उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन्‌ 1910) की धारा 24 और 41 के अधीन शक्तियों का प्रयोग करके, राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त, उत्तर प्रदेश, आबकारी आयुक्त की समय-समय पर यथासंशोधित अधिसूचना संख्या 27091/दस-लाइसेंस-59/2002-2003 दिनांक 14 मार्च, 2002 द्वारा प्रकाशित उत्तर प्रदेश आबकारी (देशी शराब की फुटकर बिक्री के अनुज्ञापनों का व्यवस्थापन) नियमावली, 2002 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं :

उत्तर प्रदेश आबकारी (देशी शराब की फुटकर बिक्री के लिये अनुज्ञापनों

का व्यवस्थापन) (तेरहवाँ संशोधन) नियमावली, 2020

1-संक्षिप्त नाम और प्रारम्भ-(1) यह नियमावली उत्तर प्रदेश आबकारी (देशी शराब की फुटकर बिक्री के लिये अनुज्ञापनों का व्यवस्थापन) (तेरहवाँ संशोधन) नियमावली, 2020 कही जायेगी।

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 2-नियम-2 का संशोधन-उत्तर प्रदेश आबकारी (देशी शराब की फुटकर बिक्री के लिये अनुज्ञापनों का व्यवस्थापन) नियमावली, 2002, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ :

स्तम्भ-1 विद्यमान नियम 2-परिभाषाएं जब तक विषय या संदर्भ में कोई बात प्रतिकूल न हो इस नियमावली में-

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम 2-परिभाषाएं जब तक विषय या संदर्भ में कोई बात प्रतिकूल न हो इस नियमावली में-

(क) ''अधिनियम'' का तात्पर्य समय-समय पर यथा संशोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है। (ख) ''वार्षिक न्यूनतम प्रत्याभूत मात्रा'' का तात्पर्य आबकारी आयुक्त द्वारा निर्गत सामान्य या विनिर्दिष्ट अनुदेशों के अनुसरण में लाइसेंस प्राधिकारी द्वारा यथा नियत और लाइसेेंसधारी द्वारा फुटकर बिक्री के प्रयोजनार्थ आबकारी वर्ष में अपनी फुटकर दुकान के लिए उसके द्वारा उठाई जाने वाली प्रत्याभूत तीव्र देशी शराब (36 प्रतिशत वी/वी के रुप में) की मात्रा से है। तथापि, यदि आबकारी वर्ष के प्रारम्भ के पश्चात्‌ कोई लाइसेंस दिया जाता है, तो आबकारी वर्ष में शेष दिनों की संख्या के अनुसार अनुपातिक रूप से उनकी न्यूनतम वार्षिक प्रत्याभूत मात्रा को घटा दिया जायेगा।

(क) ''अधिनियम'' का तात्पर्य समय-समय पर यथा संशोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है। (ख) ''वार्षिक न्यूनतम प्रत्याभूत मात्रा'' का तात्पर्य आबकारी आयुक्त द्वारा जारी सामान्य या विनिर्दिष्ट अनुदेशों के अनुसरण में लाइसेंस प्राधिकारी द्वारा यथा नियत और लाइसेेंसधारी द्वारा फुटकर बिक्री के प्रयोजनार्थ आबकारी वर्ष में अपनी फुटकर दुकान के लिए उसके द्वारा उठाई जाने वाली प्रत्याभूत तीव्र देशी शराब (36 प्रतिशत वी/वी के रुप में) की मात्रा से है। तथापि, यदि आबकारी वर्ष के प्रारम्भ के पश्चात्‌ कोई लाइसेंस दिया जाता है, तो आबकारी वर्ष में शेष दिनों की संख्या के अनुसार अनुपातिक रूप से उनकी न्यूनतम वार्षिक प्रत्याभूत मात्रा को घटा दिया जायेगा।

(ग) ''बेसिक लाइसेंस फीस'' का तात्पर्य अधिनियम की धारा-24 के अधीन देशी शराब की फुटकर बिक्री के एकान्तिक विशेषाधिकार हेतु सम्पूर्ण आबकारी वर्ष या उसके भाग के लिए लाइसेंस प्रदान किए जाने के निमित्त प्रतिफलन के उस भाग से है, जो लाइसेंसधारी के रूप में चयनित व्यक्ति द्वारा, उसको लाइसेंस प्रदान किए जाने के पूर्व, ऐसी दरों पर, जैसा कि समय-समय पर राज्य सरकार के परामर्श से आबकारी आयुक्त द्वारा अधिसूचित की जाय, भुगतान किया जाय।

(ग) ''बेसिक लाइसेंस फीस'' का तात्पर्य अधिनियम की धारा 24 के अधीन देशी शराब की फुटकर बिक्री के एकान्तिक विशेषाधिकार हेतु सम्पूर्ण आबकारी वर्ष या उसके भाग के लिए लाइसेंस प्रदान किए जाने के निमित्त प्रतिफल के उस भाग से है, जो लाइसेंसधारी के रूप में चयनित व्यक्ति द्वारा, उसको लाइसेंस प्रदान किए जाने के पूर्व, ऐसी दरों पर, जैसा कि समय-समय पर राज्य सरकार के परामर्श से आबकारी आयुक्त द्वारा अधिसूचित की जाय, भुगतान किया जाय।

परन्तु यदि व्यवस्थापन मध्य सत्र में होता है, तो बेसिक लाइसेंस फीस अवशेष अवधि के एम0जी0क्यू0 के समानुपातिक होगी।

(घ) ''देशी शराब'' में एक्सट्रा न्यूट्रल एल्कोहल (ई0एन0ए0) से निर्मित ऐसी अल्कोहलीय सांद्रता वाली ''तनु या तीव्र'' देशी स्प्रिट भी सम्मिलित है, जैसा कि समय-समय पर राज्य सरकार की पूर्व अनुमति से आबकारी आयुक्त द्वारा नियत की जाय।

(ङ) ''दैनिक बेसिक लाइसेंस फीस'' का तात्पर्य प्रतिफल शुल्क के उस भाग से है, जो कि अन्तरिम लाइसेंस के प्राप्तकर्ता द्वारा ऐसी दर से देय होगी जैसा कि राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त द्वारा अधिसूचित की जाय।

(च) ''दैनिक न्यूनतम प्रत्याभूत मात्रा'' वार्षिक (च) ''दैनिक न्यूनतम प्रत्याभूत मात्रा'' वार्षिक न्यूनतम प्रत्याभूत मात्रा का 1/365 वॉं भाग होगी। न्यूनतम प्रत्याभूत मात्रा का 1/365 वॉं भाग होगी। (छ) ''आबकारी वर्ष'' का तात्पर्य 1 अप्रैल से प्रारम्भ होकर आगामी कलेन्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है।

(छ) ''आबकारी वर्ष'' का तात्पर्य 1 अप्रैल से प्रारम्भ होकर आगामी कलेन्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 3 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

(ज) ''परिवार'' का तात्पर्य दम्पत्ति (पति या पत्नी), आश्रित पुत्रों, अविवाहित पुत्रियों और आश्रित माता-पिता से है और वे इसमें शामिल हैं।

(झ) ''प्रपत्र'' का तात्पर्य इस नियमावली के साथ (झ) ''प्रपत्र'' का तात्पर्य इस नियमावली के साथ संलग्न प्रपत्र से है।

संलग्न प्रपत्र से है।

(ञ)''लाइसेंस प्राधिकारी'' का तात्पर्य जिले के (ञ)''लाइसेंस प्राधिकारी'' का तात्पर्य जिले के कलेक्टर से है।

कलेक्टर से है।

(ट) ''लाइसेंस फीस'' का तात्पर्य बेसिक लाइसेंस फीस के अतिरिक्त, आबकारी अधिनियम की धारा-24 के अधीन देशी शराब की फुटकर बिक्री के एकान्तिक विशेषाधिकार के लिए लाइसेंस प्रदान किए जाने के लिए प्रतिफल के शेष भाग से है, जो लाइसेंसधारी द्वारा देय होगी। यह धनराशि दुकान के लिए नियत वार्षिक न्यूनतम प्रत्याभूत मात्रा पर उदग्रहणीय प्रतिफल फीस के बराबर होगी।

परन्तु यदि व्यवस्थापन मध्य सत्र में होता है, तो यह अवशेष अवधि की न्यूनतम प्रत्याभूत मात्रा में निहित प्रतिफल फीस के बराबर होगी।

(ठ) ''लाइसेंस फीस की मासिक किस्त'' बेसिक लाइसेंस फीस के अतिरिक्त होगी जो लाइसेंस प्राधिकारी द्वारा निर्धारित मासिक न्यूनतम प्रत्याभूत मात्रा में निहित प्रतिफल फीस के बराबर होगी और प्रत्येक माह देय होगी। तथापि लाइसेंसधारी द्वारा एक माह में उठाई गई देशी शराब की मात्रा में निहित प्रतिफल फीस का समायोजन नियमावली के उपबन्धों के अधीन रहते हुए लाइसेंस फीस की मासिक किस्त के प्रति किया जा सकता है।

(ड) ''मासिक न्यूनतम प्रत्याभूत मात्रा''-वार्षिक न्यूनतम प्रत्याभूत मात्रा को बारह समान भागों में विभाजित किया जायेगा। इस प्रकार की गणना में प्राप्त मात्रा मासिक न्यूनतम प्रत्याभूत मात्रा होगी।

(ढ) ''प्रतिभूति धनराशि''का तात्पर्य बेसिक लाइसेंस फीस के अतिरिक्त लाइसेंस फीस के 1/10वॉ भाग के बराबर धनराशि से है, जो जिला आबकारी अधिकारी के पक्ष में गिरवीकृत राष्ट्रीयबचत पत्र /सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी और जो राज्य सरकार के समस्त दावों और देयों के अन्तरिम व्यवस्थापन के बाद वापसी योग्य होगी

(ढ) '' प्रतिभूति धनराशि'' का तात्पर्य बेसिक लाइसेंस फीस के अतिरिक्त लाइसेंस फीस के 1/10वॉ भाग के बराबर धनराशि से है, जो जिला आबकारी अधिकारी के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी और जो राज्य सरकार के समस्त दावों और देयों के अन्तरिम व्यवस्थापन के बाद वापसी योग्य होगी परन्तु नवीकरण की स्थिति में, पूर्व में नगद जमा की गयी प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जाय।

परन्तु नवीकरण की स्थिति में, पूर्व में नगद या राष्ट्रीय बचत पत्र (एन0एस0 सी0) के माध्यम से जमा की गयी प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जाय।

(ण) ''प्रतिफल शुल्क'' का तात्पर्य आबकारी अधिनियम की धारा-30 के अधीन राज्य सरकार द्वारा देशी शराब की तीब्रता के अनुसार प्रति लीटर की दर से निर्धारित फीस से है, जो देशी शराब की आपूर्ति से पूर्व लाइसेंसधारी द्वारा सरकारी कोषागार में जमा की जायेगी।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

