उत्तर प्रदेश साधारण खण्ड अधिनियम 1904 (उत्तर प्रदेश अधिनियम संख्या 1 सन्‌ 1904) की धारा 21 के साथ पठित संयुक्त प्रान्त आबकारी अधिनियम, 1910 (संयुक्त प्रान्त अधिनियम संख्या 4 सन्‌ 1910) की धारा 41 के अधीन शक्तियों का प्रयोग करके, आबकारी आयुक्त, राज्य सरकार की पूर्व स्वीकृति से समय-समय पर यथासंशोधित उत्तर प्रदेश विदेशी मदिरा को बोतलों में भरने की नियमावली, 1969 को संशोधित करने की दृष्टि से निम्नलिखित नियमावली बनाते हैं-

संक्षिप्त नाम और प्रारम्भ-(1) यह नियमावली उत्तर प्रदेश विदेशी मदिरा को बोतलों में भरने की (चौबीसवां

संशोधन) नियमावली, 2020 कही जायेगी।

(2) यह गजट में प्रकाशित किये जाने के दिनांक से प्रवृृत्त होंगे।2 उत्तर प्रदेश असाधारण गजट, 7 अक्टूबर, 2020 ई0 2-नियम-2 का संशोधन-उत्तर प्रदेश विदेशी मदिरा को बोतलों में भरने की नियमावली, 1969 में, जिसे आगे उक्त नियमावली कहा गया है, में नीचे स्तम्भ-1 में दिये गये नियम-2 के स्थान पर स्तम्भ-2 में दिया गया नियम रख दिया जायेगा, अर्थात्‌-

स्तम्भ-1 विद्यमान नियम

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम 2(1) (क) आबकारी आयुक्त द्वारा बोतलों में भरने का लाइसेंस प्रपत्र वि0म0-3 में निम्न को स्वीकृत किया जा सकता है-

2(1) (क) आबकारी आयुक्त द्वारा बोतलों में भरने का लाइसेंस प्रपत्र वि0म0-3 में निम्न को स्वीकृत किया जा सकता है-

[एक] आसवक (डिस्टिलर) को स्प्रिट की बोतल भराई, [एक] आसवक (डिस्टिलर) को स्प्रिट की बोतल

भराई के लिये

[दो] यवासवक (ब्रुअर) को बियर की बोतल भराई, [दो] यवासवक (ब्रुअर) को बियर की बोतल भराई और

के लिये, और

[तीन] द्राक्षासवक (विंन्टनर) को वाइन, की बोतल [तीन] द्राक्षासवक (विंन्टनर) को वाइन की बोतल भराई के लिए और

भराई के लिए, और

[चार] पी0डी-33 लाइसेंस धारण करने वाली ऐसी कम्पनी या इकाई, जिसका न्यूनतम रू0 52 करोड़ का निवेश तथा न्यूनतम 40 के0एल0 प्रतिदिन की क्षमता हो, को रूपया 25 लाख की बैंक प्रत्याभूत सहित शपथ-पत्र द्वारा यह आश्वासन तथा प्रतिबद्धता प्रदान करने पर कि उसे स्प्रिट की बोतल भराई हेतु एफ0एल0-3 लाइसेंस स्वीकृत किये जाने के दिनांक से एक वर्ष के भीतर पेय आसवनी अधिष्ठापित करना होगा, पेय आसवनी स्थापित करने के लिये, यदि कोई इकाई विनिर्दिष्ट अवधि के भीतर पेय आसवनी स्थापित करने में विफल रहती है तो पूर्वोक्त बैंक प्रत्याभूति, आबकारी आयुक्त द्वारा राज्य सरकार के पक्ष में समपहृत कर ली जायेगी और बोतल भराई लाइसेंस, आसवनी प्रवर्तित किये जाने तक निलम्बित अवस्था में रहेेगा।

[चार] पी0डी-33 लाइसेंस धारण करने वाली ऐसी कम्पनी या इकाई, जिसका न्यूनतम रू0 52 करोड़ का निवेश तथा न्यूनतम 40 के0एल0 प्रतिदिन की क्षमता हो, को रूपया 25 लाख की बैंक प्रत्याभूति सहित शपथ-पत्र द्वारा यह आश्वासन तथा प्रतिबद्धता प्रदान करने पर कि उसे स्प्रिट की बोतल भराई हेतु एफ0एल0-3 लाइसेंस स्वीकृत किये जाने के दिनांक से दो वर्ष के भीतर रु0 25 प्रति किलोलीटर स्वीकृत क्षमता के आधार पर जमा करके पेय आसवनी अधिष्ठापित करना होगा। पेय आसवनी स्थापित करने के लिये, यदि कोई इकाई विनिर्दिष्ट अवधि के भीतर पेय आसवनी स्थापित करने में विफल रहती है तो पूर्वोक्त बैंक प्रत्याभूति, आबकारी आयुक्त द्वारा राज्य सरकार के पक्ष में समपहृत कर ली जायेगी और बोतल भराई लाइसेंस, आसवनी प्रवर्तित किये जाने तक निलम्बित अवस्था में रहेेगा।

(ख) प्रपत्र वि0म0-3मेें लाइसेंसधारक, बोतल में भरने

के अपने विषेशाधिकार को पूर्णतः या उसके किसी अंश को-

(ख) प्रपत्र वि0म0-3 मेें लाइसेंसधारक, बोतल में भरने के अपने विषेशाधिकार को पूर्णतः या उसके किसी अंश को-

[एक] उत्तर प्रदेश राज्य के दूसरे आसवक, [एक] उत्तर प्रदेश राज्य के दूसरे आसवक, यवासवक या द्राक्षासवक

यवासवक या द्राक्षासवक

[दो] भारत में दूसरे राज्य या संघ राज्य क्षेत्र के [दो] भारत में दूसरे राज्य या संघ राज्य क्षेत्र किसी आसवक, यवासवक या द्राक्षासवक

के किसी आसवक, यवासवक या द्राक्षासवक [तीन] भारत के राज्य क्षेत्र के बाहर के किसी आसवक, यवासवक या द्राक्षासवक को भारत में उसके पूर्ण स्वामित्वाधीन समनुषंगी इकाई को समनुदेशित कर सकता है।

[तीन] भारत के राज्य क्षेत्र के बाहर के किसी आसवक, यवासवक या द्राक्षासवक को भारत में उसके पूर्ण स्वामित्वाधीन समनुषंगी इकाई को समनुदेशित कर सकता है।

[चार] अन्य राज्य के बोतल भराई संयंत्र का लाइसेंसधारक भी लाइसेंस के लिये अर्ह होगा, परन्तु ऐसे लाइसेंसधारक की बोतल भराई इकाई निम्नलिखित मानदण्डों को पूरा करती हो-

(क) बोतल भराई इकाई की वाषिक कारबार व्यापारावर्त रुपया 100 करोड़ (राजस्व/ आबकारी शुल्क सहित) से कम न हो,

(ख) बोतल भराई इकाई की वार्षिक उत्पादन

क्षमता पांच लाख केसेज से कम न हो,

(ग) बोतल भराई इकाई का कारबार कम से कम 03 राज्यों में हो, जिनमें न्यूनतम एक करोड़ जनसंख्या हो,उत्तर प्रदेश असाधारण गजट, 7 अक्टूबर, 2020 ई0 3 स्तम्भ-1 विद्यमान नियम परन्तु यह कि ऐसा कोई समनुदेशिती इस रूप में किसी अधिकार का तब तक प्रयोग नहीं करेगा जबतक कि वि0म0-3क लाइसेंस के धारक द्वारा दिये गये आवेदन- पत्र पर आबकारी आयुक्त द्वारा उसे प्रपत्र वि0म0-3-क में लाइसेस स्वीकृत न कर दिया गया हो।

