उत्तर प्रदेश स्ववित्तपोषित स्वतंत्र विद्यालय (शुल्क विनियमन) अधिनियम, 2018
का अग्रतर संशोधन करने के लिए
अधिनियम भारत गणराज्य के इकहत्तरवें वर्ष में निम्नलिखित अधिनियम बनाया जाता है :-
1-(1) यह अधिनियम उत्तर प्रदेश स्ववित्तपोषित स्वतंत्र विद्यालय (शुल्क संक्षिप्त नाम और प्रारम्भ
विनियमन) (संशोधन) अधिनियम, 2020 कहा जायेगा;
(2) यह दिनांक 9 अप्रैल, 2018 से प्रवृत्त हुआ समझा जायेगा। 2 उार प्रदेश असाधारण गजट, 31 अगस्त, 2020 2-उत्तर प्रदेश स्ववित्तपोषित स्वतंत्र विद्यालय (शुल्क विनियमन) अधिनियम, 2018, जिसे आगे मूल अधिनियम कहा गया है, की धारा 2 में,-
(क) खण्ड (च) के पश्चात् निम्नलिखित खण्ड बढ़ा दिया जायेगा, उत्तर प्रदेश अधिनियम संख्या 40 सन् 2018 की धारा 2 का संशोधन
अर्थात्ः-
(च च) ''स्ववित्तपोषित स्वतंत्र विद्यालयों के मण्डलीय अपीलीय प्राधिकरण'' का तात्पर्य धारा 9 के अधीन गठित मण्डलीय स्ववित्तपोषित स्वतंत्र विद्यालय के प्राधिकरण से है;
(ख) खण्ड (य) निकाल दिया जायेगा।
धारा 4 का संशोधन 3-मूल अधिनियम की धारा 4 में, निम्नलिखित उपधारा (3) बढ़ा दी जाएगी, अर्थात्ः-
(3) ''इस अधिनियम में अन्तर्विष्ट किसी बात के होते हुए भी, असाधारण स्थितियों या आपात जैसी परिस्थितियों, जो दैवीय कृत्यों, महामारियों, प्राकृतिक आपदाओं, युद्धों या क्रांतियों, जनान्दोलनों, बाढ़ों आदि तक सीमित न हों, में राज्य सरकार, आदेश द्वारा, प्रत्येक शैक्षणिक वर्ष हेतु विद्यमान छात्रों व नव प्रवेशित छात्रों से मान्यता प्राप्त विद्यालयों द्वारा ऐसे समय तक जब तक पूर्वोक्त संभाव्यताएं विद्यमान हों या ऐसे समय तक जैसा कि लोकहित में ऐसा करना समीचीन प्रतीत हो, प्रभारित किए जाने वाले शुल्क का विनियमन कर सकती है।
धारा 8 का संशोधन 4-मूल अधिनियम की धारा 8 में, उपधारा (11) के स्थान पर निम्नलिखित उपधारा रख दी जायेगी, अर्थात्ः-
(11) जहाँ मान्यता प्राप्त विद्यालय या कोई व्यक्ति, जिला शुल्क नियामक समिति के विनिश्चय से व्यथित हो,वहाँ वह ऐसे विनिश्चय के दिनांक से तीस दिन के भीतर यथा विहित रीति से अपील, धारा 9 में निर्दिष्ट मण्डलीय स्ववित्तपोषित स्वतंत्र विद्यालय अपीलीय प्राधिकरण को कर सकता है।
धारा 9 का संशोधन
5-मूल अधिनियम की धारा 9 में,-
(क) पाश्र्व शीर्षक के स्थान पर निम्नलिखित पाश्र्व शीर्षक रख दिया
जाएगा, अर्थात्ः-
''मण्डलीय स्ववित्तपोषित स्वतंत्र विद्यालय अपीलीय प्राधिकरण'';
(ख) उपधारा (1), (2) और (3) के स्थान पर निम्नलिखित उपधारायें
रख दी जायेंगी, अर्थातः-
(1) राज्य के समस्त मण्डलों में एक स्ववित्तपोषित स्वतंत्र विद्यालय प्राधिकरण होगा, जिसमें निम्नलिखित सम्मिलित होंगेः-
1-मण्डलीय सभापति-आयुक्त
2-अपर निदेशक, कोषागार-सदस्य
3-मण्डलीय संयुक्त शिक्षा निदेशक-सदस्य सचिव
उपरोक्त अपीलीय प्राधिकारी अपेक्षानुसार चार्टर्ड एकाउंटेंट की सहायता ले सकते हैं;
(2) उत्तर प्रदेश निजी व्यावसायिक शैक्षणिक संस्था (प्रवेश का विनियमन और शुल्क का नियतन) अधिनियम, 2006 की धारा 11 में उपबन्धित कोई अपीलीय प्राधिकरण, इस अधिनियम के प्रयोजनार्थ मण्डलीय स्ववित्तपोषित स्वतंत्र विद्यालय अपीलीय प्राधिकरण के रूप में तब तक कार्य करेगा, जब तक कि सरकार द्वारा गजट में अधिसूचना के माध्यम से राज्य के समस्त मण्डलों में मण्डलीय स्ववित्तपोषित स्वतंत्र विद्यालय अपीलीय प्राधिकरण का गठन न कर दिया जाय;
