संक्षिप्त नाम और प्रारम्भ 1 . (1 ) इस नियमावली का संक्षिप्त नाम उत्तराखण्ड राज्य विधिक सेवा प्राधिकरण (संशोधन) नियमावली , 2026 है । (2) यह तुरन्त प्रवृत्त होगी ।

नियम 3 का संशोधन 2. उत्तराखण्ड राज्य विधिक सेवा प्राधिकरण नियमावली, 2006 (जिसे आगे मूल नियमावली कहा गया है) में नीचे स्तम्भ-1 में दिये गये नियम 3 के विद्यमान उपनियम (1 ) एवं उपनियम (2) के स्थान पर स्तम्भ 2 में दिये गये उपनियम रख दिये जायेंगें, अर्थात्ः-

Short title and Commencement

1. ( 1 ) These Rules may be called the Uttarakhand State Legal Services Authority (Amendment) Rules , 2026 .

(2) It shall come into force at once .

Amendment of Rule 3 2. In the Uttarakhand State Legal Services Authority Rules , 2006 (hereinafter referred to as the principal rules ) for existing sub - rule ( 1 ) and sub - rule ( 2) of rule 3 as set out in column - 1 below , the sub - rules as set out in column -2 shall be substituted, namely: -

संख्या-274 / XVIII ( 3 ) 2026-07 ( 60 ) 2008- राज्यपाल , ' भारत का संविधान' के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तथा इस विषय पर विद्यमान समस्त नियमों और आदेशों का अधिक्रमण करते हुए , उत्तराखण्ड राज्य के अन्तर्गत कार्यरत चकबन्दी कार्मिकों के समायोजन हेतु निम्नवत् नियमावली बनाते हैं :-

उत्तराखण्ड राज्य (चकबन्दी कार्मिकों का समायोजन) नियमावली, 2026

संक्षिप्त नाम, विस्तार और प्रारम्भ

(1) इस नियमावली का संक्षिप्त नाम " उत्तराखण्ड राज्य (चकबन्दी कार्मिकों का समायोजन) नियमावली , 2026 " है ।

(2) यह नियमावली, उत्तराखण्ड राज्य में पूर्ववर्ती राज्य उत्तर प्रदेश के कार्यरत चकबन्दी कार्मिकों के पदों पर, समायोजन हेतु लागू होगी ।

(3 ) यह तुरन्त प्रवत्त होगी ।

अध्यारोही प्रभाव

किसी अन्य सेवा नियमावली या आदेश में दी गयी किसी प्रतिकूल बात के होते हुए भी, इस नियमावली का अध्यारोही प्रभाव होगा ।

जब तक कि विषय या संदर्भ में कोई बात प्रतिकूल न हो, इस नियमावली में: -

परिभाषाएं

(क) नियुक्ति प्राधिकारी" से नियमावली के अधीन चकबंदी में कार्यरत एवं सेवानिवृत्त कार्मिकों के / पदों पर, नियुक्ति करने के लिए सक्षम प्राधिकारी अभिप्रेत है;

(ख) 'चकबन्दी कार्मिकों से उत्तराखण्ड राज्य में पूर्ववर्ती राज्य उत्तर प्रदेश के कार्यरत एवं उत्तराखण्ड राज्य से सेवानिवृत्त चकबन्दी कार्मिक अभिप्रेत है ;

(ग) "सेवानिवृत्त चकबन्दी कार्मिकों से पूर्ववर्ती राज्य उत्तर प्रदेश के उत्तराखण्ड राज्य में सेवा निवृत्त चकबन्दी कार्मिक अभिप्रेत है;

(घ) "उपलब्ध रिक्ति" से ऐसी रिक्ति अभिप्रेत है, जो समायोजन की तारीख को उत्तराखण्ड राज्य हेतु चकबन्दी के स्वीकृत पदों के सापेक्ष रिक्त हो;

(ङ) 'नियमावली' से उत्तर प्रदेश चकबन्दी विभाग लिपिक और रेखांकन कर्मचारिवर्ग नियमावली , 1980 , उत्तर प्रदेश चकबन्दीकर्ता नियमावली , 1978 , उत्तर प्रदेश राजस्व चकबंदी (उच्चतर) सेवा नियमावली , 1992 , उत्तर प्रदेश 331 भाग 1 ]

राजस्व चकबंदी सेवा नियमावली, 1992 एवं उत्तर प्रदेश चकबंदी लेखपाल सेवा नियमावली, 2006, और समय-समय पर संशोधित उक्त नियमावलियां अभिप्रेत हैं;

परन्तु, समायोजन के पश्चात्, उत्तराखण्ड चकबन्दी अधिकारी एवं सहायक चकबन्दी अधिकारी सेवा नियमावली , 2018 एवं उत्तराखण्ड राजस्व चकबंदी (उच्चतर) सेवा नियमावली, 2021 लागू होगी और अन्य के सम्बन्ध में पूर्ववर्ती राज्य उत्तर प्रदेश की सेवा नियमावलियां तब तक प्रवृत्त रहेंगी, जब तक कि उत्तराखण्ड राज्य द्वारा तत्संबंध में सेवा नियमावली. प्रख्यापित नहीं कर दी जाती है;

(च) " आयोग" से समूह ' क' एवं 'ख' के पदों पर चयन हेतु " उत्तराखण्ड लोक सेवा आयोग" तथा समूह ' ग ' के पदों पर चयन हेतु " उत्तराखण्ड अधीनस्थ सेवा चयन आयोग" अभिप्रेत है;

(छ) "चकबन्दी विभाग" से " उत्तराखण्ड राज्य चकबन्दी विभाग " अभिप्रेत है;

(ज) 'सरकार" से उत्तराखण्ड राज्य की सरकार अभिप्रेत है;

(झ) 'राज्यपाल" से उत्तराखण्ड के राज्यपाल अभिप्रेत है;

