अधिसूचना

चूँकि सेवायें या प्रसुविधायें या सहायिकी प्रदान करने के पहचान दस्तावेज के रूप में आधार के उपयोग से सरकारी परिदान प्रक्रियाएँ सुगम हो जाती हैं, पारदर्शिता और दक्षता आ जाती है और लाभार्थी अपना पहचान साबित करने के लिए बहुविध दस्तावेज प्रस्तुत करने की आवश्यकता से मुक्त होते हुये सुविधाजनक और निर्बाध रीति से सीधे अपना हक प्राप्त करने के योग्य हो जाते हैं;

और, चूँकि, राजस्व विभाग (जिसे आगे उक्त विभाग कहा गया है) राज्य आपदा मोचक निधि (एस0डी0आर0एफ0) (जिसे आगे उक्त योजना कहा गया है) को प्रशासित कर रहा है, जो आपदा प्रबन्धन अधिनियम, 2005 की धारा 48 (1) (क) के अधीन गठित की गयी है, जो राज्य सरकार के पास अधिसूचित आपदाओं के मोचन के लिए उपलब्ध प्राथमिक निधि है। केन्द्र सरकार, सामान्य श्रेणी के राज्य/संघ राज्य क्षेत्रों के लिए एस0डी0आर0एफ0 आवंटन में 75% का अंशदान करती है और उक्त निधि का उपयोग केवल आपदा पीड़ितों को तत्काल राहत प्रदान करने के व्यय की पूर्ति के लिए किया जाता है। यह योजना राहत आयुक्त कार्यालय, उत्तर प्रदेश सरकार (जिसे आगे क्रियान्वयनकर्ता अभिकरण कहा गया है) के माध्यम से क्रियान्वित की जा रही है;

और, चूँकि, उक्त योजना के अधीन क्रियान्वयनकर्ता अभिकरण द्वारा विद्यमान योजना के मार्गदर्शी सिद्धान्तों के अनुसार आपदा प्रभावित पीड़ितों (जिन्हें आगे लाभार्थी कहा गया है) को आनुग्रहिक राहत सहायता (जिसे आगे प्रसुविधा कहा गया है) प्रदान की जाती है;

और, चूँकि, पूर्वोक्त योजना में उत्तर प्रदेश संचित निधि से उपगत आवर्ती व्यय अन्तर्विष्ट है;

अतएव, अब, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (अधिनियम संख्या 18 सन्‌ 2016) (जिसे आगे उक्त अधिनियम कहा गया है) की धारा 7 के अनुसरण में, उत्तर प्रदेश सरकार एतद्‌द्वारा निम्नानुसार अधिसूचित करती है, अर्थात्‌ :-

1-(1) उक्त योजना के अधीन प्रसुविधायें प्राप्त करने के लिए पात्र व्यक्ति से एतद्‌द्वारा आधार संख्या धारित करने का प्रमाण प्रस्तुत करने या आधार अधिप्रमाणित कराने की अपेक्षा की जायेगी।

(2) उक्त योजना के अधीन प्रसुविधाओं का उपभोग करने का इच्छुक कोई व्यक्ति जो आधार संख्या धारित न करता हो या जिसने अभी तक आधार के लिए नामांकन न किया हो, से उक्त योजना को रजिस्ट्री—त करने से पूर्व आधार नामांकन के लिए आवेदन करने की अपेक्षा की जायेगी, परन्तु यह कि वह उक्त अधिनियम की धारा 3 के अनुसार आधार प्राप्त करने का हकदार हो और ऐसे व्यक्ति को आधार हेतु नामांकित किये जाने के लिए किसी आधार नामांकन केन्द्र [भारतीय विशिष्ट पहचान प्राधिकरण (यू0आई0डी0ए0आई0) की वेबसाइट www.uidai.gov.in पर उपलब्ध सूची] पर जाना होगा।

