक विज्ञान विषयों के साथ विज्ञान स्नातक की उपाधि । परन्तु उक्त दो विषयों में से एक विषय तृतीय वर्ष तक तथा शेष एक विषय द्वितीय वर्ष तक अनिवार्यतः रहा हों ।

(3)यू०टी ० ई ०टी०-2 / सी० टी० ई० टी०-2 योग्यता धारित हो ।

अथवा

(1 ) एन ० सी० ई० आर ० टी ० के क्षेत्रीय शिक्षा संस्थान से चार वर्षीय इंटीग्रेटेड कोर्स (B.Sc.Ed ) (गणित एवं विज्ञान विषयों के साथ)

(2) यू०टी० ई०टी०-2 / सी0 टी0 ई 0 टी0-2 योग्यता धारित हो ।

4 सहायक अध्यापक (विज्ञान)

(1 ) भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से रसायन विज्ञान , जन्तु विज्ञान एवं वनस्पति विज्ञान विषयों के साथ विज्ञान स्नातक की उपाधि । परन्तु उक्त दो विषयों में से एक विषय तृतीय वर्ष तक तथा शेष एक विषय द्वितीय वर्ष तक अनिवार्यतः रहा हों ।

(2) किसी राजकीय या सरकार से मान्यता प्राप्त प्रशिक्षण संस्थान / महाविद्यालय से एल ०टी ० डिप्लोमा या विधि द्वारा स्थापित विश्वविद्यालय से बी० एड्० / शिक्षा शास्त्री की उपाधि/ एन ०सी ० टी० ई० मानक के अनुसार समकक्ष प्रशिक्षण उपाधि ।

(3) यू० टी०ई ० टी०-2 अथवा सी ० टी ० ई० टी०-2

योग्यता धारित हो ।

अथवा

एन ० सी० ई ० आर ० टी० के क्षेत्रीय शिक्षा संस्थान से चार वर्षीय इंटीग्रेटेड कोर्स (B.Sc.Ed ) (रसायन विज्ञान एवं जन्तु विज्ञान विषयों के साथ )

5 सहायक अध्यापक (हिन्दी)

(1 ) भारत मे विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से हिन्दी साहित्य जो अन्तिम वर्ष तक अनिवार्यतः रहा हो, के साथ स्नातक की उपाधि और किसी राज्य स्तरीय संस्कृत शिक्षा परिषद् से उत्तर मध्यमा अथवा समकक्ष शिक्षा परिषद् से इण्टरमीटिएट अथवा समकक्ष परीक्षा संस्कृत विषय के साथ उत्तीर्ण की हो । यदि किसी अभ्यर्थी का इण्टर / समकक्ष स्तर पर संस्कृत विषय न रहा हो तो विधि द्वारा स्थापित किसी विश्वविद्यालय से संस्कृत के साथ स्नातक उपाधि अथवा शास्त्री उपाधि ।

(2) किसी राजकीय या सरकार से मान्यता प्राप्त प्रशिक्षण संस्थान / महाविद्यालय से एल ०टी० डिप्लोमा या विधि द्वारा स्थापित विश्वविद्यालय से बी०एड्० / शिक्षा शास्त्री की उपाधि/ एन ० सी० टी० ई० मानक के अनुसार समकक्ष प्रशिक्षण उपाधि ।

(2) किसी राजकीय या सरकार से मान्यता प्राप्त प्रशिक्षण संस्थान/ महाविद्यालय से एल० टी० डिप्लोमा या विधि द्वारा स्थापित विश्वविद्यालय से बी० एड्० / शिाक्षा शास्त्री की उपाधि/ एन ० सी ०टी०ई० मानक के अनुसार समकक्ष प्रशिक्षण उपाधि ।

(3) यू०टी० ई०टी०-2 अथवा सी० टी० ई० टी०-2 योग्यता धारित हो ।

अथवा

एन ०सी ० ई० आर ० टी० के क्षेत्रीय शिक्षा संस्थान से चार वर्षीय इन्टीग्रेटेड कोर्स ( B.A.Ed ) अंग्रेजी साहित्य के साथ उत्तीर्ण ।

