उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन्‌ 1910) की धारा 24-ख और 41 के अधीन शक्तियों का प्रयोग करके, आबकारी आयुक्त, उत्तर प्रदेश एतद्‌द्वारा राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त की अधिसूचना संख्या 12011/दस-लाइसेंस-77/इलाहाबाद 21 मार्च, 2001 (समय-समय पर यथासंशोधित) द्वारा प्रकाशित उत्तर प्रदेश आबकारी (बीयर के फुटकर विक्र्रय के अनुज्ञापनों का व्यवस्थापन) नियमावली,2001 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते है-

उत्तर प्रदेश आबकारी (बीयर के फुटकर विक्र्रय के अनुज्ञापनों का व्यवस्थापन) ( अट्‌ठारहवां संशोधन) नियमावली, 2020

1-संक्षिप्त नाम और प्रारम्भ-(1) यह नियमावली उत्तर प्रदेश आबकारी (बीयर के फुटकर विक्रय के अनुज्ञापनों का व्यवस्थापन) ( अट्‌ठारहवां संशोधन) नियमावली, 2020 कही जायेगी, 2-(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृृत्त होगी। 2-नियम-2-का संशोधन-उत्तर प्रदेश आबकारी (बीयर के फुटकर विक्र्रय के अनुज्ञापनों का व्यवस्थापन) नियमावली, 2001, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-2 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

2(1) परिभाषायें जब तक विषय या संदर्भ से कोई 2(1) ifjHkk"kk;sa जब तक विषय ;k संदर्भ से कोई

बात प्रतिकूल न हो, इस नियमावली में-

(क)"अधिनियम" का तात्पर्य संयुक्त प्रान्त आबकारी (क)"अधिनियम" का तात्पर्य संयुक्त प्रान्त आबकारी

अधिनियम, 1910 से है;

(ख) "बीयर" में एल, स्टाउट, पोर्टर, साइडर तथा माल्ट से बनी अन्य सभी किष्वित शराब जिसकी तीव्रता 3 प्रतिशत वी/वी से 8 प्रतिशत वी/वी के मध्य है, सम्मिलित हैं;

(ग) "दैनिक लाइसेंस फीस" का तात्पर्य सम्पूर्ण (ग) "दैनिक लाइसेंस फीस" का तात्पर्य सम्पूर्ण

वर्ष के लिए निर्धारित लाइसेंस फीस के 1/365 वें भाग से हैै;

(घ) "आबकारी o"kZÞ का तात्पर्य एक अप्रैल से प्रारम्भ होकर आगामी कैलेण्डर o"kZ के 31 मार्च तक चलने वाले वित्तीय वर्ष से है;

वर्ष के लिए निर्धारित लाइसेंस फीस के 1/365 वें भाग से हैै; (घ) "आबकारी वर्ष" का तात्पर्य एक अप्रैल से प्रारम्भ होकर आगामी कैलेण्डर वर्ष के 31 मार्च तक चलने वाले वित्तीय वर्ष से है;

(ड) "परिवार" का तात्पर्य दम्पति (पति या पत्नी), आश्रित पुत्र/पुत्रों, अविवाहिता पुत्री/पुत्रियां तथा आश्रित माता-पिता से है और इसमें वे सम्मिलित हैं;

(ड ) "परिवार" का तात्पर्य दम्पति (पति या पत्नी), आश्रित पुत्र/पुत्रों, अविवाहिता पुत्री/पुत्रियां तथा आश्रित माता-पिता से है और इसमें वे सम्मिलित हैं;

(च) "प्रपत्र" का तात्पर्य इस नियमावली के साथ संलग्न (च) "प्रपत्र" का तात्पर्य इस नियमावली के साथ

प्रपत्र से है;

संलग्न प्रपत्र से है;

(छ) "लाइसेंस प्राधिकारी" का तात्पर्य जिले के कलेक्टर (छ) "लाइसेंस प्राधिकारी" का तात्पर्य जिले के

से है;

कलेक्टर से है;

(ज) "लाइसेंस फीस" का तात्पर्य अधिनियम की धारा 24-क के अधीन फुटकर बिक्र्री की दुकान से बीयर एवं कम तीव्रता के मादक पेय की फुटकर बिक्र्री के एकान्तिक विशेषाधिकार के लिये, राज्य सरकार के परामर्श से, आबकारी आयुक्त द्वारा समय-समय पर सम्पूर्ण आबकारी वर्ष अथवा उसके आंशिक भाग के लिये लाइसेंस दिये जाने हेतु प्रतिफल के रूप में ली जाने वाली नियत राशि से है,

(ज) लाइसेंस फीस का तात्पर्य अधिनियम की धारा 24-क के अधीन फुटकर बिक्र्री की दुकान से बीयर, वाइन एवं कम तीव्रता के मादक पेय की फुटकर बिक्र्री के एकान्तिक विशेषाधिकार के लिये, राज्य सरकार के परामर्श से, आबकारी आयुक्त द्वारा समय-समय पर सम्पूर्ण आबकारी वर्ष अथवा उसके आंशिक भाग के लिये लाइसेंस दिये जाने हेतु प्रतिफल के रूप में ली जाने वाली नियत राशि से है, परन्तु यदि ऐसी दुकान का व्यवस्थापन अथवा पुनव्र्यवस्थापन मध्य सत्र में अवशेष अवधि के लिये किया जाता है, तो दुकान के लिए लाइसेंस फीस का निर्धारण वर्ष की अवशेश अवधि के समानुपात में किया जायेगा। परन्तु यदि ऐसी दुकान का व्यवस्थापन अथवा पुनव्र्यवस्थापन मध्य सत्र में अवशेश अवधि के लिये किया जाता है, तो दुकान के लिए लाइसेंस फीस का निर्धारण वर्ष की अवशेश अवधि के समानुपात में किया जायेगा।

(झ) "प्रतिभूति धनराशि" का तात्पर्य जिला आबकारी अधिकारी के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा राज्य सरकार के प्रति समस्त दावों और देयों का अन्तिम निस्तारण करने के पश्चात्‌ प्रतिसंदेय ई-भुगतान के माध्यम से जमा की जाने वाली लाईसेंस फीस के दस प्रतिशत के बराबर की धनराशि से है।

(झ) "प्रतिभूति धनराशि" का तात्पर्य जिला आबकारी अधिकारी के पक्ष में गिरवीकृत राष्ट्रीय बचत पत्र/सावधि जमा रसीद के माध्यम से अथवा राज्य सरकार के प्रति समस्त दावों और देयों का अन्तिम निस्तारण करने के पश्चात्‌ प्रतिसंदेय ई-भुगतान के माध्यम से जमा की जाने वाली लाईसेंस फीस के दस प्रतिशत के बराबर की धनराशि से है।

परन्तु नवीकरण की स्थिति में पूर्व में नकद जमा की गयी प्रतिभूति तब तक स्वीकार्य होगी, जब तक इसकी वापसी न कर दी जाय;

परन्तु नवीकरण की स्थिति में पूर्व में नकद अथवा राष्ट्रीय बचत पत्र के माध्यम से जमा की गयी प्रतिभूति तब तक स्वीकार्य होगी, जब तक इसकी वापसी न कर दी जाय;

स्तम्भ-1 विद्यमान नियम (ञ) "कम तीव्रता के मादक पेय" का तात्पर्य कारबोनेट युक्त मादक पेय से है, जिसमें 5 प्रतिशत वी/वी तक तीव्रता और 5 प्रतिशत वी/वी से अधिक 10 प्रतिशत वी/वी तक तीव्रता एल्कोहल हो, जो एक्सट्रा न्यूट्रल अल्कोहल (ई0एन0ए0) से निर्मित की गई हो और जो वासक या रंजक द्रव्य या दोनों या अन्य द्रव्य को मिलाकर परिष्कृत की गयी हो जिससे कि वह विशिष्ट स्वाद वाली हो जाय ; (ट)''अतिरिक्त प्रतिफल शुल्क'' का तात्पर्य, अधिकतम फुटकर मूल्य को 10 के गुणांक में अगले स्तर पर लाने के फलस्वरूप प्राप्त अन्तर की धनराशि से है, जो अतिरिक्त एक्स आसवनी मूल्य के रूप में यवासवनी स्तर पर संदेय होगी और यवासवनी द्वारा थोक आपूर्तिकर्ता से वसूली योग्य होगी तथा जो बाद में थोक आपूर्तिकर्ता द्वारा फुटकर लाइसेंसधारी से अधिकतम थोक मूल्य के अलावा वसूल की जा सकेगी;

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (ञ) "कम तीव्रता के मादक पेय" का तात्पर्य कारबोनेट युक्त मादक पेय से है, जिसमें 5 प्रतिशत वी/वी तक तीव्रता और 5 प्रतिशत वी/वी से अधिक 10 प्रतिशत वी/वी तक तीव्रता एल्कोहल हो, जो एक्सट्रा न्यूट्रल अल्कोहल (ई0एन0ए0) से निर्मित की गई हो और जो वासक या रंजक द्रव्य या दोनों या अन्य द्रव्य को मिलाकर परिष्कृत की गयी हो जिससे कि वह विशिष्ट स्वाद वाली हो जाय ; (ट)''अतिरिक्त प्रतिफल शुल्क'' का तात्पर्य, अधिकतम फुटकर मूल्य को 10 के गुणांक में अगले स्तर पर लाने के फलस्वरूप प्राप्त अन्तर की धनराशि से है, जो अतिरिक्त एक्स आसवनी मूल्य के रूप में यवासवनी स्तर पर संदेय होगी और यवासवनी द्वारा थोक आपूर्तिकर्ता से वसूली योग्य होगी तथा जो बाद में थोक आपूर्तिकर्ता द्वारा फुटकर लाइसेंसधारी से अधिकतम थोक मूल्य के अलावा वसूल की जा सकेगी;

(ठ) 'धरोहर धनराशि' का तात्पर्य लाइसेंस की स्वीकृति के लिये पात्रता की शर्तों की पूर्ति सुनिश्चित किये जाने के लिये आवेदन-पत्र के साथ जमा की जाने वाली लाइसेंस फीस की धनराशि के 1/10 भाग के बराबर की धनराशि से है, जो व्यतिक्र्रम की दशा में इस नियमावली के नियम-12 के उपबन्धों के अधीन जब्त किये जाने योग्य होगी; (ड) 'अनुक्रम' का तात्पर्य ई/लाटरी प्रक्र्रिया के माध्यम से लाइसेंसधारी के चयन के लिये आधार के रूप में तात्पर्यित दुकानों की धरोहर धनराशि के अवरोही क्रम से है;

(ड) 'अनुक्रम' का तात्पर्य ई/लाटरी प्रक्रिया के माध्यम से लाइसेंसधारी के चयन के लिये आधार के रूप में तात्पर्यित दुकानों की धरोहर धनराशि के अवरोही क्रम से है;

(ढ)''पोर्टल'' का तात्पर्य विशेष रूप से निर्मित इलेक्ट्रानिक प्लेटफार्म, जिस पर मदिरा निर्माण की प्रक्र्रिया से सम्बन्घित इसके वितरण के समाप्य अवस्था तक की सूचनाओं को विहित प्रारूप में अपलोड किया जायेगा, से है;

(ण)''ऋणशोधन क्षमता''का तात्पर्य फुटकर लाइसेंस की स्वीकृति के लिये आवेदन करने वाले आवेदक के लिये निर्धारित वित्तीय मानदण्ड से है;

(त) ''व्यक्ति '' का तात्पर्य ऐसे व्यक्ति से है जो आवेदन करने के समय इक्कीस वर्ष की आयु से अन्यून, भारत का नागरिक हो;

(ढ)''पोर्टल'' का तात्पर्य विशेष रूप से निर्मित इलेक्ट्रानिक प्लेटफार्म, जिस पर मदिरा निर्माण की प्रक्र्रिया से सम्बन्धित इसके वितरण के समाप्य अवस्था तक की सूचनाओं को विहित प्रारूप में अपलोड किया जायेगा, से है; (ण)''ऋणशोधन क्षमता''का तात्पर्य फुटकर लाइसेंस की स्वीकृति के लिये आवेदन करने वाले आवेदक के लिये निर्धारित वित्तीय मानदण्ड से है; (त) ''व्यक्ति '' का तात्पर्य ऐसे व्यक्ति से है जो आवेदन करने के समय इक्कीस वर्ष की आयु से अन्यून, भारत का नागरिक हो; (थ) ''व्यवस्थापन'' का तात्पर्य नवीकरण, ई-लाटरी अथवा ई-टेण्डर के माध्यम से दुकानों के व्यवस्थापन अथवा पुनव्र्यवस्थापन से है, जो समाचार-पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के लिये दुकानों का व्यवस्थापन विगत वित्तीय वर्ष की समाप्ति के पूर्व किया जा सकता है;

