अधिसूचना
भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्त विनियमन) (उत्तर प्रदेश संशोधन) विधेयक, 2020 जो उत्तर प्रदेश विधान सभा के दिनांक 22 अगस्त, 2020 के उपवेशन में पुरःस्थापित किया गया, उत्तर प्रदेश विधान सभा की प्रक्रिया तथा कार्य-संचालन नियमावली, 1958 के नियम 126 के अन्तर्गत एतद्द्वारा प्रकाशित किया जाता है।
भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्त विनियमन) (उत्तर प्रदेश संशोधन), विधेयक, 2020 भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्त विनियमन) अधिनियम, 1996 का उत्तर प्रदेश में अपनी प्रवृत्ति के संबंध में संशोधन करने के लिए
विधेयक
भारत गणराज्य के इकहत्तरवें वर्ष में निम्नलिखित अधिनियम बनाया जाता है :-
संक्षिप्त नाम
1-यह अधिनियम भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्त
विनियमन) (उत्तर प्रदेश संशोधन) अधिनियम, 2020 कहा जायेगा।
अधिनियम संख्या 27 सन् 1996 की धारा 22 का संशोधन
(2) भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्त विनियमन) 1996, जिसे आगे मूल अधिनियम कहा गया है, की धारा-22 में खण्ड (ग) में, शब्द ''ऋण और अग्रिम'' के स्थान पर शब्द
रख दिये जायेंगे।2 उत्तर प्रदेश असाधारण गजट, 21 सितम्बर, 2020 - धारा 49क का बढ़ाया जाना ''49-क (1) इस अधिनियम के अधीन किये गये किसी ऐसे अपराध का शमन, जो अधिकतम छः मास के कारावास से या जुर्माना सहित अधिकतम छः मास के कारावास से दण्डनीय हो, किसी अभियोजन के संस्थित किये जाने से पूर्व या पश्चात् अभियुक्त व्यक्ति के आवेदन पर ऐसे अधिकारी द्वारा, जिसे राज्य सरकार अधिसूचना द्वारा विनिर्दिष्ट करे, यथा विहित रीति से ऐसे अपराध के लिये उपबन्धित अधिकतम जुर्माने अथवा उसके किसी भाग, जो राज्य सरकार विहित करे, के साथ किया जायेगा।
परन्तु इस धारा के उपबन्ध, केवल प्रथम अपराध के लिये उपलबध होंगे।
(2) किसी अपराध का शमन किये जाने के लिये प्रत्येक आवेदन यथा विहित प्रपत्र में और रीति से किया जायेगा।
(3) उपधारा (1) में निर्दिष्ट कोई अधिकारी, किसी अपराध का शमन किये जाने की शक्ति का प्रयोग, राज्य सरकार के निदेश, नियंत्रण और पर्यवेक्षण के अध्यधीन करेगा।
(4) जहाँ किसी अपराध का शमन, किसी अभियोजन के संस्थित किये जाने के पूर्व किया जाता है वहाँ ऐसे अपराधी के विरूद्ध जिसके संबंध में अपराध का इस प्रकार शमन किया गया हो, ऐसे अपराध के संबंध में कोई अभियोजन संस्थित नहीं किया जायेगा।
(5) जहाँ किसी अपराध का शमन, किसी अभियोजन के संस्थित किये जाने के पश्चात् किया जाता है, वहाँ ऐसा शमन, उपधारा (1) में निर्दिष्ट अधिकारी द्वारा उस न्यायालय के संज्ञान में लिखित रूप में लाया जायेगा, जिसमें ऐसा अभियोजन लम्बित हो और इस प्रकार अपराध शमन को संज्ञान में लाये जाने पर वह व्यक्ति, जिसके विरूद्ध, इस प्रकार अपराध का शमन किया गया हो, उन्मोचित कर दिया जायेगा।''
3-मूल अधिनियम की धारा 62 की उपधारा 2 मेंः-