(2)किसी राजकीय या सरकार प्रशिक्षण संस्थान / से मान्यता प्राप्त महाविद्यालय से एल० टी० डिप्लोमा या भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से बी०एड्० / शिक्षा शास्त्री की उपाधि/ एन० सी० टी० ई ० के मानक के अनुसार समकक्ष प्रशिक्षण योग्यता

(3) यू० टी० ई ० टी०-2/ सी० टी ०ई० टी०-2 योग्यता धारित हो ।

अथवा

(1 ) भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से गृह विज्ञान विषय में बी०एससी० (ऑनर्स) के साथ स्नातक की उपाधि/ गृह विज्ञान में त्रिवर्षीय या चार वर्षीय स्नातक उपाधि ।

(1 ) भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से कम्प्यूटर विज्ञान विषय के साथ अथवा कम्प्यूटर विज्ञान विषय में स्नातक उपाधि ।

अथवा

भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से कम्प्यूटर विज्ञान में बी०टेक ० / बी ० ई ० की उपाधि ।

से (2) किसी राजकीय या सरकार से मान्यता प्राप्त प्रशिक्षण संस्थान/ महाविद्यालय एल० टी० डिप्लोमा या भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से बी० एड्० / शिक्षा शास्त्री की उपाधि।/ एन ०सी०टी ० ई ० के मानक के अनुसार समकक्ष प्रशिक्षण योग्यता

9 सहायक अध्यापक (योग)

भारत (1) में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से योग विषय के साथ स्नातक उपाधि ।

(2) किसी राजकीय या सरकार से मान्यता

प्राप्त प्रशिक्षण संस्थान / महाविद्यालय से

एल ०टी० डिप्लोमा या भारत में विधि द्वारा

10 सहायक अध्यापक (संगीत)

(1 ) भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से संगीत (वादन अथवा गायन) विषय के साथ स्नातक उपाधि ।

(2) किसी राजकीय या सरकार से मान्यता प्राप्त प्रशिक्षण संस्थान/ महाविद्यालय से एल ०टी० डिप्लोमा या भारत में विधि द्वारा स्थापित विश्वविद्यालय से बी० एड्० / शिक्षा शास्त्री की उपाधि ।

(3) यू० टी० ई० टी०-2 / सी० टी० ई० टी०-2 योग्यता धारित हो ।

मान्यता प्राप्त (2) किसी राजकीय या सरकार से प्रशिक्षण संस्थान/ महाविद्यालय से एल० टी० डिप्लोमा या भारत में विधि द्वारा स्थापित विश्वविद्यालय से बी० एड्० / शिक्षा शास्त्री की उपाधि/ एन०सी ०टी ० ई० के मानक के अनुसार समकक्ष प्रशिक्षण योग्यता

(3 )यू०टी० ई०टी०-2 / सी० टी०ई० टी०-2 योग्यता धारित हो ।

(1) भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से स्नातक उपाधि ।

12 सहायक अध्यापक शारीरिक शिक्षा

(2) राष्ट्रीय अध्यापक शिक्षा परिषद् या किसी राज्य सरकार से मान्यता प्राप्त प्रशिक्षण संस्थान/ महाविद्यालय से कम से कम 01 वर्ष का बी० पी० एड्० डिप्लोमा / भारत में विधि द्वारा 'स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से शारीरिक शिक्षा (बी ० पी० ई० ) में स्नातक उपाधि ।

(3) यू० टी० ई ० टी०-2 / सी० टी० ई ० टी०-2 योग्यता धारित हो ।

13 सहायक अध्यापक आयुर्वेद

(1 )भारत में विधि द्वारा स्थापित किसी मान्यता प्राप्त विश्वविद्यालय से संबंधित विषय में स्नातक उपाधि ।

