विद्युत अधिनियम, 2003 (अधिनियम संख्या 36 सन्‌ 2003) की धारा 181 के अधीन प्रदत्त शक्तियों तथा इस निमित्त समर्थकारी समस्त शक्तियों का प्रयोग करके पिछले प्रकाशन के बाद, उत्तर प्रदेश विद्युत नियामक आयोग एतद्‌द्वारा उ0प्र0 विद्युत नियामक आयोग(बहुवर्षीय वितरण एवं पारेषण टैरिफ) विनियमावली, 2019 में संशोधन हेतु निम्नलिखित विनियमावली बनाते हैं। अधिसूचना संख्याः यूपीईआरसी/प्रतिभूति/नियमन /2020-082, दिनांक 05 जून, 2020, अर्थात्‌-

1-संक्षिप्त नाम एवं प्रारम्भ

(i) यह विनियमावली उत्तर प्रदेश विद्युत नियामक आयोग (बहुवर्षीय वितरण एवं पारेषण टैरिफ)(प्रथम संशोधन) विनियमावली, 2020 कहलायेगी।

(ii) यह विनियमावली उत्तर प्रदेश सरकार के आधिकारिक राजपत्र में उनके प्रकाशन की तिथि से लागू होगीे।2 उत्तर प्रदेश असाधारण गजट, 5 जून, 2020 ई0 2-उत्तर प्रदेश विद्युत विनियामक आयोग (बहुवर्षीय वितरण एवं पारेषण टैरिफ) विनियमावली, 2019 के विनियम 16 ''विद्युत क्रय लागत में हुई वृद्धि का उपचार'' के प्रावधानों में संशोधन नीचे दिये गये हैंः विनियम 16 ईधन अधिभार

16.1 ईंधन अधिभार की वसूली

(क) आयोग के अनुमोदन के बाद, वितरण अनुज्ञप्तिधारी तिमाही आधार पर जैसा कि नीचे विस्तृत रूप में दिया गया है, परिवर्तनशील प्रभारों में भिन्नता के कारण हुए ईंधन अधिभार की वसूली करेगा। (ख) ईंधन अधिभार की गणना एवं इसको भारित उन विद्युत स्रोतों की वास्तविक परिवर्तनशील लागतों में भिन्नता के आधार पर किया जायेगा जिनका टू-पार्ट टैरिफ है तथा जिनका ऊर्जा का स्रोत ईंधन हो, साथ ही साथ यह सम्बन्धित टैरिफ आदेश में अनुमोदित किया गया हो। शेष बची हुई वास्तविक विद्युत क्र्रय टू-अप में व्यवहृत की जायेगी।

(ग) वितरण अनुज्ञप्तिधारी को सभी उपभोक्ताओं से nthतिमाही के लिए वसूले जाने वाले ईंधन अधिभार तथा हुई लागत का ब्योरा(n+1)thतिमाही के द्वितीय माह के प्रथम सप्ताह में विस्तृत गणना एवं सहायक अभिलेखों के साथ जैसा कि सत्यापन एवं अनुमोदन के लिए आयोग द्वारा वांछित हो, प्रस्तुत करेगा। (n+1)thतिमाही के दूसरे महीने के अन्तिम सप्ताह में एक सार्वजनिक परामर्श प्रक्रिया आयोजित की जायेगी। आयोग (n+1)thतिमाही के तीसरे महीने के दूसरे सप्ताह के अंत तक अनुमोदित करेगा। इसे (n+1)thतिमाही के तीसरे महीने के बिंिलंग डेटा का प्रयोग करते हुए केवल (n+2)thतिमाही के प्रथम महीने से भारित एवं प्रभारित किया जायेगा। अनुमोदित ईंधन अधिभार की वसूली (n+2)thतिमाही के सभी तीन महीनों में की जायेगी। इस प्रक्रिया की समय सीमा निम्नलिखित होगीः-