(त) "अतिरिक्त प्रतिफल शुल्क" का तात्पर्य देशी शराब के आप्टिमम रिटेल प्राइस को पॉंच रुपये के अगले गुणक तक पूर्णाकिंत किये जाने के फलस्वरुप प्राप्त अन्तर की धनराशि से है, जो आसवनी स्तर पर देय होगी तथा आसवनी द्वारा थोक आपूर्तिकर्ता से एक्स डिस्टिलरी प्राइस के अतिरिक्त वसूलनीय होगी एवं जो थोक आपूर्तिकर्ता द्वारा फुटकर लाइसेंसधारी से अधिकतम थोक मूल्य के अतिरिक्त वसूल की जा सकेगी, किन्तु अतिरिक्त प्रतिफल शुल्क की यह धनराशि, फुटकर लाइसेंसधारी द्वारा संदेय लाइसेंस फीस के सापेक्ष समायोजित नहीं की जायेगी।

(थ) 'धरोहर धनराशि' का तात्पर्य लाइसेंस की स्वीकृति के लिये पात्रता की शर्तों की पूर्ति सुनिश्चित किये जाने के लिये आवेदन पत्र के साथ जमा की जाने वाली बेसिक लाइसेंस फीस की धनराशि के 1/10 भाग के बराबर धनराशि से है, जो व्यतिक्रम की दशा में इस नियमावली के नियम-12 के उपबन्धों के अधीन जब्त किये जाने योग्य होगी।

(द) 'अनुक्रम' का तात्पर्य ई/लाटरी प्रक्रिया के माध्यम से लाइसेंसधारी के चयन के लिये कथित आधार दुकानों की धरोहर धनराशि के अवरोही क्रम से है।

(द) 'अनुक्रम' का तात्पर्य ई/लाटरी प्रक्रिया के माध्यम से लाइसेंसधारी के चयन के लिये कथित आधार दुकानों की धरोहर धनराशि के अवरोही क्रम से है। (ध)''पोर्टल'' का तात्पर्य विनिर्दिष्ट रूप से निर्मित इलेक्ट्रानिक प्लेटफार्म, जिस पर मदिरा निर्माण की प्रक्रिया से सम्बन्धित इसके वितरण के समाप्य अवस्था तक की सूचनाओं को विहित प्रारूप में अपलोड किये जाने के प्रयोजन से है।

(ध)''पोर्टल'' का तात्पर्य विनिर्दिष्ट रूप से निर्मित इलेक्ट्रानिक प्लेटफार्म, जिस पर मदिरा निर्माण की प्रक्रिया से सम्बन्धित इसके वितरण के समाप्य अवस्था तक की सूचनाओं को विहित प्रारूप में अपलोड किये जाने के प्रयोजन से है।

(न) ''ऋणशोधन क्षमता'' का तात्पर्य फुटकर लाइसेंस की स्वीकृति के लिये आवेदन करने हेतु आवेदक के लिये निर्धारित वित्तीय अर्हता के मानदण्ड से है।

(प) ''व्यक्ति '' का तात्पर्य ऐसे व्यक्ति से है जो आवेदन करने के समय इक्कीस वर्श की आयु से अन्यून, भारत का नागरिक होय

(प) ''व्यक्ति '' का तात्पर्य ऐसे व्यक्ति से है जो आवेदन करने के समय इक्कीस वर्ष की आयु से अन्यून, भारत का नागरिक हो।

(फ) ''व्यवस्थापन'' का तात्पर्य नवीकरण, ई-लाटरी अथवा ई-टेण्डर के माध्यम से दुकानों के व्यवस्थापन अथवा पुर्नव्यवस्थापन से है, जो समाचार पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के लिये दुकानों का व्यवस्थापन विगत वित्तीय वर्ष की समाप्ति के पूर्व किया जा सकता है।

(2) इस नियमावली में अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम में क्रमशः उनके लिए समनुदेशित हों।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 5 3-नियम-3 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-3 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम नियम-3 फुटकर बिक्री के लिए अनुज्ञापनों का व्यवस्थापन-

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम नियम-3 फुटकर बिक्री के लिए लाइसेंसों का व्यवस्थापन-

(क) इस नियमावली के उपबन्धों और बेसिक लाइसेंस फीस और प्रतिभूति धनराशि के भुगतान के अधीन रहते हुए, देशी शराब की बिक्री के लिए फुटकर दुकान का इसमें यथाविनिर्दिष्ट निर्धारित फीस प्रणाली द्वारा अथवा ऑफर आमंत्रित कर व्यवस्थापन या पुनव्र्यवस्थापन किया जायेगा । (ख) भू-गृहादि के अन्दर और उसके बाहर दोनों ही प्रकार से उपभोग के लिए मुहरबन्द बोतलों और आबकारी आयुक्त द्वारा समय-समय पर यथा अनुमोदित ऐसे पात्र्रों में देशी शराब की फुटकर बिक्री के लिये अनुज्ञापन प्रपत्र दे0श0-5ग में प्रदान किया जायेगा ।

(ख) भू-गृहादि के अन्दर और उसके बाहर दोनों ही प्रकार से उपभोग के लिए मुहरबन्द बोतलों और आबकारी आयुक्त द्वारा समय-समय पर यथा अनुमोदित ऐसे पात्र्रों में देशी शराब की फुटकर बिक्री के लिये लाइसेंस प्रपत्र दे0श0-5ग में प्रदान किया जायेगा ।

(ग) ठोस अपशिष्ट प्रबन्धन नियम 2016 के अनुसार (ग) ठोस अपशिष्ट प्रबन्धन नियम 2016 के अनुसार दुकानों पर उपभोग किये जाने के बाद खाली हुई पेट/शीशे की बोतलों एवं उन पर प्रयुक्त ढक्कनों को नष्ट करके हटाने की जिम्मेदारी दुकान के विक्रेता/ आसवक की होगी।

दुकानों पर उपभोग किये जाने के बाद खाली हुई पेट/शीशे की बोतलों/टेट्रापैक्स एवं उन पर प्रयुक्त ढक्कनों को नष्ट करके हटाने की जिम्मेदारी दुकान के विक्रेता/ आसवक की होगी। 4-नियम-6 का संशोधन-उक्त नियमावली मे,ं नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-6 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

एतद्‌द्वारा प्रतिस्थापित नियम

6-लाइसेंस की स्वीकृति-इस नियमावली के उपबन्धों के अनुसार बेसिक लाइसेंस फीस को अधिमानतः ई-पेमेन्ट प्लेटफार्म के माध्यम से भुगतान करने एवं जिला आबकारी अधिकारी के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट द्वारा जमा करने पर लाइसेंस निर्गत किया जायेगा।

6-लाइसेंस की स्वीकृति-इस नियमावली के उपबन्धों के अनुसार बेसिक लाइसेंस फीस को अधिमानतः ई-पेमेन्ट प्लेटफार्म के माध्यम से भुगतान करने एवं जिला आबकारी अधिकारी के पक्ष में गिरवीकृत राष्ट्रीयबचत पत्र /सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट द्वारा जमा करने पर लाइसेंस निर्गत किया जायेगा।

परन्तु नवीकरण की स्थिति में पूर्व में नगद जमा की गयी प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जाय।

परन्तु नवीकरण की स्थिति में पूर्व में नगद या राष्ट्रीय बचत पत्र (एन0एस0सी0) के माध्यम से जमा की गयी प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जाय।

लाइसेंसधारी से यह अपेक्षा की जायेगी कि वह उस जिले में ऋण शोधन क्षमता प्रमाण पत्र की मूलप्रति प्रस्तुत करे, जहॉं से उसे लाइसेंस स्वीकृति के समय जारी किया गया हो।

लाइसेंसधारी से यह अपेक्षा की जायेगी कि वह उस जिले में ऋण शोधन क्षमता प्रमाण पत्र या प्राधिकृत आयकर मूल्यांकक द्वारा जारी स्वामित्व सम्पत्ति प्रमाण पत्र की मूलप्रति प्रस्तुत करे, जहॉं से उसे लाइसेंस स्वीकृति के समय जारी किया गया हो।6 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 5-नियम-8 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-8 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌्‌-

8-आवेदकों के लिये पात्रता की शर्ते-

फुटकर देशी शराब की दुकान के लाइसेंस के लिए पात्र आवेदक को निम्नलिखित शर्तें अवश्य पूरी करनी होगी- अर्थात्‌-

फुटकर देशी शराब की दुकान के लाइसेंस के लिए पात्र आवेदक को निम्नलिखित शर्तें अवश्य पूरी करनी होगी अर्थात्‌ः-

(क) आवेदन एक व्यक्ति द्वारा हो जो भारत का नागरिक हो, परन्तु नवीकरण की स्थिति में सह-आवेदक, यदि कोई हो, जो भारत का नागरिक हो, भी मान्य होगा।

भागीदार वाली फर्म अथवा कम्पनी फुटकर लाइसेंस स्वीकृति हेतु पात्र नहीं होंगी। इसी प्रकार थोक विक्रेता या आसवनी/मदिरा विनिर्माता भी किसी प्रकार की फुटकर दुकान का लाइसेंस धारण करने हेतु पात्र नहीं होगा।

दुकान के आवंटन के पश्चात्‌ आवेदक की प्रास्थिति में कोई परिवर्तन अनुमन्य न होगा, लाइसेंसधारी की मृत्यु की दशा में उसका विधिक वारिस, यदि अन्यथा पात्र हो, लाइसेंस की शेष अवधि के लिए लाइसेंसधारक बना रह सकता है।

परन्तु यह और कि यदि संयुक्त रूप से दो व्यक्तियों द्वारा लाइसेंस प्राप्त किया गया हो, तो किसी एक व्यक्ति की मृत्यु की स्थिति में जीवित व्यक्ति मृतक के विधिक वारिस (वारिसो) के साथ, यदि अन्यथा पात्र हों, लाइसेंसधारी बना रहेगा या दोनो व्यक्तियों की मृत्यु की दशा में उसके विधिक वारिस (वारिसो), यदि अन्यथा पात्र हो, लाइसेंसधारक बने रह सकते हैं। दोनों व्यक्तियों के विधिक उत्तरदायित्वों में कोई भेद नहीं किया जायेगा और दोनो सम्मिलित रूप से अलग-अलग उत्तरदायी होेंगेय

(ख) आवेदन पत्र प्राप्त किये जाने के लिये नियत अवधि के प्रथम दिवस पर इक्कीस वर्ष की आयु से अधिक हो।

(ग) व्यतिक्र्रमी/काली सूची में सम्मिलित अथवा अधिनियम के अन्तर्गत बनाई गई किसी नियमावली के उपबन्धों के अन्तर्गत आबकारी लाइसेंस धारण करने से विवर्जित न किया गया हो। कोई व्यक्ति जिसे किसी न्यायालय द्वारा किसी आबकारी अपराध के लिए दोषसिद्ध किया गया हो, लाइसेंस धारण करने से स्वतः विवर्जित हो जायेगा जब तक कि उसे पूर्णतः और अन्तिम रूप से दोषमुक्त न कर दिया गया हो।

