उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 के साथ पठित उत्तर प्रदेश राजस्व संहिता, 2006 (उत्तर प्रदेश अधिनियम संख्या 8 सन् 2012) की धारा 219 के अधीन शक्तियों और अधिसूचना संख्या 740/एक-1-2016-20(5)-2016, दिनांक 3 जून, 2016 का अधिक्रमण करके राज्यपाल, कलेक्टरों को, उक्त अधिनियम संख्या 8 सन् 2012 की धारा 59 की उपधारा (4) के खण्ड (क) एवं (ग) के अधीन ग्राम पंचायतों/स्थानीय प्राधिकरणों में निहित धारा 59 की उपधारा (2) के खण्ड (एक), (दो), (तीन), (चार), (पाँच) तथा (छः) में विनिर्दिष्ट सभी या किसी वस्तु को वापस लेने की, उक्त अधिनियम संख्या 8 सन् 2012 की धारा 59 की उपधारा (4) के खण्ड (क) एवं (ग) के अधीन राज्य सरकार द्वारा प्रयोक्तव्य शक्तियाँ, उक्त संहिता की धारा 77 की उपधारा (2) के अधीन ऐसी लोक उपयोगिता की भूमि की श्रेणी में परिवर्तन करने की शक्तियाँ और उक्त संहिता, की धारा 101 (2) के परन्तुक की शक्तियाँ, उन दशाओं में, जहाँ वह फाइनेन्शियल हैण्डबुक, खण्ड (5) के भाग-1 के परिशिष्ट 9 में उल्लिखित राज्य सरकार के सेवारत विभाग हेतु अपेक्षित हो, प्रत्यायोजित करती हैं। ग्राम पंचायतों/स्थानीय प्राधिकरणों में निहित भूमि का पुनगर््रहण/श्रेणी परिवर्तन निःशुल्क किया जाएगा।

IN exercise of the powers under section 219 of the Uttar Pradesh Revenue Code, 2006 (U.P. Act no. 8 of 2012) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904) and in supersession of notification no. 740/ I-1–2016-20(5)-2016, dated June 3, 2016, the Governor is pleased to delegate to the Collectors the powers exercisable by the State Government under clauses (a) and (c) of sub-section (4) of section 59 of the said Act no. 8 of 2012, to resume all or any of the things specified in clauses (i), (ii), (iii), (iv), (v) and (vi) of sub-section (2) of section 59 vested in Gram Panchayats/Local Authorities under clauses (a) and (c) of sub-section (4) of section 59 of the said Act no. 8 of 2012, change the class of such Public Utility Land under sub-section (2) of section 77 of the said code and the powers in the proviso to section 101(2) of the said code in cases where it is required for a service department of the State Government mentioned in Appendix IX of the Financial Handbook, Volume V, Part-I. Vested land in Gram Panchayats/Local Authorities shall be resume/change the class free of cost.