(थ) ''व्यवस्थापन'' का तात्पर्य नवीकरण, ई-लाटरी अथवा ई-टेण्डर के माध्यम से दुकानों के व्यवस्थापन अथवा पुनव्र्यवस्थापन से है, जो समाचार-पत्र एवं आबकारी विभाग की वेबसाइट के माध्यम से पूर्व नोटिस एवं संसूचना देकर सप्ताह के किसी दिन में हो सकता है। आगामी वर्ष के लिये दुकानों का व्यवस्थापन विगत वित्तीय वर्ष की समाप्ति के पूर्व किया जा सकता है;

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (द) ''प्रतिफल शुल्क'' का तात्पर्य आबकारी अधिनियम की धारा 30 के अधीन बियर और कम तीव्रता के मादक पेय पर राज्य सरकार द्वारा यथानिर्धारित शुल्क से है, जो बियर और कम तीव्रता के मादक पेय की आपूर्ति से पूर्व लाइसेंसधारी द्वारा सरकारी कोषागार में जमा की जायेगी;

(द) ''प्रतिफल शुल्क'' का तात्पर्य आबकारी अधिनियम की धारा 30 के अधीन बियर, वाइन और कम तीव्रता के मादक पेय पर राज्य सरकार द्वारा यथानिर्धारित शुल्क से है, जो बियर और कम तीव्रता के मादक पेय की आपूर्ति से पूर्व लाइसेंसधारी द्वारा सरकारी कोषागार में जमा की जायेगी;

(ध) 'राज्य' का तात्पर्य उत्तर प्रदेश राज्य से है। (ध) 'राज्य' का तात्पर्य उत्तर प्रदेश राज्य से है। (न) 'वाइन' का तात्पर्य द्राक्षासव या किसी अन्य फल के गूदे या रस के अल्कोहलयुक्त किण्वन से प्राप्त उत्पाद से है जो प्राकृतिक हो या तेज की गयी हो और जिसकी अल्कोहलिक अन्र्तवस्तु 42 प्रतिशत प्रूफ स्प्रिट से अधिक न हो।

(2) इस नियमावली में अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम में क्र्रमशः उनके लिए समनुदेशित हों।

(2) इस नियमावली में अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और पदों के वही अर्थ होंगे जो अधिनियम में क्र्रमशः उनके लिए समनुदेशित हों। 3-नियम-6 का संशोधन- उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-6 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम नियम-6 लाइसेंस की स्वीकृति -

इस नियमावली के उपबन्धों के अनुसार लाइसेंस फीस का अधिमानतः ई-पेमेन्ट प्लेटफार्म के माध्यम से भुगतान किये जाने पर और जिला आबकारी अधिकारी के पक्ष में गिरवीकृत राष्ट्रीय बचत पत्र/सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से प्रतिभूति जमा किये जाने पर लाइसेंस स्वीकृत किया जायेगा। परन्तु नवीकरण की स्थिति में पूर्व में नकद जमा की गयी प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जायेगी। लाइसेंसधारी से यह अपेक्षा की जायेगी कि वह उस जिले में ऋणशोधन क्षमता प्रमाण पत्र अथवा प्राधिकृत आयकर मूल्यांकन द्वारा निर्गत सम्पत्ति स्वमित्व प्रमाण-पत्र की मूलप्रति प्रस्तुत करे, जहॉ से उसे लाइसेंस स्वीकृति के समय जारी किया गया है।

नियम-6 लाइसेंस की स्वीकृति - इस नियमावली के उपबन्धों के अनुसार लाइसेंस फीस का अधिमानतः ई-पेमेन्ट प्लेटफार्म के माध्यम से भुगतान किये जाने पर और जिला आबकारी अधिकारी के पक्ष में गिरवीकृत सावधि जमा रसीद के माध्यम से अथवा ई-पेमेन्ट के माध्यम से प्रतिभूति जमा किये जाने पर लाइसेंस स्वीकृत किया जायेगा। परन्तु नवीकरण की स्थिति में पूर्व में नकद अथवा राष्ट्रीय बचत पत्र के माध्यम से जमा की गयी प्रतिभूति तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जायेगी। लाइसेंसधारी से यह अपेक्षा की जायेगी कि वह उस जिले में ऋणशोधन क्षमता प्रमाण-पत्र अथवा प्राधिकृत आयकर मूल्यांकन द्वारा निर्गत सम्पत्ति स्वमित्व प्रमाण-पत्र की मूलप्रति प्रस्तुत करे, जहॉ से उसे लाइसेंस स्वीकृति के समय जारी किया गया है।

4-नियम 8 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-8 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

8-आवेदकों के लिए पात्रता की शर्ते-

8-आवेदकों के लिए पात्रता की शर्ते- फुटकर बीयर की बिक्र्री की दुकानों के लाइसेंस के लिए पात्र आवेदकों को निम्नलिखित शर्तें पूरी करनी होगी- अर्थात्‌-

फुटकर बीयर की बिक्र्री की दुकानों के लाइसेंस के लिए पात्र आवेदकों को निम्नलिखित शर्तें पूरी करनी होगी- अर्थात्‌-

(क) आवेदन, एक व्यक्ति द्वारा हो जो भारत का नागरिक हो, परन्तु नवीकरण की स्थिति में सह-आवेदक, यदि कोई हो, जो भारत का नागरिक हो, भी अनुज्ञात होगा।

(क) आवेदन, एक व्यक्ति द्वारा हो जो भारत का नागरिक हो, परन्तु नवीकरण की स्थिति में सह-आवेदक, यदि कोई हो, जो भारत का नागरिक हो, भी अनुज्ञात होगा।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 5 स्तम्भ-1 विद्यमान नियम भागीदार वाली फर्म अथवा कम्पनी, फुटकर लाइसेंस की स्वीकृति के लिये अर्ह नहीं होगी। इसी प्रकार थोक विक्रेे्रता अथवा आसवनी/यवासवनी/मदिरा/बीयर निर्माता भी किसी प्रकार की फुटकर दुकान का लाइसेंस धारण करने के लिये पात्र नहीं होगा।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम भागीदार वाली फर्म अथवा कम्पनी, फुटकर लाइसेंस की स्वीकृति के लिये अर्ह नहीं होगी। इसी प्रकार थोक विक्रेता अथवा आसवनी/यवासवनी/मदिरा/बीयर निर्माता भी किसी प्रकार की फुटकर दुकान का लाइसेंस धारण करने के लिये पात्र नहीं होगा।

दुकान के आवंटन के पश्चात्‌ आवेदक की प्रास्थिति में कोई परिवर्तन अनुज्ञात न होगा। लाइसेंसधारी की मृत्यु की दशा में उसका विधिक वारिस, यदि अन्यथा पात्र हों, लाइसेंस की अवशेष अवधि के लिए लाइसेंस बना रह सकता है।

दुकान के आवंटन के पश्चात्‌ आवेदक की प्रास्थिति में कोई परिवर्तन अनुज्ञात न होगा। लाइसेंसधारी की मृत्यु की दशा में उसका विधिक वारिस, यदि अन्यथा पात्र हो लाइसेंस की अवशेष अवधि के लिए लाइसेंस बना रह सकता है।

परन्तु यह और कि यदि संयुक्त रूप से दो व्यक्तियों द्वारा लाइसेंस प्राप्त किया गया हो, तो किसी एक व्यक्ति की मृत्यु की दशा में जीवित व्यक्ति मृतक के विधिक वारिस (वारिसों) के साथ यदि अन्यथा पात्र हों, लाइसेंस बना रह सकेगा या दोनों व्यक्तियों की मृत्यु की दशा में उसके विधिक वारिस (उत्तराधिकारी) यदि अन्यथा पात्र हो, लाइसेंंस बना रह सकेगा दो व्यक्तियों के वैधानिक दायित्वों के मध्य कोई भेद नहीं किया जायेगा जो संयुक्त रूप से और अलग-अलग उत्तरदायी होेंगे।

परन्तु यह और कि यदि संयुक्त रूप से दो व्यक्तियों द्वारा लाइसेंस प्राप्त किया गया हो, तो किसी एक व्यक्ति की मृत्यु की दशा में जीवित व्यक्ति मृतक के विधिक वारिस (वारिसाें) के साथ यदि अन्यथा पात्र हों, लाइसेंस बना रह सकेगा या दोनों व्यक्तियों की मृत्यु की दशा में उसके विधिक वारिस (उत्तराधिकारी) यदि अन्यथा पात्र हो, लाइसेंंस बना रह सकेगा दो व्यक्तियों के वैधानिक दायित्वों के मध्य कोई भेद नहीं किया जायेगा जो संयुक्त रूप से और अलग-अलग उत्तरदायी होेंगे। (ख) आवेदन-पत्र प्राप्त किये जाने के लिये नियत अवधि के प्रथम दिवस पर इक्कीस वर्ष की आयु से अधिक हो। (ख) आवेदन-पत्र प्राप्त किये जाने के लिये नियत अवधि के प्रथम दिवस पर इक्कीस वर्ष की आयु से अधिक हो।

(ग) व्यतिक्र्रमी/काली सूची वाला न हो या अधिनियम या तद्‌धीन बनाई गयी नियमावली के उपबन्धों के अधीन आबकारी लाइसेंस धारण करने से विवर्जित न किया गया हो। कोई व्यक्ति, जो किसी आबकारी अपराध के लिए दोषसिद्ध पाया गया हो, लाइसेंस धारण करने से स्वतः विवर्जित हो जायेगा जब तक कि उसे सक्षम न्यायालय द्वारा पूर्णतः और अन्तिम रूप से दोषमुक्त न कर दिया गया हो।

(घ) निम्नलिखित के प्रमाण स्वरूप पब्लिक नोटरी

द्वारा सम्यक्‌ रुप से सत्यापित शपथपत्र प्रस्तुत करेगाः-

(एक) यह कि उसके पास समय-समय पर यथा संशोधित उत्तर प्रदेश आबकारी दुकानों की संख्या एवं स्थिति नियमावली, 1968 के उपबंधों के अनुसार उस स्थान पर दुकान खोलने हेतु उपयुक्त परिसर है अथवा उसने किराये पर उस स्थान पर उपयुक्त परिसर का प्रबन्ध किया है।

(गग) आवेदनकर्ता, किसी एक दुकान के लिए स्वंय के नाम से मात्र एक आवेदन-पत्र प्रस्तुत किये जाने के लिए पात्र होगा। परन्तु नवीकरण की स्थिति में आवेदक एवं सह-आवेदक दोनों पात्र हाेंगे तथा नवीकरण हेतु उनकी पारस्परिक सहमति आवश्यक होगी। (घ) निम्नलिखित के प्रमाण स्वरूप पब्लिक नोटरी द्वारा सम्यक्‌ रुप से सत्यापित शपथपत्र प्रस्तुत करेगाः- (एक) यह कि उसके पास समय-समय पर यथा संशोधित उत्तर प्रदेश आबकारी दुकानों की संख्या एवं स्थिति नियमावली, 1968 के उपबंधों के अनुसार उस स्थान पर दुकान खोलने हेतु उपयुक्त परिसर है अथवा उसने किराये पर उस स्थान पर उपयुक्त परिसर का प्रबन्ध किया है।6 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (दो) यह कि उसकी दुकान के प्रस्तावित परिसर के निर्माण में किसी विधि अथवा नियमों का उल्लंघन नहीं किया गया है।

(दो) यह कि उसकी दुकान के प्रस्तावित परिसर के निर्माण में किसी विधि अथवा नियमों का उल्लंघन नहीं किया गया है।