(ग) किसी आसवक, यवासवक तथा द्राक्षासवक को बोतल में भरने हेतु प्रपत्र वि0म0-3-क मेें बाटलिंग लाइसेंस आबकारी आयुक्त द्वारा निम्नलिखित शर्तों के अधीन दिया जा सकता है-

स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम परन्तु यह कि ऐसा कोई समनुदेशिती इस रूप में किसी अधिकार का तब तक प्रयोग नहीं करेगा जबतक कि वि0म0-3क लाइसेंस के धारक द्वारा दिये गये आवेदन- पत्र पर आबकारी आयुक्त द्वारा उसे प्रपत्र वि0म0-3-क में लाइसेस स्वीकृत न कर दिया गया हो। (ग) किसी आसवक, यवासवक द्राक्षासवक तथा उक्त नियमावली के नियम संख्या 2(1) क (चार) में विनिर्दिष्ट इकाई को बोतल में भरने हेतु प्रपत्र वि0म0-3-क मेें बाटलिंग लाइसेंस आबकारी आयुक्त द्वारा निम्नलिखित शर्तों के अधीन दिया जा सकता है।

(एक) कोई आसवक, यवासवक या द्राक्षासवक उसके द्वारा बोतल में भरी गई स्प्रिट के लेबिलों पर आबकारी आयुक्त का अनुमोदन प्राप्त करने के उपरान्त अपना ब्राण्ड नाम लिखने का हकदार होगा।

(एक) कोई आसवक, यवासवक द्राक्षासवक या उक्त नियमावली के नियम संख्या 2(1) (क) (चार) में विनिर्दिष्ट इकाई उसके द्वारा बोतल में भरी गई स्प्रिट के लेबिलों पर आबकारी आयुक्त का अनुमोदन प्राप्त करने के उपरान्त अपना ब्राण्ड नाम लिखने का हकदार होगा।

(दो) आबकारी आयुक्त की विशेष अनुज्ञा के अधीन और उसके अनुसार, के सिवाय रंगना, समिश्रण करण (ब्लेडिंग), सुवासित करना या तीव्रतावरोह करना निषिद्ध होगा।

(दो) राज्य सरकार की पूर्व स्वीकृति से आबकारी आयुक्त की विशेष अनुज्ञा के अधीन और उसके अनुसार, के सिवाय रंगना, समिश्रण करण (ब्लेडिंग), सुवासित करना या तीव्रतावरोह करना निषिद्ध होगा।

(2) न्यूनतम रूपये 2,00,000 (रूपये दो लाख) के अधीन रहते हुये, किसी आसवक या द्राक्षासवक की स्थित में स्प्रिट या वाइन या कम तीव्रता के मादक पेयों पर बाटलिंग फीस निम्नलिखित दर पर या समय-समय पर राज्य सरकार के पूर्वानुमोदन से आबकारी आयुक्त द्वारा यथा निर्धारित दरों पर उद्‌गृहीत किया जायेगा।

(क) स्प्रिट या वाइन

(2) न्यूनतम रूपये 2,00,000 (रूपये दो लाख) के अधीन रहते हुये, किसी आसवक या द्राक्षासवक की स्थिति में स्प्रिट या वाइन या कम तीव्रता के मादक पेयों पर बाटलिंग फीस निम्नलिखित दर पर या समय-समय पर राज्य सरकार के पूर्वानुमोदन से आबकारी आयुक्त द्वारा यथा निर्धारित दरों पर उद्‌गृहीत किया जायेगा तथा इसकी अग्रिम वसूली की जायेगी। (क) स्प्रिट या वाइन

6. प्रपत्र विदेशी मदिरा-3 में प्रदान किया गया

प्रत्येक लाइसेंस निम्नलिखित शर्तों के अध्यधीन होगा।

6. प्रपत्र विदेशी मदिरा-3 या विदेशी मदिरा-3क में प्रदान किया गया प्रत्येक लाइसेंस निम्नलिखित शर्तों के अध्यधीन होगा।

(1) लाइसेंसधारी बोतल में भराई कार्य उसी भू- (1) लाइसेंस बोतल में भराई कार्य उसी भू-गृहादि में करेगा जो आसवनी, यवासवनी या द्राक्षासवनी के बाहर बोतल भरने की दशा में जिलाधिकारी द्वारा और आसवनी, यवासवनी या द्राक्षासवनी के अन्दर बोतल भरने की दशा में आबकारी आयुक्त द्वारा पूर्वानुमोदित हों और लाइसेंस पर पृष्ठांकित हों और भू-गृहादि का प्रयोग किसी भी अन्य प्रयोजन के लिए, सिवाय विदेशी मदिरा बोतल में भरने और उसे संग्रह करने के लिये नहीं दिया जायेगा।

गृहादि में करेगा जो आसवनी, यवासवनी या द्राक्षासवनी के बाहर बोतल भरने की दशा में जिलाधिकारी द्वारा और आसवनी, यवासवनी या द्राक्षासवनी के अन्दर बोतल भरने की दशा में आबकारी आयुक्त द्वारा पूर्वानुमोदित हों और लाइसेंस पर पृष्ठांकित हों और भू-गृहादि का प्रयोग किसी भी अन्य प्रयोजन के लिए, सिवाय विदेशी मदिरा बोतल में भरने और उसे संग्रह करने के लिये नहीं दिया जायेगा।

(2) लाइसेंस उक्त भू-गृहादि में यथास्थिति (2) लाइसेंसधारी उक्त भू-गृहादि में यथास्थिति जिलाधिकारी या आबकारी आयुक्त, की पूर्वलिखित जिलाधिकारी या आबकारी आयुक्त, की पूर्वलिखित स्वीकृति के बिना कोई परिवर्तन नहीं करेगा और इस स्वीकृति के बिना कोई परिवर्तन नहीं करेगा और इस प्रकार के सभी परिवर्तन लाइसेंस द्वारा प्रस्तुत नक्शे में प्रकार के सभी परिवर्तन लाइसेंसधारी द्वारा प्रस्तुत नक्शे दिखाये जायेंगे।

(3) बोतल में भराई कार्य इस प्रयोजनार्थ अलग (3) (i) बोतल में भराई कार्य इस प्रयोजनार्थ अलग किये गये, पृथक कक्ष (कक्षों) में किया जायेगा। किये गये, पृथक कक्ष (कक्षों) में किया जायेगा। लाइसेंसधारी मदिरा के संग्रह के लिये भराई कक्ष (कक्षों) लाइसेंसधारी मदिरा के संग्रह के लिये भराई कक्ष (कक्षों) में बोतल भराई की टंकियां स्थापित करेगा। वह भराई में बोतल भराई की टंकियां स्थापित करेगा। वह भराई कक्ष (कक्षों) में छानने, भराई करने या इससे सम्बन्धित कक्ष (कक्षों) में छानने, भराई करने या इससे सम्बन्धित

