विविध

" भारत का संविधान " के अनुच्छेद 213 के खण्ड (1 ) के अधीन मा ० राज्यपाल ने " उत्तराखण्ड अल्पसंख्यक शिक्षा अधिनियम (संशोधन) अध्यादेश , 2026" प्रख्यापित किया है और वह उत्तराखण्ड राज्य का अध्यादेश संख्याः 03 वर्ष-2026 के रूप में सर्व साधारण के सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है ।

(भारत गणराज्य के सतहत्तरवें वर्ष में राज्यपाल द्वारा प्रख्यापित)

उत्तराखण्ड अल्पसंख्यक शिक्षा अधिनियम, 2025 (अधिनियम संख्याः 18 वर्ष, 2025) में अग्रेत्तर संशोधन करने के लिए ,

अध्यादेश

चूंकि राज्य की विधान सभा सत्र में नहीं है और राज्यपाल को यह समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान है , जिनके कारण उन्हें तुरन्त कार्रवाई करना आवश्यक हो गया है;

अतएव, अब, राज्यपाल भारत के संविधान के अनुच्छेद 213 के खण्ड (1 ) द्वारा प्रदत्त शक्त्तियों का प्रयोगः करते हुए , निम्नलिखित अध्यादेश प्रख्यापित करते हैं:-

संक्षिप्त नाम और प्रारम्भ

(1 ) इस अध्यादेश का संक्षिप्त नाम उत्तराखण्ड अल्पसंख्यक शिक्षा अधिनियम (संशोधन) अध्यादेश, 2026 है । (2) यह तुरन्त प्रवृत होगा ।

धारा 2 का संशोधन

उत्तराखण्ड अल्पसंख्यक शिक्षा अधिनियम , 2025 (जिसे यहां आगे मूल अधिनियम कहा गया है) की धारा 2 में-

(क) खण्ड (घ) के स्थान पर निम्नलिखित खण्ड प्रतिस्थापित कर दिया जायेगा, अर्थात्-

(घ)" शैक्षणिक संस्थान " से

(i) कक्षा-8 तक की शिक्षा प्रदान करने के संदर्भ में ऐसा संस्थान जो सक्षम प्राधिकारी से मान्यता प्राप्त हो, तथा

(ii) कक्षा-9 से कक्षा-12 तक की शिक्षा प्रदान करने के संदर्भ में ऐसा संस्थान जो परिषद् से संबद्ध हो अभिप्रेत है ।

(ख) खण्ड (ज) , के पश्चात् निम्नलिखित खण्ड अंतःस्थापित कर दिया जायेगा, अर्थात्--

(झ) "सक्षम प्राधिकारी" से उत्तराखण्ड सरकार द्वारा कक्षा-8 तक ले विद्यालयों को मान्यता प्रदान करने अथता उनकी मान्यता का नवीनीकरण करने हेतु समय - समय पर जारी दिशा- निर्देश के अन्तर्गत नाभित सक्षम प्राधिकारी अभिप्रेत है ।

धारा 3 का संशोधन

मूल अधिनियम की धारा 3 में - (क) उपधारा (2 ) , में " परिषद " शब्द के स्थान पर "परिवद/सक्षम प्राधिकारी" शब्द एवं चिन्ह प्रतिस्थापित कर दिये जायेंगे ।

(ख) उपधारा 4 में " परिषद " , शब्द के स्थान पर " परिषद / सक्षम प्राधिकारी" शब्द एवं चिन्ह प्रतिस्थापित कर दिये जायेंगे ।

धारा 4 के परन्तुक संशोधन

मूल अधिनियम की धारा 4 के परन्तुक में "परिषद ", शब्द के स्थान पर "परिषद / सक्षम प्राधिकारी " शब्द एवं चिन्ह प्रतिस्थापित कर दिये जायेंगे ।

3. उत्तराखण्ड असाधारण गजट, 30 जून, 2026 ई ० (आषाढ़ 09 , 1948 शक सम्वत्)

धारा 11 का संशोधन

मूल अधिनियम में, धारा 11 की उपधारा (3) को विलोपित कर दिया जायेगा ।

धारा 12 का संशोधन

मूल अधिनियम की धारा 12 में-

(क) उपधारा (2) , में " परिषद ", शब्द के स्थान पर " परिषद/ सक्षम प्राधिकारी" शब्द एवं चिन्ह प्रतिस्थापित कर दिये जायेंगे ।

(ख) उपधारा (3 ) में " उत्तराखण्ड विद्यालयी शिक्षा परिषद के अनुमोदन से" शब्दों को विलोपित कर दिया जायेगा ।

धारा 14 का संशोधन

7 . मूल अधिनियम की धारा 14 में -

(क) खण्ड (ख) , के स्थान पर निम्नलिखित खण्ड प्रतिस्थापित कर दिया जायेगा अर्थात्-

(ख) " परिषद / सक्षम प्राधिकारी से मान्यता प्राप्त "