(तीन) यह कि उसका एवं उसके परिवार के सदस्यों का नैतिक चरित्र अच्छा है और उनकी कोई अपराधिक पृष्ठभूमि नहीं है और संयुक्त प्रान्त आबकारी अधिनियम, 1910 या स्वापक औषधि एवं मनःप्रभावी अधिनियम 1985 के अधीन दण्डनीय किसी अपराध या किसी अन्य संज्ञेय एवं गैर जमानती अपराध के लिए दोष सिद्व न किया गया हो।

(चार) यह कि अनुज्ञापी के रूप में उसके चयनित हो जाने की दशा में जिला, जहांॅ का वह निवासी है, के वरिष्ठ पुलिस अधीक्षक/पुलिस अधीक्षक द्वारा जारी प्रमाण-पत्र यह दर्शाते हुए प्रस्तुत करना होगा कि लाइसेंस जारी होने के पूर्व उसका एवं उसके परिवार के सदस्यों का नैतिक चरित्र अच्छा है एवं उनकी कोई अपराधिक पृष्ठभूमि या आपराधिक अभिलेख नहीं है। (पॉंच) यह कि वह किसी ऐसे व्यक्ति को बिक्रीकर्ता या प्रतिनिधि के रूप में नियोजित नहीं करेगा, जिसकी कोई आपराधिक पृष्ठभूमि होगी, जैसा कि खण्ड-तीन में उल्लिखित है या जो किसी संक्रामक रोग से ग्रसित हो या 21 वर्ष से कम आयु का हो या महिला हो। लाइसेंसधारी जिला आबकारी अधिकारी से अधिकृत बिक्रेता/प्राधिकृत प्रतिनिधि का फोटोयुक्त पहचान-पत्र प्राप्त करेगा।

(पॉंच) यह कि वह किसी ऐसे व्यक्ति को बिक्रीकर्ता या प्रतिनिधि के रूप में नियोजित नहीं करेगा, जिसकी कोई आपराधिक पृष्ठभूमि होगी, जैसा कि खण्ड-तीन में उल्लिखित है या जो किसी संक्र्रामक रोग से ग्रसित हो या इक्कीस वर्ष से कम आयु का हो या महिला हो। लाइसेंसधारी जिला आबकारी अधिकारी से अधिकृत बिक्रे्रता/प्राधिकृत प्रतिनिधि का फोटोयुक्त पहचान-पत्र प्राप्त करेगा।

(छः) यह कि उस पर किसी सार्वजनिक देयों या (छः) यह कि उस पर किसी सार्वजनिक देयों या सरकारी देयों का बकाया नहीं है।

सरकारी देयों का बकाया नहीं है।

(सात) यह कि वह ऋणशोधक्षम है और आवश्यक निधि रखता है या उसने कारोबार के संचालन के लिए आवश्यक निधि का प्रबन्ध कर लिया है, जिसका ब्योरा, यदि अपेक्षित होगा, लाइसेंस प्राधिकारी को उपलब्ध करा देगा।

(आठ) यह कि आवेदक माफिया गतिविधियों, असामाजिक गतिविधियों एवं संगठित अपराधिक गतिविधियों में लिप्त नहीं है। यदि लाइसेंस प्राप्त हो जाने के उपरान्त यह प्रमाणित हो जाता है कि वह माफिया गतिविधियों, असामाजिक गतिविधियों एवं संगठित अपराधिक गतिविधियों में लिप्त है तो उसे आवंटित किया गया लाइसेंस निरस्त कर दिया जायेगा।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (नौ) यह कि आवेदक बार काउसिंल में रजिस्ट्रीकृत अधिवक्ता नहीं है। यदि लाइसेंस प्राप्त कर लेने पर उसे बार काउसिंल में रजिस्ट्रीकृत अधिवक्ता पाया जाता है तो लाइसेंस निरस्त कर दिया जायेगा। राज्य सरकार का कर्मचारी भी लाइसेंस स्वीकृति हेतु आवेदन करने के लिये अपात्र होगा।

(नौ) यह कि आवेदक बार काउसिंल में रजिस्ट्रीकृत अधिवक्ता नहीं है। यदि लाइसेंस प्राप्त कर लेने पर उसे बार काउसिंल में रजिस्ट्रीकृत अधिवक्ता पाया जाता है तो लाइसेंस निरस्त कर दिया जायेगा। राज्य सरकार का कर्मचारी भी लाइसेंस स्वीकृति हेतु आवेदन करने के लिये अपात्र होगा।

(दस) यह कि लाइसेंसधारी के रुप में चयन हो जाने की स्थिति में चयन के 48 घंटे के भीतर धरोहर धनराशि का बैंक ड्रॉफ्‌ट, जिसे आन-लाइन आवेदन के साथ अपलोड किया गया है, को जिला आबकारी अधिकारी के कार्यालय में जमा करा देगा। (ग्यारह) यह कि उसने धरोहर धनराशि के बैंक ड्राफ्‌ट का प्रयोग इस चरण में किसी अन्य दुकान हेतु आवेदन में नही किया है।

(ग्यारह) यह कि उसने धरोहर धनराशि के बैंक ड्राफ्‌ट का प्रयोग इस चरण में किसी अन्य दुकान हेतु आवेदन में नही किया है।

(ङ) आवेदक द्वारा राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त द्वारा यथा निर्धारित धरोहर धनराशि का बैंक ड्रॉफ्‌ट जो सम्बन्धित दुकान के जिला के जिला आबकारी अधिकारी के पक्ष में जारी हो, की स्कैन प्रति आनलाइन आवेदन के साथ अपलोड किया जायेगा। लाइसेंसधारी के रूप में चयन हो जाने की स्थिति में, धरोहर धनराशि के बैंक ड्राफ्‌ट, चयन के पश्चात्‌ 48 घंटे के भीतर सम्बन्धित जिला आबकारी अधिकारी के कार्यालय में जमा करना अनिवार्य होगा। धरोहर धनराशि का समायोजन लाइसेंस फीस के सापेक्ष किया जायेगा।

लाइसेंसधारी के रूप में चयन हो जाने की स्थिति में, धरोहर धनराशि के बैंक ड्राफ्‌ट, चयन के पश्चात्‌ अड़तालीस घंटे के भीतर सम्बन्धित जिला आबकारी अधिकारी के कार्यालय में जमा करना अनिवार्य होगा जिसे दुकान की सभी देयताओं के भुगतान के उपरान्त वापस कर दिया जायेगा।

(च) आवेदक ऋणशोधन क्षमता प्रमाण-पत्र या प्राधिकृत आयकर मूल्यांकक द्वारा निर्गत सम्पत्ति स्वामित्व प्रमाण-पत्र का धारक हो तथा उसकी ऋणशोधन क्षमता या प्राधिकृत आयकर मूल्यांकन द्वारा निर्गत सम्पति स्वामित्व प्रमाण-पत्र की मालियत जिला में आवेदित दुकान का लाइसेंस प्रदान करने के लिए अवधारित लाइसेंस शुल्क की धनराशि से कम नही होगी।

(च) आवेदक ऋणशोधन क्षमता प्रमाण पत्र या प्राधिकृत आयकर मूल्यांकक द्वारा निर्गत सम्पत्ति स्वामित्व प्रमाण-पत्र का धारक हो तथा उसकी ऋणशोधन क्षमता या प्राधिकृत आयकर मूल्यांकक द्वारा निर्गत सम्पति स्वामित्व प्रमाण-पत्र की मालियत जिला में आवेदित दुकान का लाइसेंस प्रदान करने के लिए अवधारित लाइसेंस शुल्क की धनराशि से कम नही होगी।

परन्तु नवीकरण हेतु गत वर्ष के व्यवस्थापन के दौरान प्रस्तुत किये गये ऋणशोधन क्षमता प्रमाण-पत्र प्रतिग्राहय होंगे तथा नये और अधिक मूल्य के ऋणशोधन क्षमता प्रमाण-पत्र की अवश्यकता नही होगी।

परन्तु नवीकरण की स्थिति में गत वर्ष के व्यवस्थापन के दौरान प्रस्तुत किया गया ऋणशोधन क्षमता प्रमाण-पत्र अथवा किसी प्राधिकृत आयकर मूल्यांकक द्वारा जारी सम्पत्ति स्वामित्व प्रमाण-पत्र, यदि विधिमान्य है एवं अपेक्षित धनराशि के लिए है, प्रतिग्राहय होगा। 5-नियम-10 का संशोधन- उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-10 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा,अर्थात- स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम 10-लाइसेंसधारी का चयन- (क) (एक) राज्य सरकार द्वारा यथा विनिर्दिष्ट निबन्धन और शर्तों के अधीन दुकान के लाइसेंस का ऑनलाइन नवीकरण किया जा सकेगा।

10-लाइसेंसधारी का चयन- (क) (एक) राज्य सरकार द्वारा यथा विनिर्दिष्ट निबन्धन और शर्तों के अधीन दुकान के लाइसेंस का ऑनलाइन नवीकरण किया जा सकेगा।8 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

(दो) नवीकरण न होने की स्थिति में लाइसेंसधारियों का चयन आनलाइन आवेदन आमंत्रित कर राज्य सरकार द्वारा यथा विनिर्दिष्ट ई-लाटरी अथवा ई-टेण्डर प्रक्रिया के माध्यम से दुकानवार किया जायेगा। जिला आबकारी अधिकारी आनलाइन प्राप्त आवेदनों की संवीक्षा करेंगा और समस्त पात्र तथा अपात्र आवेदनों की अपात्रता के कारणों को उल्लिखित करते हुए सूची तैयार करेगा और इस सूची को ई-लाटरी एवं ई-टेण्डर हेतु गठित जिला स्तरीय लाइसेंस समिति के समक्ष प्रस्तुत करेगा। (दो) नवीनीकरण न होने की स्थिति में लाइसेंसधारियों का चयन आनलाइन आवेदन आमंत्रित कर राज्य सरकार द्वारा यथा विनिर्दिष्ट ई-लाटरी अथवा ई-टेण्डर प्रक्रिया के माध्यम से दुकानवार किया जायेगा। जिला आबकारी अधिकारी आनलाइन प्राप्त आवेदनों की संवीक्षा करेंगा और समस्त पात्र तथा अपात्र आवेदनों की अपात्रता के कारणों को उल्लिखित करते हुए सूची तैयार करेगा और इस सूची को ई-लाटरी एवं ई-टेण्डर हेतु गठित जिला स्तरीय लाइसेंस समिति के समक्ष प्रस्तुत करेगा।

(ग) यदि चयनित आवेदक लाइसेंस फीस या प्रतिभूति धनराशि जमा नहीं करेगा और विहित औपचारिकताएॅं पूरी नहीं करेगा या नियत अवधि में दुकान हेतु उपयुक्त परिसर की व्यवस्था करने में अक्षम रहेगा, तो लाइसेंस प्राधिकारी आवंटन को निरस्त कर देगा और शासन द्वारा निर्धारित प्रक्रिया के माध्यम से दुकान के पुर्नव्यवस्थापन हेतु तत्काल आवश्यक कार्यवाही करेगा।

(ख) उक्त समिति पात्र एवं अपात्र आवेदकों को चिन्हित करेगी। ई-लॉटरी की स्थिति में अर्ह आवेदकों में से प्रत्येक दुकान के लिये लाइसेंसधारी का चयन कम्प्यूटर चलित यादृच्छिक विन्यास के माध्यम से किया जायेगा। यादृच्छिकीकरण प्रक्रिया सम्बन्धित नियम के अधीन विहित अनुक्रम के अनुसार देशी मदिरा, मॉडल शाप, विदेशी मदिरा तथा बीयर की फुटकर दुकानों के क्रम में अपनायी जायेगी। ई-टेण्डर के माध्यम से लाइसेंसधारी के चयन की स्थिति में भी पूर्वोक्त अनुक्रम का पालन किया जायेगा। किसी भी आवेदक के पक्ष में सम्पूर्ण प्रदेश में सभी श्रेणी की देशी शराब, मॉडल शाप, विदेशी मदिरा, एवं बीयर की कुल मिलाकर दो से अधिक दुकानें आवंटित नहीं की जायेंगी। परन्तु यह कि पूर्वोक्त निर्बध्ांन राज्य सरकार द्वारा निर्धारित मानदण्डों के अनुसार लाइसेंसों के नवीकरण के लिए लागू नहीं होगा। परन्तु यह भी कि किसी आवेदक के पक्ष में सम्पूर्ण राज्य में दो या दो से अधिक दुकानों का नवीकरण होने की स्थिति में वह ई-लाटरी के माध्यम से अग्रतर दुकानों के चयन हेतु पात्र नहीं होगा। (ग) यदि चयनित आवेदक लाइसेंस फीस या प्रतिभूति धनराशि जमा नहीं करेगा और विहित औपचारिकताएॅं पूरी नहीं करेगा या नियत अवधि में दुकान हेतु उपयुक्त परिसर की व्यवस्था करने में अक्षम रहेगा, तो लाइसेंस प्राधिकारी आवंटन को निरस्त कर देगा और शासन द्वारा निर्धारित प्रक्रिया के माध्यम से दुकान के पुर्नव्यवस्थापन हेतु तत्काल आवश्यक कार्यवाही करेगा।