16.2 ईंधन अधिभार की गणना के लिए सूत्रः

तिमाही के लिए ईंधन अधिभार नीचे दिये गये सूत्र के आधार पर निर्धारित किया जायेगाः (FS)n = [ { ∑ (VC)i + (Excess or Shortfall) } / ∑ (Q)i ] ×10 जहॉ: (FS)nRs / kWh में है। (VC)i = करोड़ रूपये में परिवर्तनीय लागत में भिन्नता है,nthतिमाही के ithमाह में टू-पार्ट टैरिफ वाले विद्युत स्रोतों और जिनमें ऊर्जा के स्रोत के रूप में ईंधन होता है। यह ऐसे स्रोतों की कुल वास्तविक स्वीकार्य परिवर्तनीय लागत और आयोग द्वारा ऐसे स्रोतों की कुल स्वी—त परिवर्तनीय लागत के बीच अंतर के रूप में निर्धारित किया जायेगा।

i = 1, 2 और 3 nthतिमाही के तीन महीने हैं (Q)i = nthतिमाही के i th महीने की MUs में वास्तविक बिक्री की मात्रा है,उत्तर प्रदेश असाधारण गजट, 5 जून, 2020 ई0 3 (Excess of shortfall) फ्यूल सरचार्ज में आधिक्य या कमी है जो पिछली तिमाही (यों) में वसूल किया गया है, यदि कोई हो। 16.3 परिवर्तनशील अधिभारों में भिन्नता की गणना:

तिमाही के प्रत्येक महीने के लिए ईंधन अधिभार निम्नलिखित सूत्र के आधार पर निर्धारित किया जायेगाः

(i) (Power Purchase Cost)approved = (Per Unit Variable Cost)approved x (Power Purchase Quantum)approved

आयोग द्वारा अनुमोदित कुल बिजली खरीद के क्वांटम में ऊर्जा के स्रोत के रूप में ईंधन का प्रयोग करने वाले एवं टू-पार्ट टैरिफ विद्युत स्रोतों का हिस्सा लागू परिवर्तनीय लागत विद्युत खरीद स्रोत हैं। जहॉंः

(Power Purchase Quantum)approvedएक महीने के लिए, संबंधित टैरिफ ऑर्डर में अनुमोदित सभी स्रोतों से खरीदी गई बिजली के मासिक क्वांटम पर उसी अनुपात को लागू करने से निर्धारित होगा, जैसा कि एक वर्ष के लिए सम्बन्धित टैरिफ आदेश में अनुमोदित सभी स्रोतों से क्रय की गयी कुल विद्युत खरीद की मात्रा एवं लागू परिवर्तनीय लागत वाले विद्युत क्रय स्रोतों से विद्युत की मात्रा का अनुपात हो।

(Per unit Variable Cost)approvedका निर्धारण (Total Power Purchase Cost)approvedको (Total Power Purchase Quantum)approvedसे विभाजित करके किया जायेगा।

जहॉंः

(Total Power Purchase Cost)approved एक वर्ष के लिए संबंधित टैरिफ आदेश में अनुमोदित ऊर्जा के स्रोत के रूप में ईंधन का प्रयोग करने एवं टू-पार्ट टैरिफ वाले सभी विद्युत स्रोतों की लागू परिवर्तनीय लागत का योग है।

(Total Power Purchase Quantum)approved एक वर्ष के लिए संबंधित टैरिफ आदेश में अनुमोदित ऊर्जा के स्रोत के रूप में ईंधन का प्रयोग करने एवं टू-पार्ट टैरिफ वाले सभी लागू विद्युत स्रोतों की विद्युत क्रय के क्वांटम का योग है।

(ii) (Power Purchase Cost)actual allowable = (Per Unit Variable Cost)actual allowable× (Power Purchase Quantum)actual allowable जहॉं

किसी विशेष माह के लिए (Total Power purchase Quantum)actual allowable= Actual Retail Sales for the month (MUs) / [(1-Distribution Loss%) × (1-Intra State Transmission Loss%) × (1-Inter State Transmission Loss%)].