प्रक्रिया के लिये आवश्यक उपकरण स्थापित करेगा। प्रक्रिया के लिये आवश्यक उपकरण स्थापित करेगा।

(ii) विदेशी मदिरा बाटलिंग प्लान्ट में मदिरा के

आयतन तथा तीव्रता दोनों को मापने हेतु इलेक्ट्रानिक

उपकरणों को लगाना, प्रयोग करना तथा अनुरक्षण

करना।

(क) विदेशी मदिरा बाटलिंग प्लान्ट में कम से कम दो मास फ्‌लोमीटर होंगे, जिसमें एक स्प्रिट या ब्लेण्डेड विदेशी मदिरा की प्राप्ति के लिए होगा और दूसरा वांछित तीव्रता एवं माप की पेय विदेशी मदिरा की बोतल भराई को सुनिश्चत करेगा।

(ख) इन टैंकों में भंडारित किये गये स्प्रिट के स्तर को अभिलिखित किये जाने के लिए समस्त भण्डारण कुण्डों, रिडक्शन और ब्लेण्डिंग कुण्डों तथा बाटलिंग कुण्डों पर राडार आधारित लेबिल ट्रांसमीटर लगाये जायेंगे।उत्तर प्रदेश असाधारण गजट, 7 अक्टूबर, 2020 ई0 7 स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

स्तम्भ-1 विद्यमान नियम

(ग) विदेशी मदिरा बाटलिंग लाइन पर दो

इलेक्ट्रानिक बाटल काउन्टर होंगे, जिसमें पहला

आटोमैटिक फिलिंग यूनिट के ठीक बाद के स्थान पर

लगेगा तथा दूसरा उसी लाइन में सिक्योरिटी कोड

लगाने के स्थान के ठीक बाद लगेगा। सम्बन्धित

आसवनी/बाटलर्स विदेशी मदिरा बाटलिंग प्लान्ट पर

अपनी लागत पर इन बाटलिंग काउन्टरों को लगायेगा

और अनुरक्षित करेगा।

(घ) मास फ्‌लोमीटर, राडार आधारित लेबिल

ट्रांसमीटर, सेंसर आधारित इलेक्ट्रानिक बाटल काउन्टर्स,

अन्य उपकरण/उपस्कर और इन युक्तियों के माध्यम से

मापन किये जाने अभिलिखित किये जाने तथा

पुरालिखित किये जाने हेतु अपेक्षित विनिर्दिष्ट पैरामीटर

स्थापित किये जाने तथा उपयोग किये जाने से सम्बन्धित

तकनीकी विनिर्दिष्टियों एवं मार्गदर्शी सिद्वान्तों का विवरण

आबकारी आयुक्त द्वारा समय-समय पर अधिसूचित

मानक प्रचालन प्रक्रिया में विहित किया जायेगा।

विदेशी मदिरा बाटलिंग प्लान्ट का लाइसेंसधारी

इन इलेक्ट्रानिक उपकरणों तथा अन्य सहायक उपकरणों

के नियमित अनुरक्षण के लिए उत्तरदायी होगा। प्लाप्न्ट

में प्राप्त, वहां से जारी और उनमें अवशिष्ट स्प्रिट की

मात्रा तथा तीव्रता को दर्शाते हुए विदेशी मदिरा बाटलिंग

प्लान्ट का विवरण, आबकारी विभाग के प्रभारी अधिकारी

तथा अधिकारियों को निरन्तर इन उपकरणों से उपलब्ध

होंगे। बाटलिंग प्लान्ट के प्रभारी अधिकारी या निरीक्षण

अधिकारी द्वारा पता किये गये इन उपकरणों में किसी

प्रकार की खराबी को तत्काल शुद्ध किया जायेगा और

इस सम्बन्ध में उप आबकारी आयुक्त को भी सूचित

किया जायेगा। इन उपकरणों के अपने अभिहित मानक

के रूप में होने तक उक्त संयंत्र का संचालन स्थगित

रहेगा।

(ङ) बाटलिंग प्लान्ट का प्रभारी अधिकारी,

आबकारी आयुक्त द्वारा प्राधिकृत किसी प्रख्यापित संस्था

द्वारा वित्तीय वर्ष में एक बार विदेशी मदिरा बाटलिंग

प्लान्ट में प्रयुक्त समस्त मास फ्‌लोमीटर का अंशांकन

निश्चित करेगा और कम से कम तीन वर्ष तक ऐसे

स्तम्भ-1 विद्यमान नियम

(च) बाटलिंग प्लान्ट पर स्प्रिट के पहुॅंचने पर अपनायी जाने वाली

प्रक्रिया- पारेशण के बाटलिंग प्लान्ट पर पहुॅंचने के तत्काल पष्चात प्रभारी

अधिकारी उक्त विदेषी मदिरा को मास फ्‌लोमीटर के माध्यम से प्राप्त करने

हेतु आवष्यक प्रबन्ध करेगा। प्रभारी अधिकारी मास फ्‌लोमीटर द्वारा दर्षाये

गये डाटा से आयातित या परिवहन की गयी विदेषी मदिरा की मात्रा व

तीव्रता को अभिलिखित करेगा। मास फ्‌लोमीटर से लाये गये डाटा की

प्रक्रिया का मार्गदर्षन यथा उल्लिखित एस0ओ0पी0 द्वारा किया जायेगा। वह

पारेशण से आच्छादित पास पर मात्रा और तीव्रता को भी पृश्ठांकित करेगा।

आबकारी सत्यापन प्रमाण-पत्र (ईवीसी) के प्रपत्र में रसीद की प्रविश्टियों

सहित पास की एक प्रति तत्काल पारेशण निर्गत करने वाले अधिकारी को

वापस की जायेगी और प्रविश्टियों सहित दूसरी प्रति प्लान्ट में रखी जायेगी।

(iii) बाटलिंग प्लान्ट में स्प्रिट का भण्डारण- किसी बाटलिंग

प्लान्ट में एक्सट्रा न्यूट्रल अल्कोहल या रिडयूस्ड मदिरा कुण्डों या आबकारी

आयुक्त द्वारा अनुमोदित किन्ही अन्य पात्रों में भण्डारित किया जायेगा।

समस्त भण्डारण कुण्डों और रिडक्षन कुण्डों में टैंकों में रखे गये स्प्रिट के

स्तर को अभिलिखित करने हेतु राडार आधारित लेबल ट्रांसमीटर स्थापित

किया जायेगा और प्राधिकृत अधिकारी द्वारा इस सम्बन्ध में प्रमाणित

अद्यतनकृत लेबल वाल्यूम टेबिल के अनुसार पी.एल.सी. होगा जिसमें बल्क

लीटर में स्प्रिट की मात्रा को प्रदर्षित करने के लिए लेबल ट्रांसमीटर

संलग्न होगा।

बोतलों में भरी गयी मदिरा अलग कक्ष (कक्षों) में रखी जायेगी।

बोतलों में भरी गयी मदिरा अलग कक्ष (कक्षों) में रखी जायेगी। प्रत्येक कक्ष के बाहर एक तख्ती लगायी जायेगी जिस पर कक्ष का प्रयोग किस प्रयोजन के लिए किया जा रहा है, यह बात स्पष्ट रूप से लिखी जायेगी।

