[ ] उत्तर प्रदेश विद्युत नियामक आयोग अधिसूचना संख्या यूपीईआरसी/सचिव/विनियमावली/2020/210 ए लखनऊ, दिनांक : 26 अगस्त, 2020 ई0

विद्युत अधिनियम, 2003 (2003 का 36) की धारा 181 के साथ पठित धारा 42 की उपधारा (5) से (8) तक के अन्तर्गत प्रदत्त शक्ति और इस निमित्त समर्थ बनाने वाली सभी अन्य शक्तियों का प्रयोग करते हुये, उत्तर प्रदेश विद्युत नियामक आयोग द्वारा उ0प्र0 विद्युत नियामक आयोग (उपभोक्ता व्यथा निवारण फोरम और विद्युत लोकपाल) विनियमावली, 2007 का गठन किया गया था, जिसे अधिसूचना संख्या यूपीईआरसी/सचिव/विनियमावली/ 07/1259 द्वारा दिनांक 04, अक्टूबर, 2007 को प्रकाशित किया था तथा जिनको उ0प्र0 विद्युत नियामक आयोग (उपभोक्ता व्यथा निवारण फोरम और विद्युत लोकपाल) विनियमावली (प्रथम संशोधन), 2019 द्वारा संशोधित किया गया था, जिसे अधिसूचना संख्या यूपीईआरसी/सचिव/विनियमावली/2019/111ए द्वारा दिनांक 09, मई, 2019 को प्रकाशित किया गया था।

और यह कि, उक्त विनियमावली के कुछ प्राविधानों के लागू होने में अनुज्ञप्तिधारी, उपभोक्ता और सामान्य जन को कठिनाई हो रही है और उनके द्वारा कतिपय संशोधनों का अनुरोध किया गया है।

और यह कि, उक्त के परिणामस्वरूप तथा अन्य सारवान्‌ कारणों से उक्त नियमावली के कुछ प्राविधानों में संशोधन आवश्यक हो गया है।

अतः एतद्‌द्वारा, विद्युत अधिनियम, 2003 (2003 का 36) की धारा 181 के साथ पठित धारा 42 की उपधारा (5) से (8) तक के अन्तर्गत प्रदत्त शक्ति और इस निमित्त समर्थ बनाने वाली सभी अन्य शक्तियों का प्रयोग करते हुए, उत्तर प्रदेश विद्युत नियामक आयोग द्वारा उ0प्र0 विद्युत नियामक आयोग (उपभोक्ता व्यथा निवारण फोरम और विद्युत2 उार प्रदेश असाधारण गजट, 26 अगस्त, 2020 ई0 लोकपाल) विनियमावली, 2007 तथा जिसे अधिसूचना संख्या यूपीईआरसी/सचिव/विनियमावली/ 2019/111ए, दिनांक 09, मई, 2019 के अन्तर्गत प्रकाशित उ0प्र0 विद्युत नियामक आयोग (उपभोक्ता व्यथा निवारण फोरम और विद्युत लोकपाल) विनियमावली (प्रथम संशोधन), 2019 द्वारा संशोधित किया गया है, में निम्नानुसार संशोधन किये जाते हैं :- 1.0 -संक्षिप्त शीर्षक, प्रारम्भ और निर्वचन-

1.1-यह विनियमावली उ0प्र0 विद्युत नियामक आयोग (उपभोक्ता व्यथा निवारण फोरम और विद्युत लोकपाल) विनियमावली (द्वितीय संशोधन), 2020 कही जायेगी।

1.2-इन विनियमों का विस्तार सम्पूर्ण उत्तर प्रदेश पर होगा और ये राज्य में विद्युत के वितरण और आपूर्ति के व्यवसाय में संलग्न वितरण अनुज्ञप्तिधारियों पर लागू होंगे।

1.3-ये विनियम नियत तारीख से प्रवृत्त होंगे।

1.4-इस विनियमावली को उ0प्र0 विद्युत सुधार अधिनियम, 1999 के सुसंगत प्राविधानों के साथ उस सीमा तक पढ़ा जायेगा, जिस तक ये विद्युत अधिनियम, 2003 के प्राविधानों से असंगत नहीं है।

1.5-उत्तर प्रदेश साधारण खण्ड अधिनियम, 1904 इन विनियमों के निर्वचन में लागू होगा।

1.6-इन विनियमों के अंग्रेजी और हिन्दी संस्करण के बीच विरोध के मामले में अंग्रेजी संस्करण अभिभावी होगा। 2.0-उ0प्र0 विद्युत नियामक आयोग (उपभोक्ता व्यथा निवारण फोरम और विद्युत लोकपाल) विनियमावली, 2007 के निम्न वर्तमान प्राविधान उनके सामने के कालम में उल्लिखित प्राविधानों से प्रतिस्थापित हो जायेंगे-

वर्तमान विनियम 3.2(ii) संशोधित विनियम 3.2(ii)

न्यायिक सदस्य ऐसा न्यायिक अधिकारी होगा, जो अपर जिला न्यायाधीश की श्रेणी से अन्यून पद धारित किया था और जिसने 60 वर्ष की आयु प्राप्त कर लिया हो और तीन वर्ष की अवधि तक या 65 वर्ष की आयु तक, जो भी पहले हो, पद धारण करेगा।

