उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या-1 सन् 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन् 1910) की धारा 24क के अधीन शक्तियों का प्रयोग करके और अधिसूचना संख्या 50784/दस लाईसेंस-210/सषस्त्र सीमा बल/2018-19, दिनांक 23 मार्च, 2018 का अधिक्रमण करके आबकारी आयुक्त, राज्य सरकार की पूर्व स्वीकृति से सैनिक कैन्टीन स्टोर डिपार्टमेन्ट तथा संघ के कतिपय सशस्त्र बलों को लाइसेंस जारी किये जाने की दृष्टि से एतदद्वारा अधिसूचित करते है किः-
(1) सैनिक/अर्द्धसैनिक बल यथा भारत-तिब्बत सीमा पुलिस बल को कैंटीन प्रणाली के अधीन विदेशी शराब की फुटकर बिक्री के लिए ठेका देने के सम्बन्ध में कलेक्टर द्वारा कैंटीन किरायेदार को लाइसेंस दिया जा सकता है और जारी किया जा सकता है किन्तु जब कभी ऐसा लाइसेन्स जारी किया जाये, आबकारी आयुक्त को इसकी सूचना दी जानी चाहिए। इस लाइसेंस के अधीन बिक्री केवल कैंटीन में या इस प्रयोजन के लिए सैनिक/अर्द्धसैनिक बल यथा भारत-तिब्बत सीमा पुलिस बल के प्राधिकारियों द्वारा नियत स्थान पर और केवल उन्हीं व्यक्तियों को दी जायेगी, जो2 उत्तर प्रदेश असाधारण गजट, 25 फरवरी, 2021 ई0 उस रेजीमेन्ट/यूनिट, जिसके लिए लाइसेंस दिया गया हो, से सम्बद्व हों या जो ऐसी कैंंटीन का उपयोग करने के लिए आर्मी/अर्द्धसैनिक बल यथा भारत-तिब्बत सीमा पुलिस बल के विनियम के अधीन सम्यक् रुप से प्राधिकृत हों। (2) उक्त लाइसेंस प्रपत्र एफ0एल0-9 में होगा और प्रत्येक बिक्री स्थल के लिए एक पृथक् लाइसेन्स अपेक्षित होगा। इस बात से कोई अन्तर नहीं पड़ेगा कि बिक्री स्थल एक ही ठेकेदार के हैं या अलग-अलग ठेकेदारों के हैं और यह कि वे एक ही सैनिक/अर्द्ध सैनिक यथा भारत-तिब्बत सीमा पुलिस बल के यूनिट से सम्बद्व है या अलग-अलग। कैन्टीन लाइसेंस के लिए लाइसेंस शुल्क, विगत तीन माह की औसत बिक्री के आधार पर माहवार अग्रिम रुप से उदग्रहणीय होगा। वर्ष 2020-21 हेतु एफएल-9/9ए के लाइसेंसों पर विदेषी मदिरा के लिए रू0 30.00 (तीस रूपये) प्रति बोतल 750 एम0एल0 और बीयर के लिए रू0 7.00 (सात रूपये) प्रति बोतल 650 एम0एल0 की दर से लाइसेंस शुल्क संदेय होगा। विषेष माह के अनुमानित एवं वास्तविक लाइसेंस शुल्क में अन्तर की धनराशि यदि कोई हो, जो विशेष माह में होती है, लाइसेंसधारी द्वारा अनुवर्ती माह के एक सप्ताह के भीतर जमा करनी होगी। यदि संदत्त न की जाय तो इसकी वसूली जिला आबकारी अधिकारी द्वारा प्रतिभूति से की जायेगी तथा प्रतिभूति की कमी की पुनः पूर्ति लाइसेेंसधारी द्वारा की जायेगी।
(3) (क) रियायती शुल्क की रम की प्रतिरक्षा कर्मियों को फुटकर बिक्री करने के लिए कलेक्टर द्वारा ''यूनिटकैंटीन'' को प्रपत्र एफ0एल0-9ए में सैनिक यूनिट कैंटीन लाइसेंस दिया जा सकता है और जारी किया जा सकता है, किन्तु जब कभी ऐसा लाइसेंस जारी किया जाय, आबकारी आयुक्त को उसकी सूचना दी जानी चााहिये। यह लाइसेन्स यूनिट के कमाडिंग आफिसर के अनुरोध पर समुचित जांच और संवीक्षा करने के पश्चात् दिया जायेगा। उक्त लाइसेन्स के अधीन बिक्री केवल यूनिट रम कैंटीन में या सैनिक प्राधिकारियों द्वारा विशेष रुप से चिन्हांकित स्थल पर और केवल उन्हीं व्यक्तियों को दी जायेगी, जो उस इकाई या रेजीमेन्ट से, जिसके लिए लाइसेंस दिया गया हो, सम्बद्व हों, अथवा आर्मी विनियमन के अधीन कैन्टीन से क्रय करने के लिए सम्यक् रुप से प्राधिकृत हो। प्रत्येक विक्रय स्थल के लिए प्रपत्र एफ0एल0-9ए में एक पृथक लाइसेन्स अपेक्षित होगा।
(ख) एफ0एल0-9ए में कैंटीन लाइसेन्स कलेक्टर द्वारा सम्बन्धित अर्द्वसैनिक बलों यथा भारत-तिब्बत सीमा पुलिस बल की कैन्टीनों/यूनिटों को भी दिया जा सकता है और जारी किया जा सकता है, किन्तु जब कभी ऐसा लाइसेन्स जारी किया जाये, आबकारी आयुक्त को उसकी सूचना दी जानी चाहिये। यह लाइसेन्स सम्बन्धित अर्द्वसैनिक बलों यथा भारत-तिब्बत सीमा पुलिस बल के उप महानिरीक्षक/समादेष्टा के अनुरोध पर जांच और संवीक्षा करने के पश्चात् दिया जायेगा। इस लाइसेंस के अधीन बिक्री केवल "रमकैन्टीन" में या सम्बधित अर्द्धसैनिक बल यथा भारत- तिब्बत सीमा पुलिस बल द्वारा विशेष रुप से चिन्हांकित स्थान पर केवल ऐसे व्यक्तियों को की जायेगी, जो इकाई से, जिसके लिए लाइसेन्स दिया जाये, सम्बद्व हों।
(ग) कैन्टीन लाइसेंस के लिए लाइसेंस शुल्क विगत तीन माह की औसत बिक्री के आधार पर माहवार अग्रिम रुप से उदग्रहणीय होगा। वर्ष 2020-21 हेतु एफ0एल0-9/9ए के लाइसेंसों पर विदेषी मदिरा के लिए रू0 30.00 (तीस रूपये) प्रति बेातल 750 एम0एल0 और बीयर के लिए रू0 7.00 (सात रूपये) प्रति बोतल 650 एम0एल0 की दर से लाइसेंस शुल्क संदेय होगा। विषेष माह के अनुमानित एवं वास्तविक लाइसेंस शुल्क में अन्तर की धनराशि, यदि कोई हो, जो विशेष माह में होती है, लाइसेंसधारी द्वारा अनुवर्ती माह के एक सप्ताह के भीतर जमा करनी होगी। यदि सन्दत्त न की जाय, तो इसकी वसूली जिला आबकारी अधिकारी द्वारा प्रतिभूति से की जायेगी, तथा प्रतिभूति की कमी की पुनः पूर्ति लाइसेंसधारी से की जायेगी। कैन्टीन के लाइसेन्सधारी के लिए लाइसेन्स लेना आवश्यक नहीं है, यदि सेना/अर्द्धसैनिक बल यथा भारत-तिब्बत सीमा पुलिस बल युद्धाभ्यास कर रही है या मार्च कर रही है या अस्थाई स्थानों पर जब उसे नागरिक प्रशासन की सहायता के लिए बुलाया जाये, परन्तु यह कि इन स्थानों पर बिक्री को मुख्य लाइसेंन्सधारी के स्थान पर रखे गये लेखाओं में सम्मिलित कर लिया जाय।