(गग) आवेदनकर्ता किसी एक दुकान के लिये स्वयं के नाम से मात्र एक आवेदन पत्र प्रस्तुत किये जाने के लिये पात्र होगा। परन्तु नवीकरण की स्थिति में आवेदक एवं सह-आवेदक दोनोें आवेदन हेतु पात्र होगें तथा नवीकरण हेतु दोनों की सहमति आवश्यक होगी।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (गग) आवेदनकर्ता किसी एक दुकान के लिये स्वयं के नाम से मात्र एक आवेदन पत्र प्रस्तुत किये जाने के लिये पात्र होगा। परन्तु नवीकरण की स्थिति में आवेदक एवं सह-आवेदक दोनोें आवेदन हेतु पात्र होगें तथा नवीकरण हेतु दोनों की सहमति आवश्यक होगी। (घ) निम्नलिखित की पुष्टि में पब्लिक नोटरी द्वारा सम्यक रूप से अभिप्रमाणित शपथपत्र प्रस्तुत करेगा, अर्थात्‌-

(घ) निम्नलिखित की पुष्टि में पब्लिक नोटरी द्वारा सम्यक रूप से अभिप्रमाणित शपथपत्र प्रस्तुत करेगा, अर्थात्‌-

(एक) यह कि समय-समय पर यथा संशोधित उत्तर प्रदेश आबकारी दुकानों की संख्या एवं स्थिति नियमावली, 1968 के उपबन्धों के अनुकूल उस स्थान पर दुकान खोलने हेतु उपयुक्त परिसर रखता है अथवा किराए पर उस स्थान पर उपयुक्त परिसर का प्रबन्ध कर सकता है।

(दो) यह कि दुकान के उसके प्रस्तावित परिसर के निर्माण में किसी विधि अथवा नियमों का उल्लंघन नहीं किया गया है।

(तीन) यह कि उसका एवं उसके परिवार के सदस्यों का नैतिक चरित्र अच्छा है और उनकी कोई अपराधिक पृष्ठभूमि नहीं है और संयुक्त प्रान्त आबकारी अधिनियम, 1910 या स्वापक औषधि एवं मनःप्रभावी अधिनियम 1985 के अधीन दण्डनीय किसी अपराध या किसी अन्य संज्ञेय एवं गैर जमानती अपराध के लिए दोष सिद्व न किया गया हो।

(चार) यह कि लाइसेंसधारी के रूप में चयनित हो जाने की दशा में जिला, जहांॅ का वह निवासी है, के वरिष्ठ पुलिस अधीक्षक/पुलिस अधीक्षक द्वारा जारी इस आशय का प्रमाण-पत्र लाइसेंस जारी होने के पूर्व प्रस्तुत करेगा कि उसका एवं उसके परिवार के सदस्यों का चरित्र अच्छा है एवं उनकी कोई अपराधिक पृष्ठभूमि या आपराधिक इतिहास नहीं है।

(पॉंच) यह कि व किसी ऐसे व्यक्ति को बिक्रीकर्ता या प्रतिनिधि के रूप में नियोजित नहीं करेगा, जिसकी कोई आपराधिक पृष्ठभूमि होगी, जैसा कि खण्ड-तीन में उल्लिखित है या जो किसी संक्रामक रोग से ग्रसित हो या इक्कीस वर्ष से कम आयु का हो या महिला हो। लाइसेंसधारी को जिला आबकारी अधिकारी से अपने प्राधिकृत बिक्रेता/ प्रतिनिधि का फोटोयुक्त पहचान पत्र प्राप्त करना होगा।

(पॉंच) यह कि वह किसी ऐसे व्यक्ति को बिक्रीकर्ता या प्रतिनिधि के रूप में नियोजित नहीं करेगा, जिसकी कोई आपराधिक पृष्ठभूमि होगी, जैसा कि खण्ड-तीन में उल्लिखित है या जो किसी संक्रामक रोग से ग्रसित हो या इक्कीस वर्ष से कम आयु का हो या महिला हो। लाइसेंसधारी को जिला आबकारी अधिकारी से अपने प्राधिकृत बिक्रेता/ प्रतिनिधि का फोटोयुक्त पहचान पत्र प्राप्त करना होगा।

(छः) यह कि उस पर कोई लोक या राजकीय (छः) यह कि उस पर कोई लोक या राजकीय देयता का बकाया नहीं है।

देयता का बकाया नहीं है।

(सात) यह कि वह ऋणशोधक्षम है और आवश्यक निधि रखता है या उसके कारोबार के संव्यवहार के लिए आवश्यक निधि का प्रबन्ध कर लिया है, जिसका ब्यौरा, यदि अपेक्षित होगा, तो लाइसेंस प्राधिकारी को उपलब्ध करा देगा।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

(आठ) यह कि वह सक्रिय रुप से माफिया गतिविधियों, असामाजिक कार्यो एवं संगठित अपराधिक गतिविधियों में लिप्त नहीं है। यदि लाइसेंस प्राप्त हो जाने के उपरान्त भी यह प्रमाणित हो जाता है कि वह सक्रिय रुप से माफिया गतिविधियों, असामाजिक कार्यो एवं संगठित अपराधिक गतिविधियों में लिप्त है तो उसे प्रदान किया गया अनुज्ञापन निरस्त कर दिया जाये। (नौ) यह कि आवेदक बार काउंसिल में रजिस्ट्रीकृत अधिवक्ता नहीं है। यदि लाइसेंस प्राप्त कर लेने पर उसे बार काउंसिल में रजिस्ट्रीकृत अधिवक्ता पाया जाता है तो लाइसेंस निरस्त कर दिया जाय। राज्य सरकार का कर्मचारी, लाइसेंस स्वीकृति हेतु आवेदन करने के लिये अनर्ह होगा।

(नौ) यह कि आवेदक बार काउंसिल में रजिस्ट्रीकृत अधिवक्ता नहीं है। यदि लाइसेंस प्राप्त कर लेने पर उसे बार काउंसिल में रजिस्ट्रीकृत अधिवक्ता पाया जाता है तो लाइसेंस निरस्त कर दिया जाय। राज्य सरकार का कर्मचारी, लाइसेंस स्वीकृति हेतु आवेदन करने के लिये अनर्ह होगा।

(दस) यह कि लाइसेंसधारी के रुप में चयन हो जाने की स्थिति में चयन के 48 घंटे के भीतर बैंक ड्रॉफ्‌ट, जिसे आन-लाइन आवेदन के साथ अपलोड किया गया है, को जिला आबकारी अधिकारी के कार्यालय में जमा करा देगा।

(दस) यह कि लाइसेंसधारी के रुप में चयन हो जाने की स्थिति में चयन के 48 घंटे के भीतर बैंक ड्रॉफ्‌ट, जिसे आन- लाइन आवेदन के साथ अपलोड किया गया है, को जिला आबकारी अधिकारी के कार्यालय में जमा करा देगा।

(ग्यारह) यह कि उसने धरोहर धनराषि के बैंक ड्राफ्‌ट का प्रयोग, इस चरण में किसी अन्य दुकान हेतु आवेदन में नही किया है।

(ङ) राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त द्वारा यथा निर्धारित धरोहर धनराशि का बैंक ड्रॉफ्‌ट, जो सम्बन्धित दुकान के जिला आबकारी अधिकारी के पक्ष में जारी हो, की स्कैन प्रति, आनलाइन आवेदन के साथ अपलोड किया जायेगा।

लाइसेंसधारी के रूप में चयन हो जाने की दशा में धरोहर धनराशि के बैंक ड्राफ्‌ट चयन के पश्चात्‌ 48 घंटे के अन्दर सम्बन्धित जिला आबकारी अधिकारी के कार्यालय में जमा करना अनिवार्य होगा। धरोहर धनराशि बेसिक लाइसेंस फीस के सापेक्ष समायोजित कर ली जायेगी।

लाइसेंसधारी के रूप में चयन हो जाने की दशा में धरोहर धनराशि का बैंक ड्राफ्‌ट चयन के पश्चात्‌ अड़तालीस घंटे के अन्दर सम्बन्धित जिला आबकारी अधिकारी के कार्यालय में जमा करना अनिवार्य होगा, जिसे दुकान की सभी देयताओं के भुगतान के पश्चात आवेदक को वापस कर दिया जायेगा।

(झ) आवेदक ऋणशोधनक्षमता प्रमाण पत्र या प्राधिकृत आयकर मूल्यांकक द्वारा निर्गत सम्पत्ति का स्वामित्व प्रमाण-पत्र का धारक हो तथा उसकी ऋणशोधनक्षमता या प्राधिकृत आयकर मूल्यांकक द्वारा निर्गत सम्पत्ति का स्वामित्व प्रमाण-पत्र की मालियत जिला में आवेदित दुकान का लाइसेंस प्रदान करने के लिये अवधारित बेसिक लाइसेंस फीस व लाइसेंस फीस के योग के 1/6 भाग के समतुल्य धनराशि से कम नहीं होगी।

परन्तु नवीकरण हेतु गत वर्ष के व्यवस्थापन के दौरान प्रस्तुत किये गये ऋणशोधन क्षमता प्रमाण पत्र मान्य होगा तथा नये और अधिक मूल्य के ऋणशोधनक्षमता प्रमाण पत्र की आवश्यकता नहीं होगी।

परन्तु नवीकरण की स्थिति में गत वर्ष के व्यवस्थापन के दौरान प्रस्तुत किये गये ऋणशोधन क्षमता प्रमाण पत्र अथवा प्राधिकृत आयकर मूल्यांकक द्वारा जारी सम्पत्ति स्वामित्व प्रमाण पत्र, यदि वैध एवं अपेक्षित धनराशि के लिए है, प्रतिग्राह्‌य होंगे।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 9 6-नियम-10 का संशोधन-उक्त नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम 10 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌- स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

10. लाइसेंसधारी का चयन- (क) (प) राज्य सरकार द्वारा विनिर्दिष्ट प्रतिबन्धों एवं शर्ताें के अधीन दुकान के लाइसेंस का ऑनलाइन नवीकरण किया जा सकेगा।

10-लाइसेंसधारी का चयन (क) (प) राज्य सरकार द्वारा विनिर्दिष्ट प्रतिबन्धों एवं शर्ताें के अधीन दुकान के लाइसेंस का ऑनलाइन नवीकरण किया जा सकेगा।

(पप) नवीकरण न होने की स्थिति में लाइसेंसधारियों का चयन, आनलाइन आवेदन आमंत्रित कर राज्य सरकार द्वारा यथा विनिर्दिष्ट ई-लाटरी अथवा ई-टेण्डर की प्रक्रिया के माध्यम से दुकानवार किया जायेगा। जिला आबकारी अधिकारी, आनलाइन प्राप्त आवेदनों की संवीक्षा करेगा और पत्र एवं अपात्र आवेदनाें की सूची, अपात्रता के कारणों को उल्लिखित करते हुए तैयार करेगा और इस सूची को ई-लाटरी एवं ई-टेण्डर हेतु गठित जिला स्तरीय लाइसेंस समिति के समक्ष प्रस्तुत करेगा। (पप) नवीकरण न होने की स्थिति में लाइसेंसधारियों का चयन, आनलाइन आवेदन आमंत्रित कर राज्य सरकार द्वारा यथा विनिर्दिष्ट ई-लाटरी अथवा ई-टेण्डर की प्रक्रिया के माध्यम से दुकानवार किया जायेगा। जिला आबकारी अधिकारी, आनलाइन प्राप्त आवेदनों की संवीक्षा करेगा और पत्र एवं अपात्र आवेदनाें की सूची, अपात्रता के कारणों को उल्लिखित करते हुए तैयार करेगा और इस सूची को ई-लाटरी एवं ई-टेण्डर हेतु गठित जिला स्तरीय लाइसेंस समिति के समक्ष प्रस्तुत करेगा।

