राज्यपाल " भारत का संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करके तथा इस विषय में समस्त विद्यमान नियमों और आदेशों का अधिक्रमण करते हुए उत्तराखण्ड कारागार कारापाल अधीनस्थ (राजपत्रित) सेवा में नियुक्त व्यक्तियों की, सेवा की शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं, अर्थात :-

भाग-एक सामान्य

संक्षिप्त नाम और प्रारम्भ 1. (1) इस नियमावली का संक्षिप्त नाम " उत्तराखण्ड कारागार कारापाल अधीनस्थ (राजपत्रित) सेवा नियमावली, 2026" है ।

(2) यह तुरन्त प्रवृत्त होगी ।

सेवा की प्रास्थिति

उत्तराखण्ड कारागार कारापाल अधीनस्थ ( राजपत्रित) सेवा में समूह 'ख' के पद समाविष्ट हैं ।

परिभाषाएँ

3. जब तक कि विषय या संदर्भ में कोई प्रतिकूल बात न हो, इस नियमावली में :-

(क) "नियुक्ति प्राधिकारी" से कारागार महानिरीक्षक, उत्तराखण्ड अभिप्रेत है;

(ख) "भारत का नागरिक' से ऐसे व्यक्ति अभिप्रेत हैं, जो संविधान के भाग - दो के अधीन भारत का नागरिक हो या समझा जाये;

(ग) "आयोग" से उत्तराखण्ड लोक सेवा आयोग अभिप्रेत है;

(घ) " संविधान" से भारत का संविधान अभिप्रेत है;

(ङ) " सरकार " से उत्तराखण्ड की राज्य सरकार अभिप्रेत है;

(च) "राज्यपाल " से उत्तराखण्ड के राज्यपाल अभिप्रेत हैं;

(छ) " महानिरीक्षक" से महानिरीक्षक कारागार, उत्तराखण्ड अभिप्रेत है;

(ज) " सेवा के सदस्य" से सेवा के संवर्ग में किसी पद पर इस नियमावली के या इस नियमावली के प्रारम्भ के पूर्व प्रवृत्त नियमों या आदेशों के अधीन मौलिक रूप से नियुक्त व्यक्ति अभिप्रेत है,

(झ) " सेवा" से उत्तराखण्ड कारागार कारापाल अधीनस्थ (राजपत्रित) सेवा अभिप्रेत है, और

(ञ) "भर्ती का वर्ष" से किसी कैलेण्डर वर्ष की पहली जुलाई से प्रारम्भ होने वाली बारह मास की अवधि अभिप्रेत है ।

भाग -दो

संवर्ग

सेवा का संवर्ग

4. (1 ) सेवा की सदस्य संख्या और उसमें प्रत्येक श्रेणी के पदों की संख्या उतनी होगी जितनी राज्यपाल द्वारा समय- समय पर अवधारित की जाय ।

(2) सेवा की सदस्य संख्या और उसमें प्रत्येक श्रेणी के पदों की संख्या, जब तक कि उपनियम ( 1 ) के अधीन उसमें परिवर्तन करने के आदेश न दिये जायें, उतनी होगी जितनी परिशिष्ट ' क' में दी गयी है, परन्तु यह कि -

(एक) नियुक्ति प्राधिकारी किसी रिक्त पद को बिना भरे हुए छोड़ सकता है या राज्यपाल उसे आस्थगित रख सकते हैं, जिससे कोई व्यक्ति प्रतिकर का हकदार नहीं होगा, या

(दो) राज्यपाल समय - समय पर ऐसे अतिरिक्त स्थायी या अस्थायी पदों का सृजन कर सकते हैं, जिन्हें वह उचित समझें ।

भर्ती का स्रोत

5. सेवा में कारापाल के पद पर भर्ती मौलिक रूप से नियुक्त ऐसे स्थायी उप कारापालों में से जिन्होंने भर्ती वर्ष के प्रथम दिवस को इस रूप में न्यूनतम 07 वर्ष की सेवा पूर्ण कर ली हो, अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर पदोन्नति द्वारा की जायेगी।

आरक्षण

6. उत्तराखण्ड राज्य की अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य श्रेणियों के अभ्यर्थियों के लिए आरक्षण भर्ती के समय प्रवृत्त सरकार के आदेशों के अनुसार किया जायेगा ।