(घ) यदि किसी विशिष्ट दुकान के लिए कोई आवेदन प्राप्त न हो या किसी दुकान के लिए कोई अभ्यर्थी उपयुक्त नहीं पाया जाये तो लाइसेंस प्राधिकारी दुकान के पुर्नव्यवस्थापन हेतु शासन द्वारा निर्धारित प्रक्रिया के माध्यम से तत्काल कदम उठायेगा।

(घ) यदि किसी विशिष्ट दुकान के लिए कोई आवेदन प्राप्त नहीं हो या किसी दुकान के लिए कोई अभ्यर्थी उपयुक्त नहीं पाया जाये तो लाइसेंस प्राधिकारी दुकान के पुर्नव्यवस्थापन हेतु शासन द्वारा निर्धारित प्रक्रिया के माध्यम से तत्काल कदम उठायेगा।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 9 6-नियम-12 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-12 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम 12- लाइसेंस फीस और प्रतिभूति धनराशि का भुगतान- यदि किसी आवेदक को लाइसेंसधारी के रुप में चयनित किया जाता है तो अपने चयन की सूचना की प्राप्ति के तीन कार्य दिवसों के भीतर लाइसेंस फीस की सम्पूर्ण धनराशि जमा करेगा। उससे यह अपेक्षा की जायेगी कि वह प्रतिभूति धनराशि का आधा भाग अपने चयन होने की सूचना के दस कार्यदिवसों के भीतर और अवशेष प्रतिभूति धनराशि अपने चयन होने की सूचना के बीस कार्य दिवसों के भीतर जमा कर दे। आवेदक द्वारा लाइसेंस फीस का समस्त भुगतान अधिमानतः ई-पेमेन्ट के माध्यम से किया जायेगा एवं प्रतिभूति धनराशि, राष्ट्रीय बचत-पत्र/सावधि जमा रसीद के माध्यम से जो जिला आबकारी अधिकारी के पक्ष में गिरवीकृत हो अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी। परन्तु नवीकरण की स्थिति में पूर्व में जमा की गयी प्रतिभूति, तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जाय।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम 12- लाइसेंस फीस और प्रतिभूति धनराशि का भुगतान- यदि किसी आवेदक को लाइसेंसधारी के रुप में चयनित किया जाता है तो अपने चयन की सूचना की प्राप्ति के तीन कार्य दिवसों के भीतर लाइसेंस फीस की सम्पूर्ण धनराशि जमा करेगा। उससे यह अपेक्षा की जायेगी कि वह प्रतिभूति धनराशि का आधा भाग अपने चयन होने की सूचना के दस कार्यदिवसों के भीतर और अवशेष प्रतिभूति धनराशि अपने चयन होने की सूचना के बीस कार्य दिवसों के भीतर जमा कर दे। आवेदक द्वारा लाइसेंस फीस का समस्त भुगतान अधिमानतः ई-पेमेन्ट के माध्यम से किया जायेगा एवं प्रतिभूति धनराशि सावधि जमा रसीद के माध्यम से जो जिला आबकारी अधिकारी के पक्ष में गिरवीकृत हो अथवा ई-पेमेन्ट के माध्यम से जमा की जायेगी। परन्तु नवीकरण की स्थिति में पूर्व में नगद अथवा राष्ट्रीय बचत-पत्र के माध्यम से जमा की गयी प्रतिभूति, तब तक मान्य होगी, जब तक इसकी वापसी न कर दी जाय।

यदि वह विहित अवधि के भीतर लाइसेंस फीस या प्रतिभूति धनराशि जमा करने में विफल रहता है तो उसका चयन निरस्त हो जायेगा और उसकी धरोहर धनराशि तथा लाइसेंस फीस और प्रतिभूति धनराशि, जो उसके द्वारा जमा की गयी हो, राज्य सरकार के पक्ष में समपहृत कर ली जायेगी और उक्त दुकान को तत्काल राज्य सरकार द्वारा यथाविहित रीति से पुनव्र्यवस्थापित कर दिया जायेगा।

अनुवर्ती वर्ष में, दुकान का लाइसेंस लाइसेंसधारी की इच्छा पर राज्य सरकार द्वारा यथा निर्धारित मानदण्ड के अनुसार नवीकृत किया जा सकेगा। नवीकरण हेतु लाइसेंस फीस एवं प्रतिभूति के अन्तर की धनराशि राज्य सरकार द्वारा यथा विनिर्दिश्ट नियत समयावधि मेें जमा की जायेगी। यदि वह विहित अवधि के भीतर लाइसेंस फीस या प्रतिभूति धनराशि जमा करने में विफल रहता है तो उसका चयन निरस्त हो जायेगा और उसकी धरोहर धनराशि तथा लाइसेंस फीस और प्रतिभूति धनराशि, जो उसके द्वारा जमा की गयी हो, राज्य सरकार के पक्ष में समपहृत कर ली जायेगी और उक्त दुकान को तत्काल राज्य सरकार द्वारा यथाविहित रीति से पुनव्र्यवस्थापित कर दिया जायेगा।

7-नियम-13 का संशोधन उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-13 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम नियम-13 बीयर का उठान-

नियम-13 बीयर/वाइन का उठान-

(क) इस नियमावली के अधीन लाइसेंसधारी कम तीव्रता के मादक पेय सहित बीयर के लागत मूल्य का पूर्ण भुगतान, जिसके अन्तर्गत सभी कर, प्रतिफल शुल्क (अतिरिक्त प्रतिफल शुल्क सहित) जो समय-समय पर उदग्रहीत किये जांय, अधिमानतः ई-पेमेन्ट प्लेटफार्म के माध्यम से जमा करने के पश्चात्‌ जिला के किसी थोक लाइसेंसधारी वि0म0-2(ख) से एवं जिला/ प्रभार/ राज्य के एफ0एल0-2डी अनुज्ञापी से आयातित विदेशी मदिरा की आपूर्ति प्राप्त करेगा। यदि सम्बन्धित जिला में वि0म0-2(ख) अनुज्ञापन स्वीकृत नहीं है, जो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलों के थोक बिक्री लाइसेंसधारी वि0म0-2(ख) से विदेशी शराब (वाइन सहित) की आपूर्ति प्राप्त करेगा।

(क) इस नियमावली के अधीन लाइसेंसधारी कम तीव्रता के मादक पेय सहित बीयर एवं वाइन के लागत मूल्य का पूर्ण भुगतान, जिसके अन्तर्गत सभी कर, प्रतिफल शुल्क (अतिरिक्त प्रतिफल शुल्क सहित) जो समय-समय पर उदग्रहीत किये जांय, अधिमानतः ई-पेमेन्ट प्लेटफार्म के माध्यम से जमा करने के पश्चात्‌ जिला के किसी थोक लाइसेंसधारी वि0म0-2/2(ख) से एवं जिला/ प्रभार/ राज्य के एफ0एल0-2डी लाइसेंसधारी से आपूर्ति प्राप्त करेगा। यदि सम्बन्धित जिला में वि0म0-2/2(ख) लाइसेंस स्वीकृत नहीं है, जो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलों के थोक बिक्री लाइसेंसधारी से आपूर्ति प्राप्त करेगा।10 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी आबकारी आयुक्त से आदेश प्राप्त करेगा।

अधिकारी आबकारी आयुक्त से आदेश प्राप्त करेगा। (ख) अधिकतम फुटकर मूल्य- बीयर एवं कम तीब्रता के मादक पेय की बोतलों के लेबुलों पर राज्य सरकार की अनुमति से आबकारी आयुक्त द्वारा यथा निर्धारित अधिकतम बिक्री मूल्य अंकित होगा । लाइसेंसधारी बोतलों के लेबुलों पर अंकित फुटकर मूल्य से अधिक मूल्य उपभोक्ताओं से नहीं लेगा और यदि ऐसा करता पाया जायेगा तो उसे नियमानुसार दण्डित किया जायेगा।

(ख) अधिकतम फुटकर मूल्य- बीयर, वाइन एवं कम तीब्रता के मादक पेय की बोतलों के लेबुलों पर राज्य सरकार की अनुमति से आबकारी आयुक्त द्वारा यथा निर्धारित अधिकतम बिक्री मूल्य अंकित होगा । लाइसेंसधारी बोतलों के लेबुलों पर अंकित फुटकर मूल्य से अधिक मूल्य उपभोक्ताओं से नहीं लेगा और यदि ऐसा करता पाया जायेगा तो उसे नियमानुसार दण्डित किया जायेगा।

(ग) लाइसेंसधारी के लिए ग्राहकों की मौसमी आवश्यकताओं के अनुसार स्थिर तथा निरन्तर गुणवत्तापूर्ण आपूर्ति सुनिश्चित करने और साथ ही साथ बाजार में नकली आपूर्तियों के किन्हीं अवसरों को दूर करने हेतु लगातार बीयर का उठान करना बाध्यकारी होगा। उसे निरन्तर पोर्टल पर लिखित मांग-पत्र अथवा संदेश थोक विक्रेता को प्रस्तुत करना होगा। इस क्रम में उपरोक्त आवश्यकताआें की पूर्ति हेतु लाइसेंसधारी के लिए कम से कम पूर्ववर्ती वर्ष के प्रत्येक त्रैमास में उठाई गयी बीयर की मात्रा में निहित प्रतिफल शुल्क के बराबर की बीयर की मात्रा का उठान करना बाध्यकारी होगा।

(ग) लाइसेंसधारी के लिए ग्राहकों की मौसमी आवश्यकताओं के अनुसार स्थिर तथा निरन्तर गुणवत्तापूर्ण आपूर्ति सुनिश्चित करने और साथ ही साथ बाजार में नकली आपूर्तियों के किन्हींं अवसरों को दूर करने हेतु लगातार बीयर/वाइन/ कम तीव्रता के मादक पेय का उठान करना बाध्यकारी होगा। उसे निरन्तर पोर्टल पर लिखित मांग-पत्र अथवा संदेश थोक विक्रेता को प्रस्तुत करना होगा। इस क्रम में उपरोक्त आवश्यकताआें की पूर्ति हेतु लाइसेंसधारी के लिए क्रम से कम पूर्ववर्ती वर्श के प्रत्येक त्रैमास में उठाई गयी बीयर/वाइन / कम तीव्रता के मादक पेय की मात्रा में निहित प्रतिफल शुल्क के बराबर की बीयर/वाइन/कम तीव्रता के मादक पेय की मात्रा का उठान करना बाध्यकारी होगा।

8-नियम-15 का संशोधन- उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-15 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम नियम-15- लाइसेंस की समाप्ति पर बचे अतिशेष स्टाक का निस्तारण-

लाइसेंसधारी द्वारा लाइसेंस अवधि की समाप्ति पर बीयर एवं कम तीव्रता के मादक पेय की अविक्रीत पायी गयी मात्रा की ब्राण्डवार, धारितावार, तीव्रतावार एवं पैकेजिंगवार घोषणा जिला आबकारी अधिकारी के समक्ष अगले दिन 12 बजे तक की जायेगी और लाइसेंस की समाप्ति के अगले दिन जिनकों 5ः00 बजे अपरान्ह तक जिला के थोक विक्रेता को वापस की जायेगी। अवशेष स्टाक का रजिस्टर पृथक से बनाया जायेगा और साथ ही अवशेष स्टाक को जिला आबकारी अधिकारी द्वारा पोर्टल पर अपलोड किया जायेगा। ऐसे स्टाक का निस्तारण राज्य सरकार द्वारा यथा विहित रीति से किया जायेगा।