न्यायिक सदस्य ऐसा न्यायिक अधिकारी होगा, जो अपर जिला न्यायाधीश की श्रेणी से अन्यून पद धारित किया था और जिसने 60 वर्ष की आयु प्राप्त कर लिया हो और तीन वर्ष की अवधि तक या 65 वर्ष की आयु तक, जो भी पहले हो, पद धारण करेगा।

परन्तु आयोग द्वारा उसे द्वितीय अवधि के लिये पुनर्नियुक्त किये जाने पर इस शर्त के साथ विचार किया जा सकेगा कि पदधारण किये जाने की अधिकतम आयु 65 वर्ष ही रहेगी।

परन्तु यह कि उसके द्वारा वर्तमान पद पर किये गये कार्य और आचरण को ध्यान में रखते हुए आयोग द्वारा द्वितीय अवधि के लिये उसकी सेवा को इस शर्त के साथ बढ़ाया जा सकेगा कि पदधारण किये जाने की अधिकतम आयु 65 वर्ष ही रहेगी।

परन्तु यह भी कि उसकी द्वितीय अवधि के लिये कम

से कम छः माह का समय शेष हो।

वर्तमान विनियम 3.2(iii)(ङ) संशोधित विनियम 3.2(iii)(ङ)

तीन वर्ष की अवधि तक या 65 वर्ष की आयु तक, तीन वर्ष की अवधि तक या 65 वर्ष की आयु तक, जो भी पहले हो, फोरम का पद धारण करेगा।

जो भी पहले हो, फोरम का पद धारण करेगा। परन्तु आयोग द्वारा उसे द्वितीय अवधि के लिये पुनर्नियुक्त किये जाने पर इस शर्त के साथ विचार किया जा सकेगा कि पदधारण किये जाने की अधिकतम आयु 65 वर्ष ही रहेगी।

परन्तु यह कि उसके द्वारा वर्तमान पद पर किये गये कार्य और आचरण को ध्यान में रखते हुए आयोग द्वारा द्वितीय अवधि के लिये उसकी सेवा को इस शर्त के साथ बढ़ाया जा सकेगा कि पदधारण किये जाने की अधिकतम आयु 65 वर्ष ही रहेगी।

परन्तु यह भी कि उसकी द्वितीय अवधि के लिये कम

से कम छः माह का समय शेष हो।

U.P. ELECTRICITY REGULATORY COMMISSION (CONSUMER GRIEVANCE REDRESSAL FORUM & ELECTRICITY OMBUDSMAN) REGULATIONS (SECOND AMENDMENTS), 2020

In exercise of the power conferred on it by Section 181 read with sub-sections (5) to (8) of Section 42 of the Electricity Act, 2003 (36 of 2003) and all other powers enabling in this behalf, the Uttar Pradesh Electricity Regulatory Commission had made U.P.E.R.C. (Consumer Grievance Redressal Forum & Electricity Ombudsman) Regulations, 2007 which were published vide notification no. U.P.E.R.C./Secy./Regulation/ 07/1259, Lucknow, Dated 4th October, 2007, and were amended by U.P. Electricity Regulatory Commission (Consumer Grievance Redressal Forum & Electricity Ombudsman) Regulations (First Amendments), 2019 which were published vide notification no. U.P.E.R.C./Secy./ Regulation/2019/111A Lucknow, Dated 09 May, 2019.

And whereas, the licensees, consumers and public are facing difficulties in implementing some of the provisions thereof and have requested for certain amendments in the Regulations.

And whereas, as a result of the above and for other substantial reasons, it has become necessary to amend certain provisions of these Regulations.

Now, therefore in exercise of the powers conferred on it by Section 181 read with sub-sections (5) to (8) of Section 42 of the Electricity Act, 2003 (36 of 2003) and all other powers enabling in this behalf, the Uttar Pradesh Electricity Regulatory Commission hereby make the following amendments in U.P.E.R.C. (Consumer Grievance Redressal Forum & Electricity Ombudsman) Regulations, 2007, as amended by U.P. Electricity Regulatory Commission (Consumer Grievance Redressal Forum & Electricity Ombudsman) Regulations (First Amendments), 2019 which were published vide notification no. U.P.E.R.C./Secy./ Regulation/2019/111A Lucknow, Dated: 09 May, 2019 :

1.0Short Title, Commencement and Interpretation

1.1These Regulations may be called the "U.P. Electricity Regulatory Commission (Consumer Grievance Redressal Forum & Electricity Ombudsman) Regulations, (Second Amendments) 2020".

1.2These Regulations shall extend to the whole of the State of Uttar Pradesh and shall apply on the Distribution Licensees engaged in the business of distribution and supply of electricity in the State.

1.3These Regulations shall come into force from the appointed date.

1.4These Regulations shall be read with the relevant provisions of the U.P. Electricity Reforms Act, 1999 to the extent they are not inconsistent with the provisions of the Electricity Act, 2003.

1.5The Uttar Pradesh General Clauses Act, 1904 shall apply to the interpretation of these Regulations.

1.6In case of conflict between English and Hindi version of these Regulations, the English version shall prevail.

2.0Following existing clauses of U.P.E.R.C. (Consumer Grievance Redressal Forum & Electricity Ombudsman) Regulations, 2007 shall be substituted, as given below :-

Judicial Member shall be a Judicial Officer
