————— संख्या 1569/79-वि-1-20-1(क) 25-208 लखनऊ, 31 अगस्त, 2020 ———— अधिसूचना विविध ''भारत का संविधान'' के अनुच्छेद 200 के अधीन राज्यपाल महोदय ने उत्तर प्रदेश राजकोषीय उत्तरदायित्व और बजट प्रबन्ध (द्वितीय संशोधन) विधेयक, 2020 जिससे वित्त (आय-व्ययक) अनुभाग-1 प्रशासनिक रूप से सम्बन्धित है, पर दिनांक 28 अगस्त, 2020 को अनुमति प्रदान की और वह उत्तर प्रदेश अधिनियम संख्या 22 सन् 2020 के रूप में सर्वसाधारण की सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है :-

उत्तर प्रदेश राजकोषीय उत्तरदायित्व और बजट प्रबन्ध अधिनियम, 2004 का
अग्रतर संशोधन करने के लिये
अधिनियम भारत गणराज्य के इकहत्तरवें वर्ष में निम्नलिखित अधिनियम बनाया जाता है :- 1-(1) यह अधिनियम उत्तर प्रदेश राजकोषीय उत्तरदायित्व और बजट प्रबन्ध संक्षिप्त नाम और प्रारम्भ
(द्वितीय संशोधन) अधिनियम, 2020 कहा जायेगा।
(2) यह दिनांक 19 जून, 2020 से प्रवृत्त हुआ समझा जायेगा। 2 उार प्रदेश असाधारण गजट, 31 अगस्त, 2020 2-उत्तर प्रदेश राजकोषीय उत्तरदायित्व और बजट प्रबन्ध अधिनियम, 2004 की धारा 4 में, उपधारा (3) में खण्ड (ग) के स्थान पर निम्नलिखित खण्ड रख दिया जायेगा, अर्थात :-
उत्तर प्रदेश अधिनियम संख्या 5 सन् 2004 की धारा 4 का संशोधन
''(ग) वित्तीय वर्ष 2020-2021 में राजकोषीय घाटा, प्राक्कलित सकल
राज्य घरेलू उत्पाद के अनधिक पाँच प्रतिशत पर बनाये रखेगी।''
निरसन और व्यावृत्ति
3-(1) उत्तर प्रदेश राजकोषीय उत्तरदायित्व और बजट प्रबन्ध (द्वितीय संशोधन) अध्यादेश, 2020 एतद्द्वारा निरसित किया जाता है।
उत्तर प्रदेश अध्यादेश संख्या 13 सन् 2020 (2) ऐसे निरसन के होते हुए भी उपधारा (1) में निर्दिष्ट अध्यादेश द्वारा यथा संशोधित मूल अधिनियम के उपबन्धों के अधीन —त कोई कार्य या की गई कोई कार्यवाही, इस अधिनियम द्वारा यथा संशोधित मूल अधिनियम के सह प्रत्यर्थी उपबन्धों के अधीन —त या की गई समझी जायेगी मानो इस अधिनियम के उपबन्ध सभी सारवान समयों में प्रवृत्त थे।

