अधिसूचना
उत्तर प्रदेश माल और सेवा कर अधिनियम, 2017 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 2017) की धारा 148 द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, परिषद् की सिफारिशों पर, एतद्द्वारा अधिसूचना संख्या 426/ग्यारह-2-9(47)-17-उ0प्र0अधि0-1-2017-आदेश(104)-2020, दिनांक 30 अप्रैल, 2020, में निम्नलिखित संशोधन करती हैं, अर्थात् :-
संशोधन
उक्त अधिसूचना में-
(i) प्रथम प्रस्तर में, निम्नलिखित परन्तुक बढ़ा दिया जायेगा, अर्थातः-
''परन्तु व्यक्तियों के ऐसे वर्ग में वे निगमित ऋणी नहीं आयेंगे जिन्होंने आईआरपी/आरपी की नियुक्ति के पहले तक की समस्त कर अवधियों के लिए उक्त अधिनियम की धारा 37 के अधीन विवरण और धारा 39 के अधीन विवरणी प्रस्तुत कर दी है।'';
(ii) प्रस्तर-2 के स्थान पर, तारीख 21 मार्च, 2020 से, निम्नलिखित प्रस्तर रख दिया गया समझा जायेगा, अर्थातः- 2 उत्तर प्रदेश असाधारण गजट, 26 मई, 2020 जहां वह निगमित ऋणी पूर्व में रजिस्ट्रीकृत था, आईआरपी/आरपी की नियुक्ति के तीस दिन के भीतर या 30 जून, 2020 तक, जो भी पश्चात्वर्ती हो, नया रजिस्ट्रीकरण (जिसे आगे नया रजिस्ट्रीकरण कहा गया है) कराने के लिए उत्तरदायी होगा।''

IN pursuance of the provision of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of Government notification no. 489/XI-2-20-9(47)-17-U.P. Act-1-2017-Order(124)-2020, dated May 26, 2020 :

IN exercise of the powers conferred by section 148 of the Uttar Pradesh Goods and Services Tax Act, 2017 (U.P. Act no. 1 of 2017), the Governor, on the recommendations of the Council, hereby makes the following amendments in the notification No. 426/XI-2-9(47)/ 17- U.P. Act-1-2017-Order- (104) -2020 Dated April 30, 2020, namely:-
AMENDMENT
In the said notification -
(i) in the first paragraph, following proviso shall be inserted, namely: -
''Provided that the said class of persons shall not include those corporate debtors who have furnished the statements under section 37 and the returns under section 39 of the said Act for all the tax periods prior to the appointment of IRP/RP.'';
(ii) for the paragraph 2, with effect from the 21st March, 2020, the following paragraph shall be deemed to have been substituted, namely: -
"2. Registration.- the said class of persons shall, with effect from the date of appointment of IRP/RP, be treated as a distinct person of the corporate debtor, and shall be liable to take a new registration (hereinafter referred to as the new registration) in each of the States or Union Territories where the corporate debtor was registered earlier, within thirty days of the appointment of the IRP/RP or by 30th June, 2020, whichever is later.''