(ख) उक्त समिति आवंटन हेतु अर्ह एवं अनर्ह आवेदकों को चिन्हित करेगी। ई-लॉटरी की स्थिति में अर्ह आवेदकों में से प्रत्येक दुकान के लिये लाइसेंसधारी का चयन कम्प्यूटर चलित यादृच्छिक विन्यास के माध्यम से किया जायेगा। यादृच्छिकीकरण प्रक्रिया सम्बन्धित नियम के अधीन विहित अनुक्रम के अनुसार देशी मदिरा, माडल शाप, विदेशी मदिरा तथा बीयर की फुटकर दुकानों के क्रम में अपनायी जायेगी। ई-टेण्डर के माध्यम से लाइसेंसधारी के चयन की स्थिति में उसी पूर्वोक्त अनुक्रम का पालन किया जायेगा। किसी भी आवेदक के पक्ष सम्पूर्ण राज्य में सभी श्रेणी की देशी शराब, माडल शाप, विदेशी मदिरा, एवं बीयर की कुल मिलाकर दो से अधिक दुकानें आवंटित नहीं की जायेंगी।

(ख) उक्त समिति आवंटन हेतु अर्ह एवं अनर्ह आवेदकों को चिन्हित करेगी। ई-लॉटरी की स्थिति में अर्ह आवेदकों में से प्रत्येक दुकान के लिये लाइसेंसधारी का चयन कम्प्यूटर चलित यादृच्छिक विन्यास के माध्यम से किया जायेगा। यादृच्छिकीकरण प्रक्रिया सम्बन्धित नियम के अधीन विहित अनुक्रम के अनुसार देशी मदिरा, माडल शाप, विदेशी मदिरा तथा बीयर की फुटकर दुकानों के क्रम में अपनायी जायेगी। ई-टेण्डर के माध्यम से लाइसेंसधारी के चयन की स्थिति में उसी पूर्वोक्त अनुक्रम का पालन किया जायेगा। किसी भी आवेदक के पक्ष में एक जिला में सभी प्रकार की देशी शराब, माडल शाप, विदेशी मदिरा, एवं बीयर की कुल मिलाकर दो से अधिक दुकानें आवंटित नहीं की जायेंगी, जिसमें नवीकृत दुकानें भी सम्मिलित होंगी।

परन्तु यह कि उपर्युक्त निर्बंधन राज्य सरकार द्वारा निर्धारित मानदण्डों के अनुसार लाइसेंसों के नवीकरण के लिए लागू नही होगा। परन्तु यह और भी कि किसी आवेदक के पक्ष में सम्पूर्ण राज्य में दो या दो से अधिक दुकानों के नवीकरण होने की स्थिति में वह ई-लाटरी के माध्यम से अग्रतर दुकानों के चयन हेतु पात्र नहीं होगा। (ग) यदि चयनित आवेदक बेसिक लाइसेंस फीस या प्रतिभूति धनराशि जमा नहीं करेगा और विहित औपचारिकताएॅं पूरी नहीं करेगा या नियत अवधि में दुकान हेतु उपयुक्त परिसर की व्यवस्था करने में अक्षम रहेगा तो लाइसेंस प्राधिकारी आवंटन को निरस्त कर देगा और शासन द्वारा विहित प्रक्रिया के माध्यम से दुकान के पुर्नव्यवस्थापन हेतु आवश्यक कार्यवाही करेगा। (घ) यदि किसी विशिष्ट दुकान के लिए कोई आवेदन पत्र प्राप्त नहीं हो या किसी दुकान के लिए कोई अभ्यर्थी उपयुक्त नहीं पाया जाये तो लाइसेंस प्राधिकारी दुकान के पुर्नव्यवस्थापन हेतु शासन द्वारा विहित प्रक्रिया के माध्यम से तत्काल उपाय करेगा।

(ग) यदि चयनित आवेदक बेसिक लाइसेंस फीस या प्रतिभूति धनराशि जमा नहीं करेगा और विहित औपचारिकताएॅं पूरी नहीं करेगा या नियत अवधि में दुकान हेतु उपयुक्त परिसर की व्यवस्था करने में अक्षम रहेगा तो लाइसेंस प्राधिकारी आवंटन को निरस्त कर देगा और शासन द्वारा विहित प्रक्रिया के माध्यम से दुकान के पुर्नव्यवस्थापन हेतु आवश्यक कार्यवाही करेगा। (घ) यदि किसी विशिष्ट दुकान के लिए कोई आवेदन पत्र प्राप्त नहीं हो या किसी दुकान के लिए कोई अभ्यर्थी उपयुक्त नहीं पाया जाये तो लाइसेंस प्राधिकारी दुकान के पुर्नव्यवस्थापन हेतु शासन द्वारा विहित प्रक्रिया के माध्यम से तत्काल उपाय करेगा।10 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 7-नियम-12 का संशोधन-उक्त नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-12 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम 12- बेसिक लाइसेंस फीस और प्रतिभूति धनराशि का भुगतान- यदि किसी आवेदक को लाइसेंसधारी के रुप में चयनित किया जाता है तो अपने चयन की सूचना की प्राप्ति के 03 कार्य दिवसों के भीतर बेसिक लाइसेंस फीस की सम्पूर्ण धनराशि जमा करेगा। उससे यह अपेक्षा की जायेगी कि वह प्रतिभूति धनराशि का आधा भाग अपने चयनित होने की सूचना के 10 कार्यदिवसों के भीतर और अवशेष प्रतिभूति धनराशि अपने चयन होने की सूचना के 20 कार्य दिवसों के भीतर जमा कर दें। आवेदक द्वारा बेसिक लाइसेंस फीस का समस्त भुगतान अधिमानतः ई-पेमेन्ट के माध्यम से किया जायेगा। जिला आबकारी अधिकारी के पक्ष में गिरवीकृत प्रतिभूति धनराषि, राष्ट्रीय बचत-पत्र/सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी। परन्तु नवीकरण की स्थिति में पूर्व में नगद जमा की गयी प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जाय।

अनुवर्ती वर्ष में, दुकान का लाइसेंस लाइसेंसधारी की इच्छा पर राज्य सरकार द्वारा यथा निर्धारित उपभोग के मानदण्ड के अनुसार नवीकृत किया जा सकेगा। नवीनीकरण हेतु बेसिक लाइसेंस फीस एवं प्रतिभूति के अन्तर की धनराशि राज्य सरकार द्वारा निर्धारित समयावधि मेें जमा की जायेगी। यदि वह विहित अवधि में बेसिक लाइसेंस फीस और प्रतिभूति धनराशि जमा करने में विफल रहता है तो उसका चयन निरस्त हो जायेगा और उसकी धरोहर धनराशि तथा बेसिक लाइसेंस फीस और प्रतिभूति धनराशि जो उसके द्वारा जमा की गयी हो, राज्य सरकार के पक्ष में समपहृत कर ली जायेगी और उक्त दुकान को तत्काल राज्य सरकार द्वारा यथा विहित तरीके से पुर्नव्यवस्थापित कर दिया जायेगा ।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम 12- बेसिक लाइसेंस फीस एवं प्रतिभूति धनराशि का भुगतान- यदि किसी आवेदक को लाइसेंसधारी के रुप में चयनित किया जाता है तो अपने चयन की सूचना की प्राप्ति के 03 कार्य दिवसों के भीतर बेसिक लाइसेंस फीस की सम्पूर्ण धनराशि जमा करेगा। उससे यह अपेक्षा की जायेगी कि वह प्रतिभूति धनराशि का आधा भाग अपने चयनित होने की सूचना के 10 कार्यदिवसों के भीतर और अवशेष प्रतिभूति धनराशि अपने चयन होने की सूचना के 20 कार्य दिवसों के भीतर जमा कर दें। आवेदक द्वारा बेसिक लाइसेंस फीस का समस्त भुगतान अधिमानतः ई-पेमेन्ट के माध्यम से किया जायेगा। जिला आबकारी अधिकारी के पक्ष में गिरवीकृत प्रतिभूति धनराषि, सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी। परन्तु नवीकरण की स्थिति में पूर्व में नगद या राष्ट्रीय बचत पत्र (एन0एस0सी0) के माध्यम से जमा की गयी प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जाय। अनुवर्ती वर्ष में, दुकान का लाइसेंस लाइसेंसधारी की इच्छा पर राज्य सरकार द्वारा यथा निर्धारित उपभोग के मानदण्ड के अनुसार नवीकृत किया जा सकेगा। नवीनीकरण हेतु बेसिक लाइसेंस फीस एवं प्रतिभूति के अन्तर की धनराशि राज्य सरकार द्वारा निर्धारित समयावधि मेें जमा की जायेगी। यदि वह विहित अवधि में बेसिक लाइसेंस फीस और प्रतिभूति धनराशि जमा करने में विफल रहता है तो उसका चयन निरस्त हो जायेगा और उसकी धरोहर धनराशि तथा बेसिक लाइसेंस फीस और प्रतिभूति धनराशि जो उसके द्वारा जमा की गयी हो, राज्य सरकार के पक्ष में समपहृत कर ली जायेगी और उक्त दुकान को तत्काल राज्य सरकार द्वारा यथा विहित तरीके से पुर्नव्यवस्थापित कर दिया जायेगा ।

8-नियम-14 का संशोधन-उक्त नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-14 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

विफलता के परिणाम-

(क) लाइसेंसधारी को माह की अन्तिम तिथि तक लाइसेंस फीस की मासिक किस्त जमा करनी होगी, परन्तु उसके द्वारा सम्बन्धित माह के दौरान उठायी गयी देशी शराब की मात्रा/संख्या में निहित प्रतिफल शुल्क को, इस नियमावली के उपबन्धों के अधीन लाइसेंस फीस की मासिक किस्त में समायोजित किया जायेगा ।

(क) लाइसेंसधारी को माह की अन्तिम तिथि तक लाइसेंस फीस की मासिक किस्त जमा करनी होगी, तथापि उसके द्वारा सम्बन्धित माह के दौरान उठायी गयी देशी शराब की मात्रा/संख्या में निहित प्रतिफल शुल्क को, इस नियमावली के उपबन्धों के अधीन लाइसेंस फीस की मासिक किस्त में समायोजित किया जायेगा ।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 11 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

परन्तु लाइसेंसधारी द्वारा मासिक एम0जी0क्यू0 का पूर्ण रुप से उठान न किये जाने की स्थिति में लाइसेंस को, न उठाये गये एम0जी0क्यू0 की मात्रा में सन्निहित प्रतिफल शुल्क व इसमें सन्निहित 36 प्रतिशत वी0/वी0 तीव्रता की देशी मदिरा के 200 एम0एल0 की बोतलों की संख्या पर देय अतिरिक्त प्रतिफल शुल्क जमा करना आवश्यक होगा। (ख) लाइसेंसधारी से अपेक्षा की जायेगी कि वह अगले माह कि पहली तारीख के सायं 5 बजे तक स्वयं पर देय लाइसेंस फीस की गणना व सत्यापन हेतु अपने द्वारा उठायी गयी देशी शराब व जमा की गयी लाइसेंस फीस का विवरण देते हुये अपना लेखा और लाइसेंस फीस पासबुक जिला आबकारी अधिकारी को प्रस्तुत कर दें ।

