उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन्‌ 1910) की धारा 24 और 41 के अधीन शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेश, राज्य सरकार की पूर्व स्वीकृति से उक्त अधिनियम सन्‌ 1910 की धारा 18 के खण्ड (घ) के अधीन निर्धारित लाइसेंस शुल्क पर विदेशी मदिरा के बंधित गोदाम के लाइसेंस देने के लिये उत्तर प्रदेश आबकारी (विदेशी मदिरा बंधित गोदाम के लाइसेंसों का व्यवस्थापन) नियमावली, 2011 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं :

(षष्ठ्‌म संशोधन) नियमावली, 2020

1-संक्षिप्त नाम और प्रारम्भ-(1) यह नियमावली उत्तर प्रदेश आबकारी ((विदेशी मदिरा बंधित गोदाम के लाइसेंसों का व्यवस्थापन) (षष्ठ्‌म संशोधन) नियमावली, 2020 कही जायेगी।

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 नियमावली, 2011, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ :

2-परिभाषाएं जब तक विषय या संदर्भ में कोई 2-परिभाषाएं जब तक विषय या संदर्भ में कोई बात बात प्रतिकूल न हो इस नियमावली में-

प्रतिकूल न हो इस नियमावली में-

(एक) ''अधिनियम'' का तात्पर्य समय-समय पर (एक) ''अधिनियम'' का तात्पर्य समय-समय पर यथा संशोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 यथा संशोधित संयुक्त प्रान्त आबकारी अधिनियम, 1910 से है।

(तीन) ''आबकारी वर्ष''का तात्पर्य किसी कैलेण्डर वर्ष के (तीन) ''आबकारी वर्ष''का तात्पर्य किसी कैलेण्डर वर्ष के एक अप्रैल से प्रारम्भ होने वाली 12 माह की एक अप्रैल से प्रारम्भ होने वाली 12 माह की अवधि से है;

(चार) ''प्रपत्र'' का तात्पर्य इस नियमावली के साथ (चार) ''प्रपत्र'' का तात्पर्य इस नियमावली के साथ संलग्न प्रपत्र से है;

(छः) ''लाइसेंसधारी'' का तात्पर्य अन्य राज्यों की ऐसी (छः) ''लाइसेंसधारी'' का तात्पर्य अन्य राज्यों की ऐसी आसवनी, यवासवनी, द्राक्षासवनी या बोतल भराई आसवनी, यवासवनी, द्राक्षासवनी या बोतल भराई इकाई से है, जिसे प्रपत्र बी0डब्लू0एफ0एल0-2ए, इकाई से है, जिसे प्रपत्र बी0डब्लू0एफ0एल0-2ए, बी0डब्लू0एफ0एल0-2बी,

बी0डब्लू0एफ0एल0-2बी, बी0डब्लू0एफ0एल0-2सी बी0डब्लू0एफ0एल0-2सी या या बी0डब्लू0एफ0एल0-2डी में विदेशी मदिरा के बी0डब्लू0एफ0एल0-2डी में विदेशी मदिरा के

बंधित गोदाम चलाने की स्वीकृति दी गई हो;

(सात) ''लाइसेंस प्राधिकारी'' का तात्पर्य आबकारी (सात) ''लाइसेंस प्राधिकारी'' का तात्पर्य आबकारी आयुक्त से है;

एतद्‌द्वारा प्रतिस्थापित नियम

(आठ) ''लाइसेंस फीस'' का तात्पर्य अधिनियम की धारा 24क के अधीन थोक विदेशी मदिरा के अनन्य विशेषाधिकार के लिये लाइसेंस प्रदान किये जाने के लिये प्रतिफल से है, जो लाइसेंसधारी द्वारा, उसको लाइसेंस प्रदान किये जाने के पूर्व, ऐसी दरों पर, जैसा कि समय-समय पर आबकारी आयुक्त द्वारा राज्य सरकार की पूर्व स्वीकृति से निर्धारित किया जाये, राजकीय कोषागार में ई-पेमेन्ट के माध्यम से जमा की जायेगी। (नौ) ''प्रभारी अधिकारी'' का तात्पर्य आबकारी आयुक्त द्वारा नामनिर्दिष्ट आबकारी विभाग के ऐसे अधिकारी से है, जो आबकारी निरीक्षक से नीचे की श्रेणी का न हो;

(दस) ''प्रतिभूति धनराशि'' का तात्पर्य आबकारी आयुक्त द्वारा निर्धारित ऐसी धनराशि से है जो आबकारी आयुक्त, उत्तर प्रदेश के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी और जो राज्य सरकार के पूर्ण दावों और देयोें के प्रतिफल के अधीन लाईसेंसों के अन्तिम व्यवस्थापन के बाद प्रतिदेय होगी।

(दस) ''प्रतिभूति धनराशि'' का तात्पर्य आबकारी आयुक्त द्वारा निर्धारित ऐसी धनराशि से है जो आबकारी आयुक्त, उत्तर प्रदेश के पक्ष में गिरवीकृत राष्ट्रीय बचत पत्र /सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी और जो राज्य सरकार के पूर्ण दावों और देयोें के प्रतिफल के अधीन लाईसेंसों के अन्तिम व्यवस्थापन के बाद प्रतिदेय होगी। (ग्यारह) ''प्रतिफल शुल्क'' का तात्पर्य आबकारी अधिनियम की धारा 30 के अधीन विदेशी मदिरा, वाइन, बियर और कम तीव्रता के मादक पेय पर राज्य सरकार द्वारा यथानिर्धारित शुल्क से है, जो आपूर्ति से पूर्व लाइसेंसधारी द्वारा कोषागार में जमा की जाएगी।

(ग्यारह) ''प्रतिफल शुल्क'' का तात्पर्य आबकारी अधिनियम की धारा 30 के अधीन विदेशी मदिरा, वाइन, बियर और कम तीव्रता के मादक पेय पर राज्य सरकार द्वारा यथानिर्धारित शुल्क से है, जो आपूर्ति से पूर्व लाइसेंसधारी द्वारा कोषागार में जमा की जाएगी।

(बारह) ''अतिरिक्त प्रतिफल शुल्क'' का तात्पर्य अधिकतम फुटकर मूल्य को 10 के गुणांक में अगले स्तर पर लाने के फलस्वरूप प्राप्त अन्तर की धनराशि से है, जो अतिरिक्त एक्स आसवनी/एक्स यवासवनी मूल्य के रूप में लाइसेंस प्राप्त बंधित गोदाम के स्तर पर संदेय होगी और बंधित गोदाम के लाइसेंसधारी द्वारा थोक आपूर्तिकर्ता से वसूली योग्य होगी तथा जो बाद में थोक आपूर्तिकर्ता द्वारा फुटकर लाइसेंसधारी से अधिकतम थोक मूल्य के अलावा वसूल की जा सकेगी।

(तेरह) ''आयात परमिट फीस'' का तात्पर्य उत्तर प्रदेश राज्य के बाहर के किसी राज्य अथवा संघ राज्य क्षेत्र अथवा विदेश से आयात की गयी विदेषी मदिरा, वाइन, बीयर एवं एल0ए0बी0 पर अधिरोपित की जाने वाली फीस से है।4 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 3-नियम-3 का सशाेंधन-उक्त नियमावली में, नीचे स्तम्भ-एक में, दिए गए विद्यमान नियम-3 के स्थान पर स्तम्भ-दो में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

3-लाइसेंस की स्वीकृति-

3 (1) आबकारी आयुक्त या उसके द्वारा प्राधिकृत अधिकारी, जो संयुक्त आबकारी आयुक्त से निम्न श्रेणी का न हो, के द्वारा विदेशी शराब के बंधित गोदाम के लिये विदेशी शराब के थोक विक्रय का लाइसेंस निर्धारित संलग्न प्रारूप

(बी0डब्लू0एफ0एल0-2ए,

बी0डब्लू0एफ0एल0-2बी,

बी0डब्लू0एफ0एल0-2सी,

बी0डब्लू0एफ0एल0-2डी) लाइसेंस शुल्क का भुगतान किये जाने, प्रतिभूति धनराशि जमा कियेे जाने और आबकारी आयुक्त के पक्ष में प्रपत्र बी0डब्ल्यू0एफ0एल0-3 में सामान्य बन्ध-पत्र निष्पादित किये जाने पर स्वीकृत किया जायेगा।