(ञ) "सेवा का सदस्य" से इस नियमावली या इससे पूर्व प्रवृत्त नियमावली या आदेशों के अधीन मौलिक रूप से नियुक्त व्यक्ति अभिप्रेत है;

(ट) "सेवा" से उत्तराखण्ड चकबन्दी (राजस्व विभाग) सेवा अभिप्रेत है;

(ठ) 'मौलिक नियुक्ति' से सेवा के संवर्ग में किसी पद पर ऐसी नियुक्ति से अभिप्रेत है , जो तदर्थ नियुक्ति न हो और नियमानुसार चयन के पश्चात् की गई हो और यदि कोई नियम न हो तो सरकार द्वारा जारी किये गये कार्यपालक अनुदेशों द्वारा तत्समय विहित प्रक्रिया के अनुसार चयन के पश्चात् की गयी हो ।

समायोजन हेतु

पात्रता

(1) पूर्ववर्ती राज्य उत्तर प्रदेश में मौलिक रूप से नियुक्त चकबन्दी कार्मिक, जो उत्तराखण्ड राज्य की चकबन्दी इकाई में कार्यरत/ तैनात हैं , को उत्तराखण्ड चकबन्दी विभाग में समायोजन हेतु पात्र माना जायेगा ।

(2) समायोजन, सम्बन्धित कार्मिक की सहमति प्राप्त करने के उपरांत उत्तराखण्ड राज्य में पूर्ववर्ती राज्य उत्तर प्रदेश से कार्यरत होने के आधार पर उत्तराखण्ड राज्य में सृजित पदों के सापेक्ष किया जायेगा ।

[भाग 1

समायोजन हेतु शतों का निर्धारण

(1) चकबन्दी में कार्यरत कार्मिकों को पूर्ववर्ती राज्य, उत्तर प्रदेश में पद प्रास्थिति के अनुसार ही , वह जिस वेतनमान/ पदनाम में तैनात हैं , उसी वेतनमान/पदनाम में समायोजन किया जायेगा ।

(2 ) उत्तराखण्ड राज्य में चकबन्दी अधिष्ठान में समायोजन के आदेश में इंगित तारीख संबंधित कार्मिक की चकबन्दी में समायोजित होने की दिनांक मानी जाएगीः

परन्तु उनकी ज्येष्ठता , पदोन्नति एवं अन्य सेवा संबंधी मामले , पूर्ववर्ती राज्य उत्तर प्रदेश में मौलिक नियुक्ति की दिनांक से सुसंगत सेवा नियमावलियों के अंतर्गत व्यवहृत होंगे ।

i ( ( 3 ) उत्तराखण्ड राज्य में समायोजन के पश्चात् सम्बन्धित चकबन्दी कार्मिकों की ज्येष्ठता उनकी पूर्ववर्ती राज्य उत्तर प्रदेश में निर्धारित पारस्परिक ज्येष्ठता के अनुसार ही मानी जाएगी । अन्य दशाओं में ज्येष्ठता का निर्धारण, उनकी मौलिक नियुक्ति की दिनांक के आधार पर " उत्तर प्रदेश सरकारी सेवक ज्येष्ठता नियमावली, 1991 " अथवा उत्तराखण्ड सरकारी सेवक ज्येष्ठता नियमावली , 2002 " के अनुसार निर्धारित की जाएगी ।

(4) समायोजित होने वाले कार्मिकों के उपार्जित अवकाश / चिकित्सा अवकाश इत्यादि की गणना चकबन्दी विभाग में पूर्व में उपार्जित अवकाश / चिकित्सा अवकाश इत्यादि के साथ जोड़कर की जायेगी ।

होगी । (5) समस्त अर्ह कार्मिकों के जी०पी ० एफ ० / एन० पी० एस० / ई ० पी ० एफ० आदि की राशि उनके सम्बन्धित निधि लेखे में अन्तरित जी०पी ० एफ ० / एन० पी ० एस० / ई० पी०एफ ० आदि के निकासी की मांग, पूर्व में जमा अवशेष धनराशि के आधार पर की जाएगी । पूर्व में लिए गए ऋण / भविष्य निधि से लिये गए अग्रिम की कटौतियाँ , पूर्व की भाँति निर्धारित शर्तों पर की जाएगी । इस सम्बन्ध में समय - समय पर सरकार द्वारा निर्गत नियम लागू होंगे ।

(6 ) समायोजन की दिनांक को, यदि कोई कार्मिक नियमावली में स्थायीकरण हेतु विहित अर्हता पूर्ण नहीं करता है, तो नियुक्ति प्राधिकारी विहित अवधि पूर्ण करने पर उसका स्थायीकरण कर सकेगा ।

(7) चकबन्दी विभाग के स्वीकृत ढाँचे में विभिन्न पद सीधी भर्ती अथवा पदोन्नति के लिये निर्दिष्ट हैं । सीधी भर्ती अथवा पदोन्नति के स्वीकृत पदों के सापेक्ष समायोजन केवल , उत्तराखण्ड राज्य में पूर्ववर्ती राज्य उत्तर प्रदेश के कार्यरत एवं उत्तराखण्ड राज्य से सेवानिवृत्त कार्मिकों/ पदों की संख्या की सीमा तक अनुमन्य होगा ।

(8) ऐसे कार्मिक, जो उत्तराखण्ड राज्य में कार्यरत थे 333 भाग 1 ]

तथा सेवाकाल में उनकी मृत्यु होने पर उनके आश्रितों को नियुक्ति दी गयी , ऐसे नियुक्त मृतक आश्रितों को भी समायोजन में सम्मिलित किया जायेगा । उत्तराखण्ड राज्य में कार्यरत / सेवा के दौरान मृत, जिन मृतक कार्मिकों के आश्रितों को वर्तमान तक मृतक आश्रित का लाभ प्राप्त न हुआ हो , उन्हें मृतक आश्रित के रूप में नियुक्ति प्राधिकारी द्वारा सेवायोजित/ समायोजित किया जायेगा ।