भर्ती की प्रक्रिया

रिक्तियों की अवधारणा

नियुक्ति प्राधिकारी वर्ष के दौरान भरी जाने वाली रिक्तियों की संख्या और नियम 6 के अधीन उत्तराखण्ड राज्य की अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य श्रेणियों के अभ्यार्थियों के लिए आरक्षित की जाने वाली रिक्तियों की संख्या भी अवधारित करेगा ।

भर्ती की प्रक्रिया

8. (1 ) कारापाल के पद पर पदोन्नति द्वारा भर्ती अनुपयुक्त को अस्वीकार करते हुए ज्येष्ठता के आधार पर उत्तराखण्ड विभागीय पदोन्नति समिति का गठन (लोक सेवा आयोग की परिधि के बाहर के पदों के लिए ) नियमावली , 2002 (समय- समय पर यथासंशोधित) के उपबन्धों के अनुसार गठित विभागीय चयन समिति के माध्यम से उत्तराखण्ड (लोक सेवा आयोग की परिधि के बाहर) राज्याधीन सेवाओं में पदोन्नति के लिए चयन प्रकिया नियमावली, 2013 (समय- समय पर यथासंशोधित) के अनुसार की जायेगी ।

(2) नियुक्ति प्राधिकारी अभ्यर्थियों की पात्रता सूची उत्तराखण्ड (लोक सेवा आयोग के क्षेत्र के बाहर के पदों पर) चयोन्नति पात्रता सूची नियमावली, 2003 के अनुसार तैयार करेगा और उनकी चरित्र पंजियों और उनसे संबंधित ऐसे अन्य अभिलेखों के साथ, जो उचित समझे जायें, चयन समिति के समक्ष रखेगा ।

(3) चयन समिति उपनियम (2) में निर्दिष्ट अभिलेखों के आधार पर अभ्यर्थियों के मामले पर विचार करेगी और यदि वह आवश्यक समझे जो अभ्यर्थियों का साक्षात्कार भी कर सकती है ।

(4) चयन समिति चयन किये गये अभ्यर्थियों की ज्येष्ठता क्रम में एक सूची तैयार करेगी और उसे नियुक्ति प्राधिकारी को अग्रसारित करेगी ।

भाग-पाँच

नियुक्ति, परिवीक्षा , स्थायीकरण और ज्येष्ठता

नियुक्ति

नियुक्ति प्राधिकारी अभ्यर्थियों के नाम उसी क्रम में लेकर जिसमें वह, यथास्थिति नियम 8 के अधीन तैयार की गयी सूची में आये हों, नियुक्तियाँ करेगा ।

परिवीक्षा

10. (1) सेवा में किसी पद पर मौलिक रिक्ति में या उसके प्रति नियुक्त किये जाने पर प्रत्येक व्यक्ति को दो वर्ष की अवधि के लिए परिवीक्षा पर रखा जायेगा ।

(2) नियुक्ति प्राधिकारी ऐसे कारणों से, जो अभिलिखित किये जायेंगे , अलग-अलग मामलों में परिवीक्षा अवधि को बढ़ा सकता है, जिसमें ऐसा दिनांक विनिर्दिष्ट किया जायेगा जब तक की अवधि बढ़ायी जाय ।

परन्तु अपवादिक परिस्थितियों के सिवाय , परिवीक्षा अवधि एक वर्ष से अधिक और किसी भी परिस्थिति में 02 वर्ष से अधिक नहीं बढ़ायी जायेगी ।

(3) यदि परिवीक्षा अवधि या बढ़ायी गयी परिवीक्षा अवधि के दौरान किसी भी समय या उसके अन्त में नियुक्ति प्राधिकारी को यह प्रतीत हो कि परिवीक्षाधीन व्यक्ति ने अपने अवसरों का पर्याप्त उपयोग नहीं किया है या सन्तोष प्रदान करने में अन्यथा विफल रहा है तो उसे उसके मौलिक पद पर प्रत्यावर्तित किया जा सकता है ।

(4) ऐसा परिवीक्षाधीन व्यक्ति, जिसे उपनियम (3 ) के अधीन प्रत्यावर्तित किया जाय, किसी प्रतिकर का हकदार नहीं होगा ।

(5) नियुक्ति प्राधिकारी संवर्ग में सम्मिलित किसी पद पर या किसी अन्य समकक्ष या उच्चतर पद पर स्थानापन्न या अस्थायी रूप में की गयी निरन्तर सेवा को परिवीक्षा अवधि की संगणना करने के प्रयोजनार्थ गिने जाने की अनुमति दे सकता है ।

स्थायीकरण

11. किसी अभ्यर्थी को परिवीक्षा अवधि या बढ़ाई गई परिवीक्षा अवधि के अन्त में उनकी नियुक्ति पर स्थायी कर दिया जायेगा, यदि, (क) उसका कार्य और आचरण संतोषजनक पाया जाय ,

(ख) उसकी सत्यनिष्ठा प्रमाणित कर दी जाय और,

(ग) नियुक्ति प्राधिकारी को यह समाधान हो जाय कि वह स्थायीकरण के लिए अन्यथा उपयुक्त है ।

12.