(2) विदेशी मदिरा, बीयर, वाइन एवं कम तीब्रता के मादक पेय के थोक विक्रय के लिये विदेशी मदिरा के बंधित गोदाम का लाइसेंस, लाइसेंस प्राप्त अन्य राज्यों की आसवनियों, यवासवनियों, द्राक्षासवनियों को दिया जायेगा। अन्य राज्य के बाटलिंग प्लान्ट का लाइसेंसधारक भी लाइसेंस के लिये अर्ह होगा परन्तु ऐसे लाइसेंसधारक की बाटलिंग इकाई निम्नलिखित मानदण्डों को पूरा करती हो-

(एक) बाटलिंग इकाई की वार्षिक कारबार व्यापारावर्त रुपये 150 करोड़ (राजस्व/ प्रतिफल शुल्क सहित) से कम न हो;

(एक) बाटलिंग इकाई की वार्षिक कारबार व्यापारावर्त रुपये 100 करोड़ (राजस्व/ आबकारी शुल्क सहित) से कम न हो;

(दो) बाटलिंग इकाई की वार्षिक उत्पादन क्षमता, (दो) बाटलिंग इकाई की वार्षिक उत्पादन क्षमता, पॉंच लाख केसेस से कम न हो;

पॉंच लाख केसेस से कम न हो;

(तीन) बाटलिंग इकाई का कारवार कम से कम 03 राज्यों में हो, जिसमें प्रत्येक की जनसंख्या एक करोड़ से कम न हो

(3) लाइसेंस की स्वीकृति हेतु आवेदन प्रपत्र बी0डबलू0एफ0एल0-1 में किया जायेगा। यदि राज्य के बाहर की कोई इकाई विभिन्न जिलों में बाण्ड लेना चाहे तो ऐसा एकल आवेदन के द्वारा किया जा सकता है। उक्त इकाई प्रत्येक जिला /लाइसेंस हेतु पृथक-पृथक लाइसेंस फीस प्रभारित करेगी।

स्तम्भ-2

विद्यमान नियम

एतद्‌द्वारा प्रतिस्थापित नियम

(4) प्रतिभूति धनराशि आबकारी आयुक्त द्वारा राज्य सरकार की पूर्व अनुमति से निर्धारित की जायेगी, जो आबकारी आयुक्त, उत्तर प्रदेश के पक्ष में गिरवीकृत राष्ट्रीय बचत पत्र /सावधि जमा रसीद के रूप में अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी ।

(4) प्रतिभूति धनराशि आबकारी आयुक्त द्वारा राज्य सरकार की पूर्व अनुमति से निर्धारित की जायेगी, जो आबकारी आयुक्त, उत्तर प्रदेश के पक्ष में गिरवीकृत सावधि जमा रसीद के रूप में अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी ।

(5) लाइसेंस फीस, लाइसेंसधारी द्वारा ई-पेमेन्ट के माध्यम से सरकारी कोषागार में या राष्ट्रीयकृत बैंक द्वारा निर्गत बैंक ड्राफ्ट, जो आबकारी आयुक्त को संदेय हो, जमा की जायेगी।

(6) लाइसेंस की अवधि एक आबकारी वर्ष अथवा उसके आंशिक भाग के लिए होगी, जिसके लिये लाइसेंस स्वीकृत किया गया हो।

(7) लाइसेंसधारी को लाइसेंस किसी अन्य व्यक्ति (7) लाइसेंसधारी को लाइसेंस किसी अन्य व्यक्ति को अन्तरित करने अथवा उप- पट्‌टे पर देने की अनुमति नहीं होगी।

(8) राज्य के बाहर की किसी इकाई, जिसकी अन्य राज्यों में कई इकाईयां हाें, जो उत्तर प्रदेश में बाण्ड लाइसेंस लेकर अपनी विभिन्न इकाईयों में विनिर्मित आई0एम0एफ0एल0 /बीयर/ वाइन/ एल0ए0बी0 की बिक्री एक ही परिसर से करना चाहती हों, को प्रत्येक इकाई के लिये विहित लाइसेंस फीस प्रभारित करने के पश्चात्‌ अनुमति प्रदान की जायेगी। प्रतिबन्ध यह है विभिन्न इकाईयों के पारेषण उन परिसरों में पृृथक-पृथक भण्डारित किये जायेेंगे।

(8) राज्य के बाहर की किसी इकाई, जिसकी अन्य राज्यों में कई इकाईयां हाें, जो उत्तर प्रदेश में बाण्ड लाइसेंस लेकर अपनी विभिन्न इकाईयों एवं एफ0एल0-1 और एफ0एल0-1ए को सम्मिलित करते हुए एक मास्टर वेयर हाउस से विनिर्मित आई0एम0एफ0एल0 /बीयर/ वाइन/ एल0ए0बी0 की बिक्री एक ही परिसर से करना चाहती हों, को प्रत्येक इकाई के लिये विहित लाइसेंस फीस प्रभारित करने के पश्चात्‌ अनुमति प्रदान की जायेगी। प्रतिबन्ध यह है विभिन्न इकाईयों के पारेषण उन परिसरों में पृृथक-पृथक भण्डारित किये जायेेंगे।

परन्तु यह और कि प्रपत्र वि0म0-2 एवं वि0म0-2ख में लाइसेंसधारण करने व कोई थोक लाइसेंसधारक, एकल मांग पत्र के अन्तर्गत भारत निर्मित विदेशी मदिरा/ बीयर/वाइन/ कम तीब्रता के मादक पेय के विभिन्न ब्राण्डों की आपूर्ति ऐसे मास्टर वेयरहाउस से प्राप्त कर सकता है।

प्रपत्र बी0 डब्लू एफ0 एल0-2ए, बी0 डब्लू एफ0 एल0-2बी, बी0 डब्लू एफ0 एल0-2सी एवं बी0 डब्लू एफ0 एल0-2डी में लाइसेंस का नवीकरण, आबकारी आयुक्त अथवा उसके द्वारा प्राधिकृत अधिकारी राज्य सरकार द्वारा विहित निबन्धन एवं शर्तों के अध्यधीन कर सकता है।

(9) नवीकरण की स्थिति में पूर्व में नकद अथवा राष्ट्रीय बचत पत्र के माध्यम से जमा की गयी प्रतिभूति तब तक स्वीकार्य होगी, जब तक इसकी वापसी न कर दी जाय।6 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 4-नियम-5 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ एक में दिए गए विद्यमान नियम-5 के स्थान पर स्तम्भ-दो में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

5. विदेशी शराब की प्राप्ति- विदेशी मदिरा, बीयर, वाइन व कम तीव्रता का मादक पेय, उत्तर प्रदेश के बाहर की अपनी आसवनी, यवासवनी, द्राक्षासवनी या बंधित गोदाम से बन्ध पत्र के लाइसेंसधारक द्वारा प्राप्त की जा सकती है, जिसके लिए नियमावली के अधीन लाइसेंसधारक को अपने जिले से सम्बन्धित जिला आबकारी अधिकारी या सम्बन्धित प्रभार के उप आबकारी आयुक्त द्वारा परमिट निर्धारित संलग्न प्रारूप एफ0एल0-22 प्रपत्र पर जारी किया गया हो। 5-नियम-16 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ एक में दिए गए विद्यमान नियम-16 के स्थान पर स्तम्भ-दो में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

16-निलम्बन, निरस्तीकरण तथा शास्तियां-

(1) लाइसेंस प्राधिकारी लाइसेंस को निलम्बित या (1) लाइसेंस प्राधिकारी लाइसेंस को निलम्बित या निरस्त कर सकता है और प्रतिभूति धनराशि को निरस्त कर सकता है और प्रतिभूति धनराशि को समपहृत कर सकता है और जुर्माना अधिरोपित कर समपहृत कर सकता है और जुर्माना अधिरोपित कर सकता हैः-

(क) यदि लाइसेंसप्राप्त परिसर से शराब की कोई (क) यदि लाइसेंसप्राप्त परिसर से शराब की कोई ऐसी बोतल या पात्र, विक्रय करते हुये पाया ऐसी बोतल या पात्र, विक्रय करते हुये पाया जाय, जाय, जिस पर आबकारी विभाग द्वारा अनुमोदित जिस पर आबकारी विभाग द्वारा अनुमोदित सुरक्षा सुरक्षा कोड न लगा हो।