(2) किसी राजकीय या सरकार से मान्यता प्राप्त प्रशिक्षण संस्थान / महाविद्यालय से एल० टी० डिप्लोमा या विधि द्वारा स्थापित विश्वविद्यालय से बी०एड० / शिक्षा शास्त्री की उपाधि ।

(3) यू०टी० ई ० टी०-2 / सी० टी ० ई० टी०-2 योग्यता धारित हो ।

MISCELLANEOUS

In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor is pleased to make the following rules for regulating recruitment and the conditions of services ofpersons appointed to the post of the Principal , Uttarmadhyma School (Intermediate ) , Head master Purvamadhyma School (High School ) , Lecturer, special subordinate category and Assistant Teacher Uttarakhand subordinate education under Sanskrit education cadre in Government Sanskrit Schools established in Uttarakhand State , namely: -

The Uttarakhand Sanskrit Education (Academic cadre ) Service Rules , 2026

PART- I

GENERAL

Short title and Commencement

(1) These rules may be called the Uttarakhand Sanskrit Education (Academic cadre ) Service Rules , 2026

(2) Itshall come into force at once .

Status of the Service

2. The Uttarakhand Sanskrit Education (Academic cadre ) service is a State service which comprises of Principal Uttarmadhyma School (Intermediate ) Group " A" , Head master Purva Madhyma School (High School ) , Group "B " , Lecturer , Special Subordinate category and Assistant Teacher , Uttarakhand Subordinate Education (Trained Graduate Category) Group 'C' posts .

Definitions

3. In these rules , unless there is anything repugnant in the subject or context : -

(a) "Appointing Authority " means Governor for the post of Principal/Head master and Director Sanskrit Education Uttarakhand for the post of Lecturer (Special Subordinate Category, Group - C) and Assistant Teacher, Uttarakhand Subordinate Service (Trained Graduate Category , Group C);

(b) " Citizen of India" means such person who is or deemed to be a citizen of India under part II of the Constitution of India;

(c) " Commission " means the Uttarakhand Public Service Commission for Sanskrit Education (Academic Cadre) lecturer posts and Uttarakhand Subordinate Service Selection Commission for the post of Assistant Teacher Uttarakhand Subordinate Sanskrit Education (Trained Graduate Category) ;

(d) " Constitution " means ' the Constitution of India ' ;

(e) " Government " means the State Government of Uttarakhand;

(f) "Governor " means Governor of Uttarakhand ;

(g) "Member of the Service " means a person permanently /substantively appointed under these rules or orders in force prior to the commencement of these rules;

(h) ' Service ' means the Principal Uttarmadhyma School (Intermediate ) and Head master Purvamadhyma School (High School ) , lecturer ( Special Subordinate Category ) and Assistant Teacher Uttarakhand Subordinate Education(Trained Graduate Category) service in Uttarakhand Sanskrit Education (Academic Cadre ) ;

(i) ' Substantive appointment' means an appointment, not being an ad hoc appointment , on a post in the cadre of the service and made after selection in accordance with the rules and , if there were no rules , made after selection in accordance with the procedure prescribed for the time by executive instructions issued by the Government; and

(j ) ' Year of recruitment ' means a period of twelve months commencing from the first day of July of the calendar year .

PART- II

CADRE

Cadre of Service

(1) The number of posts of employee in each category of service therein shall be such as determined by the Government from time to time .

(2) The number of posts of employee in each category of service therein shall , until orders varying the same are passed under sub - rule ( 1 ) , as given in Appendix- " A":

Provided that-

(a) the Appointing Authority may leave unfilled or the Governor may hold in abeyance any vacant post , without thereby entitling any person to the compensation;

(b) the Governor may create such additional permanent or temporary posts as he may consider proper .

PART - III RECRUITMENT

Recruitment to the various categories of posts in service shall be made from the following sources : -

Source of Recruitment

to class 12)

Intermediate

(1) Principal Uttar

Madhyma (class 06

100% by promotion on the basis of seniority from amongst the head masters who have completed the satisfactory service of 05 years as such on first day of recruitment year through selection committee , rejecting the unfit.

