अधिसूचना
महामारी अधिनियम 1897 (अधिनियम संख्या 3 सन् 1897) की धारा 2 द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश महामारी कोविड-19 विनियमावली, 2020 को संशोधित करने की दृष्टि से निम्नलिखित विनियमावली बनाती हैं।

संक्षिप्त नाम
1-यह विनियमावली उत्तर प्रदेश महामारी कोविड-19 (चतुर्थ संशोधन) विनियमावली,
2020 कही जाएगी।
विनियम 15 का संशोधन
2- उत्तर प्रदेश महामारी कोविड-19 विनियमावली, 2020 में नीचे स्तम्भ-1 में दिए गए विद्यमान विनियम 15 के स्थान पर स्तम्भ-2 में दिया गया विनियम रख दिया जाएगा, अर्थात्ः-

एतद्द्वारा प्रतिस्थापित विनियम 2 उत्तर प्रदेश असाधारण गजट, 10 जुलाई, 2020 स्तम्भ-1 स्तम्भ-2 विद्यमान विनियम एतद्द्वारा प्रतिस्थापित विनियम सन् 1860) की धारा 188 के अधीन दण्डनीय कोेई अपराध किया गया समझा जाएगा। सक्षम प्राधिकारी ऐसे किसी व्यक्ति/संस्था/संगठन को दण्डित कर सकता है, यदि वह इस विनियमावली के उपबन्धों या इस विनियमावली के अधीन सरकार द्वारा जारी किन्हीं अन्य अग्रतर आदेशों का उल्लंघन करते हुए पाया जाता है।

2-अग्रतर यह कि किसी महामारी के दौरान सेवारत किसी स्वास्थ्य देखभाल सेवाकर्मी के विरूद्ध किसी व्यक्ति द्वारा किए गए हिंसात्मक कार्य अथवा महामारी के दौरान किसी सम्पत्ति की किसी प्रकार की क्षति या नुकसान करने के कारण वह, भारत सरकार द्वारा जारी महामारी (संशोधन) अध्यादेश, 2020 के अधीन दण्डनीय होगा। 2-अग्रतर यह कि किसी महामारी के दौरान सेवारत किसी स्वास्थ्य देखभाल सेवाकर्मी के विरूद्ध किसी व्यक्ति द्वारा किए गए हिंसात्मक कार्य अथवा महामारी के दौरान किसी सम्पत्ति की किसी प्रकार की क्षति या नुकसान करने के कारण वह, भारत सरकार द्वारा जारी महामारी (संशोधन) अध्यादेश, 2020 के अधीन दण्डनीय होगा।
3-किसी व्यक्ति द्वारा किसी सार्वजनिक स्थान पर अथवा घर से बाहर मुखावरण (मास्क), गमछा, रूमाल या दुपट्टा/स्कार्फ न पहनने पर या थूकने पर उसे निम्नलिखित जुर्माना से दण्डित किया जायेगाः-
3-किसी व्यक्ति द्वारा किसी सार्वजनिक स्थान पर अथवा घर से बाहर मुखावरण (मास्क), गमछा, रूमाल या दुपट्टा/स्कार्फ न पहनने पर या सार्वजनिक स्थलों पर थूकने पर उसे रू.500 (पांच सौ रूपये मात्र) जुर्माना से दण्डित किया जायेगा।
(1) प्रथम एवं द्वितीय बार के लिए
जुर्माना रू.100 (सौ रूपये मात्र);
(2) तृतीय बार तथा प्रत्येक अनुवर्ती बार के लिए जुर्माना रू.500 (पांच सौ रूपये मात्र)।
4-ऐसे व्यक्ति, जो कोविड-19 से पीड़ित न हो, द्वारा लॉक डाउन का उल्लंघन किये जाने पर उसे निम्नलिखित जुर्माना से दण्डित किया जायेगाः-

(1) प्रथम बार के लिए न्यूनतम
(1) प्रथम बार के लिए न्यूनतम जुर्माना रू.100 (सौ रूपये मात्र), जो रू.500 (पांच सौ रूपये मात्र) तक हो सकता है;

एतद्द्वारा प्रतिस्थापित विनियम
:- इन समस्त मामलों में
जुर्माना प्रशमित किए जाने की शक्ति,
सम्बन्धित न्यायालय या कार्यपालक
मजिस्टे्रट या ऐसे पुलिस अधिकारी, जो
चालान करने वाले पुलिस अधिकारी की
श्रेणी से ऊपर का हो किन्तु निरीक्षक की
श्रेणी से नीचे का न हो, में निहित होगी।
5-दुपहिया वाहन पर पिछली सीट पर
यात्रा करने परः-
(1) प्रथम बार के लिये जुर्माना रू.250
(दौ सौ पचास रूपये मात्र);
(2) द्वितीय बार के लिये जुर्माना रू.500
(पांच सौ रूपये मात्र);
(3) तृतीय बार के लिये जुर्माना रू.1000
(एक हजार रूपये मात्र);
(4) तृतीय बार के पश्चात् वाहन चलाने
का लाईसेंस निरस्त किया जाना/निलम्बित
किया जाना;
परंतु कार्यपालक मजिस्ट्रेट की अनुमति
लेकर अति आवश्यक परिस्थितियों में, दुपहिया
वाहन पर दो व्यक्ति उस दशा में यात्रा कर
सकेंगे कि पीछे बैठे व्यक्ति को हेलमेट,
जिससे पूरा चेहरा ढकता हो, के अतिरिक्त
मुखावरण एवं ग्लब्स भी लगाना होगा। ः- इन समस्त मामलों में
जुर्माना प्रशमित किए जाने की शक्ति,
सम्बन्धित न्यायालय या कार्यपालक मजिस्टे्रट
या ऐसे पुलिस अधिकारी, जो चालान करने
वाले पुलिस अधिकारी की श्रेणी से ऊपर का
हो किन्तु निरीक्षक की श्रेणी से नीचे का न
हो, में निहित होगी।

IN exercise of the powers conferred by section 2 of the Epidemic Diseases Act, 1897 (Act no. 3 of 1897) the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Epidemic Disease, Covid-19 Regulations, 2020.
THE UTTAR PRADESH EPIDEMIC DISEASE COVID-19 (FOURTH AMENDMENT) REGULATIONS, 2020
Short title 1. These regulations may be called the Uttar Pradesh Epidemic Disease, Covid-19 (Fourth Amendment) Regulations, 2020.
Amendment of

(2) For second time with fine of Rs. 500 (Five Hundred Rupees Only) which may be extended upto Rs. 1000 (One Thousand Rupees Only);
(3) After second time for every violation or repetition with fine of Rs. 1000 (One Thousand Rupees Only).

(1) For first time with fine of Rs.250 (Two Hundred Fifty Rupees Only);
(2) For second time with fine of
Rs.500 (Five Hundred Rupees Only);
(3) For third time with fine of Rs.1000 (One Thousand Rupees Only);
(4) After third time Cancellation/
Suspension of driving licence : Provided that in urgent circumstances with the permission of the executive magistrate, two persons can travel on a two wheeler with the condition that the pillion rider must wear helmet which covers whole face and must also wear face cover and gloves. NOTE :- In all these matters the power of compounding of fine shall be vested in the related Court or executive magistrate or the police officer who is above the rank of the police officer making the Challan but not below the rank of the Inspector.