(ख) यदि लाइसेंसप्राप्त परिसर में किसी अन्य प्रकार (ख) यदि लाइसेंसप्राप्त परिसर में किसी अन्य प्रकार की मदिरा या मादक औषधि पायी जाती है की मदिरा या मादक औषधि पायी जाती है जिसके लिये लाइसेंस प्रदान नहीं किया गया है।

निर्धारित की गयी एक्स बांड मूल्य, यदि कोई हो, प्रतिफल शुल्क और अन्य करों और शुल्कों को प्रतिफल शुल्क और अन्य करों और शुल्कों को छोड़कर से अधिक मूल्य प्रभारित करता है।

छोड़कर से अधिक मूल्य प्रभारित करता है (घ) यदि लाइसेंसप्राप्त परिसर में कोई अनधिकृत (घ) यदि लाइसेंसप्राप्त परिसर में कोई अनधिकृत सुरक्षा कोड यन्त्र, स्प्रिट, रंग, सुगन्ध आदि पाया सुरक्षा कोड यन्त्र, स्प्रिट, रंग, सुगन्ध आदि पाया जाता है।

(ड.) यदि लाइसेंसधारी द्वारा अभिलेखों में त्रुटिपूर्ण (ड.) यदि लाइसेंसधारी द्वारा अभिलेखों में त्रुटिपूर्ण अथवा कपटपूर्ण प्रविष्टियॉं की गयी हों जिसके

अथवा कपटपूर्ण प्रविष्टियॉं की गयी हों जिसके परिणाम स्वरूप राजस्व की हानि हुई हो।

शर्तें

1. उक्त बंधित गोदाम से विदेशी मदिरा की निकासी राज्य के किसी अन्य बंधित गोदाम को बन्ध-पत्र या राज्य के किसी थोक विके्रता एफ0एल0-2 लाइसेंसधारी को देय प्रतिफल शुल्क व अन्य प्रभारोंं के भुगतान करने के पश्चात्‌ ही दी जायेगी।

2. उक्त बंधित गोदाम से आबकारी आयुक्त, उत्तर प्रदेश द्वारा समय-समय पर निर्धारित केवल ऐसी तीव्रता की ही विदेशी मदिरा की निकासी दी जायेगी।

3. बंधित गोदाम का प्रभारी अधिकारी, सम्बन्धित प्रभार के उप आबकारी आयुक्त की पूर्व स्वीकृति से, आयुक्त के आदेश के रहने पर भी, ऐसी विदेशी मदिरा, जिसे वह उपभोग के लिए संदिग्ध समझता है और जिसका अविलम्ब नमूना भेजकर परीक्षण कराया जाना आवश्यक है, की निकासी रोकने के लिए सक्षम है।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 11 शर्तें 4. लाइसेंसधारी थोक बिक्रेताओं द्वारा किये गये विशिष्ट ब्रान्डों की मांगों और आवश्यकताओं को दृष्टिगत रखते हुये गोदाम पर ऐसे ब्राण्डों के न्यूनतम स्टाक को अनुरक्षित रखेगा।

शर्तें 4. लाइसेंसधारी थोक बिक्रेताओं द्वारा किये गये विशिष्ट ब्रान्डों की मांगों और आवश्यकताओं को दृष्टिगत रखते हुये गोदाम पर ऐसे ब्राण्डों के न्यूनतम स्टाक को अनुरक्षित रखेगा।

5. गोदाम में विदेशी मदिरा के समुचित अनुरक्षण का उत्तरदायित्व लाइसेंसधारी का होगा। लाइसेंसधारी रैको की पर्याप्त संख्या, आल्मारियों, बक्से और अन्य उपस्कर, भंडारण स्टाक के लिये जो आवश्यक हो, उपलब्ध करायेगा और उस पर प्रभारी अधिकारी के ताले के साथ अपना भी ताला लगायेगा।

6. लाइसेंसधारी आबकारी आयुक्त द्वारा समय-समय पर निर्देशित बोतल/ फ्‌लास्क की धारिता में विदेशी मदिरा की आपूर्ति करेगा।

6. लाइसेंसधारी आबकारी आयुक्त द्वारा समय-समय पर निर्देशित बोतल/फ्‌लास्क/ कैन्स/ टेट्रा पैक्स की धारिता में विदेशी मदिरा की आपूर्ति करेगा।

7. बोतलों पर लगाये गये लेबुलों पर समय-समय पर यथा संशोधित उत्तर प्रदेश विदेशी मदिरा भराई नियमावली 1969 में विहित सभी आवश्यक मुद्रित अपेक्षाएं होंगी। लाइसेंसधारी गोदाम परिसर में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड के लागू करने के लिये उचित प्रबन्ध करेगा। मदिरा के किसी भी बोतल/टेट्रापैक की बिक्री तब तक नहीं की जायेगी, जब तक उस पर आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा न हो।

7. बोतलों पर लगाये गये लेबुलों पर समय-समय पर यथा संशोधित उत्तर प्रदेश विदेशी मदिरा भराई नियमावली 1969 में विहित सभी आवश्यक मुद्रित अपेक्षाएं होंगी। लाइसेंसधारी गोदाम परिसर में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड के लागू करने के लिये उचित प्रबन्ध करेगा। मदिरा के किसी भी बोतल/ टेट्रापैक की बिक्री तब तक नहीं की जायेगी, जब तक उस पर आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा न हो।

8. लाइसेंसधारी को उप आबकारी आयुक्त प्रभार द्वारा अनुमोदित अधिकृत प्रतिनिधि बंधित गोदाम में रखना होगा तथा बंधित गोदाम से निकासी और विदेशी मदिरा के आने वाले प्रेषित माल के लिये चढ़ाने व उतारने का प्रबन्ध करेगा। गोदाम में आई0पी0 एड्रेस रखने वाला कैमरा लगाया जायेगा। गोदामों में अग्निशमन यंत्रों की व्यवस्था की जानी चाहिए।

9. लाइसेंसधारी बंधित गोदाम में विदेशी मदिरा की प्राप्ति, निकासी की गई तथा अवशेष स्टाक की मात्रा का सही-सही लेखा-जोखा रखेगा। दैनिक रजिस्टर के निर्धारित प्रपत्र में मदिरा का सही-सही लेखा रखा जायेगा। लेखा रजिस्टर के सभी पृष्ठों पर सम्बन्धित जिला आबकारी अधिकारी के रबर सील के साथ लगाकर पृष्ठ संख्या अंकित की जायेगी। विदेशी मदिरा की प्राप्ति व निकासी सहित पृष्ठों व पन्नों को समुचित ढंग से रखा जायेगा तथा आबकारी विभाग के प्राधिकारियों द्वारा निरीक्षण के समय मांॅगने पर खोली जायेगी। सम्बन्धित विवरण का एम0आई0एस0 (मैनेजमेन्ट इन्फार्मेशन सिस्टम) विहित पोर्टल पर नियत अन्तराल पर अपलोड किया जायेगा ।

शर्तें

10. लाइसेंसधारी बंधित गोदाम से मदिरा की निकासी के लिये तथा बंधित गोदाम के समुचित प्रबन्ध के लिये सभी सामान्य नियमों द्वारा नियमतः उत्तरदायी होगा।

11. लाइसेंसधारी आबकारी आयुक्त द्वारा समय-समय पर दिये गये निर्देशों के अनुसार ब्रान्डों के रजिस्ट्रेशन के लिये रजिस्ट्रेशन शुल्क के साथ अनुमोदित अधिकतम्‌ थोक व अधिकतम फुटकर बिक्री की दरें, एक्स बाण्ड मूल्य, ब्राण्डों की विस्तृत सूची आबकारी आयुक्त को प्रस्तुत करेगा। लाइसेंसधारी किसी लेबुल को प्रयोग करने से पूर्व प्रतिवर्ष चार प्रतियों में आबकारी आयुक्त द्वारा समय-समय पर निर्धारित प्रत्येक लेबुल धारितावार के अनुमोदित शुल्क के साथ ट्रेजरी चालान संलग्न करके संबंधित जिले के जिला आबकारी अधिकारी, जो उसके अनुमोदन के लिए आबकारी आयुक्त को प्रेषित करेगा, अधिकतम फुटकर विक्रय मूल्य की दर में कोई परिवर्तन वर्ष के मध्य में तब तक नहीं की जायेगी जब तक कि विशेष रुप से आबकारी आयुक्त द्वारा अनुमति प्रदान न कर दी जाय।