NOTIFICATION
In exercise of the powers under section-24-A of the United Provinces Excise Act, 1910 (U.P. Act no. 4 of 1910) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), and in supersession of notification no. 50784/X-Licence-210/ Sasastra Seema Bal/2018-19 dated March 23, 2018, the Excise Commissioner with the previous sanction of the State Government, with a view to issuing of licences to Army Canteen Stores Department and certain Armed Forces of Union, hereby notifies that :
(1) License to canteen tenant license may be granted and issued by the Collector in connection with the grant of contract for the retail vend of foreign liquor under the Military /Para Military Force such as ITBP force for Canteen System but the Excise Commissioner should be informed whenever such a licence is issued. Sales under this licence can only be made at the canteen or place appointed for the purpose by the Military /Para Military Force such as ITBP force authorities and only to persons who are attached to the regiment /unit for which the licence is granted or who are duly authorised under Army /Para Military Force such as ITBP force Regulations to use such Canteen.
(2) The licence shall be in Form F.L.9 and a separate licence shall be required for each place of vend. It will make no difference whether the places of vend belong to the same or different contractors and whether they pertain to the same or different Military/ Para Military Force such as ITBP force units.
The licence fee for a canteen licence shall be levied monthly in advance on the basis of average sale of three preceding months. The licence fee shall be payable at the rate of Rs. 30.00 (Thirty Rupees) per bottle of 750ml. for Foreign Liquor and Rs 7.00 (Rupees Seven) per bottle of 650ml. for Beer on the licences of F.L.-9/9A for the year 2020-21. The difference in expected and actual licence fee of the month, if any occurs in particular month, shall be deposited by the licensee within a week of succeeding month. If not paid, it shall be realized from the security by the District Excise Officer, and shortfall in security shall be replenished by the licensee.
(3) (a) Military Units Canteen licence in Form F.L.9 A may be granted and issued by the Collector to the 'Unit Canteen' for the retail vend of concessional duty Rum to the defence personnel, but the Excise Commissioner should be informed whenever such a licence is issued. This licence is to be granted on the request of the Commanding Officer of the unit after proper enquiry and scrutiny. Sales under the licence shall only be made at the 'Unit Rum Canteen' or place specially earmarked by the Military Authorities and only to persons attached to the unit or regiment for which the licence is granted or who are duly authorised under the Army Regulation to make purchases from the Canteen. A separate licence in Form F.L.9-A will be required for each place of vend.
(b) Canteen licence in Form F.L.9-A may also be granted and issued by the Collector to the related Para Military Forces such as ITBP force Canteens/ Unit, but the Excise Commissioner should be informed whenever such licence is issued. This licence is to be granted on the request of the D.I.G./Commanding Officer of related Para Military Forces such as ITBP force after proper enquiry and scrutiny. Sales under this licence shall only be made at the 'Rum Canteen' or place specially earmarked by the D.I.G./Commanding Officer of related Para Military Forces such as ITBP force and only to person attached to the unit for which licence is granted.
4 उत्तर प्रदेश असाधारण गजट, 25 फरवरी, 2021 ई0(c) The licence fee for a canteen licence shall be levied monthly in advance on the basis of average sale of three preceding months. NOTE:- It is not necessary for canteen licensee to take out a licence in case Troops /Para Military Forces such as ITBP force on manoeuvers the line of march, or at temporary stations when called out in aid of civil power, provided the sales at these places are incorporated in the accounts kept at the place of main licensee.