(9 ) ऐसे कार्मिक, जो उत्तराखण्ड राज्य में चकबन्दी इकाईयों में कार्यरत थे तथा उत्तराखण्ड राज्य में सेवारत रहते हुए ही सेवानिवृत्त हो गये, वह समस्त सेवानिवृत्ति लाभों को प्राप्त करने के हकदार होंगे ।

संगत सेवा नियमावली के अधीन नियुक्त समझा जाना

(1) इस नियमावली के अधीन किया गया समायोजन चकबन्दी विभाग में उनके पदनाम/ वेतनमान की मौलिक नियुक्ति की दिनांक से सुसंगत नियमावली के अधीन की गयी नियुक्ति समझी जाएगी ।

(2) समायोजित होने वाले कार्मिकों से इस आशय का विकल्प प्राप्त किया जायेगा कि वह इस नियमावली के उपबन्धों के अधीन समायोजन हेतु सहमत है अथवा नहीं । यदि कोई कार्मिक अपने पूर्ववर्ती राज्य उत्तर प्रदेश / विभाग में प्रत्यावर्त्तन चाहे , तो उसके लिए यह विकल्प, इस नियमावली के अधिसूचित होने की दिनांक से 01 वर्ष तक उपलब्ध रहेगा । इस प्रकार , अपने पूर्ववर्ती राज्य उत्तर प्रदेश / विभाग को प्रत्यावर्त्तित होने वाला कार्मिक, किसी प्रकार के प्रतिकर आदि का हकदार नहीं होगा ।

(3) उत्तराखण्ड राज्य गठन के पश्चात् राज्य में चतुर्थ श्रेणी के पदों को मृत संवर्ग घोषित किये जाने के कारण चकबन्दी अधिष्ठान हेतु ढाँचे में सृजित पदों में चतुर्थ श्रेणी के पद आउटसोर्स के रूप में सृजित हैं:

परन्तु, उत्तराखण्ड राज्य में चकबन्दी इकाइयों में पूर्ववर्ती राज्य उत्तर प्रदेश द्वारा सृजित चतुर्थ श्रेणी के पदों के सापेक्ष वर्तमान में कार्यरत चतुर्थ श्रेणी कार्मिकों के सेवानिवृत्त होने तक उतने पद उनके लिए सृजित समझे जायेंगे । उक्त पदों पर कार्यरत चतुर्थ श्रेणी कार्मिकों की सेवानिवृत्ति/ मृत्यु होने पर उक्त पद स्वतः ही आउटसोर्स के अंतर्गत सृजित समझे जायेंगे ।

निरसन तथा अपवाद

(1) इस नियमावली के प्रारम्भ होने से ठीक पूर्व प्रवृत्त कोई भी नियम , जो इन नियमों के तत्स्थानी थे और जो उत्तराखण्ड राज्य में पूर्ववर्ती राज्य उत्तर प्रदेश के कार्यरत चकबंदी कार्मिकों पर लागू होते थे, एतद्वारा निरस्त किये जाते हैं;

(2) उपनियम (1 ) के अधीन निरसित किये गये नियमों 334

के अधीन जारी हुए किसी आदेश या की गई किसी कार्यवाही के संबंध में यह समझा जायेगा कि वह आदेश या कार्यवाही इस नियमावली के तत्स्थानी उपबन्धों के अधीन जारी किया गया था या की गयी थी ।

कठिनाईयों को दूर करने की शक्ति

राज्य सरकार , इस नियमावली के किसी उपबन्ध के कार्यान्वयन में किसी कठिनाई को (जिसके विद्यमान होने के बारे में वह एकमात्र निर्णायक हो) दूर करने के प्रयोजनार्थ , कोई ऐसा सामान्य या विशेष आदेश दे सकती है , जिसे वह उचित लोकहित में आवश्यक या समीचीन समझे ।

No. 274 /XVIII ( 3 ) 2026-07 ( 60 ) 2008 --In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of all existing rules and orders on this subject , the Governor is pleased to hereby makes the following rules for the adjustment of Consolidation personnel in the State of Uttarakhand : --

The Uttarakhand State ( Adjustment of Consolidation Personnel ) Rules, 2026

Short title,

extent and

1. (1) These rules may be called the Uttarakhand State (Adjustment of Consolidation Personnel ) Rules, 2026 .

commencement

(2) These rules shall be applicable for the adjustment of Consolidation personnel working in the erstwhile State of Uttar Pradesh in the State of Uttarakhand . (3) It shall come into force at once .

Overriding effect 2. Notwithstanding anything to the contrary contained in any other service rule or orders , these rules shall have overriding effect .

Definitions

3. In these rules , unless there is anything repugnant in the subject or context : -

(a) "Appointing Authority " means the authority competent to make appointments to the posts of working and retired personnel in consolidation under these rules .

(b) "Consolidation Personnel " means the consolidation personnel of the erstwhile State of Uttar Pradesh working in the State of Uttarakhand and retired from the State of Uttarakhand .

(c) " Retired Consolidation Personnel " means the retired Consolidation Personnel in the State of Uttarakhand from the erstwhile State of Uttar Pradesh .

(d ) "Available vacancy " means such vacancy which is vacant on the date of adjustment in relation to the sanctioned posts of Consolidation for the State of Uttarakhand.