12. उत्तर प्रदेश में आयात की जाने वाली विदेशी मदिरा की पेटियों (कार्टन) की सभी छः सतहों (फेस) पर गाढे़ लाल रंग की डेढ़ इंच चौड़ी पट्‌टी पर कम से कम एक इंच आकार के काले रंग के अक्षरों में "फार सेल इन यूपी" मुद्रित कराया जायेगा।

13. लाइसेंसधारी संयुक्त प्रान्त आबकारी अधिनियम, 1910 (अधिनियम 4 सन्‌ 1910) और इनके अन्तर्गत बनाये गये नियमों और आदेशों के उपबंधों के अधीन इस लाइसेंस की शर्तों का पालन करेगा।

14. यदि लाइसेंस निर्धारित अवधि के पूर्व ही निरस्त किया जाता है या निर्धारित अवधि बीत जाने के पश्चात्‌ नवीकृत नहीं होता है तो लाइसेंसधारी बंधित गोदाम के प्रभारी अधिकारी को बचे हुये शराब के थोक स्टाक की सूचना देगा और आबकारी आयुक्त द्वारा दिये गये निर्देशों के अधीन केवल बचे हुये स्टाक का निस्तारण करेगा।

शर्तें

15. लाइसेंसप्राप्त परिसर 14 अप्रैल (अम्बेडकर 15. लाइसेंसप्राप्त परिसर 14 अप्रैल (अम्बेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गांॅधी जयन्ती), 26 जनवरी (गणतंत्र दिवस) और 3 ऐसे अतिरिक्त दिनों जैसा कि जिलाधिकारी द्वारा बन्दी के लिये अधिसूचित किया जाय, को छोड़कर बिक्री के लिये सभी दिनों में 9.00 बजे प्रातः से लेकर 8. 00 बजे सायं तक खुला रहेगा। लाइसेंसिंग प्राधिकारी/ जिलाधिकारी संबंधित विधियों के अधीन कानून व्यवस्था या सामान्य निर्वाचन सम्बन्धी क्रिया-कलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उक्त दिनांक व दिनों में दुकान की बन्दी के लिये कोई क्षतिपूर्ति देय नहीं होगी।

जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गांॅधी जयन्ती), 26 जनवरी (गणतंत्र दिवस) और 3 ऐसे अतिरिक्त दिनों जैसा कि जिलाधिकारी द्वारा बन्दी के लिये अधिसूचित किया जाय, को छोड़कर बिक्री के लिये सभी दिनों में 9.00 बजे प्रातः से लेकर 8.00 बजे सायं तक खुला रहेगा। लाइसेंसिंग प्राधिकारी/ जिलाधिकारी संबंधित विधियों के अधीन कानून व्यवस्था या सामान्य निर्वाचन सम्बन्धी क्रिया-कलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उक्त दिनांक व दिनों में दुकान की बन्दी के लिये कोई क्षतिपूर्ति देय नहीं होगी।

16. जिलों के एफ0एल0-2 लाइसेंसधारियों से विदेशी मदिरा की थोक आपूर्ति हेतु मांॅग-पत्र प्राप्त होने पर आपूर्ति प्रथम आवक प्रथम पावक के सिद्धान्त के अनुसार की जायेगी। जिसमें विफल होने पर लाइसेंसधारी के विरुद्व दाण्डिक कार्यवाही की जा सकती है।

17. बंधित गोदाम से निकासी होने वाले सभी ब्रान्डों की बोतलों के लेबुलों पर अधिकतम फुटकर बिक्री मूल्य अंकित होना अनिवार्य है। लेबुलों पर बिना अधिकतम फुटकर बिक्रय मूल्य अंकित किये हुये मदिरा की बिक्री प्रतिबन्धित है। 18- लाइसेंसधारी अपने गोदाम परिसर से मदिरा की सील्ड पेटियों का उठान उन पर लगे सुरक्षा कोड की स्कैनिंग करने के पश्चात्‌ सुनिश्चित करेगा।

संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम 4, सन्‌ 1910) और तद्‌धीन बनाये गये नियमों/आदेशों के उपबंधों के अधीन बोतल बन्द/केन्स बीयर को उत्तर प्रदेश मेें बंधपत्र के अधीन आयात, संचय व बिक्री करने के लिये उसे प्राधिकृत करते हुये स्थान.....................जिला................. (जिसे आगे लाइसेंस प्राप्त परिसर कहा गया है), के लिये दिनांक .... ..........................से प्रारम्भ होने वाली और दिनांक 31 मार्च............................... को समाप्त होने वाली अवधि (दोनों तिथियों को सम्मिलित कर) के दौरान निम्नलिखित शर्तो के अध्यधीन जिनका लाइसेंसधारी या उसके द्वारा लगाये गये व्यक्ति द्वारा उल्लंघन किये जाने पर लाइसेंसधारी अर्थदण्ड, प्रतिभूति समपहरण और लाइसेंस निरस्तीकरण के लिए उत्तरदायी होगा, लाइसेंस प्रदान किया जाता है-

शर्तें

1. उक्त बंधित गोदाम से बीयर की निकासी राज्य के किसी अन्य बंधित गोदाम को बंध-पत्र, या राज्य के किसी थोक विक्रेता एफ0एल0-2 व एफ0एल0-2बी लाइसेंसधारी को देय प्रतिफल शुल्क व अन्य प्रभारों के भुगतान करने के पश्चात्‌ ही दी जायेगी।

1. उक्त बंधित गोदाम से बीयर की निकासी राज्य के किसी अन्य बंधित गोदाम को बंध-पत्र, या राज्य के किसी थोक विक्रेता एफ0एल0-2बी लाइसेंसधारी को देय प्रतिफल शुल्क व अन्य प्रभारों के भुगतान करने के पश्चात्‌ ही दी जायेगी।

2. उक्त बंधित गोदाम से आबकारी आयुक्त, उत्तर प्रदेश द्वारा समय-समय पर ऐसे (5 वीवी से 8 वीवी) निर्धारित तीव्रता की ही बीयर की निकासी दी जायेगी।

3. लाइसेंसधारी गोदाम के प्रभारी अधिकारी, सम्बन्धित प्रभार के उप आबकारी आयुक्त की पूर्व स्वीकृति से, आयुक्त के आदेश के रहने पर भी, ऐसी बीयर जिसे वह उपभोग के लिए संदिग्ध समझता है और जिसका अविलम्ब नमूना भेजकर परीक्षण कराया जाना आवश्यक है, की निकासी रोकने के लिए सक्षम है।

शर्तें

4. लाइसेंसधारी थोक विक्रेताओं द्वारा किये गये विशिष्ट ब्रांडो की मांगो और आवश्यकताओं को दृष्टिगत रखते हुये गोदाम पर ऐसे ब्रांडों के न्यूनतम स्टाक को अनुरक्षित रखेगा।

5. गोदाम में बीयर के समुचित अनुरक्षण का उत्तरदायित्व लाइसेंसधारी का होगा। लाइसेंसधारी रैकाें की पर्याप्त संख्या, आलमारियॉं, बाक्सों और अन्य उपस्कर भंडारण स्टाक के लिये, जो आवश्यक हो, उपलब्ध करायेगा और उस पर प्रभारी अधिकारी के ताले के साथ अपना भी ताला लगायेगा।

6. लाइसेंसधारी आबकारी आयुक्त द्वारा समय-समय पर निर्देशित बोतल/केन्स की धारिता में बीयर की आपूर्ति करेगा।

7. बोतलों पर लगाये गये लेबुलों पर समय-समय पर यथा संशोधित उत्तर प्रदेश विदेशी मदिरा भराई नियमावली, 1969 में विहित सभी आवश्यक मुद्रित अपेक्षाएं होंगी। लाइसेंसधारी सुरक्षा कोड हेतु गोदाम परिसर में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड लागू करने के लिये उचित प्रबंध करेगा। बीयर के किसी भी बोतल/केन्स की बिक्री तब तक नहीं की जायेगी, जब तक उस पर आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा न हो।

