''भारत का संविधान'' के अनुच्छेद 201 के अधीन राष्ट्रपति महोदय ने कारखाना (उत्तर प्रदेश संशोधन) विधेयक, 2020 जिससे श्रम अनुभाग-3 प्रशासनिक रूप से सम्बन्धित है, पर दिनांक 9 अक्टूबर, 2020 को अनुमति प्रदान की और वह उत्तर प्रदेश अधिनियम संख्या 32 सन् 2020 के रूप में सर्वसाधारण की सूचनार्थ इस अधिसूचना द्वारा प्रकाशित किया जाता है।

कारखाना अधिनियम, 1948 का उत्तर प्रदेश में उसकी प्रवृत्ति के सम्बन्ध में
अग्रतर संशोधन करने के लिये
अधिनियम
भारत गणराज्य के इकहत्तरवें वर्ष में निम्नलिखित अध्यादेश बनाया जाता है :- 1-(1) यह अधिनियम कारखाना (उत्तर प्रदेश संशोधन) अधिनियम, 2020 कहा संक्षिप्त नाम एवं विस्तार
जायेगा।
(2) इसका विस्तार सम्पूर्ण उत्तर प्रदेश राज्य में होगा।2 उत्तर प्रदेश असाधारण गजट, 20 अक्टूबर, 2020 2-कारखाना अधिनियम, 1948 में, धारा 5 के पश्चात् निम्नलिखित धारा बढ़ा दी जायेगी, अर्थात्् :-
लोक हित में छूट प्रदान की श्ािक्त
अधिनियम संख्या 63 सन् 1948 की धारा 5 के पश्चात् धारा 5क का बढ़ाया जाना जहां राज्य सरकार का यह समाधान हो जाता है कि अपेक्षा—त अधिक आर्थिक गतिविधियाँ तथा रोजगार के अवसर सृजित करने के लिये लोकहित में ऐसा करना आवश्यक है वहाँ वह गजट में अधिसूचना द्वारा ऐसे नये कारखाने अथवा नये कारखानों के वर्ग, जो कारखाना (उत्तर प्रदेश संशोधन) अधिनियम, 2020 के प्रारम्भ होने के पश्चात् एक हजार (1000) दिवसों की अवधि के भीतर स्थापित किया गया हो/किये गये हों, तथा जिसमें/जिनमें वाणिज्यिक उत्पादन प्रारम्भ हो गया हो, को अधिनियम के समस्त अथवा किसी उपबंध से सशर्त अथवा बिना किसी शर्त के, ऐसे उत्पादन प्रारम्भ होने के दिनांक से एक हजार (1000) दिवसों की अवधि के लिये छूट प्रदान कर सकती है।

उद्देश्य और कारण
कारखानों में नियोजित कर्मकारों की काम करने की स्थिति, सुरक्षा और कल्याण को विनियमित करने के उद्देश्य से कारखाना अधिनियम, 1948 अधिनियमित किया गया था।
कोविड-19 के बढ़ते प्रसार के कारण उत्तर प्रदेश सहित देश की आर्थिक गतिविधियां बिखर गई हैं और बड़ी संख्या में प्रवासी कर्मकार उत्तर प्रदेश लौट आये, जिसके परिणामस्वरूप व्यापक रूप से बेरोजगारी हो गई। अतएव उद्योगों को बढ़ावा देने और विनिधान को आकर्षित करने और उसके द्वारा रोजगार के अवसरों में वृद्धि किये जाने के उद्देश्य से कारखाना अधिनियम सहित श्रम विधियों के उपबंधों से छूट प्रदान करना आवश्यक समझा गया।
कारखाना अधिनियम, 1948 की धारा 5 में राज्य सरकार को यह अधिकार प्रदान किया गया है कि वह मात्र सार्वजनिक आपात स्थिति में उक्त अधिनियम के उपबंधों से छूट प्रदान करे। कोविड-19 महामारी के विध्वंसकारी आर्थिक समाघात से निपटने के उद्देश्य से राज्य सरकार को अधिकार प्रदान करते हुए कारखाना अधिनियम, 1948 में संशोधन किया जाना अपेक्षित है जिससे कि वह लोकहित में ऐसी छूट प्रदान कर सके।
यह भी अनुभव किया जाता है कि इस प्रकार की छूट, सीमित अवधि के लिए अस्थायी होगी और उन कारखानों को प्रदान की जायेगी जिन्हें स्थापित किया जायेगा और जिनका वाणिज्यिक उत्पादन प्रस्तावित संशोधन के पश्चात् प्रारम्भ किया जायेगा।
तद्नुसार कारखाना (उत्तर प्रदेश संशोधन) विधेयक, 2020 पुरःस्थापित किया जाता है।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the Kaarkhana (Uttar Pradesh Sanshodhan) Adhiniyam, 2020 (Uttar Pradesh Adhiniyam Sankhya 32 of 2020) as passed by the Uttar Pradesh Legislature and assented to by the President on October 9, 2020. The Shram Anubhag-3 is administratively concerned with the said Adhiniyam.
THE FACTORIES (UTTAR PRADESH AMENDMENT) ACT, 2020

AN
ACT
further to amend the Factories Act, 1948 in its application to Uttar Pradesh.
IT IS HEREBY enacted in the Seventy-first Year of the Republic of India as
follows:-
Short title and 1. (1) This Act may be called the Factories (Uttar Pradesh Amendment) Act,
extent
2020.
(2) It shall extend to the whole of the State of Uttar Pradesh.
Insertion of 2. In The Factories Act, 1948 after section 5, the following section shall be
section 5A inserted, namely:-

of the Act no. 63 of 1948 Where the State Government is satisfied that to create more economic
activities and employment opportunities, it is necessary in
the public interest to do so, it may by notification in the
Power to exempt in public interest
Gazette, exempt new factory or class of new factories which are established and
whose commercial production starts within a period of One Thousand (1000)
days after the commencement of Factories (Uttar Pradesh Amendment) Act,
2020, from all or any provisions of the Act conditionally or unconditionally for a
period of One Thousand (1000) days from the date on which such production
starts.

STATEMENT OF OBJECTS AND REASONS
The Factories Act, 1948 was enacted with a view to regulate the working condition, safety, security and welfare of workers employed in factories.
Due to increasing spread of COVID-19 the economic activities of the country including the State of Uttar Pradesh have been shattered and a large number of migrant workers returned to Uttar Pradesh resulting in widespread unemployment. Therefore, in order to give boost to industries, attract investment and thereby increase employment opportunities it is felt necessary to provide relaxation from provisions of labour laws including the Factories Act.
Section 5 of the Factories Act, 1948 empowers the State Government to grant exemption from provisions of the said Act in case of public emergency only. In order to deal with the disruptive economic 4 उत्तर प्रदेश असाधारण गजट, 20 अक्टूबर, 2020 impact of COVID-19 pandemic, and amendment is required in the Factories Act, 1948 empowering State Government to give such exemption in public interest.
It is also felt that such exemption shall be temporary for a limited period and shall be given to those factories which will be established and whose commercial production will be started after the proposed amendment.
Therefore the Factories (Uttar Pradesh Amendment) Bill, 2020 is introduced accordingly.