उद्देश्य और कारण
राजकोषीय स्थायित्व और संपोषणीयता सुनिश्चित करने और पर्याप्त राजस्व अधिशेष की प्राप्ति करके राजकोषीय घाटे में कमी लाकर और राजकोषीय नीति के प्रभावी संचालन में आने वाली अड़चनों को दूर करने और राज्य सरकार द्वारा लिये जाने वाले उधारों, सरकारी प्रत्याभूतियों, ऋणों और घाटों पर सीमा निर्धारण और मध्यकालिक राजकोषीय रूपरेखा के प्रयोग में महत्तर पारदर्शिता के माध्यम से विवेकपूर्ण ऋण प्रबन्ध द्वारा सामाजिक और भौतिक अवसंरचना में सुधार करने और मानव विकास के अवसर में वृद्धि करने हेतु राज्य सरकार के उत्तरदायित्व की व्यवस्था करने के लिये उत्तर प्रदेश राजकोषीय उत्तरदायित्व और बजट प्रबन्ध अधिनियम, 2004 अधिनियमित किया गया है।
कोविड-19 महामारी के कारण राज्य एवं केन्द्र के संसाधनाें पर गम्भीर विपरीत प्रभाव पड़ा है। उक्त के दृष्टिगत अतिरिक्त संसाधन जुटाने हेतु केन्द्र सरकार द्वारा राज्य सरकारों को सकल राज्य घरेलू उत्पाद के 2 प्रतिशत की अतिरिक्त ऋण सीमा, वित्तीय वर्ष 2020-2021 के लिये अनुमन्य की गयी है, जिसके लिये राज्य सरकारों से अपने राजकोषीय उत्तरदायित्व और बजट प्रबन्ध अधिनियम में संशोधन करने की अपेक्षा की गयी थी। अतएव पूर्वोक्त अधिनियम में संशोधन करने का विनिश्चय किया गया है। चूँकि राज्य विधानमण्डल सत्र में नहीं था और उक्त विनिश्चय को कार्यान्वित करने के लिय तुरन्त विधायी कार्यवाही करनी आवश्यक थी, अतः राज्यपाल द्वारा दिनांक 19 जून, 2020 को उत्तर प्रदेश राजकोषीय उत्तरदायित्व और बजट प्रबन्ध (द्वितीय संशोधन) अध्यादेश, 2020 (उत्तर प्रदेश अध्यादेश संख्या 13 सन् 2020) प्रख्यापित किया गया।
यह विधेयक पूर्वोक्त अध्यादेश को प्रतिस्थापित करने हेतु पुरःस्थापित किया जाता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Rajkoshiya Uttardayitwa Aur Budget Prabandh (Dwitiya Sanshodhan) Adhiniyam, 2020 (Uttar Pradesh Adhiniyam Sankhya 22 of 2020) as passed by the Uttar Pradesh Legislature and assented to by the Governor on August 28, 2020. The Vitta (Aay-Vyayak) Anubhag-1, is administratively concerned with the said adhiniyam.
THE UTTAR PRADESH FISCAL RESPONSIBILITY AND BUDGET
MANAGEMENT (SECOND AMENDMENT) ACT, 2020
(U.P. Act no. 22 OF 2020)
[As passed by the Uttar Pradesh Legislature]
AN
ACT
further to amend the Uttar Pradesh Fiscal Responsibility and Budget
Management Act, 2004.
IT IS HEREBY enacted in the Seventy First Year of the Republic of India as
follows :–
1. (1) This Act may be called the Uttar Pradesh Fiscal Responsibility and
Short title and commencement Budget Management (Second Amendment) Act, 2020.
(2) It shall be deemed to have come into force with effect from
June 19, 2020.
Amendment of section 4 of U.P. Act no. 5 of 2004 2. In section 4 of the Uttar Pradesh Fiscal Responsibility and Budget Management Act, 2004 in sub-section (3) for clause (c) the following clause shall be substituted, namely :–
''(c) maintain fiscal deficit at not more than five per cent of the
estimated Gross State Domestic Product in the fiscal year 2020-2021.''
Repeal and saving
U.P. Ordinance no. 13 of 2020 3. (1) The Uttar Pradesh Fiscal Responsibility and Budget Management (Second Amendment) Ordinance, 2020 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the provisions of the principal Act as amended by the Ordinance referred to in sub-section (1) shall be deemed to have been done or taken under the corresponding provisions of the principal Act as amended by this Act as if the provisions of this Act were in force at all material times.

STATEMENT OF OBJECTS AND REASONS
The Uttar Pradesh Fiscal Responsibility and Budget Management Act, 2004 has been enacted to provide for the responsibility of the State Government to ensure fiscal stability and sustainability and to enhance the scope for social and fiscal infrastructure and human development by achieving sufficient revenue surplus, reducing fiscal deficit and removing impediments to the effective conduct of fiscal policy and prudent debt management through limits on State Government's borrowings Government guarantees, debt and deficit, greater transparency in fiscal operations of the State Government and use of a medium term fiscal framework.
4 उार प्रदेश असाधारण गजट, 31 अगस्त, 2020The COVID-19 pandemic has adversely affected the resources of the States and the Centre. In view of the above, to raise additional resources, the Central Government has allowed an additional borrowing limit of 2 per cent of the Gross State Domestic Product to the State Governments for the financial year 2020-2021. For which State Governments were required to amend their Fiscal Responsibility and Budget Management Act. Therefore, it was decided to amend the aforesaid Act.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Fiscal Responsibility and Budget Management (Second Amendment) Ordinance, 2020 (U. P. ordinance no. 13 of 2020) was promulgated by the Governor on June 19, 2020.
This Bill is introduced to replace the aforesaid Ordinance.
