पूर्ववर्ती अधिसूचना संख्या 997पी/छः-पु0-3-2020-82पी-2020 लखनऊ, दिनांक 12 जुलाई, 2020 का अधिक्रमण करते हुए राज्यपाल की यह राय है कि लोक महत्व के निश्चित मामलों को दृष्टिगत रखते हुए निर्देश निबन्धन में समाविष्ट और तद्धीन स्पष्टी—त, निर्धारित तथा अभिज्ञानित बिन्दुओं का परीक्षण करने, जाँच करने तथा रिपोर्ट प्रस्तुत करने हेतु जाँच आयोग गठित करना आवश्यक है;
2-अतएव, अब, जाँच आयोग अधिनियम, 1952 (अधिनियम संख्या 60 सन् 1952) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करके राज्यपाल-
(एक) न्यायमूर्ति डॉ0 बी0 एस0 चौहान (मा0 पूर्व न्यायाधीश, मा0 उच्चतम न्यायालय) अध्यक्ष (दो) न्यायमूर्ति श्री शशि कांत अग्रवाल (मा0 पूर्व न्यायाधीश, मा0 उच्च न्यायालय, इलाहाबाद) सदस्य (तीन) श्री के0 एल0 गुप्ता, आईपीएस (पूर्व पुलिस महानिदेशक) सदस्य को त्रिसदस्यीय जाँच आयोग, जिसका मुख्यालय लखनऊ में होगा, के रूप में नियुक्त करती हैं।
3-आयोग ऐसे निम्नलिखित निर्देशों-निबन्धनों की जाँच करेगा और तत्सम्बन्ध में रिपोर्ट प्रस्तुत करेगा, जिन्हें समुचित सरकार लोक महत्व का निश्चित मामला समझे;
(क)-दिनांक 2 जुलाई, 2020-3 जुलाई, 2020 की रात्रि की घटना की जाँच करना, जिसमें विकास दुबे और उसके साथियों ने अभिकथित रूप से 08 पुलिस कर्मियों की हत्या की थी और अन्य पुलिस कर्मियों को गम्भीर रूप से घायल किया था;
2 उत्तर प्रदेश असाधारण गजट, 23 जुलाई, 2020(ख)-दिनांक 10 जुलाई, 2020 की घटना की जाँच करना, जिसमें मध्य प्रदेश से कानपुर लाये जाने के दौरान विकास दुबे मारा गया;
(ग)-दिनांक 2 जुलाई, 2020-3 जुलाई, 2020 व दिनांक 10 जुलाई, 2020 के मध्य विकास दुबे के साथियों की गिरफ्तारी के दौरान पुलिस कार्यवाहियों की जाँच करना;
(घ)-विकास दुबे और उसके साथियों का पुलिस और अन्य विभागों/व्यक्तियों के साथ दुरभिसंधि, यदि कोई हों, के सम्बन्ध में जाँच करना और भविष्य में उसकी पुनरावृत्ति को रोकने के लिए सुझाव देना;
(ङ)-लगभग 64 आपराधिक मामलों का सामना करने के बावजूद विकास दुबे को जमानत/पैरोल पर छोड़े जाने के तथ्यों और परिस्थितियों की जाँच करना और तद्निमित्त उक्त मामले को व्यवहृत करने वाले प्राधिकारियों की भूमिका तथा उनकी सक्रियता/निष्क्रियता को सुनिश्चित करना;
(च)-विकास दुबे को प्रदान की गई जमानतों/पैरोल को रद्द करने हेतु —त प्रयासों, यदि कोई हों, की जाँच करना और यह भी जाँच करना कि मु0अ0सं0 65/2020 व अन्य अपराधों में दिये गये जमानत को रद्द कराने के प्रयास क्यों नहीं किए गए;
(छ)-ऊपर उल्लिखित निर्देश-निबन्धनों से सम्बन्धित किसी अन्य पहलू, जिसे आयोग उपयुक्त और/अथवा आवश्यक समझे, की जाँच करना और उसका परीक्षण करना;
(ज)-राज्य सरकार द्वारा समय-समय पर निर्दिष्ट किसी अन्य बिन्दु की जाँच करना।
4-राज्यपाल, इस राय के होते हुए कि की जाने वाली जाँच की प्र—ति और मामले की अन्य परिस्थितियों को दृष्टिगत रखते हुए ऐसा करना आवश्यक है, उक्त अधिनियम की धारा 5 की उपधारा (1) के अधीन अग्रतर निदेश देती हैं कि उक्त धारा 5 की उपधारा (2), (3), (4) एवं (5) के उपबन्ध आयोग पर लागू होंगे।
5-उक्त आयोग अपनी पहली बैठक के दिनांक से दो माह की अवधि के भीतर अपनी जाँच पूर्ण कर लेगा। इसकी अवधि में किसी प्रकार का परिवर्तन/विस्तार सरकार के आदेश से किया जायेगा।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 1082 P/VI-P-3– 2020-82P-2020, dated July 23, 2020 :

Dated Lucknow, July 23, 2020