8. लाइसेंसधारी को उप आबकारी आयुक्त प्रभार द्वारा अनुमोदित प्राधिकृत प्रतिनिधि बंधित गोदाम में रखना होगा तथा बंधित गोदाम से निकासी और बीयर के आने वाले माल के लिये चढ़ाने व उतारने का प्रबंध करेगा। गोदाम में आई0पी0 एड्रेस रखने वाला कैमरा लगाया जायेगा और अग्निशमन यंत्रों की व्यवस्था की जानी चाहिए। 9. लाइसेंसधारी बंधित गोदाम में बीयर की प्राप्ति, निकासी की गई तथा अवशेष स्टाक की मात्रा का सही-सही लेखा-जोखा रखेगा। दैनिक रजिस्टर के निर्धारित प्रपत्र में बीयर का सही-सही लेखा रखा जायेगा। लेखा रजिस्टर के पृष्ठों पर सम्बन्धित जिला आबकारी अधिकारी के रबर सील के साथ लगाकर पृष्ठ संख्या अंकित की जायेगी। बीयर की प्राप्ति व निकासी के पासों के पृष्ठों व पन्नों को समुचित ढंग से रखा जायेगा तथा आबकारी विभाग के प्राधिकारियों द्वारा निरीक्षण के समय मांॅगने पर प्रस्तुत किया जायेगा। सम्बन्धित विवरण का एम0आई0एस0 (मैनेजमेन्ट इन्फार्मेशन सिस्टम) विहित पोर्टल पर नियत अन्तराल पर अपलोड किया जायेगा ।

9. लाइसेंसधारी बंधित गोदाम में बीयर की प्राप्ति, निकासी की गई तथा अवशेष स्टाक की मात्रा का सही-सही लेखा-जोखा रखेगा। दैनिक रजिस्टर के निर्धारित प्रपत्र में बीयर का सही-सही लेखा रखा जायेगा। लेखा रजिस्टर के पृष्ठों पर सम्बन्धित जिला आबकारी अधिकारी के रबर सील के साथ लगाकर पृष्ठ संख्या अंकित की जायेगी। बीयर की प्राप्ति व निकासी के पासों के पृष्ठों व पन्नों को समुचित ढंग से रखा जायेगा तथा आबकारी विभाग के प्राधिकारियों द्वारा निरीक्षण के समय मांॅगने पर प्रस्तुत किया जायेगा। सम्बन्धित विवरण का एम0आई0एस0 (मैनेजमेन्ट इन्फार्मेशन सिस्टम) विहित पोर्टल पर नियत अन्तराल पर अपलोड किया जायेगा ।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 17 शर्तें 10. लाइसेंसधारी बंधित गोदाम से बीयर की निकासी के लिये तथा बंधित गोदाम के समुचित प्रबन्ध के लिये सभी सामान्य नियमों द्वारा नियमतः उत्तरदायी होगा।

11. लाइसेंसधारी, आबकारी आयुक्त द्वारा समय-समय पर दिये गये निदेशों के अनुसार ब्रांडो के रजिस्टे्रशन के लिए रजिस्ट्रेशन शुल्क के साथ अनुमोदित अधिकतम्‌ थोक व अधिकतम्‌ फुटकर विक्री की दरें, एक्स ब्रांड मूल्य, ब्रांडो की विस्तृत सूची आबकारी आयुक्त को प्रस्तुत करेगा। लाइसेंसधारी किसी लेबुल को प्रयोग करने से पूर्व प्रतिवर्ष चार प्रतियों में आबकारी आयुक्त द्वारा समय-समय पर निर्धारित प्रत्येक लेबुल धारितावार के अनुमोदन शुल्क के साथ ट्रेजरी चालान/ई-पेमेन्ट संलग्न करके सम्बन्धित जिले के जिला आबकारी अधिकारी के समक्ष प्रस्तुत करेगा, जो उसके अनुमोदन के लिये आबकारी आयुक्त को प्रेषित करेगा। अधिकतम फुटकर विक्रय मूल्य की दर में कोई परिवर्तन वर्ष के मध्य में तब तक नहीं किया जायेगा, जब तक कि विशेष रूप से आबकारी आयुक्त द्वारा अनुमति प्रदान न की जाये।

12. लाइसेंसधारी संयुक्त प्रान्त आबकारी अधिनियम, 1910 (अधिनियम-4 सन्‌ 1910) और इनके अन्तर्गत बनाये गये नियमों और आदेशों के उपबंधों के अधीन व इस लाइसेंस की शर्तो का पालन करेगा।

13. यदि लाइसेंस निर्धारित अवधि के पूर्व ही निरस्त किया जाता है या निर्धारित अवधि बीत जाने के पश्चात्‌ नवीकृत नहीं होता है तो लाइसेंसधारी बंधित गोदाम के प्रभारी अधिकारी को बचे हुये बीयर के थोक स्टाक की सूचना देगा और आबकारी आयुक्त द्वारा दिये गये निदेशों के अधीन बचे हुये स्टाक का निस्तारण करेगा। 14. लाइसेंसप्राप्त परिसर 14 अप्रैल (अम्बेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गांॅधी जयन्ती), 26 जनवरी (गणतंत्र दिवस) और 3 ऐसे अतिरिक्त दिनों जैसा कि लाइसेंसिंग प्राधिकारी/ जिलाधिकारी द्वारा बन्दी के लिये अधिसूचित किया जाय, को छोड़कर बिक्री के लिये सभी दिनों में 9. 00 बजे प्रातः से लेकर 8.00 बजे सायं तक खुला रहेगा। जिलाधिकारी सम्बन्धित विधियों के अधीन कानून व्यवस्था या सामान्य निर्वाचन सम्बन्धी क्रिया-कलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उक्त दिनांक व दिनों में दुकान की बन्दी के लिये कोई क्षतिपूर्ति देय नहीं होगी।

14. लाइसेंसप्राप्त परिसर 14 अप्रैल (अम्बेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गांॅधी जयन्ती), 26 जनवरी (गणतंत्र दिवस) और 3 ऐसे अतिरिक्त दिनों जैसा कि लाइसेंसिंग प्राधिकारी/ जिलाधिकारी द्वारा बन्दी के लिये अधिसूचित किया जाय, को छोड़कर बिक्री के लिये सभी दिनों में 9.00 बजे प्रातः से लेकर 8.00 बजे सायं तक खुला रहेगा। जिलाधिकारी सम्बन्धित विधियों के अधीन कानून व्यवस्था या सामान्य निर्वाचन सम्बन्धी क्रिया-कलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उक्त दिनांक व दिनों में दुकान की बन्दी के लिये कोई क्षतिपूर्ति देय नहीं होगी।18 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 शर्तें

18- उत्तर प्रदेश में आयात की जाने वाली बीयर

की पेटियों (कार्टन) की सभी छः सतहों (फेस) पर गाढे़ लाल रंग की डेढ़ इंच चौड़ी पट्‌टी पर कम से कम एक इंच आकार के काले रंग के अक्षरों में "फार सेल इन यूपी" मुद्रित कराया जायेगा।

शर्तें

1. उक्त बंधित गोदाम से वाइन की निकासी राज्य के किसी अन्य बंधित गोदाम को बंध-पत्र, या राज्य के किसी थोक विक्रेता एफ0एल0-2 लाइसेंसधारी को देय प्रतिफल शुल्क व अन्य प्रभारों के भुगतान करने के पश्चात्‌ ही दी जायेगी।

2. उक्त बंधित गोदाम से आबकारी आयुक्त, उत्तर प्रदेश द्वारा समय-समय पर निर्धारित तीव्रता की ही वाइन की निकासी दी जायेगी।

2. उक्त बंधित गोदाम से आबकारी आयुक्त, उत्तर प्रदेश द्वारा समय-समय पर निर्धारित तीव्रता की ही वाइन की निकासी दी जायेगी। 3. बंधित गोदाम के प्रभारी अधिकारी, सम्बन्धित प्रभार के उप आबकारी आयुक्त की पूर्व स्वीकृति से, आयुक्त के आदेश के रहने पर भी, ऐसी वाइन जिसे वह उपभोग के लिए संदिग्ध समझता है और जिसका अविलम्ब नमूना भेजकर परीक्षण कराया जाना आवश्यक है, की निकासी रोकने के लिए सक्षम है।