(4) प्रतिरक्षा कर्मियों और नागरिकों को आपूर्ति किये जाने के लिये आयातित भारत निर्मित विदेशी मदिरा को बोतल में भरने के एक ही कक्ष में बोतल में भरा जा सकता है। उत्तर प्रदेश में आपूर्ति करने के लिये देशी मदिरा को बोतल में भरने के लिये आबकारी आयुक्त की पूर्वानमुति से बोतल में भरने के ऐसे कक्ष का उपयोग विशेष परिस्थितियों में किया जा सकता हैः-

परन्तु यह कि देशी मदिरा की बोतलों में भराई के समय किसी भी दशा में विदेशी मदिरा की बोतलों में भराई नहीं की जायेगी और प्रतिरक्षा कर्मियों और नागरिकों के लिये भारत निर्मित विदेशी मदिरा की बोतलों में भराई एक साथ नहीं की जायेगी।

(5) प्रतिरक्षा कर्मियों के लिए रियायती उपशुल्क की दर पर दी जाने वाली भारत निर्मित विदेशी रम को केवल कर देय आसवनी में ही बोतलों में ही भराई करने की स्वीकृति दी जायेगी।

स्तम्भ-1 विद्यमान नियम

(6) जब लाइसेंसधारी बोतलों में भराई करना चाहें तब वह सहायक आबकारी आयुक्त को अड़तालिस घन्टे पूर्व उसकी सूचना देगा जिसमें स्पष्ट रूप से बोतल में भराई करने के लिए प्रस्तावित दिन तथा समय का उल्लेख होगा तथा प्रतिबन्ध यह है कि बोतलों में भराई रविवार या सार्वजनिक अवकाश के दिन भी की जा सकती है और अड़तालिस घन्टे का नोटिस देना आवश्यक न होगा, यदि बोतलों की भराई किसी आसवनी, यवासवनी या द्राक्षासवनी में की जाय। सामान्यतः प्रत्येक कार्मिक की ड्‌युटी आठ घन्टे से अधिक नही होगी तथा तीन शिफ्‌ट में प्रातः 06.00 बजे से अपरान्ह 02.00 बजे तक, 02.00 बजे अपरान्ह से रात्रि 10.00 बजे तक तथा रात्रि 10.00 बजे से प्रातः 6.00 बजे तक होगी।

(7) सिवाय आबकारी आयुक्त की विशेष अनुज्ञा के और उसके (7) सिवाय आबकारी आयुक्त की विशेष अनुज्ञा के और उसके अनुसार सम्मिश्रण (ब्लेण्डिंग) या तीव्रतारोह (रिड्‌यूसिंग) का निषेध है। अनुसार सम्मिश्रण (ब्लेण्डिंग) या तीव्रतारोह (रिड्‌यूसिंग) का निषेध है। टिप्पणीः- पद ''ब्लेण्डिंग'' तथा (रिड्‌यूसिंग) का वही अर्थ होगा जो टिप्पणीः- पद ''ब्लेण्डिंग'' तथा (रिड्‌यूसिंग) का वही अर्थ होगा जो आबकारी मैनुअल खण्ड-1 (1962 संस्करण) के पैरा 45 में दिया हुआ है। आबकारी मैनुअल खण्ड-1 (1962 संस्करण) के पैरा 45 में दिया हुआ है। (8) सिवाय आबकारी आयुक्त की विशेष स्वीकृति के और उसके अनुसार विदेशी मदिरा में कोई सुवास पैदा करने वाला या रंगने वाला कोई पदार्थ अथवा कोई भी अन्य पदार्थ मिलाने का निषेध है।

(8) सिवाय आबकारी आयुक्त की विशेष स्वीकृति के और उसके अनुसार विदेशी मदिरा में कोई सुवास पैदा करने वाला या रंगने वाला कोई पदार्थ अथवा कोई भी अन्य पदार्थ मिलाने का निषेध है।

(9) यदि बोतल में भरी गयी स्प्रिट उत्तर प्रदेश में विक्रय के लिये हो तो लाइसेंसधारी ब्रांडी, व्हिस्की या रम की दशा में 42 प्रतिशत अल्कोहल आयतन/आयतन से कम तीव्रताकी तथा ''जिन'' की दशा में 36 प्रतिशत अल्कोहल/आयतन/आयतन से कम तीव्रता की विदेशी मदिरा को बोतल में नहीं भरेगा। उत्तर प्रदेश के बाहर विक्रय के लिए बोतल में भरी गई स्प्रिट ऐसी तीव्रता पर जारी की जायेगी जैसा कि उस राज्य, संघ राज्य क्षेत्र या सम्बन्धित देश के विनियमों द्वारा अपेक्षित हो।

(10) (क) लाइसेंसधारी सिवाय नमूने के अतिरिक्त स्प्रिट व वाइन के लिए 60 मि0ली0 से कम धारिता की बोतल का प्रयोग नहीं करेगा तथा बियर के लिए 300 मि0ली0 से कम धारिता की बोतल का प्रयोग नहीं करेगा।

(ख) उत्तर प्रदेश में बिक्री हेतु आबकारी आयुक्त, उत्तर प्रदेश द्वारा

अनुमोदित धारिता की बोतलों एवं फ्‌लास्काें का ही प्रयोग किया जायेगा।

(ख) उत्तर प्रदेश में बिक्री हेतु आबकारी आयुक्त, उत्तर प्रदेश द्वारा अनुमोदित धारिता की बोतलों एवं फ्‌लास्काें का ही प्रयोग किया जायेगा।

(11) लाइसेंसधारी स्प्रिट, वाइन और बियर को बोतलों/ फ्‌लास्कों/डिब्बों या ऐसी क्षमता वाले किसी अन्य पात्रों में, जैसा कि आबकारी आयुक्त उत्तर प्रदेश द्वारा अनुमोदित किया जाय, भरेगा। (11) लाइसेंसधारी स्प्रिट, वाइन और बियर को बोतलों/ फ्‌लास्कों/डिब्बों या ऐसी क्षमता वाले किसी अन्य पात्रों में, जैसा कि आबकारी आयुक्त उत्तर प्रदेश द्वारा अनुमोदित किया जाय, भरेगा।

(12) बोतलों/फ्‌लास्कों/डिब्बों या अन्य पात्रों पर यथास्थिति अंक और अक्षर स्प्रिट/वाइन/बियर और कम तीव्रता के मादक पेय की मात्रा को मि0ली0 में डाला या बालुकाच्छेपित (सैण्डब्लास्ट) किया जायेगा। (12) बोतलों/फ्‌लास्कों/डिब्बों या अन्य पात्रों पर यथास्थिति अंक और अक्षर स्प्रिट/वाइन/बियर और कम तीव्रता के मादक पेय की मात्रा को मि0ली0 में डाला या बालुकाच्छेपित (सैण्डब्लास्ट) किया जायेगा।10 उत्तर प्रदेश असाधारण गजट, 7 अक्टूबर, 2020 ई0 स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

(13) ग्लास/पेट बोतलों के चेस्ट पर आबकारी आयुक्त द्वारा अधिसूचित समय अनुसूची के अनुसार शब्द ''उत्तर प्रदेश आबकारी'' उभरे हुए रूप में अंकित किये जायेंगे।