(e) " Rules " means the Uttar Pradesh Consolidation Department Clerk and Drawing Staff Rules , 1980, the Uttar Pradesh Consolidation Officer Rules , 1978 , the Uttar Pradesh Revenue Consolidation ( Higher) Service Rules, 1992, the Uttar Pradesh Revenue Consolidation Service Rules , 1992 and the Uttar Pradesh Consolidation Lekhpal Service Rules , 2006 , and the said Rules as amended from time to time :

Provided that after the adjustment , the Uttarakhand Consolidation Officers and Assistant Consolidation officers Service Rules, 2018 & the Uttarakhand Revenue Consolidation ( Higher) Service Rules, 2021 shall be applicable and in respect of others, the service rules of the erstwhile State of Uttar Pradesh will remain in force until the service rules in this regard are promulgated by the State of Uttarakhand.

(f) " Commission " means " Uttarakhand Public Service Commission " for Group A and B posts and "Uttarakhand Subordinate Services Selection Commission " for Group C posts ;

(g) " Consolidation Department " means ' Uttarakhand State Consolidation Department' :

( h) "Government " means the Government of the State of Uttarakhand;

( i ) " Governor " means the Governor of Uttarakharid .

(j ) " Member of the service " means a person substantively appointed under these rules or the rules or orders in force prior to these rules :

(k) " Service' means Uttarakhand Consolidation ( Revenue Department ) Service:

[भाग 1

(1 ) " Substantive appointment " means an appointment to a post in the cadre of the service , which is not an ad hoc appointment and is made after selection in accordance with the rules and , if there are no rules, after selection in accordance with the procedure for the time being prescribed by executive instructions issued by the Government .

Eligibility For 4. adjustment

(1) The Consolidation Personal substantively appointed in the erstwhile State of Uttar Pradesh, who are working/posted in the Consolidation Unit of the State of Uttarakhand, shall be considered eligible for adjustment in the Uttarakhand Consolidation Department .

(2) Such adjustment , after obtaining the consent of the concerned employee , shall be made against the post created in the state of Uttarakhand , on the basis of employee having been in service in the erstwhile State of Uttar Pradesh .

5. ( 1) The personnel working in Consolidation shall be adjusted in the same pay scale/designation in which they are posted as per the previous state post status .

Determination of conditions for Adjustment

(2) The date indicated in the order of adjustment in the Consolidation Establishment in Uttarakhand State shall be considered as the date of adjustment of the concerned employee in the Consolidation .

Provided their seniority, promotion and other service matters shall be governed by the relevant service rules from the date of substantive appointment in the erstwhile State of Uttar Pradesh .

(3) After adjustment in the State of Uttarakhand , the seniority of the concerned Consolidation personnel shall be as per the inter se seniority determined in the erstwhile State of Uttar Pradesh . In other cases , the seniority shall be determined on the basis of the date of their substantive appointment as per the 'Uttar Pradesh Government Servants Seniority Rules , 1991 or Uttarakhand Government Servants Seniority Rules, 2002.

(4) The calculation of earned leave/medical leave etc. of the personnel to be adjusted shall be done by adding it with the previously earned leave/ medical leave etc. in the Consolidation Department .

(5) The GPF/ NPS/EPF, etc. , amounts of all eligible employees shall be transferred to their respective fund accounts . Withdrawal demands for GPF/ NPS/ EPF , etc. , shall be made based on the balance previously deposited .

Deductions from previously taken loans/provident fund advances shall continue to be made under the same conditions determined before . Rules issued from time to time by the Government shall apply in thisregard.

(6) On the date of adjustment , if any employee fulfils the eligibility criteria prescribed in the rules for confirmation , the Appointing Authority may confirm him after completion of the prescribed period .

(7) Various posts within the approved structure of the Consolidation Department are designated for direct recruitment or promotion . Adjustments against approved positions for direct recruitment or promotion shall be permissible only to the extent of the number of personnel/ posts employed in the State of Uttarakhand from the erstwhile State of Uttar Pradesh and retired from the State of Uttarakhand .

(8) Those personnel who were employed in the State of Uttarakhand and whose dependents were appointed upon their death during service , such appointed deceased dependents shall also be included in the adjustment . The dependents of deceased personnel who died while working in the State of Uttarakhand and have not received the deceased dependent benefits till date, shall be employed/adjusted as deceased dependents by the Appointing Authority.

(9) Such personnel , who were working in the Consolidation units in the State of Uttarakhand and retired while serving in the State of Uttarakhand , shall be entitled to receive all retirement benefits .

Deemed to be 6. appointed under relevant service rules

( 1) The adjustment made under these rules shall be deemed to be an appointment made under the relevant rules from the date of substantive appointment in the Consolidation Department in their designation/pay scale .

(2) Personnel to be adjusted shall be asked to opt out as to whether or not they agree to adjustment under the provisions of these rules . If personnel wishes to return to their former State/department , Uttar Pradesh , the option shall be available for a period of one year from the date of notification of these rules . The personnel transferring to their erstwhile State , Uttar Pradesh/department , shall not be entitled to any compensation etc.

(3) After the formation of the State of Uttarakhand, the posts of Class IV in the State were declared as dead cadre Provided that in the consolidation units of Uttarakhand , the Class IV posts created by the erstwhile State of Uttar Pradesh shall be deemed to have been created for the Class IV employees currently working there until their retirement . Upon retirement/ death of Class IV employees working on the said posts , the said posts shall automatically be deemed to have been created under outsourcing.

Repeal and Saving

7. ( 1) Any rule in force immediately before the commencement of these rules , which were corresponded to these rules and were applicable to the consolidation personnel of the erstwhile State of Uttar Pradesh working in the State of Uttarakhand , are hereby repealed .

(2) Any order issued or any action taken under the rules repealed under sub rule ( 1) shall be deemed to have been issued or taken under the corresponding provisions of these rules .

Power to remove difficulties

8. The State Government may, for the purpose of removing any difficulty ( the existence of which it is the sole decisive) in the implementation of any provision of these rules , make such general or special order as it may deem fit which it may consider necessary or expedient in the interest of fair dealing or public interest .