उार प्रदेश असाधारण गजट, 31 अगस्त, 2020 3(3) अपीलीय प्राधिकरण के पास अपील की सुनवाई के दौरान सिविल प्रक्रिया संहिता, 1908 (अधिनियम संख्या 5 सन् 1908) के अधीन उपबन्धित सिविल न्यायालय और अपील न्यायालय की शक्तियाँ होंगी। मण्डलीय स्ववित्तपोषित स्वतंत्र विद्यालय अपीलीय प्राधिकरण द्वारा पारित विनिश्चय अन्तिम होगा।
धारा 11 का संशोधन
6-मूल अधिनियम की धारा 11 में शब्द ''राज्य स्ववित्तपोषित स्वतंत्र विद्यालय अपीलीय प्राधिकरण'' के स्थान पर शब्द ''मण्डलीय स्ववित्तपोषित स्वतंत्र विद्यालय अपीलीय प्राधिकरण'' रख दिए जायेंगे। निरसन और व्यावृत्ति
7-(1) उत्तर प्रदेश स्ववित्तपोषित स्वतंत्र विद्यालय (शुल्क विनियमन) (संशोधन) अध्यादेश, 2020 एतद्द्वारा निरसित किया जाता है।

(2) ऐसे निरसन के होते हुए भी उपधारा (1) में निर्दिष्ट अध्यादेश द्वारा यथा संशोधित मूल अधिनियम के उपबन्धों के अधीन —त कोई कार्य या की गई कोई कार्यवाही, इस अधिनियम द्वारा यथा संशोधित मूल अधिनियम के सह प्रत्यर्थी उपबन्धों के अधीन —त या की गई समझी जायेगी मानो इस अधिनियम के उपबन्ध सभी सारवान समयों में प्रवृत्त थे।

उद्देश्य और कारण
उत्तर प्रदेश राज्य में स्ववित्तपोषित स्वतंत्र विद्यालयों में शुल्क विनियमन तथा उससे सम्बन्धित या अनुषंगिक मामलों का उपबन्ध करने के लिए उत्तर प्रदेश स्ववित्तपोषित स्वतंत्र विद्यालय (शुल्क विनियमन) अधिनियम, 2018 (उत्तर प्रदेश अधिनियम संख्या 40 सन् 2018) अधिनियमित किया गया है। उक्त अधिनियम में विद्यमान छात्रों के लिए वार्षिक शुल्क में वृद्धि करने और नये छात्रों के लिए वार्षिक शुल्क का अवधारण करने का उपबन्ध था। तथापि, आपात/विशेष परिस्थितियों में राज्य सरकार द्वारा लोकहित में शुल्क वृद्धि को विनियमित करने हेतु विद्यालयों को अनुदेश देने की कोई स्पष्ट व्यवस्था नहीं थी। पूर्वोक्त अधिनियम में मण्डलीय अपील प्राधिकरण के लिए भी उपबन्ध नहीं था। अतएव यह विनिश्चय किया कि ऊपर उल्लिखित प्रयोजनों को प्राप्त करने हेतु पूर्वोक्त अधिनियम में संशोधन किया जाय।
चूँकि राज्य विधान मण्डल सत्र में नहीं था और पूर्वोक्त विनिश्चय को क्रियान्वित करने के लिए तुरन्त विधायी कार्यवाही करनी आवश्यक थी, अतः राज्यपाल द्वारा दिनांक 17 जून, 2020 को उत्तर प्रदेश स्ववित्तपोषित स्वतंत्र विद्यालय (शुल्क विनियमन) (संशोधन) अध्यादेश, 2020 (उत्तर प्रदेश अध्यादेश संख्या 12 सन् 2020) प्रख्यापित किया गया।
यह विधेयक पूर्वोक्त अध्यादेश को प्रतिस्थापित करने के लिए पुरःस्थापित किया जाता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Swavittaposhit Swantantra Vidalaya (Shulk Vniyaman) (Sanshodhan) Adhiniyam, 2020 (Uttar Pradesh Adhiniyam Sankhya 21 of 2020) as passed by the Uttar Pradesh Legislature and assented to by the Governor on August 28, 2020. The Madhyamik Shiksha Anubhag-7, is administratively concerned with the said adhiniyam.