परन्तु लाइसेंसधारी द्वारा मासिक एम0जी0क्यू0 का पूर्ण रुप से उठान न किये जाने की स्थिति में लाइसेंस को, न उठाये गये एम0जी0क्यू0 की मात्रा में सन्निहित प्रतिफल शुल्क व इसमें सन्निहित 36 प्रतिशत वी0/वी0 तीव्रता की देशी मदिरा के 200 एम0एल0 की बोतलों की संख्या पर देय अतिरिक्त प्रतिफल शुल्क जमा करना आवष्यक होगा। (ख) लाइसेंसधारी से अपेक्षा की जायेगी कि वह अगले माह कि पहली तारीख के सायं 5 बजे तक स्वयं पर देय लाइसेंस फीस की गणना व सत्यापन हेतु अपने द्वारा उठायी गयी देशी शराब व जमा की गयी लाइसेंस फीस का विवरण देते हुये अपना लेखा और लाइसेंस फीस पासबुक जिला आबकारी अधिकारी को प्रस्तुत कर दे।

(ग) लाइसेंसधारी द्वारा उठायी गयी देशी शराब में निहित प्रतिफल शुल्क के सम्यक समायोजन के पश्चात्‌ लाइसेंस फीस में कोई कमीं होने की स्थिति में जिला आबकारी अधिकारी लाइसेंस फीस की परादेय अवशेष धनराशि को लाइसेंसधारी द्वारा जमा प्रतिभूति धनराशि में से समायोजित कर लेगा एवं प्रतिभूति धनराशि में आयी कमीं को नकद जमा कराने हेतु लाइसेंस प्राधिकारी द्वारा लाइसेंसधारी को नोटिस देनें के पश्चात्‌ उसे सुनवाई का समुचित अवसर प्रदान करते हुये कार्यवाही सुनिश्चित की जायेगी । इस कार्यवाही की अधिकतम समय सीमा माह के प्रारम्भ से दस कार्य दिवस होगी । अपेक्षित प्रतिभूति धनराशि की पुनः पूर्ति न करने की दशा में नियत अवधि व्यतीत हो जाने पर प्रश्नगत लाइसेंस, लाइसेंस प्राधिकारी द्वारा निरस्त कर दिया जायेगा ।

(ग) लाइसेंसधारी द्वारा उठायी गयी देशी शराब में निहित प्रतिफल शुल्क के सम्यक समायोजन के पश्चात्‌ लाइसेंस फीस में कोई कमी होने की स्थिति में अथवा यदि वह लाइसेंस फीस की कमी की पूर्ति करने में विफल रहता है, तब जिला आबकारी अधिकारी लाइसेंस फीस की अवशेष अधिशेष धनराशि को लाइसेंसधारी द्वारा जमा प्रतिभूति धनराशि में से समायोजित कर लेगा एवं प्रतिभूति धनराशि में आयी कमी को नकद जमा कराने हेतु लाइसेंस प्राधिकारी द्वारा लाइसेंसधारी को नोटिस देने के पश्चात्‌ उसे सुनवाई का समुचित अवसर प्रदान करते हुये कार्यवाही सुनिश्चित की जायेगी । इस कार्यवाही की अधिकतम समय सीमा माह के प्रारम्भ से दस कार्य दिवस होगी। अपेक्षित प्रतिभूति धनराशि की पुनः पूर्ति न करने की दशा में नियत अवधि व्यतीत हो जाने पर प्रश्नगत लाइसेंस, लाइसेंस प्राधिकारी द्वारा निरस्त कर दिया जायेगा ।

मासान्त के पश्चात्‌ आगामी माह में देशी शराब की मात्रा उठाकर प्रतिभूति धनराशि की कमीं में पूर्ति अनुमन्य नहीं होगी ।

9-नियम-20 का संशोधन-उक्त नियमावली में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-20 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

20- दुकानों का अन्तरिम व्यवस्थापन (क) इन नियमों के उपबन्धों के अनुसार किसी लाइसेंस के निलम्बन, निरस्तीकरण या अभ्यर्पण के मामले में लाइसेंस प्राधिकारी सरकार की पूर्व स्वीकृति से आबकारी आयुक्त द्वारा यथा अधिसूचित ऐसी दरों पर दैनिक बेसिक लाइसेंस फीस और समानुपातिक लाइसेंस12 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 स्तम्भ-1 विद्यमान नियम फीस (दैनिक न्यूनतम प्रत्याभूत मात्रा में निहित प्रतिफल फीस एवं अतिरिक्त प्रतिफल फीस) जो कि एक बार में न्यूनतम चौदह दिनों कि अवधि या नियमित व्यवस्थापन के दिनांक, इसमें से जो भी पहले हो, के लिए होगी, के भुगतान पर दुकान का अन्तरिम व्यवस्थापन सर्वोच्च आफर पर कर सकता है। एक दुकान के लिये दो या दो से अधिक समान आफर प्राप्त होने के मामले में सार्वजनिक मैनुअल लाटरी के माध्यम से व्यवस्थापन कराया जायेगा। ऐसे लाइसेंसधारी को प्रतिदिन की प्रत्याभूति मात्रा में निहित प्रतिफल फीस की धनराशि की दर से अन्तरिम व्यवस्थापन की अवधि के लिए प्रतिभूति धनराशि जमा करना होगा।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम फीस (दैनिक न्यूनतम प्रत्याभूत मात्रा में निहित प्रतिफल फीस एवं अतिरिक्त प्रतिफल फीस) जो कि एक बार में न्यूनतम चौदह दिनों कि अवधि या नियमित व्यवस्थापन के दिनांक, इसमें से जो भी पहले हो, के लिए होगी, के भुगतान पर दुकान का अन्तरिम व्यवस्थापन सर्वोच्च आफर पर कर सकता है। एक दुकान के लिये दो या दो से अधिक समान आफर प्राप्त होने के मामले में सार्वजनिक मैनुअल लाटरी के माध्यम से व्यवस्थापन कराया जायेगा। ऐसे लाइसेंसधारी को प्रतिदिन की प्रत्याभूति मात्रा में निहित प्रतिफल फीस की धनराशि की दर से अन्तरिम व्यवस्थापन की अवधि के लिए प्रतिभूति धनराशि जमा करना होगा।

परन्तु लाइसेंस प्राधिकारी द्वारा किसी दुकान का ऐसा व्यवस्थापन आबकारी आयुक्त की पूर्वानुमति के सिवाय दो बार से अधिक नहीं किया जायेगा।

परन्तु लाइसेंस प्राधिकारी द्वारा किसी दुकान का ऐसा व्यवस्थापन आबकारी आयुक्त को पूर्व में सूचित किये बिना दो बार से अधिक नहीं किया जायेगा। (ख) निकाल दिया गया।

(ख) निकाल दिया गया।

(ग) इन नियमों के उपबन्धों के अनुसार किसी लाइसेंस के निरस्तीकरण या अभ्यर्पण के मामले में दुकान का मध्य-सत्र में नियमित व्यवस्थापन लाइसेंेस प्राधिकारी द्वारा शीघ्रातिशीघ्र सार्वजनिक विज्ञापन देकर ई-टेण्डर प्रणाली के माध्यम से कराया जायेगा। उक्त व्यवस्थापन की सूचना आयुक्त कार्यालय को तत्काल प्रेशित किया जाना होगा।

(ग) इस नियमावली के उपबन्धों के अनुसार किसी लाइसेंस के निरस्तीकरण या अभ्यर्पण के मामले में दुकान का मध्य-सत्र में नियमित व्यवस्थापन, लाइसेंेस प्राधिकारी द्वारा शीघ्रातिशीघ्र सार्वजनिक विज्ञापन देकर ई-टेण्डर प्रणाली के माध्यम से कराया जायेगा। पूर्वोक्त व्यवस्थापन की सूचना आयुक्त कार्यालय को तत्काल पे्रेषित किया जाना होगा।

10- नियम-21 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-21 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

(1) लाइसेंस प्राधिकारी लाइसेंस को निलम्बित या निरस्त कर सकता है-

(क) यदि लाइसेंस प्राप्त परिसर में देशी शराब की कोई बोतल पाया जाय है, जिस पर शुल्क का भुगतान नहीं किया गया हो और जिस पर आबकारी आयुक्त द्वारा सम्यक रूप से अनुमोदित शुल्क के भुगतान के प्रमाण के रूप में आबकारी विभाग द्वारा सम्यक रुप से अनुमोदित सुरक्षा कोड चस्पा नहीं किया गया हो।

(क) यदि लाइसेंस प्राप्त परिसर में देशी शराब की कोई बोतल/टेट्रा पैक या पात्र पाया जाय, जिस पर शुल्क का भुगतान नहीं किया गया हो और जिस पर आबकारी आयुक्त द्वारा सम्यक रूप से अनुमोदित शुल्क के भुगतान के प्रमाण के रूप में आबकारी विभाग द्वारा सम्यक रुप से अनुमोदित सुरक्षा कोड चस्पा नहीं किया गया हो। (ख) यदि लाइसेंस प्राप्त परिसर में किसी अन्य प्रकार की शराब या मादक औषधि की बोतल या पात्र (जिसके लिये लाइसेंस स्वीकृत नहीं किया गया है) की बोतल या पात्र जाये जाते है।

(ख) यदि लाइसेंस प्राप्त परिसर में किसी अन्य प्रकार की शराब या मादक ओषधि की बोतल या पात्र (जिसके लिये लाइसेंस स्वीकृत नहीं किया गया है) की बोतल या पात्र जाये जाते है।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 13 स्तम्भ-1 विद्यमान नियम (ग) अधिनियम व नियमोें के उपबन्धों के विरुद्ध लाइसेंसधारी कब्जे में यदि कोई मदिरा या मादक औषधि पायी जाता है।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (ग) अधिनियम व नियमोें के उपबन्धों के विरुद्ध लाइसेंसधारी के कब्जे में यदि कोई मदिरा या मादक औषधि पायी जाती है।

(घ) यदि लाइसेंसधारी द्वारा आवेदन के समय प्रस्तुत शपथ पत्र त्रुटिपूर्ण पाया जाता है और उसमें किया गया कथन असत्य पाया जाता है।

(घ) यदि लाइसेंसधारी द्वारा आवेदन के समय प्रस्तुत शपथ पत्र त्रुटिपूर्ण पाया जाता है और उसमें किया गया कथन असत्य पाया जाता है। (ड़) यदि यह पाया जाता है कि लाइसेंसधारी फर्जी नाम से प्राप्त किया गया है या लाइसेंसधारी किसी अन्य व्यक्ति के नाम में लाइसेंस धारण किये हुये है।

(ड़) यदि यह पाया जाता है कि लाइसेंसधारी फर्जी नाम से प्राप्त किया गया है या लाइसेंसधारी किसी अन्य व्यक्ति के नाम में लाइसेंस धारण किये हुये है।

(च) यदि लाइसेंसधारी लाइसेंस फीस की मासिक किस्त या प्रतिभूति धनराशि में कमी की पूर्ति विहित अवधि में जमा करने में विफल रहता है।