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग से अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से ऐसे लाभाथियों, जो अभी तक आधार के लिए नामांकित न हों, के लिए आधार नामांकन सुविधायें प्रदान किए जाने की अपेक्षा की जायेगी, और यदि सम्बन्धित ब्लॉक या तालुका या तहसील में कोई आधार नामांकन केन्द्र अवस्थित न हो तो विभाग अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से भारतीय विशिष्ट पहचान प्राधिकरण (यूआईडीएआई) के विद्यमान रजिस्ट्रारों के साथ समन्वय करके या स्वयं भारतीय विशिष्ट पहचान प्राधिकरण का रजिस्ट्रार होकर सुविधाजनक अवस्थानों पर आधार नामांकन सुविधायें प्रदान करेगा :

परन्तु यह कि किसी व्यक्ति को आधार समनुदेशित किये जाने के समय तक उक्त योजना के अधीन प्रसुविधायें, ऐसे व्यक्ति को निम्नलिखित दस्तावेज प्रस्तुत किये जाने के अध्यधीन प्रदान की जायेंगी, अर्थात्‌ :-

(क) यदि उसने नामांकन किया है तो उसकी आधार नामांकन पहचान पर्ची; और

(ख) निम्नलिखित दस्तावेजों में से कोई एक दस्तावेज, अर्थात्‌ :-

(एक) फोटोयुक्त बैंक या पोस्ट आफिस पासबुक; या

(दो) स्थायी खाता संख्या (पैन) कार्ड; या

(तीन) पासपोर्ट; या

(चार) राशन कार्ड; या

(पाँच) मतदाता पहचान-पत्र; या

(छः) मनरेगा कार्ड; या

(सात) किसान फोटो पासबुक; या

(आठ) मोटरयान अधिनियम, 1988 (अधिनियम संख्या 59 सन्‌ 1988) के अधीन लाइसेन्स प्राधिकारी द्वारा जारी किया गया ड्राइविंग लाइसेन्स; या

(नौ) राजपत्रित अधिकारी या तहसीलदार द्वारा अपने शासकीय पत्र शीर्षक पर जारी किए गए ऐसे व्यक्ति की फोटोयुक्त पहचान प्रमाण-पत्र; या

(दस) विभाग द्वारा यथा विनिर्दिष्ट कोई अन्य दस्तावेज :

परन्तु यह और कि, उपरोक्त दस्तावेजों की जाँच, विभाग द्वारा उक्त प्रयोजनार्थ विनिर्दिष्ट रूप से अभिहित किसी अधिकारी द्वारा की जा सकती है।275 RPH (Rajaswa Anubhag-11) 2020 data 4e उत्तर प्रदेश असाधारण गजट, 18 सितम्बर, 2020 3 2-उक्त योजना के अधीन लाभार्थियों को सुविधाजनक रूप से प्रसुविधायें प्रदान करने के उद्‌देश्य से विभाग को अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करनी होंगी कि मीडिया के माध्यम से लाभार्थियों को लिए व्यापक प्रचार-प्रसार, उन्हें उक्त आवश्यकता से अवगत कराने के लिए किया जायेगा।

3-समस्त मामलों में, जहाँ लाभार्थियों के खराब बायोमेट्रिक्स के कारण या किसी अन्य कारण से आधार अधिप्रमाणन विफल हो जाता है, वहाँ निम्नलिखित उपचारात्मक तन्त्र अपनाये जायेंगे, अर्थात्‌ :-

(क) खराब फिंगरप्रिंट गुणवत्ता के मामले में, अधिप्रमाणन के लिए आइरिस स्कैन या फेस अधिप्रमाणन सुविधा, अपनाई जाएगी, जिससे विभाग अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से सहज रीति से प्रसुविधायें प्रदान करने के लिए फिंगर प्रिंट अधिप्रमाणन के साथ ही साथ आइरिस स्कैनर या फेस अधिप्रमाणन के लिए उपबन्ध करेगा;

(ख) यदि फिंगरप्रिंट या आइरिस स्कैन या फेस अधिप्रमाणन के माध्यम से बायोमेट्रिक अधिप्रमाणन सफल नहीं होता है तो जहाँ कहीं सम्भाव्य और अनुज्ञेय हो, सीमित समय की वैधता के साथ यथास्थिति आधार वन टाइम पासवर्ड या समय-आधारित वन-टाइम पासवर्ड द्वारा अधिप्रमाणन, प्रदान किया जा सकता है;