THE UTTAR PRADESH SELF -FINANCED INDEPENDENT SCHOOLS
(FEE REGULATION) (AMENDMENT) ACT, 2020
(U. P. Act no. 21 of 2020)

AN
ACT
further to amend the Uttar Pradesh Self-financed Independent Schools
(Fee Regulation) Act, 2018,
IT IS HEREBY enacted in the Seventy first Year of the Rupublic of India as
follows :–
Short title and
1. (1) This Act may be called the Uttar Pradesh Self-Financed Independent commencement Schools (Fee Regulation) (Amendment) Act, 2020;
(2) It shall be deemed to have come into force with effect from April 9, 2018.
Amendment of
2. In section 2 of the Uttar Pradesh Self-Financed Independents schools (Fee section 2 of
Regulation) Act, 2018 hereinafter referred to as the Principal Act,–
U.P. Act no. 40
of 2018
(a) after clause (f) the following clause shall be inserted, namely:-
(ff) "Divisional Appellate authority of Self-Financed Independent Schools" means Divisional Self-Financed Independent Schools Authority constituted under section-9;
(b) clause (z) shall be omitted.
Amendment of
3. In section 4 of the principal Act, the following sub-section (3) shall be section 4
inserted, namely: –
(3) "Notwithstanding anything contained in this Act, in extraordinary conditions or emergent circumstances like, but not limited to Acts of God, Epidemics, Natural Calamities, Wars or Revolutions, Civil commotions, Floods, etc; the State Government may by order, regulate the fees to be charged by the recongnized schools, from existing students and newly admitted students for each academic year till such time the aforesaid eventualities exist or till such time as seems expedient in public interest to do so."
Amendment of
4. In section 8 of the principal Act for sub-section (11) the following sub- section 8
section shall be substituted, namely: –
(11) Where the recognized school or any person is aggrieved by the decision of the District Fee Regulatory Committee, it may, within thirty days from the date of such decision, prefer an appeal, in such manner as may be prescribed to the Divisional Self- Financed Independent School Appellate Authority referred to in section 9.
उार प्रदेश असाधारण गजट, 31 अगस्त, 2020 55. In section-9 of the Principal Act, –
Amendment of section 9
(a) for the marginal heading, the following marginal heading shall be
substituted, namely: –
"Divisional Self-Financed Independent School Appellate Authority";
(b) for sub-sections (1), (2) and (3) the following sub-sections shall be
substituted, namely: –
(1) There will be a Self-Financed Independent School Authority in all the
divisions of the State, which will include: –
1. Divisional Chairman- Commissioner
2. Additional Director Treasury- Member
3. Divisional Joint Director of Education- Member Secretary
The above Appellate Authority may seek the Assistance of Chartered
Accountant as required.
(2) An Appellate Authority, provided in section 11 of the Uttar Pradesh Private
Professional Educational Institutes (Regulation of Admission and Fixation of Fee) Act,
2006 shall function as Self-Financed Independent School Appellate Authority for
the purpose of this Act unless a Divisional Self-Financed Independent School Appellate
Authority is constituted in all Divisions of the State by the Government by notification
in the Gazette;
(3) The Appellate Authority shall have powers of civil court as well as appellate
court provided under the Code of Civil Procedure, 1908 (Act no. 5 of 1908) while
hearing appeal. The Decision passed by the Divisional Self-Financed Independent
School Appellate Authority shall be final.
6. In section 11 of the principal Act, for the words "the State Self-Financed Amendment of section 11
Independent School Appellate Authority", the words"the Divisional Self-Financed
Independent School Appellate Authority" shall be substituted.
7. (1) The Uttar Pradesh Self-Financed Independent Schools
Repeal and saving
U.P. Ordinance no. 12 of 2020 (Fee Regulation) (Amendment) Ordinance, 2020 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action
taken under the provisions of the principal Act as amended by the
Ordinance referred to in sub-section (1) shall be deemed to have been
done or taken under the corresponding provisions of the principal Act as
amended by this Act as if the provisions of this Act were in force at all
material times.

STATEMENT OF OBJECTS AND REASONS
The Uttar Pradesh Self-Financed Independent Schools (Fee Regulation) Act, 2018 (U.P. Act no. 40 of 2018) has been enacted to provide for regulation of fees in self-financed independent schools in the State of Uttar Pradesh and the matters connected therewith or incidental thereto. In the said Act, there was a provision for increasing the annual fee for existing sudents and determination of the annual fee for new students. However, there was no clear arrangement to give instruction to the schools to regulate the increase in fee in the public interest 6 उार प्रदेश असाधारण गजट, 31 अगस्त, 2020 under the emergent/special circumstances by the State Government. The aforesaid Act also did not have the provision for Divisional Appellate Authority. Therefore it was decided to amend the aforesaid Act to achieve the above mentioned purposes.
Since the State Lagislature was not in session and immediate Legislature action was necessary to implement the aforesaid decision, the Uttar pardesh Self-Financed Independent Schools (Fee Regulation) (Amendment) Ordinance, 2020 (U.P. Ordinance no. 12 of 2020) was promulgated by the Governor on June 17, 2020.
This Bill is introduced to replace the aforesaid Ordinance.