(च) यदि लाइसेंसधारी लाइसेंस फीस की मासिक किस्त या प्रतिभूति धनराशि में कमी की पूर्ति विहित अवधि में जमा करने में विफल रहता है। (छ) यदि लाइसेंसधारी अधिनियम में या किसी संज्ञेय और गैर जमानती अपराध में या स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम, 1985 या भारतीय दण्ड संहिता की धारा 482 से 489 के अधीन अपराध में दोषसिद्ध किया जाता है।

(ज) यदि लाइसेंस प्राप्त परिसर में कैरामल, रंग, सुगंधि, होलोग्राम/ श्रिंक स्लीव अथवा बार कोड, लेबुल, कैप्सूल, मुहर अथवा अन्य अवैध सामग्री पायी जाती है।

(छ) यदि लाइसेंसधारी अधिनियम में या किसी संज्ञेय और गैर जमानती अपराध में या स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम, 1985 या भारतीय दण्ड संहिता की धारा 482 से 489 के अधीन अपराध में दोषसिद्ध किया जाता है। (ज) यदि लाइसेंस प्राप्त परिसर में कैरामल, रंग, सुगंधि, होलोग्राम/श्रिंक स्लीव अथवा बार कोड, लेबुल, कैप्सूल, मुहर अथवा अन्य अवैध सामग्री पायी जाती है।

(झ) यदि लाइसेंस प्राप्त परिसर में मदिरा का जलापमिश्रण/ या अन्य पदार्थ का मिश्रण/तनुकरण पाया जाता है/उच्च श्रेणी की मदिरा से निम्न श्रेणी की मदिरा का अपमिश्रण पाया जाता है तो विधि के अन्य सुसंगत उपबन्धों के अधीन कार्यवाही भी की जायेगी।

(झ) यदि लाइसेंस प्राप्त परिसर में मदिरा का जलापमिश्रण/या अन्य पदार्थ का मिश्रण/ तनुकरण पाया जाता है/उच्च श्रेणी की मदिरा से निम्न श्रेणी की मदिरा का अपमिश्रण पाया जाता है तो विधि के अन्य सुसंगत उपबन्धों के अधीन कार्यवाही भी की जायेगी।

(2) लाइसेंस प्राधिकारी तत्काल लाइसेंस को निलम्बित कर देगा और लाइसेंस के निरस्तीकरण और प्रतिभूति के समपहरण के लिए कारण बताओ नोटिस जारी करेगा। लाइसेंसधारी नोटिस की प्राप्ति के 7 दिनों के भीतर अपना स्पष्टीकरण प्रस्तुत करेगा। तत्पश्चात्‌ लाइसेंस प्राधिकारी लाइसेंसधारी को सुने जाने का युक्ति-युक्त अवसर प्रदान करने के पश्चात्‌ उपायुक्त आदेश पारित करेगा।

परन्तु यह कि उपरोक्त नियम- 21(1)के उप प्रस्तर च में यथाउल्लिखित सुसंगत विशयों से संबंधित लाइसेंस का निलम्बन और निरस्तीकरण की प्रक्रिया, नियम-14 के अनुसार निश्पादित की जायेगी। (3) लाइसेंस निरस्त किये जाने की दशा में उसके द्वारा जमा की गई बेसिक लाइसेंस फीस, लाइसेंस फीस और प्रतिभूति धनराशि सरकार के पक्ष में समपहृत हो जायेगी और लाइसेंसधारी कोई प्रतिकर या वापसी के दावे का हकदार न होगा। ऐसे लाइसेंसधारी को काली सूची में भी डाला जा सकता है तथा उसे अन्य कोई आबकारी लाइसेंसधारण करने से विवर्जित किया जा सकता है।

(2) पूर्वोक्त स्थितियों में लाइसेंस प्राधिकारी तत्काल लाइसेंस को निलम्बित कर देगा और लाइसेंस के निरस्तीकरण और प्रतिभूति के समपहरण के लिए कारण बताओ नोटिस जारी करेगा। लाइसेंसधारी नोटिस की प्राप्ति के 7 दिनों के भीतर अपना स्पष्टीकरण प्रस्तुत करेगा। तत्पश्चात्‌ लाइसेंस प्राधिकारी लाइसेंसधारी को सुने जाने का युक्ति-युक्त अवसर प्रदान करने के पश्चात्‌ उपयुक्त आदेश पारित करेगा। परन्तु यह कि पूर्वोक्त नियम-21(1) के उप प्रस्तर (च) में यथाउल्लिखित सुसंगत विषयों से संबंधित लाइसेंस का निलम्बन और निरस्तीकरण की प्रक्रिया, नियम-14 के अनुसार निष्पादित की जायेगी। (3) लाइसेंस निरस्त किये जाने की दशा में उसके द्वारा जमा की गई बेसिक लाइसेंस फीस, लाइसेंस फीस और प्रतिभूति धनराशि सरकार के पक्ष में समपहृत हो जायेगी और लाइसेंसधारी कोई प्रतिकर या वापसी के दावे का हकदार न होगा। ऐसे लाइसेंसधारी को काली सूची में भी डाला जा सकता है तथा उसे अन्य कोई आबकारी लाइसेंसधारण करने से विवर्जित किया जा सकता है।14 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 स्तम्भ-1

से 31 मार्च 20...... तक के लिए जिसके लिए नियम-6 के लिए दिनांक ...........................से 31 मार्च 20...... तक और नियम-12 के अनुसार बेसिक लाइसेंस फीस और के लिए जिसके लिए नियम-6 और नियम-12 के प्रतिभूति धनराशि जमा कर दी गई है, एत्‌दद्वारा निर्गत अनुसार बेसिक लाइसेंस फीस और प्रतिभूति धनराशि किया जाता है।

जमा कर दी गई है, एत्‌दद्वारा निर्गत किया जाता है। यह लाइसेंस निम्नलिखित निबन्धन व शर्तों के अधीन रहते हुए प्रदान किया जाता है, इसमें से किसी का व्यतिक्रम करने अथवा उ0प्र0 आबकारी (देशी शराब के फुटकर अनुज्ञापनों का व्यवस्थापन) नियमावली, 2002 (यथासंशोधित) के नियम-21 में वर्णित उपबंधों का उल्लंघन करने पर अथवा उत्तर प्रदेश आबकारी अधिनियम, 1910 अथवा स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 की विधियों के अन्तर्गत किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक का लाइसेंस निरस्त हो जायेगा और सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त प्रतिभूति निक्षेप समपहृत कर ली जायेगी।

यह लाइसेंस निम्नलिखित निबन्धन व शर्तों के अध्यधीन है, इसमें से किसी का व्यतिक्रम करने अथवा उत्तर प्रदेश आबकारी (देशी शराब के फुटकर अनुज्ञापनों का व्यवस्थापन) नियमावली, 2002 (यथासंशोधित) के नियम-21 यथा में वर्णित उपबंधों का उल्लंघन करने पर अथवा उत्तर प्रदेश आबकारी अधिनियम, 1910 अथवा स्वापक ओषधि एवंं मनः प्रभावी पदार्थ अधिनियम 1985 के अधीन किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक का लाइसेंस निरस्त हो जायेगा और सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त प्रतिभूति निक्षेप समपहृत कर ली जायेगी।18 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 स्तम्भ-1

निबन्धन एवं शर्ते

1-नियम-13 के उपबन्धों के अनुसार लाइसेंसधारी मूल्य एवं प्रतिफल शुल्क अधिमानतः ई-पेमेन्ट के द्वारा जमा करने के पश्चात्‌ देशी शराब का उठान थोक अनुज्ञापन सी0एल0-2 के गोदाम से करेगा।

1-नियम-13 के उपबन्धों के अनुसार लाइसेंसधारी मूल्य एवं प्रतिफल शुल्क अधिमानतः ई-पेमेन्ट के द्वारा जमा करने के पश्चात्‌ देशी शराब का उठान थोक अनुज्ञापन सी0एल0-2 के गोदाम से करेगा। 2-नियम-14 के उपबन्धों के अनुसार लाइसेंसधारी को लाइसेंस फीस की मासिक किस्त माह की अन्तिम तिथि तक जमा करनी होगी।

2-नियम-14 के उपबन्धों के अनुसार लाइसेंसधारी को लाइसेंस फीस की मासिक किस्त माह की अन्तिम तिथि तक जमा करनी होगी।

3-देशी शराब की बोतलों में पात्रों की लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी छपे हुए अधिकतम्‌ फुटकर मूल्य से अधिक नहीं वसूल करेगा।

3-देशी शराब की पेट/शीशे की बोतलों/टेट्रा पैक्स की लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी छपे हुए अधिकतम्‌ फुटकर मूल्य से अधिक नहीं वसूल करेगा। 4-भूगृहादि पर और उसके बाहर उपभोग के लिए मुहरबन्द बोतलों और पात्रों में देशी स्प्रिट की बिक्री उसी गद्‌दी से होगी। परिसर के एक अंश को अलग रखा जायेगा, जहॉं केवल उपभोग के लिए अनुमति होगी। परिसर में उपभोग के लिए भी खुली देशी स्प्रिट नहीं परोसी जायेगी तथा ठोस अपशिष्ट प्रबन्धन नियम 2016 के अनुसार दुकानों पर उपभोग किये जाने के बाद खाली हुई पेट/शीशे की बोतलों एवं उन पर प्रयुक्त ढक्कनों को नष्ट करके हटाने की जिम्मेदारी दुकान के विक्रेता/लाइसेंस/ आसवक की होगी ।

4-भूगृहादि पर और उसके बाहर उपभोग के लिए मुहरबन्द पेट/शीशे की बोतलों/टेट्रा पैक्स में देशी स्प्रिट की बिक्री उसी गद्‌दी से होगी। परिसर के एक अंश को अलग रखा जायेगा, जहॉं केवल उपभोग के लिए अनुमति होगी। परिसर में उपभोग के लिए भी खुली देशी स्प्रिट नहीं परोसी जायेगी तथा ठोस अपशिष्ट प्रबन्धन नियम 2016 के अनुसार दुकानों पर उपभोग किये जाने के बाद खाली हुई पेट/शीशे की बोतलों तथा टेट्रा पैक्स एवं उन पर प्रयुक्त ढक्कनों को नष्ट करके हटाने की जिम्मेदारी दुकान के विक्रेता/लाइसेंस/ आसवक की होगी ।

5-विहित तीब्रता और मात्रा की देशी शराब की बिक्री 200 एम0एल0 की मुहरबन्द पेट/शीशे की बोतलों में की जायेगी, जिस पर शुल्क के भुगतान के प्रमाण के रूप में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा हो।

5-विहित तीब्रता और मात्रा की देशी शराब की बिक्री 200 एम0एल0 की मुहरबन्द पेट/शीशे की बोतलों एवं टेट्रा पैक्स में की जायेगी, जिस पर शुल्क के भुगतान के प्रमाण के रूप में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा हो।

6-लाइसेंसधारी लाइसेंस प्राधिकारी द्वारा यथा विहित प्रपत्र और रजिस्टर में नियमित और सही-सही दैनिक लेखा रखेगा, और उसे उत्तर प्रदेश आबकारी के पोर्टल पर भी एस.एम.एस. करेगा/अपलोड करेगा और जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मांगा जायेगा, तो उक्त लेखा रजिस्टर को प्रस्तुत करेगा। लाइसेंसधारी बिक्री इत्यादि का लेखा भी प्रस्तुत करेगा और यथा अपेक्षित सामग्री और दस्तावेजों की सुविधा देगा और उन्हें उपलब्ध करायेगा।