IN supersession of the earlier notification no. 997 P/VI-P-3–2020-82P-2020, Lucknow dated July 12, 2020, the Governor is of the opinion that with regard to definite matters of public importance it is necessary to constitute the Commission of inquiry to examine, enquire and report the issues comprised in the terms of reference clarified, stipulated and identified hereunder.
2. NOW, THEREFORE, in the exercise of the powers conferred by section 3 of the Commissions of Inquiry Act, 1952 (Act no. LX of 1952), the Governor is pleased to appoint :–
(i) Dr. Justice B. S. Chauhan (former Hon'ble Judge, Hon'ble Supreme Court) Chairman (ii) Mr. Justice Shashi Kant Agarwal (Former Hon'ble Judge, Hon'ble High Court
of Allahabad)
Member उत्तर प्रदेश असाधारण गजट, 23 जुलाई, 2020 3 (iii) Shri K. L. Gupta, IPS (Former Director General of Police) Member as a three membered Commission of Inquiry with Headquarters at Lucknow.
3. The Commission shall enquire into and submit a report in respect of the following terms of reference which the appropriate government considers to be the definite matters of public importance;
(a) To enquire into the incident on the night of July 2, 2020–July 3, 2020 in which Vikas Dubey and his associates allegedly killed 08 policemen and grievously injured other police personnel;
(b) To enquire into the incident dated July 10, 2020 in which Vikas Dubey got killed while being brought from Madhya Pradesh to Kanpur;
(c) To enquire into the police actions while arresting the accomplices of Vikas Dubey between July 2, 2020–July 3, 2020 and July 10, 2020;
(d) To enquire about collusion, if any of Vikas Dubey and his associates with Police and other departments/persons and to give suggestions for preventing its recurrence in future;
(e) To enquire into the facts and circumstances which resulted in the release of Vikas Dubey on bail/parole inspite of facing approximately 64 criminal cases and ascertain the role and action/inaction of the authorities who dealt with the matter for the same;
(f) To enquire into the efforts, if any, made for cancellation of bails/parole granted to Vikas Dubey and also to enquire as to why efforts were not made to get the bail granted in case crime no 65/2020 and other offences cancelled;
(g) To enquire into and examine any other aspect relating to the above mentioned terms of reference as the Commission may consider appropriate and/or necessary;
(h) Enquire any other point referred by the State Government from time to time.
4. The Governor, being of the opinion that having regard to the nature of the inquiry to be made and other circumstances of the case, it is necessary so to do, is further pleased to direct under sub-section (1) of section 5 of the said Act, that the provisions of sub-section (2), (3), (4) and (5) of the said section 5 shall apply to the Commission.
5. The Commission shall complete the inquiry within a period of two months from the date of first sitting of Commission. Any change/extension in its tenure shall be at the behest of the Government.