संख्या-196 / XVII - B - 1 / 2026-7 ( 03 ) 2026- राज्यपाल , उत्तराखण्ड अल्पसंख्यक शिक्षा अधिनियम , 2025 की धारा 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उत्तराखण्ड राज्य में अल्पसंख्यक शैक्षणिक संस्थानों की मान्यता एवं मान्यता के नवीनीकरण हेतु शर्तें एवं प्रक्रिया को विनियमित किये जाने हेतु निम्नलिखित नियमावली बनाये जाने की सहर्ष स्वीकृति प्रदान करते हैं, अर्थातः-

उत्तराखण्ड अल्पसंख्यक शैक्षणिक संस्थानों की मान्यता संबंधी नियमावली, 2026

संक्षिप्त नाम और प्रारम्भ 1. (1 ) इस नियमावली का संक्षिप्त नाम उत्तराखण्ड अल्पसंख्यक शैक्षणिक संस्थानों की मान्यता संबंधी नियमावली, 2026 है।

(2) यह उस दिनांक से प्रवृत्त होगा जो राज्य सरकार, राजपत्र में अधिसूचना द्वारा , नियत करे ।

परिभाषाएं

2. (1 ) इस नियमावली में, जब तक कि संदर्भ में अन्यथा अपेक्षित न हो-

(क) " शैक्षणिक वर्ष" से बोर्ड का शैक्षणिक सत्र अभिप्रेत है;

(ख) " अधिनियम " से उत्तराखण्ड अल्पसंख्यक शिक्षा अधिनियम, 2025 (उत्तराखण्ड अधिनियम संख्या 18 , 2025 ) अभिप्रेत है,

(ग) " प्राधिकरण" से उत्तराखण्ड राज्य अल्पसंख्यक शिक्षा प्राधिकरण (USAME) अभिप्रेत है;

(घ) "बोर्ड" से उत्तराखण्ड विद्यालयी शिक्षा बोर्ड अभिप्रेत है;

(ङ) " शैक्षणिक संस्थान " से इंटरमीडिएट स्तर तक का संस्थान जो बोर्ड के साथ सम्बद्ध हो, अभिप्रेत है;

(च) "अल्पसंख्यक समुदाय " से मुस्लिम या ईसाई या सिक्ख या बौद्ध या जैन या पारसी समुदाय अभिप्रेत है;

(छ) " अल्पसंख्यक शैक्षणिक संस्थान" से ऐसा शैक्षणिक संस्थान से है, जो किसी अल्पसंख्यक समुदाय द्वारा स्थापित व संचालित हो तथा जिसे प्राधिकरण द्वारा इस रूप में मान्यता प्रदान की गई हो, अभिप्रेत है ।

(2) शब्द और पदार्याल जो इस नियमावली में प्रयुक्त है किन्तु वे परिभाषित नहीं हैं, के वहीं अर्थ होगें, जो उत्तराखण्ड अल्पसंख्यक शिक्षा अधिनियम,. 2025 में उन्हें दिये गये हैं ।

संस्थान की मान्यता प्राप्त

करने की प्रक्रिया

(1 ) अल्पसंख्यक शैक्षणिक संस्थान के रूप में मान्यता प्राप्त करने के इच्छुक शैक्षणिक संस्थान प्राधिकरण के वेब पोर्टल usame.uk. gov.in पर ऑनलाइन आवेदन करेंगे ।

(2) अल्पसंख्यक शैक्षणिक संस्थान के रूप में मान्यता प्राप्त करने या इसके नवीनीकरण हेतु किये गये आवेदन के साथ सरकार द्वारा निर्धारित शुल्क डिजिटल रूप से ऑनलाइन जमा किया जाएगा।

(3) प्राधिकरण अधिनियम की धारा 14 में सूचीबद्ध शर्तों के अनुसार अल्पसंख्यक्त शैक्षणित संस्थान की मान्यता या नवीनीकरण के लिए किए गये आवेदन की जांच करेगा और यदि आवश्यक समझे तो शैक्षणिक संस्थान का निरीक्षण करवाएगा ।

(4) प्राधिकरण द्वारा संस्थान को दी गई मान्यता या संस्थान का नवीनीकरण तीन शैक्षणिक वर्षों की अवधि के लिए ही वैध होगा ।

मान्यता हेतु अनिवार्य शर्तें

शैक्षणिक संस्थानों की मान्यता हेतु ऑनलाइन आवेदन जमा करते समय , शैक्षणिक संस्थान द्वारा निम्नलिखित दस्तावेज/ सूचनाएं /अभिलेख के साथ, विवरण अपलोड किए जाएंगे-

(1) शैक्षणिक संस्थान को सेवा प्रदान की जाने वाली धार्मिक अल्पसंख्यक समुदाय के बारे में जानकारी ।

(2) (क) यदि संस्थान सोसाइटी रजिस्ट्रीकरण अधिनियम, 1860 के अंतर्गत पंजीकृत है, तो पंजीकरण प्रमाणपत्र , उपविधियां (By- laws) तथा सोसाइटी के सदस्यों की सूची की प्रमाणित प्रतिः अथवा

(ख) यदि संस्थान भारतीय न्यास अधिनियम , 1882 के अंतर्गत न्यास के रूप में पंजीकृत है, तो न्यासियों की सूची की प्रमाणित प्रति एवं पंजीकृत न्यास विलेख अथवा

(ग) यदि संस्थान कम्पनी अधिनियम , 2013 की धारा 8 के अंतर्गत गैर- लाभकारी कंपनी के रूप में पंजीकृत है, तो निगमन प्रमाणपत्र , संगम ज्ञापन (MOA), संघ के अनुच्छेद (AOA) एवं कम्पनी के निदेशकों की सूची की प्रमाणित प्रति तथा सभी निदेशकों की कंपनी पहचान संख्या (CIN) एवं निदेशक पहचान संख्या (DIN) ।