3. बंधित गोदाम के प्रभारी अधिकारी, सम्बन्धित प्रभार के उप आबकारी आयुक्त की पूर्व स्वीकृति से, आयुक्त के आदेश के रहने पर भी, ऐसी वाइन जिसे वह उपभोग के लिए संदिग्ध समझता है और जिसका अविलम्ब नमूना भेजकर परीक्षण कराया जाना आवश्यक है, की निकासी रोकने के लिए सक्षम है। 4. लाइसेंसधारी थोक विक्रेताओं द्वारा किये गये विशिष्ट ब्रांडो की मांगो और आवश्यकताओं को दृष्टिगत रखते हुये गोदाम पर ऐसे ब्रांडों के न्यूनतम स्टाक को अनुरक्षित रखेगा।

4. लाइसेंसधारी थोक विक्रेताओं द्वारा किये गये विशिष्ट ब्रांडो की मांगो और आवश्यकताओं को दृष्टिगत रखते हुये गोदाम पर ऐसे ब्रांडों के न्यूनतम स्टाक को अनुरक्षित रखेगा।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 21 शर्तें

शर्तें

5. गोदाम में वाइन के समुचित अनुरक्षण का उत्तरदायित्व लाइसेंसधारी का होगा। अनुज्ञापी रैको की पर्याप्त संख्या में आलमारियॉं, बक्सें और अन्य उपस्कर भंडारण स्टाक के लिये, जो आवश्यक हो, उपलब्ध करायेगा और उस पर प्रभारी अधिकारी के ताले के साथ अपना भी ताला लगायेगा।

6. लाइसेंसधारी आबकारी आयुक्त द्वारा समय-समय पर निर्देशित बोतल/फ्लास्क की धारिता में वाइन की आपूर्ति करेगा।

6. लाइसेंसधारी आबकारी आयुक्त द्वारा समय-समय पर निर्देशित बोतल/फ्लास्क /पात्र की धारिता में वाइन की आपूर्ति करेगा।

7. बोतलों पर लगाये गये लेबुलों पर समय-समय पर यथा संशोधित उत्तर प्रदेश विदेशी मदिरा भराई नियमावली, 1969 में विहित सभी आवश्यक मुद्रित अपेक्षाएं होंगी। लाइसेंसधारी सुरक्षा कोड के लिए गोदाम परिसर में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड लागू करने के लिये उचित प्रबंध करेगा। वाइन की किसी भी बोतल की बिक्री तब तक नहीं की जायेगी, जब तक उस पर आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा न हो।

8. लाइसेंसधारी को उप आबकारी आयुक्त प्रभार द्वारा अनुमोदित प्राधिकृत प्रतिनिधि बंधित गोदाम में रखना होगा तथा बंधित गोदाम से निकासी और वाइन के आने वाले माल के लिये चढ़ाने व उतारने का प्रबंध करेगा। गोदाम में आई0पी0 एड्रेस रखने वाले कैमरा सहित लगाया जायेगा और अग्निशमन यंत्रों की व्यवस्था की जानी चाहिए।

9. लाइसेंसधारी बंधित गोदाम में वाइन की प्राप्ति, निकासी की गई तथा अवशेष स्टाक की मात्रा का सही-सही लेखा-जोखा रखेगा। दैनिक रजिस्टर के निर्धारित प्रपत्र में वाइन का सही-सही लेखा रखा जायेगा। लेखा रजिस्टर के पृष्ठों पर सम्बन्धित जिला आबकारी अधिकारी के रबर सील के साथ लगाकर पृष्ठ संख्या अंकित की जायेगी। वाइन की प्राप्ति व निकासी के पासों के पृष्ठों व पन्नों को समुचित ढंग से रखा जायेगा तथा आबकारी विभाग के प्राधिकारियों द्वारा निरीक्षण के समय मांॅगने पर प्रस्तुत किया जायेगा। सम्बन्धित विवरण का एम0आई0एस0 (मैनेजमेन्ट इन्फार्मेशन सिस्टम) विहित पोर्टल पर नियत अन्तराल पर अपलोड किया जायेगा ।

शर्तें 10. लाइसेंसधारी बंधित गोदाम से वाइन की निकासी के लिये तथा बंधित गोदाम के समुचित प्रबन्ध के लिये सभी सामान्य नियमों द्वारा नियमतः उत्तरदायी होगा।

11. लाइसेंसधारी, आबकारी आयुक्त द्वारा समय-समय पर दिये गये निदेशों के अनुसार ब्रांडो के रजिस्टे्रशन के लिए रजिस्ट्रेशन शुल्क के साथ अनुमोदित अधिकतम्‌ थोक व अधिकतम्‌ फुटकर बिक्री की दरें, एक्स बांड मूल्य, ब्रांडो की विस्तृत सूची आबकारी आयुक्त को प्रस्तुत करेगा। लाइसेंसधारी किसी लेबुल को प्रयोग करने से पूर्व प्रतिवर्ष चार प्रतियों में आबकारी आयुक्त द्वारा समय-समय पर निर्धारित प्रत्येक लेबुल धारितावार के अनुमोदन शुल्क के साथ ट्रेजरी चालान संलग्न करके सम्बन्धित जिले के जिला आबकारी अधिकारी के समक्ष प्रस्तुत करेगा, जो उसके अनुमोदन के लिये आबकारी आयुक्त को प्रेषित करेगा। अधिकतम फुटकर विक्रय मूल्य की दर में कोई परिवर्तन वर्ष के मध्य में तब तक नहीं किया जायेगा, जब तक कि विशेष रूप से आबकारी आयुक्त द्वारा अनुमति प्रदान न की जाये।

12. लाइसेंसधारी संयुक्त प्रान्त आबकारी अधिनियम, 1910 (अधिनियम-4 सन्‌ 1910) और इनके अन्तर्गत बनाये गये नियमों और आदेशो के उपबंधों के अधीन व इस लाइसेंस की शर्तो का पालन करेगा।

13. यदि लाइसेंस निर्धारित अवधि के पूर्व ही निरस्त किया जाता है या निर्धारित अवधि बीत जाने के पश्चात्‌ नवीकृत नहीं होता है तो लाइसेंसधारी बंधित गोदाम के प्रभारी अधिकारी को बचे हुये वाइन के थोक स्टाक की सूचना देगा और आबकारी आयुक्त द्वारा दिये गये निदेशों के अधीन बचे हुये स्टाक का निस्तारण करेगा।

14. लाइसेंसप्राप्त परिसर 14 अप्रैल (अम्बेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गांॅधी जयन्ती), 26 जनवरी (गणतंत्र दिवस) और 3 ऐसे अतिरिक्त दिनों जैसा कि जिलाधिकारी द्वारा बन्दी के लिये अधिसूचित किया जाय, को छोड़कर बिक्री के लिये सभी दिनों में 9.00 बजे प्रातः से लेकर 8.00 बजे सायं तक खुला रहेगा। लाइसेंसिंग प्राधिकारी/ जिलाधिकारी सम्बन्धित विधियों के अधीन कानून व्यवस्था या सामान्य निर्वाचन सम्बन्धी क्रिया-कलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उक्त दिनांक व दिनों में दुकान की बन्दी के लिये कोई क्षतिपूर्ति देय नहीं होगी।

15. जिलों के एफ0एल0-2 लाइसेंसधारी से वाइन की थोक आपूर्ति हेतु मांॅग-पत्र प्राप्त होने पर आपूर्ति प्रथम आवक प्रथम पावक के सिद्धान्त के अनुसार की जायेगी। ऐसा न करने पर लाइसेंसधारी दण्ड का भागी होगा।

16. बंधित गोदाम से निकासी होने वाले सभी ब्रांडों की बोतलों के लेबुलों पर अधिकतम फुटकर बिक्री मूल्य अंकित होना अनिवार्य है। लेबुलों पर बिना अधिकतम फुटकर विक्रय मूल्य अंकित किये हुये वाइन की बिक्री प्रतिबन्धित है।

