राज्यपाल , उत्तराखण्ड कारागार और सुधारात्मक सेवाएं अधिनियम, 2024 की धारा 68 सपठित धारा 69 की उपधारा (2) में प्रदत्त शक्तियों का प्रयोग करते हुए उत्तराखंड कारागार नियमावली, 2023 में अग्रेत्तर संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं, अर्थात् -

संक्षिप्त नाम एवं प्रारम्भ
(1) इस नियमावली का संक्षिप्त नाम उत्तराखण्ड कारागार (संशोधन) नियमावली, 2026 है । (2) यह तुरन्त प्रवृत्त होगी ।
नियम 3 का संशोधन
2 उत्तराखण्ड कारागार नियमावली, 2023 में नीचे स्तम्भ-1 में दिये गये नियम 3 के विद्यमान खण्ड (xvii) के स्थान पर स्तम्भ 2 में दिया गया खण्ड रख दिया जायेगा, अर्थात्:-

स्तम्भ-1 विद्यमान खण्ड
स्तम्भ-2 एतद्वारा प्रतिस्थापित खण्ड
(xvii). "आभ्यासिक अपराधी या आदतन अपराधी से अभिप्रेत है"-
(xvii). "अभ्यस्त अपराधी (habitual offender)" से ऐसा व्यक्ति अभिप्रेत है, जिसे इस नियमावली के प्रारंभ होने से पूर्व या पश्चात् उत्तर प्रदेश अभ्यस्त अपराधी प्रतिरोध, अधिनियम, 1952 की अनुसूची में उल्लिखित (Set forth) किसी एक या अन्य अपराध के लिये कम से कम तीन पृथक- पृथक अवसरों पर मौलिक अवधि के कासवास (Substantive term of imprisonment) का दण्ड दिया गया हो और ऐसा दण्डादेश अपील अथवा पुनरीक्षण में अपास्त (Set aside) न कर दिया गया हो ।
(क) कोई व्यक्ति जिसे अपराध का दोषी ठहराया गया है , जिसकी पिछली दोषसिद्धि अथवा भारतीय दण्ड संहिता, 1860 के अध्याय XII , XVI , XVII के अंतर्गत दोषसिद्धि स्वयं में या वर्तमान मामलों के तथ्यों को साथ दर्शाता है कि वह पिछले सभी या किन्ही अध्यायों में निर्दिष्ट कोई दंडनीय अपराध आदतन कारित करता है ;
(ख) संहिता, की धारा 22 (सपठित धारा 110) के अधीन कारागार में सुपुर्द या निरूद्ध कोई भी व्यक्ति ;
(ग) उपर्युक्त (क) में विनिर्दिष्ट किसी भी अपराध के लिए दोषी ठहराया गया कोई भी व्यक्ति जब मामले में तथ्यों से प्रकट होता है, भले ही पूर्व में कोई दोषसिद्धि साबित नहीं हुई है, कि वह आदतन डकैतों या चोरों के गिरोह का सदस्य है , या चोरी की गई संपत्ति का व्यवहारी है;
(घ) भारत के बाहर कार्यरत किसी न्यायालय या न्यायाधिकरण द्वारा दोषी ठहराए गए किसी भी व्यक्ति को किसी ऐसे अपराध हेतु दोषसिद्ध ठहराया जाता है जिसे भारत में स्थापित न्यायालय में दोषी ठहराए जाने की स्थिति में आदतन अपराधी के रूप में वर्गीकृत किया जाता है ।
स्पष्टीकरण : इस परिभाषा के प्रयोजन हेतु " दोषसिद्धि शब्द में संहिता, की धारा 117 सपठित धारा । 110 के अधीन किया गया आदेश सम्मिलित है ।

NOTIFICATION
In exercise of the powers conferred by section 68 read with subsection (2 ) of section 69 of the Uttarakhand Prisons and Correctional Services Act, 2024 the Governor, with a view to further amend the Uttarakhand Jail Manual (Rules ) , 2023 makes the following manual , namely : -
The Uttarakhand Jail Manual (Amendment) (Rules) , 2026
Short title and commencement 1 ( 1 ) These manual may be called The Uttarakhand Jail Manual (Amendment ) (Rules), 2026
(2) It shall come into force at once.
Amendment of rule 3
2 In the Uttarakhand Jail Manual (Rules), 2023 , for the existing clause (xvii ) of rule 3 as set out in Column - 1 below, the clause as set out in Column- 2 shall be substituted namely; -

(xvii) . "habitual offender or habitual criminal" means-
(xvii) . " habitual offender " means a person who before or after the commencement of these Rules , has been sentenced to a substantive term of imprisonment, on not less than three different occasions for one or another of the offences set forth in the Schedule to the Uttar Pradesh Habitual Offenders ' Restriction Act, 1952 and such sentence have not been set aside in appeal or revision .
(a) Any person convicted of an Offence whose previous conviction or conviction under Chapter XII , XVI, XVII of the Indian Penal Code, 1860 taken by themselves or with the facts of the present case show that habitually commits an offence or offence punishable 3 under any or all of the previous mentioned chapters ;
(b) Any person committed to or detained in Prison under section 22 (read with section 110) of the code ;
(c) Any person convicted of any of the offence from specified in (a) above when it appears form the facts of the case even although no previous conviction has been proved that he is by habit a member of a gang of dacoits , or of thieves or a dealer in stolen property;

(d) Any person convicted by a court or Tribunal acting outside India , of an Offence which would have rendered him liable to be classified as a Habitual Criminal , if he had been, convicted in a ! court established in India .
| Explanation : For the purpose of this definition the word " Conviction" shall include an order made under Section 117, read with Section 110 , of the code .