(14) लाइसेंसधारी विदेशी मदिरा की भराई के लिए किसी ऐसी बोतल या फ्‌लास्क का प्रयोग नही ंकरेगा जिस पर किसी अन्य भराई करने वाले या किसी अन्य आसवक या यवासवक या द्राक्षासवक का नाम या चिन्ह (मार्क) अंकित हो। तथापि आबकारी आयुक्त लाइसेंसधारी को 06 माह से अनधिक अवधि के लिए सम्बन्धित भराई करने वाले आसवक, यवासवक या द्राक्षासवक की सहमति से ऐसी बोतलों तथा फ्‌लास्क के प्रयोग की अनुमति दे सकते हैं।

(15) रियायती शुल्क की रम की भराई के लिए प्रयुक्त बोतलों पर शब्द ''केवल सेना के लिए'' और यदि इस रम का उत्तर प्रदेश से बाहर निर्यात किया जाना हो तो अक्षर ''सी0एस0डी0'' तथा यदि रम सेवा-क्रय संगठन को दिया जाना हो तो शब्द ''ए0पी0ओ0'' बालुकाच्छेपित (सैण्डब्लास्ट) या उभारे (एम्बास्ड) किये जायेंगे।

(16) (क) अन्य राज्य या संघ राज्य क्षेत्र या अन्य देश को निर्यात की जाने वाली भारत निर्मित विदेशी मदिरा की भराई ऐसे बोतलाें में की जायेगी जिस पर सम्बन्धित राज्य, संघ राज्य क्षेत्र या देश के विनियमों द्वारा अपेक्षित चिन्ह या संकेत हों।

(ख) निर्यात के लिए बोतलों में भरे जाने के निमित्त मदिरा ऐसे आकार की बोतलों में जारी की जा सकती है, जो सम्बन्धित राज्य संघ राज्य क्षेत्र या देश के विनियमों द्वारा अपेक्षित हो।

(17) विदेशी मदिरा की भराई के प्रयोजनार्थ प्रयुक्त की जाने वाली बोतलें पहले पोटेशियम परमैगनेट के घोल से फिर शुद्ध जल से ठीक तरह धोकर साफ की जायेगी।

(18) बोतल भर जाने के बाद तुरन्त उनमे कार्क, कैप्सूल (18) बोतल भर जाने के बाद तुरन्त उनमे कार्क, कैप्सूल तथा लेबिल लगाया जायेगा तथा वह मदिरा भरी हुई बोतलों के संग्रह कक्ष में ले जायी जायेगी। बोतलों में भराई की प्रत्येक प्रक्रिया ''आपरेशन'' की एक विशिष्ट क्रम संख्या दी जायेगी, जिसे बैच नम्बर कहा जायेगा । यह बैच नम्बर लेबिल पर लिखा जायेगा, जिसका डिजिटल रिकार्ड भी अनुरक्षित करते हुए आबकारी विभाग के आनलाइन अभिहित पोर्टल पर प्रस्तुत किया जायेगा।

तथा लेबिल लगाया जायेगा तथा वह मदिरा भरी हुई बोतलों के संग्रह कक्ष में ले जायी जायेगी। बोतलों में भराई की प्रत्येक प्रक्रिया ''आपरेशन'' की एक विशिष्ट क्रम संख्या दी जायेगी, जिसे बैच नम्बर कहा जायेगा । यह बैच नम्बर लेबिल पर लिखा जायेगा, जिसका डिजिटल रिकार्ड भी अनुरक्षित करते हुए आबकारी विभाग के आनलाइन अभिहित पोर्टल पर प्रस्तुत किया जायेगा।

(19) (1) भारत में निर्मित विदेशी मदिरा की दशा में बोतलों पर (19) (1) भारत में निर्मित विदेशी मदिरा की दशा में बोतलों पर चिपकाये गये लेबिलों पर निम्नलिखित बाते स्पष्ट रूप से मुद्रित होंगी- चिपकाये गये लेबिलों पर निम्नलिखित बाते स्पष्ट रूप से मुद्रित होंगी- (क) बोतल में भरी हुई मदिरा का विवरण अर्थात्‌ व्हिस्की, ब्राण्डी, (क) बोतल में भरी हुई मदिरा का विवरण अर्थात्‌ व्हिस्की, ब्राण्डी, रम, जिन आदि।

(3) प्रतिरक्षा कर्मचारियों के प्रयोग के लिए विदेशी मदिरा की बोतलों पर चिपकाए गये लेबिलों पर भी निम्नलिखित संकेत-वाक्य (लीजेंड) मुद्रित किया जायेगा। लेबिल के शीर्ष पर, लाल स्याही में निम्नलिखित संकेत वाक्य-

''केवल प्रतिरक्षा कर्मचारियों को बिक्री के लिए'' लेबिल के ''केवल प्रतिरक्षा कर्मचारियों को बिक्री के लिए'' लेबिल के आर-पार विकर्णवत लाल स्याही में निम्नलिखित संकेत वाक्य- आर-पार विकर्णवत लाल स्याही में निम्नलिखित संकेत वाक्य- ''प्रतिरक्षा कर्मचारियों से भिन्न व्यक्तियों द्वारा रखना पूर्णतः ''प्रतिरक्षा कर्मचारियों से भिन्न व्यक्तियों द्वारा रखना पूर्णतः निषेध है''

(4) किसी अन्य राज्य या संघ राज्य क्षेत्र या अन्य देश को निर्यात के लिए बोतल में भरी गई मदिरा के लेबिल ऐसे आकार (डिजाइन) के होंगे और उस पर ऐसे शब्द अंकित होंगे, जैसा कि उस राज्य, संघ राज्य क्षेत्र या सम्बन्धित देश के विनियमों द्वारा अपेक्षित हो। देश के भीतर अन्य राज्यों को निर्यात किये जाने हेतु लेबिलों पर शब्द ''उत्तर प्रदेश राज्य से बाहर बिक्री हेतुु'' भी अधिमुद्रित किये जायेगें तथा देश के बाहर निर्यात किये जाने हेतु लेबुलों पर शब्द ''केवल समुद्रपार निर्यात हेतु'' अधिमुद्रित किये जायेगें। ऐसे अधिमुद्रण हेतु प्रयुक्त किया जाने वाला प्रकार, नीचे उल्लिखित आकार से कम का नहीं होगा-

(क) 750 एम0एल0 व उससे ऊपर के आकार की बोतलों में	8 एम0एम0 आकार के अक्षरों में
(ख) 375 एम0एल0 व उससे अधिक किन्तु 750 एम0एल0 से कम के आकार की बोतलो ं में	4 एम0एम0 आकार के अक्षरों में
(ग) 180 एम0एल0 व उससे अधिक किन्तु 375 एम0एल0 से कम के आकार की बोतलों में	2 एम0एम0 आकार के अक्षरों में
(घ) 180 एम0एल0 से कम के आकार की बोतलों में	1 एम0एम0 आकार के अक्षरों में
(ख) 375 एम0एल0 व उससे अधिक किन्तु 750 एम0एल0 से कम के आकार की बोतलो में ं	4 एम0एम0 आकार के अक्षरों में
(ग) 180 एम0एल0 व उससे अधिक किन्तु 375 एम0एल0 से कम के आकार की बोतलों में	2 एम0एम0 आकार के अक्षरों में
(घ) 180 एम0एल0 से कम के आकार की बोतलों में	1 एम0एम0 आकार के अक्षरों में

(5) बोतलांें पर लेबिल इस प्रकार चिपकाए जायेंगे, जिससे कि वे सरलता से पहचाने जा सकें। बोतलों पर उभारे गये या बालुकाक्षेपित किसी भी शब्द अक्षर या अंक पर लेबिल नहीं चिपकाया जायेगा।