धारा 62 का संशोधन (क) खण्ड (ढ) में शब्द रख दिये जायेंगे।
(ख) खण्ड (यच) के पश्चात् निम्नलिखित खण्ड बढ़ा दिया जायेगा, अर्थात् ''(यचक) ऐसे मामलेें, जो धारा 49क में विहित किये जाने अपेक्षित हैं।''

उद्देश्य और कारण
भवन और अन्य सन्निर्माण कर्मकारों का नियोजन तथा उनकी सेवा-शर्तो का विनियमन करने और उनकी सुरक्षा, स्वास्थ्य तथा कल्याणकारी उपायों तथा उससे सम्बन्धित या आनुषंगिक अन्य मामलों का उपबन्ध करने के लिये भवन और अन्य सन्निर्माण कर्मकार का (नियोजन तथा सेवा-शर्त विनियमन) अधिनियम, 1996 अधिनियमित किया गया है। उक्त अधिनियम में अन्य बातों के अन्तर्गत दस या अधिक सन्निर्माण कर्मकार नियोजित करने वाले अधिष्ठानों के अनिवार्य रजिस्ट्रीकरण तथा भवन और ऐसे अन्य सन्निर्माण कर्मकार कल्याण बोर्ड जिसे भवन और अन्य सन्निर्माण कर्मकारों के उसके लाभार्थी के रूप में रजिस्ट्रीकरण का कार्य सौंपा गया हो, के गठन की व्यवस्था है। बोर्ड लाभार्थियों को भवन निर्माण हेतु ऋण और अग्रिम स्वीकृत कर सकता है। यह अनुभव किया गया है कि सन्निर्माण कर्मकार अपने भवन निर्माण हेतु ऋण और अग्रिम लेने के इच्छुक नहीं है। अतएव यह विनिश्चय किया गया है कि न्यायालयों में लंबित वादों की संख्या में कमी करने और अनावश्यक मुकदमें बाजी से बचने के उद्देश्य से भवन और अन्य सन्निर्माण कर्मकारों को वित्तीय सहायता प्रदान करने और अपराधों में शमन करने की व्यवस्था करने के लिये उपर्युक्त अधिनियम का उत्तर प्रदेश में उसकी प्रवृत्ति के संबंध में संशोधन किया जाय।
पूर्वोक्त विनिश्चिय को लागू करने के उद्देश्य से भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्त विनियमन) (उत्तर प्रदेश संशोधन) विधेेयक, 2017 को उत्तर प्रदेश राज्य विधान मण्डल में पुरःस्थापित किया गया तथा उसके द्वारा पारित किया गया था। उक्त विधेयक को राष्ट्रपति के विचार के लिये राज्यपाल द्वारा आरक्षित किया गया था और भारत सरकार को उस पर राष्ट्रपति की सहमति प्राप्त करने के लिये भेजा गया था। भारत सरकार ने उक्त विधेयक मे कतिपय संशोधन सुझाए थे। भारत सरकार के सुझाव पर विचार करने के पश्चात् यह विनिश्चय किया गया है कि उक्त विधेयक, 2017 को वापस ले लिया जाए और उसके स्थान पर भारत सरकार द्वारा दिये गये सुझाव के अनुसार उत्तर प्रदेश में उसकी प्रवृत्ति के सम्बन्ध में पूर्वोक्त अधिनियम की धारा 22 की उपधारा (1) के खण्ड (ग) में सशोधन करने और उसमें धारा 49-क को बढ़ाये जाने के लिए एक विधेयक राज्य विधान मण्डल में प्रस्तुत किया जायेगा।
तद्नुसार भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्त विनियमन) (उत्तर प्रदेश संशोधन) विधेयक, 2020 पुरःस्थापित किया जाता है ।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the "Bhavan Aur Anya Sannirmaan Karmkaar (Niyojan Tatha Seva-shart Viniyaman) (Uttar Pradesh Sanshodhan) Vidheyak, 2020'' introduced in the Uttar Pradesh Legislative Assembly on August 22, 2020.