वास्तविक खुदरा बिक्री को उसी पद्धति के अनुसार ग्रास-अप किया जायेगा जैसा कि संबंधित टैरिफ आदेश में वितरण हानि, इंट्रा स्टेट ट्रांसमिशन हानि और इंटर स्टेट ट्रांसमिशन हानि को ध्यान में रखते हुए (Total power Purchase Quantum)actual allowableको प्राप्त करने के लिये अनुमोदित है।

(Power Purchase Quantum) actual allowableकिसी विशेष महीने के लिए, की गणना (Total Power Purchase Quantum) actual allowableसे उसी अनुपात को लागू करने से होगी, जैसा कि एक वर्ष के लिए सम्बन्धित टैरिफ आदेश में अनुमोदित सभी स्रोतों से क्रय की गयी कुल विद्युत खरीद की मात्रा एवं लागू परिवर्तनीय लागत वाले विद्युत क्रय स्रोतों से विद्युत की मात्रा का अनुपात हो।4 उत्तर प्रदेश असाधारण गजट, 5 जून, 2020 ई0 (Power Purchase Cost)actual allowable किसी विशेष माह के लिए एम0ओ0डी0 को (Power Purchase Quantum)actual allowableतक लागू करते हुए लागू परिवर्तनीय लागत विद्युत क्रय स्रोतों की वास्तविक परिवर्तनीय लागतों का योग होगी।

(Per Unit Variable Cost) actual allowable किसी विशेष महीने के लिए (Power Purchase Cost) actual allowableको उस विशेष महीने के लिए(Power Purchase Quantum) actual allowableसे विभाजित करके उसकी गणना की जायेगी। 16.4 भारित किया जाने वाला श्रेणी / उप-श्रेणीवार ईंधन अधिभार(n+2)तिमाही के प्रत्येक माह में निम्न सूत्र के आधार पर निर्धारित किया जायेगा :

(क) मीटर्ड खपत के लिये : [वर्ष के लिए टैरिफ आदेश में अनुमोदित उपश्रेणी उपभोक्ताओं का समेकित औसत बिलिंग दर ABR(in Rs / kWh)/ वर्ष के लिये टैरिफ आदेश में अनुमोदित वितरण अनुज्ञप्तिधारियों का समेकित सम्पूर्ण ABR(in Rs / kWh)] x ईंधन अधिभार (FS)n (in Rs / kWh).

(ख) अनमीटर्ड खपत के लिये : ईंधन अधिभार (FS)n जैसे-जैसे उपश्रेणी उपभोक्ता के ए0बी0आर0 में ईंधन अधिभार के कारण % वृद्धि/कमी एवं फिक्सड चार्जेज में वृद्धि/कमी के अनुसार वसूल किया जायेगा, उदाहरणार्थ एक निश्चित उपश्रेणी के फिक्सड चार्ज X, ए0बी0आर0 Y है तथा उपरोक्त आगणित ईंधन अधिभार Z है, उस दशा में ए0बी0आर0 में % वृद्धि/कमी (Z / Y * 100)% होगी तथा उपभोक्ता की इस उपश्रेणी से वसूला जाने वाला ईंधन अधिभार फिक्सड चार्ज में वृद्धि/कमी होगी, उदाहरणार्थ X * (Z / Y). 16.5 अन्य प्रावधान:

(क) उपश्रेणीवार ईंधन अधिभार संबंधित उपश्रेणी केABR के 10% (+)(-)पर सीमित होगा या किसी अन्य सीमा जैसा कि आयोग द्वारा निर्देशित किया जाये।

(ख) ईंधन अधिभार की गणना दो डेसीमल तक की जायेगी। (ग) ईंधन अधिभार (FS)nमें किसी भी वृद्धि या कमी को वितरण अनुज्ञप्तिधारी द्वारा आगे ले जाया जायेगा और भविष्य में ऐसी अवधि में वसूल किया जायेगा जैसा कि आयोग द्वारा निर्देशित किया जाये। (घ) ईंधन अधिभार उपभोक्ता बिलों में एक अलग हेड के तहत दिखाया जायेगा। सकारात्मक ईंधन अधिभार के मामले में, ईंधन अधिभार हेड के तहत उपभोक्ताओं को अलग से कुल बिल में वृद्धि(+)दी जायेगी नकारात्मक ईंधन अधिभार के मामले में, ईंधन अधिभार हेड के तहत उपभोक्ताओं का अलग से कुल बिल में क्रेडिट(-)दिया जायेगा, ताकि प्रभावी रूप से आयोग द्वारा निर्धारित आधार टैरिफ वही रहे।