(5) बोतलांें पर लेबिल इस प्रकार चिपकाए जायेंगे, जिससे कि वे सरलता से पहचाने जा सकें। बोतलों पर उभारे गये या बालुकाक्षेपित किसी भी शब्द अक्षर या अंक पर लेबिल नहीं चिपकाया जायेगा। (6)(क) प्रत्येक वर्ष लेबुल का प्रयोग करने के पूर्व लाइसेंसधारी उसकी ठीक वैसी ही चार प्रतियॉं आबकारी आयुक्त द्वारा समय-समय पर निर्धारित प्रति लेबुल धारितावार प्रतिवर्ष लेबुल अनुमोदन शुल्क जमा करके उसके चालान की मूल प्रति के साथ सहायक आबकारी आयुक्त प्रभारी (आसवनी, यवासवनी व द्रक्षासवनी) को प्रस्तुत करेगा, जो उन्हें आबकारी आयुक्त को उनके अनुमोदनार्थ भेजेंगे। आबकारी आयुक्त या उनके द्वारा अधिकृत कोई अधिकारी, लेबुल को अनुमोदित करेंगे, तो उस पर नम्बर अंकित करेंगे और अपनी शासकीय मुहर लगायेंगे। एक प्रति आबकारी आयुक्त के कार्यालय में अभिलेखार्थ रखी जायेगी तथा शेष तीन प्रतियां सहायक आबकारी आयुक्त प्रभारी (आसवनी, यवासवनी व

(6)(क) प्रत्येक वर्ष लेबुल का प्रयोग करने के पूर्व लाइसेंसधारी उसकी ठीक वैसी ही चार प्रतियॉं आबकारी आयुक्त द्वारा समय-समय पर निर्धारित प्रति लेबुल धारितावार प्रतिवर्ष लेबुल अनुमोदन शुल्क जमा करके उसके चालान की मूल प्रति के साथ सहायक आबकारी आयुक्त प्रभारी (आसवनी, यवासवनी व द्रक्षासवनी) को प्रस्तुत करेगा, जो उन्हें आबकारी आयुक्त को उनके अनुमोदनार्थ भेजेंगे। आबकारी आयुक्त या उनके द्वारा अधिकृत कोई अधिकारी, लेबुल को अनुमोदित करेंगे, तो उस पर नम्बर अंकित करेंगे और अपनी शासकीय मुहर लगायेंगे। एक प्रति आबकारी आयुक्त के कार्यालय में अभिलेखार्थ रखी जायेगी तथा शेष तीन प्रतियां सहायक आबकारी आयुक्त प्रभारी (आसवनी, यवासवनी वउत्तर प्रदेश असाधारण गजट, 7 अक्टूबर, 2020 ई0 13 स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

स्तम्भ-1 विद्यमान नियम

द्राक्षासवनी) को वापस कर दी जायेगी, जो उसकी एक प्रति सम्बन्धित (आसवनी, यवासवनी व द्रक्षासवनी) को दूसरी प्रति प्रभारी निरीक्षक को सूचनार्थ एवं अभिलेखार्थ देगा। तीसरी प्रति अपने कार्यालय में अभिलेखार्थ रखेंगे। लाइसेंसधारी लेबुल के सम्बन्ध में आबकारी आयुक्त द्वारा जारी किये गये निर्देशों का अनुपालन करेगा।

(ख) राज्य सरकार द्वारा यथाविहित शर्तों एवं प्रक्रिया के अधीन (ख) राज्य सरकार द्वारा यथाविहित शर्तों एवं प्रक्रिया के अधीन आगामी वर्ष हेतु लेबिलों का नवीकरण किया जा सकेगा।

आगामी वर्ष हेतु लेबिलों का नवीकरण किया जा सकेगा। (7) राज्य में निर्मित या भराई की गयी विदेशी मदिरा की पेटियों (कार्टन) की सभी छः सतहों (फेस) पर गाढ़े लाल रंग की डेढ़ इंच चौड़ी पट्‌टी पर कम से कम एक इंच आकार के काले रंग के अक्षरों में ''फार सेल इन यूपी'' मुद्रित कराया जायेगा तथा पैक्ड कार्टन पर आबकारी आयुक्त द्वारा अनुमोदित सुरक्षा कोड लगाने के साथ विभिन्न धारिता/तीव्रता/ब्राण्ड/पैकेजिंग टाइप की बोतलों की विनिर्दिष्ट संख्या पैक्ड कार्टन पर अंकित किया जायेगा।

(7) राज्य में निर्मित या भराई की गयी विदेशी मदिरा की पेटियों (कार्टन) की सभी छः सतहों (फेस) पर गाढ़े लाल रंग की डेढ़ इंच चौड़ी पट्‌टी पर कम से कम एक इंच आकार के काले रंग के अक्षरों में ''फार सेल इन यूपी'' मुद्रित कराया जायेगा तथा पैक्ड कार्टन पर आबकारी आयुक्त द्वारा अनुमोदित सुरक्षा कोड लगाने के साथ विभिन्न धारिता/तीव्रता/ब्राण्ड/पैकेजिंग टाइप की बोतलों की विनिर्दिष्ट संख्या पैक्ड कार्टन पर अंकित किया जायेगा।

(20) (1) जब तक कि आबकारी आयुक्त ने अन्यथा स्वीकृति न दी हो, तब तक सभी बोतलें पिल्फर प्रूफ कैप्सूल या क्राउन कार्क सहित अल्मूनियम कैप्सूल द्वारा मजबूती से इस प्रकार सील बन्द की जायेंगी कि कैप्सूल को बिना काटे या तोडे़ बोतल को खोलना सम्भव न हो, विभिन्न प्रकार की मदिरा के लिये प्रयुक्त किये जाने वाले कैप्सूल मानक आकार के होंगे तथा उनके शीर्ष पर लाइसेंसधारी का नाम अंकित होगा। (2) अन्य राज्य, संघ राज्य क्षेत्र या देश को निर्यात की जाने वाली मदिरा की बोतलों पर प्रयुक्त होने वाले कैप्सूल पर ऐसे शब्द अंकित होंगे, जैसा कि आबकारी आयुक्त, उत्तर प्रदेश समय-समय पर निर्देश दें।

(2) अन्य राज्य, संघ राज्य क्षेत्र या देश को निर्यात की जाने वाली मदिरा की बोतलों पर प्रयुक्त होने वाले कैप्सूल पर ऐसे शब्द अंकित होंगे, जैसा कि आबकारी आयुक्त, उत्तर प्रदेश समय-समय पर निर्देश दें। (3) लाइसेंसधारी अनिवार्य रूप से ऐसे कैप्सूल का प्रयोग करेगा, जो ''इण्डियन स्टैण्डर्ड इन्स्ट्‌ीटयूट'' द्वारा अनुमोदित प्रकार (पैटर्न) तथा विनिर्दिष्टयों के अनुरूप हो व कैप्सूल के सम्बन्ध में आबकारी आयुक्त द्वारा समय-समय पर जारी किये गये अनुदेशों का पालन करेगा।