(2) Headmaster Purva Madhyma (class 06 to class 10) High School .

(a) 45 percent by promotion on the basis of seniority from amongst the substantially appointed lecturers who have completed the continuous service of at least 07 years on first day of the recruitment year , rejecting the unfit ;

(b) 55 percent by promotion on the basis of seniority from amongst the substantially appointed Assistant Teachers who have completed the continuous service of at least 12 years on first day of recruitment year , rejecting the unfit ;

(3) Lecturer , special

subordinate

(a) A citizen of India; or

(b) A Tibetan refugee who come over to India before the 1st January, 1962 with the intention of permanently settling in India; or

(c) a person of Indian origin who has migrated from Pakistan , Burma, Sri Lanka or any of the east African countries of Kenya, Uganda and the United Republic of Tanzania (formerly Tanganika and Zanzibar) with the intention of permanently settling in India:

Provided that a candidate belonging to category (b) or ( c) mentioned above must be a person in whose favour a certificate of eligibility has been issued by the State Government :

Provided further that a candidate belonging to category (b) shall also be required to obtain certificate of eligibility granted by the Deputy Inspector General of Police , Intelligence Branch , Uttarakhand:

Provided also that if a candidate belongs to category (c) mentioned above , no certificate of eligibility shall be issued for a period of more than one year and the retention of such a candidate in service beyond a period of one year , shall be subject to his acquiring Indian citizenship.

Note: - A candidate in whose case the certificate of eligibility is necessary but the same has neither been issued nor rejected may be admitted to this examination or interview and he may also be provisionally appointed , subject to the necessary certificate being obtained by him or issued in his favour .

Academic and Training Qualification

A candidate must have following qualifications for the recruitment /promotion to the various post of the Uttarakhand Sanskrit Education service : - 26

(1) Lecturer

for appointment on the posts of lecturer in service , candidate must possess qualification mentioned against each post in Appendix- ' C '

(2) Assistant

Teacher

(a) for appointment on the posts of Assistant Teacher in service candidate must possess qualification mentioned against each post in Appendix- ' D '

(b) The eligibility criteria for Assistant Teacher shall remain in force until the National Council for Teacher Education does not determine the minimum qualification . Notifications issued by NCTE on minimum qualification from time to time shall be valid .

Preferential Qualification

Other things being equal in the matter of direct recruitment preference will be given to a candidate who has: -

(i) Served in the Territorial Army for a minimum period of two years; or

(ii) Obtained a "B " or " C " certificate of National Cadet Corps orN.S.S.

10.

Essential/ desirable qualification

The essential / desirable qualification for the posts of direct recruitment shall be according to the Essential / Desirable Qualification for the Recruitment of Group "C " posts within the Purview of Uttarakhand Public Service Commission and Outside the Purview of the Public Service Commission Rules , 2010 ( as amended from time to time) .

11.

Age

A candidate for direct recruitment must have attained the minimum age 21 years and must not attained the maximum age 42 years on the first day of July of that calendar year in which vacancies are advertised by the recruitment authority: Provided that the upper age limit in the case of candidates belonging to the Scheduled Castes , Scheduled Tribes , Other Backward Classes and such other categories of the State of Uttarakhand as may be notified by the State Government from time to time , shall be greater by such number of years as may be specified .

Character 12.

respects for employment in Government service . The Appointing Authority shall satisfy himself on this point .

Note- Person dismissed by the Union Government or a State Government or by a local authority or a corporation.. or body owned or controlled by the Union Government or a State Government shall be ineligible for appointment to any post in the service . Person convicted of any offence involving moral turpitude shall also be ineligible .

13.

Marital Status

Amale candidate who has more than one wife living or such female candidate who has married a man already having a wife living or who has more than one husband living, shall not be eligible for appointment to a post in the service : Provided that the Government may, if satisfied that there exists a specific ground for doing so , exempt any person from the operation of this rule

Physical Fitness 14.

