उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 के साथ पठित उत्तर प्रदेश —षि उत्पादन मण्डी अधिनियम, 1964 (उत्तर प्रदेश अधिनियम संख्या 25 सन् 1964) की धारा 40 द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश —षि उत्पादन मण्डी नियमावली, 1965 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।

1-(1) यह नियमावली उत्तर प्रदेश —षि उत्पादन मण्डी (चौबीसवाँ संशोधन) संक्षिप्त नाम और प्रारम्भ
नियमावली, 2020 कही जायेगी।
(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी।
2-उत्तर प्रदेश —षि उत्पादन मण्डी नियमावली, 1965 में, नीचे स्तम्भ-1 में दिये गये नियम 137 का संशोधन
नियम 137 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात् :-

एतद्द्वारा प्रतिस्थापित नियम 2 उत्तर प्रदेश असाधारण गजट, 30 जून, 2020 स्तम्भ-1 स्तम्भ-2 विद्यमान नियम एतद्द्वारा प्रतिस्थापित नियम (1) ऐसी नई प्रसंस्करण इकाई, जिसके संयंत्र और मशीनरी की लागत पाँच करोड़ या उससे अधिक हो, मण्डी शुल्क से छूट या उसमें कमी के लिए विहित प्रपत्र सोलह में यथाविनिर्दिष्ट दस्तावेजों और संलग्नकों तथा प्रसंस्करण शुल्क के रूप में सम्बन्धित मण्डी समिति के पक्ष में रु0 20,000 के बैंक ड्राफ्ट के साथ मण्डलायुक्त के समक्ष आवेदन प्रस्तुत कर सकती है। आवेदन-पत्र प्राप्त होने के सात दिनों के भीतर मण्डलायुक्त उक्त आवेदन-पत्र को सम्बन्धित जिले के जिलाधिकारी को आख्या हेतु अग्रसारित कर देगा।
(1) ऐसी नव स्थापित —षि प्रसंस्करण इकाई, जिसके संयंत्र और मशीनरी की लागत पाँच करोड़ या उससे अधिक हो, मण्डी शुल्क से छूट के लिए विहित प्रपत्र सोलह में यथाविनिर्दिष्ट समस्त सुसंगत दस्तावेजों और संलग्नकों तथा प्रसंस्करण शुल्क के रूप में सम्बन्धित मण्डी समिति के सचिव के पक्ष में रु0 20,000 के बैंक ड्राफ्ट के साथ संबंधित मण्डलायुक्त के समक्ष आवेदन प्रस्तुत कर सकती है। आवेदन-पत्र प्राप्त होने के सात दिनों के भीतर मण्डलायुक्त उक्त आवदेन-पत्र को सम्बन्धित जिले के जिला मजिस्ट्रेट को रिपोर्ट हेतु अग्रसारित कर देगा।
(2) जिला मजिस्ट्रेट उपनियम (1) के अधीन प्रस्तुत दस्तावेजों का परीक्षण करने और धारा 17-क की उपधारा (1) के खण्ड (क) के अधीन संयंत्र एवं मशीनरी का भौतिक सत्यापन करने और अपना यह समाधान कर लेने के पश्चात् कि संयंत्र एवं मशीनरी की लागत पाँच करोड़ या उससे अधिक है, अपनी रिपोर्ट पन्द्रह दिन के भीतर मण्डलायुक्त को प्रेषित करेगा।
(2) उपनियम (1) के अधीन प्रस्तुत प्रार्थना-पत्र में प्रस्तुत किये गये दस्तावेजों का परीक्षण करने एवं धारा 17-क की उपधारा (1) के खण्ड (क) के अन्तर्गत संयंत्र एवं मशीनरी का भौतिक सत्यापन कराकर अपना यह समाधान कर लेने के पश्चात् कि संयंत्र एवं मशीनरी की लागत पाँच करोड़ या उससे अधिक है, जिलाधिकारी द्वारा अपनी आख्या पन्द्रह दिन के अन्दर मण्डलायुक्त को प्रेषित की जायेगी।
(3) जिलाधिकारी से प्राप्त आख्या का परीक्षण निम्नवत् गठित समिति द्वारा किया जायेगा :-