(ग) अन्य समस्त मामलों में जहाँ बायोमेट्रिक या आधार वन टाइम पासवर्ड या समय-आधारित वन-टाइम पासवर्ड अधिप्रमाणन सम्भव न हो, वहाँ उक्त योजना के अधीन प्रसुविधायें, ऐसे भौतिक आधार-पत्र के आधार पर दी जा सकती हैं जिसकी अधिप्रामाणिकता, आधार पत्र पर मुद्रित क्विक रिस्पान्स कोड (क्यू0 आर0 कोड) के माध्यम से सत्यापित की जा सकती है और क्विक रिस्पान्स कोड रीडर की आवश्यक व्यवस्था, विभाग द्वारा अपने क्रियान्वयनकर्ता अभिकरण के माध्यम से सुविधाजनक अवस्थानों पर प्रदान की जायेगी।

4-उपरोक्त के अतिरिक्त, यह सुनिश्चित करने के उद्‌देश्य से कि उक्त योजना के अधीन कोई वास्तविक लाभार्थी अपनी देय प्रसुविधाओं से वंचित न हो, विभाग अपने क्रियान्वयनकर्ता अभिकरण के माध्यक से डी0बी0टी0 मिशन कार्यालय ज्ञाप, कैबिनेट सचिवालय, भारत सरकार दिनांक 19 दिसम्बर, 2017 में यथा रेखांकित अपवाद हैण्डलिंग तन्त्र का अनुसरण करेगा।

5-यह अधिसूचना सरकारी गजट में प्रकाशित किये जाने के दिनांक से प्रभावी होगी।

------ IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 760/ One-11-2020, dated September 18, 2020 :

No. 760/ One-11-2020

Dated Lucknow, September 18, 2020

WHEREAS the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

available with State Government for responses to notified disasters. The Central Government contributes 75% of SDRF allocation for general category States/UTs and fund is used only for meeting the expenditure for providing immediate relief to the disaster victims. This Scheme is being implemented through the Office of Relief Commissioner, Government of Uttar Pradesh [hereinafter referred to as the Implementing Agency (ies)];

AND, WHEREAS, under the Scheme, Gratuitous Relief Assistance (hereinafter referred to as the benefit) is given to the disaster affected victims (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extant Scheme guidelines;

AND, WHEREAS, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Uttar Pradesh;

NOW, THEREFORE, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Government of Uttar Pradesh hereby notifies the following, namely :–

1. (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitled to obtain Aadhaar as per section 3 of the said Act, and such individuals shall visit any Aadhaar enrolment centre [list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in] to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Dopartment through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves :

Provided that till the time Aadhaar is assigned to the individual, benefit under the Scheme shall be given to such individual subject to the production of the following documents, namely :–

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and

(b) any one of the following documents, namely :–

(i) Bank or Post Office Passbook with Photo; or

(ii) Permanent Account Number (PAN) Card; or

(iii) Passport; or

(iv) Ration Card; or

(v) Voter Identity Card; or

(vi) MGNREGA Card; or

(vii) Kisan Photo Passbook; or275 RPH (Rajaswa Anubhag-11) 2020 data 4e उत्तर प्रदेश असाधारण गजट, 18 सितम्बर, 2020 5 (viii) Driving License issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or

(x) Any other document as specified by the Department :

Provided further that the above documents may be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through the media shall be given to the beneficiaries to make them aware of the said requirement.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely :–

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department, through its Implementing Agency shall make provisions for iris scanners or face authentication alongwith fingerprint authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One-Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. In addition to the above, in order to ensure that no bona fide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing Agency shall follow the exception handling machanism as outlined in the Office Memorandum of DBT Mission, Cabinet Secretariat, Government of India dated 19th December, 2017.

5. This notification shall come into effect from the date of its publication in the official Gazette.