AMENDMENT) BILL, 2020
A
BILL
to amend the Building and Other Construction Workers (Regulation of
Employment and conditions of Service) Act, 1996 in its application to Uttar Pradesh.
IT IS HERERBY enacted in the Seventy-first Year of the Republic of India as
follows:–
Short title
1. This Act may be called the Building and Other Construction Workers
(Regulation of Employment and conditions of Service) (Uttar Pradesh Amendment)
Act, 2020 4 उत्तर प्रदेश असाधारण गजट, 21 सितम्बर, 2020 2. In sub-section (1) of section 22 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, hereinafter Amendment of section 22 of Act no. 27 of 1996 referred to as the principal Act, in clause (c) for the words "loans and advances" the words "loans, advances and financial assistance" shall be substituted.
3- After section 49 of the principal Act, the following section shall be inserted, Insertion of section 49A
namely:-
49-A(1) Any offence committed under this Act, punishable with maximum imprisonment of six months or with maximum imprisonment of six months with fine may, on an application of the accused person, either before or after institution of prosecution, be compounded by an officer as the State Government may by notification specify, for maximum fine provided for such offence, or a part thereof in such manner as may be prescribed:
Provided that the provisions of this section shall be available to the first offence only.
(2) Every application for the compounding of an offence shall be made in such form and such manner as may be prescribed.
(3) An officer referred to in sub-section (1) shall exercise the power to compound an offence subject to the direction, control and supervision of the State Government.
(4) Where any offence is compounded before the institution of any prosecution, no prosecution shall be instituted in relation to such offence, against the offender in relation to whome the offence is so compounded.
(5) Where the Composition of any offence is made after the institution of any prosecution, such composition shall be brought by the officer referred to in sub-section (1) in writing to the notice of the court in which prosecution is pending and on such notice of the composition of the offence being given, the person against whom the offence is so compounded shall be discharged.
4- In sub-section (2) of section 62 of the Principal Act-
Amendment of section 62
(a) in clause (n) for the words "loans or advances", the words "loans, advances or financial assistance" shall be substituted.
(b) after clause (zf), the following clause shall be inserted , namely:-
"(zfa) the matters which are required to be prescribed in section 49-A"

STATEMENT OF OBJECTS AND REASONS
The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 has been enacted to regulate the employment and conditions of service of building and other construction workers and to provide for their safety, health and welfare measures and for other matters connected therewith or incidental thereto. The Act amongst other things provides for compulsory registration of establishments employing ten or more construction workers and constitution of Building and Other Construction Workers Welfare Board which is entrusted with registration of building and other construction workers as beneficiary thereof. The Board may sanction loans and advances to beneficiaries.
for construction of their houses. It has been experienced that construction workers are not willing to take loans or advances for construction of their houses. It has therefore, been decided to amend the aforesaid Act in its application of Uttar Pradesh to provide for giving "financial assistance" to building and other construction workers and compounding of offences in order to reduce the number of the cases pending in courts and to avoid unnecessary litigation.
उत्तर प्रदेश असाधारण गजट, 21 सितम्बर, 2020 5 In order to implement the aforesaid decision the Building and Other Construction Workers (Regulation of Employment and Condition of Service) (Uttar Pradesh ) Bill, 2017 was introduced in, and passed by, the Uttar Pradesh State Legislature. The said Bill was reserved by the Governor for theconsideration of the President and sent to the Government of India for obtaining the assent of the President thereon. The Government of India has suggested certain amendments in the said Bill. After considering the suggestion of the Government of India it has been decided that the said Bill of 2017 should be withdrawn and in place thereof a Bill to amend clause (c) of sub-section (1) of section 22 and to insert section 49A of the aforesaid Act in its application of Uttar Pradesh as suggested by the Government of India, shall be introduced in the State Legislature .
The Building and Other Construction Workers (Regulation of Employment and Condition of Services) (Uttar Pradesh Amendment) Bill, 2020 is introduced accordingly.