(3) शैक्षणिक संस्था के शासी निकाय (Governing Body) के सदस्यों की प्रमाणित सूची।

(4) इस तथ्य को स्थापित करने के उद्देश्य से कि शैक्षणिक संस्था मुख्य रूप से उस अल्पसंख्यक समुदाय के हित में कार्य करेगा जिससे वह संबंधित है, सोसाइटी / न्यास / कंपनी के उद्देश्यों एवं लक्ष्यों को दर्शाने वाले दस्तावेज की एक प्रमाणित प्रति ।

(5) अल्पसंख्यक शैक्षणिक संस्थान के रूप में मान्यता प्राप्त करने वाली सोसाइटी/ न्यास / कंपनी द्वारा पारित संकल्प (Resolution) की प्रमाणित प्रति ।

(6) बोर्ड से संबद्ध‌ता (Affiliation) प्रमाणपत्र की प्रति ।

(7) शैक्षणिक संस्थान जिस भूमि पर स्थित है उस भूमि के स्वामित्व / पट्टे के अधिकार सिद्ध / स्थापित करने हेतुः-

(क) भूमि का विक्रय विलेख और विक्रय विलेख पर आधारित नामांतरण प्रमाणपत्र, या

(ख) भूमि हस्तान्तरण का अन्य दस्तावेज एवं उसके आधार पर नामांतरण प्रमाणपत्र या

(ग) भूमि का पंजीकृत पट्टा विलेख (Lease Deed) |

(8) किसी वाणिज्यिक बैंक में संस्थान के नाम से खोले गए बैंक खाते का विवरण (स्टेटमैंट) की प्रति ।

(9) शैक्षणिक संस्था द्वारा नियुक्त शिक्षकों एवं गैर- शिक्षण कर्मचारियों की सूची तथा उनके शैक्षिक प्रमाणपत्रों की प्रमाणित प्रति ।

(10) यह स्वघोषणा कि सोसाइटी/ न्यास/ कंपनी के किसी सदस्य / न्यासी / निदेशक ने साम्प्रदायिक सौहार्द को भंग करने में भाग नहीं लिया है / कोई संलिप्तता नहीं है ।

(11 ) सोसाइटी /न्यास / कंपनी के स्थायी खाता संख्या (PAN ) कार्ड की प्रति ।

(12) सोसाइटी/ न्यास / कंपनी के जीएसटी पंजीकरण प्रमाण पत्र की प्रति।

(13) सोसाइटी/न्यास / कंपनी के कर्मचारी भविष्य निधि (EPF ) पंजीकरण प्रमाणपत्र की प्रति ।

(14) सोसाइटी/न्याय / कंपनी के कर्मचारी राज्य बीमा (ESI) पंजीकरण प्रमाणपत्र की प्रति ।

(15) शैक्षणिक संस्थान के प्रधानाचार्य का पासपोर्ट साइज फोटो एवं पहचान पत्र ।

(16 ) शैक्षणिक संस्थान के भवन का अनुमोदित/ स्वीकृत नक्शा एवं फोटोग्राफ ।

(17) भाननीय सर्वोच्च न्यायालय के ग्यारह न्यायाधीशों की पीठ द्वारा Τ.Μ.Α. Pai Foundation & Ors Vs. State of Karnataka , W.P. (civil) 317 of 1993 decided on 31- 10--2002 में दिए गये निर्णय के अनुसार, यह स्वघोषणा कि शैक्षणिक संस्थान का अल्पसंख्यक स्वरूप बनाए रखा जाएगा ।

(18 ) अधिनियम की धारा 3 की उपधारा (2) में निहित प्रावधानों के अनुसार प्राधिकरण द्वारा निर्धारित मानकों, गुणवत्ता और सामाग्री के अनुरूप , धार्मिक अल्पसंख्यक समुदाय के लिए विशिष्ट विषयों की चयन सूची ।

नवीनीकरण की प्रक्रिया 5. अल्पसंख्यक शैक्षणिक संस्थान के रूप में मान्यता के नवीनीकरण के लिए आवेदन वैधता अवधि समाप्त होने के कम से कम तीन माह पूर्व ऑनलाइन आवदेन प्रस्तुत करना अनिवार्य होगा । नवीनीकरण के लिए ऑनलाइन आवेदन प्रस्तुत करते समय , अल्पसंख्यक शैक्षणिक संस्थान को निम्नलिखित बिन्दुओं का ध्यान रखना होगा: -

(1) यह स्पष्ट रूप से दर्शाया जाएगा कि नियम 4 के अंतर्गत अपलोड किए गए दस्तावेजों में उल्लिखित तथ्यों की स्थिति में कोई परिवर्तन हुआ है, जिसे कि बाद के नवीनीकरणों के दौरान अद्यतन किया गया है, यदि कोई परिवर्तन हुआ है, तो संस्थान द्वारा संबंधित दस्तावेज अपलोड किया जाएगा ।

(2) संस्थान द्वारा निम्नलिखित दस्तावेज ऑनलाईन प्रस्तुत किए जायेंगे

(क) पिछले तीन वर्षों के बैंक खाते के विवरण (स्टेटमेंट) की प्रति;

(ख) संस्थान द्वारा नियुक्त शिक्षकों एवं गैर- शिक्षण कर्मचारियों की सूची तथा उनके शैक्षिक प्रमाणपत्रों की प्रमाणित प्रति;

(ग) पिछले तीन वित्तीय वर्षों के आयकर रिटर्न की एक- एक प्रति बैलेंस शीट सहित;

(घ) पिछले तीन वित्तीय वर्षों की GST रिटर्न की एक - एक प्रति;

(ङ) पिछले तीन वित्तीय वर्षों की EPF रिटर्न की एक - एक प्रति;

