संयुक्त प्रान्त आबकारी अधिनियम, 1910 (अधिनियम संख्या 4 सन् 1910) की धारा 41 के अधीन शक्तियों का प्रयोग करके, और राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त, समय-समय पर यथासंशोधित, उत्तर प्रदेश वि—त स्प्रिट तथा विशिष्टतया वि—त स्प्रिट को कब्जे में रखने के लिये लाइसेंस नियमावली, 1976 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं-

लिये लाइसेंस (छठवां संशोधन) नियमावली, 2020
1-संक्षिप्त नाम और प्रारूप-(1) यह नियमावली उत्तर प्रदेश वि—त स्प्रिट तथा विशिष्टतया वि—त स्प्रिट को कब्जे में रखने के लिये लाइसेंस (छठवां संशोधन) नियमावली, 2020 कही जायेगी।
(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।2 उत्तर प्रदेश असाधारण गजट, 29 मई, 2020 ई0 2-नियम-5 का संशोधन-उत्तर प्रदेश वि—त स्प्रिट तथा विशिष्टतया वि—त स्प्रिट को कब्जे में रखने के लिये लाइसेंस नियमावली, 1976 मेें नियम-5 में-
(क) उप नियम (1) में-
(एक) नीचे स्तम्भ-1 में दिये गये खण्ड (ग) के स्थान पर स्तम्भ-2 में दिया गया खण्ड रख दिया जायेगा, अर्थात्-
स्तम्भ-1 विद्यमान खण्ड
स्तम्भ-2 एतद्द्वारा प्रतिस्थापित खण्ड (ग) स्प्रिट उत्तर प्रदेश में स्थित किसी आसवनी से
प्राप्त की जायेगी।
(ग) स्प्रिट, उत्तर प्रदेश में स्थित किसी आसवनी से प्राप्त किया जायेगा परन्तु यह कि विशिष्टतया विकृत स्प्रिट का आयात अन्य राज्य अथवा देश से किया जा सकता है।
(दो) नीचे स्तम्भ-1 में दिये गये खण्ड () के स्थान पर स्तम्भ-2 में दिया गया खण्ड रख दिया जायेगा, अर्थात्-
स्तम्भ-1 विद्यमान खण्ड
स्तम्भ-2 एतद्द्वारा प्रतिस्थापित खण्ड (ञ) लाइसेन्स धारी प्रभारी आबकारी निरीक्षक द्वारा स्टाक का सत्यापन किये जाने के पश्चात् प्रत्येक कलेण्डर माह के अन्तिम कार्य दिवस को पाये गये वि—त स्प्रिट के 1.5 प्रतिशत से अधिक संग्रहण छीजन पर विकृत स्प्रिट पर प्रति लीटर विहित विक्रय फीस (वैण्ड फी) की दर से शास्ति का देनदार होगा।
(ञ) प्रभारी आबकारी निरीक्षक द्वारा स्टाक का सत्यापन किये जाने के पश्चात् प्रत्येक कलेण्डर माह के अन्तिम कार्य दिवस को पाये गये वि—त स्प्रिट के 1.5 प्रतिशत से अधिक संग्रहण छीजन संयुक्त प्रान्त आबकारी अधिनियम, 1910 की धारा 64 के अधीन अपराध होगा और धारा 74 के अधीन दण्डनीय होगा। (ख) उप नियम (2) में नीचे स्तम्भ-1 में दिये गये खण्ड (क) के स्थान पर स्तम्भ-2 में दिया गया खण्ड रख दिया जायेगा, अर्थात्-
स्तम्भ-1 (विद्यमान खण्ड)
स्तम्भ-2 (एतद्द्वारा प्रतिस्थापित खण्ड) (क) प्रयुक्त स्प्रिट में राज्य सरकार द्वारा उद्योग के लिये अनुमोदित विकर्ता पदार्थ मिला होगा। वह केवल उत्तर प्रदेश में स्थित किसी आसवनी से ही प्राप्त किया जायेगा।
(क) प्रयुक्त स्प्रिट में राज्य सरकार द्वारा उद्योग के लिये अनुमोदित विकृतिकारक पदार्थ अन्तर्विष्ट होंगे। वह उत्तर प्रदेश में स्थित किसी आसवनी से प्राप्त किया जायेगा परन्तु यह कि विशिष्टतया विकृत स्प्रिट का आयात अन्य राज्य या देश से किया जा सकता है।

NOTIFICATION
In exercise of the powers under section 41 of the Excise Act, 1910 (Act no. IV of 1910) and with the previous sanction of the State Government the Excise Commissioner makes the following rules with a view to amending the Uttar Pradesh Licenses for the possession of Denatured Sprit and Specially Denatured Spirit Rules, 1976, as amended from time to time:

1. Short title and commencement –(1) These rules may be called the Uttar Pradesh Licenses for the Possession of Denatured Spirit and Specially Denatured Spirit (Sixth Amendment) Rules, 2020.
(2) They shall come into force with effect from the date of their publication in the Gazette.
2. Amendment of rule-5–In the Uttar Pradesh Licenses for the Possession of Denatured Spirit and Specially Denatured Spirit Rules, 1976 in rule-5:
(a) in sub-rule (1)–
(i) for clause (c) set out in Column I below, the clause as set out in the Column II shall be substituted, namely–