नियम-15- लाइसेंस की समाप्ति पर बचे अतिशेष स्टाक का निस्तारण- लाइसेंसधारी द्वारा लाइसेंस अवधि की समाप्ति पर बीयर, वाइन एवं कम तीव्रता के मादक पेय की अविक्रीत पायी गयी मात्रा की ब्राण्डवार, धारितावार, तीव्रतावार एवं पैकेजिंगवार घोषणा जिला आबकारी अधिकारी के समक्ष अगले दिन दोपहर 12 बजे तक की जायेगी और लाइसेंस की समाप्ति के अगले दिन जिनको 5ः00 बजे अपरान्ह तक जिला के थोक विक्रेता को वापस की जायेगी। अवशेष स्टाक का रजिस्टर पृथक से बनाया जायेगा और साथ ही अवशेष स्टाक को जिला आबकारी अधिकारी द्वारा पोर्टल पर अपलोड किया जायेगा। ऐसे स्टाक का निस्तारण राज्य सरकार द्वारा यथा विहित रीति से किया जायेगा।

9-नियम-17 का संशोधन-उक्त नियमावली में, नीचे स्तम्भ-1 में दिये गये विद्यमान नियम-17 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम नियम-17 लाइसेंस का निलम्बन/ निरस्तीकरण व प्रशमन और शास्तियॉं- (1) लाइसेंस प्राधिकारी लाइसेंस को निलम्बित या निरस्त कर सकता है-

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम नियम-17 लाइसेंस का निलम्बन/ निरस्तीकरण व प्रशमन और शास्तियॉं- (1) लाइसेंस प्राधिकारी लाइसेंस को निलम्बित या निरस्त कर सकता है-उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 11 स्तम्भ-1 विद्यमान नियम (क) यदि लाइसेंस प्राप्त परिसर में कोई बोतल पायी जाती है जिस पर शुल्क का भुगतान नहीं किया गया है और जिस पर आबकारी विभाग द्वारा सम्यक्‌ रूप से अनुमोदित शुल्क के भुगतान के प्रमाण के रूप में सुरक्षा कोड नहीं लगाया गया है,

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (क) यदि लाइसेंस प्राप्त परिसर में कोई बोतल/कैन पायी जाती है जिस पर शुल्क का भुगतान नहीं किया गया है और जिस पर आबकारी विभाग द्वारा सम्यक्‌ रूप से अनुमोदित शुल्क के भुगतान के प्रमाण के रूप में सुरक्षा कोड नहीं लगाया गया है, (ख) यदि लाइसेंस प्राप्त परिसर में किसी अन्य प्रकार की शराब या मादक ओशधि (जिसके लिये लाइसेंस स्वीकृत नहीं किया गया है) पाई जाती है,

(ख) यदि लाइसेंस प्राप्त परिसर में किसी अन्य प्रकार की शराब या मादक ओशधि (जिसके लिये लाइसेंस स्वीकृत नहीं किया गया है) पाई जाती है, स्तम्भ-1 विद्यमान नियम (ग) यदि लाइसेंसधारी द्वारा आवेदन के समय प्रस्तुत शपथ-पत्र त्रुटिपूर्ण पाया जाता है और उसमें दिया गया कथन असत्य पाया जाता है।

स्तम्भ-2 एतदद्वारा प्रतिस्थापित नियम (ग) यदि लाइसेंसधारी द्वारा आवेदन के समय प्रस्तुत शपथ-पत्र त्रुटिपूर्ण पाया जाता है और उसमें दिया गया कथन असत्य पाया जाता है।

(घ) यदि लाइसेंसधारी अधिनियम या तत्समय प्रवृत्त राजस्व से सम्बन्धित किसी अन्य विधि के अधीन दण्डनीय किसी अपराध में या किसी संज्ञेय और गैर जमानती अपराध में या स्वापक औषधि मनः प्रभावी पदार्थ अधिनियम, 1985 या भारतीय दण्ड संहिता की धारा 482 से 489 के अधीन अपराध में दोष सिद्ध किया गया है।

(ड़) यदि अधिनियम या नियमावली के उपबन्धों के विरुद्ध लाइसेंसधारी के कब्जा में कोई मदिरा या मादक औषधि पायी जाती है।

(च) यदि यह पाया जाता है कि लाइसेंस फर्जी नाम से प्राप्त किया गया है या लाइसेंसधारी किसी अन्य व्यक्ति की ओर से लाइसेेंसधारण किये हुए है। (छ) यदि यह पाया जाता है कि बोतलों/पात्रों के लेबिलों पर अंकित मूल्य से अधिक मूल्य उपभोक्ताओं से प्रभारित किया गया है। (ज) यदि लाइसेंस युक्त परिसर में कैरामल, रंग, सुगंधि, होलोग्राम/श्रिंक स्लीव अथवा बार कोड, लेबुल, कैप्सूल, मुहर अथवा अन्य अवैध सामग्री पायी जाती है।

(ज) यदि लाइसेंस युक्त परिसर में कैरामल, रंग, सुगंधि, होलोग्राम/श्रिंक स्लीव अथवा बार कोड, लेबुल, कैप्सूल, मुहर अथवा अन्य अवैध सामग्री पायी जाती है।

(झ) यदि लाइसेंस प्राप्त परिसर में मदिरा का जलापमिश्रण या अन्य पदार्थ का मिश्रण/ उसका तनुकरण, उच्च श्रेणी की मदिरा के साथ निम्न श्रेणी की मदिरा का अपमिश्रण पाया जाता है, तो विधि के अन्य सुसंगत उपबन्धों के अधीन कार्यवाही की जायेगी।

(2) लाइसेंस प्राधिकारी तत्काल लाइसेंस निलम्बित कर देगा, और लाइसेंस के निरस्तीकरण और प्रतिभूति जमा को समपहृत करने के लिए कारण बताओ नोटिस भी जारी करेगा लाइसेंसधारी अपना स्पष्टीकरण नोटिस की प्राप्ति के 7 दिन के भीतर प्रस्तुत कर सकता है। तत्पश्चात्‌ लाइसेंस प्राधिकारी लाइसेंसधारी को यदि वह ऐसा चाहे तो सुनवाई का समुचित अवसर देने के पश्चात्‌ उपयुक्त आदेश पारित करेगा।

(2) पूर्वोक्त स्थिति में लाइसेंस प्राधिकारी तत्काल लाइसेंस निलम्बित कर देगा, और लाइसेंस के निरस्तीकरण और प्रतिभूति जमा को समपहृत करने के लिए कारण बताओ नोटिस भी जारी करेगा लाइसेंसधारी अपना स्पष्टीकरण नोटिस की प्राप्ति के 7 दिन के भीतर प्रस्तुत कर सकता है। तत्पश्चात्‌ लाइसेंस प्राधिकारी लाइसेंसधारी को यदि वह ऐसा चाहे तो सुनवाई का समुचित अवसर देने के पश्चात्‌ उपयुक्त आदेश पारित करेगा।12 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 स्तम्भ-1 विद्यमान नियम (3) लाइसेंसधारी इस नियम के अधीन लाइसेंस के निलम्बन या निरस्तीकरण के लिए किसी प्रतिकर या वापसी के लिए दावा करने का हकदार नहीं होगा।

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम (3) लाइसेंसधारी इस नियम के अधीन लाइसेंस के निलम्बन या निरस्तीकरण के लिए किसी प्रतिकर या वापसी के लिए दावा करने का हकदार नहीं होगा। (4) यदि लाइसेंस निरस्त किया जाता है तो उसकी जमा लाइसेंस फीस और प्रतिभूति धनराशि सरकार के पक्ष में समपहृत हो जायेगी और लाइसेंसधारी को किसी प्रतिकर या प्रतिदाय का दावा करने का हक नहीं होगा। ऐसे लाइसेंसधारी को काली सूची में भी डाला जा सकता है तथा उसे भविष्य में कोई आबकारी लाइसेंसधारण करने से विवर्जित किया जा सकता है।

(4) यदि लाइसेंस निरस्त किया जाता है तो उसकी जमा लाइसेंस फीस और प्रतिभूति धनराशि सरकार के पक्ष में समपहृत हो जायेगी और लाइसेंसधारी को किसी प्रतिकर या प्रतिदाय का दावा करने का हक नहीं होगा। ऐसे लाइसेंसधारी को काली सूची में भी डाला जा सकता है तथा उसे भविष्य में कोई आबकारी लाइसेंसधारण करने से विवर्जित किया जा सकता है।

(5) फुटकर लाइसेंसों पर प्रशमन योग्य उल्लंघन के मामले में निम्नानुसार न्यूनतम प्रशमन शुल्क अधिरोपित किया जायेगा-

17 क-अन्तरिम व्यवस्थापन-

17 क-अन्तरिम व्यवस्थापन- (क) यदि लाइसेंस को इस नियमावली के उपबन्धों के अनुसरण में निलम्बित, निरस्त या समर्पित किया जाता है या यदि किसी अन्य कारण से दुकान का व्यवस्थापन होना रह गया हो तो लाइसेंस प्राधिकारी सरकार के पूर्वानुमोदन से आबकारी आयुक्त द्वारा यथा अधिसूचित दरों के उच्चतम प्रस्ताव पर दैनिक लाइसेंस फीस का भुगतान किए जाने पर दुकान का अन्तरिम व्यवस्थापन एक बार में अधिकतम्‌ चौदह दिनों के लिए या नियमित व्यवस्थापन के दिनांक तक, जो भी पहले हो, कर सकता है। एक दुकान के लिये दो या दो से अधिक समान आफर प्राप्त होने पर सार्वजनिक मैनुअल लाटरी के माध्यम से व्यवस्थापन कराया जायेगा। ऐसे लाइसेंसधारी को दैनिक लाइसेंस फीस की दर के अनुसार अन्तरिम व्यवस्थापन की अवधि के लिए प्रतिभूति धनराशि जमा करना भी अपेक्षित होगा।

(क) यदि लाइसेंस को इस नियमावली के उपबन्धों के अनुसरण में निलम्बित, निरस्त या समर्पित किया जाता है या यदि किसी अन्य कारण से दुकान का व्यवस्थापन होना रह गया हो तो लाइसेंस प्राधिकारी सरकार के पूर्वानुमोदन से आबकारी आयुक्त द्वारा यथा अधिसूचित दरों के उच्चतम प्रस्ताव पर दैनिक लाइसेंस फीस का भुगतान किए जाने पर दुकान का अन्तरिम व्यवस्थापन एक बार में अधिकतम्‌ चौदह दिनों के लिए या नियमित व्यवस्थापन के दिनांक तक, जो भी पहले हो, कर सकता है। एक दुकान के लिये दो या दो से अधिक समान आफर प्राप्त होने पर सार्वजनिक मैनुअल लाटरी के माध्यम से व्यवस्थापन कराया जायेगा। ऐसे लाइसेंसधारी को दैनिक लाइसेंस फीस की दर के अनुसार अन्तरिम व्यवस्थापन की अवधि के लिए प्रतिभूति धनराशि जमा करना भी अपेक्षित होगा। परन्तु लाइसेंस प्राधिकारी आबकारी आयुक्त की अनुमति प्राप्त किए बिना दुकान का अन्तरिम व्यवस्थापन दो बार से अधिक नहीं करेगा। (ख) इस नियमावली के उपबन्धों के अनुसार किसी लाईसेंस के निरस्तीकरण या अभ्यर्पण की स्थिति में दुकान का मध्य सत्र में नियमित व्यवस्थापन लाइसेंस प्राधिकारी द्वारा शीघ्रातिशीघ्र सार्वजनिक विज्ञापन देकर ई-टेण्डर प्रणाली के माध्यम से कराया जायेगा। पूर्वोक्त व्यवस्थापन की सूचना आबकारी आयुक्त को तत्काल प्रेशित किया जाना होगा।