7-देशी शराब की बिक्री को छोड़कर जिसके लिए कि लाइसेंस दिया गया है, लाइसेंसधारी को लाइसेंस प्राप्त परिसर में कोई अन्य व्यवसाय चलाने की अनुमति नहीं दी जायेगी।

8-लाइसेंस प्राप्त परिसर, 14 अप्रैल (आंबेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनो जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला र हेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की बन्दी का आदेश दे सकता है। उपरोक्त दिवसों पर से दुकान की बन्दी के लिए कोई प्रतिफल देय नहीं होगा। 9-लाइसेंसधारी देशी शराब के सम्पूर्ण स्टाक का भण्डारण केवल लाइसेंस प्राप्त परिसर में ही करेगा। वह ट्रैक एण्ड ट्रेस प्रणाली के अन्तर्गत विहित सुरक्षा कोड के अनुसार बोतलों की स्कैनिंग के लिये दुकान पर यथाविनिर्दिष्ट पी0ओ0एस0 (प्वाइंट ऑफ सेल) यंत्र रखेगा।

9-लाइसेंसधारी देशी शराब के सम्पूर्ण स्टाक का भण्डारण केवल लाइसेंस प्राप्त परिसर में ही करेगा। वह ट्रैक एण्ड ट्रेस प्रणाली के अन्तर्गत विहित सुरक्षा कोड के अनुसार बोतलों की स्कैनिंग के लिये दुकान पर यथाविनिर्दिष्ट पी0ओ0एस0 (प्वाइंट ऑफ सेल) यंत्र रखेगा।

10-लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित किये गये प्रपत्र साइज में एक सहज दृश्य साइनबोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, पदनाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बंद होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में अंकित की जायेंगी। साईन बोर्ड में निम्नलिखित सूचना को प्रदर्शित करना होगा-

''दुकान के बाहर आस-पास या सार्वजनिक स्थान पर शराब पीना वर्जित है। इस संबंध में कोई भी उल्लंघन दण्डनीय होगा।

11-लाइसेंसधारी लाइसेंस प्राप्त परिसर के भीतर पर्याप्त संख्या में बेंचों, तख्तों, कुर्सियों और मेजों सहित समुचित रूप से बैठने की व्यवस्था कर सकता है। लाइसेंसधारी द्वारा उपभोक्ता को गिलास, पानी, बर्फ, सोडा, स्नैक्स व विभिन्न खाद्य पदार्थो को पका कर उपलब्ध करा सकेगा।

12-लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप 12-लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम या किसी संक्रामक रोग से ग्रस्त हो या आपराधिक, आयु का हो या किसी संक्रामक रोग से ग्रस्त हो या पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी को जिला आपराधिक, पृष्ठभूमि का हो या महिला हो। आबकारी अधिकारी द्वारा सम्यक्‌ रूप से निर्गत बिक्रेता का लाइसेंसधारी को जिला आबकारी अधिकारी द्वारा फोटोयुक्त पहचान पत्र प्राप्त करना होगा और जब सम्यक्‌ रूप से निर्गत बिक्रेता का फोटोयुक्त पहचान निरीक्षणकर्ता प्राधिकारियों द्वारा मांगा जाये तो, उसे प्रस्तुत पत्र प्राप्त करना होगा और जब निरीक्षणकर्ता करना होगा।

17-लाइसेंसधारी या उसके विक्रेता के लिए दुकान की 17-लाइसेंसधारी या उसके विक्रेता के लिए गद्‌दी पर या उस स्थान से 5 फिट की दूरी पर जहॉं दुकान की गद्‌दी पर या उस स्थान से 5 फिट की विक्रय के लिए देशी शराब भण्डारित की गई है, पानी दूरी पर जहॉं विक्रय के लिए देशी शराब भण्डारित की का रखना सर्वथा निषिद्ध है।

18-लाइसेंसधारी परिसर की समुचित देख-रेख और सफाई के लिए उसकी नालियों आदि का कृमिनाशक पदार्थ से साफ किया जाना सम्मिलित है, उत्तरदायी होगा।

19-परिसर के भीतर प्रयुक्त सभी कुल्हड, पत्तलों आदि को कूडे़ के लिए निर्मित खाली स्थानों या इस प्रयोजनार्थ रखे गए ढक्कनदार कूड़ेदानों में तत्काल हटा कर डाल दिया जायेगा, जिसे कि विक्रय के निर्धारित घण्टों के दौरान कम से कम दो बार साफ किया जायेगा।

20-लाइसेंसधारी/ विक्रेता और उसके परिवार के सिवाय परिसर, जिसमें दुकान स्थित है, का प्रयोग आवास के स्थान के रूप में नहीं किया जायेगा।

आबकारी आयुक्त द्वारा यथा निर्धारित तीब्रता एवं धारिता की तीब्र एवं तनु देशी शराब की 200 एम0एल0 धारिता की पेट/शीशे की बोतलों अथवा टेट्रापैक्स में फुटकर बिक्री के लिए लाइसेंस, ऊपर लाइसेंस धारकों को जिला..........................के अन्तर्गत..................................... .... स्थान, पुलिस थाना....................... तहसील.................... .... के लिए दिनांक ...........................से 31 मार्च 20...... तक के लिए जिसके लिए नियम-6 और नियम-12 के अनुसार बेसिक लाइसेंस फीस और प्रतिभूति धनराशि जमा कर दी गई है, एत्‌दद्वारा निर्गत किया जाता है। यह लाइसेंस निम्नलिखित निबन्धन व शर्तों के अधीन रहते हुए प्रदान किया जाता है, इसमें से किसी का व्यतिक्रम करने अथवा उ0प्र0 आबकारी (देशी शराब के फुटकर अनुज्ञापनों का व्यवस्थापन) नियमावली, 2002 (यथासंशोधित) के नियम-21 में वर्णित उपबन्धों का उल्लंघन करने पर अथवा उत्तर प्रदेश आबकारी अधिनियम, 1910 अथवा स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 की विधियों के अन्तर्गत किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक का लाइसेंस निरस्त हो जायेगा और सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त प्रतिभूति निक्षेप समपहृत कर ली जायेगी।

यह लाइसेंस निम्नलिखित निबन्धन व शर्तों के अधीन रहते हुए प्रदान किया जाता है, इसमें से किसी का व्यतिक्रम करने अथवा उ0प्र0 आबकारी (देशी शराब के फुटकर अनुज्ञापनों का व्यवस्थापन) नियमावली, 2002 (यथासंशोधित) के नियम-21 में वर्णित उपबंधों का उल्लंघन करने पर अथवा उत्तर प्रदेश आबकारी अधिनियम, 1910 अथवा स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 की विधियों के अन्तर्गत किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक का लाइसेंस निरस्त हो जायेगा और सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त प्रतिभूति निक्षेप समपहृत कर ली जायेगी। निबन्धन एवं शर्ते

1-नियम-13 के उपबन्धों के अनुसार लाइसेंसधारी मूल्य एवं प्रतिफल शुल्क अधिमानतः ई-पेमेन्ट के द्वारा जमा करने के पश्चात्‌ देशी शराब का उठान थोक अनुज्ञापन के सी0एल0-2 गोदाम से करेगा।

2-नियम-14 के उपबन्धों के अनुसार लाइसेंसधारी को लाइसेंस फीस की मासिक किस्त माह की अन्तिम तिथि तक जमा करनी होगी।24 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 स्तम्भ-1

3-देशी शराब की बोतलों/टेट्रा पैक्स की लेबुलों पर अधिकतम्‌ फुटकर मूल्य मुद्रित किया जायेगा। फुटकर लाइसेंसधारी छपे हुए अधिकतम्‌ फुटकर मूल्य से अधिक नहीं वसूल करेगा।

4-भूगृहादि पर और उसके बाहर उपभोग के लिए मुहरबन्द बोतलों और पात्रों में देशी स्प्रिट की बिक्री उसी गद्‌दी से होगी। परिसर के एक अंश को अलग रखा जायेगा, जहॉं केवल उपभोग के लिए अनुमति होगी। परिसर में उपभोग के लिए भी खुली देशी स्प्रिट नहीं परोसी जायेगी तथा ठोस अपशिष्ट प्रबन्धन नियम 2016 के अनुसार दुकानों पर उपभोग किये जाने के बाद खाली हुई पेट/शीशे की बोतलों एवं उन पर प्रयुक्त ढक्कनों को नष्ट करके हटाने की जिम्मेदारी दुकान के बिक्रेता/ लाइसेंस / आसवक की होगी ।

7-देशी शराब की बिक्री को छोड़कर जिसके 7-देशी शराब की बिक्री को छोड़कर जिसके लिए कि लाइसेंस दिया गया है, लाइसेंसधारी को लाइससेंस प्राप्त परिसर में कोई अन्य व्यवसाय चलाने की अनुमति नहीं दी जायेगी।

8-लाइसेंस प्राप्त परिसर, 14 अप्रैल (अम्बेदकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनो जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की बन्दी का आदेश दे सकता है। उपरोक्त दिवसों पर से दुकान की बन्दी के लिए कोई प्रतिफल देय नहीं होगा।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम निबन्धन एवं शर्ते

10-लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित किये गये प्रपत्र साइज में एक सहज दृष्य साइनबोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, पदनाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बंद होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में अंकित की जायेंगी। साईन बोर्ड में निम्नलिखित सूचना को प्रदर्शित करना होगा-

है। कृपया शराब पीकर गाड़ी न चलायें।'' 11-लाइसेंसधारी लाइसेंस प्राप्त परिसर के भीतर पर्याप्त संख्या में बेंचों, तख्तों, कुर्सियों और मेजों सहित समुचित रूप से बैठने की व्यवस्था करेगा। लाइसेंसधारी द्वारा उपभोक्ता को गिलास, पानी, बर्फ, सोडा, स्नैक्स व विभिन्न खाद्य पदार्थो को पका कर उपलब्ध करा सकेगा।

12-लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या किसी संक्रामक रोग से ग्रस्त हो या आपराधिक, पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी को जिला आबकारी अधिकारी द्वारा सम्यक्‌ रूप से निर्गत बिक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करना होगा और जब निरीक्षणकर्ता प्राधिकारियों द्वारा मांगा जाये तो, उसे प्रस्तुत करना होगा।

13-लाइसेंसधारी किसी भी व्यक्ति को 1.5 लीटर सादा व मसाला प्रत्येक तीव्रता की अलग-अलग से अधिक देशी शराब नहीं बेंचेगा जब तक कि आबकारी मैनुअल प्रथम खण्ड 1995 संस्करण के देशी शराब के आयात-निर्यात, परिवहन व कब्जे में रखने की नियमावली के नियम-28 (3) के अनुसार अनुज्ञा प्रदान की गई हो।

14-किसी ऐसे व्यक्ति को बिक्री नहीं की जायेगी जो

21 वर्ष से कम आयु का हो या पदधारी जो वर्दी में हो।

15-लाइसेंसधारी द्वारा किसी भी दशा में बोतलों और पात्रों या उनके लेबुलों, सुरक्षा कोड, पिल्फरप्रूफ कैप (चोरी रोधक ढक्कनाें) या मोहरों से बिगाड़ करना, विकृत करना सर्वथा निषिद्ध है।

16-लाइसेंसधारी अपने लाइसेंस प्राप्त परिसर में कोई भी दुग्ध, शर्करा (चाश्नी), रंग, सुगंधि (अर्क), सुरक्षा कोड निर्माण करने वाला यंत्र, लेबुल, कैप्सूल, मुहर या कोई अपायकर सामग्री नहीं रखेगा। 17-लाइसेंसधारी या उसके विक्रेता के लिए दुकान की गद्‌दी पर या उस स्थान से 5 फिट की दूरी पर जहॉं विक्रय के लिए देशी शराब भण्डारित की गई है, पानी का रखना सर्वथा निषिद्ध है।

20-लाइसेंसधारी/विक्रेता और उसके परिवार के सिवाय परिसर, जिसमें दुकान स्थित है, का प्रयोग आवास के स्थान के रूप में नहीं किया जायेगा।

NOTIFICATION In exercise of the powers under section-24 and 41 of the United Provinces Excise Act, 1910 (U.P. Act. no. IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act. no. 1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, hereby makes the following rules with a view to amending the Uttar Pradesh Excise (Settlement of Licenses for Retail Sale of Country Liquor) Rules, 2002 published vide Excise Commissioner's Notification no. 27091/X-License-59/2002-2003, Dated March 14, 2002 and as amended from time to time.