(ड.) वितरण अनुज्ञप्तिधारी द्वारा ईंधन अधिभार को नियमित तथा समय पर दाखिल किया जाना है, अन्यथा याचिका के प्रस्तुतीकरण के विलम्ब के लिए उ0प्र0 विद्युत नियामक आयोग (फीस एण्ड फाइन्स) विनियमावली, 2010 के प्रथम संवर्धन/संशोधन के क्रमांक 7, पार्ट-ए जनरल, फीस अनुसूची में संवर्धन, समय-समय पर संशोधित, में दिये गये अधिभार लागू होंगे।

(च) आयोग, हालांकि, यदि वह इसे अधिक उपयुक्त मानता है, तो सूत्र/प्रक्रिया को उपयुक्त रूप से संशोधित/परिवर्तित कर सकता है।

Notification

In exercise of powers conferred under Section 181 of the Electricity Act, 2003 (No. 36 of 2003) and all other powers enabling in this behalf, and after previous publication, the Uttar Pradesh Electricity Regulatory Commission, hereby makes the following Regulations to amend the Uttar Pradesh Electricity Regulatory Commission (Multi Year Tariff for Distribution and Transmission) Regulations, 2019 vide Notification No. UPERC/Secy/ Regulation/2020-082 dated June 05, 2020, namely: -

1. Short Title and Commencement–

1.1 These Regulations may be called the Uttar Pradesh Electricity Regulatory Commission (Multi Year Tariff for Distribution and Transmission) (First Amendment) Regulations, 2020.

1.2 These Regulations shall come into force from the date of their publication in the Official Gazette of the Uttar Pradesh Government .

2. The provisions of Regulation 16 "Treatment of incremental Power Procurement Cost" of the Uttar Pradesh Electricity Regulatory Commission (Multi Year Tariff for Distribution and Transmission) Regulations, 2019 are amended as hereunder:

Regulation 16. Fuel Surcharge

16.1 Recovery of Fuel Surcharge :

a) After the approval of the Commission, the Distribution Licensee shall recover the Fuel Surcharge incurred due to variation in variable charges, as detailed below,on a quarterly basis.

b) The Fuel Surcharge shall be computed and charged on the basis of variation in actual variable cost of the power sources having two-part tariff and having fuel as a source of energy vis- a'-vis the same approved in the concerned Tariff Order. All remaining actual power purchase shall be dealt in True-up.

c) The Distribution Licensee shall submit details of the cost incurred and Fuel Surcharge to be charged to all consumers for the nth quarter, along with the detailed computations and supporting documents as may be required for verification and approval of the Commission within 1st week of the second month of (n+1)th quarter. A public consultation process shall be held in the last week of the second month of (n+1)th quarter.

The Commission shall approve by the end of the 2nd week of the 3rd month of (n+1)th quarter. The same shall be levied and charged from the first month of (n+2)th quarter only using the billing data of 3rdmonth of (n+1)th quarter. The Fuel Surcharge approved, shall be levied in all 3 months of (n+2)th quarter.

The timelines for the process shall be as following:

16.2 Formula for computation of Fuel Surcharge:

The Fuel Surcharge for the quarter will be determined based on the formula below:

(FS)n=[{∑ (VC)i + (Excess or Shortfall)}/∑ (Q)i]X10

Where:

(FS)n is in Rs. / kWh

(VC)i = is the variation in Variable Cost in Rs. Crore, of the power sources having two-part tariff and having fuel as a source of energy in ith month of nth quarter. This shall be determined as the difference between total actual allowable variable cost of such sources and the total approved Variable Cost of such sources by the Commission.

i = 1, 2 and 3 are the three months of the nthquarter (Q)i = is the quantum of actual sales in MUs of the ith month of nth quarter

(Excess or Shortfall) is excess or shortfall in Fuel Surcharge recovered in the previous quarter(s), if any.

16.3 Computation of variation in variable charges:

The Fuel Surcharge for each month of the quarter shall be determined based on the following formula:

Where:

(i) (Power Purchase Cost)approved = (Per Unit Variable Cost)approved X (Power Purchase Quantum)approved

The share of power sources having two-part tariff and having fuel as a source of energy in the total power purchase quantum approved by the Commission are the applicable variable cost power purchase sources.

Where:

(Power Purchase Quantum)approved for a month, is determined by applying the same proportion on the monthly quantum of power purchased from all the sources approved in the concerned Tariff Order, as to the proportion of quantum of power from the applicable variableउत्तर प्रदेश असाधारण गजट, 5 जून, 2020 ई0 7 cost power purchase sources and the total quantum of power purchase from all the sources approved in the concerned Tariff Order for a year.