परन्तु लाइसेंस प्राधिकारी आबकारी आयुक्त को पूर्व सूचना दिये बिना दुकान का अन्तरिम व्यवस्थापन दो बार से अधिक नहीं करेगा। (ख) इस नियमावली के उपबन्धों के अनुसार किसी लाईसेंस के निरस्तीकरण या अभ्यर्पण की स्थिति में दुकान का मध्य सत्र में नियमित व्यवस्थापन लाइसेंस प्राधिकारी द्वारा शीघ्रातिशीघ्र सार्वजनिक विज्ञापन देकर ई-टेण्डर प्रणाली के माध्यम से कराया जायेगा। पूर्वाेक्त व्यवस्थापन की सूचना आबकारी आयुक्त को तत्काल प्रेषित किया जाना होगा।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 15 11-नियमावली के साथ संलग्न अनुज्ञापन प्रपत्र-एफ0एल0-5(ख) का संशोधन-उक्त नियमावली, में नीचे स्तम्भ-1 में दिये गये विद्यमान प्रपत्र के स्थान पर स्तम्भ-2 में दिया गया प्रपत्र रख दिया जायेगा, अर्थात- स्तम्भ-1 विद्यमान नियम प्रपत्र एफ0एल0-5(ख) (नवीकरण हेतु ) भू-गृहादि के बाहर उपभोग के लिये मुहरबन्द बोतलों में बीयर (एल0ए0बी0 सहित) की फुटकर बिक्री के लिये लाइसेंस

भू-गृहादि के बाहर उपभोग के लिये मानक बोतलों या कैनो (650 मि0ली0), (500 मि0ली0),(330 मि0ली0),(300 मि0ली0) और 275 मि0ली0 मेंं बीयर एवं 1000मि0ली0, 275मि0ली0 की धारिता मेें केवल कम तीव्रता के मादक पेय और वाइन ऐसी धारिताओं में जैसा कि सुसंगत नियमावलियों में उपबंधित है, की फुटकर बिक्री के लिये लाइसेंस एतद्‌द्वारा उपर्युक्त लाइसेंस धारकों को, जिला...............के अन्तर्गत............. .स्थान, पुलिस थाना................. तहसील................ के लिये दिनांक ..................से 31 मार्च 20......... हेतु, जिसके लिये नियम-6 के अनुसार लाइसेंस फीस और प्रतिभूति धनराशि जमा कर दी गयी है, लाइसेंस प्रदान किया जाता है। यह लाइसेंस निम्नलिखित विशेष और सामान्य शर्तों के अधीन रहते हुए प्रदान किया जाता है, उनमेंं से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम, 1910 और स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 की विधियों के अन्तर्गत किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक सुसंगत विधियों के अधीन आरोपित किन्हीं शास्तियों के अतिरिक्त अपने लाइसेंस और प्रतिभूति निक्षेप का समपहरण किए जाने के लिए दायी होगा। यह लाइसेंस निम्नलिखित विशेष और सामान्य शर्तों के अधीन रहते हुए प्रदान किया जाता है, उनमेंं से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम, 1910 और स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 की विधियों के अन्तर्गत किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक सुसंगत विधियों के अधीन आरोपित किन्हीं शास्तियों के अतिरिक्त अपने लाइसेंस और प्रतिभूति निक्षेप का समपहरण किए जाने के लिए दायी होगा। सामान्य और विशेष शर्तें 1- लाइसेंसधारी, बीयर (एल0ए0बी0 सहित) की आपूर्ति, अधिमानतः ई-पेमन्ट के माध्यम से समय समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस, आदि को सम्मिलित करते हुए मदिरा की कीमत का पूर्ण भुगतान करने के पश्चात्‌ जिला के थोक बीयर लाइसेंसधारी से प्राप्त कर सकेगा। यदि सम्बन्धित जिला में वि0श0-2ख लाइसेंस स्वीकृत नहीं है, तो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलोें के थोक लाइसेंसधारी (वि0श0-2ख) से बीयर और कम तीव्रता पेय की आपूर्ति प्राप्त करेगा।

सामान्य और विशेष शर्तें 1- लाइसेंसधारी, बीयर (वाइन एवं कम तीव्रता के मादक पेय सहित) की आपूर्ति, अधिमानतः ई-पेमन्ट के माध्यम से समय समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस, आदि को सम्मिलित करते हुए मदिरा की कीमत का पूर्ण भुगतान करने के पश्चात्‌ जिला के थोक लाइसेंसधारी ( वि0श0-2/2ख ) से प्राप्त कर सकेगा। यदि सम्बन्धित जिला में वि0श0-2/2ख लाइसेंस स्वीकृत नहीं है, तो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलोें के थोक लाइसेंसधारी ( वि0श0-2/2ख ) से बीयर, वाइन और कम तीव्रता के पेय आपूर्ति प्राप्त करेगा।

2- लाइसेंसधारी, अपर्याप्त आपूर्ति की स्थिति में, जिला आबकारी अधिकारी को सूचित करेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा। 2- लाइसेंसधारी, अपर्याप्त आपूर्ति की स्थिति में, जिला आबकारी अधिकारी को सूचित करायेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा।

3- लाइसेंस प्राप्त परिसर पर बिक्री केवल परिसर के बाहर उपभोग के लिए की जायेगी। कोई भी मदिरा परिसर 'में' उपभोग /पेय नहीं की जायेगी।

4- किसी भी व्यक्ति को 650 मि0ली0, 500मि0ली0, 330मि0ली0 300 मि0ली0 और 275 मि0ली0 में बीयर व एल0ए0बी0 तथा अतिरिक्त रूप से केवल एल0ए0बी0 के लिये 1000मि0ली0 व 275मि0ली0 की मानक बोतलों एवं कैंस में बिक्री की जायेगी।

4- किसी भी व्यक्ति को 650 मि0ली0, 500मि0ली0, 330मि0ली0 300 मि0ली0 और 275 मि0ली0 में बीयर व कम तीव्रता के मादक पेय एवं वाइन ऐसी धारिताओं में जैसा कि सुसंगत नियमावलियों में उपबंधित है तथा अतिरिक्त रूप से केवल कम तीव्रता के मादक पेय के लिये 1000मि0ली0 व 275मि0ली0 की मानक बोतलों एवं कैंस में बिक्री की जायेगी।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 17 सामान्य और विशेष शर्तें

सामान्य और विशेष शर्तें

5- बीयर/ एल0ए0बी0 की बोतलों या कैंस पर अधिकतम्‌ फुटकर मूल्य मुद्रित होगा। फुटकर बिक्री का लाइसेंसधारी मुद्रित अधिकतम्‌ फुटकर मूल्य से अधिक प्रभारित नहीं करेगा।

6- उपरिलिखित क्षमता के मुहरबन्द बोतलों एवं कैंस में विहित तीब्रता और मात्रा के बीयर की बिक्री की जायेगी और जिन पर शुल्क के भुगतान के प्रमाण के रूप में सुरक्षा कोड चस्पा हो, जैसा कि आबकारी विभाग द्वारा अनुमोदित किया गया हो।

5- बीयर/वाइन/ कम तीव्रता के मादक पेय के लेबिल पर अधिकतम्‌ फुटकर मूल्य मुद्रित होगा। फुटकर बिक्री का लाइसेंसधारी मुद्रित अधिकतम्‌ फुटकर मूल्य से अधिक प्रभारित नहीं करेगा। 6- उपरिलिखित क्षमता के मुहरबन्द बोतलों या कैंस में विहित तीब्रता और मात्रा के बीयर एवं वाइन तथा कम तीव्रता के मादक पेय की बिक्री की जायेगी और जिन पर शुल्क के भुगतान के प्रमाण के रूप में सुरक्षा कोड चस्पा हो, जैसा कि आबकारी विभाग द्वारा अनुमोदित किया गया हो।

7- लाइसेंसधारी विहित प्रपत्र और रजिस्टर (एफ0एल0-25ख) जो लाइसेंस प्राधिकारी के द्वारा निर्धारित किया गया हो, नियमित और सही-सही दैनिक हिसाब रखेगा एवं उसे वेबसाइट पर अपलोड करेगा और उसे जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मांगा जायेगा, तो लेखा रजिस्टर को प्रस्तुत करेगा और निरीक्षण प्राधिकारी द्वारा अपेक्षित सामग्री और दस्तावेजों को उपलब्ध करायेगा।

7- लाइसेंसधारी विहित प्रपत्र और रजिस्टर (एफ0एल0-25ख) जो लाइसेंस प्राधिकारी के द्वारा निर्धारित किया गया हो, नियमित और सही-सही दैनिक हिसाब रखेगा एवं उसका वेबसाइट पर अपलोड करेगा और उसे जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मांगा जायेगा, तो लेखा रजिस्टर को प्रस्तुत करेगा और निरीक्षण प्राधिकारी द्वारा अपेक्षित सामग्री और दस्तावेजों को उपलब्ध करायेगा।

8- लाइसेंसधारी बीयर/एल0ए0बी0 के सम्पूर्ण मात्रा का भण्डारण केवल लाइसेंसयुक्त परिसर में करेगा। उससे ट्रैक एण्ड ट्रेस प्रणाली के अधीन विहित सुरक्षा कोड के अनुसार बोतलों की स्कैनिंग के लिए दुकान पर यथाविनिर्दिष्ट पी0ओ0एस0 (प्वाइंट ऑफ सेल) यंत्र रखने की अपेक्षा की जायेगी।

8- लाइसेंसधारी बीयर/वाइन/कम तीव्रता के मादक पेय के सम्पूर्ण मात्रा का भण्डारण केवल लाइसेंसयुक्त परिसर में करेगा। उससे ट्रैक एण्ड ट्रेस प्रणाली के अधीन विहित सुरक्षा कोड के अनुसार बोतलों की स्कैनिंग के लिए दुकान पर यथाविनिर्दिष्ट पी0ओ0एस0 (प्वाइंट ऑफ सेल) यंत्र रखने की अपेक्षा की जायेगी।

9- लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रपत्र/आकार का एक सहज दृष्य साइनबोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएॅं भी मोटे अक्षरों में मुद्रित की जायेंगी। साइन बोर्ड में निम्नलिखित सूचना को प्रदर्शित करना होगाः-

''> दुकान के बाहर आस-पास या सार्वजनिक स्थान पर शराब पीना वर्जित है। इस संबंध में कोई भी उल्लंघन दण्डनीय होगा।

> शराब पीकर गाड़ी चलाना जानलेवा हो सकता

है। कृपया शराब पीकर गाड़ी न चलायें।''

> शराब पीकर गाड़ी चलाना जानलेवा हो सकता है। कृपया शराब पीकर गाड़ी न चलायें।''

10- लाइसेंसधारी, किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या किसी संक्रामक रोग और या छुआ-छूत से ग्रस्त हो या आपराधिक, पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी को जिला आबकारी अधिकारी द्वारा निर्गत बिक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करना तथा निरीक्षणकर्ता प्राधिकारियों के मांगने पर प्रस्तुत करना होगा।

11- लाइसेंसधारी किसी भी क्रेता को 7.8 लीटर भारत में भरी हुई व आयातित बीयर प्रत्येक अलग-अलग व 6 लीटर की मात्रा से अधिक कम तीव्रता के मादक पेय की फुटकर बिक्री एक बार में नहीं करेगा, जब तक अन्यथा अनुमति प्राप्त न हो।

11- लाइसेंसधारी किसी भी क्रेता को 7.8 लीटर भारत में भरी हुई व आयातित बीयर प्रत्येक अलग-अलग तथा 3 ली0 भारत में भरी हुइर््र व आयातित वाइन दोनों अलग-अलग एवं 6 लीटर की मात्रा से अधिक कम तीव्रता के मादक पेय की फुटकर बिक्री एक बार में नहीं करेगा, जब तक अन्यथा अनुमति प्राप्त न हो।

12- उप निरीक्षक की श्रेणी से नीचे के पुलिसकर्मी या सैनिक या वर्दी में किसी सरकारी कर्मी, इक्कीस वर्ष से कम आयु के व्यक्तियों को बिक्री नहीं करेगा।

13- लाइसेंसधारी द्वारा किसी भी दशा में बोतलों या कैनों व उसके लेबुलों, सुरक्षा प्रणाली से फिक्स किया गया सुरक्षा कोड या मोहरों से बिगाड़ करना, विकृत करना सर्वथा निषिद्ध है। 13- लाइसेंसधारी द्वारा किसी भी दशा में बोतलों या कैनों व उसके लेबुलों, सुरक्षा प्रणाली से फिक्स किया गया सुरक्षा कोड या मोहरों से बिगाड़ करना, विकृत करना सर्वथा निषिद्ध है।