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR RETAIL SALE OF COUNTRY LIQUOR) (THIRTEENTH AMENDMENT) RULES, 2020.

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of Licenses for Retail Sale of Country Liquor) (Thirteenth Amendment) Rules, 2020.

(2) They shall come into force with effect from the date of their publication in the Gazette.

2. Amendment of Rule 2– In the Uttar Pradesh Excise (Settlement of Licenses for Retail Sale of Country Liquor) Rules, 2002 hereinafter referred to as the said rules, for rule-2 setout in Column I below, the rule as setout in Column II shall be substituted, namely:-

2. Definition:

(a) "Act" means the United Provinces Excise Act, 1910 as amended from time to time;

(b) "Annual Minimum Guaranteed Quantity (MGQ)", means the quantity of "Strong" country liquor (in terms of 36% v/v) as fixed by the Licensing Authority in accordance with the general or specific instructions issued by the Excise Commissioner and guaranteed by the licensee to be lifted by him for his retail shop during an excise year for the purpose of retail sale. However if any license is granted after the commencement of the excise year then its annual minimum guaranteed quantity shall be reduced proportionately in accordance to the number of days remaining in the excise year.

(c) "Basic License fee" means that part of consideration fee for the grant of license for the exclusive privilege of retail sale of country liquor under section- 24 of the Act, payable by the person selected as licensee before the license is granted to him, for the whole excise year or part thereof on such rates as notified by the Excise Commissioner in consultation with the State Government from time to time:

Provided that if settlement is done in mid session the basic license fee will be in proportion to remaining minimum guaranteed quantity.

(d) "country liquor" includes country spirit "mild" or "strong" manufactured from Extra Neutral Alcohol (ENA) having such alcoholic strength as may be fixed by the Excise Commissioner with prior sanction of the State Government from time to time.

(e) "daily basic license fee" means that part of consideration fee which is payable by the grantee in interim license on such rate as notified by the Excise Commissioner with prior sanction of the State Government.

(f) "daily minimum guaranteed quantity" shall be 1/365th part of annual minimum guaranteed quantity.

(g) "Excise Year" means the financial year commencing on 1st April to 31st March of the next calendar year.

(h) "family" means and includes spouse (husband or wife), dependent son (s), unmarried daughter (s) and dependent parents;

(i) "Form" means a form appended to these (i) "Form" means a form appended to these Rules;

(k) "License Fee" means the remaining part of consideration fee for grant of license for exclusive privilege of retail sale of country liquor under section-24 of the Act, payable by the licensee, in addition to the basic license fee. This sum shall be equal to the consideration fee leviable on the annual minimum guaranteed quantity fixed for the shop.

Provided that if settlement is done in mid session it will be equal to consideration fee leviable on minimum guaranteed quantity.

(l) "Monthly Installments of Licence fee" It shall be in addition to basic licence fee which shall be equal to the consideration fee involved in the minimum guaranteed quantity of a month fixed by the licensing authority and shall be payable every month. However the consideration fee involved in the quantity of the country liquor lifted during the month by the licensee, may be adjusted against the monthly installments of the licence fee subject to the provisions of these rules;

(m) "Monthly Minimum Guaranteed Quantity"- Annual Minimum Guaranteed quantity shall be apportioned into twelve equal parts. Quantity obtained from such calculation shall be minimum guaranteed quantity;

(n) "Security amount" means a sum equal to the 1/10th part of the license fee excluding basic license fee, to be deposited through National Saving Certificate/Fixed deposit receipt pledged in favour of District Excise Officer or through e-payment refundable after the final settlement of all the claims and dues to the State Government;

Provided, in case of renewal security deposited prior in cash shall be acceptable till it is not refunded;

(o) "Consideration fee" means a fee fixed, per liter by the State Government under Section 30 of the Excise Act according to the strength of the country liquor, to be deposited in the Government Treasury by the licensee before taking supply of country liquor;

(p) "Additional Consideration fee" means difference amount obtained as a result of rounding off the optimum retail price of country liquor to the next multiple of five rupees, which shall be payable at Distillery level and recoverable by distillery from wholesale supplier in addition to Ex-Distillery Price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price. But this amount of additional consideration fee shall not be adjusted against the license fee payable by retail licensee;

(q) "earnest money" means the amount equal to 1/10 of the amount of basic licence fee, to be tendered with application form, for ensuring the fulfillment of the eligibility conditions for the grant of licence and is liable to be forfeited in case of default under provisions of rule-12 of these rules;

(r) "Hierarchy" means the earnest money of shops in the descending order purported to be the basis for the selection of licensee through the process of e/lottery;

(s) "Portal" means the electronic platform created specifically for the purpose of uploading information in the prescribed form with regard to the process of manufacturing liquor up to the terminal stage of its distribution;

(t) "Solvency" means financial eligibility criteria set for an applicant applying for the grant of retail licence;

(u) 'Individual' means a person who is the citizen of India not below the age of twenty-one years;

(v) "Settlement" means settlement or re- settlement of shops through renewal, e-lottery or e- tender which may take place on any day of the week by giving prior notice and intimation through the newspaper and website of the excise department. The settlement of shops for the forthcoming year may also be done prior to the cessation of preceding financial year.

(2) Words and expressions not defined in these rules but defined in the Act shall have the meanings respectively assigned to them in the Act.

No change in the status of applicant shall be allowed after allotment of shop. In case of death of licensee his legal heir if otherwise eligible, may continue to hold the license for the remaining period of the license.

Provided further that if a license is jointly held by two persons, in the event of death of either of them, the survivor along with the legal heir (s) of deceased if otherwise eligible, may continue to hold the license or in case of death of both persons their legal heir(s), if otherwise eligible may continue to hold the license. No distinction will be made between the legal liabilities of the two persons who will be jointly and severally responsible:

(iii) that he and his family members possess good moral character and have no criminal background not have been convicted of any offence punishable under United Provinces Excise Act. 1910 or Narcotics Drugs and Psychotropic Substances Act, 1985 or any other cognizable and non-bailable offence.

(iv) that in case he is selected as licensee he will furnish a certificate issued by Senior Superintendent/ Superintendent of Police of the district of which he is resident, showing that he as well as his family members possess good moral character and have no criminal background or criminal record prior to issuance of license.

(v) that he shall not employ any salesmen or representative who has criminal background as mentioned in clauses (iii) or who suffers from any infectious or contagious diseases or is below twenty-one years of age or a woman. Licensee shall have to obtain Identity Cards bearing photographs of his authorized salesman / representative from District Excise Officer.

(vi) that he is not in arrear of any public dues or Government dues.

(vii) that he is solvent and has the necessary funds or has made arrangements for the necessary funds, for conducting the business, the details of which shall be made available to the licensing authority.

(ix) that applicant is not an advocate registered with Bar Council. If he is found registered advocate after getting the license then the license shall be cancelled. An employee of the Government shall also be ineligible to apply for the grant of licence.

(x) that In case of selection as licensee, bank draft of earnest money, which has been uploaded online along with application, shall be deposited in the office of District Excise Officer within 48 hours of such selection.

(xi) that he has not made use of the earnest money bank draft for application of any other shop in the same phase.

(e) that he shall upload a scanned copy of bank draft issued in favour of District Excise Officer of concerned shop of the district for fixed earnest money along with online application as may be fixed by the Excise Commissioner with the prior sanction of the State Government.

In case of selection as licensee, it shall be necessary to deposit bank draft of earnest money in the office of the concerned District Excise Officer within 48 hours after selection. The earnest money shall be adjusted against the basic license fee.

In case of selection as licensee, it shall be necessary to deposit bank draft of earnest money in the office of the concerned District Excise Officer within forty-eight hours after selection, which shall be refunded to applicant after payment of all dues.

(f) That he is holder of solvency certificate or certificate of owned property issued by Income Tax valuer and the worth of solvency or property certificate issued by Income Tax valuer shall be not less than the equivalent amount of 1/6 part of sum of basic license fee and license fee determined for the grant of licence of the shop applied in the district.

Provided, for renewal solvency certificate produced during the settlement of previous year shall be acceptable and there shall be no need of new solvency certificate along with added value.

Provided, in case of renewal, solvency certificate or certificate of owned property issued by an authorized Income Tax Valuer produced during the settlement of previous year shall be acceptable if it is valid and is for the required amount.

6-- Amendment of rule-10-- In the said rules, for existing rule 10 setout in Column-I below, the rule as setout in Column-II shall be substituted, namely-

(ii) In case of non-renewal, licensees shall be selected shop wise through the process of e- lottery or e-tender, as specified by the State Government, through inviting online applications. District Excise Officer shall scrutinize the applications received online and prepare list of all eligible and ineligible applications, describing the reasons of ineligibility and shall put up this list before the District Level Committee of Licensing constituted for e-lottery and e-tender.

(b) The said committee shall identify eligible and ineligible applicants. In case of lottery the licensee shall be selected for each shop from amongst the eligible applicants through the computer driven randomized arrangement. Randomization process shall be adopted in the order of country liquor, model shops, foreign liquor and beer shops as per prescribed hierarchy under respective rule. In case of selection of licensee through e-tender the same aforesaid sequence shall be adopted. Not more than two shops including all categories of country liquor, model shop, foreign liquor and beer shall be allotted in favour of an applicant in the district, where in renewed shops shall also be included.

(c ) In case the selected applicants does not deposit the required basic licence fee or security amount and does not fulfill the prescribed formalities or is unable to arrange suitable premises for the shop within the stipulated period, the Licensing Authority shall cancel the allotment and take steps for resettlement of the shop through the process as prescribed by the Government.

In case of obtaining two or more equal offers for one shop, settlement shall be done through the manual public lottery. Such licensee shall also be required to deposit refundable/ adjustable security amount equivalent to the duty involved in daily minimum guaranteed quantity for the period of interim settlement.