(4) उक्त समिति तीस दिन के भीतर उपनियम (2) के अन्तर्गत जिलाधिकारी द्वारा प्रेषित आख्या एवं इकाई द्वारा प्रस्तुत दस्तावेजों का परीक्षण करेगी और मण्डी शुल्क (विकास सेस को छोड़कर) से छूट प्रदान करने या उसकी दर में कमी करने की संस्तुति करेगी, जिसकी अवधि पाँच वर्ष से अधिक नहीं होगी अथवा प्रार्थना-पत्र को लिखित रूप में सकारण अस्वी—त करेगी।
(4) उक्त समिति तीस दिन के भीतर उपनियम (2) के अधीन जिला मजिस्ट्रेट द्वारा प्रेषित रिपोर्ट और इकाई द्वारा प्रस्तुत दस्तावेजों का परीक्षण करेगी और अनधिक पाँच वर्ष की अवधि के लिये मण्डी शुल्क (उपकर को छोड़कर) से छूट प्राप्त करने के लिये संस्तुति करेगी अथवा आवेदन-पत्र को लिखित रूप में कारण सहित अस्वी—त कर देगी। 3 उत्तर प्रदेश असाधारण गजट, 30 जून, 2020 स्तम्भ-2 स्तम्भ-1 विद्यमान नियम एतद्द्वारा प्रतिस्थापित नियम (5) उपनियम (4) के अधीन समिति द्वारा किये गये विनिश्चय के पश्चात् मण्डलायुक्त मण्डी शुल्क (उपकर को छोड़कर) से छूट हेतु अपनी संस्तुतियों सहित प्रस्ताव राज्य सरकार को प्रेषित करेगा। उक्त प्रस्ताव के प्राप्त हो जाने पर राज्य सरकार अन्तिम विनिश्चय करेगी और उसे ऐसी शर्तों एवं निर्बन्धनों, जैसा कि वह उचित समझे, के साथ गजट में अधिसूचित करेगी।
(5) उपनियम (4) के अधीन समिति द्वारा लिये गये निर्णय के पश्चात् मण्डलायुक्त द्वारा जिन फर्मों को मण्डी शुल्क में छूट अथवा दर में कमी की जानी है (विकास सेस को छोड़कर), के सम्बन्ध में अपनी स्पष्ट संस्तुति सहित प्रस्ताव शासन को प्रेषित किया जायेगा। उक्त प्रस्ताव के प्राप्त हो जाने पर राज्य सरकार अन्तिम निर्णय लेगी और उसे ऐसी शर्तों एवं प्रतिबन्धों के साथ गजट में अधिसूचित करेगी जैसा वह उचित समझे।
स्पष्टीकरण ः-धारा 17(क) और इस नियम के प्रयोजन के लिए नवस्थापित —षि प्रसंस्करण इकाई का तात्पर्य उत्तर प्रदेश —षि उत्पादन मण्डी (संशोधन) अधिनियम, 2013 (उत्तर प्रदेश अधिनियम संख्या 27 सन् 2013) के गजट में प्रकाशित होने के दिनांक 20 दिसम्बर, 2013 को या उसके पश्चात् स्थापित इकाई से है।
स्पष्टीकरण ः-धारा 17-क और इस नियम के प्रयोजनों के लिए नवस्थापित —षि प्रसंस्करण इकाई का तात्पर्य उत्तर प्रदेश —षि उत्पादन मण्डी (संशोधन) अधिनियम, 2013 (उत्तर प्रदेश अधिनियम संख्या 27 सन् 2013) के गजट में प्रकाशित किये जानेे के दिनांक 20 दिसम्बर, 2013 को या उसके पश्चात् स्थापित इकाई से है।

IN exercise of the powers conferred by section 40 of the Uttar Pradesh Krishi Utpadan Mandi Adhiniyam, 1964 (U.P. Act no. XXV of 1964) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Krishi Utpadan Mandi Niyamawali, 1965.
THE UTTAR PRADESH KRISHI UTPADAN MANDI (CHAUBEESWAN
SANSHODHAN) NIYAMAWALI, 2020
Short title and 1. (1) These rules may be called the Uttar Pradesh Krishi Utpadan Mandi
commencement (Chaubeeswan Sanshodhan) Niyamawali, 2020.
(2) They shall come into force with effect from the date of their publication
in the Gazette.
Amendment of 2. In the Uttar Pradesh Krishi Utpadan Mandi Niyamawali, 1965 for rule 137

(4) The said Committee shall examine the report send by the District Magistrate under sub-rule (2) and documents submitted by the unit and shall recommend to exempt or reduce the rate of Mandi Fee (excluding Cess) for a period not exceeding five years or reject the application form with the reasons in writing for such rejection within thirty days.

5 उत्तर प्रदेश असाधारण गजट, 30 जून, 2020 COLUMN-I COLUMN-II Existing rule Rule as hereby substituted(5) After the decision taken by the Committee under sub-rule (4) the Divisional Commissioner shall send the proposal to the State Government with his recommendations for the exemption or reduction in the rate of Mandi Fee (excluding Cess). On receipt of the said proposal the State Government shall take the final decision and notify the same in the Gazette with the conditions and restrictions as it may think fit.
(5) After the decision taken by the Committee under sub-rule (4) the Divisional Commissioner shall send the proposal to the State Government with his recommendations for the exemption of Mandi Fee (excluding Cess). On receipt of the said proposal the State Government shall take the final decision and notify the same in the Gazette with the conditions and restrictions as it may think fit.
Explanation:- For the purposes of section 17-A and this rule, the newly establish agro processing unit means the unit established on or after the date of publication of notification dated December 20, 2013 the date of publication of the Uttar Pradesh Krishi Utpadan Mandi Vidhi (Sanshodhan) Adhiniyam, 2013 (U.P.