(Per Unit Variable Cost)approved is determined by dividing the (Total Power Purchase Cost)approved with the (Total Power Purchase Quantum)approved.

Where:

(Total Power Purchase Cost)approved is total of applicable variable cost of all the power sources having two-part tariff and having fuel as a source of energy as approved in the concerned Tariff Order for a year.

(Total Power Purchase Quantum)approved is total of quantum of power purchase of all the applicable power sources having two-part tariff and having fuel as a source of energy as approved in the concerned Tariff Order for a year.

(ii) (Power Purchase Cost)actual allowable = (Per Unit Variable Cost)actual allowable X (Power Purchase Quantum)actual allowable

Where:

(Total Power Purchase Quantum)actual allowable for a particular month = Actual Retail Sales for the month (MUs)/[(1-Distribution Loss%) X (1-Intra State Transmission Loss%) X (1-Inter State Transmission Loss %)].

The Actual Retail Sales will be grossed up as per the same methodology as approved in concerned Tariff Order taking into consideration the approved Distribution Loss, Intra State Transmission Loss and Inter State Transmission Loss to find the (Total Power Purchase Quantum)actual allowable.

(Power Purchase Quantum)actual allowable for a particular month will then be calculated from the (Total Power Purchase Quantum)actual allowable by applying the same proportion as to the proportion of quantum of power from the applicable variable cost power purchase sources and the total quantum of power purchase from all the sources approved in the concerned Tariff Order for a year.

(Power Purchase Cost)actual allowable for a particular month will be total of actual variable costs of all the applicable variable cost power purchase sources by applying MOD upto the (Power Purchase Quantum)actual allowable.

(Per Unit Variable Cost)actual allowable for a particular month will be calculated by dividing the (Power Purchase Cost)actual allowable for a particular month with the (Power Purchase Quantum)actual allowable for that particular month.

16.4 Category / Sub-Category wise Fuel Surcharge to be charged in each month of (n+2) quarter shall be determined based on the formula below:

a. For metered consumption:

[Consolidated Average Billing Rate (ABR) of Consumer Sub-category (in Rs./ kWh) as approved in the concerned Tariff Order/Consolidated Overall ABR of Distribution Licensee (in Rs./ kWh) as approved in Tariff Order for the year] x Fuel Surcharge (FS)n (in Rs./ kWh).

b. For un-metered consumption:

The Fuel Surcharge (FS)n shall be levied as the % increase/decrease in Fixed Charges via-s- via % increase/decrease in the ABR of Consumer Sub-category due to Fuel Surcharge i.e. say for a certain Sub-category the Fixed Charges is X, ABR is Y and the above computed Fuel Surcharge is Z, then % increase/decrease in ABR would be (Z/Y*100)% and the Fuel Surcharge to be charged from the consumer of this Sub-category will be as addition/reduction in Fixed Charges i.e. X * (Z/Y).

16.5 Other Provisions:

a. The Sub-category wise Fuel Surcharge shall be capped at (+)(-) 10% of the ABR of the respective Sub-category, or any other ceiling as may be directed by the Commission.

b. The computation of Fuel Surcharge will be done upto two decimals.

c. Any excess or shortfall in the Fuel Surcharge (FS)n shall be carried forward by the Distribution Licensee and shall be recovered over such future period as may be directed by the Commission.

d. The Fuel Surcharge shall be shown under a separate head in the consumer bills. In case of positive Fuel Surcharge, the addition (+) to total bill shall be given to the consumers under the Fuel Surcharge head separately & in case of negative Fuel Surcharge, the credit (-) in total bill shall be given to the consumers under the Fuel Surcharge head, so that the base tariff determined by the Commission effectively will remain the same.

e. Regular and timely filing of Fuel Surcharge has to be done by the Distribution Licensee, otherwise Surcharge for delay in submission of the Petition at Sl. No. 7, Part A General, Addendum to 'Schedule of Fees', in First Addendum/ Amendment to Uttar Pradesh Electricity Regulatory Commission (Fees & Fines) Regulation, 2010 as amended from time to time, will apply.

f. The Commission may however, suitably modify / change the formula / procedure if it considers it to be more appropriate.