(1 ) No candidate shall be appointed to a post in the service unless he be in a good mental and bodily health and free from any physical defect likely to interfere with the efficient performance of his duties . Before a candidate is finally approved for appointment, he shall be required to pass the medical examination .

(2) A candidate have to produce a certificate of fitness in accordance with the rules framed under Fundamental Rule 10 contained in Chapter III of the Financial Handbook , Volume II , Part III :

Provided that in order of section 33 , the posts identified for this and the categories identified under section 34 of the Rights of Persons with Disabilities Act, 2016 (Act No. 49 of 2016) , disabled shall not be denied for appointment as per rules:

Provided further that the medical certificate of fitness shall not be required from a candidate recruited by promotion.

PART -V

PROCEDURE FOR RECRUITIMENT

Determination of 15 . vacancies

The Appointing Authority shall determine number of vacancies to be filled during the course of the year and also the number of vacancies to be reserved for candidates belonging to Scheduled Castes , Scheduled Tribes , Other Backward Classes , Economically Weaker Sections and Other Categories belonging to State of Uttarakhand under rule 6, and shall intimate the information in this regard to the selection committee/ Uttarakhand Public Service Commission /Uttarakhand Subordinate Service Selection Commission , whoever is concerned.

Selection

16.

(1) Lecturer

Procedure by

direct

recruitment

(a) The Appointing Authority shall identify the number of posts earmarked for selection through direct recruitment on the post of lecturer and intimate the Uttarakhand Public Service Commission about the vacancies .

(b) The Commission shall invite the application from candidates in prescribed performa for the post of lecturer of direct recruitment on the basis of requisition sent by the Appointing Authority .

(c) The Commission shall organize written examination of such number of candidates as it deems necessary and who fulfills the required qualification according to Appendix C keeping in view the need to ensure due representation of candidates belonging to the Scheduled Castes , Scheduled Tribes , Other Backward Classes , the Economically weaker section and Other categories as per rule 6 .

(d) The Commission shall conduct subject wise written examination for candidates and prepare a subject wise selection list in order oftheir proficiency as indicated by the marks obtained by each candidates in the written examination . The number of names in the list shall be more than vacancy determined (but not more than 25 percent) . Commission shall forward the list to Appointing Authority.

(2) Assistant Teacher

(a)The Appointing Authority shall identify the number of post for selection through direct recruitment on the post of Assistant Teacher and intimate the Uttarakhand Subordinate Staff Selection Commission about the vacancies .

of (b)Commission shall invite the application from candidates in prescribed performa for the post of Assistant Teacher direct recruitment on the basis of requisition sent by the Appointing Authority .

Classes Economically Weaker Sections and other categories as per rule 6 shall organize written examination of such number of candidates as it deems necessary and who complete the required qualification according to Appendix D and on the basis of marks obtained in the written examination shall prepare a merit list .

(d)The Commission shall prepare a selection list of candidate in merit order as disclosed from marks obtained by each candidate in written examination . Names in the list shall be more than vacancy (but not more than 25 percent) . The Commission shall forward the list to Appointing Authority.

Principal:

Procedure for 17. recruitment by promotion

Promotion on 100 percent post of principal Uttarmadhyma level shall be made on the basis of seniority rejecting the unfit from amongst the headmaster appointed on the post of Purva madhyma school through selection committee constituted under the provision of the Uttarakhand Constitution of Departmental Promotion Committee (on the posts outside the purview of Uttarkhand Public Service Commission ) Rules , 2002 ( as amended from time to time) . Departmental Selection Committee on the basis of specified record shall consider the matter of candidates according to the Uttarakhand Procedure for Selection by Promotion in State Services ( outside the purview of public service commission ) Rules , 2013 ( as amended from time to time) .

