उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन् 1904) की धारा 21 और उत्तर प्रदेश क्षेत्र पंचायत तथा जिला पंचायत अधिनियम, 1961 (उत्तर प्रदेश अधिनियम संख्या 33 सन् 1961) की धारा 117 की उपधारा (2) के साथ पठित उक्त अधिनियम की धारा 237 की उपधारा (1) के अधीन शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश क्षेत्र समिति तथा जिला परिषद निर्माण कार्य नियमावली, 1984 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।

नियमावली, 2020
1-(1) यह नियमावली उत्तर प्रदेश क्षेत्र समिति तथा जिला परिषद निर्माण कार्य (प्रथम संक्षिप्त नाम और प्रारम्भ
संशोधन) नियमावली, 2020 कही जाएगी।
(2) यह गजट में प्रकाशन किये जाने के दिनांक से प्रवृत्त होगी।
सामान्य संशोधन 2-उत्तर प्रदेश क्षेत्र समिति तथा जिला परिषद निर्माण कार्य नियमावली 1984 में, शीर्षक, उपशीर्षक और संक्षिप्त नाम सहित शब्द ''क्षेत्र समिति'' तथा ''जिला परिषद'' जहाँ कहीं आये हों, के स्थान पर शब्द क्रमशः ''क्षेत्र पंचायत'' तथा ''जिला पंचायत'' रख दिये जायेंगे। 2 उत्तर प्रदेश असाधारण गजट, 14 जुलाई, 2020 3-उक्त नियमावली में, नीचे स्तम्भ 1 में, दिये गये नियम 18 के स्थान पर स्तम्भ-2 में नियम 18 का संशोधन
दिया गया नियम रख दिया जायेगा, अर्थात् :-

18-अनुमोदित ठेकेदारों का रजिस्टरः-
18-ठेकेदारों का रजिस्ट्रीकरण और
उनकी अर्हता :-
अनुमोदित ठेकेदारों का एक रजिस्टर प्रपत्र संख्या नि0 का0-1 में परिषद या क्षेत्र समिति के कार्यालय में रखा जाएगा। ठेकेदार स्थानीय समाचार पत्रों में विज्ञापन द्वारा आवेदन पत्र आमंत्रित करके और प्रार्थीयों के पूर्ववृत्त की जांच करने और यथास्थिति सार्वजनिक निर्माण समिति या कार्यकारिणी का अनुमोदन लेने के पश्चात् अनुमोदित किए जाएंगे। किसी परिषद या क्षेत्र समिति के निर्माण कार्यों का निष्पादन करने के लिए अनुमोदित प्रत्येक ठेकेदार से अपेक्षा की जाएगी कि अनुमोदित ठेकेदारों के रजिस्टर में उसका नाम लिखे जाने से पूर्व वह रजिस्ट्रीकरण शुल्क के रूप में 100 रुपये की धनराशि जमा करें।
समस्त जिला पंचायतों में रजिस्ट्रीकृत ठेकेदारों के अतिरिक्त, राज्य सरकार के सिंचाई विभाग, लोक निर्माण विभाग में रजिस्ट्रीकृत ठेकेदार भी जिला पंचायतों के निर्माण कार्य तथा अन्य कार्यों के संबंध में आमंत्रित की जाने वाली निविदाओं में भाग लेने हेतु पात्र होंगे और किसी विशिष्ट कार्य के लिए टेण्डर के न्यूनतम होने की दशा में, ठेकेदार से जिला पंचायत में रजिस्ट्रीकरण के प्रयोजनार्थ अपेक्षित रजिस्ट्रीकरण शुल्क, डिमाण्ड ड्राफ्ट/ ई-बैंकिंग के माध्यम से जमा कराया जायेगा और जिला पंचायत के लिए यह अनिवार्य होगा कि वह उस ठेकेदार को एक सप्ताह के भीतर रजिस्ट्रीकृत करें और उसे विशिष्ट टेण्डर की निबन्धन और शर्तों के अनुसार प्रतिभूति इत्यादि जमा करने के लिए कहे और जिला पंचायत उसके साथ एक करार निष्पादित करेगा। जिला पंचायत में, ठेकेदारों द्वारा रजिस्ट्रीकरण शुल्क के रूप में रु0 10,000 (दस हजार रुपये मात्र) की धनराशि जमा की जाएगी।

IN exercise of the powers under sub-section (1) of section 237 of the Uttar Pradesh Kshettra Panchayat and Zila Panchayat Adhiniyam, 1961 (U.P. Act no. XXXIII of 1961) read with sub-section (2) of section 117 of the said Adhiniyam and section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904), the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Kshettra Samitis and Zila Parishads Work Rules, 1984.

(FIRST AMENDMENT) RULES, 2020
Short title and 1. (1) These rules may be called the Uttar Pradesh Kshettra Samitis and Zila
commencement Parishads Work (First Amendment) Rules, 2020.
(2) They shall come into force with effect from the date of their publication in
the Gazette.
General
2. In the Uttar Pradesh Kshettra Samitis and Zila Parishads Work Rules, 1984

for the words "Kshettra Samitis and Zila Parishads" wherever occurring including
headings, sub-headings and the short title the word "Kshettra Panchayat" and "Zila
Panchayat" shall respectively be substituted.