17. लाइसेंसधारी अपने गोदाम परिसर से मदिरा की सील्ड पेटियों का उठान उन पर लगे सुरक्षा कोड की स्कैनिंग करने के पश्चात्‌ सुनिश्चित करेगा।

18. उत्तर प्रदेश में आयात की जाने वाली वाइन की पेटियों (कार्टन) की सभी छः सतहों (फेस) पर गाढे़ लाल रंग की डेढ़ इंच चौड़ी पट्‌टी पर कम से कम एक इंच आकार के काले रंग के अक्षरों में "फार सेल इन यूपी" मुद्रित कराया जायेगा।

2. उक्त बंधित गोदाम से आबकारी आयुक्त, उत्तर प्रदेश द्वारा समय-समय पर निर्धारित तीव्रता की ही कम तीव्रता के मादक पेय की निकासी दी जायेगी।

3. बंधित गोदाम के प्रभारी अधिकारी, सम्बन्धित प्रभार के उप आबकारी आयुक्त की पूर्व स्वीकृति से, आयुक्त के आदेश के रहने पर भी, ऐसी कम तीव्रता के मादक पेय जिसे वह उपभोग के लिए संदिग्ध समझता है और जिसका अविलम्ब नमूना भेजकर परीक्षण कराया जाना आवश्यक है, की निकासी रोकने के लिए सक्षम है।

शर्तें 4. लाइसेंसधारी थोक विक्रेताओं द्वारा किये गये विशिष्ट ब्रांडो की मांगो और आवश्यकताओं को दृष्टिगत रखते हुये गोदाम पर ऐसे ब्रांडों के न्यूनतम स्टाक को अनुरक्षित रखेगा।

5. गोदाम में कम तीव्रता के मादक पेय के समुचित अनुरक्षण का उत्तरदायित्व लाइसेंसधारी का होगा। लाइसेंसधारी रैंको की पर्याप्त संख्या में आलमारियॉं, बक्सों और अन्य उपस्कर भंडारण स्टाक के लिये, जो आवश्यक हो, उपलब्ध करायेगा और उस पर प्रभारी अधिकारी के ताले के साथ अपना भी ताला लगायेगा।

6. लाइसेंसधारी आबकारी आयुक्त द्वारा समय-समय पर निर्देशित बोतल/फ्लास्क की धारिता में कम तीव्रता के मादक पेय की आपूर्ति करेगा।

6. लाइसेंसधारी आबकारी आयुक्त द्वारा समय-समय पर निर्देशित बोतल/फ्लास्क /कैन्स की धारिता में कम तीव्रता के मादक पेय की आपूर्ति करेगा।

7. बोतलों पर लगाये गये लेबुलों पर समय-समय पर यथासंशोधित उत्तर प्रदेश विदेशी मदिरा भराई नियमावली, 1969 में विहित सभी आवश्यक मुद्रित अपेक्षाएं होंगी। लाइसेंसधारी गोदाम के परिसर में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड लागू करने हेतु उचित प्रबंध करेगा। कम तीव्रता के मादक पेय के किसी भी बोतल की बिक्री तब तक नहीं की जायेगी, जब तक उस पर आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड चस्पा न हो

8. लाइसेंसधारी को उप आबकारी आयुक्त प्रभार द्वारा अनुमोदित प्राधिकृत प्रतिनिधि बंधित गोदाम में रखना होगा तथा बंधित गोदाम से निकासी और कम तीव्रता के मादक पेय के आने वाला माल के लिये चढ़ाने व उतारने का प्रबंध करेगा। गोदाम में आई0पी0 एड्रेस रखने वाले कैमरा लगाया जायेगा और अग्निशमन यंत्रों की व्यवस्था की जानी चाहिए।

शर्तें 10. लाइसेंसधारी बंधित गोदाम से कम तीव्रता के मादक पेय की निकासी के लिये तथा बंधित गोदाम के समुचित प्रबन्ध के लिये सभी सामान्य नियमों द्वारा नियमतः उत्तरदायी होगा।

10. लाइसेंसधारी बंधित गोदाम से कम तीव्रता के मादक पेय की निकासी के लिये तथा बंधित गोदाम के समुचित प्रबन्ध के लिये सभी सामान्य नियमों द्वारा नियमतः उत्तरदायी होगा। 11. लाइसेंसधारी, आबकारी आयुक्त द्वारा समय-समय पर दिये गये निदेशों के अनुसार ब्रांडाें के रजिस्टे्रशन के लिए रजिस्ट्रेशन शुल्क के साथ अनुमोदित अधिकतम्‌ थोक व अधिकतम्‌ फुटकर विक्री की दरें, एक्स बांड मूल्य, ब्रांडाें की विस्तृत सूची आबकारी आयुक्त को प्रस्तुत करेगा। लाइसेंसधारी किसी लेबुल को प्रयोग करने से पूर्व प्रतिवर्ष चार प्रतियों में आबकारी आयुक्त द्वारा समय-समय पर निर्धारित प्रत्येक लेबुल धारितावार के अनुमोदन शुल्क के साथ ट्रेजरी चालान संलग्न करके सम्बन्धित जिले के जिला आबकारी अधिकारी के समक्ष प्रस्तुत करेगा, जो उसके अनुमोदन के लिये आबकारी आयुक्त को प्रेषित करेगा। अधिकतम फुटकर विक्रय मूल्य की दर में कोई परिवर्तन वर्ष के मध्य में तब तक नहीं किया जायेगा, जब तक कि विशेष रूप से आबकारी आयुक्त द्वारा अनुमति प्रदान न की जाये।

11. लाइसेंसधारी, आबकारी आयुक्त द्वारा समय-समय पर दिये गये निदेशों के अनुसार ब्रांडाें के रजिस्टे्रशन के लिए रजिस्ट्रेशन शुल्क के साथ अनुमोदित अधिकतम्‌ थोक व अधिकतम्‌ फुटकर विक्री की दरें, एक्स बांड मूल्य, ब्रांडाें की विस्तृत सूची आबकारी आयुक्त को प्रस्तुत करेगा। लाइसेंसधारी किसी लेबुल को प्रयोग करने से पूर्व प्रतिवर्ष चार प्रतियों में आबकारी आयुक्त द्वारा समय-समय पर निर्धारित प्रत्येक लेबुल धारितावार के अनुमोदन शुल्क के साथ ट्रेजरी चालान संलग्न करके सम्बन्धित जिले के जिला आबकारी अधिकारी के समक्ष प्रस्तुत करेगा, जो उसके अनुमोदन के लिये आबकारी आयुक्त को प्रेषित करेगा। अधिकतम फुटकर विक्रय मूल्य की दर में कोई परिवर्तन वर्ष के मध्य में तब तक नहीं किया जायेगा, जब तक कि विशेष रूप से आबकारी आयुक्त द्वारा अनुमति प्रदान न की जाये।

12. लाइसेंसधारी संयुक्त प्रान्त आबकारी अधिनियम, 1910 (अधिनियम संख्या 4 सन्‌ 1910) और इनके अन्तर्गत बनाये गये नियमों और आदेशाें के उपबंधाें के अधीन व इस लाइसेंस की शर्तो का पालन करेगा।

13. यदि लाइसेंस निर्धारित अवधि के पूर्व ही निरस्त किया जाता है या निर्धारित अवधि बीत जाने के पश्चात्‌ नवीकृत नहीं होता है तो लाइसेंसधारी बंधित गोदाम के प्रभारी अधिकारी को बचे हुये कम तीव्रता के मादक पेय के थोक स्टाक की सूचना देगा और आबकारी आयुक्त द्वारा दिये गये निदेशों के अधीन बचे हुये स्टाक का निस्तारण करेगा।

15. जिलोें के एफ0एल0-2बी लाइसेंसधारियों से कम तीव्रता के मादक पेय की थोक आपूर्ति हेतु माँग-पत्र प्राप्त होने पर आपूर्ति प्रथम आवक प्रथम पावक के सिद्धान्त के अनुसार की जायेगी। ऐसा न करने पर लाइसेंसधारी दण्ड का भागी होगा।

16. बंधित गोदाम से निकासी होने वाले सभी ब्रांडों की बोतलों के लेबुलों पर अधिकतम फुटकर बिक्री मूल्य अंकित होना अनिवार्य है। लेबुलों पर बिना अधिकतम फुटकर बिक्रय मूल्य अंकित किये हुये कम तीव्रता के मादक पेय की बिक्री प्रतिबन्धित है।

18- उत्तर प्रदेश में आयात की जाने वाली कम तीव्रता के मादक पेय की पेटियों (कार्टन) की सभी छः सतहों (फेस) पर गाढे़ लाल रंग की डेढ़ इंच चौड़ी पट्‌टी पर कम से कम एक इंच आकार के काले रंग के अक्षरों में "फार सेल इन यूपी" मुद्रित कराया जायेगा।

NOTIFICATION In exercise of the powers under section 41 of the United Provinces Excise Act, 1910 (U.P. Act. no. IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act. no. 1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, makes the following rules with a view to amending the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouses) Rules, 2011 for the grant of Licenses of Foreign Liquor Bonded Warehouse under clause(d) of section 18 of the said Act of 1910 on fixed License fee in supersession of all the previous rules published in this behalf to the extent of their inconsistency with these rules.