Selection committee shall consist of following : -

(a) Principal Secretary or Secretary , as the case may be , Sanskrit Education Chairperson Department , Uttarakhand Government;

(b) Secretary of Personnel Department , Member Uttarakhand Government or officer nominated by him not below the level ofAdditional Secretary of Government ;

(2) Headmaster :

(1) Promotion on 100 Percent post of Headmaster Purvmadhyama level shall be made from amongst the Assistant Teacher Trained Graduate Category and lecturer appointed to the post of teachers in Government 30

Sanskrit School on the basis of seniority , rejecting the unfitthrough selection committee . For promotion on the postofheadmaster promotion ratio of Assistant Teacher / lecturer shall be in accordance with sub - rule (2) of rule 5.

(2) Promotion on the post of headmaster Government Sanskrit School ( class 6 to 10) shall be done on the basis of seniority , rejecting the unfit , through selection committee constituted under the provision of the Uttarakhand Constitution of Departmental Promotion Committee (on the posts outside the purview of Uttarakhand Public Service Commission ) Rules , 2002 (asamended from time to time) . Departmental Selection Committee on the basis of mentioned record shall consider the matter of candidates according to the Uttarakhand Procedure for Selection by Promotion in State Service (outside the purview of public service commission) Rules , 2013 ( as amended from time to time).

Selection committee shall consist of following:

(a) Principal Secretary or Secretary as the Chairperson case may be Sanskrit Education Department , Uttarakhand Government ;

Member

(b) Secretary of Personnel Department, Uttarakhand Government or officer nominated by him not below the level of Additional Secretary of Government;

Member secretary

(3) Lecturer

Recruitment by promotion on the 50 percent posts of total sanctioned post in lecturer cadre shall be made on the basic of seniority, rejecting the unfit according to the Uttarakhand Promotion by Selection in Consultation with Public Service Commission (Procedure) Rules , 2003 ( as amended from time to time).

18.

Combined selection list

Ifin any recruitment year appointment is made by both direct recruitment and promotion , than a combined list shall be prepared by taking names from relevant list in such a manner so that prescribed percentage is maintained . The first name in the list shall be of the person appointed by promotion .

PART -VI

ΑΡΡΟΙΝΤΜΕNT , PROBATION , CONFIRMATION AND SENIORITY

19.

Appointment

(1 ) Subject to the provisions of sub - rule (2) the Appointing Authority shall make appointment by taking the names of candidates , in the order , in which they stand in the lists prepared under rules 16, 17 and 18 as the case may be .

(2) Where in any year of recruitment appointments are to be made both by direct recruitment and by promotion , regular promotions shall not be made unless selections are made from both the sources and a combined list is prepared in accordance with rule 18 .

(3) Ifmore than one order of appointment are issued in respect ofany one selection, a combined order shall also be issued mentioning the names of the persons in order of seniority as determined in the selection or , as the case may be , as it stood in the cadre from which they are promoted . If the appointments are made both by direct recruitment and by promotion, names shall be arranged in accordance with the cyclic order , referred in rule 18.

20.

Probation

( 1 ) A person appointed on the vacancy on the any permanent post or service or against it shall be placed on probation for a period of two year .

(2) The Appointing Authority may , for reasons to be recorded , in separate cases extend period of probation in individual cases specifying the date up to which the period is extended:

Provided that , save in exceptional circumstances , the period of probation shall not be extended beyond one year and in no circumstances beyond two years .

(3) If it appears to the Appointing Authority at any time during or at the end of the period of probation or extended period ofprobation that a probationer has not made sufficient use of his opportunities , he may be reverted to his substantive post, if any, and if he does not hold a lien on any post, his services may be dispensed with .

(4) A probationer who is reverted or whose services are dispensed with under sub - rule (3 ) shall not be entitled to any compensation.

(5) The Appointing Authority may allow continuous service, rendered in an officiating or temporary capacity in a post included in the cadre or any other equivalent or higher post, to be taken into account for the purpose of computing the period ofprobation.

21.

Confirmation

(1 ) A probationer shall be confirmed in his appointment at the end of the period of probation or the extended period of probation under the provisions of sub rule (2 ) if-

(a) he has passed the prescribed departmental examination if any;

(b) he has successfully undergone the prescribed training if any;

(d) his integrity is certified ;

(e) the Appointing Authority is satisfied that he is otherwise fit for confirmation .

