चूँकि राज्यपाल की राय है कि एक लोक महत्व के विषय, जिसमें विकास दुबे तथा उसके साथियों के द्वारा दिनांक 2 जुलाई, 2020-3 जुलाई, 2020 एवं दिनांक 10 जुलाई, 2020 की घटना और इस अवधि के दौरान इस प्रकरण से सम्बन्धित विभिन्न स्थानों पर पुलिस और अपराधियों के मध्य हुए मुठभेड़ के सम्बन्ध में जाँच आयोजित करना आवश्यक है;
2-अतएव, अब, जाँच आयोग अधिनियम, 1952 (अधिनियम संख्या 60 सन् 1952) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल न्यायमूर्ति (सेवानिवृृत्त) श्री शशि कांत अग्रवाल पुत्र स्व0 श्री राम सरन अग्रवाल, निवासी जे0-404, आदित्य मैगा सिटी, वैभव खण्ड, इन्दिरापुरम, गाजियाबाद को एकल सदस्यीय जाँच आयोग, जिसका मुख्यालय कानपुर में होगा, के रूप में नियुक्त करती है;
3-उक्त आयोग निम्नलिखित बातों को दृष्टिगत रखते हुए उक्त घटनाओं के सम्बन्ध में जाँच करेगा और उस पर रिपोर्ट देगा :-
(1)-विकास दुबे तथा उसके साथियों के द्वारा दिनांक 2 जुलाई, 2020-3 जुलाई, 2020 की रात्रि में की गयी घटना, जिसमें 08 पुलिस कर्मियों की हत्या हुई थी तथा अन्य पुलिस कर्मी घायल हुए थे, की गहनतापूर्वक जाँच किया जाना;
2 उत्तर प्रदेश असाधारण गजट, 12 जुलाई, 2020(2)-दिनांक 10 जुलाई, 2020 को पुलिस एवं विकास दुबे के मध्य हुई मुठभेड़ की गहनतापूर्वक जाँच किया जाना;
(3)-दिनांक 2 जुलाई, 2020-3 जुलाई, 2020 एवं दिनांक 10 जुलाई, 2020 के मध्य पुलिस और इस प्रकरण से सम्बन्धित अपराधियों के बीच हुई प्रत्येक मुठभेड़ की गहनतापूर्वक जाँच किया जाना;
(4)-विकास दुबे और उसके साथियों की पुलिस तथा अन्य विभागों/व्यक्तियों से दुरभिसंधि के सम्बन्ध में गहनतापूर्वक जाँच करना और भविष्य में इसकी पुनरावृत्ति को रोकने के लिये सुझाव दिया जाना;
(5)-ऊपर उल्लिखित बिन्दुओं से सम्बन्धित किसी भी अन्य पहलू की गहनता से परीक्षण किया जाना;
(6)-राज्य सरकार द्वारा समय-समय पर निर्दिष्ट किसी अन्य बिन्दुओं पर जाँच किया जाना।
4-राज्यपाल, इस राय के होते हुए कि, की जाने वाली जाँच की प्र—ति और मामलों की अन्य परिस्थितियों को दृष्टिगत रखते हुए ऐसा करना आवश्यक है, उक्त अधिनियम की धारा 5 की उपधारा (1) के अधीन अग्रतर निदेश देती हैं कि उक्त धारा 5 की उपधारा (2), (3), (4) एवं (5) के उपबन्ध आयोग पर लागू होंगे। 5-उक्त आयोग इस अधिसूचना के जारी किये जाने के दिनांक से दो मास की अवधि के भीतर अपनी जाँच पूर्ण कर लेगा। इसकी अवधि में किसी प्रकार का परिवर्तन सरकार के आदेश से किया जायेगा।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 997 P/VI-P-3–2020- 82P-2020, dated July 12, 2020 :
No. 997 P/VI-P-3–2020-82P-2020
Dated Lucknow, July 12, 2020
WHEREAS the Governor is of the opinion that it is necessary to hold an enquiry with regard to matter of public importance in which incident on July 2, 2020–July 3, 2020 and July 10, 2020 by Vikas Dubey and his associates and encounter between police and criminal regarding this episode at various places during this period.
2. NOW, THEREFORE, in the exercise of the powers conferred by section 3 of the Commissions of Inquiry Act, 1952 (Act no. LX of 1952), the Governor is pleased to appoint Justice (Retd.) Shri Shashi Kant Agarwal S/o Late Ram Saran Agarwal, Resident Jo-404, Aditya Mage City, Vaibhav Khand, Indirapuram, Ghaziabad as a single member Commission of Inquiry with Headquarters at kanpur.
3. The Commission shall enquire into and submit a report in respect of the said incidents with a view to;
(1) intensively enquire into the incident on the night of July 2, 2020–July 3, 2020 carried out by Vikas Dubey and his associates in which 08 policemen were killed and other police personnel were injured;

(3) intensively enquire each encounter between police and criminals related to this episode between July 2, 2020–July 3, 2020 and July 10, 2020;
(4) intensively enquire about collussion of Vikas Dubey and his associates with Police and other departments/persons and to give suggestions for preventing its recurrence in future;
(5) intensively examine any other aspect related to the above mentioned points;
(6) enquire any other point referred by the State Government from time to time.
4. The Governor, being of the opinion that having regard to the nature of the inquiry to be made and other circumstances of the case, it is necessary so to do, is further pleased to direct under sub-section (1) of section 5 of the said Act, that the provisions of sub-section (2), (3), (4) and (5) of the said section 5 shall apply to the Commission.
5. The Commission shall complete the inquiry within a period of two months from the date of the issue of this notification. Any change in its tenure shall be at the behest of the Government.