(च) पिछले तीन वित्तीय वर्षों की ESI रिटर्न की एक -एक प्रति;

(छ) अल्पसंख्यक शिक्षण संस्थान की पिछले तीन वर्षों की वार्षिक रिपोर्ट की प्रति, जिसमें शिक्षा प्रदान करने के प्रदर्शन तथा अन्य गतिविधियों जैसे खेल , संस्कृति आदि में प्रदर्शन का भी विवरण हो ; (ज) शैक्षणिक संस्थान के प्रधानाचार्य का पासपोर्ट साइज फोटो एवं पहचान पत्र;

(झ) पिछले तीन वर्षों के प्रवेश रजिस्टर की एक - एक प्रति;

(ञ) यह स्व- घोषणा कि अल्पसंख्यक शैक्षणिक संस्थान में पिछले तीन शैक्षणिक वर्षों में से प्रत्येक वर्ष में गैर- अल्पसंख्यक समुदाय के 15 प्रतिशत से अधिक छात्र नामांकित नहीं थे;

(ट) बोर्ड से अनापत्ति प्रमाणपत्र (NOC) ।

सान्यता प्रदान करने 6. नवीनीकरण के लिए आवदेन पर निर्णय

(1 ) किसी शैक्षणिक संस्थान द्वारा अल्पसख्यक शैक्षणिक संस्थान के रूप में मान्यता प्राप्त करने या मान्यता के नवीकरण हेतु किसी शैक्षणिक संस्थान से ऑनलाइन आवेदन प्राप्त होने पर, प्राधिकरण आवेदन में दी गई जानकारी की सत्यता की जांच करेगा और इस 344

उद्देश्य के लिए प्राधिकरण संबंधित जिले में अल्पसंख्यक कल्याण अधिकारी की सहायता से संस्थान का निरीक्षण करवा सकता है ।

(2) यदि प्राधिकरण इस निष्कर्ष पर पहुंचता है कि शैक्षणिक संस्थान मान्यता/ नवीनीकरण प्रदान करने के लिए अधिनियम एवं इस नियमावली में निर्धारित सभी शर्तों को पूर्ण करता है, तो वह मान्यता/ नवीनीकरण प्रदान करेगा अन्यथा , की दशा में वह शैक्षणिक संस्थान को अस्वीकृति के कारणों का उल्लेख करते हुए आवेदन अस्वीकृति की सूचना देगा ।

सूचना आदि की मांग

प्राधिकरण किसी भी समय अल्पसंख्यक शिक्षण संस्थान के कार्यों से संबंधित कोई भी दस्तावेज या जानकारी (सांख्यिकीय या अन्य) मांग सकता है तथा संस्थान का निरीक्षण भी करा सकता है । अल्पसंख्यक शिक्षण संस्थान प्राधिकरण द्वारा निर्धारित अवधि के भीतर आवश्यक दस्तावेज/ जानकारी उपलब्ध कराएगा और निरीक्षण किए जाने की स्थिति में हर संभव सहायता प्रदान करेगा ।

नान्यता समाप्त करने की शक्ति

अल्पसंख्यक शैक्षणिक संस्थान के रूप में मान्यता प्रदान करने के पश्चात् किसी भी समय , प्राधिकरण , संस्थान को सुनवाई का उचित अवसर प्रदान करने के पश्चात्, ऐसी मान्यता समाप्त कर सकता है, यदि वह यह पाता हैकिः--

(1 ) अधिनियम/ इस नियमावली में उपवन्धित किसी भी शर्तों का उल्लंघन किया जाता है , या

(2) शुल्क, दान, अनुदान या वित्तपोषण के किसी अन्य स्रोत के माध्यम से प्राप्त धन का दुरूपयोग किया जाता हैं ।

THE UTTARAKHAND RECOGNITION OF MINORITY EDUCATIONAL INSTITUTIONS RULES , 2026

Short title and commencement

1. ( 1 ) These rules may be called The Uttarakhand Recognition of Minority Educational Institutions Rules , 2026 .

(2) These rules shall come into force on such date as the State Government may, by notification in the Gazette , appoint.

Definitions

2. ( 1 ) In these rules , unless the context otherwise requires

(a) "Academic Year" means an academic year of the Board;

(b) " Act" means The Uttarakhand Minority Education Act, 2025 ; ( Uttarakhand Act No. 18 of2025)

( c) " Authority" means the Uttarakhand State Authority for Minority Education (USAME);

(d) "Board" means the Board of School Education, Uttarakhand ;

(e) "Educational institution " means an educational institution up to senior secondary/ intermediate level affiliated with theBoard;

a (1) " minority community " means community comprising either Muslims or Christians or Siklas or Buddhists or Jains or Zoroastrians (Parsis) ;

(g) " minority educational institution " means an educational institution established and administered by a minority community and recognized as such by the Authority ;

(2) Words and expression used in these rules but not defined herein shall have the same meanings as assigned to them in the Uttarakhand Minority Education Act , 2025 Procedure for seeking recognition as a Minority Educational Institution

3. (1) An educational institution seeking recognition as a Minority Educational Institution shall submit an online application on the web -portal of the Authority i.e. www.usame.uk.gov.in 346

(2) A fee, as determined by the Government, shall be digitally deposited online along with the application for recognition or renewal of a Minority Educational Institution .

(3) The Authority shall examine the application for recognition or renewal of a Minority Educational Institution as per the conditions enumerated in section 14 of the Act and get the educational institution inspected, ifrequired .

(4) The recognition and renewal granted by the Authority shall be valid only for a period of three academic years .

Mandatory condition for recognition

4. While submitting the online application for recognition, the educational institution shall upload the details with following documents/ informations/records: -

(1) Information about the religious minority community to be served by the educational institution.