ज्येष्ठता

मौलिक रूप से नियुक्त व्यक्तियों की ज्येष्ठता समय - समय पर यथा संशोधित उत्तराखण्ड सरकारी सेवक ज्येष्ठता नियमावली, 2002 के अनुसार अवधारित की जायेगी ।

भाग-छः

वेतन इत्यादि

वेतनमान

13. सेवा में किसी पद पर नियुक्त व्यक्तियों का वेतनमान ऐसा होगा , जैसा सरकार द्वारा समय - समय पर अवधारित किया जाय । इस नियमावली के प्रारम्भ के समय प्रवृत्त वेतनमान परिशिष्ट-" ख " में दिया गया है ।

परिवीक्षा अवधि में वेतन

14. (1 ) मूल नियमों में किसी प्रतिकूल उपबन्ध के होते हुए भी , परिवीक्षाधीन व्यक्ति को, यदि वह पहले से स्थायी सरकारी सेवा में न हो , समयमान में उसकी प्रथम वेतनवृद्धि तभी दी जायेगी, जब उसने एक वर्ष की सन्तोषप्रद सेवा पूरी कर ली हो, और द्वितीय वेतनवृद्धि तभी दी जायेगी जब उसे स्थायी कर दिया गया हो, परन्तु यदि संतोषजनक सेवाएँ प्रदान न कर सकने के कारण परिवीक्षा अवधि बढ़ाई जाय तो इस प्रकार बढ़ायी गई अवधि की गणना वेतनवृद्वि के लिए नहीं की जायेगी, जब तक कि नियुक्ति प्राधिकारी अन्यथा निर्देश न दे ।

(2) ऐसे व्यक्ति का, जो पहले से सरकार के अधीन कोई पद धारण कर रहा हो, परिवीक्षा अवधि में वेतन सुसंगत मूल नियमों द्वारा विनियमित होगा:

परन्तु, यदि सन्तोषजनक सेवाये प्रदान न कर सकने के कारण परिवीक्षा अवधि बढ़ायी जाये तो इस प्रकार बढ़ायी गयी अवधि की गणना वेतनवृद्धि के लिए नहीं की जायेगी जब कि नियुक्ति प्राधिकारी अन्यथा निर्देश न दे ।

(3) ऐसे व्यक्ति का जो पहले से स्थायी सरकारी सेवा में हो , परिवीक्षा अवधि में वेतन राज्य के कार्यकलाप के सम्बन्ध में सेवारत सरकारी सेवकों पर सामान्यतः लागू सुसंगत नियमों द्वारा विनियमित होगा ।

अन्य उपबन्ध

पक्ष समर्थन

15. किसी पद या सेवा के सम्बन्ध में लागू नियमों के अधीन अपेक्षित सिफारिशों से भिन्न किसी सिफारिश पर, चाहे लिखित हो या मौखिक कोई विचार नहीं किया जायेगा । किसी अभ्यार्थी की ओर से अपनी अभ्यर्थिता के लिये प्रत्यक्ष या अप्रत्यक्ष रूप से समर्थन प्राप्त करने का कोई प्रयास उसे नियुक्ति के लिये अनर्ह कर देगा ।

16.

