उत्तर प्रदेश राज्य विधान मण्डल (सदस्यों की उपलब्धियाँ और पेंशन) (संशोधन) विधेयक, 2020 जो उत्तर प्रदेश विधान सभा के दिनांक 22 अगस्त, 2020 के उपवेशन में पुरःस्थापित किया गया, उत्तर प्रदेश विधान सभा की प्रक्रिया तथा कार्य-संचालन नियमावली, 1958 के नियम 126 के अन्तर्गत एतद्द्वारा प्रकाशित किया जाता है।

उत्तर प्रदेश राज्य विधान मण्डल (सदस्यों की उपलब्धियाँ और पेंशन) अधिनियम, 1980
का अग्रतर संशोधन करने के लिए
विधेयक
भारत गणराज्य के इकहत्तरवें वर्ष में निम्नलिखित अधिनियम बनाया जाता है :-
1-(1) यह अधिनियम उत्तर प्रदेश राज्य विधान मण्डल (सदस्यों की उपलब्धियाँ और संक्षिप्त नाम और प्रारम्भ
पेंशन) (संशोधन) अधिनियम, 2020, कहा जायेगा।
(2) यह दिनांक 1 अप्रैल, 2020 से प्रवृत्त हुआ समझा जायेगा।2 उत्तर प्रदेश असाधारण गजट, 21 सितम्बर, 2020 2-उत्तर प्रदेश राज्य विधान मण्डल (सदस्यों की उपलब्धियाँ और पेंशन) अधिनियम, 1980, जिसे आगे मूल अधिनियम कहा गया है, की धारा 3 में, उपधारा (1) में निम्नलिखित परन्तुक बढ़ा दिया जायेगा, अर्थात् :-
उत्तर प्रदेश अधिनियम संख्या 23 सन् 1980 की धारा 3 का संशोधन
''परन्तु यह कि पूर्वोक्त सदस्य, माह अप्रैल, 2020 से मार्च, 2021 तक उपर्युक्त वेतन का मात्र सत्तर प्रतिशत के लिए हकदार होगा।''
धारा 4 का संशोधन 3-मूल अधिनियम की धारा 4 में, निम्नलिखित परन्तुक बढ़ा दिया जायेगा, अर्थात् :- ''परन्तु यह कि पूर्वोक्त सदस्य, माह अप्रैल, 2020 से मार्च, 2021 तक उपर्युक्त निर्वाचन क्षेत्र भत्ता का मात्र सत्तर प्रतिशत के लिए हकदार होगा।''
4-मूल अधिनियम की धारा 15-क में, निम्नलिखित परन्तुक बढ़ा दिया जायेगा, धारा 15-क का संशोधन
अर्थात् :-
''परन्तु यह कि पूर्वोक्त सदस्य, माह अप्रैल, 2020 से मार्च, 2021 तक उपर्युक्त सचिवीय भत्ता का मात्र सत्तर प्रतिशत के लिए हकदार होगा।''
5-(1) उत्तर प्रदेश राज्य विधान मण्डल (सदस्यों की उपलब्धियाँ
निरसन और व्यावृत्ति
और पेंशन) (संशोधन) अध्यादेश, 2020, एतद्द्वारा निरसित किया जाता है।

(2) ऐसे निरसन के होते हुए भी उपधारा (1) में निर्दिष्ट अध्यादेश द्वारा यथा संशोधित मूल अधिनियम के उपबन्धों के अधीन —त कोई कार्य या की गई कोई कार्यवाही, इस अधिनियम द्वारा यथा संशोधित मूल अधिनियम के सह प्रत्यर्थी उपबन्धों के अधीन —त या की गई समझी जायेगी मानों इस अधिनियम के उपबन्ध सभी सारवान समयों में प्रवृत्त थे।

