सा0प0नि0-29 साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन् 1897) की धारा 21 के साथ पठित खान और खनिज (विकास और विनियमन) अधिनियम, 1957 (अधिनियम संख्या 67 सन् 1957) की धारा 23ग के अधीन शक्तियों का प्रयोग करके, राज्यपाल, उत्तर प्रदेश खनिज (अवैध खनन, परिवहन एवं भण्डारण का निवारण) नियमावली, 2018 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।
उत्तर प्रदेश खनिज (अवैध खनन, परिवहन एवं भण्डारण का निवारण) (द्वितीय संशोधन) नियमावली, 2020
1-(1) यह नियमावली उत्तर प्रदेश खनिज (अवैध खनन, परिवहन एवं भण्डारण का संक्षिप्त नाम और प्रारम्भ निवारण) (द्वितीय संशोधन) नियमावली, 2020 कही जायेगी।
नियम 4 का संशोधन (2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी। 2-उत्तर प्रदेश खनिज (अवैध खनन, परिवहन एवं भण्डारण का निवारण) नियमावली, 2018 में, नीचे स्तम्भ-1 में दिये गये नियम-4 के उप नियम (1) के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्ः-

(ख) ऐसी कोई कम्पनी, जो कम्पनी
(ख) ऐसी कोई कम्पनी, जो कम्पनी अधिनियम, 2013 की परिधि में न हो;

(घ) ऐसा कोई व्यक्ति, जिसकी अनुज्ञप्ति किसी पूर्व अनुज्ञप्ति की निबंधन एवं शर्तों का उल्लंघन करने के लिए रद्द कर दी गयी हो;
(ङ) सम्बन्धित जिला हेतु नदी तल

(2) उत्तर प्रदेश खनिज (अवैध खनन, परिवहन एवं भण्डारण का निवारण) (प्रथम संशोधन) नियमावली, 2019 अधिसूचना संख्या 342/LXXXVI–2019-183-2011, दिनांक 9 मार्च, 2019 में प्रकाशित की गई।

IN pursuance of provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of following English translation of Notification No.729/LXXXVI-2020- 183-2011, dated May 22, 2020 :
No. 729/LXXXVI-2020-183-2011 Dated Lucknow, May 22, 2020 IN exercise of the powers under section 23C of the Mines and Minerals (Development and Regulation) Act, 1957 (Act no. 67 of 1957), read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897) the Governor is pleased to make the following rules, with a view to amending the Uttar Pradesh Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2018.
THE UTTAR PRADESH MINERALS (PREVENTION OF ILLEGAL MINING, TRANSPORTATION AND STORAGE) (SECOND AMENDMENT) RULES, 2020 Short title and
1. (1) These rules may be called the Uttar Pradesh Minerals (Prevention of commencement
Illegal Mining, Transportation and Storage) (Second Amendment) Rules, 2020.
(2) They shall come into force with effect from the date of their publication in the Gazette.
2. In the Uttar Pradesh Minerals (Prevention of Illegal Mining, Transportation Amendment of

and Storage) Rules, 2018 for sub-rule (1) of rule 4 set out in column-I below, the sub-rule as set out in column-II shall be substituted, namely:-

(2) The Uttar Pradesh Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules 2018, (First Amendment) was issued vide notification no. 342/LXXXVI–2019-183-2011, dated March 9, 2019.