अन्य विषयों का विनियमन

उन विषयों के सम्बन्ध में जो विनिर्दिष्ट रूप से इस नियमावली या विशेष आदेशों का विनियमन के अन्तर्गत न आते हों, सेवा में नियुक्त व्यक्ति ऐसे नियमों, विनियमों और आदेशों द्वारा शासित होगें जो राज्य के कार्यकलाप के संबंध में सेवारत सरकारी सेवकों पर सामान्यतया लागू होते है ।

सेवा की शर्तों में शिथिलता

17. जहां राज्य सरकार का यह समाधान हो जाये कि सेवा में नियुक्त व्यक्यिों की सेवा की शर्तों को विनियमित करने वाले किसी नियम के प्रवर्तन से किसी विशिष्ट मामलें मे अनुचित कठिनाई होती है वहां वह उस मामलें में लागू नियमों में किसी बात के होते हुये भी आदेश द्वारा उस नियम की अपेक्षाओं की उस सीमा तक और ऐसी शर्तों के अधीन रहते हुये जिन्हें वह मामलें में न्याय संगत और साम्यपूर्ण रीति से कार्यवाही करने के लिए आवश्यक समझें अभिमुक्त या शिथिल कर सकती है :

परन्तु यदि कोई नियम आयोग के परामर्श से बनाया गया हो तो उस नियम की अपेक्षाओं को आयोग से पहले परामर्श किये बिना अभिमुक्त या शिथिल नहीं किया जायेगा ।

व्यावृत्ति

18. इस नियमावली के किसी बात का कोई प्रभाव ऐसे आरक्षण और अन्य रियायतों पर नहीं पड़ेगा जिनका इस सम्बन्ध में सरकार द्वारा समय - समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य श्रेणियों के अभ्यर्थियों के लिए उपबन्ध किया जाना अपेक्षित हो ।

MISCELLANEOUS

In exercise of the powers conferred by the proviso to article 309 of " the Constitution of India " and in supersession of all existing rules and orders on the subject , the Governor is pleased to make the following rules to regulate the recruitment and conditions of service of the persons appointed to , the Uttarakhand Prison Jailor subordinate (Gazetted) service , namely-

The Uttarakhand Prison Jailor Subordinate ( Gazetted ) Service Rules , 2026

Part-I

General

Short title and commencement 1. (1) These rules may be called the Uttarakhand Prison Jailor Subordinate (Gazetted) Service Rules , 2026.

(2) It shall come into force at once .

Status of Service

2. The Uttarakhand Prison Jailor Subordinate (Gazetted) Service comprises ofGroup ' B ' posts .

Definitions

3. In these rules , unless there is anything repugnant in the subject or context-

(a) "Appointing Authority " means the Inspector General of Prisons , Uttarakhand;

(b) "Citizen of India " means a person who is or is deemed to be a citizen of India under part - II of the Constitution;

(d) " Constitution" means the Constitution of India;

(e) "Government " means the State Government of Uttarakhand;

(f) "Governor" means the Governor of Uttarakhand;

(g) "Inspector General " means The Inspector General of Prisons Uttarakhand;

(h) "Member of Service " means a person substantively appointed under these rules or orders in force prior to the commencement of these rules to a post in the cadre of the service ;

means (i) " Service" The Uttarakhand Prison Jailor Subordinate (Gazetted) Service and;

(j ) " year of recruitment " means a period of twelve months commencing from the first day of July of the calendar year .

PART- II

CADRE

Cadre of Service

(1) The strength of the service and of each category of posts shall therein be such as may be determined by the Governor from time to time .

(2) The strength of the service and each category of posts therein shall , until orders varying the same are passed under sub - rule ( 1 ) , be as given in Appendix- "A " :

Provided that-

(i ) The Appointing Authority may leave any vacant post unfilled or the Governor may keep it in abeyance , so that no person shall be entitled to compensation, or ;

(ii) The Governor may create from time to time such additional permanent or temporary posts as he may consider proper .

PART - III

RECRUITMENT

Source of Recruitment

5. Recruitment for the posts of Jailor shall be made by promotion, on the basis of seniority subject to the rejection of unfit from amongst such substantively appointed permanent deputy Jailors , who have completed 07 years service as such on the first day of the year of recruitment .

Reservation

6. Reservation for the candidates belonging to Scheduled Castes , Scheduled Tribes and other category belonging to the State of Uttarakhand shall be in accordance with the orders of the Government in force at the time of the recruitment .

PART - IV

PROCEDURE FOR RECRUITIMENT

Determination of vacancies 7 . The Appointing Authority shall determine and intimate to the Commission the number of vacancies to be filled during the course of the year and also the number of vacancies to be reserved for candidates belonging to Scheduled Castes , Scheduled Tribes and other categories under rule 6.

