अधिसूचना
''भारत का संविधान'' के अनुच्छेद 213 के खण्ड (1) द्वारा प्रदत्त शक्ति का प्रयोग करके राज्यपाल महोदय द्वारा निम्नलिखित उत्तर प्रदेश औद्योगिक क्षेत्र विकास (संशोधन) अध्यादेश, 2020 (उत्तर प्रदेश अध्यादेश संख्या 16 सन् 2020) जिससे औद्योगिक विकास अनुभाग-4 प्रशासनिक रूप से सम्बन्धित है, प्रख्यापित किया गया है जो इस अधिसूचना द्वारा सर्वसाधारण की सूचनार्थ प्रकाशित किया जाता है।

उत्तर प्रदेश औद्योगिक क्षेत्र विकास अधिनियम, 1976 का अग्रतर संशोधन करने के लिए
अध्यादेश
चूँकि राज्य विधान मण्डल सत्र में नहीं है और राज्यपाल का यह समाधान हो गया है कि ऐसी परिस्थितियाँ विद्यमान हैं जिनके कारण उन्हें तुरन्त कार्यवाही करना आवश्यक हो गया है;
अतएव, अब, संविधान के अनुच्छेद 213 के खण्ड (1) द्वारा प्रदत्त शक्तियों का प्रयोग
करके राज्यपाल निम्नलिखित अध्यादेश प्रख्यापित करती हैं :-
संक्षिप्त नाम 1-यह अध्यादेश उत्तर प्रदेश औद्योगिक क्षेत्र विकास (संशोधन) अध्यादेश, 2020 कहा
जायेगा। 2 उत्तर प्रदेश असाधारण गजट, 28 जुलाई, 2020 2-उत्तर प्रदेश औद्योगिक क्षेत्र विकास अधिनियम, 1976 की धारा 7 में निम्नलिखित 'परन्तुक' बढ़ा दिया जायेगा, अर्थात् :-
उत्तर प्रदेश अधिनियम संख्या 6 सन् 1976 की धारा 7 का संशोधन
''परन्तु जहाँ इस प्रकार आवंटित की गई किसी भूमि का उपयोग कब्जा के दिनांक से पांच वर्ष की अवधि, अथवा आवंटित किये जाने की शर्त के अन्तर्गत ऐसे उपयोग के लिए नियत अवधि, जोे भी अधिक हो, के भीतर नहीं किया जाता है वहाँ आवंटन और पट्टा विलेख रद्द हुआ माना जायेगा और उक्त भूमि प्राधिकरण के पास रहेगी; परन्तु यह और कि जहाँ पूर्वोक्त अवधि इस अध्यादेश के प्रारम्भ होने के पूर्व पहले ही व्यपगत हो गयी हो वहाँ प्राधिकरण आवंटी को ऐसे प्रयोजन, जिसके लिए वह आवंटित की गयी थी, के लिए एक वर्ष की अवधि के भीतर उक्त भूमि का प्रयोग करने के लिए नोटिस देगा और यदि उपर्युक्त एक वर्ष की अवधि के भीतर आवंटी भूमि का उपयोग नहीं करता है तो आवंटन और पट्टा विलेख स्वतः रद्द हुआ माना जायेगा।''

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Audyogik Kshettra Vikas (Sanshodhan) Adhyadesh, 2020 (Uttar Pradesh Adhyadesh Sankhya 16 of 2020) promulgated by the Governor. The Audyogik Vikas Anubhag-4 is administratively concerned with the said Ordinance.

(AMENDMENT) ORDINANCE, 2020
(U.P. ORDINANCE No. 16 OF 2020)
[Promulgated by the Governor in the Seventy first Year of the Republic of India]
AN
ORDINANCE
further to amend the Uttar Pradesh Industrial Area Development Act, 1976.
WHEREAS the State Legislature is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action;
NOW, THEREFORE, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor is pleased to promulgate the following Ordinance:-
Short title 1. This Ordinance may be called the Uttar Pradesh Industrial Area Development (Amendment) Ordinance, 2020.
उत्तर प्रदेश असाधारण गजट, 28 जुलाई, 2020 32. In section 7 of the Uttar Pradesh Industrial Area Development Act, 1976 the
following proviso shall be inserted, namely :-
Amendment of section 7 of U.P. Act no. 6 of 1976
''Provided that where any land so allotted is not utilized for the purpose for which it was allotted within the period of five years from the date of possession or within the period fixed for such utilisation in the conditions of allotment, whichever is longer, the lease deed will stand cancelled and the land shall vest with the Authority. Provided further where the aforesaid period has already lapsed before the commencement of this Ordinance, the Authority shall give a notice to the allottee to use the land for the purpose for which it was allotted within a period of one year and if within the above period of one year the allottee does not use the land, then the allotment and lease deed shall stand automatically cancelled.