(2) Where , as per provisions of Uttarakhand Confirmation of Government Servant Rules , 2002 the confirmation is not necessary, the order passed under sub -rule (3 ) of rule 5 making this declaration that the concerned person has successfully completed the probation period , shall be considered as the order of confirmation .

22.

Seniority

The seniority of any personnel on post of any category in service shall be determined in accordance with the provisions ofUttarakhand Government Servants Seniority Rules , 2002 (as amended from time to time) .

Part- VII

Pay etc.

23 .

Pay Scales

(1) The scales of pay admissible to persons appointed to the various categories of posts in the service shall be such as may be determined by the Government from time to time .

(2) The Scales of pay at the time of the commencement of these rules is given in Appendix 'A' .

24 .

PayDuring Probation

(1)Notwithstanding any provision in the Fundamental Rules to the contrary a person on probation if he is not already in permanent government service shall be allowed his first increment in the time- scale, when he has completed one year of satisfactory service and has passed the departmental examination and undergone training where prescribed and second increment , after two years of satisfactory service , where he has completed the probationary period and is also confirmed;

Provided that , if the period of probation is extended on account of failure to give satisfaction , such extension shall not be counted for increment unless the Appointing Authority directs otherwise .

(2) The pay during probation of a person who has already been holding a post , under the Government , shall be regulated, by the relevant Fundamental Rules :

(3) The pay , during probation of a person who is already in permanent government service shall be regulated by the relevant rules applicable generally to Government Service serving in connection with the affairs of the State .

PART -VIII

OTHER PROVISIONS

Canvassing

25. No recommendation , either written or oral , other than those required under the rules applicable to the post or service shall be taken into consideration . Any attempt on the part of a candidate to enlist support directly or indirectly for his candidature will disqualify him for appointment .

Regulation of other matters

26. In relation to matters , not specifically covered by these rules or special orders , persons employed in the service will be regulated by the rules , regulations and orders generally applicable to the government servants serving in connection with the affairs of the State .

27 .

Relaxationfrom the conditions of service

Where the State Government is satisfied that the operation of any rule regulating the conditions of service of persons appointed to the service caused undue hardship in any particular case, it may , notwithstanding anything contained in the rules applicable to the case , by order , dispense with or relax than requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner:

Provided that where any rule is made in consultation with commission, before dispensing with or relaxing from requirement of rule commission shall be consulted.

Saving

28. Nothing in these rules shall affect reservations and other concessions required for the candidates belong to Scheduled Castes , Scheduled Tribes , Other Backward Classes , Economically Weaker Sections and other special categories of persons to the State of Uttarakhand in accordance with the orders of the Government issued from time to time in this regard.

B.Tech./B.E . degree in Computer Science from any recognized University established by law.

(3) Possess U.T.E.T. - 2 OR C.T.E.T. - 2 qualification .

(2) Senior diploma in music from Allahabad University in Vocal and Instrumental or degree of Sangeet Visharat from Bhat Khande Sangeet College

Sangeet Visharad degree from Uttarakhand Bhat Khande Sangeet Mahavidhalya;

Six year Sangeet Prabhakar degree from Prayag Sangeet Samiti Allahabad .

11 Assistant Teacher (Art)

(1 ) Graduation degree in drawing or painting fine Art (painting) /visual Art (Painting) Subject from any recognized University established by law in India .

(2) LT diploma from any Government or Government affiliated training institute / college or degree of Shiksha Shastri or B.Ed. form any University established by law in India/Training degree according to N.C.T.E. Standards .

(3 ) Possess U.T.E.T. - 2 OR C.T.E.T. - 2 qualification .

12 Assistant Teacher Physical Education

(1) Graduation degree from any recognized University established by law in India.

(2) One year B.P.Ed. Diploma from a Training Institute/ College recognized by the National Council for Teacher Education or any State Government /B.P.E . graduation degree from any recognized University established by law in India .

(3) Possess U.T.E.T. - 2/C.T.E.T. - 2 qualification.