उद्देश्य और कारण
भारत और उत्तर प्रदेश राज्य कोविड-19 वैश्विक महामारी का सामना कर रहे हैं जिसका लोक स्वास्थ्य तथा आर्थिक प्रशाखाओं पर गम्भीर प्रभाव पड़ा है। इस महामारी ने जनसामान्य को तीव्र राहत तथा सहायता प्रदान करने के महत्व को परिलक्षित किया है। इसके प्रसार को नियंत्रित करने हेतु कतिपय आपात उपाय किये जाने आवश्यक हैं।
इस महामारी के प्रसार को नियंत्रित करने के उद्देश्य से उत्तर प्रदेश सरकार ने चिकित्सा सुविधाओं तथा उपकरणों की पर्याप्त उपलब्धता सुनिश्चित करने और यह भी सुनिश्चित करने कि समाज के आर्थिक रूप से कमजोर वर्गों के व्यक्तियों को पर्याप्त मौद्रिक सुविधायें तथा दैनिक उपयोग की आवश्यक वस्तुएं उपलब्ध करायी जायें, के लिये विभिन्न महत्वपूर्ण विनिश्चय किये हैं ताकि उन्हें सामान्य जीवन यापन करने में कठिनाई का सामना न करना पड़े। अतएव राज्य विधान मण्डल के सदस्यों के वेतन तथा कतिपय भत्तों में कटौती करके अतिरिक्त वित्तीय संसाधनों में वृद्धि किया जाना आवश्यक हो गया था।
चूँकि राज्य विधान मण्डल सत्र में नहीं था और पूर्वोक्त विनिश्चय को लागू करने के लिए तुरन्त विधायी कार्यवाही की जानी आवश्यक थी, अतः राज्यपाल द्वारा दिनांक 11 अप्रैल, 2020 को उत्तर प्रदेश राज्य विधान मण्डल (सदस्यों की उपलब्धियाँ और पेंशन) (संशोधन) अध्यादेश, 2020 (उत्तर प्रदेश अध्यादेश संख्या 5 सन् 2020) प्रख्यापित किया गया।
यह विधेयक पूर्वोक्त अध्यादेश को प्रतिस्थापित करने के लिए पुरःस्थापित किया जाता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the " Uttar Pradesh Rajya Vidhan Mandal (Sadasyon ki Uplabdhiyan Aur Pension) (Sanshodhan) Vidheyak, 2020'' introduced in the Uttar Pradesh Legislative Assembly on August 22, 2020.
THE UTTAR PRADESH STATE LEGISLATURE (MEMBERS' EMOLUMENTS AND PENSION) (AMENDMENT) BILL, 2020 A BILL
further to amend the Uttar Pradesh State legislature (Members' Emoluments and
Pension) Act, 1980. IT IS HEREBY enacted in the Seventy-first Year of the Republic of India as follows:-
Short title and 1. (1) This Act may be called the Uttar Pradesh State Legislature (Members'
commencement Emoluments and Pension) (Amendment) Act, 2020.
(2) It shall be deemed to have come into force with effect from 1st April, 2020.
Amendment of 2. In section 3 of the Uttar Pradesh State Legislature (Members' Emoluments
section 3 of and Pension) Act, 1980 hereinafter referred to as the principal Act, in sub-section (1)
U.P. Act no. 23 following proviso shall be inserted, namely :–
of 1980
"Provided that the aforesaid member shall be entitled to only seventy per cent
of the above mentioned salary from the month of April, 2020 to March, 2021."
3. In section 4 of the principal Act, the following proviso shall be inserted, Amendment of
section 4
namely :–
"Provided that the aforesaid member shall be intitled to only seventy per cent of
the above mentioned constituency allowance from the month of April, 2020 to
March, 2021."
4. In section 15-A of the principal Act, the following proviso shall be inserted, Amendment of
section 15-A namely :–
"Provided that the aforesaid member shall be entitled to only seventy per cent of
the above mentioned secretarial allowance from the month of April, 2020 to
March, 2021."

Repeal and saving 5. (1) The Uttar Pradesh State Legislature (Members'
Ordinance Emoluments and Pension) (Amendment) Ordinance, 2020 is hereby
no. 5 of 2020 repealed.
(2) Notwithstanding such repeal, anything done or any action
taken under the provisions of the principal Act as amended by the
Ordinance referred to in sub-section (1) shall be deemed to have been
done or taken under the corresponding provisions of the principal Act
as amended by this Act as if the provisions of this Act were in force at
all material times.
4 उत्तर प्रदेश असाधारण गजट, 21 सितम्बर, 2020STATEMENT OF OBJECTS AND REASONS
India and the State of Uttar Pradesh are grappling with global pandemic of COVID-19 which has severe health and economic ramifications for the people. This pandemic has shown the importance of expeditious relief and assistance to the public. It is necessary to take certain emergency measures to contain its spread.
In order to contain the spread of this pandemic, the Government of Uttar Pradesh has taken various inportant decisions to ensure adequate availability of medical facilities and equipments and to also ensure that persons belonging to economically weaker sections of society are provide with adequate monetary facilities and essential goods of daily use so that they do not face defficulty in leading a normal life. Therefore, it had become necessary to raise additional financial resources by reduction of salaries and certain allowances of members of State Legislature.
Since the State Legislature was not in session and immediate Legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh State Legislature (Members' Emoluments and Pension) (Amendment) Ordinance, 2020 (U.P. Ordinance no. 5 of 2020) was promulgated by the Governor on April 11, 2020.
This Bill is introduced to replace the aforesaid Ordinance.
