आदेश
यतः, भारत निर्वाचन आयोग द्वारा दिनांक 21.01.2022 की अधिसूचना नं. 464/उत्तरा-वि.स./ 2022 के अनुसरण में उत्तराखण्ड के साधारण निर्वाचन 2022 आयोजित किया गया था ; और
यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन मे, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
यतः उत्तराखण्ड राज्य के 24- ऋषिकेश विधानसभा निर्वाचन क्षेत्र के साधारण निर्वाचन के परिणाम, रिटर्निंग अधिकारी द्वारा दिनांक 10.03.2022 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 09.04.2022 थी; और
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम ( 1 ) अंतर्गत , जिला निर्वाचन अधिकारी , देहरादून, जो मुख्य निर्वाचन अधिकारी, उत्तराखण्ड से दिनांक 22.04.2022 के पत्र सं० 2782/XXV- 53 /2022 को प्राप्त हुई थी, के अनुसार श्री जगजीत सिंह जो उत्तराखण्ड राज्य के 24- ऋषिकेश विधानसभा निर्वाचन क्षेत्र, 2022 से निर्वाचन लड़ने वाले अभ्यर्थी है , विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे है; और,
यतः, जिला निर्वाचन अधिकारी, देहरादून की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत श्री जगजीत सिंह को अपने निर्वाचन व्यय का लेखा प्रस्तुत नहीं करने के लिए को कारण बताओ नोटिस सं . 76/उत्तराखण्ड- वि.स. /24/2022/सी.ई.एम.एस.- III, दिनांक 20.10.2022 जारी किया गया था; और 2

घतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89के उप -नियम (6) के अनुसार श्री जगजीत सिंहको निर्वाचन व्यय का लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनो के भीतर जिला निर्वाचन अधिकारी, देहरादून को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निर्देश दिया गया था; और
यतः, जिला निर्वाचन अधिकारी , देहरादून से दिनांक 15.06.2023 के पत्र संख्या क्रमांक 891 /XXV - 22 ( 11 ) /2008 के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस श्री जगजीत सिंह के द्वारा दिनांक 18.11.2022 को स्वंय प्राप्त किया गया था, इसके पश्चात श्री जगजीत सिंह द्वारा दिनांक मई, 2023 को आयोग के समक्ष एक अभ्यावेदन प्रस्तुत किया गया था, जिसे टिप्पणियों हेतु जिला निर्वाचन अधिकारी, देहरादून को अग्रेषित किया गया था ; और
यतः, जिला निर्वाचन अधिकारी, देहरादून, द्वारा अपने पत्र संख्या क्रमांक 1248/XXV- 33 /2025 दिनांक 29.07.2026 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री जगजीत सिंह , ने अपूर्ण व्यय लेखा (दैनिक व्यय रजिस्टर, अपूर्ण शपथ - पत्र तथा व्यय विवरण) प्रस्तुत किया है । साथ ही सार विवरण एवं मूल व्यय वाउचर प्रस्तुत नहीं किये है । इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री जगजीत सिंह ने विधि के अंतर्गत यथा विहित लेखा अपेक्षित रीति में दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और
यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क में अनुबंधित किया गया है कि: - "यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहाहै; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्षकी कालावधि के लिए निरर्हित होगा; "
यतः, तथ्यों और उपलब्ध रिकार्डो के आधार पर आयोग का यह समाधान हो गया है कि श्री जगजीत सिंहअपने निर्वाचन व्यय का लेखा अपेक्षित रीति में दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नही है, और
अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि उत्तराखण्ड राज्य के साधारण निर्वाचन, 2022 के 24- ऋषिकेश विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री जगजीत सिंह , 26/21 चन्द्रेश्वर मार्ग, मायाकुण्ड, ऋषिकेश , जिला देहरादून, उत्तराखण्ड इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होगें ।

ORDER
WHEREAS, the General Election to Legislative Assembly of Uttarakhand , 2022 was held in pursuance of the Election Commission of India Notification No. 464/UKD - LA/2022 dated 21.01.2022 and WHEREAS , as per Section 78 of the Representation of the People Act, 1951 , every contesting candidate at an election shall , within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act ; and WHEREAS , the result of the above- mentioned elections for 24 - Rishikesh Assembly Constituency of Uttarakhand was declaredby the Returning Officer on 10.03.2022 and hence the last date for lodging the account of Election Expenses was 09.04.2022 ; and
WHEREAS , as per the District Election Officer, Dehradun , Uttarakhand report forwarded by the Chief Electoral Officer , Uttarakhand vide their letter no . 2782/ OXV - 53 /2022 dated 22.04.2022, under sub -rule ( 1 ) of Rule 89 of the Conduct of Elections Rules , 1961 , Sh . Jagjeet singh , a contesting candidate from 24- Rishikesh Assembly Constituency of Uttarakhand has failed to lodge his account of election expenses , as required under law; and
WHEREAS , on the basis of the said report of the District Election Officer, Dehradun , a Show- Cause notice No. .76/उत्तराखण्ड- वि.स ./24/2022 /सी.ई.एम.एस. - 111 , dated 20.10.2022 was issued under sub -rule ( 5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Sh . Jagjeet singla for not lodging of his account of Election Expenses ; and ,
WHEREAS, through the above said Show Cause Notice and under sub - rule ( 6 ) of Rule 89, of the Conduct of Elections Rules, 1961 , Sh . Jagjeet singh , was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Dehradun within 20 days from the date of receipt of the Notice; and
WHEREAS , District Election Officer , Dehradun vide his letter No. 891 /XXV 22(11 )/2008 dated 15.06.2023 , informed that the said notice was received by the candidate, Sh . Jagjeet singh on 18.11.2022 . Subsequently , a representation in May, 2023 was submitted by Shri Jagjeet Singh which was forwarded to the District Election Officer, Dehradun for comments ; and 4

WHEREAS , the District Election Officer, Dehradun in his Supplementary Report , vide its letter no . 1248/XXV- 33 /2025 dated 29.07.2026 has reported that Sh . Jagjeet singh , has submitted incomplete account of election expenses (daily expenditure register, incomplete affidavit etc) . Also , he has not submitted the abstract statement and the original bills/ vouchers . Further, after receipt of the said notice , Sh . Jagjeet singh , has neither furnished any reason nor explanation to the Election Commission of India , for failure to lodge the account of election expenses in the manner as prescribed under law; and
WHEREAS , Section 10 A of the Representation of the People Act, 1951 provides that : - "If the Election Commission is satisfied that a person-
( 1) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act, and
(b) has no good reason or justification for the failure , the Election Commission shall. by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date ofthe order."
WHEREAS , on the basis of facts and available records , the Commission is satisfied that Sh .
Jagject singh has failed to lodge his account of election expenses in the manner as required under the law and has no good reason or justification for the failure to do so ; and
NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Sh . Jagjeet singh resident of 26/21 , Chandreshwar Marg . Mayakund , Rishikesh , Distt . Dehradun , Uttarakhand a contesting candidate from 24- Rishikesh Assembly Constituency of General Election to the Legislative Assembly of Uttarakhand, 2022 , tobe disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order .