(ख) खण्ड (झ),में "परिषद " शब्द के स्थान पर " परिषद / सक्षम प्राधिकारी " शब्द एवं चिन्ह प्रतिस्थापित कर दिये जायेंगे ।

(ग) खण्ड (ञ),में "परिषद" शब्द के स्थान पर "परिषद/ सक्षम प्राधिकारी " शब्द एवं चिन्ह प्रतिस्थापित कर दिये जायेंगे ।

धारा 16 का संशोधन

मूल अधिनियम की धारा 16 में खण्ड (ख ) के पश्चात् निम्नलिखित खण्ड अंतःस्थापित कर दिया जायेगा , अर्थात्-

(ग) यदि प्राधिकरण को इस आशय की जानकारी प्राप्त होती है कि किसी संस्थान द्वारा इस अधिनियम की धारा 3 की उपधारा (1 ) का उल्लघंन करते हुए धार्मिक शिक्षा प्रदान की जा रही है अथवा धारा 14 में उल्लिखित शर्तों का उल्लंघन किया जा रहा है, तो समुचित जांचोपरान्त इस जानकारी की पुष्टि होने पर प्राधिकरण ऐसे संस्थानों में तालाबंदी करते हुए , उनके संचालकों पर रूपये पांच लाख तक का अर्थदण्ड अधिरोपित कर सकता है, रिसीवर नियुक्त कर सकता है तथा किसी आपराधिक कृत्य के पाये जाने की दशा में संगत कानूनों के अन्तर्गत प्रथम सूचना रिपोर्ट भी दर्ज करा सकता है:

परन्तु यह कि उपर्युक्तानुसार कार्यवाही करने के पूर्व संस्थान के संचालकों को सुनवाई का समुचित अवसर प्रदान किया जायेगा ।

In pursuance of the provisions of Clause (3 ) of Article 348 of the Constitution of India , the Governor is pleased to order the publication of the following English translation of " Uttarakhand Minority Education Act (Amendment ) Ordinance, 2026" ( Uttarakhand Ordinance No. 03 of 2026) .

Aspromulgated by the Governor on 30 June, 2026 .

Further to amend the Uttarakhand Minorty Education Act, 2025 (Act No.18 of 2025 )

Whereas , the Legislative Assembly of the State is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action ;

Now, therefore , in exercise of the powers conferred by clause ( 1 ) of article 213 of the constitution of India , the Governor is pleased to promulgate the following Ordinance: -

Short title and commencement 1 . ( 1) This Ordinance may be called the Uttarakhand Minority Education Act (Amendment) Ordinance , 2026.

(2) It shall come into force at once .

Amendment of section 2

2. In section 2 of the Uttarakhand Minority Education Act , 2025 ( hereinafter referred to as the principal Act)-

(A) For clause ( d) , the following clause shall be substituted , namely-

(d) "Educational Institution " means

(i) an institution providing education up to Class 8 and recognized by the competent authority ; and

(ii) an institution affiliated with the Board for providing education from class 9 to Class 12 .

(B) After clause (h ) , the following clause shall be inserted , namely-

(i) " Competent Authority " means the authority designated by the Uttarakhand Government for granting recognition or renewal of recognition to schools up to Class 8 under the rules / guidelines issued from time to time .

Amendment of section 3

3. In section 3 of the principal Act-

(A) In sub section (2) , for the word " Board " , the words and symbol " Board/ Competent Authority " shall be substituted .

(B) In sub section (4) for the word " Board " , the words and symbol "Board /Competent Authority" shall be substituted .

Amendment of the proviso to 4. Section 4

In the proviso to section 4 of the principal Act, for the word " Board " , the words and symbol " Board/ Competent Authority " shall be substituted .

Amendment of section 11

In the principal Act , sub section ( 3 ) of section 11 shall be omitted.

Amendment of section 12

6. In section 12 of the principal Act-

(A) In sub section (2) , for the word " Board" , the words and symbol " Board/Competent Authority " shall be substituted .

(B) In sub section (3 ) , the words " with the approval of the Board of School Education Uttarakhand " shall be omitted .

Amendment of section 14

In section 14 of the principal Act-

(A) For clause (b) , the following clause shall be substituted

(b) " recognized by the Board/ Competent Authority"

(B) In clause ( i ) , for the word " Board " , the words and symbol "Board/ Competent 6

Amendment of section 16

8. In section16 of the principal Act, after clause (b) , the following clause shall be inserted, namely-

(c) If the Authority receives information or has reason to believe that any institution is imparting. religious education in violation of sub section ( 1 ) of section 3 of the Act, or is violating the conditions mentioned in section 14, then after proper inquiry and confirmation of such information , the Authority may lock down the institution, impose a penalty up to Rs 5 lakh on its managers/operators , appoint a receiver , and if any criminal offence appears to have been committed , lodge an FIR under the relevant laws:

Provided, before taking such action, the managers / operators of the institution shall be given a proper opportunity of being heard .