14- लाइसेंसधारी अपने लाइसेंस प्राप्त परिसर में कोई भी स्प्रिट, दुग्ध, शर्करा (चाश्नी), रंग, ईत्र, सुगंधि (अर्क), सुरक्षा कोड निर्मित करने वाला यंत्र, लेबुल, कैप्सूल, मुहर या कोई अपायकर सामग्री नहीं रखेगा।

15- सिवाय लाइसेंसधारी /विक्रेता और उसके परिवार द्वारा, परिसर, जिसमे दुकान स्थित है, का प्रयोग आवास के स्थान के रूप में नहीं करेगा।

16- लाइसेंसधारी द्वारा अपनी बिक्री बढ़ाने के दृश्टिगत उपभोक्ता को प्रलोभन देना या आकर्षित करना सर्वथा निषिद्ध है। द्यूत या नृत्य कार्यक्रम कराना भी निषिद्ध है।

17- लाइसेंस प्राप्त परिसर, 14 अप्रैल (आंबेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनाें जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उपरोक्त आधार पर दुकान की बन्दी के लिए कोई प्रतिकर नही प्रदान किया जायेगा। 17- लाइसेंस प्राप्त परिसर, 14 अप्रैल (आंबेडकर जयन्ती), 15 अगस्त (स्वतंत्रता दिवस), 2 अक्टूबर (गॉंधी जयन्ती), 26 जनवरी (गणतन्त्र दिवस) और तीन ऐसे अतिरिक्त दिनाें जैसा कि लाइसेंस प्राधिकारी द्वारा बन्दी के लिए अधिसूचित किया जाय, को छोड़कर बिक्री के लिए सभी दिवसों पर प्रातः 10 से रात्रि 10 बजे तक खुला रहेगा। लाइसेंस प्राधिकारी सुसंगत विधियों के अधीन कानून और व्यवस्था या सामान्य निर्वाचन से सम्बन्धित क्रिया कलापों आदि के कारण से भी दुकान की बन्दी के आदेश दे सकता है। उपरोक्त आधार पर दुकान की बन्दी के लिए कोई प्रतिकर नही प्रदान किया जायेगा।

18- लाइसेंसधारी को लाइसेंस प्राप्त परिसर में कोई अन्य व्यवसाय चलाने की अनुमति नहीं दी जायेगी, सिवाय ऐसी गतिविधियों के जिसके लिये कि लाइसेंस दिया गया है।

19- लाइसेंसधारी लाइसेंस की समाप्ति पर अवशेष स्टाक के निस्तारण के लिए जिला आबकारी अधिकारी को रिपोर्ट करेगा, जिसका निस्तारण समय-समय पर आबकारी आयुक्त द्वारा इस निमित्त दिये गये आदेशों के अनुसार किया जायेगा।उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 19 सामान्य और विशेष शर्तें सामान्य और विशेष शर्तें

भू-गृहादि के बाहर उपभोग के लिये मानक बोतलों, (650 मि0ली0), (500 मि0ली0), (330 मि0ली0), (300 मि0ली0) और (275 मि0ली0) मेंं बीयर एवं 1000मि0ली0, 275मि0ली0 की धारिता मेें केवल एल0ए0बी0 और वाइन ऐसी धारिताओं में जैसा कि सुसंगत नियमावलियों में उपबंधित है, की फुटकर बिक्री के लिये लाइसेंस एतद्‌द्वारा उपर्युक्त लाइसेंस धारकों को, जिला...............के अन्तर्गत..............स्थान, पुलिस थाना.................तहसील.......... ......के लिये दिनांक से 31 मार्च 20 हेतु, जिसके लिये नियम-6 के अनुसार लाइसेंस फीस और प्रतिभूति धनराशि जमा कर दी गयी है, लाइसेंस प्रदान किया जाता है।

यह लाइसेंस निम्नलिखित सामान्य और विशेष शर्तों के अधीन रहते हुए प्रदान किया जाता है, उनमेंं से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम, 1910 और स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 की विधियों के अधीन किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त अपने लाइसेंस और प्रतिभूति निक्षेप का समपहरण किए जाने के लिए दायी होगा। यह लाइसेंस निम्नलिखित सामान्य और विशेष शर्तों के अधीन रहते हुए प्रदान किया जाता है, उनमेंं से किसी का व्यतिक्रम करने पर या संयुक्त प्रान्त आबकारी अधिनियम, 1910 और स्वापक औषधि एवं मनः प्रभावी पदार्थ अधिनियम 1985 की विधियों के अधीन किसी अपराध के लिए दोष सिद्ध होने पर लाइसेंस धारक सुसंगत विधियों के अधीन अधिरोपित किन्हीं शास्तियों के अतिरिक्त अपने लाइसेंस और प्रतिभूति निक्षेप का समपहरण किए जाने के लिए दायी होगा।

निबन्धन एवं शर्ते

1- लाइसेंसधारी, बीयर (एल0ए0बी0 सहित) की आपूर्ति, जिला के थोक बियर लाइसेंसधारी (विदेशी मदिरा-2ख) से समय-समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस, आदि को सम्मिलित करते हुए बीयर की कीमत का पूर्ण भुगतान करने के पश्चात्‌ अधिमानताः ई-पेमेंट के माध्यम से प्राप्त कर सकेगा। यदि सम्बन्धित जिला में वि0श0-2ख लाइसेंस स्वीकृत नहीं है, तो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलोें के थोक लाइसेंसधारी (वि0श0-2ख) से बीयर और एल0ए0बी0 की आपूर्तियॉ प्राप्त करेगा।

सामान्य एवं विशेष शर्ते 1- लाइसेंसधारी, बीयर (वाइन एवं कम तीव्रता के मादक पेय सहित) की आपूर्ति, अधिमानतः ई-पेमन्ट के माध्यम से समय समय पर उदग्रहणीय समस्त करों, प्रतिफल फीस, आदि को सम्मिलित करते हुए मदिरा की कीमत का पूर्ण भुगतान करने के पश्चात्‌ जिला के थोक लाइसेंसधारी ( वि0श0-2/2ख) से प्राप्त कर सकेगा। यदि सम्बन्धित जिला में वि0श0-2/2ख लाइसेंस स्वीकृत नहीं है, तो लाइसेंसधारी आबकारी आयुक्त की पूर्वानुमति से अन्य जिला/जिलोें के थोक लाइसेंसधारी ( वि0श0-2/2ख ) से बीयर, वाइन और कम तीव्रता के मादक पेय की आपूर्ति प्राप्त करेगा।

2- लाइसेंसधारी अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी को अवगत करायेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा। 2- लाइसेंसधारी अपर्याप्त आपूर्ति की स्थिति में जिला आबकारी अधिकारी को अवगत करायेगा, जो आबकारी आयुक्त से आदेश प्राप्त करेगा।

3- लाइसेंस प्राप्त परिसर पर बिक्री केवल परिसर के ''बाहर'' उपभोग के लिए की जायेगी। कोई भी मदिरा परिसर में उपभोग नहीं की जायेगी।

4- किसी भी व्यक्ति को 650 मि0ली0, 500मि0ली0, 330मि0ली0, 300 मि0ली0 और (275 मि0ली0) में बीयर व एल0ए0बी0 तथा अतिरिक्त रूप से केवल एल0ए0बी0 के लिये 1000मि0ली0 व 275मि0ली0 की मानक बोतलों एवं कैंस में बिक्री की जायेगी।

5- बीयर/वाइन/ एल0ए0बी0 की बोतलों या कैंस पर अधिकतम्‌ फुटकर मूल्य मुद्रित होगा। फुटकर बिक्री का लाइसेंसधारी मुद्रित अधिकतम्‌ फुटकर मूल्य से अधिक प्रभारित नहीं करेगा। 5- बीयर/ एल0ए0बी0 की बोतलों या कैंस पर अधिकतम्‌ फुटकर मूल्य मुद्रित होगा। फुटकर बिक्री का लाइसेंसधारी मुद्रित अधिकतम्‌ फुटकर मूल्य से अधिक प्रभारित नहीं करेगा।

6- उपरिलिखित क्षमता के मुहरबन्द बोतलों एवं कैंस में विहित तीब्रता और मात्रा के बीयर की बिक्री की जायेगी और जिन पर प्रतिफल शुल्क के भुगतान के प्रमाण के रूप में सुरक्षा कोड चस्पा हो, जैसा कि आबकारी विभाग द्वारा अनुमोदित किया गया हो।

6- उपरिलिखित क्षमता के मुहरबन्द बोतलों एवं कैंस में विहित तीब्रता और मात्रा के बीयर एवं वाइन की बिक्री की जायेगी और जिन पर शुल्क के भुगतान के प्रमाण के रूप में सुरक्षा कोड चस्पा हो, जैसा कि आबकारी विभाग द्वारा अनुमोदित किया गया हो।

7- लाइसेंसधारी विहित प्रपत्र और रजिस्टर (एफ0एल0-25ख) जो लाइसेंस प्राधिकारी के द्वारा निर्धारित किया गया हो, में नियमित और सही-सही दैनिक लेखा रखेगा एवं उसका वेबसाइट upexciseonline.in पोर्टल पर SMS के माध्यम से पर अपलोड करेगा और उसे जब कभी सक्षम निरीक्षण प्राधिकारी द्वारा मॉगा जायेगा, तो लेखा रजिस्टर को प्रस्तुत करेगा। लाइसेंसधारी विक्रय लेखा आदि उपलब्ध करायेगा तथा निरीक्षण प्राधिकारी द्वारा यथा अपेक्षित सामग्री तथा दस्तावेजों को सुगमता पूर्वक उपलब्ध करायेगा।

8- लाइसेंसधारी बीयर/वाइन/एल0ए0बी0 के सम्पूर्ण मात्रा का भण्डारण केवल लाईसेंस प्राप्त लाइसेंस युक्त परिसर में ही करेगा। उससे ट्रैक एण्ड ट्रेस प्रणाली के अधीन विहित सुरक्षा कोड के अनुसार बोतलों की स्कैनिंग के लिए दुकान पर यथाविनिर्दिश्ट पी0ओ0एस0(प्वाइंट ऑफ सेल) यंत्र अनुरक्षित करने की अपेक्षा की जायेगी। 8- लाइसेंसधारी बीयर/एल0ए0बी0 के सम्पूर्ण मात्रा का भण्डारण केवल लाईसेंस प्राप्त लाइसेंस युक्त परिसर में ही करेगा। उससे ट्रैक एण्ड ट्रेस प्रणाली के अधीन विहित सुरक्षा कोड के अनुसार बोतलों की स्कैनिंग के लिए दुकान पर यथाविनिर्दिश्ट पी0ओ0एस0(प्वाइंट ऑफ सेल) यंत्र अनुरक्षित करने की अपेक्षा की जायेगी।

9- लाइसेंसधारी दुकान के प्रवेश द्वार पर आबकारी आयुक्त द्वारा अनुमोदित प्रपत्र/आकार का एक सहज दृष्य साइनबोर्ड लगाएगा, जिसके ऊपर लाइसेंसधारी का नाम, दुकान की अवस्थिति, लाइसेंस की अवधि, दुकान खुलने व बन्द होने का समय और लाइसेंस प्राधिकारी द्वारा यथा विहित अन्य सूचनाएं भी मोटे अक्षरों में मुद्रित की जायेंगी। साइन बोर्ड में निम्नलिखित सूचना को प्रदर्षित करना होगाः-

''> दुकान के परिसर के बाहर, आस-पास या सार्वजनिक स्थानों पर शराब पीना वर्जित है। इस संबंध में कोई भी उल्लंघन दण्डनीय होगा। > शराब पीकर गाड़ी चलाना जानलेवा हो सकता है। कृपया शराब पीकर गाड़ी न चलायें।'' ''> दुकान के परिसर के बाहर, आस-पास या सार्वजनिक स्थानों पर शराब पीना वर्जित है। इस संबंध में कोई भी उल्लंघन दण्डनीय होगा। > शराब पीकर गाड़ी चलाना जानलेवा हो सकता है। कृपया शराब पीकर गाड़ी न चलायें।'' 10- लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या किसी संक्रामक रोग और या छुआ-छूत से ग्रस्त हो या आपराधिक, पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी को जिला आबकारी अधिकारी द्वारा निर्गत बिक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करना तथा निरीक्षणकर्ता प्राधिकारियों के मांगने पर प्रस्तुत करना होगा।