Procedure for recruitment

(1 ) Recruitment to the post of jailor through promotion subject to rejection of unfit shall be made accordance with the selection process for promotion to the services under the Uttarakhand State Services ( Promotion Selection Process for Posts Outside the Purview of the Public Service Commission) Rules , 2013 ( as amended from time to time) through a Departmental Selection Committee constituted in accordance with the provisions of the Uttarakhand Constitution of Departmental Promotion Committee (for posts outside the purview of the Public Service Commission) Rules , 2002 ( as amended from time to time) on the basis of seniority.

(2) The Appointing Authority shall prepare the eligibility list of candidates in accordance with the Uttarakhand (Eligibility List for Promotion to Posts Outside the Purview of the Public Service Commission) Rules , 2003 , and shall place the same before the Selection Committee along with their character rolls and such other relevant records as may be considered appropriate .

(3) The Selection Committee shall examine the cases of the candidates on the basis of the documents specified in sub -rule (2) , and may , if consider necessary , also conduct interviews of the candidates .

(4) The Selection Committee shall prepare a list of the selected candidates in order of seniority and forward it to the Appointing Authority.

PART-V

ΑΡΡΟΙΝΤΜENT , PROBATION , CONFIRMATION AND SENIORITY

Appointment

( 1 ) The Appointing Authority shall make appointments by taking the names of the candidates in the same order in which they appear in the list prepared under rule 8 .

Probation

10. ( 1) A person on appointment to a post in the service in or against substantive vacancy shall be placed on probation for a period of two years .

(2) The Appointing Authority may, for reasons to be recorded , extend the period of probation in individual cases specifying the date up to which the period is extended

provided that save in exceptional circumstances , the period of probation shall not extended for more than one year and in no circumstances beyond two years .

(3) If it appears to the Appointing Authority at any time during or at the end of the period of 13 उत्तराखण्ड असाधारण गजट, 29 जून , 2026 ई० (आषाढ़ 08, 1948 शक सम्वत्)

probation or extended period of probation that a probationer has not made sufficient use of his opportunities , or his otherwise failed to give satisfaction, he may be reverted to his substantive post,

(4) A probationer who is reverted under sub - rule (3 ) shall not be entitled to any compensation.

(5) The Appointing Authority may allow continuous service, rendered in an officiating or temporary capacity in a post included in the cadre or any other equivalent or higher posts , to be taken into account for the purpose of computing the period ofprobation .

Confirmation

11. A probationer shall be confirmed in his appointment at the end of the period of probation at the end of extended period of probation if-

(a) his work and conduct are reported to be satisfactory;

(b) his integrity is certified , and .

12.

Seniority

Seniority of the substantively appointed persons shall be determined in accordance with the Uttarakhand Government Servants Seniority Rules , 2002 , as amended time to time .

Part- VI Pay scale etc.

13.

Pay scale

The scale of pay admissible to persons of service shall be such as may be determined by the Government from time to time . The pay scale at the time of the commencement of this rules is given in Appendix ' B ' .

Pay during probation

( 1) Notwithstanding any provisions in the Fundamental Rules to the contrary , a person on probation if he is not already in permanent Government Service , shall be allowed his first increment in the time scale when he has completed one year of satisfactory service and second increment after two years of service when he has completed the probation period and is also confirmed:

Provided that if the period of probation is extended on account of failure to give satisfactory service such extension shall not be counted for increment unless the Appointing Authority directs otherwise .

(2) The pay during probation of a person who was already holding a post under the Government shall be regulated by the relevant fundamental rules :

(3) The pay during probation of a person already in permanent Government Service shall be regulated by the relevant rules , applicable generally to Government servants serving in connection with the affairs of the State .

PART -VII OTHER PROVISIONS

Canvassing

consideration. Any attempt on the part of a candidate to enlist support directly or indirectly for his candidature shall disqualify him for appointment .

16.

Regulation of other matters

In relation to such subjects , which do not fall under these rules or special orders , the persons employed in the service shall be regulated by the rules , regulations and orders generally applicable to the serving Government servants related to the affairs of the State .

Relaxation from the conditions of service

17. Where the State Government is satisfied that the operation of any rule regulating the conditions of service of persons appointed to the service causes undue hardship in any particular case, it may, notwithstanding anything contained in the rules applicable to the case , by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner :

Provided that if a rule was framed in consultation with the Commission the requirements of that rule shall not be dispensed with or relaxed without the Commission being consulted before hand .

Saving

18. Nothing in these rules shall affect reservations and other concessions required for the candidates belong to Scheduled Castes , Scheduled Tribes and other categories of candidates in accordance with the orders of the Government issued from time to time inthis regard .