(2) ( a) if institution is registered as a Society under The Societies Registration Act , 1860 , the Registration Certificate , the By - laws and certified copy of the list of members of the Society: or

(b) if institution is registered as a Trust under The Indian Trusts Act, 1882 , certified copy of the list of Trustees and the registered Trust Deed; or

(c) if institution is registered as a Non- profit making company under Section 8 of The Companies Act, 2013 , the Certificate of Incorporation, the Memorandum of Association , the Articles of Association and certified copy of the list of Directors of the company along with the Company Identification Number (CIN) and Director Identification Number (DIN) of all Directors .

(3) A certified list of members of the Governing Body of the educational institution.

(4) With a view to establishing the fact that the educational institution shall primarily serve the interest of the minority community to which it belongs , a certified copy of the document mentioning the aims and objectives of the Society/Trust/ Company.

(5) A certified copy of the resolution passed by the Society/Trust /Company for seeking recognition as Minority Educational Institution . a

(6) A copy of the Certificate of Affiliation with the Board .

(7) For establishing the ownership/lease rights of the land on which the educational institution is located -

(a) Sale Deed of the land and mutation certificate based on the Sale Deed ; or

(b) Other instrument of transfer of land and mutation certificate based on such transfer ; or

(8 ) A copy of the statement of Bank Account opened in the name of the educational institution in a commercial bank.

(9) A certified copy of the list of teachers and non- teaching staff appointed by the educational institution and their educational certificates .

(10) A self-declaration that none of the members/ trustees/ directors of the Society/ Trust/Company has been involved indisturbing communal/social harmony .

(11) A copy of the Permanent Account Number (PAN) Card of the Society / Trust /Company .

(12) A copy of the GST registration certificate of the Society/ Trust/ Company 348

(13) A copy of the Employees ' Provident Fund (EPF) registration certificate of the Society/Trust/ Company .

(14) A copy of the Employees' State Insurance (ES1 ) registration certificate of the Society/Trust/ Company .

(15) Passport size photograph and ID Proof ofthe Principal of the educational institution .

(16) Approved map and photograp of the building of the educational institution

(17) In the spirit of the judgement delivered by the eleven judges' bench of the Hon'ble Supreme Court in the TMA Pai Foundation Vs State of Karnataka, W.P. (civil) 317 of 1993 decided on 31-10-2002 , a self- declaration that minority character of the educational institution shall be maintained .

(18) In conformity with the standards , quality and content laid down by the Authority as per the provisions contained in sub -section (2) of section 3 of the Act , the choice of subjects specific to the religious minority community .

Procedure for renewal

5. An application for renewal of the recognition as a minority educational institution shall be submitted online at least three months prior to the expiry of the validity period. While submitting the online application for renewal , the Minority Educational Institution shall keep in mind the following points : -

(1) It shell be clearly indicated if there has been any change in the status of the facts mentioned in the documents uploaded under Rule 4 as updated during subsequent renewals , if any, and in case of a change, Institution shall upload the related documents .

(2) Institution shall submit the following documents online: -

( a) A copy of the statement of Bank Account for the previous three years.

(b) A certi fied copy of the list of teachers and non - teaching staff appointed by the institution and their educational certificates .

(d) A copy each of the last three financial years ' GST Returns .

(e) A copy each of the last three years ' EPF Returns .

(f) A copy each of the last three years' ESI Returns

(g) A copy each of the last three years' annual report of the minority educational institution mentioning performance in imparting education as well as performance in other activities i.e. sports , culture etc.

(h) Passport size photograph and ID Proof of the Principal of the educational institution

(i) A copy each of last three year s ' admission register.

(j ) A self- declaration that not more than fifteen percent students from non-minority community were enrolled in each of the last three academic years in the minority educational institution

(k) No objection certificate from the Board .

Decision on the application fo rgranting recognition /renewal

( 1 ) On receipt of an online application from an educational institution for recognition as a minority educational institution or for the renewal of the recognition , the Authority shall satisfy itself about the veracity of information contained in the application and tor this purpose it may get the institution inspected with the help of the officer- in- charge of Minority Welfare in the District concerned.

(2) If the Authority comes to the conclusion that the educational institution fulfills all the requirements enumerated in the Act and these rules for granting recognition/renewal, it shall grant the same , otherwise it shall inform the educational institution that the application has been rejected mentioning the grounds for rejection.

Calling for information etc.

7. At any time, the Authority may call for any document or information (statistical or otherwise) relating to the functioning of the Minority Educational Institution and also get the institution inspected. The Minority Educational Institution shall required documents/ information within the period specified by the Authority and in case an inspection is to be conducted , provide all possible help to facilitate the same . provide the

Power to Cancel of recognition

the 8. At any time after granting recognition as a Minority Educational Institution, the Authority may, after giving a reasonable opportunity of being heard το institution, cancel such status if it finds (1) violation of any of the conditions enumerated in the Act/these Rules ; /or (2) misutilisation of funds received through fees , donations , grants through any other source of funding . or

मेरे नाबालिग पुत्र के आधार कार्ड नं 0 4637 2589 3289 में त्रुटिवश उसका घरेलु नाम रामकृष्ण चामोली (Ramkrishan Chamoli) गलत दर्ज हो गया है । जबकि मेरे पुत्र का वास्तविक नाम अमन चमोली (Aman Chamoli ) है । जो पुत्र के जन्म प्रमाण -पत्र पंजी सं० B- 2020: 5-90028-001381 व स्थाई निवास प्रमाण- पत्र पंजी सं ० UK25ES0100535588 में भी दर्ज है । भविष्य में मेरे पुत्र को अमन चमोली (Aman Chamoli) पुत्र श्री गजेन्द्र प्रसाद के नाम से जाना पहचाना व पुकारा जाए ।

समस्त विधिक औपचारिकताएँ मेरे द्वारा पूर्ण कर ली गई हैं ।
