उत्तर प्रदेश लोक तथा निजी सम्पत्ति क्षति वसूली अध्यादेश , 2020 (उत्तर प्रदेश अध्यादेश संख्या 2 सन् 2020) की धारा 7 की उपधारा (1 ) और उत्तर प्रदेश लोक तथा निजी सम्पत्ति क्षति वसूली नियमावली, 2020 , जो उक्त अध्यादेश की धारा 26 के अधीन बनायी गयी है , की धारा 9 की उपधारा ( 1) के अधीन प्रदत्त शक्तियों का प्रयोग करके राज्यपाल उक्त अध्यादेश एवं नियमावली के अधीन प्राप्त दावा याचिकाओं के निस्तारण हेतु उत्तर प्रदेश राज्य में लखनऊ एवं मेरठ मण्डलों में दावा अधिकरणों का गठन करती है ।

2- उक्त दावा अधिकरणों में, पूर्वोक्त नियमावली के नियम 9 के उपनियम (2) के उपबन्धों के अनुसार दावा अधिकरण में दो सदस्य होंगे , जिसमें एक सेवानिवृत्त जिला न्यायधीश सम्मिलित होगा , जो उक्त अधिकरण में अध्यक्ष नियुक्त किया जायेगा और एक अपर मण्डलायुक्त उसका सदस्य होगा । दावा अधिकरण के अध्यक्ष की नियुक्ति, पूर्वोक्त नियमावली के नियम 9 (5) से नियम 9 (12) के उपबन्धों के अनुसार की जायेगी ।

3-झॉसी, कानपुर, चित्रकूट, लखनऊ , अयोध्या, देवीपाटन, प्रयागराज, आजमगढ़, वाराणसी , गोरखपुर, बस्ती एवं विंध्याचल धाम मण्डलों की दावा याचिकाये लखनऊ क्षेत्र के दावा अधिकरण की अधिकारिता के अधीन होगी और सहारनपुर , मेरठ , अलीगढ़ , मुरादाबाद, बरेली, आगरा मण्डलों की दावा याचिकायें , मेरठ क्षेत्र के दावा अधिकरण की अधिकारिता के अधीन होगी ।

IN pursuance of the provisions of clause (3 ) of Article 348 of the Constitution , the Governor is pleased to order the publication of the following English translation of notification no . 1728 /VI - P - 9-20- 31 ( 75 ) -2009TC- ( B) dated September 11 , 2020 :

IN exercise of the powers conferred under the sub- sections ( 1 ) of Section 7 of the Uttar Pradesh Recovery of Damages to Public and Private Property Ordinance , 2020 ( Uttar Pradesh Ordinance No. 2 of 2020) and sub section 1 of section 9 of the Uttar Pradesh Recovery of Damages to Public and Private Property Rules , 2020 ( made under Section 26 of the said Ordinance) , the Governor is Pleased to constitute the Claims Tribunals at Lucknow and Meerut Divisions in the State of Uttar Pradesh , for the disposal of the claim petitions received under the said Ordinance and the rules .

2. In the said Claims Tribunal , according to the provisions of sub - section ( 2) of section 9 the aforesaid rules , 2020 the Claims Tribunal shall consist of two members , including a retired District Judge who will be appointed as the Chairman of the said Tribunal and an Additional Divisional Commissnor as a member thereof, The Chairman of the Claims Tribunal shall be appointed as per the provisions of rule 9 ( 5) to rule 9 ( 12) of the aforesaid rules .

3. The Claim petitions of Jhansi , Kanpur , Chitrakoot, Lucknow , Ayodhya , Devipatan , Prayagraj , Azamgarh , Varanasi , Gorakhpur , Basti and Vindhyachal Dham divisions will be under the Jurisdiction of the Claims Tribunal of Lucknow Circle and the Claim petitions of Saharanpur, Meerut , Aligarh , Moradabad, Bareilly and Agra divisions will be under the Jurisdiction of the Claims Tribunal of the Meerut Circle.