10- लाइसेंसधारी किसी भी व्यक्ति को विक्रेता के रूप में सेवायोजित नहीं करेगा, जो 21 वर्ष से कम आयु का हो या किसी संक्रामक रोग और या छुआ-छूत से ग्रस्त हो या आपराधिक, पृष्ठभूमि का हो या महिला हो। लाइसेंसधारी को जिला आबकारी अधिकारी द्वारा निर्गत बिक्रेता का फोटोयुक्त पहचान पत्र प्राप्त करना तथा निरीक्षणकर्ता प्राधिकारियों के मांगने पर प्रस्तुत करना होगा।22 उत्तर प्रदेश असाधारण गजट, 20 अप्रैल, 2020 ई0 निबन्धन एवं शर्ते सामान्य एवं विशेष शर्ते

11- लाइसेंसधारी किसी भी क्रेता को 7.8 लीटर भारत में भरी हुई व आयातित बीयर प्रत्येक अलग-अलग तथा 3 ली0 भारत में भरी हुइर््र व आयातित वाइन दोनों अलग-अलग एवं 6 लीटर की मात्र्रा से अधिक कम तीव्रता के मादक पेय की फुटकर बिक्री एक बार में नहीं करेगा, जब तक अन्यथा अनुमति प्राप्त न हो।

12- उप निरीक्षक की श्रेणी से नीचे के पुलिसकर्मी या सैनिक या वर्दी में किसी सरकारी कर्मी या 21 वर्ष से कम आयु के व्यक्तियों को बिक्री नहीं की जानी चाहिए।

13- लाइसेंसधारी द्वारा किसी भी दशा में बोतलों या कैनों, उसके लेबुलों, सुरक्षा प्रणाली से फिक्स किया गया सुरक्षा कोड या प्रूफकैप या मोहरों से बिगाड़ करना, (विकृत करना) सर्वथा निषिद्ध है। 14- लाइसेंसधारी अपने लाइसेंस प्राप्त परिसर में कोई भी स्प्रिट, दुग्ध, शर्करा (चाश्नी), रंग, ईत्र, सुगंधि (अर्क), सुरक्षा कोड निर्मित करने वाला यंत्र, लेबुल, कैप्सूल, मुहर या कोई अपायकर सामग्री नहीं रखेगा।

15- सिवाय लाइसेंसधारी /विक्रेता और उसके परिवार द्वारा, परिसर, जिसमे दुकान स्थित है, का प्रयोग आवास के स्थान के रूप में नहीं करेगा। 16- लाइसेंसधारी द्वारा अपनी बिक्री बढ़ाने के लिए खरीददारों को प्रलोभन देना या आकर्षित करना सर्वथा निषिद्ध है। द्यूत या नृत्य कार्यक्रम कराना भी निषिद्ध है।

18- लाइसेंसधारी को लाइसेंस प्राप्त परिसर में कोई अन्य व्यवसाय चलाने की अनुमति नहीं दी जायेगी, सिवाय ऐसी गतिविधियों के जिसके लिये लाइसेंस दिया गया है।

In exercise of the powers under sections 24-B and 41of the United Provinces Excise Act, 1910 (U.P. Act no. IV of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government hereby makes the following rules with a view to amending the Uttar Pradesh Excise (Settlement of licenses for Retail Sale of Beer) Rules, 2001 published vide Excise Commissioner notification no. 12011/X- Licence77/Allahabad/ March 21, 2001 (as amended time to time):

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENCES FOR RETAIL SALE OF BEER) (EIGHTEENTH AMENDMENT) RULES, 2020.

1.Short title and Commencement (1) These rules may be called the Uttar Pradesh Excise (Settlement of licenses for Retail Sale of Beer) (EighteenthAmendment) Rules, 2020.

(2) They shall come into force with effect from the date of their publication in the Gazette.

(i) "Security amount" means a sum equal to ten percent of the licence fee to be deposited through National Saving Certificate /Fixed deposit receipt pledged in favor of District Excise Officer or through e-payment refundable after the final settlement of all the claims and dues to the State Government.

(j)"Low Strength alcoholic beverages" means the carbonated alcoholic beverages having alcohol upto 5% v/v and above 5% v/v to 10% v/v manufactured from Extra Nuetral alcohol (E.N.A.) and sophisticated by addition of flavouring or colouring matter or both and any other material so as to give it a special flavor.

(m) "Hierarchy" means the earnest money of shops in the descending order purported to be the basis for the selection of licensee through the process of e/lottery.

(n) "Portal" means the electronic platform created specifically for the purpose of uploading information in the prescribed form with regard to the process of manufacturing liquor up to the terminal stage of its distribution.

(o) "Solvency" means financial eligibility criteria set for an applicant applying for the grant of retail licence.

(p) 'Individual' means a person who is the citizen of India not below the age of twenty-one years at the time of application.

(q) "Settlement" means settlement or re- settelment of shops through renewal, e-lottery or e-tender which may take place on any day of the week by giving prior notice and intimation through the newspaper and website of the Excise Department. The settlement of shops for the forthcoming year may also be done prior to the cessation of preceding financial year.

(r)" consideration fee" means a fee for beer and low alcoholic beverages as fixed by the State Government under section 30 of the Excise Act, which shall be deposited in treasury by the licensee prior to supply of beer and low alcoholic beverages .

Provided that in case of renewal security deposited prior in cash shall be acceptable till it is not refunded. The licensee shall be required to furnish the solvency certificate or certificate of owned property issued by an authorized Income Tax Valuer in original copy in the district from where it has been issued at the time of grant of licence.

The licence shall be granted on payment of licence fee preferably through e-payment platform and deposit of security amount through Fixed Deposit Receipt pledged in favor of District Excise Officer or through e-payment in accordance with the provisions of these rules: Provided that in case of renewal security deposited prior in cash or through National Saving Certificate shall be acceptable till it is not refunded. 8.Amendment of rule-4.In the said rules, for existing rule 8 set out in Column I below, the rule as set out in Column II shall be substituted, namely:

(d) submit an affidavit duly verified by notary public as proof of the following namely:

(i) That he possesses or has an arrangement for taking on rent a suitable premises in that locality for opening the shop in accordance with the provisions of Uttar Pradesh Number and Location of Excise Shop Rules, 1968 as amended from time to time.

(ii) That his proposed premises of the shop have not been constructed in violation of any law or rules;

(iii) That he and his family members possess good moral character and have no criminal background nor have been convicted of any offence punishable under the United Provinces Excise Act, 1910 or the Narcotics Drugs and Psychotropic Substances Act, 1985 or any other cognizable and nonbailable offence.

(ix) That applicant is not an Advocate registered with Bar Council. If he is found registered advocate after getting the licence then the licence shall be cancelled. An employee of the Government shall also be ineligible to apply for the grant of licence.

(x) That in case of being selected as licensee, bank Draft of earnest money which has been uploaded online along with application shall be deposited in the office of District Excise Officer within 48 hours of such selection. (xi) That he has not made use of Bank Draft of earnest money for the application of any other shop in the same phase.

(e) The applicant shall upload a scanned copy of Bank Draft issued in favour of District Excise Officer of the district of concerned shop for earnest money, along with online application, as may be fixed by the Excise Commissioner with the prior sanction of the State Government.

In case of selection as licensee, it shall be necessary to deposit bank draft of earnest money in the office of the concerned District Excise Officer within 48 hours after selection. The earnest money shall be adjusted against the license fee.

(f) The applicant shall be the holder of solvency or certificate of owned property issued by an authorized Income Tax Valuer and the worth of solvency or certificate of owned property certificate issued by authorized Income Tax Valuer shall be equivalent to an amount not less than the license fee determined for the grant of licence of the applied shop in the district.

Provided that for renewal solvency certificates produced during the settlement of previous year shall be acceptable and there shall be no need of new solvency certificate along with added value.

Provided, in case of renewal solvency certificate or certificate of owned property issued by an authorized Income Tax Valuer produced during the settlement of previous year shall be acceptable if it is valid and is for the required amount.

10.Amendement of rule-5. In the said rules, for existing rule 10 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely:-

In case of selection of licensee through e-tender the same aforesaid sequence shall be adopted. Not more than two shops including all categories of country liquor, model shop, foreign liquor and beer shall be allotted in favour of an applicant in the entire State (b) The said committee shall identify eligible and ineligible applicants. Payment of License fee and Security amount- In case an applicant is selected as licensee, he shall deposit the entire amount of licence fee within three working days of being intimated of his selection. Entire amount of license fee shall be deposited by the applicant preferably through E-payment, security amount will be deposited through Fixed Deposit Receipt pledged in favowr of District Excise Officer or through e- payment.

12. Payment of License fee and Security amount- In case an applicant is selected as licensee, he shall deposit the entire amount of licence fee within three working days of being intimated of his selection. 13.Lifting of beer/Wine (a) The licensee under these rules shall obtain supplies of beer , wine in addition to Low alcoholic beverages from any wholesale licence (FL- 2/F.L.2B ) of the districts, and FL-2D of district/ charge/ State after making full payment of cost price including all Taxes, Consideration fee (including additional consideration fee) as levied from time to time preferably through e-payment platform. If the FL-2/F.L-2B licence is not sanctioned or supply interrupts in the concerned district, the licensee shall obtain supplies from wholesale licencees of other district/districts with prior permission of the Excise Commissioner. 13.Lifting of beer (a) The licensee under these rules shall obtain supplies of beer and in addition to it of Low alcoholic beverages from any wholesale licence (F.L.2B ) of the districts, and FL-2D of district/ charge/ State after making full payment of cost price of beer including all Taxes, Consideration fee (including additional consideration fee) as levied from time to time preferably through e-payment platform. In case of insufficient supply of any district, district excise officer shall seek the orders from the Excise Commissioner. (b) The Maximum Retail Price- The Maximum Retail Price, as fixed by Excise Commissioner on approval of the State Government, shall be printed on the lables of bottles of beer and low alcoholic beverages. The licensee shall not charge from consumers more than the maximum retail price printed on the lables of bottles and if found to be doing so, he will be penalized as per rules. (c) Licensee shall be under obligation to regularly lift beer to ensure steady and continuous quality supply as per seasonal requirements of the customers as well as to remove any chances of spurious supplies in the market. He shall regularly place written indents on portal or messages to the wholesaler. In order to meet the above requirements the licensee shall be under obligation to lift in each quarter beer at least equivalent to the consideration fee involved in the quantity of beer lifted in the preceding year.

Seperate register shall be maintained for balance stock and shall be also uploaded on the portal by District Excise Officer. The disposal of such stock shall be made in a manner as prescribed by the State Government.

Any balance of beer, wine and Low Alcoholic Beverages quantity found unsold at the expiry of the term of license shall be declared by licensee brand wise, volume wise, strength wise and packaging wise before the District Excise Officer on the next day upto 12: oo (noon) clock and shall be returned by him to the wholesale shop of the district by 5.00 p.m. of the next day of expiry of license. Seperate register shall be maintained for balance stock and shall be also uploaded on the portal by District Excise Officer. The disposal of such stock shall be made in a manner as prescribed by the State Government.

17. Amendment of rule-9-In the said rules, for existing rule 17 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely-

(d) If the licensee is convicted of an offence punishable under the Act or any other law for the time being in force relating to revenue, or of any cognizable and non-bailable offence, or any offence punishable under Narcotics Drugs and Psychotropic Substances Act.1985 or of any offence punishable under Sections 482 to 489 of the Indian Penal Code.

(e) If any liquor or intoxicating drug is found in the possession of licensee against the provisions of the Act or Rules.

(f) If it is found that the licence has been obtained in a false name and the person is holding the licence on behalf of some other person.

(g) If it is found that price has been charged from the consumers more than the M.R.P. printed on the labels of bottles/containers.

Such licensee shall also be required to deposit security amount according to the rate of daily licence fees for the period of interim settlement:

(a) In case a licence is suspended, cancelled or surrendered in accordance with the provisions of these rules or if the shop remains unsettled for any reason the Licensing Authority may make interim settlement of the shop at the highest offer on the payment of daily licence fee, on such rates as notified by the Excise Commissioner with prior sanction of the Government for a maximum period of fourteen days at one stretch or till the date of regular settlement, whichever is earlier.