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR FOREIGN LIQUOR BONDED WAREHOUSE ) (SIXTH AMENDMENT) RULES, 2020

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse) (Sixth Amendment) Rules, 2020.

(2) They shall come into force with effect from the date of their publication in the Gazette.

2. Amendment of Rule 2–In the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse Rules, 2011, hereinafter referred to as the said rules, for existing rule-2 set out in Column- I below, the rule as set out in Column-II shall be substituted, namely-

2. Definition:

(i) "Act" means the United Provinces Excise Act, 1910 as amended from time to time;

(ii) "District Excise Officer" means an officer of the Excise Department not below the rank of an Assistant Excise Commissioner or an officer of the Revenue Department not below the rank of Sub-Divisional Magistrate, duly appointed and vested with the powers under clause (b) of sub-section (2) of section- 10 of the Act.

(iii) "Excise Year" means the period of 12 months commencing from 1st day of April of a calendar year;

(iv) "Form" means form appended to (iv) "Form" means form appended to these rules;

(iv) "Foreign Liquor" means Indian Made Foreign Liquor (IMFL), beer, wine and Low strength Alcoholic Beverages (LAB).

(vi) "Licensee" means a Distillery, Brewery , Vintinery or Bottling Unit of other State to whom a License in Form BWFL-2A, BWFL-2B, BWFL-2C & BWFL-2D has been granted for running a Bonded Warehouse of Foreign Liquor.

(ix) "Officer in-charge" means an officer of the Excise Department nominated by the Excise Commissioner not below the rank of Excise Inspector.

(x) "Security amount" means the amount fixed by the Excise Commissioner which is to be deposited through Fixed Deposit Receipt pledged in favour of Excise commissioner Uttar Pradesh, or through e-payment and shall be refundable after final settlement of Licenses under consideration of entire claims and dues of State Government.

(xi) "Consideration Fee" means a fee for foreign liquor, wine, beer and low alcoholic beverages as fixed by the State Government under section 30 of the Excise Act, which shall be deposited in treasury by the licensee prior to supply.

(xii) "Additional Consideration Fee" means difference amount obtained as a result of rounding off the maximum retail price of foreign liquor, wine ,beer and low alcoholic beverages to the next multiple of ten, which shall be payable at licenced bonded warehouse level and recoverable by the licencee of the bonded ware house from wholesale supplier in addition to Ex-Distillery/Ex-Brewery Price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price.

(xii) "Additional Consideration Fee" means difference amount obtained as a result of rounding off the maximum retail price of foreign liquor, wine ,beer and low alcoholic beverages to the next multiple of ten, which shall be payable at licenced bonded warehouse level and recoverable by the licencee of the bonded ware house fro m wholesale supplier in addition to Ex-Distillery/Ex-Brewery Price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price.

(xiii) "Import permit fees" means fee imposed on foreign liquor, wine, beer and low alcoholic beverages imported from overseas or any state or union territory outside the Uttar Pradesh.

(5) License fee shall be deposited by the licensee through e-payment in Government Treasury or by Bank-draft issued by a Nationalized Bank payable to Excise Commissioner.

(8) Any out of state unit having multiple units in other states, desirous of selling IMFL/ Beer /Wine/LAB manufactured in its different units from same premises after obtaining bond licenses in Uttar Pradesh, may be allowed so after charging prescribed license fee for every unit provided that consignment from various units shall be stored separately in that premises.

(7) The license shall not be permitted to transfer or sublet the license to any other person. (8) Any out of state unit having multiple units in other states, desirous of selling IMFL/ Beer/Wine/LAB manufactured in its different units including FL-1 and FL-1A from a master warehouse same premises after obtaining bond licenses in Uttar Pradesh, may be allowed so after charging prescribed license fee for every unit: "Provided that consignment from various units shall be stored separately in that premises;

(9) In case of renewal security deposited prior in cash or through National Saving Certificate shall be acceptable till it is not refunded.

4-- Amendment of rule-5--In the said rules, for existing rule-5 setout in Column-I below, the rule as setout in Column-II shall be substituted, namely-

How to obtain Foreign liquor- Foreign liquor, beer, wine and low strength alcoholic beverages may be obtained by license holder of bond from his own Distillery, Brewery, Ventinery or Bonded Warehouse outside Uttar Pradesh on a permit in define format of annexed FL- 22 Form issued by the Collector belonging to the district of license holder under rules.

16. Suspension, Cancellation and Penalties

16. Suspension, Cancellation and Penalties (1) Licensing Authority may suspend or cancel the license and forfeit the security money and imposed fine,-

(a) if any bottle or container of liquor which does not carry security code as approved by the Excise Department, is found to be sold from the licensed premises.

(b) if any other kind of liquor or intoxicating drug for which license is not granted, is found in the licensed premises.

(c) if licensee charges from wholesaler more than the ex-bond price declared at the time of brand registration before the Excise Commissioner, except consideration fee and other taxes and duties if any.

(d) if any unauthorized security code equipment, spirit, colour, essence etc. is found in the licensed premises.

(e) if licensee has made incorrect or fraudulent entries in records which resulted in loss of revenue.

(f) if any liquor or intoxicating drug is found in the possession of the licensee against the provision of the Act or rules.

(g) if licensee fails to supply the liquor within 48 hours of the receipt of the indent for supply of same alongwith price including taxes if any.

(2) In case irregularities mentioned in sub- clause (1) are found, the Licensing Authority shall immediately suspend the license and issue a show cause notice for cancellation of license and forfeiture of security amount. The licensee shall submit his explanation within 7 days of the receipt of notice. Thereafter the Licensing Authority shall pass suitable orders as he deems fit.

(3) The Licensing Authority shall also recover the loss of excise revenue caused due to incorrect entries or irregularities committed by the Licensee or his salesman from the licensee after adopting the procedure of sub-rule(2).

3- The Officer In-charge of the Bonded Warehouse is empowered to stop with the prior sanction of the Deputy Excise Commissioner of the charge concerned, pending the orders of the Excise Commissioner, the issues of foreign liquor which he considers doubtful for consumption and is required to send samples of such foreign liquor for analysis without delay. 4- The licensee shall maintain such minimum stock of such brand at the warehouse keeping in view the demands and requirements of the particular brands by the wholesale vendors.

The account shall be correctly maintained up to date daily in a register in prescribed form. Pages of the Account Register shall be numbered and sealed with a rubber seal of concerned District Excise Officer. Pages and counterfoils of the passes covering the receipt and issues of foreign liquor shall be properly kept and shall at all times be open to inspection by the authorities of Excise Department. 14- In case the licence is cancelled during the currency of the period of licence or is not renewed on its expiry, the licensee shall forthwith intimate the whole stock of foreign liquor held in balance at the Bonded Warehouse to the Officer In-charge and dispose off the balance stock only under directions given by the Excise Commissioner. 15- The license premises shall remain open for sale on all days from 9.00 am. to 8.00 pm by evening, except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26 January (Republic Day) and upto 3 more days as notified by the Collector. The Licensing Authority/ Collector may also order for closure of shop in account of law and order or General Election related activity etc. under the provisions of relevant laws. No compensation shall be given for the closure of shop on above dates/ days.