(3) लाइसेंसधारी अनिवार्य रूप से ऐसे कैप्सूल का प्रयोग करेगा, जो ''इण्डियन स्टैण्डर्ड इन्स्ट्‌ीटयूट'' द्वारा अनुमोदित प्रकार (पैटर्न) तथा विनिर्दिष्टयों के अनुरूप हो व कैप्सूल के सम्बन्ध में आबकारी आयुक्त द्वारा समय-समय पर जारी किये गये अनुदेशों का पालन करेगा। (21) लाइसेंसधारी निम्नलिखित रजिस्टरों में लेखा रखेगा-

(21) लाइसेंसधारी निम्नलिखित रजिस्टरों में लेखा रखेगा- (1) प्रपत्र वि0म0 ख-3 में रजिस्टर, जिसमें लाइसेंसधारी बोतल में भरने के लिये प्राप्त तथा जारी की गयी मदिरा की मात्रा, उसका विवरण तथा उसकी तीव्रता दर्ज करेगा।

(1) प्रपत्र वि0म0 ख-3 में रजिस्टर, जिसमें लाइसेंसधारी बोतल में भरने के लिये प्राप्त तथा जारी की गयी मदिरा की मात्रा, उसका विवरण तथा उसकी तीव्रता दर्ज करेगा।

(2) प्रपत्र वि0म0 ख-4 में रजिस्टर, जिसमें लाइसेंसधारी बोतल में (2) प्रपत्र वि0म0 ख-4 में रजिस्टर, जिसमें लाइसेंसधारी बोतल में भराई के लिये की गई प्रक्रिया का विवरण लिखेगा।

(3) प्रपत्र. वि0म0 ख-5 में रजिस्टर, जिसमें लाइसेंसधारी भराई की गई तथा लाइसेंस प्राप्त भू-गृहादि में संग्रह की गयी विदेशी मदिरा की बोतलों का दैनिक लेखा रखेगा।

(4) प्रपत्र वि0म0 ख-6 में खाता बही, जिसमें लाइसेंसधारी लाइसेंस (4) प्रपत्र वि0म0 ख-6 में खाता बही, जिसमें लाइसेंसधारी लाइसेंस प्राप्त भू-गृहादि में सम्पन्न किये गये सभी कार्य की संक्षिप्ति दर्ज करेगा। प्राप्त भू-गृहादि में सम्पन्न किये गये सभी कार्य की संक्षिप्ति दर्ज करेगा।14 उत्तर प्रदेश असाधारण गजट, 7 अक्टूबर, 2020 ई0 स्तम्भ-2 एतद्‌द्वारा प्रतिस्थापित नियम

(5) प्रपत्र वि0म0 ख-7 में रजिस्टर, जिसमें लाइसेंसधारी महीने के अन्त में मदिरा की बल्क (जो बोतल में न भरी गई हो) तथा बोतल में भरी गई मात्रा दर्ज करेगा।

(5) प्रपत्र वि0म0 ख-7 में रजिस्टर, जिसमें लाइसेंसधारी महीने के अन्त में राडार आधारित लेबिल ट्रांसमीटर के माध्यम से पी.एल.सी. द्वारा यथाप्रदर्षित मदिरा की बल्क (जो बोतल में न भरी गई हो) तथा बोतल में भरी गई मात्रा दर्ज करेगा।

(6) प्रपत्र वि0म0 ख-8 में प्राधिकृत अधिकारी द्वारा प्रमाणित (6) प्रपत्र वि0म0 ख-8 में टंकियों का माप रजिस्टर।

कुण्डों की लेबिल वाल्यूम टेबिल

(7) प्रपत्र वि0म0 ख-9 में डिप बुक पुस्तिका।

(7) प्रपत्र वि0म0 ख-9 में कुण्डों की लेबेल वाल्यूम टेबिल (8) ये प्रपत्र डिजिटली भी अनुरक्षित किये जायेंगे तथा आबकारी विभाग के अभिहित पोर्टल पर दैनिक अपलोड किये जायेंगे।

(8) ये प्रपत्र डिजिटली भी अनुरक्षित किये जायेंगे तथा आबकारी विभाग के अभिहित पोर्टल पर दैनिक अपलोड किये जायेंगे। (22) लाइसेंसधारी उत्तर प्रदेश में विक्रय की जाने वाली भारत निर्मित विदेशी मदिरा, बियर, वाइन एवं कम तीव्रता के मादक पेय के प्रत्येक बोतल/मोनोकार्टन, कैन अथवा टेट्रा पैक सहित पैकिंग कार्टन पर जिसमें बोतलाें की संख्या/धारिता/तीव्रता/ ब्राण्ड/ पैकेजिंग का प्रकार अंकित होगा, शुल्क के भुगतान के प्रमाण के रूप में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड भराई के तुरन्त बाद निकासी के पूर्व लगायेगा तथा इस सम्बन्ध में यथानिर्धारित व्यवस्था आसवक/ यवासवक/द्राक्षासवक द्वारा अनिवार्य रूप से सुनिश्चित की जायेगी। यह सभी रिकार्ड डिजिटल भी अनुरक्षित करने के साथ ही विभागीय पोर्टल पर प्रतिदिन अपलोड किये जायेंगे।

(22) लाइसेंसधारी उत्तर प्रदेश में विक्रय की जाने वाली भारत निर्मित विदेशी मदिरा, बियर, वाइन एवं कम तीव्रता के मादक पेय के प्रत्येक बोतल/मोनोकार्टन, कैन अथवा टेट्रा पैक सहित पैकिंग कार्टन पर जिसमें बोतलाें की संख्या/धारिता/तीव्रता/ब्राण्ड/पैकेजिंग का प्रकार अंकित होगा, शुल्क के भुगतान के प्रमाण के रूप में आबकारी विभाग द्वारा अनुमोदित सुरक्षा कोड भराई के तुरन्त बाद निकासी के पूर्व लगायेगा तथा इस सम्बन्ध में यथानिर्धारित व्यवस्था आसवक/ यवासवक/द्राक्षासवक द्वारा अनिवार्य रूप से सुनिश्चित की जायेगी। यह सभी रिकार्ड डिजिटल भी अनुरक्षित करने के साथ ही विभागीय पोर्टल पर प्रतिदिन अपलोड किये जायेंगे।

(23) लाइसेंसधारी उत्तर प्रदेश में विक्रय की जाने वाली भारत निर्मित विदेशी मदिरा, बियर व वाइन के लेबुलों पर अधिकतम फुटकर विक्रय मूल्य इस प्रकार अंकित करेगा जो सरलता से दृष्य हो।

(23) लाइसेंसधारी उत्तर प्रदेश में विक्रय की जाने वाली भारत निर्मित विदेशी मदिरा, बियर व वाइन के लेबुलों पर अधिकतम फुटकर विक्रय मूल्य इस प्रकार अंकित करेगा जो सरलता से दृष्य हो। (24) भराई करने वाली इकाई को सालिडवेस्ट मैनेजमेन्ट रूल्स, 2016 में विहित रिसाइकिलिंग एवं अपशिष्ट प्रबन्धन हेतु ऐसी समस्त व्यवस्था करना होगा।

NOTIFICATION

In exercise of the powers under section 41 of the United Provinces Excise Act, 1910 (U.P. Act no. IV of 1910) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no.1 of 1904), the Excise Commissioner with the previous sanction of the State Government hereby makes the following rules with a view to amending the Uttar Pradesh Bottling of Foreign Liquor Rules, 1969 as amended from time to time:

THE UTTAR PRADESH BOTTLING OF FOREIGN LIQUOR (TWENTY FOURTH

AMENDMENT) RULES, 2020

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Bottling of Foreign Liquor (Twenty Fourth Amendment) Rules, 2020.

