सा0प0नि0-53 साधारण खण्ड अधिनियम, 1897 (अधिनियम संख्या 10 सन्‌ 1897) की धारा 21 के साथ पठित खान और खनिज (विकास एवं विनियमन) अधिनियम, 1957 (अधिनियम संख्या 67 सन्‌ 1957) की धारा 23ग के अधीन शक्तियों का प्रयोग करके राज्यपाल, उत्तर प्रदेश खनिज (अवैध खनन, परिवहन एवं भण्डारण का निवारण) नियमावली, 2018 में संशोधन करने की दृष्टि से निम्नलिखित नियमावली बनाती हैं।

उत्तर प्रदेश खनिज (अवैध खनन, परिवहन एवं भण्डारण का निवारण) (तृतीय संशोधन) नियमावली, 2020

1-(1) यह नियमावली उत्तर प्रदेश खनिज (अवैध खनन, परिवहन एवं भण्डारण का संक्षिप्त नाम और प्रारम्भ निवारण) (तृतीय संशोधन) नियमावली, 2020 कही जायेगी।

नियम 4 का संशोधन (2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी। 2-उत्तर प्रदेश खनिज (अवैध खनन, परिवहन एवं भण्डारण का निवारण) नियमावली, 2018 में, नीचे स्तम्भ-1 में दिये गये नियम-4 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌ः-

4 अनुज्ञप्ति की स्वीकृति और खनिजों के 4 अनुज्ञप्ति की स्वीकृति और खनिजों के

भण्डारण की पात्रता -

भण्डारण की पात्रता -(1) निम्नलिखित व्यक्तियों को छोड़कर प्रत्येक व्यक्ति, अनुज्ञप्ति स्वीकृत किये जाने हेतु पात्र होगा :- (1) निम्नलिखित व्यक्तियों को छोड़कर प्रत्येक व्यक्ति, अनुज्ञप्ति स्वीकृत किये जाने हेतु पात्र होगा :- (क) ऐसा कोई व्यक्ति, जो भारतीय (क) ऐसा कोई व्यक्ति, जो भारतीय राष्ट्रिक न हो; राष्ट्रिक न हो; 2 उत्तर प्रदेश असाधारण गजट, 4 अगस्त, 2020

स्तम्भ-1 स्तम्भ-2

(ख) ऐसी कोई कम्पनी, जो कम्पनी

(ख) ऐसी कोई कम्पनी, जो कम्पनी अधिनियम, 2013 की परिधि में न हो;

(ग) ऐसा कोई व्यक्ति, जो किसी न्यायालय द्वारा सिद्धदोष ठहराया गया हो;

(घ) ऐसा कोई व्यक्ति, जिसकी अनुज्ञप्ति किसी पूर्व अनुज्ञप्ति की निबंधन एवं शर्तों का उल्लंघन करने के लिए रद्‌द कर दी गयी हो;

(ङ) सम्बन्धित जिला हेतु नदी तल के खनिजों की दशा में, पट्‌टेदार, कोविड-19 महामारी से उत्पन्न होने वाली परिस्थितियों के कारण दिनांक 31 दिसम्बर, 2020 को समाप्त होने वाली अवधि में भण्डारण अनुज्ञप्ति के सिवाय। (ङ) सम्बन्धित जिला हेतु नदी तल के खनिजों की दशा में, पट्‌टेदार, कोविड-19 महामारी से उत्पन्न होने वाली परिस्थितियों के कारण दिनांक 31 दिसम्बर, 2020 को समाप्त होने वाली अवधि में भण्डारण अनुज्ञप्ति के सिवाय।

(2) खनिज भण्डारण की अनुज्ञा दी (2) खनिज भण्डारण की अनुज्ञा दी

जायेगी, यदि :-

(क) वह नदी तल के खनिजों की दशा में, पट्‌टाकृत क्षेत्र से 05 कि0मी0 के घेरे के अन्तर्गत न हो,

(क) वह नदी तल के खनिजों की दशा में, पट्‌टाकृत क्षेत्र से 05 कि0मी0 के घेरे के अन्तर्गत न हो :

परन्तु उक्त निर्बन्धन, नदी तल में अनन्य रूप में मिश्रित अवस्था में पाये गये बालू, बजरी, बोल्डर पर आधारित उद्योगों के लिये लागू नहीं होंगे;

(ख) वह अनुज्ञप्ति में विनिर्दिष्ट

मात्रा से अधिक संग्रहीत न किया जाय। मात्रा से अधिक संग्रहीत न की जाय।

Dated Lucknow, August 4, 2020 IN exercise of the powers under section 23C of the Mines and Minerals (Development and Regulation) Act, 1957 (Act no. 67 of 1957), read with section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor is pleased to make the following rules, with a view to amending the Uttar Pradesh Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2018.

THE UTTAR PRADESH MINERALS (PREVENTION OF ILLEGAL MINING, TRANSPORTATION AND STORAGE) (THIRD AMENDMENT) RULES, 2020 Short title and

1. (1) These rules may be called the Uttar Pradesh Minerals (Prevention of commencement

Illegal Mining, Transportation and Storage) (Third Amendment) Rules, 2020.

(2) They shall come into force with effect from the date of their publication in the Gazette.

Amendment of

rule 4

2. In the Uttar Pradesh Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2018 for rule 4 set out in column-I below, the rule as set out in column-II shall be substituted, namely:-

4 Eligibility for grant of licence and 4 Eligibility for grant of licence and

storage of minerals –

(1) Every Person shall be eligible for grant of license except the following person:-

(a) a person who is not an Indian (a) a person who is not an Indian

National;

(b) a company which is not the (b) a company which is not in the

ambit of Companies Act, 2013;

(d) a person whose license has been cancelled for violation of terms and conditions of a previous licence;

(e) lessee in case of river bed minerals for the concerned district except in the storage license period ending on December 31, 2020, owing to conditions arising from Covid-19 pandemic.

(a) it is not within a radius of 05 km. from the leased out area in case of river bed minerals;

be applicable to the industries based on

exclusively found in river-bed;

(b) it is not stocked beyond the