(2) They shall come into force with effect from the date of their publication in the Gazette.

2. Amendment of Rule 2–In the Uttar Pradesh Bottling of Foreign Liquor Rules, 1969, hereinafter referred to as the said rules, for rule 2 set out in Column I below, the rule as set out in Column II, shall be substituted, namely:-

(iii) A vintner to bottle wines; and (iv) a company or unit holding PD-33 licence; to establish a potable distillery, having a minimum, investment of Rs. 52 Crore and a minimum capacity of 40 KLPD, on giving an assurance and commitment by an affidavit and supported by Bank Guarantee of Rs. 25 Lakh that it shall install potable distillery within one year from the date of grant of FL-3 licence to bottle spirits. If the unit fails to establish the potable distillery within the specified period, the aforesaid Bank Guarantee shall be forfeited in the favour of the State Government by the Excise Commissioner and the bottling licence shall be held in suspended stage until the distillery is commissioned.

(iv) a company or unit holding PD-33 licence; to establish a potable distillery, having a minimum, investment of Rs. 52 crore and a minimum capacity of 40 KLPD, on giving an assurance and commitment by an affidavit and supported by Bank Guarantee of Rs. 25 Lakh that it shall install potable distillery within two year by depositing Rs. 25/- per Kiloliter of sanctioned capacity from the date of grant of FL-3 licence to bottle spirits. If the unit fails to establish the potable distillery within the specified period, the aforesaid Bank Guarantee shall be forfeited in the favour of the State Government by the Excise Commissioner and the bottling licence shall be held in suspended stage until the distillery is commissioned.

2. Amendment of Rule 6–In the Uttar Pradesh Bottling of Foreign Liquor Rules, 1969, hereinafter referred to as the said rules, for rule-6 set out in column-1 below, the rule as set out in column-2, shall be substituted, namely–

(2) The licensee shall make no alterations in the said premises without the previous approval in writing of the Collector or the Excise Commissioner, as the case may be, and all such alterations shall be shown in the plan filed by him.

(3) Bottling shall be conducted in separate room(s) set apart for the purpose. The licensee shall erect bottling vats in bottling room(s) for storage of liquor. He may setup in the bottling room(s) such apparatus for filtration, bottling and processes connected therewith as may be necessary.

(a) There shall be at least two Mass Flow Meters at a Foreign Liquor bottling plant, one for receipt of spirit or blended Foreign Liquor and the other to ensure bottling of potable Foreign Liquor at desired strength and measure.

(b) There shall be Radar based Level Transmitters to be mounted on all the storage vats, reduction and blending vats and bottling vats to record the level of spirit stored in these tanks.

(c) There shall be two electronic bottle counters at a Foreign Liquor bottling line. The first one shall be installed on the bottling line just after the automatic filling unit and the second one shall also be on the same line just after the affixation of Security Code. Concerned distillers/bottlers shall install and maintain these bottle counters at Foreign Liquor bottling plant at their own cost.

(d) The details of technical specifications and guidelines related to installation and use of Mass Flow Meters, Radar Based Level Transmitters, sensor based electronic bottle counters & other appliances/accessories, and the specified parameters required to be measured, recorded and archived through these devices shall be prescribed in the Standard Operating Procedure (SOP) notified by the Excise Commissioner from time to time. The licensee of a Foreign Liquor bottling plant shall be responsible for regular maintenance of these electronic devices and other allied accessories. Any malfunctioning of these instruments detected by the Officer-in-Charge of the bottling plant or any inspecting officer, shall be corrected forthwith and the Deputy Excise Commissioner shall also be intimated about this. The operation of the plant shall remain suspended till the restoration of these instruments to its designated standard.

(e) The Officer-in-Charge of the bottling plant shall ensure calibration of all the Mass Flow Meters used in the foreign liquor bottling plant once in a financial year by any accredited institution authorized by the Excise Commissioner and preserve the certificate of such calibration for at least three years.

(f) Procedure to be observed on arrival of spirit at the bottling plant- Immediately on arrival of a consignment at the bottling plant the Officer- in-Charge shall make necessary arrangement to receive the said foreign liquor through the Mass Flow Meter. The Officer-in-Charge shall record the volume and strength of foreign liquor, imported or transported, from the data shown by the Mass Flow Meter. The process of fetching data from Mass Flow Meter shall be guided by the SOP as mentioned. He shall also endorse the volume and strength on the Pass, covering the consignment. One copy of the Pass with the entries of receipt in the form of Excise verification certificate (EVC) shall be immediately returned to the officer, who issued the consignment and the other copy with the entries thereon shall be kept in the plant.

(iii) Storage of spirit in bottling plant- Extra Nutral Alcohol or reduced liquor in a bottling plant shall be stored in vats or in any other receptacles approved by the Excise Commissioner. All the storage vats and reduction vats shall be mounted with Radar based Level Transmitter to record the level of spirit in tanks as well and there shall be PLC (Programmable Logic Controller) attached to the level transmitter to display the volume of spirit in Bulk liter in accordance with the updated 'level- volume' table certified by the authorized authority in this regard.

(6) When the licencee wishes to carry on bottling, he shall give to the Assistant Excise Commissioner forty-eight hours prior notice clearly mentioning the days and hours during which bottling is proposed to be done provided that bottling may be done on a Sunday or a public holiday and forty-eight hours notice will not be necessary when bottling is done in a distillery or brewery or vintnery. (14) The licensee shall not use for bottling foreign liquor any bottles bearing the name and trademark of any other bottler or distiller or brewer or vintner. The Excise Commissioner may however, give permission to the holder of licence in Form F.L.-3A. to use bottles bearing the name and trademark of any other bottler, distiller, brewer or vintner.

(15) Bottles used for bottling of concessional rum shall also have sandblasted or embossed on them the words "for troops only" along with the letters "C.S.D." when the rum is meant for export outside Uttar Pradesh and the letter Ä.P.O." when meant for issue to the Army Purchase Organisation.

(16)(a) Indian Made Foreign Liquor which is intended for export to another State or Union territory or other country shall be bottled in bottles having such marks and indications as may be required by the regulations of that State, Union Territory or country.

(b) The liquor bottled for export may be issued in bottles of such sizes as may be required by the regulations of the State, Union Territory or country concerned.

(17) Bottles to be used for the purpose of bottling foreign liquor shall be properly cleaned and washed first with a solution of potassium permanganate and then with pure water.

(18) Immediately after the bottles have been filled up, they shall be corked, capsuled and labelled and removed to the room for storage of bottled liquor. A distinctive serial number to be known as the batch number shall be assigned to each bottling operation and the number shall be noted on the label. A digital record will be maintained also and be submitted online on designated portal of Excise Department daily.

(19)(i) In case of foreign liquor manufactured in India labels affixed to the bottles shall have the following conspicuous print on them:

This will be maintained in digital form also and be submitted online on designated portal of Excise Department daily.

(23) The licensee shall print the maximum retail price on the labels of Indian Made Foreign Liquor, Beer and Wine to be sold in Uttar Pradesh which shall be easily visible.

(24) Bottling unit shall make all such arrangements prescribed in Solid Waste Management Rules, 2016 for recycling and management of solid wastes.
